Mayo Clinic Health Systems offers Flu Facts and Fiction
While many people attempt
to survive the winter season with
chicken soup and cold medicine,
there are more than 31.4 million
outpatient visits and 200,000
hospitalizations each year because
of the flu. According to the CDC
Foundation, this amounts to an
estimated $10.4 billion a year in
direct medical expenses and an
additional $16.3 billion in lost
earnings annually.
Mayo Clinic Health System’s
Kellee Dixon, a specialist in
Infection Prevention and Control
says the number one way to prevent
the flu is to get the Influenza
vaccination. “When one person gets
vaccinated, they keep themselves
healthy and keep others from
getting sick too” says Dixon.
Dixon also emphasizes the
importance of addressing the
misconceptions about the Influenza
vaccination and the flu virus itself.
“The problem is that many people
are hesitant to get the flu vaccine
because of negative things they’ve
heard from family, friends, or the
media.” Mayo Clinic Health System
insists that everyone should know
facts from fiction to help increase
the amount of flu vaccinations
and prevent flu related visits to the
doctor.

Top 10 Flu Facts:
1. You will not get the flu from
the Influenza vaccine, this includes
shot and mist forms. Flu vaccines
are made with inactive/dead viruses.
You can’t catch the flu from getting
one. The flu shot can also take up to
two weeks to be effective. During
those two weeks it is still possible to
contract the Influenza virus.
2. The flu shot is safe for
pregnant women and is highly
recommended. The flu vaccine
protects women during pregnancy
and their babies up to six months
after birth. One study proved
vaccinating pregnant women was
92% effective in preventing infant
flu hospitalization.

Friday, October 30th there was a pep rally held in honor of Schutte.
Words were spoken by her coach Eliza Philpott and Principal David
Ross. Afterwords the high school students and staff gathered in the
parking lot to send-off the entire cross country team with an escort
service through town from Monona Police and Fire.
MFL MM Student Council members attended XXXV annual Iowa Association of Student Councils Conference
MFL MarMac Student Council
members attended the XXXV
annual Iowa Association of Student
Councils Conference in Des Moines
on Sunday October 25 and Monday
October 26. The 12-member council
and their advisor joined over
1,300 students and advisors from
across the state of Iowa to listen
to keynote speakers Kyle Scheele
and Lt. Col. Justin Wagner of the
Air National Guard. Informative
break out sessions were also given,
two of which were organized by
MFL MarMac Student Council
members Chaun’te Drahn, Bryce
Burke and Allison Corlett. Their
session was titled “Involving Your
Community in Your School.” The
session focused on two major
events the council hosts throughout
the school year: Veterans Day
and Cancer Awareness. Student
Council members include: Bryce
Burke, Cassie Cahoon, Chaun’te
Drahn, Becca Harms, Allison
Corlett, Nicholas Larson, Coltin
Ball, Chelbe Feuerhelm, Siera
Wiebensolm, Brenna Moser, Josie
Kleinow, and Skylar Moser. Many
ideas were gathered at the various
sessions and leadership skills
were enhanced with this great
opportunity.

Musical Beauty and
the Beast to be held

The 2015 MFL MarMac
High School Musical is
Disney’s Beauty and the Beast.
Performances will be Friday
and Saturday, November 13th
and 14th at 7:30 pm in the High
School Auditorium in Monona.
Doors open at 6:45 pm.

