Buying at Waddington’s™
Condition:
All lots will be offered and sold subject to this Condition of Sale as well as
any Glossary and posted or oral announcements. By bidding at auction,
bidders are bound by those Conditions and Glossary, as amended by any
oral announcements or posted notices, which together form the contract
of sale between the successful bidder (buyer), Waddington’s™ (auctioneer), and the consignor (seller) of the lot. Description or photographs of
lots are not warranties and each lot is sold “as is” in accordance with the
Conditions of Sale.
IMPORTANT
A buyer’s premium of 20% of the successful
bid price of each lot up to and including
$50,000 and 15% on any amount in excess
of $50,000 is paid by buyer as part of the
total purchase price.
A charge of 6% GST (Goods and Services
Tax) and 8% PST (Provincial Sales Tax) is
applicable on the hammer price and
buyer’s premium, except for purchases
exported from Canada. In the case where
purchases are shipped out of the province
of Ontario, the PST is exempt.

Condition of Lots:
All of the items are to be considered, unless otherwise noted in the
description, in good condition. The definition of “good” when used in reference to condition, describes an object as having had no major damage
or repair but as with the nature of the material, may show minor surface
wear, discolouration etc., which indicates the acceptable wear that the
piece may acquire with age. If you are particular about minor flaws, you
should examine the pieces in person or have our staff answer any questions before bidding. Sizes are approximate. It is the sole responsibility of
the bidder to inquire as to the condition of a lot before bidding. Condition
reports are available upon request by phone, fax, email or in person. You
are advised to make any requests well in advance of the sale.
Absentee Bidders:
All absentee bidders are required to contact our offices at 416-504-9100
to confirm whether they have been successful.
Shipping:
The Auctioneers will not undertake packing or shipping. The purchaser
must designate and arrange for the services of an independent shipper
and be responsible for all shipping and insurance expenses. The
Auctioneers will, upon request, provide names of professional packers
and shippers but will not be held responsible for the service or have any
liability for providing this information. Reliable pre-auction estimates of
shipping costs of lots offered in this sale may be obtained from:

at the Oehlschlager Gallery in Chicago. His subjects which ranged
from urban scenes to military views are represented in the collections of the Art Institute of Chicago, the Metropolitan Museum, the
Whitney Museum and the Cranbrook Academy.

Note: Sydney Laurence was the first professionally trained artist to make Alaska his home. He was
born in New York and studied at the Art Students League before moving to St. Ives, Cornwall,
England in 1889. Over the next decade he exhibited at the Royal Society of British Artists and was
included in the Paris Salon in 1890,1894 and 1895. For reasons unknown, he moved to Alaska in
1904 and lived the life of a pioneer prospector. He painted little in his first years in the territory but
between 1911 and 1914 he began to refocus on his art. He moved from Valdez to Anchorage in
1915. He painted a wide variety of Alaskan scenes during his career but it is the image of Mt.
McKinley from the hills above the rapids of the Tokositna River that became his trademark. It is this
image more than any other which personifies Laurence for his many admirers and collectors in
Alaska and beyond. Laurence forged a uniquely personal style by applying the tonalist techniques
he had learned in New York and Europe to the wilderness of the North. He, more than any other
artist, defined for Alaskans and others the image of Alaska as “The Last Frontier”

In the Fall of 1980, this work was featured in several Toronto newspaper and Canadian media features
including:
a Global Television news feature, a CBC, Metro Morning interview with Mr. Crossley; and an article and
illustration of the work published in The Toronto Sun newspaper .
In December 1981, Charles S. Rhyne, then Chairman of the Department of Art, at Reed College, Portland,
Oregon obtained permission to include a reproduction of Gathering Flowers in a forthcoming four-volume catalogue raisonné to contain all drawings and paintings Attributed to John Constable.
Note: Since being discovered in 1979 this work has been the subject of much debate and intrigue. It
charmed art-lovers at the AGO for ten years and hung amid masterpieces by Cézanne, Matisse,
Constable and Van Gogh.
This lot is accompanied by a letter to Mr. Crossley from Michael J.H. Liveridge, Lecturer-in-charge at the
University of Bristol, dated August 30, 1980 confirming the attribution of this work to David Cox Snr.
Liveridge writes: “The painting conforms closely to the usual canon of the artist’s informal oil studies, and
the style is also close to his work in watercolour. In particular the handling of foliage and the treatment of
atmospheric effects in [the] painting correspond to Cox’s vigorous and direct treatment of landscape
scenery, especially in his oil sketches.”

