Loi n°89.421 du 23.06.1989 – Article 19
La loi n°72.1137 du 22.12.1972 relative à la protection des consommateurs en matière de
démarchage et de vente à domicile est ainsi modifiée : l'article 1er est ainsi rédigé "est soumis aux
dispositions de la présente loi quiconque pratique ou fait pratiquer le démarchage au domicile
d'une personne physique, à sa résidence ou à son lieu de travail, même à sa demande, afin de lui
proposer l'achat, la vente, la location-vente ou la location avec option d'achat de biens ou la fourniture de
services".
Est également soumis aux dispositions de la présente loi le démarchage dans des lieux
non destinés à la commercialisation du bien ou du service proposé et notamment l'organisation par un
commerçant ou à son profit de réunions et d'excursions, afin de réaliser les opérations définies à l'alinéa
précédent.
Conditions Générales de Ventes
1- Tous nos prix s’entendent hors taxes, t.v.a. en sus : 10 % et 20 % sur les boissons
alcoolisées. Nos prix seront révisables en fonction de l’augmentation des matières premières,
énergie et taxes.
2- Les tarifs appliqués ont été chiffrés sur la base du nombre de personnes stipulé sur le
bon de commande. Une diminution de couverts supérieure à 10 % pourra entraîner une augmentation du
tarif défini au départ.
Toutes nos propositions de cocktails et repas seront distribuées sans supplément de prix
dans le triangle TOULON, MONTPELLIER et VALENCE.
3- Aucune vente n'est officielle avant la signature du contrat de vente, accompagné
d'un acompte de 30 % du montant de la facture toutes taxes comprises, sauf accord préalable des deux
parties.
4- En cas de non-paiement à la date d'échéance convenue, les sommes dues porteront
de plein droit un intérêt de retard de 2 % par mois, tout mois commencé étant dû.
5- La S.A. MEFFRE Traiteur engage sa responsabilité en ce qui concerne toutes les
prestations qu'elle facture. Par contre, elle n'est pas tenue responsable des produits complémentaires
facturés par des tiers qui entreraient dans la composition d'un produit MEFFRE TRAITEUR.
6- Les mets qui n’auront pas été consommés lors de la prestation pourront être laissés au
client qui le demande, à la condition que celui-ci signe une décharge. En effet, nous avons l’obligation
de jeter toute nourriture qui n’a pas été mangée sur place. Ceci afin de respecter la chaine du froid.
7- Le nombre approximatif de convives doit être stipulé lors de la signature du contrat de
vente. Le nombre définitif sera confirmé par écrit, (courrier ou mail), 20 jours pleins avant la date de la
réception et servira de base à la facturation, même en cas d'annulation à la dernière minute. Dans le cas où
le nombre de convives serait augmenté après la confirmation écrite, MEFFRE TRAITEUR se réserve le
droit de modifier les menus à sa convenance tout en conservant la qualité souhaitée par le client. Nos
prix s’entendent toujours hors commission.

8- En cas d'annulation complète de la commande, une indemnité sera exigée à raison de
:
30% de la valeur H.T. de la commande, si l'annulation intervient deux semaines avant la
date de la réception (correspondant à l’acompte versé à la signature du bon de commande)
80% de la valeur H.T. de la commande, si l'annulation intervient une semaine avant la date
de réception.
100% de la valeur H.T. de la commande, si l'annulation intervient la veille ou le jour même
de la réception.
9- Tout évènement de force majeure, accident ou épidémie, grève générale ou
particulière dégage la responsabilité de la S.A. MEFFRE TRAITEUR de toute responsabilité dérivant du
contrat de vente.
10- Le service est assuré par notre personnel pour une vacation de 2h à 7h, dès l’heure
d’arrivée des clients, indiquée sur le contrat. Au-delà de ces horaires, un supplément de 35
€ hors taxes, par heure et par personne restant au service, sera à votre charge.
11- Les boissons fournies par le client sont à livrer sur le lieu de la réception et devront être
récupérées le soir même. MEFFRE TRAITEUR dégage entièrement sa responsabilité en ce qui concerne la
perte, le vol ou la casse pouvant survenir aux boissons du client en dehors des horaires de présence de son
personnel sur les lieux de réception
12-. Des frais de 150 € H.T., pour 150 KG de transport avec garde et assurance comprises,
seront imputés au client pour le vin, lui appartenant, qui sera livré à la Société MEFFRE TRAITEUR et
transporté par cette dernière.
13- En cas de litige quelconque relatif à l'interprétation, l'exécution ou la rupture du contrat
de vente,seul le tribunal d'Avignon sera compétent.
