Maude Draper

Maude Baker Draper, who
was a twin born of a twin,
traveled to the Aitkin area at
age four with her family in
a covered wagon. She was
used to a life of work. As
soon as she left home she
worked caring for elderly
people. She married Burrell
Draper, however a few years
later her husband was killed
by accident at work. Maude
was left with two children,
Robert and Franklin and no
money. She took whatever
work she could get and
ended up working for Dr.
Reginald McHugh. It was

The McGregor Police Department, Aitkin County
Sheriff’s Office and the Minnesota State Patrol responded
and investigated. Aided by
several witnesses, the officers
were able to locate a suspect,

Maude was helped and

to have her because, as a
midwife, she handled most
of the birthings and the doc-
tors could get some sleep
at night.
Roger Baker recalls, “My
Aunt Maude always had
babies around. My Mother
Hazel often helped out by
preparing formula and doing all the chores necessary
for infant care. There was
always washing and cleaning. Aunt Maude’s home was
a shotgun house (a long narrow house) on 5th St. NW.
We lived farther down 5th
St. and I always walked by
Maude’s house on the way
home. One day there was a
car parked in front of Aunt
Maude’s house, with both

made it to the hospital in

accepted for the 26th annual Miss Aitkin Scholarship
Pageant. The pageant will
be held during Riverboat
Days on Thur., July 17, 2008
in the Aitkin High School
auditorium at 7 p.m.
Over $2,500 in scholarships
and prizes will be awarded.
The Miss Aitkin Royalty
will serve as an ambassador
for Aitkin at community and
area events for a year. The
contest includes judging of
personal interview, casual
wear, talent, poise and final
question.
Young women who wish to
enter must have completed

Don’t fall for “instant tax refunds”
Some tax preparation companies advertise that they
can get you your tax refund
money within a day from
when you file your return
with them. These ‘instant’ or
‘fast’ tax refunds are actually expensive, high interest
loans.
This practice has cost American taxpayers more than $1
billion dollars each year. It’s
money that could be better
used to pay utility bills, put
food on the table, pay off
debt or put into savings. It
means less of the tax refund
is received by the tax payer.
In the event the IRS denies
or reduces a consumer’s tax
refund, the consumer may
not receive a refund, but will
now owe the refund loan
amount including interest.
Consumers unable to pay
off the loan promptly may
be subjected to debt collection and a damaged credit
rating.
Some consumers obtain the
“refund anticipation loans”
thinking it will take a long
time for the IRS or the Minnesota Department of Revenue to process their return.
Tax returns submitted electronically may have refunds
returned to the consumer
within days. Paper tax returns submitted by mail are
slower.
Don’t have a preparer rush

