See www.mainebar.org for details. 1891-2016 Celebrating 125 Years Welcome: President’s Message DEAR FELLOW MAINE LAWYERS: I hope you are planning to attend the Summer Bar Conference scheduled for June 22-24, 2016, in Bar Harbor. Whether or not you have attended in the last few years, you will want to come back to “rediscover” and enjoy this annual gathering. The planning committee has worked hard to create an innovative meeting, while preserving the time-honored traditions that make this event special. You’ll enjoy opportunities to connect with your colleagues, celebrate your profession, and take in all the sights and sounds of Bar Harbor with family and friends. The conference is located at the Harborside Hotel, Spa & Marina in downtown Bar Harbor. Our welcome reception, meals, special events and CLE take place at the adjacent Bar Harbor Club. The schedule has been carefully structured to include plenty of leisure time with your family and colleagues, all in the informal and relaxed setting of Bar Harbor. Stephen Nelson, 2016 MSBA President The CLE schedule will include 17 showcase-quality programs and an ethics plenary. We’ll also recognize 50-year members, this year’s recipient of the Vincent L. McKusick Award for outstanding writing in the Maine Bar Journal, and the VLP Director’s Award. In addition, our second-annual Leadership Academy class will “graduate” Thursday evening. The Class of 2016 is an impressive group of new attorneys who are committed to advancing their practice and contributing to the legal community in Maine. If you’re traveling with children, there will be a kids’ pizza party Thursday night, so the adults can enjoy the dinner, music and dancing to the Larry Williams Band. Outside the classroom, you can enjoy carriage rides in Acadia National Park with Carriages of Acadia; Dive-In Theater with Diver Ed; and craft beer tasting, courtesy of Rock Harbor Brewing Co. Thanks to generous sponsors, the carriage rides and Dive-In Theater will be offered to attendees and their families free of charge! Take advantage of excellent accommodation rates offered only for this event. The MSBA has secured the special rates of $190$239 per night, plus applicable taxes, and rates will be honored 2 days prior and post conference. These rates are guaranteed through May 23. Rooms sell out quickly, but reservations will be accepted after May 23 on a space- and rate-available basis. There are also a variety of other hotels, motels, bed and breakfasts, and campgrounds in the area. While we encourage you to join us on site, Bar Harbor offers many lodging options. As you can see, every effort is being made to ensure that this year’s meeting will be fun, relaxing and professionally rewarding. We hope you will register right away and look forward to seeing you in Bar Harbor this June. Stephen D. AFTER THE ACA, ABLE AND DECAMBRE: WHAT’S SPECIAL ABOUT SPECIAL NEEDS TRUSTS? This one-hour program is for the general practitioner, and it follows an all-day MSBA CLE on special needs trusts presented in May. This shorter session will focus on the new world of special needs trust planning and the additional options for individuals with disabilities following the passage of the Affordable Care Act in 2010 and the Achieving a Better Life Experience (ABLE) Act at the end of 2014. Is a special needs trust the best tool for the situation? What if the individual receives public housing benefits? If a special needs trust is appropriate, should it be a third-party trust or a first-party trust? How about a pooled trust? What are conversion trusts and sole-benefit trusts? When should a testamentary supplemental needs trust be considered? Jane Skelton, Esq., Maine Elder Law Firm, Bangor 2. CASEMAKER Come to the Casemaker presentation and take full advantage of this outstanding member benefit. Learn some tricks, tips and strategies and how to become more effective at online legal research from a 30-year veteran of online searching! Jim Corbett, Esq., Lawriter Corp., Cincinnati, OH 3. LIMITED-SCOPE REPRESENTATION UPDATE In 2001, Maine became the second state in the nation to adopt comprehensive rules to permit lawyers to unbundle legal services. This panel will address developments in legal services delivery models over the past 15 years, how attorneys can use limited-scope representation to increase revenue, the value this practice model brings to the court, and brainstorm about how to attract and serve consumers using limited-scope representation. Justice Andrew M. Mead, Penobscot Judicial Center, Bangor Elizabeth J. Scheffee, Esq., Shaheen & Gordon PA, Saco Elizabeth F. Stout, Esq., Law Office of Elizabeth Stout, Portland 4. THE PROFESSION AT RISK: THE SCOPE OF MENTAL HEALTH PROBLEMS AMONG ATTORNEYS, JUDGES AND LAW STUDENTS AND A PROPOSAL FOR ACTION (1.0 ETHICS) In January the results of a study of mental health issues in the American legal profession were published in the Journal of Addiction Medicine. The study, jointly funded by the ABA and the Hazelden Betty Ford Foundation, was the most comprehensive of its kind ever undertaken. More than 12,000 