Beginner Strings for 3rd Graders
Dear Parents of 3rd Grade Students,
South Brunswick Community Education is offering Before School Beginner Strings instruction for the following
instruments: Violin, Viola, and Cello. The music lessons will be taught by a certifcated music teacher.
This beginner program is divided into two 12 week sessions: September - December and February - May. Below
is the information for the September - December session. You will have the opportunity to end lessons after the 12
weeks or register your child for the February - May session in January.
Classes will meet in the Music Room of the school your child attends. Lessons will not be held when school is closed
or if there is a delayed opening due to inclement weather. Inclement weather make-ups will be scheduled as needed.
Transportation is not provided. Parents must bring their child to the school.
Due to the limited number of spots available – 10 per class, this is offered on a first-come, first-served basis. Registration opens Saturday, September 17 at 9 AM. Registration closes Thursday, September 22 or earlier if all the
spots fill up. Register ASAP to avoid missing out on this great experience! Cost is $75 per student. Beginners Only!
Instrument rental is the responsibility of the parent. As soon as you register, please rent the instrument, so your child
will have it for the first lesson. Rental information is attached, however, you may rent from any company that you
wish. The book that will be used is Essential Elements for Strings with EEi. Please order the book specific to the instrument your child will play. Since your child will be able to register and continue lessons for the February - May
session, remember to explore all rental options to take advantage of the best rental rates. If you have any questions
about renting an instrument, please contact the music teacher at your school.

This is a rent-to-rent Agreement. There are no ownership rights or options for the instrument being rented. Monthly payments after the initial trial period are voluntary and stay the same, varying between $15.00 and $69.99 per month depending upon the instrument being rented. There is no obligation to continue renting after the initial term. Instruments can be returned at any time with no further obligation. Rates advertised are valid from 5/29/16 to 10/31/16. Not all brands are
available at all locations.

