D
e echte parels onder de springpaarden zijn zeldzaam. Exclusief voor u is een selectie van
getalenteerde springpaarden gescout door Jeroen Dubbeldam, Ben Schröder, Wim Schröder
en Mario Everse. Stuk voor stuk professionals met een groot palmares in de springsport.
De eerste editie van de Jumping Talent Sale vindt plaats op de vooravond van Jumping Amsterdam,
op woensdag 28 januari 2015, in de Amsterdam RAI.
Na een zorgvuldige en langdurige selectieprocedure komen alleen de beste jonge springpaarden
onder de hamer. Professionele trainers en ruiters hebben deze talenten, onder begeleiding van de
initiatiefnemers, voorbereid op een internationale sportcarrière. Met gepaste trots wordt in deze
catalogus de selectie van de Jumping Talent Sale
aan u gepresenteerd.

de video’s van de paarden, die u tevens kunt

Exclusively for you, a selection of talented
jumpers have been scouted by Jeroen
Dubbeldam, Ben Schröder, Wim Schröder and
Mario Everse. All professionals with an
­impressive record of achievements in show
jumping. The first edition of the Jumping Talent
Sale will be held on the eve of Jumping
­Amsterdam, on Wednesday 28 January 2015,
in the Amsterdam RAI.
After a careful and prolonged selection procedure only the best young jumpers will be auctioned.
Under the guidance of the initiators, professional trainers and riders have prepared these talents
for an international career. In this catalogue the selection of the Jumping Talent Sale is proudly
presented to you.
In front of this catalogue you will find a USB-stick with the videos of the horses, which can also
be viewed on www.jumpingtalentsale.nl. We are looking forward to seeing you on Wednesday
28 January in the Amsterdam RAI.

Initiatiefnemers / Initiators
Jeroen Dubbeldam
Jeroen (Zwolle, 15 april 1973) runt in Weerselo zijn eigen springstal
‘Stal de Sjiem’. Deze stal heeft zijn naam te danken aan het paard
waarmee hij wereldberoemd is geworden door het hoogst haalbare
te winnen: Olympisch goud in Sydney (2000) en de Grote Prijs van
Aken. Met BMC Nassau won Jeroen in 2005 de Nations Cup van
Barcelona en op het Europees kampioenschap in San Patrignano
team- en individueel brons. In 2006 veroverde het Nederlandse
springteam, waar Jeroen en BMC Up and Down deel van uit­
maakten, teamgoud op de Wereldruiterspelen in Aken.
In 2007 maakten zij weer deel uit van een gouden team.
De succesreeks zet Jeroen ook in 2014 voort, in het bijzonder
afgelopen zomer op de Wereldruiterspelen in Normandië. Hier
vormden Maikel van der Vleuten, Jur Vrieling, Gerco Schröder én
Jeroen Dubbeldam een gouden team met een oranje tintje. Ook won Jeroen individueel goud met
­Zenith SFN na de alom bekende paardenwissel.
Jeroen (Zwolle, 15 April 1973) runs his own jumping stables in Weerselo by the name of ‘Stal de Sjiem’,
called after the horse on which he became world famous by winning the highest achievements
possible: the Olympic title in Sydney and the Aachen Grand Prix. In 2006 the Dutch show jumping
team in which Jeroen with BMC Up and Down took part won team gold at the Aachen World
Equestrian Games. In 2007 they were again part of the golden team. After all these successes 2014 was
again a great year for Jeroen! At the World Equistrian Games he achieved fantastic results. Maikel van
der Vleuten, Jur Vrieling, Gerco Schröder and Jeroen Dubbeldam formed the golden team with an
orange touch. Jeroen also won individual gold with Zenith SFN after the well-known horse-switches.
Ben Schröder
Ben (Tubbergen, 17 april 1971) is de tweelingbroer van Wim en
oudere broer van Gerco Schröder. Samen met zijn tweelingbroer
werd Ben opgeleid door Hans Bijen van Stal Maathuis. Later is
Ben gaan werken voor Wim van der Vorm van de Margaretha
Hoeve. Hier is hij Bollvorm’s Athletico gaan rijden en heeft
vervolgens het Nederlands Kampioenschap op zijn naam geschreven. Vervolgens is Ben verder gegaan als zelfstandig ruiter en heeft
onder andere Unaniem verkocht aan Athina Onassis. Ben is een
uitstekende trainer die paarden kan opleiden tot Grand Prix niveau.
Samen met Wim runt hij de BWG Stables in Tubbergen.
Ben (Tubbergen, 17 April 1971) is the twin brother of Wim and elder
brother of Gerco Schröder. Together with his twin brother, Ben was
trained by Hans Bijen from Stal Maathuis. Later on Ben was employed by Wim van der Vorm from the
Margaretha Hoeve and became Dutch Champion with Bollvorm’s Athletico. After this Ben continued
as an individual rider and amongst others was able to sell Unaniem to Athina Onassis. Ben is an
excellent trainer who can bring any horse to Grand Prix level. Together with Wim he runs BWG
Stables in Tubbergen.

Initiatiefnemers / Initiators
Wim Schröder
Wim (Tubbergen, 17 april 1971) is de oudere broer van Gerco en de
tweelingbroer van Ben. Wim was vanaf het begin verbonden aan Stal
Eurocommerce en tevens voor een groot deel verantwoordelijk voor
het succes van deze over de gehele wereld bekende springstal.
Wim heeft onder andere met Eurocommerce Montreal gesprongen
tijdens de Olympische spelen in Athene waar hij vierde werd.
Hiernaast heeft Wim zich ontwikkeld tot topscout van toptalent.
London, de Olympische hengst onder Gerco, is door Wim ontdekt.
Samen met Ben runt hij de BWG Stables in Tubbergen.
Wim (Tubbergen, 17 April 1971) is the elder brother of Gerco and
twin brother of Ben. Wim has been committed to Stal
­Eurocommerce from the start and is also largely responsible for the
success of this world famous jumping stable. Wim jumped with Eurocommerce Montreal amongst
others at the Atlanta Olympics where he came in fourth. In addition, he has developed himself to a
top-class scout of top-talent horses. He discovered London, the Olympic Stallion on which Gerco is
currently very successful. Together with Ben he runs BWG Stables in Tubbergen.
Mario Everse
Mario (Rotterdam, 2 september 1969) kapper van oorsprong nam
zeven jaar geleden voor het laatst zijn schaar in de hand en knipte
de knoop door. De kapper werd paardenhandelaar en hierin is hij
zeer succesvol. Samen met zijn vrouw Micha Everse runt hij Stal
Everse in Waddinxveen. Enkele jaren geleden startten zelfs zeven
paarden van Stal Everse op het WK in ­Zangersheide, waarvan vier
uit eigen fokkerij. Jonge paarden fokken of kopen, trainen en
verkopen is zijn handelsmerk, waarbij kwaliteit hoog in het vaandel
staat. De meeste mensen kennen Mario van de hengst Big Star,
Olympisch Kampioen en winnaar van de Grote Prijs van Aken.
Mario (Rotterdam, 2 September 1969), hairdresser from origin used
his scissors for the last time seven years ago and became a successful
horse dealer. Together with his wife Mischa Everse he runs Stal Everse in Waddinxveen. A few years
ago seven horses from Stal Everse jumped at the World Championships in Zangersheide, of whom
four of their own breeding. To buy or breed young horses, train and sell them is his trademark, in
which quality is highly valuated. Most people know Mario from the famous stallion Big Star, Olympic
Champion and winner of the Aachen Grand Prix.

