“THE JEWEL THAT IS CUBA – DISCLAIMER
BOOKING CONDITIONS
YOUR CONTRACT IS WITH The Jewel Event Limited, a company incorporated in England with registered number 05790675 and whose registered office is at 8
Ledbury Mews North, London W11 2AF (referred to herein as “the Company” or “us” or “we”).
1.
APPLICATION PROCESS & YOUR HOLIDAY CONTRACT: To apply for a place on “The Jewel That is CUBA” (“the Tour”), please complete, sign and
date the application form that can be found in the brochure and send it to The Jewel Event Limited, 8 Ledbury Mews North, London W11 2AF.
We will notify you if your application to participate in the Tour has been accepted. Please note that we shall not be liable whatsoever for loss of enjoyment or any other
similar losses or damages if your application is unsuccessful. If your application is accepted, your booking will be subject to these Booking Conditions and a legally
binding contract will exist between the Company and each person that is named on the application form as intending to travel and participate in the Tour. Each person
that has signed the application form warrants, represents and undertakes that he/she has full authority to do so on behalf of all persons whose names appear on the
application form and warrants, represents and undertakes that all such persons are fully aware of and accept these Booking Conditions. Each person that is named on the
application form shall be liable to pay all sums due to us in respect of the Tour on a joint and several basis. THEREFORE, PLEASE ENSURE THAT ALL PERSONS
DETAILED ON THE APPLICATION FORM READ THESE BOOKING CONDITIONS CAREFULLY.
This contract is made on the terms of these Booking Conditions, which are governed by English Law, and the jurisdiction of the English Courts.

TOUR PRICE:
We reserve the right to alter the prices of the Tour shown in the brochure and/or application form. You will be advised of the current prices of the Tour before
your contract is confirmed. The prices will include most meals, hotel accommodation for two people and shipment of your vehicle from the United Kingdom
to the country where the Tour is taking place and back to the United Kingdom. Please note that the following items are not included in the prices (without
limitation): air travel for the participants (unless otherwise specified), incidental and sundry expenses, single room supplement and car marine insurance
(which can be purchased separately by contacting Jay Bullock of Cars Motorsports on +44 (0)1284 850 760).
When you make your booking you must pay the relevant deposit. The balance of the price of your travel arrangements must be paid in accordance with the
payment schedule and payment methods set out in the brochure and/or application form. Time for payment is of the essence of your contract. Accordingly, if
the deposit and/or balance is not paid by the due dates set out in the payment schedule, we shall cancel your application to participate in the Tour. If the
balance is not paid in time we shall retain your deposit and all other sums paid to date.
Changes in transportation costs, including (but not limited to) the cost of fuel, taxes or fees chargeable for services such as landing taxes or embarkation or
disembarkation fees at ports and airports and exchange rates mean that the price of your participation in the Tour may change after your application has been
accepted. However there will be no change within 30 days of your departure. We will absorb and you will not be charged for any increase equivalent to 2% of
the price of your participation in the Tour, which excludes insurance premiums and any amendment charges. You will be charged for the amount over and
above that, plus an administration charge together with an amount to cover agents’ commission. If this means that you have to pay an increase of more than
10% of the price of your participation in the Tour, you will have the option of cancelling and receiving a full refund of all monies paid less appropriate
administration charges, except for any amendment charges. Should you decide to cancel for this reason, you must exercise your right to do so within 14 days
from the issue date printed on your final invoice. Should the price of your holiday go down due to the changes mentioned above by more than 2% of the cost
of your participation in the Tour, then any refund due will be paid to you. However, please note that travel arrangements are not always purchased in local
currency and some apparent changes have no impact on the price of your participation in the Tour due to contractual and other protection in place.
3.
SUBSTITUTION OF PARTICIPANT(S): If any person named on the application form is prevented from travelling it may be possible to transfer the
booking to another suitable person and suitable vehicle (such suitability to be decided at the Company’s absolute discretion) provided that written notice is given a
reasonable length of time prior to departure. An administration fee will be charged plus any additional costs that are imposed on us. If applicable, airlines may impose
100% cancellation charges and the cost of a new ticket. All costs incurred in making the transfer will be the responsibility of the original named participant and the
proposed substituted participant. If we decide that such alternative person and/or vehicle is not suitable or if your request to transfer is not received a reasonable length of
time prior to departure, you will be deemed to have cancelled your booking and the terms of paragraph 4 below shall apply.
4.
IF YOU CANCEL: You, or any other participant named in your application form, may cancel your booking at any time but subject to the remaining
provisions of this paragraph. Written notification from the person who made the application must be received at our offices no less than 3 months prior to the start date
of the Tour. If your notice is received by us less than 3 months prior to the start date of the Tour, then we reserve the right to retain all sums that you have paid to us. If
your notice is received by us 3 months or more prior to the start date of the Tour, then you will be entitled to receive a refund of all sums that you have paid to us but less
such cancellation charges that we consider to be reasonable and appropriate in all the circumstances. In general, the more notice that you give to us the more money that
you will be refunded. Notwithstanding the foregoing, since all accommodation for the Tour participants is booked on a “group basis”, in the event of your cancellation, a
hotel’s standard cancellation policy may not apply. In addition and if applicable, many air tickets have no refund value whatsoever and, therefore, airlines may impose
100% cancellation charges. Note: As mentioned at paragraph 8 below, we strongly recommend that you take out an appropriate insurance policy as soon as your
application to participate in the Tour is accepted by us and, accordingly, if the reason for your cancellation is covered under the terms of such an insurance policy, you
may be able to reclaim from the insurer all or some of the sums that you have paid to us and/or the relevant airline in connection with your participation in the Tour.
5.
