QUITOEKUADOR 22-27 MARET 2013 LAPORAN BADAN KERJASAMA ANTAR PARLEMEN DELEGASI DPR RI KE THE 128TH INTER-PARLIAMENTARY UNION (IPU) ASSEMBLY AND RELATED MEETINGS LAPORAN BADAN KERJASAMA ANTAR PARLEMEN MENGENAI DELEGASI DPR RI KE THE 128TH INTER-PARLIAMENTARY UNION (IPU) ASSEMBLY QUITO - ECUADOR, 22-27 MARET 2013 A. PENDAHULUAN Pada tanggal 22 sampai dengan 27 Maret 2013 Delegasi DPR-RI telah menghadiri rangkaian the 128th Inter-Parliamentary Union (IPU) Assembly and related meetings di Quito - Ecuador. Assembly ke-128 IPU ini dihadiri oleh 120 parlemen anggota IPU dengan jumlah total sekitar 1300 anggota delegasi, termasuk di antaranya 650 orang anggota parlemen. Governing Council dipimpin oleh Presiden IPU, Mr. Abdelwahad Radi, sedangkan Assembly dipimpin oleh H.E. Mr. Fernando Cordero Cueva, Ketua Parlemen Ekuador. Sidang dibuka secara resmi oleh Presiden Ekuador, H.E. Mr. Rafael Correa Delgado, pada tanggal 22 Maret 2013. Pengiriman Delegasi DPR RI ke Assembly IPU ke – 128 ini didasarkan pada Surat Keputusan Pimpinan DPR RI No.181/ PIMP/ III/ 2012-2013 dengan komposisi dan susunan Delegasi DPR RI sebagai berikut: 1) Dr. Ir. Pramono Anung Wibowo, MM. (FPDIP) - Ketua Delegasi 2) KH. DR. Surahman Hidayat (FPKS/ Komisi X) - Anggota Delegasi 3) H. Hayono Isman, S.IP (FPD/ Komisi I) - Anggota Delegasi 4) H. Andi Anzhar Cakra Wijaya, SH. (FPAN/ Komisi III) - Anggota Delegasi 5) Dr. Nurhayati Ali Assegaf, M.Si. (FPD/ Komisi I) - Anggota Delegasi 6) Tantowi Yahya (FPG/ Komisi I) - Anggota Delegasi 7) Meutya Viada Hafid (FPG/ Komisi I) - Anggota Delegasi 2 8) Puan Maharani (FPDIP/ Komisi I) - Anggota Delegasi 9) Evita Nursanty, M.Sc. (F-Hanura/ Komisi I) – Anggota Delegasi Delegasi didampingi oleh pimpinan dan anggota DPD RI (sebagai adviser), unsur Kementerian Luar Negeri, KBRI Quito, Tenaga Ahli BKSAP dan Sekretariat Jenderal DPR RI. B. MISI DELEGASI 1. BKSAP menargetkan agar Indonesia dapat mencalonkan anggota-anggotanya pada beberapa jabatan kosong di IPU; 2. Memimpin dan mengikuti dengan baik beberapa pertemuan sesuai dengan keanggotaan anggota DPR RI di berbagai komisi dan badan di IPU (seperti Executive Committee, Coordinating Committee for Women Parliamentarians, Meeting for Women Parliamentarians, Committee to Promote Respect for International Humanitarian Law, dan Advisory Group on HIV/AIDS – MNCH); 3. Memberi kontribusi Indonesia pada General Assembly, draf resolusi yang didiskusikan dalam standing committee, Meeting of Women Parliamentarians, Meeting of Young Parliamentarians serta beberapa diskusi panel dan open session lainnya; 4. Menjalin networking dengan delegasi parlemen dan organisasi internasional yang hadir di sidang IPU. 3 C. AGENDA PERSIDANGAN The 128th IPU Assembly and related meetings telah membahas sejumlah agenda dan isu yang pembahasannya dilaksanakan melalui: 1. Executive Committee, dengan agenda-agenda: Laporan kegiatan dan finansial IPU, Status keanggotaan dan observer IPU, IPU Strategy 2012-2017, kerjasama dengan Perserikatan Bangsa-Bangsa (PBB), kegiatan dan Assembly IPU yang akan datang, serta masalah kesekretariatan; 2. Opening Session; 3. Assembly, dengan agenda-agenda: Pemilihan Presiden dan Wakil Presiden IPU Assembly ke-128; Emergency item; General debate; Adopsi resolusi-resolusi yang telah didiskusikan dalam Standing Committee; Persetujuan topik-topik untuk IPU Assembly ke-130 dan penunjukkan Rapporteurs; Amandemen terhadap Statuta dan Rules IPU. 4. Governing Council yang membahas masalah keorganisasian IPU; 5. Standing Committee: 1st Standing Committee (Peace and International Security) membahas draf resolusi dengan judul Enforcing the Responsibility to Protect: The Role of Parliament in Safeguarding Civilians’ Live; 2nd Standing Committee (Sustainable Development, Finance and Trade) membahas draf resolusi dengan judul Fair trade and innovating financing Mechanism for Sustainable Development; 3rd Standing Committee (Democracy and Human Rights), membahas draf resolusi dengan judul The use of media, including social media, the enhance citizen engagement and democracy 6. Coordinating Committee for Women Parliamentarians; 7. Meeting of Women Parliamentarians; 4 8. Committee to Promote Respect for the International Humanitarian Law; 9. Advisory Group on HIV/AIDS, Maternal, and Children Health (MNCH). Sementara itu, Delegasi juga menghadiri pertemuan-pertemuan kelompok kawasan maupun bilateral dengan: 1. ASEAN +3 Meeting; 2. Asia Pacific Group (APG) Meeting; 3. Consultation Meeting of the Islamic Group (PUIC); 4. Pertemuan Bilateral dengan delegasi Ekuador dan Maroko. Delegasi DPR RI juga mengikuti pertemuan informal lainnya sebagai berikut: 1. Meeting of Young Parliamentarians; 2. Open Session of Committee to Promote Respect for International Humanitarian Law on Parliamentary Dimension on Responsibility to Protect; 3. Panel Discussion on Legalization of Drugs: Can it Help Curb Organized Crime; 4. Panel Discussion on Addressing the Rights of Children with Disabilities. D. JALANNYA PERSIDANGAN EXECUTIVE COMMITTEE Dr. Nurhayati Ali Assegaf, M.Si. mengikuti pertemuan Executive Committee IPU sebagai President of IPU Coordinating Committee for Women Parliamentarians. Pertemuan menghasilkan beberapa hal, sebagai berikut: 1. Pada isu implementasi IPU Strategy 2012 - 2017, IPU telah berkomitmen untuk berkontribusi secara aktif dalam penyusunan agenda pembangunan pasca-MDGs. Hal ini ditunjukkan dengan beberapa pertemuan yang telah dilakukan, termasuk di Monrovia dan Johannesburg. Pertemuan The High Level Panel dengan anggota5 anggota parlemen yang akan berlangsung di Bali pada 25-26 Maret 2013 juga akan menjadi saluran bagi pesan yang ingin disampaikan IPU mengenai bagaimana demokrasi dan pemerintahan yang demokratik harus muncul dengan jelas sebagai salah satu tujuan baru pasca-2015. Presiden IPU juga mendorong anggota parlemen untuk mengikuti survey online mengenai democratic governance untuk merefleksikan pandangan anggota parlemen dengan lebih baik. 2. Mengenai pengaturan pemilihan Sekretaris Jenderal IPU yang baru, Executive Committee telah menyetujui jangka waktu lima belas bulan untuk memilih Sekretaris Jenderal IPU yang baru agar memungkinkan untuk memilih calon yang terbaik. Executive Committee telah mendiskusikan pertimbangan rotasi geografis, namun hal itu akan menjadi pertimbangan kedua, sementara yang utama adalah mendapatkan kandidat terbaik. 3. Mengenai format baru IPU Assembly, fungsi Biro Standing Committee, dan status IPU Committee on UN Affairs, Executive Committee menekankan keputusan yang telah diambil oleh Governing Council pada IPU Assembly di Quebec City, bahwa kedua Assembly akan berdurasi empat hari dengan masing-masing Assembly memiliki program kerja yang serupa termasuk debat umum dan sesi penutupan untuk mengadopsi resolusi; debat mengenai emergency item; pertemuan Governing Council dan Executive Committee; pertemuan standing committee; Committee on UN affairs; Committee on Human Rights of Parliamentarians, dan Meeting of Women Parliamentarians. Selain itu, sekiranya sudah disetujui, maka dimungkinkan pula diadakan Meeting of Young Parliamentarians. Sementara itu, masing-masing Standing Committee akan tetap hanya mengadopsi satu resolusi setiap tahunnya. 