Uitproberen
Als u naar aanleiding van de catalogus of
presentatie video één van de paarden wilt
uitproberen kunt u via de organisatie een
afspraak maken met de initiatiefnemers. Tijdens de veiling worden de paarden uiteraard

Veterinaire rapporten
Alle paarden zijn binnen 3 maanden
­voorafgaand aan de veiling klinisch en
röntgenologisch onderzocht. De rapporten
liggen op de dag van de veiling ter inzage op
het organisatiekantoor. Tevens is er een
veterinair aanwezig om toelichting te geven op
de rapporten. Indien u eerder informatie wenst
te ontvangen kunt u contact opnemen met de
organisatie. Bieders en kopers worden geacht
bekend te zijn met de inhoud van boven­
genoemde bescheiden.

Auction order
The order in the catalogue is different from the
order in the auction. The official order of the
horses in the auction will be announced at the
beginning of the auction on Wednesday
28 January 2015.

In the back of the catalogue the complete
conditions of auction can be found. In cases of
dispute only the Dutch version is binding, the
English version is only meant as an explanation
of the Dutch version.

In the three months before the auction, all
horses have been X-rayed and clinically
examined. The reports and X-rays are available
for viewing on Wednesday 28 January at the
Jumping Talent Sale Office in the Amsterdam
RAI. The organization veterinary will be
present to supply explanations of the reports
and X-rays. If you want to receive information
earlier you can contact the organization.
Bidders and purchasers are presumed to be

fokkerij van springpaarden. Moeder Prima
Donna Z sprong 1.30m tot een blessure haar
sportcarrière deed beëindigen. Halfbroer
Ami Z van Air Jordan is een goedgekeurde
hengst. Vader Picasso Z sprong op het hoogste
niveau met Alvaro de Miranda net als zijn zoon
AD Wilbert Z.

lightfooted and with good reflexes. She is by
Cantos, a son of Contender who contributes
positively to the breeding of sport horses.

her sport career was ended by an injury.
Halfbrother Ami Z by Air Jordan is an approved
stallion. Sire Picasso Z jumped at the highest
level with Alvaro de Miranda just like his son

Luziana is een merrie met veel bloed en
vermogen. Ze is op de goede weg om in de
toekomst op hoog niveau te presteren. Luziana
is een nakomeling van Lord Pezi, Lacros x
Zymbal I, die succesvol was in de grote sport.
Zijn nakomelingen doen het geweldig: zijn
zoon Louis won op 1.60m niveau met Beat
Mändli en Little Pezi met Mario Stevens en
Abullah Al Sharbatly. Moeder Passion Lady is
een afstammeling van Laurion, welke
internationaal sprong met Soren Pedersen.
Grootmoeder Pandora is een Pilot x Direx
merrie, een bewezen combinatie in de
springsport. Uit de moederlijn komen niet
alleen springpaarden, maar ook Olympische
dressuurpaard Goldstern van Klaus Balkenhol
en de goedgekeurde hengst Lordanus.

Luziana is a mare with a lot of blood and a lot
of scope. She is on the right track to compete
in the big classes in the future. Sire of Luziana
is Lord Pezi, Lacros x Zymbal I, who was
successful in the big sport. His offspring is
doing great, for example his sons Louis who
won at 1m60 level with Beat Mändli and Little
Pezi with Mario Stevens and Abdullah Al
Sharbatly. Dam Passion Lady is by Laurion
who jumped internationally with Soren
Pedersen. Grandmother Pandora is a Pilot x
Direx mare, a proven combination in show
jumping. Out of this damline are not only
show jumpers, but also Olympic Dressage
horse Goldstern of Klaus Balkenhol and the
approved stallion Lordanus.

Foudre F heeft alles: hij is lichtvoetig, heeft veel
bloed en is erg voorzichtig. Hij is nog onervaren
maar heeft alle mogelijkheden om een geweldig
springpaard te worden. Vader Namelus R is
bekend door zijn internationale springnakomelingen zoals Tripple X III, Tantalus en T Sellie 15.
Moeder Petillant sprong 1.30m en is een
nakomeling van Cavalier, ook bekend als SP
Mister en erg succesvol met Franke Sloothaak.
Ze is ook moeder van Voila, die 1.45m sprong
met Tom Brinkman. Uit deze merrielijn zien we
veel nationale en internationale springpaarden
tot en met Grand Prix niveau.

Foudre F has everything, he is lightfooted,
bloodtyped and very careful. He is still
inexperienced but has all the capabilities to
become a great jumper. Sire Namelus R is
known for his international jumping offspring
like Tripple X III, Tantalus and T Sellie 15. Dam
Petillant was jumping 1m30 and is by Cavalier,
also known as SP Mister and very succesful
with Franke Sloothaak. She also is mother of
Voila, who jumped 1m45 with Tom Brinkman.
Out of this dam line we see a lot of national
and international jumping horses up till Grand
Prix level.

Flyer is een scherp springpaard met een zeer
goede galop. Hij geeft zijn ruiter een zeer fijn
gevoel. Vader Unaniem sprong als jong paard
met Ben Schröder. De zoon van de alom
bekende Nummero Uno staat nu op stal bij
Athina Onassis de Miranda waar hij 1.60m
springt op internationale concoursen. Moeder
Vivian springt 1.30m. De bekende hengsten
Voltaire en Nimmerdor zijn twee keer te
vinden in de stamboom van Flyer. Uit deze
moederlijn stammen de internationale
springpaarden Woline, Zoline, Bredero, Boy,
Bling Bling 2 en Cupido.

Flyer is a sharp jumping horse with a nice
canter who gives his rider a very good ride.
Sire Unaniem jumped as a young horse with
Ben Schröder and is now stabled at AD stables
of Athina Onassis de Miranda, who competes
at 1m60 level with this son of the well known
Numero Uno. Dam Vivian jumped 1m30.
Famous sires as Voltaire and Nimmerdor are
found twice in the pedigree of Flyer. Out of
this damline descend the international show
jumping horses Woline (Why Not), Zoline,
Bredero (Blue Eye), Boy (Que Pasa 5), Bling
Bling 2 and Cupido.

is makkelijk te rijden, heeft een comfortabele
galop, een top karakter en veel vermogen.
Vader Zambesi combineert de reflexen van
Heartbreaker met het vermogen van Calvaro Z.
Moeder Zomertijd B. komt uit Cobra, vice
wereldkampioen van de vijfjarige spring­
paarden en wereldkampioen van de zesjarige
springpaarden in Lanaken. De stamboom van
Future B. is compleet met de Hannoveraanse
hengst Stalon en keurhengst Jasper.
Uit deze merrielijn komen onder andere
Winterberg B van Wim Schröder en Amigo B
van Doda de Miranda.

