For them, justice means: • Escaping Domestic Violence • Saving their Home from Foreclosure • Securing Essential Health Care, and • Obtaining Subsistence Income for Basic Needs. 2 No two client stories or situations are ever exactly the same. More often than not, we find their lives are complex and our clients are in crisis. We are committed to helping those with nowhere else to turn. We can do it... together. Please join us! With Your Help, We Can Change Lives “Together” is an appropriate theme to describe a year that challenged us to unite and work harder than ever to serve the thousands of local people that depend on Pisgah Legal Services. In the spring of 2013, we learned of massive government funding cuts to our domestic violence program, cuts that might force us to turn away more than half of the clients served by this effective program. Pisgah Legal Services shared this news with our friends and donors, county governments, community foundations and other funders who understood the value of preserving legal aid for victims of abuse. The community rallied, we successfully met our funding goals for 2013, and services remained intact. Thank you, sincerely, for your caring and generous support. We wish that we could tell you that the funding crisis has ended, but the truth is that while federal and state funding continues to wane, the need for our services only increases. We begin a new year knowing that we must again raise the funds that allow our dedicated attorneys, staff and volunteers to serve people in our mountains who are facing tremendous hardships, such as homelessness and abuse. Our clients often don’t have enough money to buy food, much less pay for an attorney. Legal help can be life-changing, and we’re committed to being there for the most vulnerable people in our region. And there are new challenges. In 2013 PLS began helping folks navigate their way through the health insurance Marketplace created by the Affordable Care Act. An incredible group of volunteers and staff are guiding individuals and families through this complicated process to access comprehensive care. Siekman Board President 3 Stopping Domestic Violence ... Sofia’s* husband was so abusive and controlling that she was not allowed to eat, leave the house or take a bath without permission. Nor was she allowed to have a phone, friends or computer access. He drove her everywhere. Her only private moments were during check-ups at the health department. That’s where Pisgah Legal Court Advocate Thalia Hoy began meeting with Sofia in secret to create an escape plan. In 2013, we provided legal help to more than 4,089 people, primarily women and children, trying to escape domestic violence and abuse. 4 But when Sofia did leave, her husband took out a protective order against her and sought emergency custody to prevent her from having access to their children. He filed false criminal charges, and Sofia was arrested. PLS Attorney Lynne Davis says, “I’ve never seen someone manipulate the system the way that he did.” Together, Davis and fellow PLS Attorney Martin Jarrard successfully guided Sofia through the legal system. They also assisted a private attorney who helped Sofia get primary custody of her girls. Today she is divorced, has a full-time job and lives in a new Habitat for Humanity home. *Client’s name changed Sofia (left) with her PLS Attorney Lynne Davis. “It was a nightmare; I was living in fear all of the time. The people at Pisgah Legal were angels sent by God. I was not just a job to them; they feel love and compassion for the people they help.” Solving Housing Problems and Preventing Homelessness ... After contracting polio as a child, James spent years in an iron lung and remained hospitalized until age 12. Despite serious physical disabilities, James went on to college, worked in broadcasting, and then in the security department of the Grove Park Inn for 25 years. James and Nettie “Mr. Whalen was the superman that really saved something that meant a great deal to my mother and me, and that was our home. I just can’t thank him enough.” When his father fell ill in 2003, James’ parents put their home in his name. He and his mother, Nettie, continued to live there. The home was paid for, but James took out a small mortgage to make the home handicap accessible. He fell behind on the payments and soon faced foreclosure. PLS Attorney Bill Whalen helped secure a loan modification that saved James and Nettie’s home. In 2013, we helped prevent homelessness for more than 4,654 people. We stopped foreclosures and evictions, improved housing conditions, and helped low-income people secure subsidized housing. 5 Securing Income for Basic ... Needs Jack broke his neck in a four-wheeler accident when he was a young man. It was difficult to adjust to being a quadriplegic and living his life in a wheelchair, but Jack did and went on to live a full life with a successful career working with computers. In 2013, we helped more than 1,267 people secure subsistence income to afford food, housing and other basic needs. 