March 12, 2012 Cartersville, Georgia The Bartow County Board of Education met for the Work Session on March 12, 2012 at 6:00 p.m., at the Board of Education Office, 65 Gilreath Road, Cartersville, Georgia, with the following members present:
Dr. Davis Nelson, Chairman; Mrs. Angie Cornett, Vice Chair; Mrs. Wanda Cagle Gray, Mr. John Howard and Mrs. Anna Sullivan Call to Order Dr. Davis Nelson called the meeting to order. Recognitions March 12‐ 16, 2012 is Board Member Appreciation Week throughout the state of Georgia. All of our schools participated in celebrating the dedication that each of our board members exhibit daily to the students of Bartow County. Public Participation One individual addressed the board with middle school sports concerns; one individual spoke regarding redistricting of two of our elementary schools. Superintendent’s Dr. Harper discussed the redistricting of Euharlee Elementary and Taylorsville Report Elementary schools. Department Mr. Pankaj Daiya, Director of Construction and Maintenance, Mr. Todd Hooper, Chief Financial Officer gave department reports. Reports Regular Board The agenda for the upcoming Board Business Meeting on March 19, 2012 Agenda was discussed. March 12, 2012 Cartersville, Georgia The Bartow County Board of Education met for a Called Meeting on March 12, 2012 immediately following the Work Session at 6:00 p.m., at the Board of Education Office, 65 Gilreath Road, Cartersville, Georgia, with the following members present: Dr. Davis Nelson, Chair, Mrs. Angie Cornett, Vice Chair, Mrs. Wanda Cagle Gray, Mr. John Howard, and Mrs. Anna Sullivan Call to Order Dr. Davis Nelson called the meeting to order. FY 13 Budget Upon motion duly made by Mr. John Howard and seconded by Mrs. Wanda Reduction Plan Cagle Gray, the following resolution was passed by a vote of 5‐0 : BE IT RESOLVED by the Board of Education of Bartow County, Georgia, that the FY 13 Budget Reduction Plan be approved as presented by the Superintendent.
Executive Upon motion duly made by Mrs. Angie Cornett and seconded by Mrs. Anna Session Sullivan, the following resolution was passed by a vote of 5‐0 to wit: BE IT RESOLVED by the Board of Education of Bartow County, Georgia, that the Board go into Executive Session to discuss personnel. March 19, 2012 Cartersville, Georgia The Bartow County Board of Education met for the Regular Board Business Meeting on Monday, March 19, 2012 at 6:00 p.m., at 65 Gilreath Road, Cartersville, Georgia, with the following members present: Dr. Davis Nelson, Chairman, Mrs. Angie Cornett, Vice Chair, Mrs. Wanda Cagle Gray, Mr. John Howard and Mrs. Anna Sullivan Call to Order Dr. Davis Nelson called the meeting to order. Public Two individuals requested to speak regarding the proposed millage increase and Participation District 5 Board of Education seat Character Kingston Elementary presented the character education word of the month of Self‐
Education and Discipline. Ms. Dot Frasier recognized numerous students and staff. Recognitions Superintendent’s Dr. Harper announced the Euharlee and Taylorsville Redistricting Parent Meeting. The Report meeting will be held on March 22, 2012 at 6pm at Taylorsville Elementary. INTERGOVERNMENTAL AGREEMENT
THIS INTERGOVERNMENTAL AGREEMENT, (hereinafter, “Agreement”) is made
and entered into this ____ day of _______________, 20____, by and between THE BOARD OF
EDUCATION OF BARTOW COUNTY, GEORGIA (hereinafter, the “Board of Education”),
BARTOW COUNTY, GEORGIA (hereinafter, the “County”), and THE BARTOW COUNTY
SHERIFF (hereinafter, the “Sheriff”)
W I T N E S S E T H T H A T:
WHEREAS, the Board of Education is the governing body for the Bartow County
School
District,
a
political
subdivision
of
the
State
of
Georgia
pursuant
to
Article VIII, Section V, Paragraph I of the 1983 Georgia Constitution, operating under the laws
and regulations of this State; and
WHEREAS, the County is a political subdivision of the State of Georgia pursuant to
Article IX, Section III, Paragraph I of the 1983 Constitution of Georgia, operating under the laws
and regulations of this State; and
WHEREAS, the Sheriff is a constitutional officer of the State of Georgia pursuant to
Article IX, Section I, Paragraph III of the 1983 Constitution of Georgia authorized to serve as the
law enforcement agent in Bartow County; and
WHEREAS, pursuant to Article IX, Section III, Paragraph I of the 1983 Constitution of
Georgia, the parties are authorized to contract with one another for a purpose which the parties
are otherwise authorized by law to undertake or provide; and
WHEREAS, the governing authority of the Board of Education and the County, as well
as the Sheriff, independently charged to act in the best interest of the citizens of Bartow County,