Jumping Talent Sale B.V. organiseert op woensdag 28 januari 2015 de Jumping Talent Sale in het Amsterdam RAI Convention Centre te Amsterdam waarbij paarden zullen worden geveild. Onderstaande voorwaarden zijn van toepassing op de Veiling alsmede alle daarbij betrokken
Deelnemers als hierna nader omschreven.
5. Selecties en keuringen Paarden voor de Veiling
5.1JTS bepaalt de criteria waaraan voor de Veiling te selecteren Paarden dienen te voldoen.
5.2Een door JTS samengestelde selectiecommissie onderzoekt en selecteert de Paarden die in aanmerking komen voor deelname aan de
Veiling. Een besluit van de selectiecommissie ter zake is bindend. De selectiecommissie is bevoegd advies in te winnen bij derden, doch
heeft te allen tijde de bevoegdheid een Paard zonder opgave van redenen te weigeren op grond van (lichamelijke) gebreken, alsmede
wegens andere door de selectiecommissie te bepalen gronden, ook indien het Paard reeds voor de Veiling is geselecteerd. JTS (en de
selectiecommissie) is (zijn) nimmer gehouden om, op welke grond dan ook, de door de verkoper gemaakte kosten te voldoen.
5.3Alle Paarden zijn in de drie maanden voorafgaand aan de Veiling röntgenologisch en klinisch onderzocht. Een afschrift van de veterinaire keuring alsmede de röntgenfoto’s liggen (zeven dagen) voorafgaand aan de Veiling ter inzage.
1. Definities
1.1Bieder(s): natuurlijke- of rechtspersonen die in de Veiling bieden op een Paard, al dan niet middels een tussenpersoon (vertegenwoordiger of gevolmachtigde);
1.2Catalogus: de catalogus, zoals door JTS samengesteld, met daarin Paarden welke men voornemens is op de Veling aan te bieden;
1.3Deelnemer(s): deelnemers aan de Veiling waaronder mede begrepen tussenpersonen (vertegenwoordigers of gevolmachtigden),
­Bieders, Kopers en Verkopers;
1.4Gunning: de acceptatie van een door een Koper uitgebracht bod door de Veilingmeester waarmee een Koopovereenkomst tot stand
komt;
1.5JTS: Jumping Talent Sale B.V.;
1.6Koopovereenkomst: de overeenkomst tussen Koper en Verkoper aangaande de koop en verkoop van een Paard tegen betaling, welke
overeenkomst, gezien de bijzondere wijze van totstandkoming daarvan middels het veilen, niet dient te worden beschouwd als een
“consumentenkoop” als genoemd in het Burgerlijk Wetboek;
1.7 Koopsom: het bod van de Koper zoals bij Gunning vastgesteld;
1.8Koper(s): natuurlijke- of rechtspersoon die heeft geboden op een Paard tijdens de Veiling, al dan niet middels een tussenpersoon,
als Koper optreedt bij een Koopovereenkomst, waaronder mede begrepen eventuele rechtsopvolgers/rechtsverkrijgers; 1.9Paard(en): een door de Verkoper voor de Veiling aangewezen en ingeschreven paard of paarden;
1.10Veiling: de door JTS georganiseerde Veiling ter verkoop van Paarden, waar aan eigenaren van Paarden de mogelijkheid wordt geboden
hun Paarden te Veiling;
1.11Veilingmeester: een door JTS aangewezen Veilingmeester die de Veiling leidt;
1.12Verkoper(s): natuurlijke- of rechtspersoon die als Verkoper optreedt bij een Koopovereenkomst, waaronder mede begrepen eventuele
rechtsopvolgers/rechtsverkrijgers;
1.13Voorwaarden: deze algemene voorwaarden van JTS;
1.14 Website: de website van JTS, www.jumpingtalentsale.nl
2.Algemeen
2.1Door deelname aan de Veiling verklaart de Deelnemer (i) bekend te zijn met de Voorwaarden, (ii) dat de Voorwaarden aan hem vóór de
Veiling ter hand zijn gesteld en (iii) in te stemmen met de Voorwaarden met uitsluiting van eventueel door de Deelnemer zelf te hanteren voorwaarden. De Voorwaarden zijn gedeponeerd bij de Rechtbank van Amsterdam en zijn gepubliceerd in de Catalogus, alsmede op
de JTS website en verspreid tijdens de Veiling.
2.2De Veiling zal plaatsvinden onder toezicht van een notaris. Het notariële toezicht ziet enkel op de procedure van opbod en Gunning
tijdens de Veiling, en niet op andere aspecten uit de veilingvoorwaarden, zoals voorselectie, financiële afwikkeling van de koopprijs etc.
2.3 De relatie tussen JTS en de Verkoper is een overeenkomst van opdracht.
2.4 JTS is niet gebonden aan afspraken of overeenkomsten tussen de Deelnemers onderling, tenzij in deze Voorwaarden anders is vermeld.
3. Veiling procedure
3.1De wijze van voorbereiding en uitvoering van de Veiling wordt uitsluitend door JTS bepaald. Dit betekent onder andere, doch niet uitsluitend, dat JTS de gang van zaken voorafgaand aan en tijdens de Veiling bepaalt en de bevoegdheid heeft om, zonder opgave van redenen, deze Voorwaarden te wijzigen, personen al of niet tot de Veiling toe te laten, één of meer Paarden niet te veilen, een Bieding niet te
erkennen en/of ongeldig te verklaren, de Veiling te schorsen, te hervatten, af te gelasten en/of andere naar haar oordeel noodzakelijke
maatregelen te nemen. JTS heeft voorts het recht onjuistheden, door of namens haar gedane mondelinge en schriftelijke uitlatingen en
(al of niet tijdens een Veiling) gemaakte fouten te corrigeren, zonder dat daaraan door de Deelnemer enig recht kan worden ontleend.
3.2Paarden worden bij opbod verkocht met een verschillende minimum inzet per Paard. Deze minimum inzet wordt gepubliceerd in de
Catalogus, op de Website en/of tijdens de Veiling.
3.3Paarden worden verkocht voetstoots zonder actie of refactie, in de staat waarin zij zich bij Gunning bevinden.
3.4Deelnemers worden geacht volledig handelingsbekwaam te zijn en bij het volle verstand. Iedere Bieder wordt geacht voor zichzelf te
hebben geboden en is aan zijn bod gehouden totdat een hoger bod middels Gunning definitief is geaccepteerd. Een Bieder is naast zijn
eventuele lastgever volledig aansprakelijk voor het niet nakomen van zijn verplichtingen. Een Verkoper die als Koper zijn Paard blijkt te
hebben teruggekocht, wordt mede beschouwd als Bieder/Koper en voor de alhier bedoelde verkoper gelden aldus eveneens alle bepalingen (waaronder mede begrepen alle (betalings)verplichtingen) in deze Voorwaarden die Bieders betreffen.
3.5De Koopovereenkomst komt tot stand door de Gunning. De Koper zal onmiddellijk na Gunning onder vertoning van legitimatie een
schriftelijke Koopovereenkomst tekenen in de vorm zoals aan deze voorwaarden is gehecht als BIJLAGE 1. Mocht de Koopovereenkomst
niet onmiddellijk aan de Koper ter ondertekening worden aangeboden, dan dient hij zich direct na de Veiling te melden bij het secretariaat van JTS.
3.6Het risico ter zake van de Paarden, waaronder mede begrepen doch niet beperkt tot de schade aan en veroorzaakt door Paarden, gaat op
het moment van Gunning onmiddellijk over van de Verkoper op de Koper. Zolang JTS geen algehele betaling van de Koper heeft ontvangen, blijft de Verkoper eigenaar van het Paard.
4. Informatie
4.1 JTS heeft getracht de Catalogus zo nauwkeurig mogelijk samen te stellen op basis van de informatie zoals aangeleverd door de betreffende Verkoper. De informatie over de pedigrees en andere informatie is erop gericht een indruk te geven van de kwaliteit van de Paarden, zonder de pretentie volledig te zijn en zonder daarmee garanties te geven.
4.2Het is de verantwoordelijkheid van de Verkoper om de juistheid van de informatie in de Catalogus ter zake van het door hem aangeboden Paard te controleren en JTS vóór de Veiling tijdig en schriftelijk van eventuele fouten of onvolledigheden in kennis te stellen en
daarbij zo gedetailleerd als mogelijk aan te geven welke wijzigingen of aanvullingen dienen te worden aangebracht. De Verkoper staat in
voor de juistheid van de informatie zoals opgenomen in de Catalogus.
4.3 Een afschrift van het veterinair rapport van een Paard alsmede röntgenfoto’s kunnen op verzoek (zeven dagen) voorafgaand aan de
Veiling en op de dag van de Veiling worden ingezien. De inhoud van het veterinair rapport, de röntgenfoto’s en eventuele overige door
JTS verstrekte veterinaire rapportage is bindend voor Deelnemers.
4.4Bieders zijn verplicht om op verzoek van JTS informatie te verschaffen omtrent hun financiële gegoedheid, waarbij zij bescheiden aan
JTS dienen over te leggen waaruit deze gegoedheid blijkt. Door een verzoek tot deelname aan de Veiling machtigen de Bieders JTS informatie in te winnen bij derden over hun financiële gegoedheid.