attorneys, judges and law students were surveyed. The study results surprised even members of the lawyer assistance program community: more than 36 percent of the study population qualified as problem drinkers; 20.6 percent suffered from depression and 19 percent suffered from anxiety. This program will explore details of the study, and, more importantly, examine the various avenues available to better assist those who face these issues, and help prevent others from falling victim to them. William C. Nugent, Esq., Maine Assistance Program for Lawyers & Judges, Portland 10:20–11:20 CONCURRENT SESSIONS (1.0 CLE CREDIT) 5. A PRIMER FOR MAINE ATTORNEYS TO DEMYSTIFY CLAIMS FOR SOCIAL SECURITY AND LONG-TERM DISABILITY BENEFITS Long-term disability (LTD) insurance coverage has become a more common and important part of the suite of employee benefits offered by employers to attract and retain qualified employees. At the same time, because of ERISA, the federal law governing most private group LTD policies, representing LTD claimants has become more challenging and complex. In the public disability benefits arena, with the financial pressures on the Social Security Administration, it has become much more difficult to win social security disability claim cases. These areas of legal practice are more closely aligned than one might think, but each has its own unique set of issues and challenges. This presentation will review the difficulties Maine lawyers grapple with in both LTD and social security disability cases, and will offer ideas and strategies to effectively respond to these issues. Presenters will outline winning strategies for prevailing in these claims. They will also discuss issues of legal ethics that are specific to SSA and LTD claims. Henri A. Benoit II, Esq., Law Offices of Joe Bornstein, Portland Andrew J. Bernstein, Esq., Law Offices of Joe Bornstein, Portland 6. THE ART AND ETHICS OF WITNESS PREPARATION (0.25 ETHICS) Preparing witnesses for depositions or interviews with the government takes time and skill. Too often we don’t spend the time necessary to ensure our clients put their best foot forward, and they accidentally say something untrue, are led into providing incomplete information or are confused about what they can and cannot say and leave out information important to their case. This session will be led by a litigator experienced with preparing clients to testify at depositions, before federal and state government agencies, and at trial. We will review strategies for preparing clients, including explaining the process to clients, how much information to prepare them with and doing an effective mock interview. We will also examine the line between preparation and coaching. Amy P. Dieterich, Esq., Skelton Taintor & Abbott, Auburn 7. CHOICES FOR BUSINESSES: WHAT WORKS FOR WHOM? This workshop will review Maine’s current LLC, corporate and similar business vehicles in the context of economic development needs and risk containment. Current rulings and examples of issues around ownership, control, expansion and risks will be discussed. Attendees are encouraged to bring questions on best practices as we explore business for development in Maine. Martha A. Novy-Broderick, Business Law Centers of Martha Novy-Broderick, Esq., Lincoln 8. LEVERAGING SOCIAL MEDIA TO MARKET YOUR PRACTICE The New Lawyers Section will provide an overview of the latest and greatest ways to use LinkedIn, Facebook, and Twitter to market one’s practice. The panelists include a group of new lawyers who have used social media creatively to build their brands as attorneys. The session will include an interactive workshop where the panelists will analyze attendees’ social media presences and provide real-time, live feedback. Kristen R. Dorion, Esq., Douglas McDaniel Campo & Schools LLC PA, Westbrook Aaron W. Mosher, Esq., Mosher Law Firm, Portland Jacqueline R. Moss, Esq., Maine Community Law Center, Portland FRIDAY, JUNE 24 9:00 – 10:00 CONCURRENT SESSIONS (1.0 CLE CREDIT) 9. A MULTIDISCIPLINARY APPROACH TO BUSINESS SUCCESSION PLANNING Nearly all business owners agree that succession planning is important, yet fewer than 15 percent have a plan that is current and written. Typically, planning is initiated only as a result of an event—an unsolicited offer, death of an owner, or a conflict between partners—leading to a suboptimal result. This session will bring together best practices from three professionals, all of whom focus on business succession planning, and will demonstrate that a systematic and well-coordinated approach between all of the clients professional advisors often leads to the best outcome. Marianna P. Liddell, Esq., Pierce Atwood LLP, Portland Andrew Smith, CPA, Principal, Baker Newman Noyes, Portland Steven E. Tenney, Senior Vice President, UBS Wealth Management, Portland 10. MEDIATION, MEDITATION, AND LIFE AFTER LITIGATION This session will cover my own transition from being a trial lawyer through my exploration of options and development of my current practice. Because part of my practice concerns helping lawyers work through