have each examined the needs of the citizens and have determined that it is in the best interest of
the citizens to provide certain services which are authorized by law; and
WHEREAS, in consideration of the mutual benefits and consideration accruing to each
of the parties hereto, which benefits are hereby expressly acknowledged, the parties have
determined that it is in the best interest of the citizens of Bartow County to enter an agreement
for the following purposes; and
WHEREAS, the parties share concerns about the safety of students while on Board of
Education school buses traveling on public roads throughout Bartow County; and
WHEREAS, the Georgia General Assembly, during the 2011 Regular Session, amended
O.C.G.A. § 40-6-163 to add a new subsection (d) regarding the use of video recording devices to
capture evidence of vehicles meeting or overtaking a school bus and to provide notice and
procedures for violations of said code section; and
WHEREAS, the law enforcement agency authorized to enforce O.C.G.A. § 40-6-163 has
certain responsibilities with regard to verification and notification to violators of O.C.G.A. § 406-163(a); and
WHEREAS, O.C.G.A. § 40-6-163(d)(9) authorizes school systems to enter into
intergovernmental agreements pertaining to an offset of expenses regarding the implementation
and ongoing operation of video recording devices utilized for the purposes stated in O.C.G.A. §
40-6-163; and
WHEREAS, the parties agree that video recording devices authorized by O.C.G.A. § 406-163(d) would be a beneficial tool to provide an additional safety mechanism for school
students and to deter violations of the Uniform Rules of the Road, specifically O.C.G.A. § 40-6163(a); and

WHEREAS, the parties desire to enter into an agreement whereby the Board of
Education shall procure certain video recording devices and related equipment in furtherance of
O.C.G.A. § 40-6-163, shall affix said video recording devices to the exterior of school buses
owned by the Board of Education and install related equipment on or within the buses; and
WHEREAS, the parties desire to enter into an agreement whereby the Board of
Education will provide data to the Sheriff pursuant to O.C.G.A. § 40-6-163 for the purpose of
enforcing violations of said law and the Sheriff in turn will fulfill the law enforcement duties
stated therein; and
WHEREAS, the parties desire to enter into an agreement whereby the County will
prosecute violations of O.C.G.A. § 40-6-163, collect civil penalties thereunder, and remit a
percentage of the civil penalties to the Board of Education as compensation for the Board of
Education authorizing use of school buses to facilitate the devices and equipment; and
WHEREAS, the parties desire to enter into an agreement whereby the County will remit
a percentage of said civil penalties to the Sheriff in order to defray the administrative costs
incurred by the Sheriff while facilitating enforcement of O.C.G.A. § 40-6-163; and
WHEREAS, furthermore, the Board of Education will benefit from the equipment’s
enhanced safety features while operating buses, augment the Board of Education’s ability to
protect and provide for the welfare of students under the care of the Board of Education, and
alleviate the obligations of Board of Education bus driver employees to report a violation of
O.C.G.A. § 40-6-163; and
WHEREAS, the data generated by the devices and equipment procured and installed by
the Board of Education on school buses will provide an enhanced law enforcement tool to the

