December, we received real estate tax assessment values
Property Tax Increasing! Inwhich
reflect an overall increase of 46%. This is only the first
half of the expected increase. The amended bill provided for the increase to be phased in over a period of two years.
We retained a tax attorney to review the information, and filed an appeal with the State Tax Court. After a full review
and discussion with an independent appraiser, it was determined we did not have a good case. The Hawaii County, Maui
County and Oahu City and County have used the same method to value timeshares for twenty years. (The method uses
condo [whole unit] sales to evaluate Timeshares vs. actual Timeshare Sales data).
The effect to maintenance fees based on current tax rates range between 2.2% - 4.9%, depending on the building and
unit size. This represents an increase of $182,500 for the Resort in the 2015/2016 County fiscal year.
Keep in mind that our final tax rates will not be determined until May or June, so there could be an even larger increase
in the taxes we are required to pay. We are working to save in every other area in order to minimize the effect of this
increase on our owners.
Credit Card Transaction Fee
We have heard many concerns from owners and
reviewed this policy once more. In our efforts to
keep costs down for the benefit of all owners, we will
still need to pass this expense on to those who pay
maintenance fees by credit card.
However, the transaction fee will be 2% instead of 4%.
This could be accomplished by accepting only VISA
and MasterCard. Effective immediately, we do not
accept American Express, Discover, Diners, JCB, Debit
or Prepaid cards.
You may opt to pay your maintenance fees with a
cashier’s check, a personal check, an e-bank draft or
a bank draft, thereby avoiding any surcharge.

what we would have expected from the Mahalo Week program, and
they have not consumed staff time or other expenses.
Based on many requests from owners, I reviewed the potential of
an Owner’s discount for such rentals. We obtained rental rates from
comparable resorts on the South Shore and found our rates are
reasonable and even lower. The lowest weekly rate for a one
bedroom garden view is $1,600 and for a two bedroom garden view
is $2,000.

The Alii interior renovations are completed after 43 months! I would
like to Thank everyone for their patience throughout the renovation.
Now with the units complete we are working on addressing the
exterior concerns; walkway carpet replacement, painting of the
railings (hallway & lanai) and a few other items.

We just passed the first year of Banyan renovations with a total
of 21 units complete. At the recent meeting, we obtained approval
to redesign the entertainment center in the Executive Suites. This
will allow for a larger TV in the future.

The Coral Board representatives reviewed and approved to replace
the floor tiles in all units. Though we are only half way through the
life of the tile, we are experiencing lifting and cracking. We learned
that the tile was not set properly. Unfortunately, this company is no
longer in business. And this particular tile is not available as well.
Once the new tiles are received, the schedule will be set and made
available on the resort website.
The previously approved project of window replacement and
bathroom renovation project in Lika Lani has been placed on hold.
The awarded contractor will be relocating to the mainland for
personal reasons and will not be able to take on our project. We are
in the process of obtaining additional proposals for consideration by
the Board of Directors.
Our Solar project continues to be at a standstill as we wait for
County approvals. We will move forward once we obtain these.
If you remember, we eliminated the Mahalo Week Program due to
foreclosing on delinquent accounts sooner. We opted to place our
inventory with the HTSE rental program as they have an established
network with other resorts and companies.
In late November, we placed 144 weeks in the HTSE rental program
for dates ranging between April and October. To date, they have
confirmed 58 weeks with total revenue to the resort of $63,486; an
average of $1,094 per week. If this trend continues and all weeks are
successfully rented we will see approximately $152,500 in revenue.
As we move forward into the year, additional weeks for the last

relocated rocks from the sand to the rock wall, picked up trash and
trimmed the overgrown hedges along the road side. We included
shorelines across our resort and also fronting Prince Kuhio Park.