6. Afwezigheid Paarden op de Veiling
6.1Een overeenkomstig artikel 5 geselecteerd Paard dient aan de Veiling deel te nemen, bij gebreke waarvan de Verkoper, naast het overig
door hem verschuldigde, aan en ten behoeve van JTS een vergoeding is verschuldigd ter grootte van € 15.000,00. Het totaalbedrag dat de
Verkoper uit hoofde van al zijn betalingsverplichtingen is verschuldigd wordt vermeerderd met een rente van 1,5% per maand, te berekenen vanaf datum Veiling tot het tijdstip van algehele betaling.
6.2Mocht een Paard naar oordeel van de Verkoper wegens gezondheidsredenen niet aan de Veiling zal kunnen deelnemen, dan dient dit
tijdig, schriftelijk en met een zo gedetailleerd mogelijke omschrijving van de aandoening aan JTS te worden medegedeeld, waarna een
door JTS aangewezen veterinair op kosten van Verkoper de aard van de aandoening zal vaststellen. De vaststelling van die veterinair ter
zake is bindend.
7. Inschrijvingen, kosten en betaling
7.1JTS is te allen tijde bevoegd een inschrijving van een Paard zonder opgave van redenen niet in behandeling te nemen, danwel Paarden
en/of Deelnemers te weigeren van de Veiling.
7.2Het inschrijfgeld per Paard zoals door Verkopers aan JTS verschuldigd is een commissie van 10% inclusief BTW over de Koopsom exclusief BTW, met een minimumbedrag van € 2.000,00 inclusief BTW. Dit minimumbedrag van € 2.000,00 is door de Verkoper aan JTS
verschuldigd vanaf het moment dat een ingeschreven Paard is gefotografeerd of is opgenomen op video, of zoveel eerder als een mondelinge danwel schriftelijke opdracht tot verkoop door Verkoper aan JTS is verstrekt. JTS zal Verkoper hiertoe een factuur versturen. JTS
zal een Paard niet eerder in de Catalogus opnemen dan nadat Verkoper het minimum bedrag van het inschrijfgeld heeft voldaan. De
Verkoper dient op de Veiling het overige inschrijfgeld gerelateerd aan de Koopsom te betalen bij het secretariaat van JTS, in euro’s,
zonder enige korting of inhouding.
7.3Op het moment dat de Verkoper het minimumbedrag aan inschrijfgeld verschuldigd wordt aan JTS, zal hij ervoor zorgdragen dat het
bedoelde bedrag binnen 14 dagen is bijgeschreven op IBAN-nummer NL21 INGB 0006 6723 69 van JTS onder vermelding van het inschrijfnummer. De Verkoper en zijn Paard(en) worden pas toegelaten tot de Veiling, nadat hij bescheiden heeft overgelegd waaruit
blijkt dat het bedoelde bedrag volledig is voldaan.
7.4 Over de Koopsom is de Koper aan JTS een bedrag aan opgeld verschuldigd van 10% van de Koopsom.
7.5De Koper kan na afloop van de Veiling de Koopsom vermeerderd met 10% opgeld inclusief BTW over de Koopsom exclusief BTW (i)
direct contant betalen bij het secretariaat van JTS (in euro’s zonder enige korting of inhouding) of (ii) giraal voldoen (in euro’s zonder
enige korting of inhouding). Wanneer de Koper giraal betaalt dient het verschuldigde bedrag uiterlijk 2 februari 2015 te zijn bijgeschreven op de rekening van de Verkoper.
7.6Slechts met voorafgaand schriftelijk verkregen toestemming van JTS heeft een Koper het recht giraal te betalen, waarbij het verschuldigde bedrag binnen drie werkdagen na de Veiling (2 februari 2015) op het in het sub 7.2 genoemde IBAN-nummer van JTS dient te zijn
bijgeschreven.
7.7 JTS heeft onder andere de bevoegdheid om toestemming tot girale betaling te onthouden indien Koper zijn financiële gegoedheid naar
oordeel van JTS niet aantoont of geen danwel onvoldoende zekerheid stelt middels een bankgarantie of anderszins. JTS heeft de bevoegdheid de door haar gegeven toestemming op elk moment weer in te trekken indien naar haar oordeel twijfel bestaat over de financiële gegoedheid van de Koper of over de door hem gestelde zekerheid.
7.8Indien de Koper het Paard niet contant betaalt op 28 januari 2015 is hij verplicht het Paard te verzekeren bij Hippo Zorg BV. De verzekering loopt minimaal tot het moment wanneer Koper het Paard zal ophalen zoals vastgelegd in de Koopovereenkomst, uiterlijk één week
na de Veiling (uiterlijk 7 februari 2015). Koper kan op de schriftelijke Koopovereenkomst kiezen voor deze optie. De premie van de verzekering bedraagt 1,0-1,5% van de Koopsom bedraagt afhankelijk van de duur van de verzekering. Deze korte samenvatting van de verzekering pretendeert niet volledig te zijn en de Koper kan hieraan geen rechten ontlenen. De Koper kan de verzekeringsvoorwaarden op
de dag van de Veiling verkrijgen bij het secretariaat van JTS. Wanneer de Koper het Paard niet verzekert, is JTS of Verkoper niet aansprakelijk.
7.9 Betaling aan enig ander dan JTS, bevrijdt de Verkoper of de Koper niet van de betalingsverplichtingen jegens JTS.
7.10 ndien JTS niet binnen drie werkdagen (2 februari 2015) na de Veiling algehele betaling van de Koper heeft ontvangen, is de Koper van
rechtswege in verzuim. De Koper is dan, naast het overig door hem verschuldigde, aan en ten behoeve van JTS een vergoeding verschuldigd ter grootte van 12% inclusief BTW van de Koopsom exclusief BTW. Het totaalbedrag dat de Koper uit hoofde van zijn betalingsverplichtingen is verschuldigd, wordt vermeerderd met een rente van 1,5% per maand, te berekenen vanaf de Veiling tot het tijdstip van
algehele betaling.
7.11Indien JTS niet binnen drie dagen na de Veiling algehele betaling van de Koper heeft ontvangen, heeft JTS voorts de bevoegdheid
zonder ingebrekestelling namens de Verkoper en zonder zijn toestemming de koop als ontbonden te beschouwen. De Verkoper en de
Koper blijven in dat geval jegens JTS gehouden om aan al hun in deze Voorwaarden genoemde betalingsverplichtingen te voldoen, voor
zover die een vergoeding ten behoeve van JTS betreffen.
7.12Indien de Koper of de Verkoper in verzuim is ter zake van zijn (betalings)verplichtingen, komen alle (buiten)gerechtelijke kosten die
JTS daardoor maakt voor rekening van de Koper danwel de Verkoper, met een minimumbedrag van € 1.000,00 inclusief BTW.
7.13Indien en pas nadat aan alle (betalings)verplichtingen jegens JTS zijn voldaan overeenkomstig deze Voorwaarden door zowel Verkoper
als Koper, zal JTS uiterlijk 30 dagen daarna het door haar aan de Verkoper verschuldigde voldoen.
7.14Verrekening van wederzijdse vorderingen door de Verkoper danwel de Koper ten opzichte van JTS is uitgesloten. JTS is te allen tijde
bevoegd wederzijdse vorderingen te verrekenen.
8. Afgifte en verwijdering Paarden
8.1Onmiddellijk na Gunning is de Koper verantwoordelijk voor de zorg van en aansprakelijk voor schade aan het Paard en/of door het
Paard ontstaan.
8.2Indien en pas nadat de Koper volledig aan zijn (betalings)verplichtingen heeft voldaan (uiterlijk 2 februari 2015), waaronder mede begrepen betalingsverplichtingen die een vergoeding ten behoeve van JTS betreffen, kan de Koper over het Paard beschikken, waarbij hij
de benodigde bescheiden zal ontvangen. JTS of Verkoper is nimmer verplicht het Paard af te geven indien de Koper niet geheel aan zijn
(betalings)verplichtingen heeft voldaan.