This is all in part of the Random Acts of Kindness being done throughout
the year.
This month in my article I
would like to remind everyone
that the deer rut is going on and
we have had an increase in car
deer accidents. The deer rut is the
mating season for the whitetail
deer in our area when the bucks are
chasing the does. Crops are coming
out of the fields and deer are getting
hit by vehicles. As I am writing this
we had two car/deer accidents the
deputies covered last night. Also
the raccoon are running as well
and here at the office we recently
had damage to a squad car from
a raccoon hitting the underside of
the vehicle causing considerable
damage. I don’t know how to tell
you to avoid hitting a raccoon when
they are so hard to see but to maybe
be more alert.
I’ve had a lot of questions come
to me in regards to renewing your
non-professional permit to carry
weapons. If you wish to renew
your permit you need to take a
training course offered by an NRA
or IA Law Enforcement Academy
Certified handgun instructor or
qualify on a firing range. This
must occur within 12 months
prior to the expiration date on the
current permit and you must apply
at least 30 days before the current
permit expires. So that leaves you
an eleven month window. This is
also the same for the military form
DD214 applicants. I have spoken to
my firearms instructors and they are
working on offering a qualification
for permit holders coming up this
next spring. We were thinking
of charging in the $25 range and
this would just be a short refresher
course on updated laws and some
shooting to make sure the shooter
knows what they are doing and to
help them become a better shot.
We’re trying to make this simple yet
effective for everyone. The renewal
fee for a permit is $25.
If an applicant applies 29
days or less before the current
permit expiration date or after it
has expired, they must provide
a copy of their previous training
documentation or military service.
So basically your old training
certificate or form DD214 would
work to obtain a new permit, but
you would be without a permit from
when it expired until the paperwork
is completed. We do strongly
recommend qualifying and learning
about new laws but that is the way
the law reads. The fee for a new or
expired permit is $50.

Clayton County Supervisors continue investigation
of Auditor’s office and possible action
The Clayton County Board
of Supervisors met Wednesday
to discuss further possible action
against County Auditor Dennis
Freitag. After an auditor’s report
under oath Monday, which became
contentious at some points,
Supervisor Larry Gibbs issued a
statement listing deficiencies in
the Auditor’s office while Freitag
has been engaged with an ongoing
medical problem with his wife,
Pam, who is battling Lupus. They
included Freitag’s limited contact
with his staff, failure to complete
necessary reports for last year’s
budget and, keeping checks and
county records at his home.
“We have three options,” Gary
Bowden said at Wednesday’s meeting.
“We can do nothing, hire a budget
director or refer this to the Attorney
General’s Office to determine
whether a Chapter 66 review petition
would be appropriate.”
Chapter 66 of the Iowa Code has
to do with the removal of an elected
official from his or her office. A
request to do so must be filed with
the State Attorney General’s Office.
“Of the options Gary laid out,
I can see a scenario where we
could pursue the Attorney General
option,” Supervisor Ron McCartney
commented. “But we also have
new budget discussions coming up,

Clayton county Attorney Alan
Heavens was also at the meeting.
“As far as Chapter 66 goes, I would
envision that Scott Brown, the
area prosecutor from the Attorney
General’s Office, would start an
official investigation to review
the transcript from Monday’s
meeting, review Documents and
conduct interviews with office
staff,” Heavens said. After that, he
will talk to Attorney General Tom
Miller. It’s ultimately up to him
(Miller) on whether or not to pursue
this. There is a 20 day requirement
that once a Chapter 66 petition is
filed, the issue must be resolved.”
After some further discussion,
the Supervisors unanimously
voted to authorize the County
Attorney to contact the Attorney
General’s Office and ask for
further investigation of the County
Auditor’s Office and for a review of
possible removal of the auditor.
There will be no cost to the
county for brown’s services.

A three vehicle accident
occurred on October 23 in the city
of Monona. Braxton Dundee, 15,
Monona, was traveling south on
Main Street at 3:42 p.m. As he
approached a stop sign, he noticed
his brakes having problems. He
swerved to miss a stopped vehicle,
driven by Cassidy Penrod, 15,
McGregor, but struck her in the
rear, causing her vehicle to rear
end another stopped vehicle driven
by Blake Brainard, 17 Monona.
Dundee’s 1992 Dodge Ram,
Penrod’s 1999 Jeep and Brainard’s
1997 Pontiac each sustained $1,500
in damages.
On October 21 at 7:39 a.m.
Jane Robinson, 17, Garnavillo, was
traveling on Highway 52 near Kale
Avenue when she struck a deer.
Her 2001 Chevy Malibu sustained
$1,500 in damages.

