DEAR FELLOW MAINE LAWYERS:
I hope you are planning to attend the Summer Bar Conference scheduled for
June 22-24, 2016, in Bar Harbor. Whether or not you have attended in the last few
years, you will want to come back to “rediscover” and enjoy this annual gathering. The
planning committee has worked hard to create an innovative meeting, while preserving
the time-honored traditions that make this event special. You’ll enjoy opportunities to
connect with your colleagues, celebrate your profession, and take in all the sights and
sounds of Bar Harbor with family and friends.
The conference is located at the Harborside Hotel, Spa & Marina in downtown Bar
Harbor. Our welcome reception, meals, special events and CLE take place at the
adjacent Bar Harbor Club. The schedule has been carefully structured to include plenty
of leisure time with your family and colleagues, all in the informal and relaxed setting of
Bar Harbor.

evening. The Class of 2016 is an impressive group of new attorneys who are committed
to advancing their practice and contributing to the legal community in Maine.

Houlton. It is a company wholly owned by the Carpenter family – Mike, Joanne,
Charles, Dennis, and Emily. Mr. Carpenter is an attorney licensed to practice in
all the courts in Maine, is a veteran of the Vietnam War, and was Maine’s attorney general from 1991 to 1995. He is also a lifelong lover and owner of horses;
big and small. He grew up on a local potato farm and used draft horses for
much of the farm work. He learned his horse knowledge from his father, a wellknown local blacksmith who once shod for the Genesee Brewing Company out
of Rochester, New York.

Diver Ed’s Dive-In Theater is a scenic boat ride in Frenchman Bay in Acadia
National Park, where Diver Ed and his sidekick “Mini Ed” dive down to the
ocean floor with specially equipped video and sound equipment, allowing you
to see and hear the ocean floor in real time, from the comfort of the deck.
At the end of the dive, Ed and Mini Ed return to the boat, so do the creatures.
Touch tanks allow you to observe, handle – and sometimes even kiss – these
strange and mysterious beings before they are returned safely to the sea.

1. AFTER THE ACA, ABLE AND DECAMBRE: WHAT’S SPECIAL ABOUT SPECIAL NEEDS TRUSTS?
This one-hour program is for the general practitioner, and it follows an all-day MSBA CLE on special needs trusts presented in
May. This shorter session will focus on the new world of special needs trust planning and the additional options for individuals
with disabilities following the passage of the Affordable Care Act in 2010 and the Achieving a Better Life Experience (ABLE) Act
at the end of 2014. Is a special needs trust the best tool for the situation? What if the individual receives public housing benefits? If a special needs trust is appropriate, should it be a third-party trust or a first-party trust? How about a pooled trust? What
are conversion trusts and sole-benefit trusts? When should a testamentary supplemental needs trust be considered?

In 2001, Maine became the second state in the nation to adopt comprehensive rules to permit lawyers to unbundle legal services. This panel will address developments in legal services delivery models over the past 15 years, how attorneys can use
limited-scope representation to increase revenue, the value this practice model brings to the court, and brainstorm about how to
attract and serve consumers using limited-scope representation.

4. THE PROFESSION AT RISK: THE SCOPE OF MENTAL HEALTH PROBLEMS AMONG ATTORNEYS, JUDGES AND
LAW STUDENTS AND A PROPOSAL FOR ACTION (1.0 ETHICS)
In January the results of a study of mental health issues in the American legal profession were published in the Journal of Addiction Medicine. The study, jointly funded by the ABA and the Hazelden Betty Ford Foundation, was the most comprehensive
of its kind ever undertaken. More than 12,000 attorneys, judges and law students were surveyed. The study results surprised
even members of the lawyer assistance program community: more than 36 percent of the study population qualified as problem
drinkers; 20.6 percent suffered from depression and 19 percent suffered from anxiety. This program will explore details of the
study, and, more importantly, examine the various avenues available to better assist those who face these issues, and help
prevent others from falling victim to them.