8.3De Koper dient het Paard op uiterlijk 7 februari 2015, na afloop van de Veiling op eigen kosten van de plek te hebben verwijderd waar het
Paard staat gestald, zoals afgesproken op de schriftelijke Koopovereenkomst. Indien de Koper het Paard niet tijdig heeft verwijderd, is
hij van rechtswege in verzuim. JTS heeft in dat geval de bevoegdheid het Paard van het terrein te (doen) verwijderen en elders te stallen,
waarbij alle in redelijkheid door en naar oordeel van JTS te maken kosten in dat verband voor rekening komen van de Koper. De Koper
blijft verantwoordelijk voor de zorg van en aansprakelijk voor schade aan het Paard en/of door het Paard ontstaan.
Jumping Talent Sale B.V. organizes the Jumping Talent Sale on Wednesday 28 January 2015 in the Amsterdam RAI Convention Centre in
Amsterdam in which Horses will be auctioned. The conditions below apply to the Auction and to all Participants involved as described more
precisely after this.
9. Stalondeugden en gebreken
9.1Indien de Koper bij het gekochte Paard gebreken als stalondeugden (i.e. kribbebijten, weven of luchtzuigen) constateert dan dient de
Koper binnen zeven dagen na de Veiling JTS hiervan schriftelijk en met een zo gedetailleerd mogelijke omschrijving van de aard van de
stalondeugden op de hoogte te stellen. Alsdan zal JTS het Paard op een door haar te bepalen locatie onderbrengen, teneinde het Paard
door een door haar aan te wijzen veterinair op de door de Koper omschreven stalondeugden te laten onderzoeken. Voornoemde veterinair stelt de aard van de stalondeugden bindend vast. Indien naar oordeel van die veterinair van de door de Koper omschreven stalondeugden sprake is, dient de Verkoper de ter zake gemaakte kosten, waaronder mede voor wat betreft de stalling, het transport en de
kosten van die veterinair, aan JTS te voldoen. [Koper heeft alsdan het recht de Koopovereenkomst te ontbinden waarna Verkoper de
Koopprijs zal restitueren.] De Koper dient de bedoelde kosten aan JTS te voldoen indien naar oordeel van voornoemde veterinair geen
sprake is van de door de Koper omschreven stalondeugden.
9.2 Indien de Koper niet binnen voornoemde termijn van zeven dagen na de Veiling op voornoemde wijze melding maakt van bedoelde
stalondeugden of (andere) gebreken en/of indien voornoemde veterinair de stalondeugden of (andere) gebreken niet vaststelt, vervalt
de bevoegdheid van de Koper de koop te ontbinden of een beroep te doen op een wilsgebrek.
10. Ontbinding en vernietiging
10.1Indien de Koopovereenkomst rechtsgeldig door de Koper of de Verkoper wordt ontbonden of vernietigd, blijven de Verkoper en de Koper gehouden aan al hun in deze Voorwaarden genoemde betalingsverplichtingen jegens JTS te voldoen, voor zover die een vergoeding
ten behoeve van JTS betreffen. De koop kan worden ontbonden of vernietigd met inachtneming van de ter zake geldende wettelijke
bepalingen, voor zover daarvan in deze veilingvoorwaarden niet rechtsgeldig is afgeweken.
11.Aansprakelijkheid
11.1JTS is niet aansprakelijk voor de accuratesse van de informatie in de Catalogus, de informatie gegeven op het veilingterrein en de informatie voor, tijdens of na de Veiling. De Verkoper vrijwaart JTS tegen ieder aanspraak van derden (waaronder mede begrepen Deelnemers) wegens schade die voortvloeit uit het niet voldoen aan de controle- en mededelingsverplichting door Verkoper ter zake van de
Catalogus.
11.2JTS is niet aansprakelijk voor de accuratesse van de informatie in het veterinair rapport, de veterinaire informatie gegeven op het veilingterrein en de informatie tijdens de Veiling.
11.3 J TS is niet aansprakelijk voor schade voorafgaand aan, tijdens of na afloop van de Veiling door en/of aan personen, goederen of Paarden
geleden.
11.4Ter zake van onder meer de Paarden sluit JTS geen verzekering af ten behoeve van de Verkopers en Kopers. Aangezien Verkopers en
Kopers geheel voor eigen rekening en risico aan de Veiling deelnemen, adviseert JTS hen bedoelde verzekering zelf af te sluiten. Ingeval
van dood van het Paard op de dag van de Veiling, terwijl de betreffende Verkoper of Koper geen uitkering op grond van een eventueel
door hemzelf afgesloten verzekering ontvangt, zal JTS het inschrijfgeld ad € 2.000,00 inclusief BTW aan de betreffende Verkoper of het
opgeld aan de betreffende Koper terugbetalen. Met voornoemde terugbetaling verleent JTS service aan Verkopers en Kopers, zonder dat
JTS enige aansprakelijkheid erkent en zonder dat Verkopers en/of Kopers hieraan nu of in de toekomst rechten kunnen ontlenen.
11.5JTS is niet aansprakelijk voor tekortkomingen van derden. Hieronder valt tevens de wanbetaling van de Koper.
11.6JTS sluit aansprakelijkheden uit, behoudens ingeval van opzet of bewuste roekeloosheid van JTS en/of diegenen die voor of ten behoeve
van JTS werkzaam zijn of waren.
11.7Een ieder die schade toebrengt aan (goederen van danwel gebruikt door) JTS is aansprakelijk voor deze schade.
11.8Deelnemers zijn aansprakelijk voor alle schade door hen veroorzaakt. Deelnemers vrijwaren JTS tegen iedere aanspraak van derden
(waaronder mede begrepen andere Deelnemers, danwel bezoekers) ter zake daarvan.
12.Overig
12.1Indien ter zake van de overgang van geveilde Paarden naar een andere lidstaat van de Europese Unie op verzoek van de Koper wordt
gefactureerd met het BTW-nultarief, verplicht de Koper zich alle daartoe noodzakelijke voorwaarden te vervullen teneinde een rechtsgeldige intracommunautaire transactie te verwezenlijken.
12.2Indien toepassing van het BTW-nultarief door welke omstandigheid dan ook (achteraf) niet mogelijk blijkt, is de Koper op dat moment
alsnog een bedrag verschuldigd ter grootte van het bedrag dat verschuldigd zou zijn indien sprake is van een binnenlandse levering van
het desbetreffende Paard. Op verzoek van JTS is de Koper echter verplicht vorenbedoeld bedrag onmiddellijk aan JTS te voldoen. Alsdan
zal terugbetaling daarvan eerst en slechts plaatsvinden indien de Koper aan de voorwaarden sub 12.1 heeft voldaan. De Koper is aansprakelijk en vrijwaart JTS in ieder geval voor alle schade die voortvloeit uit het niet voldoen aan de voorwaarden artikel 12.1. Daarnaast is de
Koper aansprakelijk voor alle (buiten)gerechtelijke kosten die JTS maakt, met een minimumbedrag van € 1.000,00 inclusief BTW.
13.Conversie
13.1Indien één of meer van de in deze Voorwaarden genoemde bepalingen niet rechtsgeldig zou(den) zijn of worden, blijven de overige
bepalingen verder rechtsgeldig. In dat geval treedt in plaats van de bedoelde niet rechtsgeldige bepaling een nieuwe bepaling, die met
de bedoelde oude niet rechtsgeldige zoveel als mogelijk overeenkomt voor wat betreft inhoud, bereik en doel daarvan.
14.Geschillen
14.1Indien bij een Gunning een verschil van mening ontstaat over de vraag wie het laatste bod heeft gedaan, of indien er andere moeilijkheden, onduidelijkheden en geschillen ontstaan bij biedingen en/of over de Gunning, is de Veilingmeester bevoegd hierover een bindend
oordeel uit te spreken. Ingeval van vorenbedoeld verschil van mening omtrent het laatste bod is de Veilingmeester bevoegd de verkoop
bij opbod te doen continueren.
14.2Indien de Veilingmeester de notaris verzoekt een oordeel te vellen, zal de notaris bindend en onherroepelijk voor alle partijen beslissen.
De notaris is gedurende de Veiling tevens bevoegd te oordelen over geschillen van andere aard dan ter zake van de biedingen en Gunningen.
14.3Stichting Concours Hippique International Jumping Amsterdam, Jumping Amsterdam B.V., de notaris, Amsterdam RAI B.V. en haar
medewerkers kunnen niet aansprakelijk gesteld worden voor enige schade of gebrek.
14.4De rechtsverhoudingen tussen Deelnemers worden uitsluitend beheerst door Nederlands recht, met algehele uitsluiting van het Weens
Koopverdrag (CISG). Geschillen, anders dan die ingevolge het bepaalde sub 54 en 55 aan het oordeel van de Veilingmeester of de notaris
zijn onderworpen zullen uitsluitend worden beslecht door de bevoegde rechter te Amsterdam.