The Board of Directors and Management Staff met on Monday,
January 26, 2015 at 10:00 am.
New Business

Information Services: (Calvert de Coligny, Chair)
Information Services oversees all the different information and
communication equipment/systems. Anytime you have a problem
please don’t hesitate to contact the Front Desk for assistance.
Located in the Honu Center are the ShakaNet kiosks, where you
are able to print your boarding passes for free. The newsletters are
published three times a year with articles due for the Spring issue by
February 13, 2015. The newsletter is emailed to all owners unless
a black and white hard copy is requested. I encourage you to read
the newsletter as it is very informative and provides updates on
important issues.
In an effort to update our property cameras we installed a fiber optic
cable between Alii and Banyan. The plan to install a fiber optic
cable between Coral and Banyan was scrapped for a more cost
effective solution, a point to point radio connection.

on Wednesday, January 28, 2015, in the Rooftop Center at Lawai
Beach Resort, 5017 Lawai Road, Koloa, Kauai, Hawaii.
Building & Grounds: (Jerry Stewart, Chair)
Concrete Spalling: We discovered our first spalling issue at Alii in
2007; to date we have completed approximately $700,000 in repairs
without any special assessment to owners. Spalling occurs when the
steel reinforcement in the concrete is exposed to moisture
causing it to rust and expand causing the concrete to crack. When
these buildings were built in the 80’s, the building code did not
require as much concrete over the rebar as it does now. We are
working to address four areas on property; Banyan east stairwell,
Alii east stairwell, Alii center stairwell, Alii west stairwell. We will
keep a close eye out for further developments.

Alii Lawn Revitalization: The Alii lawn had many varieties of
grass including weeds. The lawn was divided into 10 zones with the
intent to replant with Seashore Paspalum, a hearty and well-proven
grass. We have just hydro-seeded the largest and final zone fronting
the east side of Alii.

Propane Tank Enclosure - Alii: We are in process of enclosing the
smaller Alii propane tank. We will revitalize the lawn and
landscaping in the area once the enclosure is completed.
Hawaii Timeshare Exchange (HTSE)
Reiko Ayabe (Vacation Counselor): We offer exchanges, rentals,
bonus weeks and last minute specials. You are able to place your
week in the rental program, bank your owner week, book your
exchange week or initiate a search for a specific week up to two
years in advance. We have two locations, here at Lawai Beach
Resort and at the Imperial Hawaii Vacation Club in Waikiki. We are
a full service travel agency. Please contact us toll free at
866-860-4873 for quotes on hotel, car, and airline rates or visit our
website www.htse.net. Our office hours are Monday through Friday
8:00 am to 4:30 pm.
Finance: (Michael Harrow, Chair)
Financials: The Resort financial statements were reviewed at the
Board’s preliminary meeting. Noe will provide the information
further in the meeting.
Capital Fund Update: The reserve funds and pending projects
for each building were reviewed to determine the availability of
funding for upcoming projects. The capital reserve balances will be
provided by Noe later in the meeting.
County Bill 2548 – Real Property Tax: The County of Kauai will
revert to the methodology used 20 years ago because they feel that
timeshare properties are not paying their fair share of taxes. Our
property taxes for 2015-2016 have increased 46% based on the
current rate; that equates to an approximate increase of $76 per
interval. There are also rumors that the County will increase the
tax rate, but the rates will not be confirmed until June. This comes
after our 2015 budgets were approved, so we’re not prepared for a