Tyyne M. Rardin
Tyyne M. Rardin, 90, of Brainerd, died Wed., March 19, 2008
at Bethany Good Samaritan
Village.
Services were held Fri., March
21, 2008, at the Bethany Good
Samaritan Village Chapel in
Brainerd with Pastor Jon Gehrls
officiating. Burial was in the Evergreen Cemetery in
Brainerd.
She was born was born on June 5, 1917, in Aitkin
County, to Samuel and Anna (Koski) Kasari. She married
George Rardin in 1940. She was a bailiff at the Crow
Wing County Courthouse. She was a member of the
Community Covenant Church in Brainerd.
She is survived by her sons and daughters-in-law:
Alan (Nona) Rardin, Palisade; Ron (Judy) Rardin, Brainerd; daughter, Kathleen Ness, Sauk Rapids; brother
and sister-in-law, William (Addie) Kasari, California;
eight grandchildren, eight great-grandchildren and two
great-great-grandchildren.
She was preceded in death by her parents; husband,
George, in 1953; brothers, Arthur and Penton Kasari;
and son-in-law, Keith Ness.
Arrangements are with Halvorson-Johnson Funeral
Home and Cremation Services, Brainerd.
Jessie M. Biedermann
Jessie M. Biedermann, 70, of Crosby, died Fri., March
21, 2008, at Cuyuna Regional Care Center in Crosby.
Memorial services will be held Sat., March 29, 2008, 2
p.m., at Immanuel Lutheran Church in Crosby. Visitation
will be one hour prior to the service at the church.
She was born Sept. 26, 1937, in St. Paul to Herman
and Jessie (Schoenheider) Scheler. She was a former
member of the Myrin-James American Legion Auxiliary
#443, Ironton.
She is survived by her sons and daughters-in-law:
David (Doreen) Biedermann, St. Paul; Thomas (Iris)
Biedermann, Brawley, CA; daughter and son-in-law,
Judy (Tom) Clepper, Sierra Vista, AZ; ex-husband,
Ronald Biedermann, Minneapolis; six grandchildren;
10 great-grandchildren; nieces and nephews.
She was preceded in death by her parents; daughter, Kathleen Biedermann; special friend, Robert Lee;
brother, Herman Scheler; and sister, Elizabeth Evans.
Arrangements were with the Koop Funeral Home
of Crosby.
Roxanna A. Ritter
Roxanna “Roxie” A. Ritter, 97, of Aitkin, died Fri.,
March 21, 2008, at Aitkin Health Services in Aitkin.
Services were held Tue., March 25, 2008, at St. James
Catholic Church in Aitkin with Fr. Paul Fruth officiating.
Burial was in the St. Thomas Cemetery in Aitkin.
She was born March 8, 1911, in Aitkin County, to
Charles and Dora (Elmhurst) Tibbetts. She grew up
and attended country school. She married Amborse
Ritter on Oct. 20, 1929, in Aitkin County. They moved
to Chokio and lived there for a number of years before
returning to Aitkin. Her husband started Ritter Sewer
Service and she kept busy raising the family. In her
later years she worked for the Wild Rice plant in the
packaging division and she had also served as a home
health aide. She was a member of the Moose Lodge,
St. James Catholic Church and the church women’s
council, and the PTA.
She is survived by her daughters and sons-in-law:
Lois (Larry) Fyle, Nisswa; Mary Jo (Bud) Sergent, Pequot Lakes; Wendie (Larry) Bunnell, Aitkin; sons and
daughters-in-law: Ronald (Lin) Ritter, Aitkin; Patrick
(Evelyn) Ritter, Aitkin; 19 grandchildren; seven stepgrandchildren; 44 great-grandchildren; seven greatgreat-grandchildren; and brother, Bob Tibbitts, Aitkin.
She was preceded in death by her parents, husband,
Ambrose, in 1995; two grandchildren; four sisters and
six brothers.

Jennifer L. Curtis
Jennifer L. Curtis, 34, of Aitkin, died Sat., March 22,
2008, at Hospice of Catawba County, Hickory, NC, after
a long battle with breast cancer.
Memorial services will be held Sat., March 29, 2008,
1 p.m., at First Lutheran Church in Aitkin. Visitation will
be one hour prior to the service at the church.
She was born July 16, 1973, in Aitkin to Jerold and
Barbara Johnson. She graduated from Aitkin High
School in 1991. She was employed at Aitkin County
Abstract Company for the past several years. She married Dee Curtis on Aug. 25, 2001, in Malmo.
She is survived by her husband, Dee Curtis, Aitkin;
her parents in Hickory, NC; brother and sister-in-law,
Andy (Tekla) Johnson, Makinen; nieces, nephews,
family and friends.
She was preceded in death by her grandparents:
Claire and Vern Wharton, and Barbara and Enoch
Johnson.
George G. Specht
George G. Specht, 91, of Aitkin, died Sat., March 22,
2008, at Aicota Health Care Center in Aitkin.
Services were held Thur., March 27, 2008, at St.
John’s Lutheran Church in Aitkin with Rev. David Becker
officiating. Burial was in the Spencer Cemetery.
He was born July 8, 1916, in Aitkin to Charles and
Annie (Schwab) Specht. He attended the Cedar Brook
School. In 1945, he married Elsie Hansen. They worked
many long hard years farming on the home place in
Cedar Brook. In his later years he won awards at the
county fair for latch hooking. He was a member of St.
John’s Lutheran Church in Aitkin.
He is survived by Elsie Specht, Aitkin; daughter
and son-in-law, Betty (Joe) Balk, Savage; sister and
brother-in-law, Margaret (John) Martin, Brainerd;
nieces, nephews, relatives and friends.
He was preceded in death by his sisters: Rose Petersen, Mary Petersen, and Kathryn Bergstrom; brothers: John, Carl and Bill Specht; and his parents.