1.Definitions
1.1Bidder(s): natural person or legal entity that bids on a Horse during the Auction, whether of not through an intermediary (representative or assignee);
1.2Catalogue: the Catalogue, as composedby JTS, that includes the Horses that are intended to take part in the Auction;
1.3Participant(s): Participants to the Auction such as intermediaries (representatives or assignees), Bidders, Buyers and Vendors;
1.4Allotment: the acceptation by the Auctioneer of an offer made by a Buyer which results in an Agreement of Sale;
1.5JTS: Jumping Talent Sale B.V.;
1.6Agreement of sale: the agreement between the Buyer and Vendor concerning the purchase and sale of a Horse against payment, which
agreement, regarding the particular way of its emergence through auctioning, cannot be considered as a “consumer purchase” as mentioned in the civil code;
1.7Purchase price: the Buyer’s bid as determined at Allotment;
1.8Byer(s): natural person or legal entity that made a bid on a Horse during the auction, whether or not through an intermediary, that acts
as the Buyer in an Agreement of Sale in which legal successors/procurers are also included;
1.9Horse(s): a horse or horses that are assigned and registered by the Vendor to the Auction;
1.10Auction: the by JTS organized Auction to the sale of Horses, in which owners of horses are offered the opportunity to assign their Horses for Auction;
1.11Auctioneer: a by JTS assigned Auctioneer that is in charge of the Auction;
1.12Vendor(s): natural person or legal entity that acts as a Vendor in an Agreement of Sale, in which legal successors/procurers are also included;
1.13Conditions: these conditions of auction of JTS;
1.14Website: the website of JTS, www.jumpingtalentsale.nl.
2. General
2.1By participating in the Auction the Participant declares (i) to be acquainted with the Conditions, (ii) that the Conditions were offered
to him/her before the auction and (iii) to agree with the Conditions with elimination of contingent conditions to be handled by the
participant him/herself. The Conditions are provided to the Civil Court of Amsterdam and published in the Catalogue, as well as on the
Website and distributed during the Auction.
2.2The Auction will take place under the supervision of a notary. The notarial supervision only includes the procedure of the sale by Auction and the Allotment, and no other aspect of the Conditions such as selection, financial processing etc.
2.3The relationship between JTS and the vendor is an agreement by order.
2.4JTS is not bound to agreements between the Participants, unless stated otherwise in these conditions of auction.
3. Auction procedure
3.1The way of preparation and execution of the Auction will be determined solely by JTS. This means, among other things, yet not limited
to, that JTS determines the state of affairs before and during the Auction and retains the right, without any giving reasons, to alter these
Conditions, to deny participation by persons, not to auction one or more Horses, not to recognize a bid or to declare a bid invalid, to
interrupt, resume, cancel and to take all necessary means according to its judgment. JTS further has the right inaccuracies, through its
or on behalf of its verbal or written statements and to correct (whether or not during the Auction) made errors, of which the Participants cannot derive any rights from.
3.2Horses will be, at bidding, sold with a various minimum stake per Horse. The minimum stake will be published in the Catalogue and/
or Website and/or during the Auction.
3.3 The horses will be sold outright, without proceedings or recompense, in the state in which they were allotted.
3.4Participants are expected to be fully commercially competent and to be in full possession of their mental faculties. Each Bidder is expected to have bid for him/herself and will be held to his/her bid until a higher bid has been definitely accepted through Allotment. A
Bidder is, along with his/her eventual principal, fully responsible for non-fulfillment of his/her obligations. A Vendor who appears to
have bought his/her own horse, will also be seen as Bidder/Buyer and all Conditions (under which is also meant all obligations of payment) are considered applicable concerning Bidders for the meant vendor.
3.5The Agreement of Sale is realized by Allotment. Immediately after allotment, the Buyer shall, on production of identification, sign a
written Agreement of sale such as is attached as ATTACHMENT 1. If the Agreement of sale is not immediately offered for signing to the
Buyer, then he/she must, directly after the Auction, report to the JTS administration office.
3.6Risks concerning the Horses by which is meant among other things, yet not limited to, damage to and damages caused by Horses, are
transferred immediately from the Vendor to the Buyer at the moment of Allotment. As long as JTS has not received full payment from
the Buyer, the Vendor remains owner of the horse.
4. Information
4.1JTS has strived to compile the catalogue as accurately as possible based on the information given by the concerned Vendor. Pedigree
information and other information aims to give an impression of the quality of the horses without pretending to be exhaustive and
therefore gives no guarantees.
4.2It is the responsibility of the Vendor to control the accuracy of the information in the Catalogue that concerns the Horse that he/she has
put on offer and to write to JTS in good time before the Auction in the event of any mistakes or inadequacies and bring to the notice of
such, thereby acquainting JTS, in as much detail as possible, with any changes or additions that are needed. The Vendor will be held
responsible for the accuracy of the information stated in the Catalogue.
4.3A duplicate of the veterinary report of a Horse as well as X-rays can be seen, on request, seven days before the Auction and on the day of
the Auction itself. The contents of the veterinary report, the X-rays and any other by JTS provided veterinary reports, are binding for JTS
Participants.
4.4Bidders are obliged, if requested by JTS, to supply information concerning the adequacy of their financial circumstances, in which case
they must show documentation proving the substance of their finances to JTS. By requesting participation in the Auction, the Bidders/
Buyers authorize JTS in the obtaining of information concerning their financial circumstances from third parties.