Nashua, struck a deer. Her 2007
Buick sustained $2,500 in damages.
On October 25 at 7:40 p.m.

struck a deer on Highway 13 near
Crystal Road causing $2,000
in damages to his 2001 Chevy
Cavalier.
Later that evening at 9:31 p.m.
Emily Grimes, 21, Dubuque, was
driving on the Great River Road
when she struck a deer, causing
$2,000 in damages to her 2009
Chevy Cobalt.

afterwards.

pumpkin pie at the meeting October
14th, Her Thought for the Day was
entitled “Love” from Psalms 100:
1-5. Surprise Halloween cards from
past Secret Pals were under the
placemats.
Roll call was A Favorite
Halloween costume. The lesson
was by Erma Swenson. She told
about the various bus trips the
the Freedom Club has provided.

Nashville Christmas Concert,
Mystery trips to Swisher and
Chicago.

The Froelich U & I Club met
Wednesday the 28th at the Museum.
President Patty Buerger called the
meeting to order at 1:37pm after a
lengthy discussion of the upcoming
election and the candidates. Jean
Smith showed a baby quilt she had
machine quilted (made by Janelle
Smith) for a great grandson. Ellen
Jones read a story of Halloween and
the first Harvest Festival.
Hostess Suzanne Kaber read
devotions “Moving to a Nursing
Home.” Roll call - “A Surprise”
covered many occasions. Patty
showed pictures of past club
meetings.
It was decided to hold the
Christmas Party on Dec. 9th at
noon. Bring your favorite dish.
Suzanne also had the program,
all read the sayings on cards on
display. For the program on Buttons,
she showed many jars, large and
small of all kinds that had been
saved - collected for many many
years. Buttons were invented in the
1800’s. There were many
button factories along the
Mississippi from 1890 to 1930.
She also showed 2 large displays
of hundreds of buttons, all kinds,
made by Willa Helwig and given to
the Museum. Suzanne had 2 very
old ladies suit tops with buttons, the
construction of the garments was
very interesting. Some machine
stitching but a lot of hand sewing
to make the items wearable. Also
a piece of toddler shoes that took a
button hook to close. Marilyn Baade
brought her “Button on a String”
toy.

the Holidays” which will be
held November 13-16, at the
Allamakee Fairgrounds Pavilion.
Reservations are now being
taken for the popular Saturday
and Monday Christmas Fantasy
Luncheons sponsored by the
Allamakee County Cattlemen’s
Association.
The luncheons,
pictured

delicious meal served among
the trees, plus entertainment
and ample time to view all of the
breathtaking decorations.
Reservations are being taken
now for the Veterans Memorial
Health Care Foundation’s 24th
Annual Christmas Fantasy 2015
held Friday, Saturday, Sunday and
Monday, November 13, 14, 15 and
16, at the Allamakee Fairgrounds
Pavilion. The theme will be “Ring
In the Holidays.”
Reservations are now being
taken for the popular Saturday and
Monday Noon luncheons and the
Saturday evening Wine, Cheese and
Dessert Event.
The luncheons are sponsored by
the Allamakee County Cattlemen’s
Association, and will be held
Saturday, November 14, at Noon,
and again on Monday, November 16
at Noon. A full meal will be served
plus entertainment will be provided
at both events. All guests will
have ample time to view all of the
displays. Reservations can be made
by calling (563) 568-6262. Cost for
either of the luncheons is $10 per
adult.
The Saturday evening Wine,
Cheese and Dessert event will
be held from 7-9 p.m. Saturday
evening, November 14. This year
the event will again be sponsored
by the Eagle’s Landing Winery
of Marquette, Iowa. They will be
serving a variety of their finest
wines and entertainment will also
be provided. Reservations can be
made for this event by calling 5684177.
This years’ Christmas Fantasy
event will have a huge number of
decorated trees on display. Many
items will also be available on
silent auction for a great Christmas
shopping opportunity. These items
will include centerpieces, a wide
variety of gift baskets, beautiful
wreaths, swags, chairs, quilts, toys,
mini-trees, crafted items, wall
hangings and other decorative
items.
The Friday evening “Tingle ‘N
Mingle” happy hour will be held
November 13, from 5 to 8 p.m., and
is sponsored by Four County Ag in
Postville. This annual Friday night
happy hour event will be hosted
by B.E. Catered, Jim and Charlene
Baxter and Mary Engrav. This is a
special opportunity to meet socially
with friends and co-workers after
work. Many tables of hearty hors
d’oeuvres, plus desserts, candies,
and spirits will be served among the
trees. Special holiday entertainment
will also be provided. The cost is
$15.00 per person. Tickets can be
purchased at Veterans Memorial
Hospital or at local banks. Tickets
may also be purchased at the door.
Christmas Fantasy will be open
to the public Saturday, November
14, from 2 to 5 p.m., Sunday,
November 15, from 11 a.m. to
4:30 p.m., and again Monday,
November 16, from 2 to 7 p.m.