Mahalo Week Program: This program was started about 20 years
ago to recoup maintenance fees on delinquent weeks which at that
time exceeded 1,000. Over the years this program has been effective
but we have noticed that with the significant drop in delinquencies
this program is more of a burden than a source of revenue. The
foreclosure schedule also affects this program as we will no longer
have any inventory to rent. While weeks are in the foreclosure
process they cannot be rented. Motion: To terminate the Mahalo
Week Program due to lack of inventory as we will be foreclosing
immediately on delinquencies. Yes: 5 (Babcock, Kent,
McCarthy, Shepard, Stewart), No: 0, Abstain: 4 (Blohowiak,
Buck, Harrow, Hipke), Ineligible: 1 (Goeldner). Motion is
passed.
Unfinished Business
TBMA – San Diego, CA October 26-28th: Thomas Babcock and
Edward Kent attended this meeting and found that a lot of people
think very highly of our resort. Members of this particular
organization independently own their timeshare operations. A lot of
members had similar issue facing a legacy resort such as an aging
ownership and appealing to the younger generations. Going to this
meeting gave us some great ideas of what other resorts are doing.
I would like to say that you should be proud of your resort staff.
Some board members from other resorts also own Lawai Beach
Resort and said that they wish their property was as great as Lawai
Beach Resort.
Rental Program: In reviewing our by-laws, we found that we are
prohibited from hosting a rental program. The Association does own
weeks from foreclosures and deed in lieu transactions. While these
weeks are on the market for sale we still need to recoup the
maintenance fee. To become compliant and recoup the maintenance
fees we will list our Association weeks with HTSE. Motion: To
place unsold Association owned inventory with HTSE Rental
Program to recoup maintenance fees and to bring the
Association into compliance as declarations do not allow an
internal rental program. Yes: 5 (Babcock, Kent, McCarthy,
Shepard, Stewart), No: 0, Abstain: 4 (Blohowiak, Buck,
Harrow, Hipke), Ineligible: 1 (Goeldner). Motion is passed.
Credit Card Transaction Fee: At the last Board meeting we
actually passed this operating cost on to the users. We originally
stated it would be a 4% cost to the user, but found that American
Express and Discover doesn’t allow you to surcharge. We will no
longer accept American Express and Discover card. We will accept
Visa and MasterCard which allows a max of 2% surcharge. This
charge is passed on to the users. (MSP: Buck/Kent): To approve
only accepting Visa and MasterCard with a user surcharge of 2%
on maintenance fee payments.
AOAO:
Solar Energy: Alii, Banyan and Coral have new roofs and all
planned solar panels are installed. We are currently waiting for
approval from the County for Phase IV which includes Lika Lani,
Rooftop Center & the Laundry Facility.
FYE Audit 093014: We will review the audits once they are
available.
General Manager’s Report (Noe Hookano)
Property Overview: I would like to apologize for the noise
associated with the major projects throughout the resort. We strive
to do our best to maintain the quality and beauty you have come to
expect. Please visit our website to stay informed on the real
property tax issue, foreclosures and renovation updates.
VFD (Variable Frequency Drives) Pumps: The VFD’s are on
property and installation is pending delivery of miscellaneous parts.
These pumps will allow for significant savings of power during
hours when the pools are closed.
Financials:
October 2014-December 2014
AOAO: Total income is $758,914; total expenses are $789,014;
with a shortfall of $30,100. Capital Reserve balance is $424,232.
TSOA: Total income is $1,396,319; total expenses are $1,392,879;
with a surplus of $3,440. Capital Reserve balances are:
Alii-$278,318; Banyan-$239,663; Coral-$706,668.
Lobby Furniture: The third set is on order and should arrive next
week.
Receivables
The receivable balance as of January 7, 2015 is $591,478
(Alii - $177,171; Banyan - $211,094; Coral - $203,213); compared
to $839,298 in 2014 (41.9% variance).
Building Exterior Painting: We determined that it is not needed at
this time.
Write Offs
(MSP: Harrow/Hipke): To approve total write-offs of $30,720.77
for the AOAO.
(MSP: Harrow/Babcock): To approve total write-offs of
$69,697.45 for the TSOA.
Banyan Pool Tiling: The Banyan pool tiling is complete.
Mahalo Weeks:
As of December 31, 2014 the last 10 weeks were sold. Total Sales:
West Entry Drain: The contractor installed the drain but we were
not satisfied with the quality of the concrete as it was deteriorating.
They did address this issue by replacing the concrete and sealing it
with asphalt top coat.
Pool Towels: The new pool towels were received and are in use.
Hallway Flooring: We continue to obtain proposals.
Pool Umbrellas: The 10 additional pool umbrellas were delivered.
Alii & Banyan pools received 4 additional umbrellas and Coral pool
received 2.