their own transitions, I will talk about the issues commonly seen both in succession planning for older lawyers, and in finding employment or the right niche for younger lawyers. I will also be speaking about how to explore options to create an enriching life after law. Bill D. Robitzek, Esq., Maine Lawyer Services, Brunswick 11. MEDICAL MARIJUANA LAW AND YOUR PRACTICE The Maine Medical Use of Marijuana Act and its regulations have significant impacts on many other areas of law, including employment, land use, education, and business. The panel will present an overview of the Act and its regulations, followed by a discussion of the intersection of these laws on land use and zoning. There will also be a discussion of how the state is working to develop new ways of dealing with medical marijuana patients in the workplace. While time will only allow an overview of the three topics, the presenters will provide a road map for those who are seeking further information. Moderator: Lynne A. Williams, Esq., Bar Harbor Panelists: Peter D. Lowe, Esq., Brann & Isaacson LLP, Lewiston Christopher E. McCabe, Esq., Portland 12. MINDFULNESS BASED STRESS REDUCTION (1.0 ETHICS) In MBSR, participants learn to recognize habitual, unhelpful reactions to difficulty and learn instead to bring an interested, accepting and non-judgmental attitude to all experience, including difficult sensations, emotions, thoughts and behavior. MBSR may be used to a focus on specific patterns of negative thinking that people with depression are vulnerable to, but which we all experience from time to time. Elisabeth A Pickle, Esq., Pickle Law Firm, LLC, Manchester 10:15 – 11:15CONCURRENT SESSIONS (1.0 CLE CREDIT) 13.CASEMAKER Come to the Casemaker presentation and take full advantage of this outstanding member benefit. Learn some tricks, tips and strategies and how to become more effective at online legal research from a 30-year veteran of online searching! Jim Corbett, Esq., Lawriter Corp., Cincinnati, OH 14. FAMOUS CASE STUDIES: HOW BANKRUPTCY IMPACTED GENERAL LITIGATION CLAIMS OF THE RICH AND FAMOUS We will discuss the intersection of bankruptcy with three famous case studies, including a divorce, a personal injury action and a collection action involving high profile celebrities. We will demonstrate how a pending bankruptcy case may impact your ability to move forward with your case, we will discuss the discovery available in a bankruptcy context, and we will present some suggestions about how to avoid certain pitfalls that arise due to a pending bankruptcy case. Hon. Peter G. Cary, US Bankruptcy Court-District of Maine, Portland Jennifer H. Pincus, Esq., Office of the United States Trustee, Portland Tanya Sambatakos, Esq., Molleur Law Office LLC, Biddeford 15. IP CRASH COURSE FOR MAINE PRACTITIONERS In today’s knowledge-based economy, intellectual property continues to be one of the fastest growing legal specialties in the U.S. The speakers will present an overview of the law governing this fascinating and cutting-edge field of law, including the basics of trademark, unfair competition, copyright, patent, and other federal and state laws designed to protect intangible rights. The presentation will include tips and best practices for the practicing lawyer. Prior experience with IP law is not required. Jonathan M. Gelchinsky, Esq., Pierce Atwood LLP, Portland Vivek Rao, Esq., Pierce Atwood LLP, Portland 16. MAINE’S NEW ESTATE TAX REGIME: NOW WHAT? The presenters will review the history of the Maine estate tax as the foundation for the current estate tax rules and will outline how the new rules work, including the exemption amount, tax rates, and the effective gift tax on gifts made within one year of death. In addition, they will discuss what the current rules mean for both existing estate plans and new estate plans and techniques that may be utilized to adapt old plans to the new rules. Moderator: Abigail K. Diggins, Esq., LeBlanc & Young PA, Portland Panelists: Matie B. Little, Esq., LeBlanc & Young PA, Portland Stephen D. Nelson, Esq., Severson, Hand & Nelson, P.A., Houlton Kenleigh A. Nicoletta, Esq., Brann & Isaacson LLP, Lewiston 11:30 – 12:30PLENARY 17. I’LL KNOW IT WHEN I SEE IT… OR WILL I? NAVIGATING THE DISCRETIONARY AND MANDATORY REPORTING REQUIREMENTS OF MAINE RULE OF PROFESSIONAL CONDUCT 8.3 (1.0 ETHICS) Maine’s collegial bar can become constrained when lawyers must consider whether to report a colleague for disciplinary or impairment reasons. This session will consider and discuss how firms of all sizes can start developing policies (and tweak what they already have in place) to deal with questions/concerns related to discretionary and mandatory reporting of lawyers. Practitioners know that the reporting question might arise in the context of an overly aggressive or dishonest opposing counsel; a lawyer charged with or convicted of a serious crime; an unsafe and or volatile lawyer; a lawyer struggling with dementia, mental health or substance abuse challenges; or a lawyer who is improperly using client trust funds or law firm operating accounts.