4. Pada diskusi mengenai logo baru IPU, anggota-anggota Executive Committee masih belum puas dengan desain yang diberikan oleh konsultan. Sebagian besar anggota Executive Committee berpendapat perlunya untuk mempertahankan sebagian unsur dari logo lama, misalnya tetap mencantumkan tahun, dan tidak begitu saja diganti dengan desain yang sama sekali baru. Executive Committee akan kembali melakukan kajian mengenai logo ini di Jenewa; 6 5. Mengenai isu tuan rumah IPU Assembly yang akan datang, Executive Committee meminta konfirmasi Azerbaijan, yang akan menjadi tuan rumah IPU Assembly tahun 2014, untuk dapat menjamin akses untuk seluruh anggota dan oberservers IPU agar dapat hadir di Azerbaijan. Pada saat pertemuan berlangsung, Sekjen masih menunggu konfirmasi tersebut dari Pemerintah Azerbaijan. Untuk IPU Assembly tahun 2015, Executive Committee menyambut baik kesiapan Vietnam untuk menjadi tuan rumah. Delegasi Indonesia mencatat tidak hadirnya anggota Executive Committee yang merupakan perwakilan dari Asia-Pacific Group. Hal ini sangat disayangkan karena suara Asia-Pacific Group menjadi tidak terwakili, selain beberapa agenda penting yang menjadi tidak tersampaikan pada pertemuan Asia-Pacific Group. Sementara, Dr. Nurhayati Ali Assegaf dari Indonesia hadir dalam kapasitasnya sebagai wakil dari anggota parlemen perempuan dan tidak dapat melaporkan kepada pertemuan AsiaPacific Group karena berada dalam Meeting of Women Parliamentarians yang dilaksanakan pada saat yang bersamaan. Perhatian ini sekaligus update mengenai pertemuan Executive Committee telah disampaikan Delegasi Indonesia kepada pertemuan Asia-Pacific Group. OPENING SESSION Pada tanggal 22 Maret 2013, Presiden Ekuador, H.E. Mr. Rafael Correa Delgado membuka secara resmi rangkaian IPU Assembly ke-128. Dalam sambutannya, Presiden Ekuador menekankan bahwa tema utama IPU Assembly ke-128 menunjukkan pentingnya pemerintahan yang baik sebagai elemen penting pembangunan dan pertumbuhan yang menghormati “the health of our planet”. Mr. Correa juga menyampaikan pentingnya merumuskan cara alternatif yang lebih efektif untuk meningkatkan partisipasi masyarakat dalam demokrasi langsung dengan memanfaatkan teknologi baru. 7 Pada kesempatan yang sama, Ketua Parlemen Ekuador yang juga merupakan Ketua Geopolitical Group for Latin America and the Caribbean (GRULAC) IPU, Mr. Fernando Cordero menyampaikan pentingnya mendorong parlemen untuk mewujudkan model pertumbuhan ekonomi yang lebih berkelanjutan dan merumuskan cara untuk memperkuat demokrasi dan melindungi hak asasi manusia. Sementara Presiden IPU, Mr. Abdelwahad Radi, menyampaikan perlunya memprioritaskan dialog untuk mencapai kesepakatan, memperkuat institusi dan langkah antar parlemen dalam mendorong demokrasi. Parlemen dengan fungsinya memiliki kekuatan untuk membentuk dunia baru yang lebih baik dan juga berkewajiban untuk mewakili kepentingan dan melindungi rakyatnya. Ia juga menekankan pentingnya perdamaian dan kesejahteraan seluruh bangsa serta penggunaan dialog sebagai instrumen efektif untuk mengakhiri konflik. Mr. Radi menyampaikan tantangan terkini bagi parlemen adalah untuk mengimplementasikan praktek dan program yang mencakup model sosial untuk mencapai kemajuan pembangunan dan penerapan demokrasi. Oleh karena itu, untuk menghadapi tantangan tersebut, perlu dilakukan modernisasi terhadap visi IPU dan menjadikan IPU sebagai institusi global. Pada sesi pembukaan ini, Under Secretary General PBB, Mr. Philippe DousteBlazy, mewakili Sekretaris Jenderal PBB, menyampaikan apresiasi terhadap usaha IPU dalam mempromosikan Millennium Development Goals (MDGs) dan pembangunan berkelanjutan, serta menjadikan kedua isu tersebut sebagai isu utama dalam IPU Assembly ke-128. Konsep “Buen Vivir” dalam tema Assembly kali ini menunjukkan pentingnya keselarasan dalam hidup manusia dan pentingnya untuk tidak bergantung pada konsumsi dan produksi industri yang tidak terkendali. Mr. Douste-Blazy mengatakan hasil IPU Assembly ke-128 akan menjadi bahan pertimbangan dalam pembahasan prioritas agenda pembangunan pasca 2015 dan pencapaian pembangunan berkelanjutan yang sedang berlangsung di PBB. 8 ASSEMBLY Pemilihan President dan Vice-President Assembly IPU Assembly ke-128 secara aklamasi memilih H.E. Mr. Fernando Cordero Ketua Parlemen Ekuador sebagai President Assembly. Emergency Items Dalam IPU Assembly ke-128 terdapat 6 (enam) emergency items yang diusulkan untuk dibahas, yaitu: 1. Should the deliberate destruction of world cultural heritage not be considered as a crime against humanity? The role of parliaments in: 1) passing appropriate legislation to guarantee protection of world cultural heritage; and 2) developing international criminal law provisions that criminalize serious attacks on the cultural heritage of humanity yang diusulkan oleh Maroko; 2. That homosexuals are entitled to full rights of citizenship. It is the role of parliaments to pass legislation that decriminalizes homosexuality and homosexual acts between consenting adults yang diusulkan oleh New Zealand; 3. The role of parliaments in achieving international peace and security through a peaceful settlement of the Syrian crisis yang diusulkan oleh Syiria; 4. The status of Syrian refugees: The role of parliaments in bringing pressure to bear on their governments to assume their international and humanitarian responsibility towards these refugees and to support the neighbouring countries that receive them yang diusulkan oleh Yordania; 5. Unaccompanied migrant children around the world yang diusulkan oleh Meksiko; 6. The security and humanitarian impacts of the crisis in Syria, including in neighbouring countries yang diusulkan oleh United Kingdom. 9 Foto 1: Delegasi DPR-RI pada salah satu sesi assembly: (nomor 2 dari kiri ke kanan) Tantowi Yahya, Susaningtyas Kertopati, Hayono Isman, Surahman Hidayat, Hidayat Nur Wahid, Pramono Anung Usulan Selandia Baru dan Mexico ditetapkan oleh Presiden IPU bukan sebagai emergency items, sehingga dikeluarkan dari pembahasan. Kemudian Sidang menyetujui untuk membahas usulan emergency item yang diusulkan oleh Yordania untuk disusun ulang oleh drafting committee dengan mengakomodasi usulan Inggris mengenai isu serupa. Pada saat pengesahan Resolusi untuk emergency item ini, delegasi Suriah menyatakan reservasi terhadap beberapa bagian dalam resolusi yang dianggap mengancam kedaulatan Suriah. Selain itu, delegasi dari Aljazair, Ekuador, El Savador, Iran, Mexico, Peru, Rusia, Sudan, Suriah, dan Uruguay menyatakan reservasi terhadap pencatuman kata “security” dalam judul resolusi. Masuknya kata “security” dalam judul resolusi dianggap tidak sesuai dengan kesepakatan sebelumnya bahwa draf resolusi tersebut dimaksudkan untuk memberikan bantuan kemanusiaan bagi pengungsi Suriah dan bukan menangani isu keamanan di Suriah. Menanggapi protes tersebut, Yordania sebagai sponsor menyatakan bahwa kata “security” telah ada dalam proposal awal dengan mengingat masalah pengungsi dapat mengancam situasi keamanan pada negara sekitar dan tidak merujuk pada Suriah. 10 Sidang IPU ke-128 akhirnya mengesahkan resolusi untuk emergency item yang berjudul "The role of parliaments in addressing the security and humanitarian impact of the crisis in Syria and in bringing pressure to bear on their governments to assume their international and humanitarian responsibility towards Syrian refugees and to support the neighbouring countries that receive them” (Lampiran 1). General Debate Pada sesi debat umum ini, seratus delegasi menyampaikan pandangan terkait konsep “Buen Vivir” sebagai alternatif terhadap pembangunan yang terfokus pada pencapaian “hidup yang baik” atau good life dengan menekankan pentingnya harmonisasi antara pembangunan ekonomi yang dilakukan masyarakat dan kelestarian alam. Tema Buen Vivir (communal well-being) sebagai orientasi kebijakan suatu negara memerlukan kondisi material yang memastikan keamanan, akses kesehatan, perumahan, pengembangan personal melalui pendidikan, persamaan kesempatan, akses budaya, pengakuan warga negara dan partisipasi politik bagi warga negaranya. Pada kesempatan ini, Ketua Delegasi RI, Dr. Ir. Pramono Anung Wibowo, MM. menyampaikan pidato (Lampiran 2) yang berisi pokok-pokok sebagai berikut: a. Komitmen Indonesia dalam membangun hubungan yang harmonis antara manusia dan alam termasuk dalam hal pembangunan sebagaimana dimuat dalam Undangundang Dasar 1945 yang menjamin bahwa tanah, air dan sumber daya alam lainnya dipelihara oleh negara dan dimanfaatkan sebesar-besarnya untuk kepentingan rakyat; 11 Foto 2: Ketua Delegasi DPR-RI, Pramono Anung Wibowo, menyampaikan pidato pada sesi General Debate yang bertema “Buen Vivir” b. Mendorong IPU agar lebih berkontribusi terhadap perumusan pendekatan dan solusi baru atas penyelesaian isu global saat ini; c. Menyampaikan apresiasi atas upaya IPU mempromosikan global consultation on Post-2015 Development Agenda. Terkait hal ini, Indonesia menyampaikan dukungan kepada IPU atas dukungan atas penyelenggaraan Regional Consultation on MDGs and Post-2015 Development Agenda di Bali yang dilaksanakan di sela-sela Pertemuan ke-4 Consultative Meeting of the High Level Panel of Eminent Persons for Post-2015 Development Agenda; d. Menyampaikan pandangan Indonesia atas isu dalam draf resolusi yang akan disahkan IPU Assembly ke - 128. Indonesia mendukung penyelesaian damai sebagai prioritas solusi terhadap konflik dan intervensi militer sebagai upaya terakhir. Terkait perdagangan, Indonesia berpandangan pentingnya pembagian keuntungan perdagangan yang adil dan mendorong upaya nasional dan dukungan internasional untuk membentuk kapasitas suplai dan ekspor yang kompetitif khususnya bagi Least Developed Countries (LDCs) dan negara berkembang. Indonesia juga mengakui pentingnya media sosial untuk meningkatkan partisipasi masyarakat dan pencapaian demokrasi, namun tetap berpandangan bahwa kebebasan berekspresi bukanlah sesuatu yang absolut. 