mechanic’s lien. The general contractor promptly demanded arbitration in Ohio, as expressly
provided in the subcontract, and moved to stay them action and to compel arbitration in Ohio.
Will you defeat the motion to compel arbitration in Ohio?
The answer is yes.
In HVS, LLC v. Fortney & Weygandt, Inc., 34601/2014, NYLJ 1202738552136, at *1 (Sup.
Ct. Rockland Co., September 24, 2015), the plaintiff was the electrical subcontractor for
construction of a CVS pharmacy on Route 304 in Bardonia, New York. The defendant general
contractor terminated the plaintiff’s contract after problems with delays, and refused to permit
the plaintiff to complete the work.
Plaintiff filed a mechanic’s lien for the electrical work it performed, and sued for breach
of contract and to foreclose the mechanic’s lien. The defendants responded by demanding
arbitration in Ohio, as provided in the subcontract, and moved to stay the action and to compel
arbitration in Ohio.
Justice Victor Alfieri, Jr., ruled that the subcontract provision requiring arbitration in
Ohio was void and unenforceable pursuant to General Obligations Law § 757, which voids any
contract provision that makes the contract subject to the laws of another state, or requires
dispute resolution by arbitration or otherwise to be conducted in another state (except a contract
with a material provider).
The Court rejected the defendant’s argument that the Federal Arbitration Act preempts
GOL § 757, ruling that this case was distinguishable from Matter of Diamond Waterproofing
Sys., Inc. v. 55 Liberty Owners Corp., 4 N.Y.3d 247 (2005), which involved out-of-state entities and
materials obtained out of state, thereby affecting interstate commerce. The plaintiff here, by
contrast, was a local company, performed all of its work in New York, and obtained most of the
materials from local suppliers.
The Court severed the improper portion of the arbitration clause and ordered
arbitration in New York, citing King C Ironwork, Inc. v. Burdg, Dunham & Associates
Construction Corp., 150710/2014 (Sup. Ct. N.Y. Co.), and Brady v. Williams Capital Group, LP, 64
A.D.3d 127 (1st Dep’t 2009).
The Lesson?
If your subcontractor client based in New York wants to sign a contract with a New
Jersey general contractor to perform work in New York, and the general contractor insists on a
clause providing for arbitration in New Jersey, advise your client that the provision for
arbitration in New Jersey will likely be void and unenforceable pursuant to General Obligations
Law § 757, provided the work is performed in New York, and the materials come from local
suppliers.

Dear Colleagues,
We have successfully transitioned to Fall. The vibrant colors of Autumn remind us that the change
of the seasons is one of the reasons many of us decide to live and work in the Northeast.
On October 8 we said a bittersweet good-bye to Sandy Garvin, long-time and beloved Executive
Director of the RCBA. Nearly 100 family, friends and colleagues joined at the Nyack Seaport to wish Sandy
a happy and fulfilling retirement. I'd like to express my personal thanks to Sandy for helping make my
transition to Executive Director such an enjoyable experience, and helping make the learning curve just a
little flatter.
The RCBA's Annual Dinner, held this year on October 29, was a huge success! 240 guests and
admirers turned out (one of the largest crowds in the history of the Bar Association) to honor Judge of the
Surrogate's Court Thomas E. Walsh II, and Lifetime Achievement awardee William Frank, Esq. Guests
were treated to lively musical entertainment at the end of the evening provided by "The Vic 6 Band," a
group of legal beatles including Judge Vic Alfieri (drums), RCBA Treasurer Jim Birnbaum (guitar), and
RCBA Member Rob Fellows (harmonica and vocals). A great time was had by all!
Thank you to everyone for your continued support of our Association, and have a wonderful and
colorful Fall.

In addition to providing end-of-life care, United Hospice of Rockland, operates www.Assuringyourwishes.org It provides a
free, secure way for individuals store and for them and their health care providers to retrieve their documents when
needed. All enrollees an receive ID card to carry in their wallet and additional cards for them to distribute to healthcare
providers, family members, etc. We have stored directives for thousands of Rocklanders.
There are two attorneys in Rockland County, Courtney Boniface and David Klein, who have their clients sign an enrollment
form for Assuringyourwishes.org as they complete their advance directives. These attorneys mail they enrollment form and
the directives to us. We store and send all documents and ID cards back to the client. I would like to encourage other
attorneys to do the same. It is a wonderful, free service that can be offered to their clients. I have attached an enrollment