County and Sheriff and afford the Sheriff with greater flexibility in the allocation of law
enforcement resources; and
WHEREAS, the execution, delivery and performance of this Agreement by all parties
has been authorized by resolutions, ordinances duly adopted by the respective governing body of
the Board of Education and the County at public meetings conducted pursuant to the Open
Meetings Act, O.C.G.A. § 50-14-1 et seq.; and
WHEREAS, the execution, delivery and performance of this Agreement by all parties
has the full support and agreement of the Sheriff as evidence by the Sheriff’s signature hereto;
and
NOW THEREFORE, in consideration of mutual covenants and promises and the
authority granted to these parties by the laws of Georgia, the undersigned parties hereby enter
into and agree to be bound by the provisions set forth in the preamble of this Agreement as if
fully set forth below and the following provisions.
1.
RECITALS
The foregoing recitals, each being true, are made a part of this Agreement by reference.
2.
TERM
The term of this Agreement shall commence upon the last date that this Agreement has
been executed and delivered by each of the parties and shall terminate upon the passing of any of
the following events, whichever occurs first:
(a)
fifty (50) years from the date of commencement of this Agreement:

(b)
upon sixty (60) days’ written notice from any party evidencing the governing
body’s adoption of a binding resolution declaring its intentions to terminate this
Agreement.
(c)
upon thirty (30) written notice of intent to terminate for cause from any party after
due notice and an opportunity to cure a material breach have been afforded in
conformance to the notice requirements of this Agreement.
(d)
upon thirty (30) days after the Board of Education ceases to have a contract with a
third party to supply and maintain the equipment and devices and supply the
images necessary to comply with O.C.G.A. § 40-6-163.
3.
REPRESENTATIONS OF THE PARTIES
Each party hereto makes the following representations and warranties which are
specifically relied upon by all of the other parties as a basis for entering into this Agreement:
(a)
All parties have the legal authority to enter into this Agreement under the laws of
the State of Georgia and the United States of America; and
(b)
All parties agree to perform and complete all of the obligations described herein;
and
(c)
All parties stipulate that this Agreement shall be binding upon the parties and
their assigns, employees, agents, representatives, and successors in office for the
fifty-year term of this Agreement as authorized by law; and
(d)
All parties agree that they are subject to O.C.G.A. § 40-6-163.

4.
OBLIGATIONS OF THE BOARD OF EDUCATION
OF BARTOW COUNTY, GEORGIA
(a)
Procurement of Devices and Equipment.
Within 30 days of the execution of
this Agreement, the Board of Education shall enter into an agreement to procure
devices and equipment which are capable of performing in accordance with the
requirements of O.C.G.A. § 40-6-163.
The Board of Education shall be
responsible for installing the devices and equipment on the Board of Education
buses within 30 days of the execution of this Agreement.
(b)
Costs. The Board of Education shall be financially responsible for all costs
associated with the following:
(i)
procurement of the devices and equipment;
(ii)
any scheduled maintenance contract provided by the manufacturer or
supplier of the devices and equipment;
(iii)
costs associated with transferring the data to the Sheriff in furtherance of
O.C.G.A. § 40-6-163.
(iv)
general monitoring of the installed devices and equipment and reporting to
the County of any maintenance or functionality concerns noted by Board
of Education Employees during routine bus maintenance;
(v)
any increase in insurance as a result of the installed devices and
equipment; and

(vi)
publication
on
the
Board
of
Education
website
and
general
communications regarding the rules, procedures, features and benefits
concerning the installed devices and equipment.
(c)
Communication. The Board of Education shall communicate with the County and
Sheriff in writing within five (5) working days of any Board of Education
employee becoming aware of any concerns regarding the performance,
functionality or physical condition of the installed devices and equipment. The
Board of Education shall communicate to the Sheriff within five (5) working days
any bus containing installed devices and equipment that has become mechanically
inoperable or will not be used to transport students for a period of ten (10) or
more days.
(d)
Reporting. The Board of Education shall provide the County and the Sheriff with
written reports after installation is completed, to include the following
information:
(i)
manifest of all buses with the installed devices and equipment by bus
number and location;
(ii)
description of the route traveled by each bus with the installed devices and
equipment on the manifest;
(iii)
documentation of any functionality concerns or physical damage to the
installed equipment and devices; and
(iv)
periodic (meaning every sixty (60) days or less) written amendments of
the reports listed in this subsection to reflect all updates and changes
to the information contained therein .