12 Rangkuman dari pidato-pidato yang disampaikan dalam general Debate dirangkum ke dalam Quito Communique (Lampiran 3). Resolutions of The Three Standing Committees Sidang IPU ke-128 mengesahkan 3 (tiga) resolusi hasil pembahasan Standing Committee, yaitu: a. Resolusi “Enforcing the Responsibility to Protect: The Role of Parliament in Safeguarding Civilians’ Live” oleh 1st Standing Committee on Peace and International Security (Lampiran 4). Resolusi pada pokoknya menekankan antara lain: Meminta parlemen dan anggota parlemen untuk meningkatkan kesadaran publik tentang pentingnya mencegah dan menghentikan genosida, kejahatan perang, pembersihan etnis dan kejahatan kemanusiaan, dengan perhatian khusus bagi perempuan dan anak, dan untuk menyelesaikan akar permasalahan konflik; Parlemen agar memanfaatkan jaringan internasionalnya untuk memastikan ratifikasi terhadap Rome Statute of the International Criminal Court; Mendorong parlemen untuk memastikan perlindungan terhadap hak asasi manusia, termasuk perempuan dan anak, kelompok minoritas, dijamin oleh hukum nasional dan diimplementasikan. b. Resolusi “Fair trade and innovating financing Mechanism for Sustainable Development” (Lampiran 5) oleh 2nd Standing Committee on Sustainable Development, Finance and Trade. Resolusi pada pokoknya menekankan antara lain: Mendorong parlemen untuk mempromosikan dan mendukung fair trade dan menjadikan fair trade sebagai bagian tidak terpisahkan dari Tujuan Pembangunan Berkelanjutan (SDGs) yang menjadi bagian dari agenda pembangunan pasca 2015; 13 Mengundang negara maju untuk menyediakan sumber dana bagi negara berkembang melalui mekanisme kerjasama pembangunan untuk mengembangkan produk fair trade yang baru; Meminta parlemen agar berperan lebih aktif melalui legislasi dan peraturan untuk mengurangi pajak dan biaya produk fair trade. c. Resolusi “The use of media, including social media, the enhance citizen engagement and democracy” (Lampiran 6) oleh 3rd Standing Commitee on Democracy and Human Rights. Resolusi pada pokoknya menggarisbawahi hal-hal sebagai berikut: Mendorong parlemen agar mengembangkan strategi dan pedoman untuk meningkatkan peran masyarakat dalam proses demokrasi melalui penggunaan media, termasuk media sosial. Meminta parlemen, khususnya parlemen perempuan, untuk menggunakan media sosial dalam berinteraksi dengan parlemen lainnya dan masyarakat guna meningkatkan peran dan keterlibatan perempuan dalam proses demokrasi. Mendorong parlemen dan pemerintah untuk melakukan upaya melindungi kebebasan pers, meningkatkan transparansi, memperkuat kapasitas pers dan menjadikannya lebih demokratis. Approval of the subject items for the 130th Assembly Sidang IPU Assembly ke-128 juga telah menetapkan tema yang akan dibahas masing-masing Standing Committee IPU pada Sidang IPU ke-130 di Baku, Azerbaijan tanggal 9-13 April 2014, yaitu: a. 1st Standing Committee: “Towards a nuclear-weapon-free world: The contribution of parliaments”. b. 2nd Standing Committee: “Towards risk-resilient development: Taking into consideration demographic trends and natural constraints”. 14 c. 3rd Standing Committee: “The role of parliaments in protecting the rights of children, in particular unaccompanied migrant children, and in preventing their exploitation in situations of war and conflict”. Other Matters IPU Assembly ke-128 menyetujui pula Presidential Statement mengenai kekerasan seksual terhadap perempuan yang pada pokoknya menyampaikan perhatian terhadap semakin maraknya aksi kekerasan seksual terhadap perempuan, khususnya pemerkosaan, dan meminta parlemen dan pemerintah agar mengambil tindakan segera dan efektif guna menjamin hak perempuan untuk mempertahankan integritasnya secara fisik dan psikologis dan hidup bebas dari ketakutan dan kekerasan (Lampiran 7). GOVERNING COUNCIL Sidang Governing Council Sesi ke-192 berlangsung dalam tiga sesi dan dipimpin Presiden IPU, Mr. Abdelwahad Radi. Sidang ini membahas hal-hal terkait penetapan anggota berbagai komite IPU serta masalah administratif seperti laporan kegiatan IPU, keanggotaan IPU, Laporan Presiden dan Sekretaris Jenderal IPU, format IPU Assembly, jabatan dalam komite IPU, kegiatan IPU di masa yang akan datang, dan keuangan organisasi. Berikut adalah hasil pembahasan dari agenda-agenda tersebut: a. Telah dilakukan pembahasan implementasi IPU Strategic Plan 2012-2017 yang ditetapkan di IPU Assembly ke-126 di Kampala, Uganda. Pada pembahasan Strategic Objective 4 and 5, IPU telah mempersiapkan berbagai masukan dari hasil General Debate terkait agenda pembangunan pasca 2015 yang selanjutnya disarikan ke dalam dokumen Quito Communique. b. Pada pembahasan format baru dari IPU menginformasikan beberapa hal sebagai berikut: 15 Assembly, Governing Council - Bahwa perubahan format IPU Assembly merupakan lanjutan dari kesepakatan di pertemuan Quebec dan diharapkan dapat menjadikan IPU sebagai organisasi kerjasama yang efektif dalam kerjasama antar parlemen, termasuk dalam hal kerjasamanya dengan Perserikatan Bangsa-Bangsa (PBB). Format baru ini telah diperjelas dan dibahas oleh Executive Committee; - Jika proses konsultasi berlangsung sesuai rencana, maka mulai pada tahun 2014, durasi masing-masing IPU Assembly hanya akan berlangsung selama empat hari; - Pertemuan parlemen muda (Meeting of Young Parliamentarians) yang semula bersifat informal disepakati akan menjadi formal dengan nama Forum of Young Parliaments; - Pertemuan parlemen perempuan akan diberikan alokasi waktu yang lebih lama dibandingkan dengan pertemuan lainnya dalam IPU; - Masa kerja Rapporteur dari masing-masing Standing Committee yang semula satu tahun diubah menjadi enam bulan. Dengan perubahan tersebut, maka untuk enam bulan berikutnya, Standing Committee dapat membahas isu lain; - Sesuai kesepakatan di Executive Committee, Committee on UN Affairs akan menjadi salah satu komite tetap IPU. Dengan demikian, mulai tahun 2014 akan terdapat empat Standing Committee dalam IPU; d. Terkait pembahasan keanggotaan dalam Komite, Governing Council telah mengusulkan untuk menghapuskan status titular dan substitute dari anggota parlemen guna menjamin keterwakilan yang adil dan proses pengambilan keputusan yang demokratis; e. Dalam pembahasan strategi komunikasi dari IPU, telah disampaikan bahwa tengah dikonsultasikan beberapa perubahan pada logo dan website IPU guna merefleksikan keberadaan IPU di tataran global. Terkait hal ini, beberapa negara menyampaikan pandangan agar proses penggantian logo dipertimbangkan kembali mengingat hal tersebut akan memerlukan biaya yang tidak sedikit. Terdapat pula 16 pandangan agar alih-alih mengganti logo, IPU sebaiknya melakukan inovasi pendekatan kepada publik di luar komunitas IPU. Keputusan akan format dan proses baru ini akan diputuskan dalam pertemuan di Jenewa bulan Oktober tahun 2013, didahului dengan pembahasan dalam kelompok geopolitik; Foto 3: Ketua BKSAP, Dr. Surahman Hidayat dan Wakil Ketua BKSAP, Hayono Isman hadir pada sesi pertemuan Governing Council IPU f. Sidang Governing Council ke-192 juga memutuskan hal-hal sbb: - Menerima laporan Presiden IPU dan Executive Committee sejak Sidang Governing Council ke-191; - Menerima laporan Sekretaris Jenderal IPU mengenai kegiatan IPU selama tahun 2012; - Mencatat laporan pertemuan dan konferensi khusus IPU, kerjasama IPU dengan PBB, implementasi IPU Strategy 2012-2017 dan laporan keuangan 2012; - Mengesahkan laporan-laporan: Meeting of Women Parliamentarians, Committee on Human Rights of Parliamentarians, Committee on Middle East Questions, dan Committee to Promote Respect for International Humanitarian Law; - Menetapkan rencana penyelenggaraan Sidang IPU Assembly ke-130 di Baku, Azerbaijan, yang akan diselenggarakan pada tanggal 9-13 April 2014, dan 17 menetapkan Hanoi, Vietnam sebagai tuan rumah IPU Assembly ke-132 yang akan diselenggarakan pada akhir Maret atau awal April tahun 2015; - Memilih dan menetapkan kekosongan posisi pada berbagai Komite dan Kelompok Kerja. Wakil Indonesia, yaitu Ibu Herlini Amran, telah mengajukan diri dan terpilih secara aklamasi untuk mengisi posisi anggota substitute dalam Committee on Middle East Questions. Sementara itu, Bapak Andi Anzhar Cakra Wijaya terpilih secara aklamasi pada pertemuan Committee to Promote Respect to International Humanitarian Law sebagai Presiden Komite tersebut. STANDING COMMITTEE Delegasi RI menghadiri pertemuan Standing Committee yang membahas draf-draf resolusi dengan tema-tema sebagai berikut: 1. 