TERMS AND CONDITIONS OF RENTAL
National Educational Music Co., Ltd. (“NEMC”), as Lessor, rents the Instrument designated on this Agreement or an instrument received through
an exchange and all accompanying accessories and services, including Exchange Options and service, (collectively “the Instrument”) to the named
Lessee. The Instrument is the property of NEMC and Lessee will not own the Instrument unless Lessee makes all payments necessary to acquire
ownership or exercises the Early Purchase Option.
2. The number of months of the Initial Trial is the term for which the Lessee is obligated beginning on the Date Received shown on other side.
3. Following the Initial Trial the Lessee may (I) continue to rent the Instrument by the month; (II) purchase the Instrument outright by exercising the
Early Purchase Option; or (III) at any time during rental, return the Instrument in good repair, normal wear and tear expected, without further
obligation except for any outstanding amounts which may be due and owing to NEMC at the time of the return. Such return shall terminate this
Agreement. If the Lessee continues to rent the Instrument by the month and pays the Cash Price, the Lessee will then own the Instrument. All
monthly fees are payable in advance and are due on the same day of each successive month. An invoice or payment coupons will be supplied prior
to the expiration of the Initial Trial if the Lessee does not select the Easy Pay option below.
4. If any part of a manufacturer’s expressed warranty covers the Instrument at the time the Lessee acquires ownership of the Instrument, it shall be
transferred to the Lessee, if allowed by the terms of the warranty.
5. Other Fees: A Monthly Payment which is more than 15 days late shall incur a Late Fee of $5.00. The return to NEMC or our Affiliate of any check
as non-collectible shall incur a Return Check Fee of $20.00 or the highest amount allowable by law.
6. Early Purchase Option: At any time after the Initial Payment, the Lessee may acquire ownership of the Instrument by payment to NEMC of all
outstanding amounts which may be due and owing to NEMC at the time the option is exercised plus an amount equal to the difference between the
Cash Price and the total of all Initial and Monthly Rental Payments made by the Lessee up to the time of the exercise of the option. The Early Pur
chase Option amount is subject to sales tax.
7. Maintenance and service necessitated by normal use is included while the instrument is on rental and the account is paid up to date. Coverage for
damage or loss requires the purchase of the optional Damage Waiver. Replacement of expendable accessories, such as cases, strings, reeds,
drum sticks, drum heads, bows, bow hair, rosin, bridges, lubricants, or mouthpieces is not covered.
8. If Lessee selects the optional Damage Waiver, Lessee is entitled to receive damage repairs, and where necessary in NEMC’s judgment,
replacement of the instrument without further cost to Lessee, EXCEPT THAT Lessee will not be relieved of the cost of the repair or replacement of
the instrument in the event that it is damaged due to an intentional or negligent act or omission INCLUDING LOSSES AND CLAIMS DUE TO
MYSTERIOUS DISAPPEARANCES, OR AS THE RESULT OF THE INSTRUMENT BEING MISPLACED OR LEFT UNATTENDED. For payment
of Damage Waiver, NEMC agrees to waive the following claims which might arise against Lessee in the event of the loss of the instrument: (I) The
return of the instrument; (II) The Fair Market Value of the instrument; or (III) The contract balance and taxes, calculated as of the date of the loss
and calculated as if all amounts then due and owing to NEMC immediately prior to the loss had been paid. (In the event of a loss, the Lessee must
provide NEMC with a copy of a police report or fire report within 30 days of loss. A report must specifically list the musical instrument as one of the
items stolen or destroyed. In the event of a theft, a police report will only be accepted if it establishes breaking and entering.) Such waiver does not
relieve the Lessee of liability for payment to NEMC of all amounts due and owing to NEMC immediately prior to the loss. This waiver covers only
the instrument which is the subject of this Agreement. In the event of a loss which is covered by the above waiver, the Lessee may obtain a
replacement instrument of similar or equal brand, age, and condition, as determined by NEMC upon payment to NEMC of a Replacement fee equal
to 20% of the remaining balance due or $100.00, whichever is greater. The Replacement Fee does not apply towards the purchase of the
instrument. Upon payment of the Replacement Fee and receipt of a replacement instrument the terms, conditions, and remaining balance of the
account which is the subject of this Agreement will apply to the replacement instrument.
9. No one other than NEMC or its Affiliates may repair the instrument. Lessee agrees that if the instrument is in need of repair for any reason, Lessee
shall promptly return it for that purpose to the Affiliate from whom it was obtained (or at NEMC’s request, to NEMC, or another Affiliate of NEMC).
10. Lessee agrees to properly care for the instrument at all times. If Lessee desires to return the instrument, Lessee is solely responsible for its return
in good condition, reasonable wear and tear expected, to NEMC’s Affiliate’s premises or to NEMC’s offices in Mountainside, New Jersey, or to such
other location as may be directed in writing by NEMC.
11. Exchange Options: This agreement includes certain exchange options. If the instrument is exchanged without signing a new agreement, Les
see agrees that the terms of this Agreement apply to each exchanged instrument, with the exception of the Cash Price of each instrument. If any
exchanged instrument’s Cash Price is different from the original instrument’s Cash Price, Lessee agrees to have their agreement amended with the
exchanged instrument’s Cash Price. A $20 exchange fee may apply.
12. Lessee agrees that this Agreement is a “Rental-Purchase Agreement” and not an installment sales contract or security-agreement. Lessee also
agrees that this Rental-Purchase Agreement will be treated as a true lease in any Bankruptcy proceeding. This means that if Lessee is involved in a
Bankruptcy proceeding, the Lessee or trustee must either: (I) Return the musical instrument; or (II) Assume the Rental-Purchase Agreement, cure
any past Defaults, and make Rental Payments on an on-going basis.
13. Unless otherwise indicated, the instrument shall be kept at the address of Lessee shown on this Agreement. Lessee agrees to advise NEMC, in
advance and in writing, of any change of Lessee’s address or of the address at which the instrument shall thereafter be kept. Failure to advise
NEMC in advance of any address change shall constitute a material breach of this Agreement.
14. If a default should occur and the Instrument has been returned, the account may be reinstated within 180 Days of the date of return. The account
may be reinstated within 180 Days if 60% or more of the Total Cost has been paid. All amounts due and owing to NEMC, including collection fees,
must be paid before the reinstatement may be made and the Instrument or a similar Instrument, in NEMC’s opinion, is returned to the Lessor.
15. The Initial Rental Payment is not refundable.
16. NOTICE: You are renting this property. You will not own it until you make all of the regularly scheduled payments or you use the early purchase
option. You do not have the right to keep the property if you do not make required payments or do not use the early purchase option. If you miss a
payment, the lessor can repossess the property, but you may have the right to the return of the same or similar property. See the contract for an
explanation of your rights.

ADDITIONAL PAGES, EVEN IF OTHERWISE ADVISED. DO NOT SIGN THIS AGREEMENT IF IT HAS ANY BLANK SPACES. YOU ARE ENTITLED
TO AN EXACT COPY OF ANY AGREEMENT YOU SIGN. YOU HAVE THE RIGHT TO EXERCISE ANY EARLY BUY-OUT OPTION AS PROVIDED IN
THIS AGREEMENT. EXERCISE OF THIS OPTION MAY RESULT IN A REDUCTION OF YOUR TOTAL COST TO ACQUIRE OWNERSHIP UNDER
