Even though it is the shortest month of the year, February is one of the most eventful months, with celebrations and days of distinction galore; not to mention all
the weather-related activities that have affected us all

however, very thankful for all of our members with
snowplows who have done a great job of keeping the
roads, streets, driveways and parking lots cleared!

1. After proper schooling never read a
book to improve your knowledge base.
One should only read fantasy fiction to
escape the reality of life. This may be
your only source of enjoyment.

energy for the next task. You are too
busy to go above and beyond the call
of duty. Nothing is perfect anyway.
2. Whatever you do, make no room for
personal development. The point is to
make it through the day. Success is only
a figment of your imagination. You don’t
have time to improve your life anyway. If
you have a spare moment, take a nap.
7. Never exercise unless it is fun. Stay
as sedentary as possible—-it saves
energy. Think of it it this way: you won’t
have to eat as much.
How to be Mediocre
3. Do not be kind to others. Live out your
true feelings. Say what you think. If
you’re having a bad day, make sure others know it and wear a frown. It will only
get worse.
4. Consider every action you take to
make sure it benefits you first and only
then, the other person. If there is no personal benefit, do not proceed. You must
not help another simply to help another.
5. Take absolutely no thought to preplanning your day. Simply put out the

State Plan Review & Design Release Process is Streamlined in HB1301
For those of you involved in commercial construction,
you are probably familiar with the statutory requirement
that prior to commencing construction on a new or existing class 1 structure, an engineer or architect must submit plans and specifications to the state for a plan review. Currently there are no timeframes specified in
state statute or administrative code requiring plan review
to be conducted within certain time frames. This leads to
a great deal of uncertainty when it comes time to explaining to project owners when they will see work begin on
their projects. Rep. Heath VanNatter (R-Kokomo) has
responded by authoring House Bill 1301 (HB1301)
which, among other things, streamlines the state plan
review process by setting statutory time frames by which
state plan reviewers must respond to applicants after
receiving projects for plan review.
In addition to streamlining the plan review process, the
bill also repeals the statute requiring the division of fire
and building safety (division) to employ a state building
law compliance officer and creates the office of state
building commissioner, who is appointed by the governor
to serve: (1) at the pleasure of the governor; and (2) full
time. It also provides that the state building commissioner
has the duties and responsibilities of the state building
law compliance officer and requires the state building
commissioner to issue a written interpretation of a building law or fire safety law not later than 10 business days
after the date of receiving a request. HB1301 also defines a townhouse as a Class 2 structure for purposes of
the state fire, building, and equipment laws. Finally, under this proposal a political subdivision would be prohibited from adopting an ordinance or other requirement after
February 28, 2013, that would require a builder or remodeler to be licensed, certified, permitted, registered, or
listed by the political subdivision as a condition to the
builder or remodeler constructing or remodeling a residential dwelling.
IBA is a strong supporter of HB1301, and will testify in
support of the bill when it is heard in the Committee on
Veterans Affairs and Public Safety next Tuesday. Please

and urge them to support this important legislation
IBA Testifies in Support of Property Tax Assessment and
Environmental Rulemaking Bills
Earlier this week, IBA Chief Executive Officer, Rick Wajda, testified in support of two bills that, if passed, would
have a positive impact on Indiana's housing industry. The first bill, House Bill 1143 (HB1143) authored by
Rep. Dave Wolkins (R-Warsaw), prohibits the environmental rules board from adopting a rule or standard that
is more stringent than the corresponding regulation or

standard established under federal law. This has been
a long-standing issue on IBA's legislative agenda and
we applaud Rep. Wolkins for introducing it this session. HB1143 was heard in the House Environmental
Affairs committee on Wednesday and likely will receive
a vote when the committee meets again next Wednesday.
The second bill, Senate Bill 266 (SB266) authored by
Sen. Scott Schneider (R-Indianapolis), provides a limit
on the amount by which the assessed value of real
property may be increased for the four assessment
dates after the assessed value of the real property is
determined in a property tax appeal, in the case of appeals initiated after the effective date of the statute. In
the case of a property tax appeal that is pending on the
effective date of the statute and that was filed within the
preceding four years, the assessed value for the assessment date in question and for each of the following
three assessment dates may not be increased by more
than a specified amount. It also specifies that these
limits do not apply to any part of a change in an assessment: (1) that is directly applicable to any change in an
objective factor or feature relating to the property, including an improvement or enlargement of the property;
or (2) that results from the correction of an error or