1st Standing Committee (Peace and International Security): Enforcing the Responsibility to Protect: The Role of Parliament in Safeguarding Civilians’ Live; 2. 2nd Standing Committee (Sustainable Development, Finance and Trade): Fair trade and innovating financing Mechanism for Sustainable Development; 3. 3rd Standing Committee (Democracy and Human Rights): The use of media, including social media, the enhance citizen engagement and democracy. First Standing Committee Pada diskusi mengenai darf resolusi mengenai Enforcing the Responsibility to Protect: The Role of Parliament in Safeguarding Civilians’ Live, Delegasi DPR RI yang diwakili H. Hayono Isman, S.IP. dan Dr. M. Hidayat Nur Wahid telah menyampaikan pernyataan Indonesia mengenai draf resolusi tersebut (Lampiran 8) sebagai berikut: 18 a. Sejak akhir Perang Dunia II, berbagai upaya internasional telah dilakukan dalam konflik bersenjata untuk melindungi masyarakat dari kekejaman massal, seperti genosida, pembantaian etnis, kejahatan perang, dan kejahatan kemanusiaan; b. Pada World Summit 2005, konsep Responsibility to Protect (RtP) telah disepakati para pemimpin dunia dengan tujuan untuk melindungi masyarakat dari berbagai ancaman akibat konflik bersenjata; Foto 4: Delegasi DPR-RI berpartisipasi pada Sidang the First Standing Committee IPU (dari kiri ke kanan: M. Tantangannya saat ini terletak pada penerapan prinsip-prinsip RtP secara praktis dalam bentuk kebijakan untuk mencegah genosida dan akibat-akibat konflik bersenjata terulang kembali; d. Kerangka RtP dan ketiga pilarnya sudah mencukupi untuk menopang hukum humaniter internasional. Oleh karena itu, sangatlah penting untuk mempertahankan dan menjalankan konsensus global ini untuk mencegah kekerasan massal; e. Namun, penting untuk menggarisbawahi bahwa ketika suatu negara gagal untuk menjalankan kewajibannya untuk melindungi warga negaranya, komunitas internasional harus memprioritaskan cara-cara non-kekerasan untuk merespon kondisi seperti ini, dan meletakkan pilihan intervensi militer sebagai cara terakhir 19 dalam skema peace building untuk mengambalikan stabilitas dan perdamaian internasional. Pada pembahasan di First Standing Committee mengemuka hal-hal antara lain sebagai berikut: a. Pentingnya peran parlemen dan pemerintah untuk bersama-sama melindungi rakyat dan anggota parlemen; b. Menyepakati pentingnya perhatian khusus terhadap perempuan dan anak dalam situasi konflik; c. Mendorong keterlibatan perempuan, termasuk parlemen perempuan, dalam berperan dalam proses perdamaian; d. Kekhawatiran intervensi militer dapat memperburuk situasi konflik; e. Perlunya menetapkan definisi dan prinsip-prinsip umum yang disepakati bersama mengenai kapan dan bagaimana konsep RtP dapat diberlakukan. Second Standing Committee Dalam pembahasan di Komite II untuk draf resolusi dengan judul “Fair Trade and Innovating Financing Mechanism for Sustainable Development”, Delegasi Indonesia yang diwakili oleh H. Andi Anzhar Cakra Wijaya, SH., Ibu Puan Maharani, dan Ibu Evita Nursanty, M.Si. menyampaikan pernyataan (Lampiran 9) antara lain: a. Menekankan pentingnya mencari dukungan finansial yang inovatif dari segala sumber untuk memungkinkan dan memastikan keberlangsungan pembangunan berkelanjutan di seluruh negara, khususnya negara berkembang; b. Mendorong perlunya mekanisme sumber pembiayaan tambahan dan inovatif seperti Private Public Partnership (PPP), kebijakan-kebijakan pajak, dan lain-lain sebagai pelengkap dari Official Development Assistance (ODA) yang merupakan sumber utama untuk membiayai pembangunan berkelanjutan di negara berkembang; 20 Foto 5: Delegasi DPR-RI berpartisipasi dalam Sidang the Second Standing Committee (dari kiri ke kanan: Puan Maharani dan Evita Nursanty) c. Memandang perlunya dukungan bagi produsen dalam menghadapi tantangantantangan ekonomi, lingkungan dan sosial untuk memperkuat keberlangsungan mereka, sehingga dapat berkontribusi terhadap kehidupan yang lebih berkelanjutanl d. Menekankan petingnya inisiatif Aid for Trade sebagai bagian dari diskusi mengenai bantuan internasional di WTO. Third Standing Committee Dalam pembahasan di Komite III untuk draf resolusi dengan judul “The use of media, including social media, the enhance citizen engagement and democracy”, Delegasi Indonesia yang diwakili oleh Bapak Tantowi Yahya, menyampaikan pernyataan (Lampiran 10) antara lain: 21 Foto 6: Delegasi DPR-RI berpartisipasi dalam Sidang the Third Standing Committee, Tantowi Yahya (paling tengah) a. Pada lingkungan yang demokratis, keinginan rakyat harus menjadi inti dari kebijakan dan pembuatan keputusan. Untuk mendukung konsep ini, kebutuhan akan adanya suatu channel untuk menghubungkan antara rakyat dan pemerintah menjadi sangatlah penting; b. Dengan menggunakan media sosial, parlemen dapat memfasilitasi keterlibatan warga negara yang lebih besar melalui interaksi dua-arah bahkan, multi-arah; dan anggota parlemen, diberi mandat oleh rakyat untuk mewakili mereka dan menyalurkan aspirasi mereka. Oleh karena itu, anggota parlemen bertanggung jawab untuk memperkuat komunikasi dan berhubungan dengan konstituen untuk kemudian menterjemahkan aspirasi mereka ke dalam proses pembuatan kebijakan dan undang-undang; c. Pengalaman Indonesia dalam mengakomodasi kepentingan ini adalah dengan mengeluarkan Undang-Undang mengenai Press tahun 1999, yang memberikan 22 jalur baru untuk press dengan menghilangkan intervensi Pemerintah pada media publikasi; d. Namun, untuk memberi jaminan kebebasan secara penuh selalu memiliki tantangan tersendiri. Di satu sisi, hal tersebut akan memberikan saluran yang mencukupi untuk melibatkan warga negara dalam demokrasi, sementara di sisi lain hal tersebut juga berarti menyediakan alat-alat yang mencukupi untuk memfasilitasi pidato yang bernuansa kebencian, pesan-pesan gelap, fitnah dan penistaan, dan sebagainya; e. Oleh karena itu, penting untuk dapat memastikan bahwa kebijakan yang merujuk pada hak atas kebebasan berekspresi harus dilaksanakan dengan semangat saling menghormati dan bertanggung jwab; Pada pembahasan Third Standing Committee on Democracy and Human Rights mengemuka hal-hal lain sebagai berikut: Komite menerima draft resolusi yang telah menerima amandemen termasuk masukan dari Indonesia; Perdebatan terjadi pada saat pengajuan item yang akan menjadi pembahasan pertemuan tahun 2014, ketika delegasi Selandia Baru dan Timor Leste mengajukan kembali usulan topik terkait sexual orientation and gender identity rights yang sebelum telah ditolak melalui pemungutan suara di Biro Komite III; Sebelumnya dalam pembahasan di tingkat biro, telah dibahas 6 (enam) usulan topik pembahasan, termasuk usulan Selandia Baru. Setelah melalui pengambilan suara, biro memutuskan usulan dari Bahrain, GRULAC dan Kelompok Afrika terkait perlindungan hak-hak anak, termasuk hak-hak anak migran, untuk menjadi isu yang dibawa ke pertemuan selanjutnya. Namun demikian, dengan menggunakan dasar aturan IPU yang membolehkan usulan yang ditolak untuk dibawa ke sidang Komite, Selandia Baru dan Timor Leste mengajukan kembali. Keputusan tersebut mengundang kecaman dari mayoritas negara yang hadir karena dianggap sebagai permainan terhadap