66 Despite his disability, Jack was healthy until he was injured during a medical procedure. He was plagued with infections and hospitalized more than 30 times. He lost everything: his job, his home, his savings, and his independence. “I’m a pretty tough guy,” Jack says, “but I got to the point that I didn’t want to live.” He moved to North Carolina and came to Mission Hospital for treatment. Jack was told that surgery could improve his health, but not until he had disability benefits. PLS Disability Advocate Aundry Freeman worked together with Jack and Mission staff to secure Jack’s benefits, improve his health and move him into an assisted living facility. Aundry and Jack “I am the poster boy for what the system was built for, but I was falling through the cracks. Pisgah made it all work, and opened doors for resources that changed my life. They did so without judgment or criticism. They cared for me with joy in their hearts.” Increasing Access to Health ... Care In 2013, Pisgah Legal Services experienced devastating cuts of more than $350,000 in grants to our program that helps victims of domestic violence. For more than 36 years, Pisgah Legal Services has witnessed the devastating effects of what can happen to people who lack health insurance. When health crises hit, many uninsured people deplete their savings, go into debt, and even lose their homes, trying to pay their bills. Without health insurance, many fall into poverty. When the new N.C. Health Insurance Marketplace, created as a provision of the federal Affordable Care Act, opened in fall 2013, Pisgah Legal saw an opportunity to secure health insurance for thousands and to help prevent the financial crises caused by lack of coverage. PLS, as part of a statewide consortium, received federal funding to help our neighbors navigate the new marketplace of health insurance options and enroll in the plan that is right for them. By February 2014, with additional support from Buncombe County’s Department of Social Services and Mission Hospital, PLS recruited and trained 80+ volunteer navigators to assist people across WNC to purchase health insurance. Through this work, we are changing the lives of many people in our mountain region. Last year no services were cut thanks to your incredible support and generosity. For our third annual Poverty Forum in October, we brought Kim Gandy (shown above), President and CEO of the National Network to End Domestic Violence, to Asheville. She told a crowd of almost 300 people, “Poverty exacerbates the violence. Fighting Poverty and Leveraging Funds ... for WNC $25.3 million in benefits = 9 to 1 return on your investment Pisgah Legal Services secured more than $25,316,000 in quantifiable benefits for our low-income clients in 2013 on a budget of $2.9 million, including: In addition to helping thousands of people through direct services, • Home equity saved from foreclosure PLS works with community partners to improve or create policies and • Child support for victims of domestic violence programs to protect WNC’s most vulnerable citizens. This year, we: • Medicaid benefits payable to local medical providers • Subsistence income for disabled individuals. Protected the Rights of Consumers PLS worked as part of a state-wide coalition of legal aid providers to advocate for better consumer protection laws for North Carolinians including preventing predatory lending and identifying ways to Percentage of Cases Closed by Issue Area in 2013 protect homeowners from illegal lending practices. Secured Fair Housing Practices PLS Attorney Ben Many successfully advocated with the Forest City Housing Authority to change their admission policy to allow non-married couples to share a lease, in compliance with the law. Office volunteers provided 8,782 hours of service by interviewing potential clients and assisting with legal research, administration and fundraising. Douglas Wilson Michael Wimer Anne Winner William Wolcott Robert Wolf Terry Young Jon Yarbrough Lach Zemp Thank you, George Ward Hendon When George Ward Hendon passed away unexpectedly in 2013, the community lost a leader and Pisgah Legal Services lost a friend and champion. Ward Hendon was an Asheville native who practiced law for more than 45 years at the firm of Adams, Hendon, Carson, Crow & Saenger. Over the years, Ward provided legal help to more than 85 PLS clients. He served on the PLS Board for six years, including as the Board President. Ward also served on the Board of North Carolina’s Interest on Lawyers Trust Accounts and as its Chairman. In 2005, Ward played an important role as a lead counsel for PLS in a dispute between PLS and the federal Legal Services Corporation over ownership of the Gudger House, PLS’ main office from 1981 - 2008. Ward is pictured above (center, gold tie, arms folded) with the team of local attorneys who successfully defended that lawsuit. She also represents clients in landlord/tenant cases, focusing on subsidized housing. Additionally, Robin is an advocate for the creation of affordable housing and the elimination of homelessness. Julie Klipp Nicholson is a Managing Attorney who has worked with Pisgah Legal Services since 2006. As a Mountain Violence Prevention Project Attorney, she represented victims of intimate partner violence and child abuse. Today she oversees the volunteer and MAVL programs at PLS. She also works closely with community organizations to allieviate child poverty and prevent domestic violence and child abuse.
