TERMS AND CONDITIONS OF SALE
1. The Bucking Stock Sale Management acts only as an Agent. All responsibilities and guarantees are between Buyer and Seller.
2. The Bucking Stock Sale Management is not responsible for injuries to
persons or animals.
3. The highest bidder will be the buyer, and if a dispute arises between
two or more bidders the horse or bull shall immediately be put up
again for advance bids. If there are no advance bids, the horse or bull
shall go to the person from whom the auctioneer recognized the last
bid. The auctioneer will decline any bid made by parties who have
defaulted in former purchases, or by persons who, in his judgment, are
not responsible bidders.
4. Every effort has been made to assure correctness of the catalog but
the sales management and auctioneer are not responsible for errors or
omissions, and assume no liability on its part or on the part of the seller
as to any statements, either verbal or written, regarding horses or bulls
sold.
5. Upon failure of compliance with any of the above conditions, the lot
shall be resold by public or private sale, and the deficiency (if any)
shall be made good by the defaulter immediately.
6. *Buyers must register at the Sale Office and receive a number prior to
the beginning of the auction. Please provide a valid driver’s license to
register.
7. Terms of the sale are cash. We do not accept debit or credit cards.
8. Any consignor who PO’s the sale of their animal will be charged $150
PLUS the $100 consignment fee
9. Payment in full is to be made to the cashier immediately after the sale.
Possession of livestock cannot be obtained until payment in full has
been made.
10.BUYERS - Attention Canadian Buyers - We will accept Canadian checks
only if the check is payable in U.S. funds.
11.All buyer’s must pay for ALL stock purchased under their bidder number. NO items will be transferred to another number when paying.
12.Upon receiving payment for a horse or bull, the cashier will issue an
order to obtain delivery. Buyers are cautioned not to lose these orders.
Buyers assume all expenses and risks on horses or bulls after they have
left the auction ring. Buyers must make arrangements with the sale company for care of stock until it can be removed if it cannot be removed
by specified time.
13.All livestock is sold as is. All known defects will be announced before
each animal is started. Every horse or bull will be sold under this rule.
Therefore, no horse or bull can be rejected by buyer when struck off
by auctioneer. The seller guarantees all mares were bred to stallions
and all cows were bred to bulls as specified in the catalog. We believe
them to be bred, but are selling them as they are and without return
privileges, unless otherwise specified.
14.Immediately after the horse or bull is sold, it will be the sole risk and
responsibility of the buyer thereof, The Bucking Stock Sale Management is not responsible for any injuries or death to any animal bought
or sold.
15.SELLERS - All checks to pay out sale proceeds to the seller will only be
issued to the name(s) listed in the catalog - No split or revised names
will be made on checks.
16.Sellers will be charged a catalog fee of $100 per consigned animal
and 10% commission. All deductions will be retained from seller’s
check.
17.Buyers and Spectators are cautioned to be careful while on the premises and particularly while livestock is being bucked in the arena. The
Management cannot be responsible for any accidents.
18.Sale horses and bulls will be received beginning at 9am Monday January 13th and removed by midnight Wednesday January 15th
19.Consignors are reminded to bring any and all necessary health and
test papers required to transport livestock in the U.S. and paperwork
will be turned into the office when the animal is unloaded. NO ANIMAL WILL BE UNLOADED WITHOUT PROPER PAPERWORK.