in the journal Pediatrics
suggests parents should
have repeated discussions with their children
about sex, rather than
one “big talk.”
Researchers found that
teens who talked often
with parents about sex
felt closer to mom and
dad and felt more able
to communicate with
their parents in general,
and about sex specifically. Valerie Huber is
with the National Abstinence Education Association.
“You really don’t need
to have a study to show
the results because we
already knew that, that
would be the case. But
it is nice to have empirical evidence that
bolsters the value of
parent-child communication.”
She hopes this can be a
reminder to parents that
their children do listen
to what they have to say
on private matters.
“Study after study has
shown that teens really
want to hear from their
parents and what this
study shows is that it’s
not enough to have ‘the
talk’ but it has to be a
natural part of open
conversation between
parent and child. And
who better to be sex educators of their children
than mom and dad.”
Dr. Den Trumbull with
the American College of
Pediatricians says it’s up
to Christian parents to
give their teens a godly
view of sex. He says
there are plenty of opportunities.
“Whether it’s during a
movie, whether it is a relationship with another
friend that has occurred,
but the parent’s going
to have to be attentive
to opportunities to talk
about sex and talk about
sexual activity with their
adolescent.”
The study found that
moms tend to discuss
sexual topics with the
kids twice as often as
dads.

Sesquicentennial tour: D.J. Knox house and the Knox brothers

Another residence on the tour was the Daniel Jackson
(D.J.) Knox home built circa 1890 on a hill near the Mud
(Ripple) River. Today Gordy and Jeanne Root own the
residence.
D. J. Knox was one of five brothers who came to Aitkin
in the early days of the city’s existence. They all became
merchants, dealing mostly in lumber and supplies and
were the adventurous sons of George and Julia ( Jackson)

residence was built there and later became the Dr. Ratcliffe home. George was a postmaster in Aitkin, superintendent of schools, a state legislator and owner/captain
of the riverboat steamer “Fawn.” Years later, his son, Walter F. Knox, wrote about George
in records at the Aitkin County Historical Society: “Father built a store on property now occupied by the old
National Bank and part of Weisbeck Lumber Co. (Knox
& DeLaittre)…F. M. Shook came with his family from
Devil’s Lake, ND, becoming a member of the firm…Knox
purchased the interests of DeLaittre and Shook, and the
store became G. W. Knox’s.” Walter said the steamboat

he contracted measles, suffered exposure and complications eventually leading to consumption. Clifford went
on expeditions to Nebraska and North Dakota Indian
Territory, spent the winter of 1864-65 with his company
at Fort Union on the Missouri at the North Dakota/

War and married Emily Tenney, a neighbor. When he
returned, almost a year later, his daughter, Emily had
been born.
In 1877, Warren Potter hired Fay Knox to run his store
in Grand Rapids. In 1879 Fay moved his family there.
Soon after he established his own store, including a post
office, in that wilderness community. A second store built
c.1886 housed the family above it. Emily, his first wife,
died in 1881. He later met and married Alice Polley of
Aitkin. However, there was an Indian scare in Grand
Rapids. They moved back to Aitkin, for two years, as
Alice was expecting. “Fay Knox later built and ran a mill in Grand Rapids,”
wrote Rogers. “In addition, he was county supervisor, a
partner in a bank, and an active member of the business
community, attending and contributing to the building
of their Presbyterian Church.
“My grandfather, Harrison [Harry] Rogers, worked in
Aitkin with his brothers, William, Robert & Frank Rogers in the lumber business,” wrote David Rogers. “There

Farm applications
Minnesota families who
have owned their farms for
100 years or more are encouraged to apply for the
Minnesota State Fair’s 2008
Century Farm program.
The Century Farm program recognizes family
farms according to three
qualifications. The farm
must be: 1) at least 100
years old according to authentic land records; 2) in
continuous family ownership for at least 100 years
(continuous residence on
the farm is not required);
and 3) at least 50 acres.
Since its inception in 1976,
a total of 8,694 Minnesota
farms have been designated Century Farms.
A commemorative certificate signed by the president of the State Fair,
the president of the Minnesota Farm Bureau Federation and Governor Tim
Pawlenty will be awarded to qualifying families,
along with an outdoor sign
signifying Century Farm
recognition.

Aitkin Community Hospital was opened in the early
50s and that was the end of
the maternity hospital, however, Maude soon was working in the new hospital.
Richard Draper, one of
Maude’s grandsons remembers, “Police cars would
come to our house in the
middle of the night and
give Grandma a ride to the
hospital where she would
assist as a mid-wife. Maude
provided a great service
to the community and at a
very reasonable price. Most
women stayed five days during which they got home
cooked meals, home made
bread and laundry as well as
physical care for themselves
and the baby.”
In May of 1974 the maternity section of the Aitkin
Hospital was named the
Maude Draper Maternity
Suite. The naming took
place at a special recognition day for Maude.