aturan IPU; 23 Setelah mengalami perdebatan sengit, Ketua Komite memutuskan untuk melakukan pemungutan suara untuk menentukan apakah Komite menerima usulan Biro sebagai satu-satunya usulan atau menerima pengajuan usulan yang telah ditolak sebelumnya. Pengambilan suara akhirnya memutuskan untuk menerima usulan Biro dan menolak usulan baru. Biro Komite juga diminta untuk meninjau kembali aturan yang memperbolehkan negara untuk mengusulkan kembali usulannya yang telah ditolak di tingkat Biro. COORDINATING COMMITTEE FOR WOMEN PARLIAMENTARIANS Pada pertemuan ini, Anggota Delegasi Indonesia, Dr. Nurhayati Ali Assegaf, sebagai President of Coordinating Committee for Women Parliamentarians memimpin pertemuan untuk merumuskan berbagai hal yang akan dibahas dalam Meeting of Women Parliamentarians, termasuk penetapan Ketua Pertemuan dan briefing dari Sekretariat IPU. Foto 7: Dr. Nurhayati Ali Assegaf (pertama dari kanan) sebagai President Coordinating Committee for Women Parliamentarians memimpin Sidang Coordinating Committee dan membuka Sidang Meeting of Women Parliamentarians 24 MEETING OF WOMEN PARLIAMENTARIANS Meeting of IPU Women Parliamentarians yang ke-18 diselenggarakan pada tanggal 22 Maret 2013 dan dihadiri oleh 120 delegasi dari 56 negara dan perwakilan dari organisasi internasional. Pertemuan dibuka oleh Presiden Coordinating Committee of Women Parliamentarians (CCWP) IPU, Dr. Nurhayati Assegaf, dan pembahasan agenda pertemuan dipimpin oleh Ketua terpilih Ms. Scheznarda Fernandez Doumet, anggota Parlemen Ekuador dan First Vice President CCWP. Pertemuan membahas antara lain hal-hal sebagai berikut: a. Pembahasan dan masukan dari perspektif parlemen perempuan terhadap rancangan resolusi dari First dan Second Standing Committee yang terbagi menjadi dua grup kecil, dengan pokok-pokok sebagai berikut: Enforcing the responsibility to protect: the role of parliament in safeguarding civilian’s lives Pada Pertemuan ini, Delegasi RI yang diwakili Ibu Evita Nursanty dan Ibu Puan Maharani menyampaikan pandangan antara lain sebagai berikut: o Pentingnya pengakuan internasional terhadap hak perempuan, terutama pada saat perang/konflik sebagai landasan bagi parlemen dalam memberikan dukungan legislatif untuk melindungi rakyat sipil. Hal ini mengingat perempuan dan anak/anak perempuan merupakan kelompok yang paling rentan terhadap kekerasan seksual pada saat terjadi perang; o Perlunya draf resolusi ini menyatakan secara jelas peran penting parlemen dalam pembuatan produk hukum yang mendukung perlindungan terhadap perempuan dan mendorong peran mereka dalam proses perdamaian (peace-keeping). Dalam hal ini, disampaikan bahwa DPR-RI telah mengesahkan Undang-undang No.7 tahun 2012 tentang Penanganan Konflik Sosial yang bertujuan mendorong semua pihak, termasuk perempuan, 25 untuk melakukan upaya penanganan dan penyelesaian akar permasalahan, serta pencegahan konflik sosial di Indonesia. Foto 8: Delegasi DPR-RI menghadiri Meeting of Women Parliamentarians kedua dari kanan Evita Nursanty dan Puan Maharani Pertemuan parlemen perempuan selanjutnya menyepakati beberapa usulan perubahan terhadap ranres ini dan sebagian besar masukan diterima oleh First Standing Committee, antara lain: Agar resolusi secara jelas menyatakan jaminan terhadap perlindungan perempuan dan anak dalam situasi konflik; Memastikan efektivitas implementasi peraturan internasional terkait perlindungan perempuan dan anak terhadap kekerasan seksual, termasuk pemerkosaan; Parlemen agar mengesahkan undang-undang yang mencegah dan mengkriminalisasikan kejahatan terhadap perempuan dan anak, termasuk pada situasi konflik; • Mempromosikan pembentukan kerangka untuk memastikan prioritas diberikan kepada perempuan dalam situasi konflik atau darurat, termasuk akses mendapatkan makanan dan keamanan di tempat pengungsian; 26 • Parlemen agar memastikan implementasi resolusi Dewan Keamanan PBB 1325 antara lain dengan mendorong partisipasi aktif perempuan dana proses negosiasi perdamaian, serta adanya pelatihan/kapasitas perempuan sebagai peacebuilders dan peacemakers; • Menekankan pentingnya pendidikan dan kekuatan media untuk menangani akar permasalahan konflik; • Parlemen agar memanfaatkan berbagai cara, termasuk melalui sosial media untuk mendorong upaya menghentikan kejahatan terhadap perempuan. Fair Trade and Innovative Financing Mechanisms for Sustainable Development Pada Pertemuan ini, Delegasi DPR RI yang diwakili oleh Ibu Meutya Viada Hafid dan Dr. Susaningtyas NH Kertopati menyampaikan pandangan antara lain: o Perlu dilakukan upaya menghadapi berbagai tantangan pemajuan pemberdayaan perempuan, antara lain stereotyping dan stigma terhadap perempuan, kesempatan yang terbatas bagi perempuan di bidang ekonomi, termasuk untuk mendapat pekerjaan dan memiliki tanah atau bisnis; o Parlemen perempuan perlu mendukung pembentukan legislasi dan kebijakan perdagangan yang sensitif terhadap gender dan mendorong perempuan untuk mendapatkan hak dan keuntungan yang sama dari perdagangan, termasuk dalam hal pengambilan keputusan; 27 Foto 9: Delegasi DPR-RI berpartisipasi dalam Meeting of Women Parliamentarians dari kanan ke kiri: Meutya Viada Hafid dan Dr. Susaningtyas N Kertopati o Selain itu, parlemen perlu memastikan penggunaan anggaran yang transparan dan akuntabel, dan mendorong mekanisme public-private partnership dalam pendanaan, untuk mempromosikan dan mengembangkan hak-hak perempuan; o Indonesia dalam hal ini telah memiliki undang-undang yang mengatur kesamaan gender dalam kepemilikan tanah, melakukan kegiatan ekonomi, termasuk perbankan. Upaya lain yang dilakukan Indonesia adalah melalui program kesejahteraan keluarga dan pemberdayaan, dengan memberikan kesempatan bagi perempuan untuk bekerja di rumah dan melakukan bisnis pada saat yang sama. b. Debat mengenai topik kemajuan dan kemunduran representasi perempuan di parlemen tahun 2012 28 Debat didahului dengan paparan mengenai persentase jumlah anggota parlemen perempuan secara global sepanjang tahun 2012. Beberapa hal yang mengemuka dalam paparan ini adalah: Terjadi peningkatan tingkat rata-rata parlemen perempuan di dunia dari 19.5% di tahun 2011 menjadi 20.4% pada tahun 2013 (Januari); Jumlah perempuan dalam parlemen di beberapa negara kawasan Arab dan Pasifik khususnya mengalami perubahan yang penting, yaitu peningkatan jumlah anggota parlemen perempuan dari Arab Saudi, Aljazair dan Papua Nugini; Beberapa faktor yang mempengaruhi akses perempuan terhadap posisi dalam pemilihan adalah sistem pemilihan dan partai, penggunaan mekanisme kuota, dan tingkat dukungan dari partai politik; Tantangan terkait pendanaan kampanye; Pada sesi ini, Delegasi RI, diwakili Ibu Evita Nursanty, menyampaikan pandangan sebagai berikut: Apresiasi terhadap kerja IPU dalam meningatkan partisipasi perempuan dalam politik, seperti termuat dalam IPU Publication on Women Parliamentarians in 2012 yang menunjukkan peningkatan berarti partisipasi perempuan dalam parlemen dan politik; Guna mempertahankan kemajuan tersebut dan mempercepat pencapaian partisipasi maksimum perempuan dalam politik, diperlukan upaya lebih lanjut, termasuk pembentukan parlemen yang sensitif terhadap gender; Faktor lain yang penting untuk meningkatkan partisipasi perempuan dalam politik adalah adanya kuota dalam pemilihan dan pemberdayaan dan pendidikan politik bagi perempuan; Indonesia dalam hal ini melalui UU Pemilihan Umum dan UU yang mengatur partai politik telah mengatur kuota minimum 30% bagi perempuan tidak 29 hanya dalam parlemen tapi juga dalam partai politik. Selain itu, saat ini parlemen Indonesia sedang membahas rancangan UU mengenai persamaan gender yang bertujuan untuk mewajibkan seluruh unsur negara mengintegrasikan isu gender dalam berbagai aspek. c. Dialog mengenai penanganan kekerasan terhadap perempuan, khususnya kekerasan seksual Dialog dibuka dengan paparan dari Director of the Women’s Human Rights Programme, The Advocates for Human Rights, Ms. C.A. Thomas, yang menjelaskan elemen utama dalam undang-undang untuk mencegah sexual assault. Pada sesi ini, delegasi menyampaikan berbagai upaya nasional untuk mencegah kekerasan seksual dan memberikan perlindungan/bantuan bagi korban kekerasan seksual. Pada sesi ini, Delegasi RI, diwakili Ibu Puan Maharani, menyampaikan halhal sebagai berikut: Parlemen agar mendorong masyarakat untuk menghormati perempuan dan hak-haknya. Dalam hal ini, parlemen dapat membuat peraturan hukum yang memberikan efek jera bagi pelaku kekerasan terhadap perempuan; Indonesia telah mengesahkan legislasi yang mengatur perlindungan dan hakhak perempuan dan anak, antara lain UU ITE, UU Perlindungan Anak, dan UU Penghapusan Kekerasan dalam Rumah Tangga; Pentingnya komitmen dari semua pihak untuk menangani berbagai tantangan dalam perlindungan perempuan dan hak-haknya, termasuk menghilangkan stigma terhadap perempuan, dan terutama mengawasi implementasi berbagai peraturan dan undang-undang terkait perempuan. 