tomatoes, beans, lettuce, corn, and
apples through Genesys, the largest
database of plant genetic material in

Located near Decorah, IA, SSE
maintains a plant genebank of fruit,
vegetable, and flower varieties with
an emphasis on family heirlooms
and historic commercial varieties
from the United States.
Sharing information on Genesys
will allow researchers around
the world to learn about the
varieties in the SSE genebank and
compare these holdings to those in
collections around the world.

Partnerships for Children board of
directors. A November 16, 2015
deadline has been set for completed

HAWC office in Decorah.
HAWC’s mission is to promote
quality early care, wellness,
education, and intervention
opportunities for children and
families through community

members are responsible for
implementing state Early Childhood
Iowa funding to address building

to 3 years old; increasing quality

providing preschool support for

and implementation of prevention
and early intervention activities that

Elkader Keystone
Chorus show to be
held Nov. 7, 2015
The Elkader Keystone Chorus
will feature guest quartet McPhly
in its fall barbershop harmony show
November 7, 2015 at the Elkader
Opera House. McPhly, placed eighth in the
International Barbershop Harmony
Society’s 2015 competition.
They have also won the quartet
championship in the Rocky
Mountain District. They are based
in Denver, Colorado.
The Keystone Chorus will lead
the show with a selection of favorite
songs. The quartet Three Lads
and Dad will add to the show and
another quartet is preparing, as well.
The chorus is made up of about
30 men of all ages from Northeast
Iowa and Southwest Wisconsin who
love the sound of close harmony.
Tickets are $15 and are available
by calling 563-873-2378 or at
Moser Pharmacy in Elkader. You
can also ask any chorus member.
The show starts at 7 p.m.
An afterglow will be at Johnson’s
Restaurant after the show. Those

“A criminal charge is merely
an accusation. All are presumed
innocent until proven guilty in