two Lawai Beach Resort weeks from that organization without
having to foreclose on them. The scams evolve over time and we
would like you to be cautious. We are unique as we offer a deed
in lieu program, not a lot of timeshare resorts offer this to their
owners who cannot travel or continue to pay the maintenance
fees.
TSOA:
Sofa Sleeper Mattresses-All: The sofa sleeper mattresses are to be
replaced in all buildings. The purchase will include the mattress
encasements as well. (Alii: MSP: Babcock/McCarthy): To
purchase at a cost not to exceed $17,100. (Banyan: MSP: Hipke/
Kent): To purchase at a cost not to exceed $18,600.
(Coral: MSP: Buck/Harrow): To purchase at a cost not to exceed
$13,800.
Alii:
Renovation Project: The renovation is complete.
AOAO:
Mini Golf Greens: It is time for the mini golf greens to be
replaced. (MSP: Harrow/Hipke): To replace the greens at a cost
not to exceed $15,000 utilizing Lihue Flooring & Drapery.
Banyan:
Renovation Project: The renovation continues on schedule with
19 units complete.
Treadmills: (MSP: Buck/Kent): To replace both treadmills with
Life Fitness treadmills at a cost not to exceed $11,500.
BES Sofa: The sofas in the guest bedroom have been replaced.
Alii Drain Pipe Water Leak: There is a brittle drain pipe that is
leaking and requires replacement. This will involve taking 4 units
out of order to do the repairs. (MSP: Babcock/McCarthy): To
approve repair at a cost not to exceed $10,600 utilizing Cabreira
Plumbing and JD Painting.
Coral:
Closet Mirror Doors: There is 1 unit left to complete.
Telephone Raceways: This project is complete.
Icemaker Waterlines: This project is complete.
Lamp Shades: The lamp shades should arrive at Home Depot next
week.
Entry Doors: We continue to obtain proposals that include changing
the metal door frames to wood with stainless steel hardware.
TSOA:
Banyan
BES Entertainment Center: We would like to remodel the
living room entertainment centers by removing the top half and
installing a counter top matching the kitchen counter top.
(MSP: Blohowiak/Kent): To utilize K Anderson Construction at
a cost not to exceed $4,900
Coral:
Tile Floor: About half way through the life of the Coral tile we
are experiencing cracks and lifting. The grout under the tile is
deteriorating. We found that the tile was not set correctly and the
company that installed this tile is no longer in business.
(MSP: Buck/Harrow): To approve purchase & replacement of
the tile at a cost not to exceed $332,465
New Business
Interval International Club Gold Program: This is a points
program that we would like to offer as another option for owners.
We will have our legal counsel review the contract to ensure we are
in compliance and the Board will discuss it at the May meeting.
RCI Affiliate Newsletter: This is another program that RCI is
offering in addition to their current services. We will have our legal
counsel review this contract and discuss again in May.
Report of Executive Session
There was no Executive Session.
Scams: Please be mindful that there are a lot of scams out there.
Recently, a timeshare rental company called Bruce Blohowiak
saying they were representing the Lika Lani Timeshare Association
which is the “largest association with the largest rental program”.
His wife answered the phone and told the person I have someone
you should speak with and before Bruce got on the phone, he hung
up. If you receive any offers or phone calls that sound suspicious
please send the information to Jeff Olson of Pacific Real Estate
Services (PRES), as he is compiling a list of scams. There is a new
scam we found where they conduct timeshare transfers (fraudulent
transfers). They call you to get you out of your timeshare obligation.
The transactions can cost anywhere from $3,000 to $10,000 and they
do their best to convince you to transfer it to them. They will give
you situations like, your kids won’t want to be responsible for the
debt if you pass away or if you go into foreclosure you will tarnish
your credit score. They try to empathize with you by saying this is
the easiest way out of your timeshare responsibility. This company
will complete the transfer; transfer the deed to another entity, then
never pay the maintenance fee and the week goes into foreclosure.
In the state of Washington the Attorney General has filed charges
against a company that was doing just that. We found out about it in

Property Overview: We are aware of the naupaka hedge west of
Lika Lani that is dying. We will change the soil and keep fertilizing
to help it grow back. If this doesn’t work then we will obtain
proposals to remove the hedge install a fence and plant a jasmine
vine as we did to the front of Lika Lani.