30 PERTEMUAN KELOMPOK KAWASAN DAN BILATERAL (1) ASEAN+3 Pada rangkaian pertemuan IPU Assembly ke-128, Delegasi DPR RI telah menghadiri Pertemuan ASEAN +3 dengan diwakili oleh Ketua BKSAP, KH. Dr. Surahman Hidayat, MA., dan Wakil Ketua BKSAP, Andi Anzhar Cakra Wijaya. Pertemuan ASEAN +3 menetapkan hal-hal sebagai berikut: a. Pertemuan ASEAN +3 dipimpin oleh Mr. Motoyuki Odachi dari Jepang dan dihadiri oleh Singapura, Thailand, Vietnam, Filipina, Indonesia, Korea dan China; b. Pertemuan membahas emergency item dan pencalonan pada berbagai Komite dan Kelompok Kerja, serta drafting committee; c. Pertemuan ASEAN +3 secara aklamasi menetapkan Laos sebagai Ketua ASEAN +3 untuk memimpin pertemuan mendatang; d. Pertemuan juga mendukung keputusan Vietnam untuk menjadi tuan rumah IPU Assembly ke-132 pada tahun 2015. (2) ASIA-PACIFIC GROUP Pertemuan Asia-Pacific Group (APG) pada tanggal 21 Maret 2013 dipimpin oleh Ketua Delegasi Jepang, Mr. Mitsuhiro Uesugi, dan telah membahas agenda antara lain: a. Laporan Executive Committee. Pada kesempatan ini, Indonesia sebagai anggota Executive Committee telah melaporkan hasil pembahasan Executive Committee utamanya mengenai perkembangan reformasi di dalam IPU antara lain pengusulan penggantian logo dan format serta pengurangan jumlah pertemuan IPU. 31 Foto 10: Delegasi DPR-RI menghadiri pertemuan informal Asia-Pacific Group (dari kanan ke kiri: Dr. Nurhayati Ali Assegaf, Dr. Surahman Hidayat dan Andi Anzhar Cakra Wijaya) b. Posisi APG terhadap 6 (enam) usulan emergency item. Selandia Baru yang mengajukan isu pemberian hak kewarganegaraan bagi kelompok homoseksual menyatakan menarik usulannya karena isu tersebut masih kontroversial, namun akan tetap meminta isu ini dibahas dalam Second Standing Committee. Kelompok APG mendukung sepenuhnya usulan emergency item dari Maroko terkait perlindungan benda cagar budaya. Sementara itu, pertemuan tidak mencapai konsensus terhadap 3 (tiga) usulan lainnya terkait Suriah dan isu anak-anak migran yang diusulkan Meksiko dan menyerahkan posisi kepada masing-masing delegasi. c. Pada agenda pencalonan pada berbagai Komite dan Kelompok Kerja, serta Drafting Committee, pertemuan di antaranya mendukung pencalonan Indonesia yaitu Dr. Surahman sebagai anggota Committee on Middle East Question dan Hayono Isman sebagai anggota Drafting Committee pada Third Standing Committee. Namun pada perkembangannya, sesuai dengan lobi-lobi yang ada dan ketentuan IPU, pencalonan dari Indonesia untuk Committee on Middle East Question digantikan oleh Ibu Herlini Amran, sedangkan Bapak Hayono Isman mundur dari pencalonan drafting committee Standing Committee. 32 d. Pertemuan Kelompok APG juga telah mendengarkan paparan dari Hon. Saber Chowdury dari Bangladesh mengenai “Climate Change Adaptation and Disaster Risk Reduction in the context of Sustainable Development” yang pada intinya mengharapkan partisipasi aktif anggota parlemen dalam mengalokasikan anggaran untuk isu perubahan iklim dan penanganan bencana serta pengawasan implementasinya dalam konteks Hyogo Framework of Action yang akan direview pada tahun 2015. (3) CONSULTATION MEETING OF THE ISLAMIC GROUP (PUIC) Pada pertemuan ini, Delegasi Indonesia diwakili oleh KH. Dr. Surahman Hidayat dan Dr. Muhammad Hidayat Nur Wahid. Pertemuan membahas agenda-agenda di antaranya usulan perubahan tanggal untuk IPU Assembly ke-129 yang bertepatan dengan Hari Raya Idul Adha, dukungan terhadap Azerbaijan untuk menjadi tuan rumah IPU Assembly ke-130, Emergency Item, persetujuan agenda untuk IPU Assembly ke-130 dan penunjukkan rapporteurs, serta Amandemen Statutes and Rules of the IPU. Pertemuan di antaranya memutuskan hal-hal sebagai berikut: 1. Mengapresiasi upaya Sekretariat IPU untuk mengubah tanggal pelaksanaan IPU Assembly ke-129 di Jenewa-Swiss yang dipercepat menjadi tanggal 6-9 Oktober 2013 (semula tanggal 13-16 Oktober 2013); 2. Memberi dukungan kepada Azerbaijan untuk menjadi tuan rumah penyelenggaraan IPU Assembly ke-130 pada 9-13 April 2013; 3. Memberi dukungan terhadap emergency item yang diusulkan oleh Maroko, yaitu Should the deliberate destruction of world cultural heritage not be considered as a crime against humanity? The role of parliaments in: 1) passing appropriate legislation to guarantee protection of world cultural heritage; and 2) developing international criminal law provisions that criminalize serious attacks on the cultural heritage of humanity 33 (4) BILATERAL INDONESIA-MAROKO Pertemuan Bilateral antara Indonesia-Maroko dihadiri oleh Ketua Delegasi RI Pramono Anung Wibowo, Surahman Hidayat, Hayono Isman, Tantowi Yahya, Puan Maharani, dan Muhammad Hidayat Nur Wahid. Delegasi Maroko dipimpin oleh Ketua Parlemen Maroko, Mr. Karim Ghellab, dan Anggota Parlemen yang terdiri dari Mr. Abdelaiz Omari, Ms. Rachida Benmassoud dan Mr. Noureddine Lazrak. Pada kesempatan pertemuan ini, Delegasi Maroko menyampaikan hal-hal sebagai berikut: 1. Keinginan Maroko untuk memperkuat hubungannya dengan Indonesia. Saat ini Maroko telah memiliki konstitusi yang baru (tahun 2011) yang berdasarkan demokrasi. Perubahan sistem pemerintahan tersebut memperluas cakupan tugas parlemen untuk melakukan pengawasan terhadap kinerja pemerintah dan menyeimbangkan hubungan parlemen dan pemerintah; 2. Terkait hal ini, Maroko melihat Indonesia sebagai model yang sangat baik dalam hal pelaksanaan reformasi demokrasi sehingga dapat membantu Maroko yang sedang mengalami proses transisi menuju pemerintahan demokratis; 3. Selain itu, Maroko juga menyampaikan permintaan dukungan dari Indonesia terkait kasus Sahara Barat. Delegasi Maroko menyampaikan bahwa Maroko telah mengajukan solusi pemberian otonomi di wilayah Sahara Barat untuk menyelesaikan sengketa ini, namun hingga saat ini usulan tersebut belum mendapat kemajuan yang berarti. Delegasi Maroko menyampaikan maksud untuk mempelajari pelaksanaan otonomi daerah di Indonesia; 34 Foto 11: Delegasi DPR-RI menghadiri pertemuan bilateral dengan Delegasi Maroko. Delegasi Indonesia menyampaikan secara singkat upaya Indonesia dalam melaksanakan demokrasi, menjaga integritas wilayah kesatuan RI dan menjaga keselarasan antara Islam dan politik serta keberagaman masyarakat di Indonesia. Delegasi kedua negara sepakat untuk mengembangkan dialog, kerjasama dan meningkatkan hubungan dalam berbagai bidang, khususnya mengenai pelaksanaan reformasi demokrasi, kesatuan nasional, otonomi daerah, agama (Islam) dan budaya. 