WHEREAS, the Assigned Counsel Department has a need for a Grants and Training Coordinator
to obtain ongoing grant funding in order to provide education and certified training to Attorneys staffing
the Assigned Counsel Program and to receive state revenue, and
WHEREAS, grant funding necessary to cover the salary and fringes for this position in the
amount of $227,643 is guaranteed by New York State Office of Indigent Legal Services for three years
(from January 1, 2014, through December 31, 2016) under the Upstate Quality Improvement and
Caseload Reduction Project, with some possibility of continuation beyond, now therefore be it
RESOLVED, on recommendation of the Public Safety and the Budget, Capital, and Personnel
Committees, That one position of Grants and Training Coordinator (1058/10) is created effective
immediately in the competitive class as a full-time, 35 hour per week position at a White Collar labor

Jail Project Update--Revised Design of Outdoor Facility
Jail Project Update--Revised Design of Outdoor Facility (ID # 4776)
A request was made that LaBella create a new design that rotates the current outdoor structure to
be rotated 180 degrees with a solid wall on the north and west sides of the structure.
Mr. Robison proposed that a special meeting be held at the Jail and that the Sheriff prepare
responses to the questions and provide all Legislators with a copy. A special meeting was scheduled on
May 5th at 5:45 p.m. at the Jail. Mr. Kukuvka will bring back a design based on the request made earlier
for a three-wall structure.

Authorization to Appropriate Department of Homeland Security
Grant Funding
WHEREAS, in 2012 the Sheriff’s Office had been approached by the Cornell University Police Department
who had expressed a desire to begin and maintain a regional K9 Explosive-Detection Team, and
WHEREAS, federal funding of up to $50,000 through the Department of Homeland Security was made
available for such purpose, and
WHEREAS, Cornell University was unable to apply for said funds on its own due to not being a municipality
as required by Homeland Security Grant guidelines, and
WHEREAS, Tompkins County as the grantee was able to apply for said funds, accept said funds, and
distribute said funds in accordance with pre-authorized expenses related to creating such a program, and
WHEREAS, on August 7, 2012, by Resolution No. 157, the Tompkins County Legislature gave its approval to
the Sheriff’s Office to accept said funds, and
WHEREAS, the Sheriff’s Office and Cornell University were unable to complete the purchase of the related
equipment and obtain reimbursement during the remainder of the 2012 and 2013 budget cycle, now therefore be it

aforementioned purpose,

WHEREAS, by Resolution 2013-143, this Legislature authorized an Amendment to the 2013-2017 Capital
Program and the execution of a contract with LaBella Associates for architectural and engineering services for a
renovation of the existing Tompkins County Jail that would convert little-used program space within the Jail to a
dormitory housing seven individuals, and offset the reduction of internal program space with a new sheltered outdoor
recreation facility, and

WHEREAS, the principal goal of the sheltered outdoor recreation facility is to reduce the reliance on indoor
program space, particularly on inclement days when weather conditions would otherwise force mandatory recreation
time for incarcerated individuals to occur in the remaining indoor program space that now houses a variety of other
programs and functions for inmates, and

WHEREAS, by Resolution 2013-143, LaBella Associates prepared architectural designs for such indoor and
outdoor improvements, and

WHEREAS, the design for the three-sided outdoor recreation facility proposed by LaBella Associates has
been reviewed by the Public Safety Committee and the Budget, Capital and Personnel Committees (“Committees”)
and by members of the public who have attended those review sessions, and

WHEREAS, the initial LaBella design has elicited numerous suggestions from Committee members, other
County Legislators, the Sheriff, County staff, and the public that are generally intended to maximize the tangible and
intangible benefits of outdoor recreation for incarcerated individuals and its safety and functionality for staff, and

WHEREAS, at its Special Meeting on May 5, the Public Safety Committee informally narrowed the design
choices to two, with one option located on the western portion of the recreation area and oriented to the east (“Option
A”), and the second option located on the eastern portion of the recreation area and oriented to the west (“Option B”),
and

WHEREAS, renderings of each option have been made available to all Legislators and to the public via the
County’s web page and are included in the formal minutes of the Public Safety Committee, and

WHEREAS, upon review of the renderings, the Public Safety Committee has recommended proceeding with