Motions in the Appellate Division: A Procedural Primer

When most attorneys think of Appellate Practice, they often think of it as being restricted to the Record on appeal,
Briefs, and Oral arguments. However, Motion practice is common in the Appellate Courts, and in some circumstance can be
the key to a client’s success at the Appellate level. Though by no means exhaustive, below is a practical guide to the basic
procedure involving Motion practice in the Appellate Courts of New York State.
Other than the procedural requirements for Motion practice set forth in the CPLR, the Appellate Courts of each
Judicial Department have their own unique rules and regulations that Movants (and opposition counsel) must be aware of.
These procedural rules can be found in the Rules of Procedure for each respective Court in section 600.2 for the 1st Dept.;
670.5 for the 2nd Dept.; 800.2 for the 3rd Dept.; and 1000.13 for the 4th Dept. Notably, in the absence of a Departmental rule to
the contrary, the CPLR governs.
As with Motion practice in the Supreme Court, written Motions in the Appellate Courts can be brought by one of
two means, via Notice or Order to Show Cause. As Orders to Show Cause in the Appellate Divisions can be procedurally
complex, this article will focused solely on Motions brought via Notice.
Preliminarily, it should be noted that all Motions before the Appellate Courts must include the underlying Notice of
Appeal and Judgment/Order which is the Subject of the Appeal. Failure to include these documents may lead to the Motion
being rejected out of hand.
Motions on Notice at the Appellate Level are governed by CPLR § 2214 as to timing and content, and must include:
the Parties, a noticed return date, statement of relief sought. Service, or course, must be properly made as well.
From Sept 1st - June 30th Motions in the 1st Dept. may be made returnable any weekday at 10 am, but from
July-August, must be made returnable on Mondays at 10 am. The 2nd Dept. requires that all Motions be made returnable on
Fridays at 9:30 am, and the 3rd and 4th Depts. require that Motions be made returnable on Mondays at 10 am. Each
Department has a $45 Filing fee and does not allow a Reply or Oral arguments (Oral arguments allowed with permission in
3rd Dept. only). Although it is not necessary, when drafting Appellate level Motions consider using the same font and spacing
guidelines required by each Department when drafting a Brief.
As can be expected, each Department has their own unique filing requirements regarding Motions aside from the
required return dates.
In the 1st Dept., papers must be filed by noon the day before motion is returnable; supplied to the Court in a package marked
“Motion Papers”; and should enclose Self-Addressed stamped postcard to be returned stamped “Received”; and must
include Self-Addressed Stamped Envelope. Cross-Motions must be served and filed 3 days prior to the return date.
In the 2nd Dept., moving papers must be filed one week before return date; Opposition papers must be filed by 4:00
pm the day before the return date; and Cross-Motions must be served and filed 3 days prior to return date.
In the 3rd Dept., papers and proof of service must be filed “as soon as possible,” and although the 3rd Dept. will be
flexible, the best practice is to be sure everything is filed with the Clerk of the Court no later than the return date. The 3rd
Dept. has no specific rules regarding Cross-Motions, but best practice would be to follow the three day rule adopted by the 1st
and 2nd departments.
In the 4th Dept., an original and one copy of all papers must be filed no later than 5:00 the Friday before return date.
Cross-Motions must be served via personal or overnight service 4 days before return date.

Motions in the Appellate Division: A Procedural Primer Continued……………………...
With that procedural background in place, it should be noted that due to the nature of appellate practice only
certain types of Motions are appropriate to bring before the intermediate Courts. The most common types of Motions at the
Appellate level include the following:
Motions for interim relief and/or a Stay which seek to either injunctive relief or to stay the Lower Court proceeding
in its entirety or an Order of the Lower Court.
Motions to Reargue, much like in the Lower Court, can be made before the Appellate Division within 30 days from
Notice of Entry in order to have the Court re-address a prior Decision.
Motions to Enlarge or to Strike portions or the entirety of the Record on Appeal can be made where there is either
an incomplete Record, or the party who prepared the Record on appeal has included documents that were not
before the Lower Court, i.e.: there is information that is “Dehors” the Record.
Motions to Disqualify are appropriate as well where there are conflicts of interest with current clients, former
clients, or otherwise as the case might be.
Motions to appear Pro Hac Vice are allowed, but governed by each individual Court’s rules.
Motions to Consolidate are governed by CPLR 602, and can sometimes be used in order to avoid split decisions
under related but distinct Notices of Appeal.
Clearly, no single article can be a comprehensive guide to Motion practice before each respective Appellate Division.
However, the brief outline above offers a helpful procedural starting point that you might consider before proceeding with
any Motion at the Appellate level.

These tips are offered to aids in one’s personal life. The following are the suggested steps of

Recognize I have a problem. Denial is a barrier to moving on.
Accept that another party can assist with the situation. Discuss the situation with a trusted friend. Seek counseling.
Trust that another party can handle the responsibility. Let go of ownership of the problem and assign mechanics to a
professional.
4. Examine myself. What are my strengths? What are my weaknesses? What do I wish to keep? What do I wish to
change?
5. Recognize my weaknesses by revealing them to a trusted party; communicate my willingness to change?
6. Prepare to make change. Resolve I will be a different person, for the better.
7. Take the action to change. Move from resolution to doing.
8. List persons to strengthen our relationship. Improve communication with people in our lives.
9. Actually talk, see, and be with the people that are in your life. Be active; be personable.
10. Do a regular inventory of myself. Periodically take stock of where I’m at, where I’ve been and where I’m going. List
my plusses and minuses. Recognize where I need to improve.
11. Use mediation. Practice speaking my wishes. Learn to listen to the whispering of serendipity; to hear things I missed
in the past.
12. Help others. Be active in the community. Offer to do things that contribute to the larger world.