On August 17, 2015 at about
1:24 AM, Clayton County Deputies
were dispatched to 16442 190th
Street for a burglary in progress. A
short time later, Deputies located
the suspect vehicle on the Gunder
Road, and conducted a traffic
stop. As the Deputy attempted to
stop the vehicle, three occupants
fled from the vehicle. Deputies
were able to detain one individual,
and another passenger that was
still in the vehicle. During the
investigation, Deputies located
items taken during the burglary.
It was also learned that several
other burglaries had occurred
throughout Clayton County. As a
result of the investigation, Clayton
County Deputies filed charges on
four suspects in the burglaries.
Harley Bushaw (19) of Arlington
was charged with Possession of
Marijuana, Driving while barred,
Operation without owner’s consent,
3 counts of Conspiracy to commit
an aggravated misdemeanor
(burglary), conspiracy to commit
a non-forcible felony (burglary),
and unlawful possession of a
prescription drug. Ashley Reson
(19) Maynard is being charged
with 3 counts of Conspiracy to
commit an aggravated misdemeanor
(burglary), and conspiracy to
commit a non-forcible felony
(burglary). Colton Blue (18) West
Union is being charged with
Improper Rear lamp, 3 counts
of Conspiracy to commit an
aggravated misdemeanor (burglary),
conspiracy to commit a non-forcible
felony (burglary). Lucas Bennett
(24) of West Union is being charged
with 3 counts of Conspiracy to
commit an aggravated misdemeanor
(burglary), conspiracy to commit
a non-forcible felony (burglary),
possession of drug paraphernalia,
and interference with official acts.
On September 4, 2015 at 9:00
PM, Clayton County Deputies
were dispatched to the Great River
Road near North Buena Vista. The
reporting party advised dispatchers
that his vehicle was being rammed
by another vehicle, and that it had
occurred at least 20 times. A short
time later, the caller was rammed
again, causing his vehicle to go
into the ditch, and overturn. After
a lengthy investigation, Kenneth
Hefel (50) of Sherill was arrested
and charged on September 20th
with Willful Injury (Class D
Felony), Criminal Mischief 2nd
Degree (Class D Felony), Leaving
the Scene of an accident, Reckless
driving, driving while suspended,
no insurance, failure to obtain
certificate of title, and operation
without registration. Hefel was
transported to the Clayton County
Jail.
On September 28, 2015 at about
midnight, Clayton County Sheriff’s
Deputies responded to a car vs. deer
accident on Highway 13 near 305th
Street. Upon further investigation, it
was determined that Ian Rodenberg
(36) of Guttenberg was operating a
1998 Chevrolet Cavalier when he
struck a deer in the roadway causing
$1,500 damage. No injuries were
reported.
On September 30, 2015 at 7:
17 AM Clayton County Deputies
were dispatched to a car vs.
tractor accident on Greenfield
Ave near Monona. Upon further
investigation, it was determined that
Nicholas Meyer (37) of Monona was
operating a 1969 John Deere 3020
when a 2015 Ford Windstar van
operated by Juan Lopez-Ramos (33)
of Buffalo Center attempted to pass
Meyer as he was turning left into
a field drive. Both the tractor and
van collided causing $3000 damage
to the van, and $500 to the tractor.
No injuries were reported. LopezRamos was cited for unsafe passing.
On October 3, 2015 at 6:47 AM,
Clayton County Deputies responded
to a car vs. deer accident on the
Garber Road near Ironwood Rd.
Upon further investigation, it was
determined that Nicholas Chase
(23) of Farmersburg was operating
a 2010 Chevrolet Silverado when he
struck a deer in the roadway causing
$2000 damage. No injuries were
reported.
On October 4, 2015 at 11:50
AM, Clayton County Deputies
responded to a car vs. deer accident
on Highway 52 near Nest Ave.
Upon further investigation, it was
determined that Wayne Ries (64) of
Dubuque was operating a 2015 Jeep
Grand Cherokee when he struck a
deer in the roadway causing $6000
damage. No injuries were reported.
On October 6, 2015 at 7:24 AM,
Clayton County Sheriff’s Deputies
were dispatched to a school bus
vs. deer accident on Canoe Road.
Upon further investigation, it was
determined that Ronald Hummel
(65) of Strawberry Point was
operating a 2015 Blue Bird School
bus owned by Starmont Community
Schools when he struck a deer
in the roadway causing $5,000
damage. No injuries were reported.
On October 9, 2015 at 9:20 AM,
Clayton County Deputies conducted
a traffic stop on Highway 13 near
230th Street for a traffic violation..
Upon further investigation, it
was determined that the driver,
Lynette Corkey (57) of Muscatine
had an arrest warrant for the Iowa
State Patrol for Driving While
Suspended. Corkery’s license was
currently suspended in the State
of Iowa. Corkery was arrested
and charged with Driving while
suspended, No insurance, operation
without registration, fail to carry
registration card, and failure to
display registration. Corkery was
also arrested on the Iowa State
Patrol Warrant. She was transported
to the Clayton County Jail, where
she was held pending an initial
appearance in court.
On October 9, 2015 at 9:30
PM, Clayton County Deputies
responded to a car vs. deer accident
on the Gunder Road. Upon further
investigation, it was determined that
Autumn Lamb (17) of Clermont
was operating a 2004 Dodge
Stratus when she struck deer in the
roadway causing $1,500 damage.
No injuries were reported. The

PM, Clayton County Deputies were
dispatched to 25529 Mississippi
Road for a disturbance. Upon
further investigation, Deputies
observed drug paraphernalia within
plain view. Shannon Watt (45)
of Garnavillo was arrested and
charged with drug paraphernalia.
Watt was transported to the Clayton
County Jail pending an initial
appearance in court.
On October 15, 2015 at 11:43
AM, Clayton County Deputies
were dispatched to a semi rollover
accident on the Gunder Road
near 130th Street. Upon further
investigation, it was determined that
Bradley Snitker (34) of Brownsville,
MN was operating a 2015
International 9100 when he turned
onto the Gunder Road off of 130th
Street. Snitker pulled the semi off
onto the shoulder of the road to let
traffic by, when his wheels dropped
off of the should of the roadway
causing the semi to roll causing
$20,000 damage. The Sheriff’s