Note: This lot is accompanied by images captured by enhanced infra-red imaging revealing an erased sketch of a
smaller figure in a similar pose beneath the present drawing. Modigliani often made several drawings of the
same sitter in various poses. Faint alternative and erased lines are seen within the present design. Although
hardly visible in normal light, the initial attempt is revealed quite well in enhanced infra-red imaging.
Reproductions of this erased drawing and the changes in the placement of the sitter’s right hand captured by
infra-red imaging accompany the lot.
The lot also includes by a copy of an indistinctly signed hand-written document, dated at Paris le 8/IX 1952,
signed, M/Mrs. or H. Zborowski (?) certifying this drawing as a Modigliani.
Portrait de Femme has all the characteristic traits of the signature facial type that Modigliani developed after
1916: the elongated oval face, the graceful swan-like neck, the sensuous lips and the impenetrable almondshaped eyes. Although the sitter for the present lot is not identified, the naturalistic frontal pose of the seated
model with hands clasped in her lap framed by sketching lines in the background recalls Modigliani’s drawing of
1917, the similar size portrait, Femme au Chapeau (Ref. C. Parisot pgs.148-149) and Portrait de Jeune Fille sold at
Sotheby’s, London, 2 July, 1970, lot 56. While, the small oval face, tilted to the left with her newly chic, bobbed
hair style, recalls the woman depicted in Modigliani’s portrait of Madame Menier, in La Femme au Collier Vert,
painted in 1918.
At first glance, Portrait de Femme, portrays a sophisticated calm. The sitter’s classical frontal pose and the curving
lines of her collar creates a graceful movement which continues to curve through her arms coming to rest in the
sitter’s clasped hands. Tension occurs when the eye moves upwards to the fanned vertical lines framing the sitter’s head and shoulders, the vertical hatching of the shading, enforcing movement in the composition.
Purchased by prominent Canadian lawyer and civil servant collector, Henry Alexander Dyde (1896-1976) and his
wife from the Saidenberg Gallery in October of 1954 with only a deposit, the Modigliani was one of several
important International works housed in their collection. The Saidenberg Gallery was a highly regarded gallery
occupying a central position in New York cultural life for decades. In 1950, Daniel Saidenberg, a Canadian cellist
and conductor, and his wife, Eleanore Block opened the gallery located in the Upper East side at 10 77th Street,
New York. They began collecting modern paintings and sculpture in New York in 1943. By 1955, the gallery had
risen to world prominence when the Saidenbergs were appointed Picasso’s primary representatives in America.
Eleanore Saidenberg was the founding member of the Art Dealers Association of America. At her death in the
summer of 1999, the estate collection included the most impressive works to come to market in recent years
including a major work by Picasso and 45 other paintings and sculpture by artists such as Leger, Gris and Braque.
The undated, hand-written gallery receipt is testimony by its informality that a trusted relationship existed
between the Dydes and the Saidenbergs. The Saidenberg Gallery was influential in introducing this important
Canadian collector to Amedeo Modigliani, one of the great European modern masters of our time.

All lots will be offered and sold subject to the Conditions of Sale
which appear in this catalogue as well as any Glossary and posted
or oral announcement. By bidding at auction, bidders are bound by
those Conditions and Glossary, as amended by any oral announcement or posted notices, which together form the contract of sale
between the successful bidder (buyer), Waddington’s™ or Joyner™
Waddington’s, and the consignor (seller) of the lot. Descriptions or
photographs of lots are not warranties and each lot is sold “as is” in
accordance with the Conditions of Sale.
A premium of 20% of the successful bid price of each lot up to and
including $50,000 and 15% on any amount in excess of $50,000 is
paid by the buyer as part of the total purchase price.
Ontario Retail Sales Tax is charged on all purchases, whether picked up
or delivered in Ontario, unless the buyer completes a valid exemption
form at the time of purchase. All lots are subject to Goods and Services
Tax on the hammer price and on the buyer’s premium.
Bidding
To bid in person at the auction, you must register for a bidding number by showing identification acceptable to the Auctioneer upon
entering the salesroom. Your number will identify you if you are the
successful bidder. You will be responsible for all lots purchased on
your bidding number. Banking information may be requested by
Waddington’s™ or Joyner™ Waddington’s.
You may submit an Absentee Bid Form if you are unable to attend
the sale. Please refer to this form in the back of this catalogue for
the appropriate forms and further information.
Bidding by telephone, in limited circumstances, can be arranged
prior to the sale. While we are pleased to offer absentee and telephone bidding as a service to our clients, and take great care in their
commission, the Auctioneer will not be responsible for errors or failure to execute bids.
The Auctioneer may also execute bids on behalf of the consignor to
protect the reserve. The reserve is the confidential minimum price
the seller is willing to accept for his or her property, below which it
will not be sold
Payment
Payment for purchases must be by cash, INTERAC direct debit (Cdn
clients in person only), certified cheque (U.S. & Overseas not
applicable), travelers cheque, bank draft, electronic transfer (fee
applies), and VISA or Mastercard (up to $25,000). As Waddington's

Removal of Purchases
The purchaser will be responsible for shipping and insurance
expenses. The Auctioneer will, upon request, provide names of professional packers and shippers but will not be responsible or have
any liability for providing this information.
Purchases must be paid for within 48 hours of the date of the sale,
and removed from premises within 10 days of the date of sale (see
Conditions of Sale, conditions 8 to 15).
Clients are advised that packing and/or handling of purchased lots
by our employees or agents is undertaken solely as a courtesy for
the convenience of clients.

Paintings, drawings, prints, furniture, jewellery and all forms of decorative arts and collectibles may be brought to our Toronto office
where we can provide you with preliminary auction estimates and
consignment procedures. Please visit our website at www.waddingtons.ca for details on our various departments and how to contact
the specialists. We also accept mailed and emailed requests for
advice on the marketability of objects. A photograph and phone
number must accompany a full description of each item.
Our specialists regularly travel to major Canadian cities to meet with
prospective consignors. For further information, or to arrange an
appointment, please contact our Toronto office.
Property normally arrives at Waddington’s™ or Joyner™ Waddington’s
at least three months before the sale in order to allow our specialists
time to research, catalogue, photograph and promote the items.
Consignors will receive a contract to sign, setting forth terms and
fees for our services.