5. A PRIMER FOR MAINE ATTORNEYS TO DEMYSTIFY CLAIMS FOR SOCIAL SECURITY AND LONG-TERM DISABILITY BENEFITS
Long-term disability (LTD) insurance coverage has become a more common and important part of the suite of employee benefits offered by employers to attract and retain qualified employees. At the same time, because of ERISA, the federal law governing most private group LTD policies, representing LTD claimants has become more challenging and complex. In the public
disability benefits arena, with the financial pressures on the Social Security Administration, it has become much more difficult to
win social security disability claim cases. These areas of legal practice are more closely aligned than one might think, but each
has its own unique set of issues and challenges. This presentation will review the difficulties Maine lawyers grapple with in both
LTD and social security disability cases, and will offer ideas and strategies to effectively respond to these issues. Presenters
will outline winning strategies for prevailing in these claims. They will also discuss issues of legal ethics that are specific to SSA
and LTD claims.

6. THE ART AND ETHICS OF WITNESS PREPARATION (0.25 ETHICS)
Preparing witnesses for depositions or interviews with the government takes time and skill. Too often we don’t spend the time
necessary to ensure our clients put their best foot forward, and they accidentally say something untrue, are led into providing
incomplete information or are confused about what they can and cannot say and leave out information important to their case.
This session will be led by a litigator experienced with preparing clients to testify at depositions, before federal and state government agencies, and at trial. We will review strategies for preparing clients, including explaining the process to clients, how much
information to prepare them with and doing an effective mock interview. We will also examine the line between preparation and
coaching.

Nearly all business owners agree that succession planning is important, yet fewer than 15 percent have a plan that is current
and written. Typically, planning is initiated only as a result of an event—an unsolicited offer, death of an owner, or a conflict
between partners—leading to a suboptimal result. This session will bring together best practices from three professionals, all of
whom focus on business succession planning, and will demonstrate that a systematic and well-coordinated approach between

11. MEDICAL MARIJUANA LAW AND YOUR PRACTICE
The Maine Medical Use of Marijuana Act and its regulations have significant impacts on many other areas of law, including
employment, land use, education, and business. The panel will present an overview of the Act and its regulations, followed by a
discussion of the intersection of these laws on land use and zoning. There will also be a discussion of how the state is working
to develop new ways of dealing with medical marijuana patients in the workplace. While time will only allow an overview of the
three topics, the presenters will provide a road map for those who are seeking further information.

12. MINDFULNESS BASED STRESS REDUCTION (1.0 ETHICS)
In MBSR, participants learn to recognize habitual, unhelpful reactions to difficulty and learn instead to bring an interested, accepting and non-judgmental attitude to all experience, including difficult sensations, emotions, thoughts and behavior. MBSR
may be used to a focus on specific patterns of negative thinking that people with depression are vulnerable to, but which we all
experience from time to time.

16. MAINE’S NEW ESTATE TAX REGIME: NOW WHAT?
The presenters will review the history of the Maine estate tax as the foundation for the current estate tax rules and will outline
how the new rules work, including the exemption amount, tax rates, and the effective gift tax on gifts made within one year of
death. In addition, they will discuss what the current rules mean for both existing estate plans and new estate plans and techniques that may be utilized to adapt old plans to the new rules.

17. I’LL KNOW IT WHEN I SEE IT… OR WILL I? NAVIGATING THE DISCRETIONARY AND MANDATORY REPORTING REQUIREMENTS OF MAINE RULE OF PROFESSIONAL CONDUCT 8.3 (1.0 ETHICS)
Maine’s collegial bar can become constrained when lawyers must consider whether to report a colleague for disciplinary or
impairment reasons. This session will consider and discuss how firms of all sizes can start developing policies (and tweak what
they already have in place) to deal with questions/concerns related to discretionary and mandatory reporting of lawyers. Practitioners know that the reporting question might arise in the context of an overly aggressive or dishonest opposing counsel; a
lawyer charged with or convicted of a serious crime; an unsafe and or volatile lawyer; a lawyer struggling with dementia, mental
health or substance abuse challenges; or a lawyer who is improperly using client trust funds or law firm operating accounts.