35 Foto 12: Delegasi DPR-RI menghadiri pertemuan bilateral dengan Delegasi Maroko (5) BILATERAL INDONESIA - ECUADOR Delegasi DPR RI yang terdiri dari Pramono Anung Wibowo, Surahman Hidayat, Hayono Isman, dan M. Hidayat Nur Wahid dengan didampingi oleh Dubes RI untuk Quito dan anggota DPD Poppy Dharsono juga melakukan pertemuan bilateral dengan Ketua Parlemen Ekuador, Mr. Fernando Cordero. Delegasi RI juga 36 mengundang Ketua Parlemen Ekuador untuk berkunjung ke Indonesia pada bulan April 2013, sebagai kelanjutan dari kunjungan Presiden dan Wakil Ketua Parlemen Indonesia ke Ecuador. Delegasi DPR RI juga menyampaikan maksud untuk mempelajari upaya Ekuador melestarikan kekayaan alam. Menanggapi Delegasi RI, Mr. Fernando Cordero menyampaikan apresiasi atas undangan Indonesia dan akan mempertimbangkan mengingat pada saat yang sama, Ekuador akan melaksanakan pelantikan Presiden baru dan pemilihan parlemen. Ekuador menyatakan sangat tertarik untuk memperdalam hubungan dengan Indonesia. Terkait kebijakan perlindungan alam, Ekuador menyampaikan salah satu inisiatif yang dilakukan adalah upaya konservasi alam dilakukan sebelum terjadi kontaminasi. Foto 14: Ketua Delegasi DPr-RI, Dr. Pramono Anung Wibowo, sedang berjabat tangan dengan Ketua Parlemen Ekuador, Mr. Fernando Cordero Cueva ADVISORY GROUP ON HIV/AIDS – MATERNAL, NEW BORN, AND HEALTH CHILD/MNCH Pertemuan dipimpin oleh Ms. Libby Davies, anggota parlemen Kanada, dan dibuka dengan paparan singkat oleh Director of the Programme for the Promotion of Democracy of the IPU, Martin Chungong, dan Parliamentary Policy Advisor, Maternal, 37 Newborn, and Health Child, Ms. Sue Mbaya. Pada pertemuan ini hadir pula wakil dari organisasi internasional/regional yaitu Deputy Director of WHO and Partnership for Maternal, Newborn, Child Health, Mr. Andres De Fransisco Serpa; Senior Adviser, Parliamentary Relations, Special Initiatives to the Global Fund to Fight AIDS, Tuberculosis and Malaria, Mr Svend Robinson; Coordinator, Department of Reproductive Health and Research to the WHO, Ms. Lale Say; Parliamentary Advisor, Democratic Governance Group of UNDP, Mr Charles Chauvel; dan Regional Director for Latin America, Joint UN Programme on HIV/AIDS, Mr. Cezar Antonio Nunez. Foto 15: Tantowi Yahya sebagai anggota Advisory Group on HIV/AIDS – Maternal, Newborn and Childhealth berpartisipasi dalam Pertemuan Advisory Group 38 Delegasi DPR RI yang diwakili oleh Tantowi Yahya, sebagai anggota Advisory Group, menyampaikan pandangan bahwa permasalahan utama adalah perlunya meningkatkan kesadaran anggota parlemen mengenai isu HIV/AIDS dan MNCH. Hal ini mengingat sebagian besar negara berkembang mengalokasikan dana yang lebih sedikit untuk menangani isu ini daripada dana untuk pertahanan. Selain itu, juga disampaikan usulan agar Advisory Group dapat memberikan dukungan pendampingan bagi parlemen dalam menyusun kebijakan anggaran yang lebih mendukung isu kesehatan. Usulan Indonesia tersebut menjadi catatan dalam pertemuan dan Ms. Sue Mbaya menyatakan akan melihat kemungkinan penyediaan program dimaksud bagi parlemen Indonesia. Wakil The Global Fund menyampaikan apresiasi terhadap upaya dan kepemimpinan Presiden RI dalam mempromosikan ketersediaan obat generik antiviral dan antiretroviral. The Global Fund juga menyediakan bantuan bagi anggota parlemen dalam melaksanakan berbagai proyek terkait HIV/AIDS, termasuk bantuan finansial. MEETING OF YOUNG PARLIAMENTARIANS Delegasi DPR RI, yang diwakili oleh Meutya Havid dan Puan Maharani, telah berpartisipasi dalam pertemuan informal parlemen muda IPU pada tanggal 23 Maret 2013. Pertemuan ini membahas dua agenda utama yaitu format masa depan dari pertemuan parlemen muda di IPU dan kontribusi parlemen muda terhadap dokumen akhir yang dibahas pada ketiga Standing Committee IPU. Pertemuan membahas dan menyepakati draft proposal yang pada intinya mengusulkan perubahan sifat pertemuan menjadi pertemuan formal dengan nama Forum of Young Parliamentarians. Forum ini akan menciptakan program-program yang bermanfaat dalam meningkatkan peran serta pemuda. Pertemuan dilanjutkan dengan diskusi mengenai kriteria pemuda dan perlu atau tidaknya pembatasan usia pemuda. Terkait hal ini, Delegasi DPR RI 39 menyampaikan perlu ditetapkan batasan usia untuk mendefinisikan parlemen muda. Ketiadaan batasan yang hanya menyebut parlemen muda dan parlemen senior sebagaimana usulan dalam proposal justru malah menghilangkan esensi dari dibentuknya forum ini. Setelah melalui perdebatan dan dilakukan voting, pertemuan akhirnya mengambil keputusan untuk tetap mengacu pada usulan proposal yang menggunakan istilah parlemen muda dan parlemen senior yang memiliki ketertarikan pada isu kepemudaan dengan amandemen yang diajukan Indonesia dan Jerman untuk memberikan persentase terhadap partisipasi anggota parlemen senior agar forum ini tetap layak untuk disebut sebagai pertemuan anggota parlemen muda. Forum juga memilih perwakilan dari parlemen muda dari Jerman, Afrika Selatan dan Ekuador untuk memberikan masukan terkait peran parlemen muda dalam isu draf resolusi yang dibahas dalam pertemuan tiga Standing Committee IPU. Pada akhir pertemuan, forum mendengarkan penjelasan dari Sekjen IPU yang mengatakan bahwa sejalan dengan proses reformasi yang berlangsung di IPU, maka parlemen muda dapat saja membentuk formasi dan aturan baru yang memperkaya keterwakilan aspirasi pemuda dalam IPU. Namun demikian, mengingat Rencana Strategis IPU 2012-2017 telah berjalan, maka untuk sementara format pertemuan masih bersifat informal meskipun berlangsung secara permanen. COMMITTEE TO PROMOTE RESPECT FOR INTERNATIONAL HUMANITARIAN LAW (IHL) Pertemuan ke-22 Committee to Promote Respect for International Humanitarian Law (IHL) berlangsung pada tanggal 25 Maret 2013 dengan agendaagenda utama penetapan Presiden Komite, hubungan Komite dengan organisasi internasional, dan rencana kerja Komite. Penetapan Presiden Komite IHL sebelumnya hanya dilakukan secara provisional karena sejak awal pembentukannya Komite ini tidak dapat memenuhi kuorum kehadiran para anggotanya. Pada pertemuan ini kuorum telah terpenuhi dan mengingat aturan prosedur Komite belum diresmikan, maka anggota Parlemen 40 Indonesia, Andi Anzhar Cakra Wijaya telah mengajukan diri sebagai Presiden Komite tersebut. Pengajuan diri ini selanjutnya diterima secara konsensus dengan catatan bahwa masa kerja Presiden akan berakhir sampai dengan akhir masa kerjanya sebagai anggota Komite IHL, yaitu April 2014. Selama waktu tersebut Presiden dan Sekretariat akan merumuskan aturan prosedur, rencana kerja, dan draf perubahan modalitas Komite ini untuk kemudian menyampaikan pada pertemuan IPU Assembly ke-129 di Jenewa, Bulan Oktober 2013. Foto 16: Andi Anzhar Cakra Wijaya memimpin pertemuan Committee to Promote Respect for International Humanitarian Law (IHL) Pada agenda terkait hubungan kerja dengan UNHCR telah dibahas rencana penerbitan buku panduan bagi parlemen terkait kewarganegaraan and statelessness serta panduan terkait internally displaced person (IDPs) yang diharapkan dapat diterbitkan pada IPU Assembly Bulan Oktober 2013. Dalam penjelasan mengenai perkembangan kedua isu tersebut, wakil UNHCR menginformasikan bahwa saat ini terdapat 3,6 juta IDPs di dunia, dimana saat ini sekitar 1 jutanya berada di negaranegara tetangga Suriah. Terkait dengan hal ini Komite mengusulkan adanya kunjungan komite ke salah satu penampungan pengungsi yang berada di sekitar 41 Suriah. Kepastian tentang rencana kunjungan akan diputuskan sebelum pertemuan komite selanjutnya. Selanjutnya, terkait hubungan kerja Komite dengan Palang Merah International, telah disampaikan hasil-hasil keputusan Konferensi Konfederasi Palang dan Bulan Sabit Merah yang dilangsungkan tahun 2011 dimana terdapat kesepakatan pentingnya perlindungan terhadap elemen-elemen baru seperti perlindungan terhadap paramedis dan perawat dalam konflik bersenjata. Wakil ICRC juga menggarisbawahi pentingnya anggota parlemen untuk memonitor perkembangan pembahasan Konvensi Pelarangan Perdagangan Senjata Kecil yang tengah dibahas di PBB mengingat kesepakatan akan hal ini akan berdampak besar pada intensitas konflik secara global. DISKUSI PANEL DAN WORKSHOP Pada Sidang IPU Assembly ke-128, Delegasi RI juga mengikuti diskusi panel mengenai The legalization of drugs: Can it help curb organized crime? dan Addressing the rights of children with disabilities, serta Open Session of the Committee to Promote Respect to the International Humanitarian Law mengenai International Humanitarian Law Dimension of the Responsibility to Protect. a. Panel Discussion on The legalization of drugs: Can it help curb organized crime? Diskusi menghadirkan anggota parlemen dari Afghanistan (Ms. Farkhunda Zahra), Serbia (Ms. Marija Obradovic) dan Sekjen National Drugs Board Uruguay (Mr. Julio Calzada), serta koresponden dari Amerika Latin (Mr. Erik de la Reguera) sebagai panelis, dengan Mr. Lord Dholaia (UK) sebagai moderator. Para panelis mempresentasikan pandangan mengenai legalisasi narkoba dan potensinya dalam upaya penanganan narkoba. Diskusi bertujuan untuk membahas keberhasilan dan tantangan dalam implementasi kebijakan penanganan narkoba di negara konsumer, supplier dan transit. Diskusi ini dimaksudkan