TERMS AND CONDITIONS / TOURISTIC EQUIPMENT RENTAL
Introduction
1. The purpose of this document is to lease tourist facilities at the request of the lessee and supplied by CityFollowers Ltd, designated ahead as Lessor.
Lessor
1. The lessor states renting the tourist equipment, required by the lessee, with the purpose for which it is intended and special conditions of the lease in question.
2. All equipment will be delivered in good working conditions.
3. The lessor is not responsible for any direct, indirect
or derivative costs of execution of this agreement and/or
use of the equipment by the lessee.
4. Restored rented equipment, in perfect working order or
paid the amount in case of damage or loss of the material originating from the fault or negligence of the lessee,
the lessor is obliged to return the deposit of 50 euros,
regarding that rental.
Lessee and Additional Drivers
1. The lessee of the device must have a minimum age of
21 years old and have a driving license for category B. In
the case of not being resident in the EU, the lessee or any
additional driver should have international driving license.
2. The lessee is obligated to make payments, according to
the price list at the time of booking (50% of the total) and
upon delivery (the remaining amount).
3. The lessee is obliged to give the equipment a careful
use, according to its characteristics, complying with the
operating instructions and doing the maintenance and
preservation recommended by the lessor or manufacturer.
4. During the lease time period and until the equipment
is returned to the lessor, the lessee is responsible for it,
as well as for any damage that it may suffer or cause as
much in people as in goods, whether it is to his own person or to others.
Delivery and Reception of the Equipment
1. The delivery of the equipment is carried out in an agreed
place between the parties upon the signing of this term of
responsibility, duly recognized, as well as the provision of
personal data of the lessee (Driving License, valid Citizen
Card).
2. The rental of the equipment is mentioned in the particular
conditions of this term, as well as their specications, in a
document specially written for that effect.
3. The lessee acknowledges that at the moment of the delivering the vehicle, this one is in good working order, clean,
equipped with all accessories that it was leased with and
all the ve tires are in good condition, showing no apparent defects and is obliged to return it in good condition and
cleaned under the same conditions in which it was given,
with all documents and accessories it was leased with. In
the event of any loss or damage done, the lessee is obliged
to pay its repair.
4. Deliveries and receptions of leased equipment must be
made during the ofce hours (from monday to Saturday,
from 09:00 AM to 08:00 PM and Sunday, from 11:00 AM to
06:00PM), if made outside the schedule mentioned, a fee
of 15 Euros will be charged. Or in case the distance exceeds more than 20km from the headquarters (Parque das
Nações, Lisbon), a 0,60 Euros per km tax will be charged.
5.The return of the equipment will be in place agreed by the
contracting parties, always in person or through a representative of the rental company.
6. Failure to comply by the lessee of any obligations in
this document causes immediate termination without any
money compensation, giving the lessor the right to take
possession of the leased equipment.
7. Damage, arrangements or other expenses arising
from the lease of the equipment, repair or replacement
of the leased equipment are the responsibility of the
lessee, whether negligent or culpable, that will pay immediately, whether foreseeable or previously dened, or at a later
date by presenting respective budget.
8. The delay in equipment delivery is obliged to pay the
rental, by law, for each day, whole or fraction, the amount of
daily rental price charged at the time of the year when the
delivery was made.
9. If for some reason, such as late delivery bythe previous
lesse, accident, theft, damage, or other situation that makes
the previous reserved equipment unavailable, and the delivery cannot be doneon the scheduled date, the lessor to
returns the entire amount paid previously for the rental
booking. In these situations, the lessor is not entitled to
payments or refunds, in addition to the amount paid for the
reservation of the rental.
10. The vehicle must be returned clean inside (no garbage,
sand, mud or other waste) and abroad, as it was delivered. If
no such conditions a 50 Euros cleaning fee will be charged
according to the amount established for this purpose.
a. Up to 30 days before the check in, does not have any
costs for the lessee;
11. Upon return of the vehicle, the fuel level should not
be less than which had upon delivery. If so, a 50 Euros fee will be charged for the provision of an employee
to perform refueling equipment.
c . Up to 14 days before the check in, the price of the reservation will not be refunded to the lessee.