Data shows ethanol’s savings for consumers
The availability of ethanol
is currently reducing the cost
of gasoline by between 6
and 9 cents per gallon, according to data collected by
the American Coalition for
Ethanol (ACE).
“The growing availability
of ethanol across the United
States is reducing the cost of
gasoline by up to nine cents
a gallon,” said Brian Jennings,
Executive Vice President of
ACE. Without ethanol, gas
prices would likely be even
higher.”
According to recent price
reports by Axxis Petroleum
and the Oil Price Information
Service, ethanol for blending
is selling for as much as 10 to
35 cents lower than gasoline,
depending on the market.
Factoring in the blender’s tax
credit, this means that the
wholesale cost of E10 is between 6 and 9 cents less per
gallon than gasoline.
“The price of gasoline isn’t
rising as quickly as the price
of diesel, partly due to the
fact that there’s an alternative
to gasoline – ethanol – that’s
adding more than 2 million
gallons a day to our nation’s
fuel supply,” noted Ron Lamberty, ACE’s Vice President/
Market Development.
According to today’s AAA
fuel price report, the national average price of diesel
reached $4.029 a gallon, while
the national average price
of gasoline remains at $3.26
for regular and $3.587 for
premium.
Oil companies are taking
note of ethanol’s blending
economics. Last week Marathon Oil Corp. announced that
beginning in May, it will switch
to an all-ethanol product slate
at 16 of its Midwestern terminals, offering only E10 and no
longer offering any unblended
product. ExxonMobil also
announced a similar move,
stating that beginning in May,
the company is eliminating
conventional gasoline at some
of its terminals and moving to
pre-blended E10 instead.
“We are pleased to see the
oil companies recognizing the
value that ethanol brings to
consumers, and having both
Marathon and ExxonMobil
switch to ethanol at several of
their terminals is a significant
step in the right direction,”
Jennings added.
The U.S. now has the capacity to produce 7.9 billion
gallons of ethanol on an an-
nual basis. More than half of
the nation’s gasoline contains
some percentage of ethanol,
most as E10, the 10 percent
ethanol blend approved for
use in all makes and models
of vehicles.

supply of fuel that will relieve
some of the pressures of hundred-dollar oil.

Spring Style Show
The Garrison Lions will
host their annual Spring

Ironton City Council meeting

The Ironton City Council
met Wed, March 19 at the
Ironton City Hall. Present
were: Council Members Bill
Thoms, Bill Wynn, Dean
French and Gerri Altonen.
Also present, Rosemary Caddy, City Clerk-Treasurer.
The minutes of the March
5 City Council meeting were
approved as were the bills.
The Clerk informed the
Council that the City Attorney is working on the following under Old Business:
Three individual houses on
the same water line on Second Street, Pine Street/SEH
Crosby issue, and institution
of a Sidewalk Ordinance in
Ironton.
New Business: There was a
follow-up discussion about
State Fire Codes. The uniform fire code is effective
throughout the State of
Minnesota regardless of
whether a city adopts the
code. Ironton City Council
does not need to adopt
the code in order for it to
be effective within the city
limits. If the city chooses
not to adopt the State Fire
Code, the State Fire Marshall
will be the one to enforce it,
however if the Council opts
to conduct inspections on
the local level, the Fire Marshall will provide assistance
upon request. At this time
inspections are conducted
when a structure is renovated, changes occupancy
or is listed for sale. The City
Council took no action on
this matter.
A brief discussion took
place concerning a letter
from the Initiative Foundation outlining the Foundation’s mission, i.e. to
work through and alongside
Central Minnesota citizens
to create healthy and sustainable communities. The
Foundation requested the
City of Ironton invest in
their community by supporting them through a
donation. No action was
taken on this matter.
A letter from Cuyuna
Range Economic Development, Inc. was reviewed.
Elissa Rogers, Economic
Development Specialist,
inquired about an Ironton
City Council member serving on the CREDI Board of
Directors. Council Member
French indicated he will attend a CREDI meeting in the
near future and report back
to the Council concerning
serving on the Board.
A motion was made and
seconded to close the City
Council meeting and hold a
closed session concerning
union contract negotiations.
After the closed session, the
Council Meeting was reopened and then adjourned
without further business.

meets on the first and third
Wednesday of the month,
6 p.m. at city hall. The
meetings are open to the
public.