IF WE CHANGE OR CANCEL THE TOUR: Our aim is to operate the Tour in accordance with the brochure but since we do plan the Tour many months in
advance we may have to make changes and we reserve the right to do so at any time. Most of these changes will be minor and we will advise you of them at the earliest
possible date. We also reserve the right in any circumstances to cancel your participation in the Tour or indeed to cancel the Tour itself; for example (but without
limitation), if the minimum number of participants required for the Tour is not reached, we may have to cancel it. However, we will not cancel your application to
participate in the Tour or the Tour itself less than 4 weeks before your departure date, except for reasons of “force majeure” (see below) or failure by you to pay the final
balance. If we have to cancel your participation in the Tour or the Tour itself, you can either receive a full refund of all the monies that you have paid less appropriate
administration costs or accept an offer to participate in any other tour organised by us (and we will refund any price difference if the alternative tour is of a lower value).
If we make a major change to the Tour, we will inform you as soon as reasonably possible if there is time before your departure. You will have the choice of either
accepting the change of arrangements, accepting an offer of your participation in any other tour organised by us (we will refund any price difference if the alternative is
of a lower value), or cancelling your participation and receiving a full refund of all monies paid less appropriate administration costs.
“Force Majeure” means unusual or unforeseeable circumstances beyond our control. These can include, for example (but without limitation), war, riot, industrial dispute,
terrorist activity and its consequences, natural or nuclear disaster, fire, adverse weather conditions.
6.
OUR LIABILITY TO YOU: Our liability, except in cases involving death, injury or illness, shall be limited to a maximum of the total cost of the price that
you have paid to participate in the Tour. Our liability will also be limited in accordance with and/or in an identical manner to:
(a)
the contractual terms of the companies that provide the transportation for you and your car. These terms are incorporated into this contract; and
(b)
any relevant international convention, for example the Montreal Convention in respect of travel by air and the Paris Convention in respect of the
provision of accommodation, which limit the amount of compensation that you can claim for death, injury, delay to passengers and loss, damage and delay to
luggage. We are to be regarded as having all benefit of any limitation of compensation contained in these or any other applicable conventions from time to
time.
7.
PASSPORT, VISA & IMMIGRATION REQUIREMENTS AND RECOMMENDED VACCINATIONS & MEDICATIONS: Your specific passport and
visa requirements, and other immigration requirements, are your sole responsibility and you must identify any specific immigration requirements. We do not accept any
responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements. You must also identify and obtain all
recommended vaccinations and take all recommended medications for the country where the Tour is taking place. We do not accept any responsibility if you fall ill or
die or suffer any loss as a result of your failure to obtain such vaccinations and/or take all such medications.
8.
TRAVEL, HEALTH & OTHER INSURANCE: You are advised to take out suitable travel and health insurance in order to take part in the Tour both for
yourself and for your vehicle. You are wholly responsible for arranging your own insurance. We strongly advise you to take out marine and additional road risk
insurance which can be provided by Cars Motorsport (see contact details at paragraph 2(a) above). This cannot be taken up once you have left the UK. We recommend
that such additional insurance is taken out and we take no responsibility for any accident or event that may occur to you or your vehicle, in transit or at the destination.
9.
LOCAL LAWS & BEHAVIOUR: All participants in the Tour are expected to obey the laws and regulations of the countries visited and behave in a
responsible manner at all times so as not to cause offence or danger to any other person or property. Any failure to do so will relieve us of all obligations that we may
otherwise have under this contract.
10.
OUR RESPONSIBILITIES: Given the nature of the Tour there is an element of potential risk and exposure to potential hazards whilst travelling between
locations. All applications are accepted on the understanding that you appreciate such risks and hazards and that you undertake the Tour at your own volition. If you
participate in an activity not included as part of the Tour itinerary, you accept all responsibility for taking part in such an activity and indemnify us against any and all
claims related to such an activity. You accept all responsibility for taking part in the Tour and we exclude, to the fullest extent permitted by law, any responsibility or
liability for any part of the Tour, including (but not limited to) the acts or omissions of any sub-contractors, agents, suppliers, consultants or personnel used or engaged in
the Tour. This is a comprehensive exclusion of liability that applies to all damages of any kind, including (but not limited to) compensatory, direct, indirect or
consequential damage, loss of income or profit, loss of or damage to property and claims of third parties. However, were you to suffer death, personal injury or any
other loss whatsoever as a result of an activity forming part of the Tour, we shall only accept responsibility if the death, personal injury or loss was caused by the
negligent acts and/or omissions of our employees, officers, agents, suppliers or sub-contractors but we shall not be so liable if there has been no fault on the part of us or
our employees, officers, agents, suppliers or sub-contractors, or if the cause was the fault of you (including, without limiting the generality of the foregoing, your
participation in any activity/option not specifically detailed as included on the Tour or operated directly by us) or due to the actions of someone unconnected with the
Tour or due to circumstances which neither we nor our partners could have reasonably anticipated or avoided.
11.
EXCLUSIONS: To the fullest extent permitted by law, we do not recommend, guarantee, warrant or represent (whether expressly or impliedly):
(a)
the safety, risk management, planning or any other element whatsoever of the Tour;
(b)
the suitability, quality, specification, fitness for purpose or any other element whatsoever of any of the routes or venues used in the course of the
Tour;
(c)
the suitability, experience, expertise, training, qualifications, fitness for purpose or any other element whatsoever of any of the sub-contractors,
agents, suppliers, consultants or personnel used or engaged in the provision of the Tour.
12.
DATA PROTECTION: We shall hold all personal information that we obtain from you in accordance with the Data Protection Act 1998 and any other
applicable data protection legislation.