AOAO: Total income is $15,372; total expenses are $15,415;
with a shortfall of $43; Capital Reserve balance is $34,276.
TSOA: Total income is $35,841; total expenses are $36,192;
with a shortfall of $351 Capital Reserve balance is $48,890.
Foreclosures and Liens: A foreclosure auction is scheduled for
Thursday, March 12, 2015 at 10:30 am at the Department of
Accounting & General Services in Puhi.
Unfinished Business
TBMA – San Diego, CA October 26-28th: Thomas Babcock and
Edward Kent attended this meeting and found that a lot of people
think very highly of Lawai Beach Resort. Members of this particular
organization independently own their timeshare operations. A lot of
members had similar issue facing a legacy resort such as an aging
ownership and appealing to the younger generations. Going to this
meeting gave us some great ideas of what other resorts are doing. I
would like to say that you should be proud of your resort staff. Some
board members from other resorts also own Lawai Beach Resort and
said they wish their property was as great as Lawai Beach Resort.
Credit Card Transaction Fee: At the last Board meeting we
actually passed this operating cost on to the users. We originally
stated it would be a 4% cost to the user, but found that American
Express and Discover doesn’t allow you to surcharge. We will no
longer accept American Express and Discover card. We will accept
Visa and MasterCard which allows a max of 2% surcharge. This
charge is passed on to the users. (MSP: de Coligny/Blohowiak):
To approve only accepting Visa and MasterCard with a user surcharge
of 2% on maintenance fee payments.

Solar Energy: Phase IV of the solar project will start as soon as the
permits are approved by the County. The roofing will be replaced with
ARCH 80 (the same as the Lawai Beach Resort buildings) and solar
panels will be installed on the south side roof only, to prevent glare
into the Alii units.
Pool Towels: These were received and are in use.
Window Replacement: The contractor that was approved in
September has withdrawn as he will be relocating to the mainland.
We are obtaining other proposals.
Gutters: This project is approved but on hold for the completion of
the solar project.
Building Exterior Painting: This project is approved but on hold for
the completion of the solar project.

New Business
Interval International Club Gold Program: This is a points program
that we would like to offer as another option for owners. We will have
our legal counsel review the contract to ensure we are in compliance
and the Board will discuss it at the May meeting.
RCI Affiliate Newsletter: This is another program that RCI is
offering in addition to their current services. We will have our legal
counsel review this contract and discuss again in May.
Scams: Please be mindful that there are a lot of scams out there.
Recently, a timeshare rental company called Bruce Blohowiak saying
they were representing the Lika Lani Timeshare Association which
is the “largest association with the largest rental program”. His wife
answered the phone and told the person I have someone you should
speak with and before Bruce got on the phone, he hung up. If you
receive any offers or phone calls that sound suspicious please send the
information to Jeff Olson of Pacific Real Estate Services (PRES), as
he is compiling a list of scams. There is a new scam we found where
they conduct timeshare transfers (fraudulent transfers). They call you
to get you out of your timeshare obligation. The transactions can cost
anywhere from $3,000 to $10,000 and they do their best to convince
you to transfer it to them. They will give you situations like, your kids
won’t want to be responsible for the debt if you pass away or if you go
into foreclosure you will tarnish your credit score. They try to
empathize with you by saying this is the easiest way out of your
timeshare responsibility. This company will complete the transfer;
transfer the deed to another entity, then never pay the maintenance fee
and the week goes into foreclosure. In the state of Washington the
Attorney General has filed charges against a company that was doing
just that. We found out about it in time by going to the TBMA
meeting and Noe was able to recover two Lawai Beach Resort
weeks from that organization without having to foreclose on them.
The scams evolve over time and we would like you to be
cautious. We are unique as we offer a deed in lieu program, not a
lot of timeshare resorts offer this to their owners who cannot travel
or continue to pay the maintenance fees.
FYE 093014 Audits: We will review the audits once they are
available.