Public Safety Meeting Report- April 2014
Dear Members of the Public Safety Committee,
During the month of April, Sheriff Lansing participated in a several events and committee meetings.
On April 2nd, Sheriff Lansing attended a Cops, Kids and Toys committee meeting in order to discuss general
updates and future events. Additionally, on April 5th Sheriff Lansing refereed for the Special Olympic
Basketball Tournament that was held at TC3.
Sheriff Lansing also attended the Empire State Law Enforcement Traffic Safety Conference that was held in
Albany from April 7th to April 9th. There were many interesting speakers there that presented many ideas that
we have already started to implement; such as promoting the ‘Below 100’ initiative, which aims to reduce the
line of duty deaths to below 100.
The County Emergency Planning Committee met on April 10th in order to discuss basic committee functions
and provide updates. Additionally, on April 14th, Sheriff Lansing attended the Public Safety Meeting; at which
LaBella Associates presented the new jail presentation that will be proposed to the Legislature at a later date.
Also on April 14th, Sheriff Lansing spoke at the Trumansburg Gun Club regarding the New York Safe Act, in
order to inform the citizens about the new gun laws put in place.
On April 17th, Sheriff Lansing participated in an Officer Involved Domestic Violence Conference Call; which
was incredibly informative and contains a great deal of information that can be used within our own department
cases. Also on April 17th, the Tompkins County Sheriff’s Office participated in the fundraiser over at
Applebee’s for the Special Olympics. There was a great turn out from the community and a great amount of
donations made. Undersheriff Osborne, Sergeant Donahue, Deputy Slocum, Deputy Moracco, and Deputy
Thompson were also in attendance.
Additionally, on April 18th, Corrections Officer Patricia Smith celebrated her retirement. We wish her all the
best in her future endeavors and hope that she has enjoyed her work with our department.
Lastly, Sheriff Lansing attended a session about community-campus relations; which was put on by Cornell’s
Community and Regional Development Institute and Office of Community Relations.

The Sheriff’s Office teamed up with the Cornell Police Department on April 26th in order to put on our monthly
Child Car Seat Safety Program. We had 10 appointments made. Additionally, the Tompkins County Sheriff’s
Office worked a total of 12 hours of DWI Grant Special Detail; during which time 6 traffic tickets were issued.
During the month of April, there were several training sessions and tests that took place. Deputies Walker,
Haselman and Skeval attended the Child Passenger Safety Training Program that was held at the Cortlandville
Fire Department; which will allow the Sheriff’s Office to have more deputies able to install Child car seats.
Additionally, Deputy Humble, Deputy Walker, Sergeant Manning, Sergeant Koskinen, and Investigator
Berhardt attended the New York Tactical Officers Association Conference. This conference covers several
different S.W.A.T. seminars and programs.
Another training that took place was the New York State Firearms Instructor School; which was held at the
Ithaca Police Department. Sergeant Koskinen and Deputy Vann attended. Also, April 14th-April 18th the
Sheriff’s Office had an In-Service Training for the department. This was held at the Crash, Fire and Rescue
Building. It covered CPR, AED, Tactical Emergency Casualty Care, Right to Know, Blood borne Pathogens,
DRE Awareness, and Search and Seizure training. Lastly, On April 24th and 25th the Sheriff’s Office
participated in the yearly Respirator Fit Test that is put on by the Tompkins County Health and Safety Division.
In general, for Sheriff’s Office arrests, we had a several notable cases. On April 4th, 2014 at 9:50 PM,
Tompkins County Sheriff's Deputies responded to an erratic driver complaint in the area of Trumansburg Road
near Cayuga Medical Center. The complaint was from a concerned citizen reporting a possible intoxicated
driver. Deputies observed the vehicle, a grey Volvo traveling at a very slow speed and observed the vehicle
cross the center lane divider line. Deputies performed a traffic stop on the vehicle and spoke with the driver,
Kathryn L. Rehner, age 61 of Mount Road in Trumansburg. At the conclusion of the investigation, Deputies
arrested Rehner for Driving While Intoxicated. Rehner was charged with Driving Too Slow (violation), Failure
to Keep Right (violation), Crossing Road Hazard Markings (violation), Driving While Intoxicated - First
Offense (U Misdemeanor) and Driving While BAC is at or Greater Than .18% - First Offense (U
Misdemeanor). She was issued an appearance ticket on the charges and was directed to appear at the Town of
Ithaca Court on May 1st, 2014 at 9:00 AM.
On April 5, 2014 at approximately 6:11 AM, deputies responded to a motor vehicle accident on Peruville Road,
near Armstrong Road, in the Town of Lansing. Upon arrival, deputies observed a 2014 Toyota in a ditch along
the side of the road. Deputies identified the operator as Laura A. Path-Falso age 42 of Homer, New York.
Deputies determined Path-Falso was intoxicated. Path-Falso was charged with two counts of Driving While