This notice concerns applications to the Minnesota Public
Utilities Commission (MPUC) by Enbridge Energy, Limited
Partnership and Enbridge Pipelines (Southern Lights) L.L.C,
(Enbridge) for a Certificate of Need (CON) and Pipeline
Routing Permit (PRP). This notice provides the dates, times
and locations for scheduled public hearings and a description
of the issues to be considered at the public hearings. Any
questions may be directed to the appropriate contact person
identified below.

ISSUES TO BE CONSIDERED
Certificate of Need (CON). The CON proceeding
examines the size, type and timing to determine
whether the proposed pipelines are needed and in
the public interest. The MPUC is authorized by
Minn. Stat. §216B.243, subd. 2, to issue a CON if
Enbridge can demonstrate that there is a need for
the project.
Pipeline Routing Permit (PRP). The PRP
proceeding determines the location of the
pipelines. During this proceeding the impact
that the proposed projects will have on humans
and the environment and methods to minimize
or mitigate those impacts, will be considered. A
PRP designates both where the pipeline may be
built and specifies the conditions for right-ofway preparation, construction, and right-of-way
restoration. The MPUC is authorized by Minn.
Stat. §216G.02 to designate routes where pipelines
may be built and issue PRPs.

Carlton. This line will transport approximately 450,000
barrels per day (bpd) of heavy crude oil from the Canadian
oil sands to Midwest refineries. Enbridge plans to construct
the Alberta Clipper Project in conjunction with the Southern
Lights Diluent Project.

PUBLIC HEARINGS
The Honorable Eric L. Lipman, an Administrative Law Judge
(ALJ) from the Office of Administrative Hearings (OAH),
will hold public hearings on behalf of the MPUC regarding
the CON and PRP proceedings for the Enbridge Projects.
The hearings identified below will address need and routing
issues for all projects for areas south and east of Clearbrook,
Minnesota. Separate Certificate of Need and Pipeline
Routing Permit hearings were held in November 2007 and
January 2008 for the LSr Project and a portion of the Alberta
Clipper Project north and west of Clearbrook in Kittson,
Marshall, Pennington, Red Lake, Polk, and Clearwater
counties.
Any person who would like to comment on the need or
proposed route for the pipeline, or propose a minor location
change or alignment modification within Enbridge’s
REVISED proposed route will have the opportunity to
present evidence, recommendations and comments to the
ALJ at any of the scheduled hearings identified below.
CONDUCT OF HEARING
At the start of each hearing session, the ALJ will explain the
procedural rules for the hearing, including the sequence for
providing testimony and questioning witnesses. Members of
the public will be allowed to participate without the necessity
of intervening as a party. Representation by legal counsel is
permitted but not required. Participation includes: a) offering
direct testimony; b) offering testimony or other material in
written format, or following the hearing; and c) questioning
witnesses.
Any person who wishes to question a witness, but does not
want to ask the questions, may submit questions in writing
to the ALJ, who will then question the witness. Questions
may be submitted during the hearing or may be sent to the
ALJ in advance of the hearing. For more information about

to provide an overview of the CON, PRP and the hearing
processes and describe how the public may participate in
each of them.
Each of the hearings will continue until all persons have
had the opportunity to present evidence and question
witnesses. If needed, the hearing may be recessed
and continued and additional hearing dates may be
established by the ALJ in accordance with Minnesota
Rules Parts 1405.1400 to 1405.2300.
PARTIES
For the certificate of need proceeding, there are three parties:
Enbridge, the Minnesota Department of Commerce OES
and the Minnesota Center for Environmental Advocacy
(MCEA). MCEA and its witnesses will only be participating
in the evidentiary portion of the Certificate of Need hearing
scheduled for May 13 and 14, 2008 in St. Paul at the
MPUC’s Office. Enbridge and MCEA are the only parties to
the PRP proceeding.
PUBLIC COMMENT PERIOD DEADLINES
The public hearing record will remain open following
the hearings until 4:30 p.m. on April 21, 2008, to allow
additional written comments from the public.
OVERVIEW OF ENBRIDGE PIPELINE PROJECTS
Enbridge seeks authorization to build two petroleum
pipelines, shown on the accompanying map. The
proposed projects are intended to increase crude petroleum
transportation capacity between the oil sands in Western
Canada and Midwestern refineries, and are a part of
Enbridge’s system expansion plans in Canada and the
United States.
Alberta Clipper/Southern Lights Diluent Projects
(Docket No. PL9/PPL-07-361): The Alberta Clipper
Project is a 990-mile-long, 36-inch outside diameter crude