omission, including the correction of a mathematical
error. SB266 was voted out of the Senate Appropriations committee on Wednesday.
Onsite Septic System Regulations May Move to IDEM
Senate Bill 107 (SB107), authored by Sen. Charbonneau (R-Valparaiso), transfers from the state department of health (ISDH) to the department of environmental management (IDEM) the responsibility for regulating residential onsite sewage systems and commercial onsite sewage systems. The bill also provides
for IDEM, rather than ISDH, to regulate sewage disposal systems of mobile home communities that employ septic tank absorption fields. (IDEM already regulates mobile home community sewage disposal systems that do not employ septic tank absorption fields.)
Several local health departments testified in opposition
to the bill, primarily to express concerns about maintaining the working relationships that they already
have with ISDH staff. IDEM testified that the ISDH staff
would remain intact be moved to IDEM. SB107 was
voted out of the Senate Environmental Affairs committee on Monday.
Plan Review Bill Passes Committee and 2nd Reading;
Tell Your Rep to Vote Yes on 1301
A proposal authored by Rep. Heath VanNatter (RKokomo) that would streamline the state's plan review
process was heard in the House Fire and Building
Safety Committee this past Tuesday. IBA Governmental Affairs Director, Tom Havens, testified in support of House Bill 1301 (HB1301) because of the positive impact this change would have on Indiana's economy. By reducing the amount of time projects are held
up in state plan review, owners will be able to take
possession of class 1 structures quicker and, as a result, begin generating revenue and employing Hoosiers sooner than is the case under the current system. HB1301 passed second reading in the House
yesterday, and third reading is scheduled to take place

Title Insurance Proposal Voted Out of Committee
On Wednesday, IBA testified in support of House Bill
1224 (HB1224), a bill that would require the Indiana Department of Insurance (DOI) to create a consumer comparison tool for title insurance rates. Title insurers historically have not had to file their rates with DOI; however, a
bill was passed last session requiring title insurers to file
their rates with DOI for approval. Since that law went into
effect last summer, IBA staff has heard from members
that title insurance rates are on the rise in certain parts of
the state. This bill should help keep title insurance rates
competitive because this tool will allow consumers to go
to one place and compare all the title insurance rates that
have been approved by all title insurers operating in Indiana. HB1224 passed out of committee on Wednesday
and scheduled for second reading in the House on Monday. If you would like to read the complete bill, please

On Time and Budget

How impossible would it be for a small builder to have every
product and material for a home in hand before construction
ever started? Imagine never having to hold up a job because
the cabinets or windows or something else hasn’t arrived by
the time your crew was ready for it.
That’s what my company tries to do on custom home projects. I’ve also tried it on a couple of design/build jobs and
believe it or not, it’s making our process smoother and clients happier. But it is driving my production manager nuts.
I call this “staging,” and my inspiration for it is an experiment
that my mentor, Phoenix remodeler and radio personality
Rosie Romano, did with his design/build firm many years
ago.
For a year and a half, Romero’s company offered clients
what he called “the impossible promise”: the job would come
in on time and on budget—-or it would be free.
As it turns out, the promise wasn’t impossible and Romero
never had to work for free. But it wasn’t easy, either and he
didn’t do it for long. It took Romero and his company three
years just to be in a position to offer that promise.
Here’s the rundown of how it works: You spec everything
out, work with the homeowners to make all of their selections, order the materials, open the boxes to verify that
what’s inside is what you ordered and is in perfect condition,
get the clients to sign off on every piece and then stow it all
in storage. We use a warehouse service
that stores our boxes securely and will
deliver them to us on demand.
Once you have all of that in place, then
you break ground. No decisions are
made later. Nothing is picked up later—
—not a single screw. It’s all done by the
time construction starts.
I’m replicating Romero’s process but one big exception: I’m not
offering my clients anything for free. What I’m finding however,
is that I’m saving money because the process saves time—even though we have to open a lot of boxes on the front end.
And my customers are giving me higher marks on Guild Quality
surveys because we’re finishing their homes quicker. That’s
crucially important to me.
I know that this isn’t z usual way for a small builder to operate.
Frankly, it’s a pain in the neck, and my crew lets me know it.
They have to be extra careful about protecting what’s in all those
open boxes so nothing gets damaged or lost. They admit they
would rather wait to order the materials and not open the boxes
until they need the item, even if it means they won’t discover
that something is wrong with the product until the day they
planned to install it. At that point, if a product is defective, they’d
have to reorder it and then wait weeks for replacement.
The impossible promise changes everything. It’s a paradigm
shift. It’s different from the way we’ve always done things. But
it’s mandate to get the job done when you said you would, and
it’s like gold if referrals from satisfied customers are important to
you. They are important to me.