Intoxicated, Failure to Keep Right, Failure to Use the Designated Lane, and Operating on the Shoulder. PathFalso was released and is to appear in the Town of Lansing Court on April 29, 2014 at 9:30 AM.
Additionally, on April 5, 2014, deputies observed a gray Nissan traveling south on Danby Road in the Town of
Ithaca at a high rate of speed. Deputies identified the operator as Alyn C. O'Brien age 21 of Ithaca, New York.
Deputies determined O'Brien was intoxicated. O'Brien was charged with two counts of Driving While
Intoxicated and Excessive Speed in a Posted Zone. O'Brien was released and is to appear in the Town of Ithaca
Court on April 30, 2014 at 4:00 PM.
Another case took place on April 6th, 2014 at 7:15 PM, Tompkins County Sheriff's Deputies attempted to
perform a traffic stop on a blue colored Chevrolet Trailblazer traveling South on Trumansburg Road near
ShurSave. The vehicle failed to yield emergency lights and sirens and accelerated to speeds upwards of 85 mph.
The vehicle eventually went off road and through a corn field to avoid apprehension on Halseyville Road.
Schuyler County Sheriff's Office K9 responded to the scene and conducted a successful track on the suspect
who fled on foot. The driver, Nathan R. Nehrbass, age 32 of Halseyville Road in Trumansburg was arrested on
April 12th, 2014 once he was identified as the driver. Nehrbass was charged with Unlawful Fleeing a Police
Officer in a Motor Vehicle in the Third Degree, Aggravated Unlicensed Operation of a MV in the Second
Degree, Criminal Possession of Stolen Property in the Fifth Degree and Operating a MV out of Ignition
Interlock Restrictions, all of which are misdemeanors. Nehrbass was also charged with several other Vehicle
and Traffic Law Violations. Nehrbass was arraigned on the Town of Ulysses Court and remanded to the
Tompkins County Jail. Nehrbass is due to return to the Town of Ulysses Court on April 16th, 2014 at 9:30 AM.
On April 8th, 2014 at 5:38 PM, Tompkins County Sheriff's Deputies responded to Kimberly Circle in the Town
of Dryden for a motor vehicle accident reporting no injuries. Deputies found the operator, John P. Praast, age 63
of Kimberly Drive, Dryden still inside the vehicle stuck and unable to get out. Once Dryden Fire Department
arrived and assisted in removing Praast from the vehicle, Sheriff's Deputies conducted a DWI Investigation
which led to the arrest of Praast for DWI. Praast was charged with Driving While Intoxicated - 1st Offense
(Unclassified Misdemeanor) and Failure to Keep Right (Violation). Praast was processed and released to a third
party. Praast is due to appear on May 5th, 2014 at 5:00 PM, Town of Dryden Court.
On April 11th at 11:50 AM, Tompkins County Sheriff Deputies were dispatched to Stevens Road in the Town of
Groton for a report of a two-car motor vehicle collision; whereas the suspect vehicle fled the scene. Upon
investigation, Charlton J. Crandall, age 37 of ST Route 215 Cortland, was found to be the operator of 2007
Chevrolet Blazer that struck a vehicle and fled the scene. Upon further investigation, Deputies discovered that
the Victim, whose vehicle was struck, had a Valid Order of Protection against Crandall. The Order of Protection
was signed by Judge Elizabeth Burns in the City of Cortland Court ordering Crandall to stay away from the
Victim. Crandall was charged with Unsafe Passing on the Left, Aggravated Unlicensed Operation in the 2nd
Degree, Leaving the Scene of a Property Damage Motor Vehicle Accident, and Criminal Contempt in the First
Degree (Class E Felony). Per the Town of Groton Magistrate, Crandall was issued an Appearance Ticket to
appear in court on April 23rd at 2:30 PM.