(e)
Inspection. The Board of Education shall provide the County, Sheriff, and their
designated representatives access to the devices and equipment during and
subsequent to the installation process at times mutually convenient to the Board of
Education and the County. Said access shall not be unreasonably withheld.
(f)
Access to Generated Data.
The Board of Education shall provide to the Sheriff
all authorizations, access information and other data necessary for the Sheriff to
access and utilize the data generated from the devices and equipment in
furtherance of O.C.G.A. § 40-6-163.
5.
OBLIGATIONS OF BARTOW COUNTY, GEORGIA
(a)
Operation of Courts. The County shall allocate resources for the prosecution of
violations of O.C.G.A. § 40-6-163 in County courts designated to hear violations
of O.C.G.A. § 40-6-163 and shall take all steps necessary to facilitate the duties of
the Board of Education and the Sheriff created by this Agreement and O.C.G.A. §
40-6-163.
(b)
Compensation to the Board of Education. The County shall pay the Board of
Education $195 or 65% of each ticket processed and paid during the previous
month. For tickets that are processed and paid at a rate less than $300, the County
shall pay the Board of Education the lessor of $195 or 100% of the total fine
amount.
Said compensation shall be due and payable within each successive
thirty-day period following execution of this Agreement and for every subsequent
month during the term of this Agreement. The civil penalties from which said
compensation is to be drawn from shall be limited to those civil penalties

collected during the applicable period by those courts in the County having
jurisdiction over violations of the Uniform Rules of the Road and which are
obligated to deposit civil penalties into the County general fund. All parties agree
that said compensation is due consideration for the Board of Education providing
the County with access to and use of the Board of Education buses, associated
insurance, if any, administration, and as a reflection of the enhanced law
enforcement tool and safety measures to benefit the public.
(c)
Inspection.
The County and Sheriff by and through their designated
representatives shall be authorized to conduct inspections of the devices and
equipment during and subsequent to the installation process at times mutually
convenient to the parties.
6.
OBLIGATIONS OF BARTOW COUNTY SHERIFF
(a)
Obligations under O.C.G.A. § 40-6-163.
The Sheriff acknowledges that the
Sheriff and its qualified employees shall serve as “law enforcement” as that term
is used in O.C.G.A. § 40-6-163 and shall fulfill the duties therein assigned to law
enforcement, including but not limited to issuing citations, sending notices,
preparing verifications and summons, serving as a witness when necessary, and
otherwise facilitating prosecution of O.C.G.A. § 40-6-163, the costs of said law
enforcement duties being born by the Sheriff.
(b)
Cooperation with the Board of Education and County. The Sheriff agrees to
cooperate with the Board of Education and the County to receive and process

physical evidence demonstrating of violations of O.C.G.A. § 40-6-163, and shall
comply with all laws and procedures regarding evidence and chain of custody.
(c)
Reporting. The Sheriff shall provide the County and the Board of Education with
written reports during the term of this Agreement, to include the following
information:
(i)
summary report of all citations issued for violations of O.C.G.A. § 40-6163 within thirty (30) days of the issuance of said citation; and
(ii)
summary report of all notices, summons and certifications prepared
pursuant to O.C.G.A. § 40-6-163 within thirty (30) days of the issuance of
same; and
(iv)
periodic written amendments of the reports listed in this subsection
to reflect all updates and changes to the information contained therein.
7.
OWNERSHIP AND CONTROL OF DATA
As between the Board of Education, the County and the Sheriff, the data generated by the
devices and equipment which are the subject of this Agreement (“generated data”) shall at all
times remain the property of the Board of Education. Neither the County nor the Sheriff shall
have rights to duplicate, mirror, alter, destroy or tamper with the generated data except as
otherwise expressly approved by the Board of Education and only for the furtherance of this
Agreement. In the event a third party makes a request for access to generated data, the County or
Sheriff shall respond that the County or Sheriff is not the custodian of the generated data and any
inquiry should be made of the Board of Education. It is the understanding of all parties that such
generated data may be exempt from federal and state law regarding access to public records,