Equipment Usage
1. You may not make any modications or changes to the
equipment, or install accessories or advertising or commercial endorsements without permission written by the
lessor.
2. The lessor commits not to allow the equipment to be
driven by people who are not identied in this contract or
enclosure of the same, beeing for those responsible, or
otherwise existing agreement of responsibilities between
all individuals who will enjoy this rental duly noted and recorded.
3. The lessee commits not to use or not to allow the use of
the equipment in the following situations:
a. The Transport of goods in violation of customs or tax
regulations or for any other reason such conduct is unlawful;
b. To push or pull any vehicle or trailer;
c. By anyone under the influence of alcohol or other substances not allowed by law;
d. For Passenger in violation of vehicle characteristics,
present in the vehicle documents.
4. The lesse is obliged to close and lock the equipment
properly, and not let inside the documents concerning the
same or any other objects susceptible to cause theft or
damage to the vehicle.
5. The loss or destruction of all or part of the equipment
documentation or keys, are the lessee obligated to indemnify the lessor for damages inherent, including the expenses arising from the issuance of duplicates.
6. The vehicle is delivered with the following equipment:
fridge, heating, two tanks of butane gas, a toilet with “cassette“, a TV, an adjustable satellite antenna, solar panels,
two sets of bed linen, bath towels, 3G mobile broadband
wi-, a Via Verde device (toll) and kitchen accessories. It
is also equipped with a map of Portugal and Spain and a
book with other camping information, two reflective jackets, one spare tire, a warning triangle, a cross key and a
key to the tires.
7. The vehicles are tted with a small instruction manual
for use and operation of the boiler, water, refrigerators, and
other equipment that justied, and should be consulted
whenever necessary.
Repair and Maintenance of Equipment
1. The vehicle is reviewed every four months by external
technicians and certied by mandatory annual inspection
by law. However, for greater security of the lessee and for
the proper functioning of equipment, fuel level and water
level of the the engine should be checked. If the lessee is
aware of the existence of some mechanical problem in the
vehicle, commits to immediately contact the rental company that will tell the lessee how to proceed.
2. If you can not solve any possible problem on site, the
lessee may make repairs at an authorized service by prior written agreement of the store, and in accordance with
the instructions transmitted by this. All expenses recurring
from these repairs are the responsibility of the lessor.
3. If the equipment becomes immobilized due to mechanical breakdown or accident and there is the possibility of
on-site repair, the rental company will send a trailer return
to the site of delivery of the equipment. If this distance is
less than 50 Km the rental company will send other equipment at the site for replacement. If the distance is more
than 50 km, the lessee and the equipment will be transported to the place where will be delivered similar equipment. In case there is no availability other equipment, the
rental company will refund the value of the remaining days
provided for the lease.
Reservations
1. To carry out the booking, the lessee must pay 50 % of
the total value of the service. The booking conrmation is
made upon receipt of the agreed values and communication of conrmation of rental.
2. If the tenant want to make any changes made to the
reservation, contact the lessor, although, these changes
may not be possible due to the availability of services. Any
change must be approved by the rental company.
3.For cancellation of reservations have to be considered
the following conditions:
b. Up to 15 days before the check in, it is refunded to the
lessee 50% of the total amount paid;
4. The minimum rental period is: 2 days in low season, 3
days in mid season and 5 days in high season. If you want
to rent fewer days then will be charged the referent value
the minimum rental days in each of the seasons
5. If the renter wish to extend the rental must inform the rental company with at least 72 hours window before the reantal actual date and obtain a new
contract. That extension will always be subject
to
written
approval
from
the
rental
company.
Payments
1. The vehicle rental has the following xed prices, depending on the selected vehicle, with VAT at the legal rate
included: High Season, 85 or 92 €/day; Mid Season 75 or
82 €/ day; and Low Season 55 or 62 €/day.
2. The lessee commits to pay the amounts resulting from
the celebration of this contract and the rental it self, as
soon as its requested by the lessor:
a. Average price per rental equipment, depending on the
period and time of rental and which includes the mandatory insurance;
b. Any and all charges related to overseas travel insurance,
additional drivers, drivers under 25 years, additional extra
kit´s, and any other charges applicable the rental, in accordance with the additional fees contained in the particular circumstances of this term;
c. All costs incurred by the lessor, collecting payments
owed by the lessee as a result of this term, including lawyer fees, or other fees related to justice issues.