Meeting of May 12, 2014
On April 12th, 2014 at 5:41 PM, Tompkins County Sheriff's Deputies who were assisted by the Ithaca Police
Department and the Ithaca College Public Safety responded to Therm located at 1000 Hudson Street in the
Town of Ithaca for a Criminal Mischief Complaint. The complaint was that three college aged males were seen
knocking over and damaging the Therm sign located out front of the business. The three individuals were
located shortly after the phone call and identified as Evan M. Skea, age 19 of Baskinridge, N.J., Brendan W.
Brown, age 18 of Middletown, N.Y. and Michael J. Rabasca, age 19 of Berkeley Heights, N.J. All three were
arrested and charged with Criminal Mischief in the Fourth Degree. They were all issued appearance tickets and
ordered to answer the charges at the Town of Ithaca Court on April 30th, 2014 at 4:00 PM.
Also on April 12th, 2014, at 10:41 PM the Tompkins County Sheriff's Deputies responded to Rogan's Corners,
located at 825 Danby Road in the Town of Ithaca for a motor vehicle accident that struck the Rogan's Corners
building. Deputies investigated the accident scene and determined that Danielle M. Pettit, age 39 of North Road
in Whitney Point was the driver. Deputies conducted Standardized Field Sobriety Tests on Pettit and concluded
that Pettit was Driving While Intoxicated. Pettit was arrested and charged with Driving While Intoxicated - First
Offense and Aggravated Driving While Intoxicated with BAC at or above .18% - First Offense. Pettit is ordered
to appear at the Town of Ithaca Court on May 8th, 2014 at 9:00 AM to answer the charges.
On April 15th, 2014 at 9:58 A:M, Deputies responded to the area of Auburn Road (State Route 34) in the Town
of Lansing for a report of a tractor trailer that rolled over onto its side. Upon investigation into the incident,
deputies determined that a 2005 Freightliner tractor trailer hauling scrap metal was traveling north on Auburn
Road and veered off of the east shoulder of the roadway and came to rest on its side in the ditch. The driver,
Jaime Melfi, age 42 of Syracuse, NY was not injured. The 2005 Freightliner belongs to Shameless Trucking,
LLC out of Oswego, NY. Melfi was issued a ticket for failure to keep right. The New York State Police
Commercial Motor Vehicle Enforcement Unit assisted at the scene.
On April 15th, at 2:30 PM, Tompkins County Sheriffs Deputies arrested Kristina A. Heptig, age 54 of
Mecklenburg Road in the Town of Ithaca, for Petit Larceny. The incident took place on April 3rd at 3:30 PM at
the Mobile Gas station located on N. Triphammer Road in the Village of Lansing. It was reported that while
Heptig was shopping at the Mobile, Heptig went behind the counter and stole two Electronic Cigarettes and
exited the store. Heptig was arrested and issued an appearance ticket to appear in the Town of Lansing Court on
May 20th at 9:00 AM
The Sheriff’s Office reports the unfortunate death of inmate Travis M. Yavits, age 32, of Ithaca, NY. Mr. Yavits
was placed in the jail by a City of Ithaca court order on April 15th at 4:44 PM. He was to serve a 60 day
sentence for a Larceny conviction. On April 16th at approximately 3:32 AM, Yavits was discovered deceased in
his bunk by a Corrections Officer making routine cell inspections. Mr. Yavits’ death does not appear to be
suspicious in nature and there is no indication of foul-play; however, a determination into the cause of his death
is still under investigation. Assistance is being provided by the Onondaga County Medical Examiner’s Office.
On April 18, 2014 at 2:30 PM, Tompkins County Sheriffs Deputies arrested Kristina A. Heptig age 54 of