Enbridge proposes to construct the Southern Lights
Diluent Project generally along or adjacent to its
existing pipeline right-of-way. When completed,
this new pipeline will begin in the Chicago area
and end at the Enbridge tank farm in Clearbrook,
Minnesota. At Clearbrook, Enbridge will
reverse the flow on one of its existing 18-inch
liquid petroleum pipelines between Clearbrook,
Minnesota and the Canadian border near Neche,
North Dakota. The Southern Lights Diluent Project
will allow Enbridge to transport a byproduct of the
refining process from refineries in the Chicago area
to the oil sands of Alberta, Canada, where it will be
used to dilute the Canadian crude oil to enable it to
flow through a pipeline.
ENBRIDGE’S PROPOSED PIPELINE ROUTE
Chapter 7852 of the Minnesota Rules requires the applicant
to identify a preferred route. A route may have a variable
width from the minimum required for the pipeline right-ofway (approximately 50-75 feet) up to 1.25 miles. Enbridge
initially identified a proposed route of 75 feet generally to the
south side of its existing pipelines. On December 20, 2007,
Enbridge changed its original proposed route to a REVISED
PROPOSED ROUTE of 500 feet in width (minimum),
centered approximately 25 feet south of Enbridge’s existing
southernmost pipeline. The width of the revised proposed
route represents the area in which Enbridge is requesting
to place the pipelines, not the amount of land required to
install the pipelines. Enbridge states it intends to use, follow
or parallel its existing pipelines and rights-of-way where
possible, deviating from its existing right-of-way only where
necessary in congested areas and around pumping stations.
Enbridge has identified a preliminary location alignment
within its REVISED Proposed Route, which is subject to
change throughout the permitting process. In certain
sections of the route, Enbridge has identified areas wider than
500 feet.
Land and Right-Of-Way Requirements. These pipelines
will be placed alongside existing easements/right-of-way in
most areas. When placed in this manner, the pipelines will
require up to 75 feet of additional permanent right-of-way
space next to Enbridge’s existing pipelines. Temporary work
space varying in width from 90 to 140 feet will be required
in addition to the permanent easement to store excavated soil
and pipe sections, move equipment and vehicles, and provide
a safe work area to install the pipelines.

Enbridge has consulted with the Minnesota Department
of Natural Resources (MDNR) regarding state threatened
and endangered species and will apply to the MDNR for a
License to Cross Public Waters. Enbridge will be consulting
with, and applying to, the Minnesota Pollution Control
Agency (MPCA) regarding Section 401 water quality
certifications.

MINNESOTA LAWS AND RULES
GOVERNING PIPELINES
All applicable statutes and rules are on the State of
Minnesota website at:
http://www.leg.state.mn.us/leg/statutes.asp.
Certificate of Need. Under Minn. Stat. §216B.243, subd. 2,
a facility cannot be sited or constructed in Minnesota unless
the MPUC issues a CON to the Applicant. The CON rules
pertinent to this filing are Minnesota Rules, Parts 7853.0010
to 7853.0800.
Pipeline Routing Permit. Under Minn. Stat. §216G.02, the
proposed pipeline facilities cannot be sited or constructed
unless the MPUC issues a PRP to the Applicant. The PRP
application is being reviewed pursuant to Minn. Rules, parts
7852.0800 to 7852.1900.
Eminent Domain. Enbridge will have the authority upon
issuance of a CON and a PRP under Minnesota laws (Minn.
Stat.117.48) to use eminent domain to acquire the rightof-way necessary to construct and operate the proposed
pipelines and associated facilities.
Agricultural Mitigation Plan. Minnesota Statute Section
216E, subd. 3. (b) gives the Department of Agriculture
(DOA) the responsibility for development of the agricultural
mitigation plan required for this project. The DOA may
participate and advise the MPUC as to whether to grant a

GOVERNING PIPELINES
Enbridge has filed other required permit applications with
the U.S. Department of State for a Presidential Permit for
Cross-Border Crossing, the United States Army Corps of
Engineers (USACE) for wetland and waterbody crossing
permits, the U.S. Forest Service for an amended Special Use
Permit. In addition, Enbridge is consulting with the USACE
and State and Tribal Historic Preservation Officers regarding
compliance with Section 106 of the National Historic
Preservation Act, and with the U.S. Fish and Wildlife Service
and the U.S. Forest Service regarding compliance with
Section 7 of the Endangered Species Act.
Presidential Permit for Cross-Border Crossing. The
proposed pipeline project falls under the jurisdiction of the
U.S. Department of State (as designated by Executive Order)
and explained on their website under the Energy Policy,
Pipeline Permits, Non-Agricultural Commodities portion of
the website (http://state.gov/e/eeb/c9982.htm).
Section 404 and Section 10 Authorization. The proposed
projects are subject to jurisdiction by the USACE under
section 404 of the Clean Water Act and section 10 of the
Rivers and Harbors Act. Additional information on these
permit programs is available on the USACE website
(http://www.mvp.usace.army.mil/regulatory/).