5. Selection and inspection of Horses for the Auction
5.1JTS determines the criteria by which Horses that are to be selected for the auction must fulfill.
5.2A selection committee compiled by JTS will examine and select the Horses considered to be likely candidates for participation in the
Auction. A decision by the selection committee concerned is binding. The selection committee is entitled to ask advice from third parties, notwithstanding that, at all times, they have the right to refuse a Horse, without having to state reasons, on grounds of being found
physically or otherwise, defective, as well as other grounds determined by the selection committee, also in cases where a Horse has already been selected for the Auction. JTS (and the selection committee) is in no way beholden, on no matter what grounds, for the responsibility of any costs accrued by the Vendor.
5.3All Horses are, three months before the Auction, clinically tested as well as having X-rays made. Copies of the veterinary report, as well
as the X-rays, are available for inspection seven days before the commencement of the Auction.
8.3The Buyer must remove, at his/her own cost, at the latest, on 7 February 2015 from the place where the Horse is stabled, as agreed in the
written Agreement of Sale. If the Buyer has not removed the Horse in good time, he/she is in default in the law. JTS then has the right
to have the Horse removed and stabled elsewhere, whereby the Buyer will be charged for the costs accrued, as considered reasonable in
the judgment of JTS. The Buyer remains responsible for the care of the Horse and is liable for damage to the Horse or caused by the
Horse.
6. Horses absent at time of Auction
6.1A horse, in accordance with Article 5 , that has been selected must take part in the Auction; in default of such, the Vendor must, as well
as his/her other obligations of payment to JTS, pay an indemnity of € 15,000.00. The total sum that is indebted by the Vendor from his/
her obligations of payment, will be augmented by an interest of 1.5% per month over the total owed sum, to be calculated from the date
of Auction until the time of the payment in total.
6.2In the event that a Horse, in the opinion of the Vendor, cannot participate in the Auction because of health reasons, he/she must explain
in writing, in good time, the disorder to JTS, whereby after a veterinary surgeon that has been assigned by JTS will establish the nature
of the disorder. The conclusion of the veterinary surgeon concerned will be binding.
7. Registration, costs and payment
7.1JTS is, at all times, authorized to refuse either Horses and/or Participants and/or Vendors for registration without having to state
­reasons.
7.2The registration fee per Horse that Vendors owe to JTS shall be a commission of 10% (including VAT) of the Purchase price excluding
VAT at a minimum sum of € 2,000.00 including VAT. This minimum sum of € 2,000.00 is due to JTS by the Vendor from the moment
that a registered Horse has been photographed or has been recorded on video or has been, at some time earlier, either verbally or in
writing, assigned for sale by JTS by the Vendor. JTS will send the Vendor an invoice for the registration fee. JTS will not include a Horse
in the Catalogue before the Vendor has paid the minimum sum of the registration fee. The vendor must pay, at the auction, the remaining registration fee as related to the Purchase price, in cash, at the administration offices of JTS, in euros, without any discount or
­deduction.
7.3 At the moment when the Vendor’s registration fee of the minimum sum (as corresponding to part 17) is due to JTS, he/she shall ensure
that the aforesaid sum shall be deposited, within 14 days, on the bank account number (IBAN) NL21 INGB 0006 6723 69 of JTS, and
stating the registration number concerned. The Vendor and his/her Horse or Horses will only be allowed entry to the Auction after he/
she has documentary proof to show that it is apparent that he/she has fully paid the aforesaid registration fee.
7.4On the Purchase price the buyer owes JTS an amount of 10% agio of the Purchase price.
7.5The Buyer must make cash payment to the administration office of JTS at the Auction, that is; the Purchase price augmented by 10%
agio including VAT on the Purchase price, excluding VAT, in euros, without any discount or deduction. The Buyer has the possibility to
pay the Purchase price augmented by 10% agio including VAT on the Purchase price, excluding VAT, in euros, without any discount or
deduction by bank. If the Buyer makes a bank payment, the aforesaid sum needs to be added to the JTS bank account at the latest on 2
February 2015.
7.6Only with written permission obtained from JTS prior to the Auction has a Buyer the right to pay with a transfer account whereby he/
she must transfer payment within 3 working days after the Auction (2 February 2015) to the bank account number of JTS (as corresponding to part 7.2).
7.7JTS has the right to, among other things, yet not limited to, withhold the above-mentioned permission in the event that the Buyer´s financial circumstances, according to JTS’ judgment, by means of bank guarantees or suchlike, do not show, or fall short of, sufficient
means. JTS has the right to withdraw its given permission at any time in case doubts arise, in their opinion, as to the financial adequacy
of the bidder/purchaser or to the securities that have been supplied by him/her.
7.8If the Buyer does not pay the Horse in cash on 28 January 2015 JTS will, in such cases, oblige the Buyer to have the Horse insured, which
will take effect immediately and will be at the cost of the Buyer, with Hippo Zorg BV. This insurance must be for a minimum period
until the Buyer picks up the Horse as agreed to in the Agreement of Sale, at latest one week after the Auction (at latest 7 February 2015).
Buyer can agree with this option on the written Agreement of Sale. The premium is 1.0-1,5% of the Purchase price depending of the period of the insurance. This short summary of the insurance is not considered to be complete thus the Buyer cannot derive any legal
rights from such. The Buyer can obtain a copy of the conditions of insurance on the day of the auction from the administration office of
JTS. If the Buyer does not insure the Horse, JTS or the Vendor are not liable.
7.9Payment to any other person other than JTS does not release the Vendor or the Buyer from payment obligations toward JTS.
7.10 In the event that JTS has not received the payment in full from the Buyer within 3 working days after the Auction, the Buyer is, according
to the law, in omission. The Buyer is then obliged to pay to JTS, as well as his/her other obligations of payment, an indemnity to the sum
of 12% (including VAT) of the purchase price excluding VAT. The total sum that the Buyer is indebted from his/her obligation of payment will be augmented by an interest of 1.5% per month to be calculated from the time of Auction until the time of full payment.
7.11If JTS does not receive, from the Buyer, full payment within 3 working days after the Auction, JTS has the right, without notification of
default, on behalf of the Vendor and without his/her permission, to consider the sale as not binding. In such cases, the Vendor and
Buyer remain obliged to fulfill all their payment obligations toward JTS as laid out in the Conditions as far as these concern an ­i­ndemnity
on behalf of JTS.
7.12If the Buyer is in default of fulfilling his/her payment obligations towards JTS, all judicial and extra judicial costs accrued by JTS by these
circumstances will be charged to the Buyer with a minimum sum of € 1,000.00 including VAT.
7.13When, and only when, all payment obligations towards JTS have been fulfilled by both the Vendor and the Buyer, will JTS then complete
payment of all money owed to the Vendor within 30 days.
7.14Settling of mutual claims by the Vendor or the Buyer in regard to JTS is out of the question. JTS is, at all times, authorized to settle
mutual claims.
8. Delivery and removal of horses
8.1The Buyer is responsible for the care of the Horse immediately after it has been allotted and liable for any damage to the Horse, or
caused by the Horse.
8.2When, and only when, the Buyer has fully complied with his/her obligations of payment (2 February 2015 at latest), under which is
meant obligations of payment concerning reimbursement to JTS, can the Buyer take delivery of the Horse, whereby he/she will receive
the necessary documents. JTS is not obliged to deliver the Horse in the event that the Buyer has not fully complied with his/her (payment) obligations.