3. The lessee is obliged to refund to the lessor the values
of any nes paid by the lessor or illegal acts committed
during the period rental of equipment or failure to make
payment at tolls, scut’s, parking tickets or trafc nes.
Insurances
1. The leased equipment has an insurance of civil liability
and personal injury under the legislation in force. They also
incorporate traveling assistance and broken windows. To
travel abroad, must be triggerd the additional driver insurance and for drivers under 25 years, there is a additional fee
of 2 Euros per rental, per day .
2. In case of accident , the lessee is obliged to follow these
procedures:
a. Participate to the lessor and to the police any accident,
theft, robbery or any other claims, within 24 hours;
b. Get the names and addresses of those involved and possible witnesses;
c. Do not leave the vehicle without taking adequate measures to protect and safeguard the vehicle;
d. Not assume any responsibility or plead guilty in the case
of accidents, which may involve responsibility for rental;
e. Call in immediately to the rental agency providing with all
the details including accident report issued by the police.
3. In case of accident or theft , with fault or negligence of the
driver, the costs will be allocated to him with the maximum
amount corresponding to the maximum commercial value
of equipment. If for reasons other than the fault or negligence: the driver will be refunded the remaining value of the
lease.
4. Any expense trailer inside or outside the country due to
the misuse of equipment will always be the responsibility
of the lessee.
5. In case of accident due to speeding, negligence, driving
under the influence of alcohol or consumption of any substance that diminishes the capabilities of driving, the lessee
will be responsible for all the repair costs and compensation corresponding to the stoppage of rugged equipment
time, regardless of insurance.
6. The equipment will only be covered by insurance during
the agreed period lease term, unless there is extension of
the contract , section “Extension the Rental”.
Informations and Explanations
1. The lessee recognizes that all the clauses of this document, those expressly communicated in a timely manner
and that it became aware thereof, by signing this document.
2. In the case of derivative litigation or related to the rental
agreement, it is agreed that jurisdiction is the lessee company equipment.

O presente termo é celebrado entre o “Condutor 1” e CityFollowers, Lda., com sede no Parque das Nações, Lisboa, matriculada na Conservatória do Registo
Comercial de Lisboa sob o nº 513 289 364, aqui designada como locadora. São aceites e acordados mutuamente os Termos e Condições Gerais, respeitantes ao aluguer de equipamento turístico, nas datas assinaladas em “Aluguer” no Anexo aos Termos e Condições.
This contract is celebrated between “Condutor 1” and CityFollowers, Lda., with headquarters in Parque das Nações, Lisboa, recognized by the the
Conservatória de Lisboa with the no. 513 289 364, above described as lessee. These terms and conditions are accpeted by each parts of these agreement,
regarding the rental of the turist equipment, in the dates marked in “Aluguer” in this Annex to the Terms and Conditions.
Taxas adicionais caso se apliquem os seguintes casos / Extra fees if:
a. 3€/dia per day: Condutores com menos de 25 anos de idade; Condutores adicionais, mais de um; Deslocações para
fora de Portugal. / Drivers with less than 25 years old; Extra drivers, more than one; Going outside of Portugal.
b. Deslocações para entrega e receção superiores a 20Km da sede (Parque das Nações, Lisboa) 0.60€/quilómetro em
cada deslocação / Deliveries and receptions more than 20Km distance from head office, 0.60€/kilometer for each trip;
c. Entregas e receções fora do horário dos escritórios, 15€ / Deliveries and receptions outside the office business hours, 15€;
d. Receções depois das 14 horas, taxa adicional de meia noite conforme época do ano. / Receptions after 2pm, extra
fee of half night regarding the season of the year;
e. Combustível abaixo do nível registado na entrega, 50€ / Fuel below the level registered in the delivery, 50€;
f. Incumprimento da limpeza mínima exigida, 50€ / Failure to comply with minimum cleaning required, 50€;