The Department of Commerce, Office of Energy Security,
represents the public interest in certificate of need and
other proceedings before the MPUC. The OES provides
two separate and distinct roles with two separate and
distinct staffs. The OES’s Energy Planning and Advocacy
function and staff serve as the state agency charged with
advocating for the public interest in CON proceedings.
The OES’s Energy Facilities Permitting function and
staff serve as the facilitators of the processes required in
route permitting proceedings as well as ensuring that the
route permitting record is complete for the Commission’s
decision.

Recreational ATV use needs to be “sustainably” managed
Recreational ATV use (trail
riding) is one of the fasted
growing uses of public land
in our area. One of the glaring issues regarding recreational ATV use is the fact
that the development of trails
has not kept pace with the
growth and popularity of the
sport; and people are uncertain as to where they can and
cannot ride. The result is an
unacceptable level of damage
on public land due to recreational ATV riding. Currently
the damage is somewhat
isolated but every projection
indicates significant growth
in this sport within the next
decade; which will likely lead
to more widespread impacts
if not adequately managed.
The projected increase in recreational trail riding also has
the potential to be in conflict
with other forest users, including traditional “utilitarian”
ATV users (such as hunters,
trappers, berry pickers, etc.)
that tend to have short-term,
low-impact seasonal use of
public forestlands. Un-managed motorized recreation is
listed by the chief of the US
Forest Service as one of the
top threats to public lands in
the 21st century. In my opinion as a public land manager,
this is not as much of an ATV
trail issue as it is a land-use
issue. We are past the point
of debating the merits of
ATV’s or ATV trails on public
land; that ship sailed long
ago. We need to address this
impending land-use issue and
better manage this growing
recreational use. I believe that
a well-designed, extensive,
well-monitored, “sustainable” trail system is a viable
approach to begin managing
the existing and projected impacts and conflicts regarding
recreational ATV use.
To be considered sustainable, a trail system must meet
the test of economic, environmental, and social impacts
and benefits. Recreational
ATV trail riders deserve a
good place to recreate, but
the use is not appropriate
everywhere. Much of the ATV
damage that occurs is from
irresponsible riders making a
“track” through an unsuitable
area and over time others
follow, assuming it is an official trail. We need to guide
users away from environmentally sensitive areas and
toward areas where they can
provide positive economic
benefits. To many, the face
of a recreational ATV trail
rider is a young guy covered
in mud. I’m optimistically envisioning that this “face” will
gradually change; and much
of the projected increase in
recreational ATV trail riding
will involve families looking
for a new way to enjoy the
outdoors. They will want a
place to go that is legal, safe,
and enjoyable. A sustainable, designated trail system
that links communities via
corridor trails for services
(food, gas, lodging); has loop
trails that allow access to the
forest; and is well mapped,
signed, and monitored; will
be viewed as a destination
by this user-group and create positive economic impacts to our area. Given a
desirable place to ride most
users will do the right thing;
a designated trail system
that captures the increased
growth in recreational ATV
use will reduce potential
environmental impacts resulting from un-managed
off-trail use. Constructing
trails to a high standard from
the start will serve to reduce
long-term maintenance costs.
Guiding recreational ATV use
to a designated trail system
may also serve to reduce
the “gray areas” related to
enforcement.
Perhaps you’ve been following or heard rumors about
the “Aitkin-Itasca 70-Mile trail
project” that was launched in
2007. The Aitkin-Itasca project will be a well-designed,
diverse, sustainable trail system. The ultimate location
and alignment of this trail
project will need to be well
thought out to be sustainable;
so it can’t go just anywhere.
There have been numerous
opportunities for stakeholder
input to help determine potential trail alignments; along
with an ongoing thorough
assessment of potential environmental impacts. Benefits
of the trail system include ad-
equate access/parking areas,
an enforcement and monitoring plan, the linking of small
communities for economic
benefits, maps and promotional materials to guide users
to the trail system (and away
from unsuitable areas), dates
of “recreational” use will be
established to avoid resource
damage and user conflicts,
and it’s extensive enough to
accommodate the increasing
number of users. The AitkinItasca 70-Mile trail project or
any “sustainable” trail system
will not resolve all of the
issues associated with unmanaged ATV use in our area,
but it is a start to proactively
manage a growing land-use
concern.