on Bell Road near A Ave. Upon

determined that John Cunningham
(70) of Elkader was operating
a 2006 Buick LaCrosse when a
deer entered the roadway causing
Cunningham’s vehicle to strike the
deer causing $1,500 damage. No
injuries were reported.
On October 16, 2015 at 2:30 PM
a Clayton County Deputy assisted
a motorist who had a flat tire on
the Great River Road near Sny
Magil. While assisting the motorist,
Deputies obtained information
that an occupant of the vehicle,
Jacob Nehl (19) of Guttenberg was
required to register as a sex offender
due to a prior offense. Deputies
verified that Nehl was not registered
in Iowa as a sex offender. Nehl was
placed under arrest for failing to
register as a sex offender. Nehl was
transported to the Clayton County
Jail where he was held for his initial
appearance in court.
On October 17, 2015 at 10:06
AM, the Clayton County Sheriff’s
Office was notified of a one vehicle
rollover accident on the Great River
Road near Omega Rd which had
happened in the early morning
hours. Upon further investigation, it
was determined that Brandi Evans
(29) of Manchester was operating
a 2008 Honda when she swerved
to miss a deer, entered the ditch
and rolled the vehicle. Evans was
uninjured in the accident. Deputies
observed signs of impairment
from Evans, and conducted an
investigation to determine if Evans
was impaired. Evans was arrested
and charged with OWI- 2nd offense,
and Failure to Maintain Control.

On October 21, 2015 at 7:39
AM, Clayton County Sheriff’s
Deputies responded to a car vs deer
accident on Highway 52 near Kale
Ave. Upon further investigation, it
was determined that Jane Robinson
of Garnavillo was operating a 2001
Chevrolet Malibu on Highway
52 when she struck a deer in the
roadway causing $1,500 damage.
No injuries were reported.

Bowden opened a public hearing on the CAFO

there is a manure spill. He emailed health studies to the Supervisors for their review. He also
voiced concerns over air quality in the area if
the project was allowed to move forward. The
public hearing was closed at 10:50.
In the absence of the applicants, the Supervisors took no action on the issue due to lack of
information.

the flu. You don’t get sick from
going outside without a hat. The
Influenza virus survives best in low
humidity, and relative humidity is
lower in the fall and winter. Indoor
spaces have even less humidity,
so you are more likely to contract
the flu when you spend more time
inside.
This is a weekly feature highlighting some of Iowa’s unsolved homicides in the hopes that it
will lead to new tips and potentially help solve cases. The project is a partnership between this
newspaper and other members of the Iowa Newspaper Association.
Jorge “Louie” Gutierrez, Sr
Louie Gutierrez, of East Moline,
Ill., was found wrapped in a sleeping
bag in the bed of his maroon 1983
Chevrolet pick-up truck in the early
Jorge “Louie” Gutierrez, Sr, 47,
Died Oct. 19, 2004,
Location: Davenport
afternoon of October 19, 2004. The
truck, which was covered in Dallas
Cowboys stickers, was parked along
the Mississippi River in the 3400
block of South Concorde Street in
Davenport. Gutierrez was believed
to have been killed two days earlier, on Oct. 17, 2004, as a result of
blunt force trauma to the head.
Because his body was left to
make it look like he died in his
sleep, coupled with other evidence
in the case, his family believes the
people responsible for his death
must have known him. Family
members also believe that more
than one person is responsible for
his death because he was a burly
man, and it would take more than
one person to carry him.