Snorkeling at Lawai Beach

The plane has finally landed, the rental car was ready this time, Costco had
everything we needed, and including things we didn’t know we needed! Kaumuali’i
Highway (50) traffic was light this afternoon, and after we passed thru the “Tree
Tunnel” Koloa looked quaint as always.
We then round the traffic circle at Kukui’ula and there it is, with the Banyan
building seeming to have outstretched arms welcoming you home. We walk quickly
to see the view from our lanai, and breathe our first relaxed breath of the next week
or two in paradise. The food is quickly stashed, the Maui chips safely (for the
moment) are set with care on top of the counter, and we quickly unpack, and hurry
to relax.
And then it hits us, fear trembling, panic, and sheer terror, we are going to snorkel
for the first time this week, and our “friends” insist, there is no way out.
OK, let’s stop right there! Snorkeling across the street from LBR is one of the real
treasures in our part of paradise, and with a little help, you can learn the few secrets
of making it one of the most enjoyable experiences on the island.
First, lets start with proper gear. All you really need is a good fitting mask and
quality snorkel. (Modern snorkels are designed to have water bypass the air tube so
you cannot get water in your mouth). Fins are really optional in our little bay, and
if you watch others struggle with those suckers, you’ll get my point. If you have
prescription glasses like me, than consider going to a dive shop near home and have
a mask made with the corrections you need. Plan 2 months ahead for these, and
they can take a while to be custom made, and sent to you. If you come here every
year like a good LBR owner, it will be worth the investment, and we all know that a
spare set of glasses are a good thing to bring, even though you’ll look a little funny
at using your mask to read a menu!
Ok we have a mask, snorkel, room key, outside towel, water bottle (for a refreshing
sip when done) and oh yea something called a “Rash Guard”. This is a top that will
provide ultra sun protection, and since there are no rash germs in the Pacific, the
name seems misleading. A better name might be “a shirt”. Ok, all set. We step on
the beach near the grass by the Bay View restaurant (we’ll call that the east end) and
walk west. FYI, tides are present here, but you will only notice a few feet difference
between high and low tide, so don’t worry about that. As we walk to the west, walk
as far as you can before the sandy beach ends, and a solid rock “bench” starts. If
you look out toward the waves you should see a sand path into the water that invites
you in like a runway to a plane. This is the key to a clumsy free entrance and exit to
our little bay. All other parts of the beach have slippery boulders that remain hidden
by the waves until you step on them, and then it’s good by “grace” and hello Mr./
Mrs. Clumsy.
Ok, we are in the right part of the beach, the mask is on the forehead ready to be put
in place, the snorkel is fastened to the mask band (on the left side) and we’re off!
Remember the part about no fins, watch others, and you can thank me later.
Nothing I can write will help you adjust to the 80-degree weather and the ice cold
water (actually it’s about 77 degrees). So go in slowly and extend the stress, or jump
in and get it over with!
Now relax, breathe, open your eyes and prepare to see a few or a few hundred really
cool colorful looking fish, and if you have lived your life well to this point, you may
see a turtle, the holy grail of snorkeling here, and then you suddenly realize that all
the work, stress, and fear has been wiped away, and you have truly become one with
Lawa’i Beach, and the LBR experience.
And the best part, you can do this all over tomorrow.

The American Cancer Society Relay For Life is a life-changing event that gives everyone in communities
across the globe a chance to celebrate the lives of people who have battled cancer, remember loved ones

Kauai Hospice Concert in the Sky
The Kauai Hospice Annual Concert in the Sky on July 4 at Vidinha Stadium, will again be the largest 1 day event on
Kauai. Over 6,000 people are expected to attend and that of the ticketed attendees, 40% will be visitors from out of state.
The event will provide both visitors and residents with a local style Independence Day celebration with Hawaiian
entertainment by local musicians and halau dancers. This event will be a shining example of the kind of event that public/
private partnerships can achieve. It will provide opportunities for interaction between residents and visitors with a unique
experience as this is the largest aerial fireworks event on Kauai on the 4th of July. Visitors will get to celebrate our national