Additionally, on April 19, 2014 at approximately 1:34 AM, deputies observed a red in color Chevrolet fail to
stop at the stop sign on Emmonds Road at the intersection with Davis Road in the Town of Lansing. The
vehicle failed to stop at the stop sign again on Davis Road at the intersection with Jerry Smith Road. Deputies
identified the operator as Ronald M. Shields Jr., age 52 of Genoa, New York. Deputies further determined
Shields was intoxicated. Shields was charged with two counts of Driving While Intoxicated, Failure to stop at a
Stop Sign and Unsafe or Failure to Signal a Turn. Shields was released and is to appear in the Town of Lansing
Court on May 8, 2014 at 7:00 PM.
On April 20, 2014 at approximately 2:21 AM, deputies responded to 125 Manhattan Road in the Town of
Newfield for a report of damage to a vehicle. Upon arrival, deputies interviewed the vehicle owner who stated
he witnessed Billy R. Ward age 27 of Newfield, New York smash the windshield and window of the owner's
2002 Ford while it was parked at the residence. Ward then fled the area and was later arrested at his residence
without incident. Ward was charged with Felony Criminal Mischief in the Third Degree. He was released and is
to appear in the Town of Newfield Court on May 8, 2014 at 1:00 PM.
On April 23rd, 2014, Tompkins County Sheriff's Deputies responded with Fire/Medical to Main Street and
Sherbore Drive, Town of Dryden for a two car personal injury motor vehicle accident. The accident scene
indicated that one of the vehicles failed to keep right crossing into the oncoming lane. The vehicles then
collided head on. Fire/Medical attempted to airlift one patient however the helicopter declined due to weather.
The patient was transported to Upstate Medical for treatment of their injuries by Dryden Ambulance.
On April 25, 2014 at approximately 11:58 PM, deputies responded to a report of a personal injury motor vehicle
accident on Freese Road in the Town of Dryden. Upon arrival, deputies observed a 1997 blue in color Chevrolet
pickup truck into a tree at 97 Freese Road. Deputies further observed the operator of the vehicle, Matthew H.
Sloat age 44 of Ithaca, New York still inside the vehicle. Sloat exited the vehicle through the front where the
windshield was blown out due to the impact of the motor vehicle accident. Deputies determined Sloat was
intoxicated. Sloat was charged with two counts of Driving While Intoxicated, Failure to Keep Right and
Excessive Speed Due to Road Conditions. Sloat was released and is to appear in the Town of Dryden Court on
May 12, 2014 at 5:00 PM.
Lastly, On April 26th, 2014 at 3:13 PM, Tompkins County Sheriff's Deputies responded to 279 Pennsylvania
Ave in the Town of Ithaca for a noise complaint. Deputies found a large party underway with over 200 people
attending. There was also amplified music that could be heard from around the neighborhood. Deputies arrested
and cited one resident, Christopher A. Ramirez, age 23. Ramirez was issued an appearance ticket charging him
with the Town of Ithaca Noise Ordinance violation and is due to appear on May 7th, 2014 at 4:00 PM.
In relation to the same case, on April 26th, 2014 at 4:35 PM, Tompkins County Sheriff's Deputies again
responded to 279 Pennsylvania Ave in the Town of Ithaca for a noise complaint. Deputies found that the large

gathering they attempted to disperse earlier has started back up. This time there were over 100 people and a DJ
playing amplified music that could again be heard around the neighborhood. Two residents, Kevin L. Collins,
age 20 and Christopher R. Ramirez, age 23 were both arrested and cited for violation of the Town of Ithaca
Noise Ordinance. Deputies also arrested Madeline Graziano, age 20 of 17 Sutton Place in Middletown, NJ for
Under Age Possession of Alcohol. Graziano, Collins and Ramirez were all issued appearance tickets ordering
they appear at the Town of Ithaca Court on May 7th, 2014 at 4:00 PM.
To conclude this report, during the month of April, the Civil Division took in $99,885.04 and remitted
$13,369.40 in revenue to the Tompkins County Treasurer. 222 actions were docketed requiring 264 services;
127 of these papers were exempt from fees. 420 attempts were made throughout the entire county to serve the
civil process paper; resulting in 212 successful services. The Civil Division also processed 13 new pistol permit
applications, 4 duplicate licenses and 72 amendments. The total revenue generated by pistol permits was
$370.00.