4. You can spread the flu virus
without showing symptoms. 20%
to 30% of people carrying the
influenza virus have no symptoms.
A simple, uncovered cough or
sneeze can easily spread the virus
up to 35 feet.
5. You still need the vaccine
even if you’ve already had the flu
this year. Getting the flu does not
make you immune to it. Although
effective, the flu vaccine does not
cover all Influenza strains. The
FDA selects three or four influenza
viruses each year to create the
vaccine. It’s possible to have
contracted one strain but you still
need protection from the others.
6. If you get the flu and you’ve
been vaccinated, it doesn’t mean the
shot didn't work. The flu vaccine is
about 60 to 90% effective. Multiple
strains of the virus circulate every
year, and it's difficult to predict
which strains will be dominant.
If you get the flu it means that
you acquired a different strain not
included in the vaccine. Because
of your original vaccine, your
symptoms will be less severe, and
it won’t last as long even with the
different strain.
7. Your flu vaccination last year
does not protect you this year. Flu
viruses are always changing. They
can vary from year to year so it
is important to stay up to date on
vaccinations to protect against the
new strains.

It may seem unusual for a
prosecutor to be writing on this
topic, especially one who has never
been a criminal defense attorney.
There are undoubtedly many
attorneys who, having actually
served in this role, could provide
a more complete, detailed and
eloquent explanation on this subject.
That being said, it’s a worthwhile
topic of discussion even if only from
a prosecutor’s perspective because
a criminal defense attorney has a
job that is very important and often
misconstrued.
The role of a criminal defense
attorney starts with a fundamental
principle found in both the United
States and Iowa Constitutions: a
person accused of a committing a
crime is guaranteed the right to the
assistance of counsel for his or her
defense. If a defendant is indigent
and could be facing incarceration,
an attorney is appointed to represent
the defendant at the government’s
expense. In other words, the law
mandates that a defendant be
represented in a criminal case
unless this right has been knowingly
and voluntarily waived or forfeited
by misconduct.
A criminal defense attorney’s job
is to advocate for the best interests
of his or her client, the defendant.
Traditionally this advocacy comes
in the form of challenging state’s
evidence, presenting evidence
favorable to the defendant, and
making legal arguments on the
defendant’s behalf, all of which
occur at contested proceedings
before a judge or jury.
Advocacy also occurs behind
the scenes through negotiation with

question in a case is not whether
the defendant committed the crime
but rather what the appropriate
punishment should be, a criminal
defense attorney advocates for
the defendant by identifying and
emphasizing factors which suggest
a sentence on the more lenient end
of the spectrum and by responding
to and minimizing factors which
suggest a more severe sentence.
I’m occasionally asked to
speculate why a lawyer would
represent a defendant charged with
a particularly heinous crime. My
answer is that a criminal defense
attorney must be able to separate
personal feelings about a case from
their professional obligation to
advocate for the defendant. That
may be an exceptionally difficult
task for cases with sympathetic
victims or unsympathetic
defendants but if no one was willing
to do this job then the constitutional
guarantee of an attorney for all
criminal defendants would have no
meaning.
Overall there are many
individuals and organizations
with the ability to hold defendants
accountable: the legislature decides
what constitutes a crime and the
range of appropriate punishments,
law enforcement investigates,
apprehends, and charges those
who violate the law, county
attorneys serve as prosecutors,
juries determine a defendant’s
guilt or innocence, and judges
sentence defendants. Criminal
defense attorneys are a watchdog
and balancing factor over all these
groups. By serving as an advocate
for the defendant, criminal defense
attorneys help to ensure that an
innocent person is not convicted
and a guilty verdict is only returned
after the defendant’s constitutional
rights are recognized and due
process of law is followed every
step of the way down the path
towards justice for all.

Schutte finishes
47th at State Cross
Country Meet
As a first year runner, Freshman
Hannah Schutte qualified as a participant
at the State Cross Country Meet in Fort
Dodge where she represented MFL
MarMac in fine fashion.
After qualifying in the top 15 at the
regional level, Schutte was honored with
a fire truck escort into town and upon
arrival at the school, she had the chance
to ring the victory bell.
As a state participant, Hannah ran at
Fort Dodge on Halloween, October 31.
As a freshman, Schutte was in the top
third of the finishers as she was 47th out
of 156 runners.
Coaches Eliza Philpott and Eric
Koenig were a force in Hannah’s success
as they pushed her to reach for her goals
throughout the year. They encouraged
her and reminded her that goals can
happen with hard work and dedication.
Northeast Iowa was very well
represented at the State Cross Country
Meet. In IA Elkader Central placed first.
In 2A South Winn Placed third; in 3A
Decorah placed fifth.