including but not limited to the Georgia Open Records Act, codified at O.C.G.A. § 50-18-70 et
seq.
8.
FORCE MAJEURE
If, by reason of force majeure, any party hereto shall be rendered unable wholly, or in
part, to carry out its obligations under this Agreement, then if such party shall give written notice
in full particulars of such force majeure to the other party within a reasonable time after
occurrence of the event or cause relied on, the obligation of the party giving such notice, so far as
it is affected by such force majeure, shall be suspended during the continuance of the inability
then claimed, but for no longer period, and any such party shall endeavor to remove or overcome
such inability with all reasonable dispatch. The term “force majeure” as employed herein, shall
mean acts of God, strikes, lockouts, or other industrial disturbances, acts of a public enemy,
orders, refusals or denials of any required permit(s) of any kind from the government of the
United States or the State of Georgia, or any agency thereof, or any civil or military authority,
insurrections, riots, epidemics, earthquakes, restraint of government and people, civil
disturbances, explosions, breakage or accidents to machinery, pipelines, or inability on the part
of the Board of Education to operate buses with the devices and equipment described herein
because of any of the above-stated instances, or on account of any other cause not reasonably
within the control of the party claiming such inability.

BREACH OF CONTRACT

In the event that any party to this Agreement contends that any other party has breached
the terms of this Agreement, written notice of the breach shall be forwarded to the other parties
by certified mail. If the stated breach is not remedied within thirty (30) days of the receipt of
said notice, the aggrieved party may submit a claim to dispute resolution, as provided in the
section below entitled “Dispute Resolution” or declare in writing that the offending party has
failed to cure their breach and the Agreement is thereby terminated.
10.
DISPUTE RESOLUTION
The parties hereby agree to submit any controversy arising under this Agreement for nonbinding mediation. Any party may file a petition in the Superior Court of the County with notice
to all other parties and request that the presiding judge appoint a neutral mediator within thirty
(30) days of receipt of the petition.
Where the mediation is unsuccessful, the neutral party or parties shall prepare a report
which shall be provided to each governing authority and made a public record. The cost of
mediation authorized by this section shall be shared equally by the disputing parties. Thereafter,
any party who remains aggrieved may file suit in the Superior Court of the County to enforce
any breach of this Agreement following ten (10) days written notice to the other parties of the
aggrieved party’s intent to file suit.
11.

Any notices required to be sent under the provisions of this Agreement shall be sent to the

12.
This Agreement is solely for the benefit of the formal parties hereto and no right or cause
of action shall accrue upon or by reason hereof, to or for the benefit of any third party not a
formal party hereto.
13.
This Agreement sets forth the entire understanding between the parties and no
representations or warranties not contained herein shall be binding upon the undersigned.
14.
This Agreement may be modified in writing by mutual agreement of the parties. No
waiver, modification, or amendment of any term, condition, or provision of this
Intergovernmental Agreement will be valid or of any force or effect unless made in writing and
signed by the parties hereto. The Agreement shall also be revised whenever necessary to meet
the requirements of federal and state laws, regulations, or orders.

This Agreement shall be administered and interpreted under the laws of the State of
Georgia. Jurisdiction of any and all litigation arising out this Agreement shall be in the State of
Georgia and venue shall lie in the county set forth at the beginning of this Agreement.
16.
In the event any portion of this Agreement shall be declared or adjudged invalid or
unconstitutional, it is the intention of the parties hereto that such adjudications shall in no manner
affect the other sections, sentences, clauses or phrases of this Agreement which shall remain in
full force and effect as if the invalid or unconstitutional section, sentence, clause or phrase were
not originally part of this Intergovernmental Agreement.
17.
Upon execution, this Agreement shall be entered upon the minutes of the next scheduled
Board of Education Meeting and County Commissioner Meeting as a fully authorized
Intergovernmental Agreement.