Up to 20 deaf and hard-ofhearing youth, who will work
with deaf staff and trained
sign language interpreters,
will also be hired.

The Minnesota Conservation Corps was created
in 1981 by the Minnesota
Legislature to do two things
- engage youth and young
adults in enhancing natural
resources and provide opportunities for training and
life skills development.
Summer conservation program
Minnesota youth ages 15
to 18 who are looking for a
unique opportunity to develop and strengthen leadership and camping skills while
understanding and appreciating the natural environment
are encouraged to apply for
the Minnesota Conservation
Corps (MCC) Summer Youth
Program. Applications for 90
positions are being accepted
between now and April 25.
Youth will be based at a
residential program site in
St. Croix State Park for eight
weeks. From this base site,
they will travel in crews led
by staff members to various
state and federal lands to
camp and work on conservation projects.
“Participants can expect to
work hard on projects such
as trail construction, erosion
control, bridge and boardwalk building, and invasive
exotic plant removal,” said
Eric Antonson, MCC youth
programs manager.

development, environmental
topics, education planning,
and leadership and life skills

The incredible Fool’s Hen

In the conifer forests in
the very northern parts of
the state lives one of the
most interesting members
of the grouse family. The
Spruce Grouse is a real
prize to birders. They are
often referred to as “fool’s
hens” do to the fact that they
are very tame and seem to
be totally unafraid of man.
They are usually a solitary
bird and not often seen.
Occasionally they may be
seen in small groups which
are probably families.
The male is a striking bird.
At sixteen inches long, it
is slightly smaller than its
more common cousin the
Ruffed Grouse. It is gray
above with black on the
throat and breast. There are
white stripes on its sides and
a very distinct white stripe
that runs along the side of
the neck from its eyes to its
breast, separating the black
and gray colors. Its blackish
tail is tipped in a chestnut
color. Add to that beautiful
crimson red combs above
each eye and you have one
very striking fellow. The
female is a mottled brown
with black barring and white
spots underneath. She too
has the chestnut color on
the tip of her tail feathers.
All of the male members
of the grouse family put on
spectacular courtship displays and the Spruce Grouse
is no different. He begins his
display in April when there
is still snow on the ground.
He struts around his territory, which may be up to
ten acres in size, with his
tail partly spread, red combs
erect, neck up and throat
feathers slightly ruffed. Every so often, he will stop
and make a short leap into
the air making a whirring of
wings and while in flight,
he will make a sharp wing-
snapping sound by beating
his wings together. He will
land about ten or twelve
feet up in the limb of a
conifer and scan his territory. After a few minutes,
he will start it all over again.
I have had the pleasure of
seeing this display a couple
of times and it is a thing of
beauty. The first time I came
across a displaying male, I
first heard the clap of his
wings. I had a tape of the
low deep call that a male
can make and played it. To
my amazement, he came
strutting out of the spruce
trees and literally walked
right across my feet. With
camera in hand, he was way
too close for my telephoto
lens. I walked back to the
car to inform my friends of
my find and to get a smaller
lens. At very close range,
my friends and I watched
as he flew up, did his wing
clapping and landed in a

branch just above eye level.
He was totally unconcerned
that we were around and did
his display several times. If
you ever get the chance to
observe this ritual, you will
be thoroughly entertained.
They feed on pine needles
and buds, berries, grass
seeds, fern fronds and a few
insects.
Due to their preference
for the heavy conifer forests, they primarily nest in
the very northern part of
Minnesota and while I have
had reports of them being
Young Spruce Grouse
seen in northern Aitkin
County, I have yet to see
one here. They do nest as
far south as Itasca County
and Scenic State Park. The
nest is made by the female
and is well hidden in moss
or dense undergrowth well
back into the conifer forest. The female lays six to
eight eggs whose cinnamon
color is sometimes called
the prettiest in nature. They
are incubated solely by the
female until hatching occurs
24 days later. They are led
away into the pines and at
only one week of age they
are able to make their first
flight attempts. Several years
ago, I came across a family
of Spruce Grouse at Scenic
State Park. The five young
seemed so small and it was
a real surprise when they
flew. But they didn’t fly away
-- they flew up on a branch
less than a foot from my face
and for a while, I thought
they were going to land on
me. I had to back up to take
pictures. What a thrill!