9. Stall vices and deficiencies
9.1In the event where a Buyer detects defects such as stall vices in the Horse purchased, whether crib-biting, weaving or wind-sucking, the
Buyer must, within 7 days after the Auction, notify JTS in writing with a description in as much detail as possible of the nature of the
stall vice. In such cases, JTS will remove the Horse to a location of their choice with the aim to having the Horse examined by a veterinary surgeon assigned by them in order to have the stall vice, as described by the Buyer, examined. The veterinary surgeon’s conclusion
of the nature of the stall vice is binding. In the event where, in the judgment of the veterinary surgeon, there is such a stall vice as described by the Buyer, then the Vendor is obliged to pay the costs accrued to JTS, among which those concerning the stabling, the transport costs and the veterinary surgeon’s fee. The Buyer is obliged to pay the said costs accrued to JTS in the case where, in the judgment
of the veterinary surgeon, there is no stall vice as described by the Buyer.
9.2In the event that the Buyer, within the term of 7 days after the Auction, does not notify JTS in the manner as mentioned above, of the
stall vices in question or other defects, and/or in the event where the above-mentioned veterinary does not establish that there are stall
vices or other defects, the Buyer does not have the right to annul the sale nor make a claim of absence of consensus ad idem.
10. Annulment and quashing
10.1 In the event where the legal sale is annulled or quashed by the Buyer, the Vendor and the Buyer will remain bound to all their obligations
of payment toward JTS, as mentioned in the Conditions of Auction, as far as these concern indemnities to JTS. The sale can be annulled
or quashed if the valid legal conditions concerned are taken into consideration, insomuch as they do not deviate in law from the conditions of auction.
11.Liability
11.1JTS cannot be held liable for the accuracy of the information in the Catalogue, the information supplied at the Auction grounds or any
information made available before, during or after the Auction. The Vendor indemnifies JTS from all damages resulting from inadequacy in the obligations of checking and the obligations of statements made by the vendor concerning the Catalogue.
11.2JTS cannot be held liable for the accuracy of the information contained in the veterinary report, the veterinary information supplied at
the Auction grounds or any information made available during the Auction.
11.3JTS cannot be held liable for any damage before, during or after the Auction, sustained or perpetrated by any person, goods or Horses.
11.4JTS will not take out an insurance concerning Horses or other matters, on behalf of the Vendors and Buyers. As Vendors and Buyers take
part in the Auction at their own cost and at their own risk, JTS advises that they take out the meant insurance themselves. In the event
of the death of a Horse on the day of the Auction and while the Vendor or Buyer concerned does not receive any compensation on
grounds of any insurance he/she may have taken out for him/herself, then JTS will refund the registration fee of € 2,000.00 including
VAT to the vendor concerned or will repay the agio to the Buyer concerned. The aforementioned refund is a service granted by JTS to
Vendors and Buyers without acknowledgement of any liability on the part of JTS, now or in the future.
11.5 JTS is not liable for the failings of third parties; under this is also classified the case of non-payment by the Buyer.
11.6JTS is not liable for anything whatsoever, except in cases of willful intent or willful recklessness on the side of the JTS and/or those who
work on behalf of, or have worked on behalf of the JTS.
11.7Anyone who perpetrates damage to goods, or goods used by JTS, are liable for such damage.
11.8Participants are liable for any damage they may have perpetrated . Participants indemnify JTS from any liability toward third parties by
which is meant other Participants or visitors concerning this matter.
12. Other matters
12.1 In the event where, in the business of transferring the auctioned Horses to another member state of the European Union, at the request
of the Buyer an invoice is sent with zero VAT, the Buyer puts him/herself under obligation, in the member state of destination, to fulfill
all necessary conditions demanded and in so doing to actualize an intra-community legal transaction.
12.2If application of the VAT zero rating tariff, no matter the circumstances, appears to be impossible (subsequently), then the Buyer, at that
time, is still obliged to pay a sum to the amount that would be owed in the case of a domestic delivery of the Horse concerned. At the
request of JTS the Buyer is required to pay the aforementioned sum to JTS immediately. In such cases, the refund will be reimbursed
only when and not before, the Buyer has complied with the conditions of part 12.1. The Buyer indemnifies JTS in all cases from damages
that result from the non-compliance of part 12.1. Therein the Buyer is liable for all judicial and extra judicial costs accrued by JTS with a
minimum sum of € 1,000.00 including VAT.
13.Conversion
13.1In the case where one or more of these Conditions are not, or become, no longer lawful, the remaining conditions remain lawful. In such
cases, a new lawful condition will come in the place of the no longer lawful condition; in which the new condition will resemble,
­concerning content, range and aim, as much as possible the old, no longer lawful, condition.
14.Disputes
14.1If, at allotment, a difference of opinion arises to the question as to whom had made the last bid, or in the event that other difficulties,
confusions or disputes arise at the time of bidding and/or Allotment, the Auctioneer is authorized to have final say herein which is
binding. In the case where the aforementioned difference of opinion concerns the last bid made, the Auctioneer is authorized to continue the sale by way of bidding.
14.2In the event that the auctioneer calls in the notary to make judgment, the notary shall, binding and irrevocably, decide for all parties.
During the Auction, the notary is also authorized to make judgment in disputes in other matters than those regarding that of bidding
and Allotment.
14.3Stichting Concours Hippique International Jumping Amsterdam, Jumping Amsterdam B.V. the notary the Amsterdam RAI B.V. and
her employees cannot be held accountable for no damage or notice of default.
14.4The legal relationship between Participants are subject solely to Dutch law, with the complete exclusion of the Vienna Sales Treaty
(CISG). Disputes, other than those specifically in pursuance of parts 14.1 and 14.2, which are subject to the judgment of the auctioneer
and the notary, shall be settled exclusively by the qualified judge in Amsterdam. These conditions are a translation from the Dutch
language. In the case of dispute only the original Dutch version is binding.

U betaalt contant
Na afloop van de veiling meldt u zich op het
secretariaat van de Jumping Talent Sale, waar u
contant afrekent. U ontvangt dan uiteraard een
betalingsbewijs.
U zorgt voor een bankgarantie
U kunt bij uw bank een bewijs aanvragen dat
getuigt van uw ‘financiële gegoedheid’. Met
deze bankgarantie krijgt u van ons toestemming giraal te betalen. Het bedrag dient dan
binnen 7 dagen na de veiling op de rekening
van Jumping Talent Sale B.V. te staan.
LEADING
U betaalt een bedrag vooruit
Afhankelijk van de prijs die u eventueel bereid
bent uit te geven tijdens de veiling, betaalt u
voorafgaand aan de veiling op de bankrekening
van Jumping Talent Sale B.V. een bedrag dat in
redelijke verhouding staat (te beoordelen door
Jumping Talent Sale BV) tot het mogelijk uit te
geven bedrag. Als u geen paard heeft gekocht
krijgt u het bedrag na afloop van de veiling
teruggestort.
By payment in cash
After the auction, you should report to the
secretariat of the Jumping Talent Sale where
you can then pay in cash. A receipt will be
given after the transaction.
By providing a bank guarantee
You should ask your bank to supply documentary evidence of your ‘financial means’. With
such a bank guarantee, we can give you
permission for a giro transfer. The sum should
be paid to Jumping Talent Sale B.V. account
within 7 days after the auction.
By partial payment in advance
Depending on the price that you are eventually
prepared to pay at the auction, you can transfer
a sum to the account of Jumping Talent Sale
B.V. in advance of the auction. The sum should
be a reasonable amount (as judged by Jumping
Talent Sale B.V..) in the light of the possible
final sum. In case you do not buy a horse, the
sum will be returned to your account after the
auction.