untuk melihat potensi keuntungan dan tantangan 42 legalisasi atau dekriminalisasi narkoba sebagai langkah penanganan permasalahan narkoba. Beberapa hal pokok yang mengemuka dalam diskusi antara lain: - Masih terdapat perbedaan cara pandang terkait legalisasi narkoba sebagai upaya menanggulangi narkoba. Sebagian delegasi peserta, terutama dari negara berkembang, berpendapat bahwa legalisasi narkoba hanya akan menimbulkan dampak negatif terutama terhadap situasi ekonomi dan sosial suatu negara. Legalisasi narkoba juga dapat menggerus nilai-nilai spiritual dan religius yang menjadi pegangan masyarakat dan mengakibatkan penurunan moral; - Parlemen perlu mengambil langkah-langkah positif untuk menangani isu narkoba di tingkat nasional, antara lain dengan membuka debat mengenai isu ini di parlemen dan masyarakat dengan dimulai dari skala terbatas, mempertanyakan pendapat masyarakat dari segi budaya maupun personal dengan tujuan tidak hanya melihat argumen terhadap isu ini tetapi juga untuk mengarahkan opini publik; - Parlemen agar mulai mengidentifikasi berbagai isu yang dapat dijadikan contoh penanganan narkoba yang dapat diterapkan di dalam masyarakat, seperti penalisasi kepemilikan narkoba, dekriminalisasi, legalisasi, regulasi terhadap supply obat-obatan; - Perlunya IPU membuat suatu resolusi mengenai isu penanganan narkoba untuk selanjutnya dapat dibahas dan disepakati sebagai salah satu upaya parlemen dalam area ini. b. Panel Discussion on Addressing the rights of children with disabilities Diskusi dipimpin oleh Mr. Ian Liddell-Grainger, anggota parlemen Inggris, dan yang juga menjadi panelis bersama dengan Deputy Director Programme Division UNICEF Ms. Susana Sottoli, Wakil Presiden Ekuador Mr. Lenin Moreno, dan perwakilan NGO di Burkina Faso yaitu Direktur Solidarity Nationale Mr. Boukary Savadogo. 43 Wakil Presiden Ekuador dan anggota parlemen Inggris menyampaikan best practices terkait inisiatif nasional Ekuador dan kegiatan parlemen Inggris dalam rangka mempromosikan hak-hak anak penyandang cacat. Diskusi dilanjutkan dengan pertukaran informasi dan best-practices terkait kebijakan penanganan penyediaan hak-hak anak penyandang cacat. Beberapa hal yang mengemuka dalam diskusi ini adalah: - Negara-negara perlu mengidentifikasi data anak-anak penyandang cacat; - Pentingnya jaminan perlindungan dan bantuan bagi keluarga yang memiliki anak penyandang cacat. Hal ini diharapkan dapat meningkatkan kerja sama antara pemerintah dan parlemen dengan masyarakat terutama keluarga karena mereka merupakan rekan penting untuk memastikan pemberian hakhak anak penyandang cacat; - Belum adanya pemahaman yang sama mengenai apa yang diperlukan oleh anak penyandang cacat yang seharusnya melakukan pendekatan berbasis HAM dan bukan atas dasar kasihan. Untuk itu, perlu dilakukan upaya untuk mengubah pola pikir masyarakat dengan menjadikan anak-anak penyandang cacat sebagai salah satu prioritas; - LSM dan masyarakat madani juga berperan untuk memberikan advokasi kepada parlemen mengenai Konvensi PBB mengenai Hak-hak Penyandang Cacat, termasuk anak-anak, serta menyediakan bantuan pengembangan kapasitas bagi para pendamping anak-anak penyandang cacat. Peningkatan kesadaran masyarakat dan parlemen diperlukan guna mengubah cara pandang masyarakat terhadap anak-anak penyandang cacat; - Parlemen didorong untuk menyusun suatu prosedur untuk meningkatkan kesadaran parlemen dan masyarakat bahwa penyandang cacat, termasuk anak-anak, juga memiliki kelebihan. Selain itu, parlemen juga perlu mendorong pemerintah untuk mengimplementasikan kebijakan yang melindungi hak-hak anak penyandang 44 cacat, termasuk mendorong pangarusutamaan isu ini melalui pemberian kesempatan bagi penyandang cacat untuk bersekolah di sekolah biasa. c. Open Session of the Committee to Promote Respect to the International Humanitarian Law on International Humanitarian Law Dimension of the Responsibility to Protect Diskusi ini dipimpin oleh Andi Anzhar Cakra Wijaya yang merupakan anggota titular dari Komite IHL dan dihadiri oleh 40 (empat puluh) anggota parlemen. Diskusi diawali dengan paparan Legal Advisor Palang Merah Internasional (ICRC) Mr. P. Zahnd; anggota International Humanitarian Law (IHL) Mr. S. Janquin; dan Direktur Canadian Center for Responsibility to Protect (CRtoP) Ms. J.Park. Foto 17: Salah satu suasana pertemuan Committee to Promote Respect for International Humanitarian Law Dalam paparannya, panelis mengarisbawahi pentingnya anggota parlemen memahami konsep RtoP dan penerapan yang bias dilakukan oleh anggota parlemen. Meskipun demikian, disadari adanya sifat paradoks pada tahap implementasi hukum humaniter yang mengutamakan kedaulatan negara untuk menyelesaikan persoalan dalam negerinya dengan konsep RtP yang justru memberikan kesempatan adanya intervensi terhadap suatu negara bilamana 45 suatu negara dianggap gagal melindungi warganya dari pembunuhan massal, kejahatan perang, pembersihan etnis dan kejahatan atas kemanusiaan. Foto 18 : Andi Anzhar Cakra Wijaya (tengah) setelah terpilih menjadi President Committee to Promote Respect for IHL, memimpin Open Session of the Committee to Promote Respect for IHL Dalam sesi tanya jawab, persoalan isu suriah yang diungkit oleh panelis dari CRtoP serta masalah Palestina telah menjadi contoh nyata dari sulitnya penerapan konsep RtP dimana di satu pihak negara-negara barat mendesak agar RtP dijalankan bagi Suriah, namun demikian di sisi lain pendudukan dan pembunuhan yang dilakukan Israel di Palestina tidak mendapatkan reaksi yang sama. Isu legalitas dari penerapan RtP juga mendapatkan sorotan tajam dari peserta. Berbeda dengan konsep Hukum Humaniter yang telah terkodifikasi secara baik ke dalam hukum internasional serta hukum nasional negara anggota, konsep RtP tidak memberikan kepastian dan dengan dasar apa suatu negara dianggap gagal dan dapat dintervensi dengan alasan kemanusiaan. Terkait hal tersebut, terdapat pandangan bahwa RtP selayaknya hanya menghentikan kekejaman yang terjadi dan tidak digunakan untuk hal-hal lain seperti menggulingkan suatu pemerintahan yang sah. 46 Pada bagian akhir, pertemuan ini menghimbau agar anggota parlemen dapat melakukan upaya preventif guna mencegah munculnya kejahatan atas kemanusiaan di negaranya sesuai dengan mandat mereka. Terkait dengan hal ini, Indonesia memberikan contoh diundangkannya UU Penanganan Konflik Sosial yang dimaksudkan untuk mencegah dan menangani konflik horizontal di masyarakat. V. HASIL-HASIL PERSIDANGAN Rangkaian persidangan the 128th IPU Assembly and related meetings telah menghasilkan dokumen-dokumen sebagai berikut: 1. Resolusi Enforcing the Responsibility to Protect: The Role of Parliament in Safeguarding Civilians’ Lives dengan pokok-pokok sebagai berikut: a. Menghimbau parlemen dan anggota parlemen untuk menggunakan seluruh alat pendidikan dan peningkatan kesadaran publik untuk membantu mencegah dan menghentikan genosida, kejahatan perang, pembersihan etnis, dan kejahatan kemanusiaan, terutama kekerasan terhadap wanita dan anakanak; b. Mendorong parlemen-parlemen untuk memastikan pemerintah masingmasing untuk melindungi populasinya dari genosida, kejahatan perang, pembersihan etnis, dan kejahatan kemanusiaan; c. Mendesak parlemen dan pemerintah bersama-sama mendampingi dan membangun kapasitas negara untuk mencegah genosida, kejahatan perang, pembersihan etnis, dan kejahatan kemanusiaan dan pada saat dibutuhkan melakukan aksi secara cepat dan tepat waktu, sesuai dengan Piagam PBB, untuk mencegah atau menghentikan kejahatan-kejahatan tersebut; d. Meminta parlemen untuk mensahkan Undang-undang dan kebijakan untuk melindungi anak dan perempuan, untuk mencegah dan mengkriminalisasi kekerasan seksual dan untuk menyediakan ganti rugi dan upaya pemulihan terhadap korban, baik di waktu damai maupun konflik; 47 e. Mendorong parlemen untuk mengetahui kewajiban negaranya di bawah perjanjian dan resolusi internasional untuk mengawasi pelaporan pemerintah yang diharuskan oleh perjanjian-perjanjian internasional tertentu, khususnya yang terkait dengan isu HAM; f. Mendorong parlemen untuk memastikan bahwa seluruh perjanjian internasional di mana negaranya menjadi pihak untuk diselaraskan dengan Undang-undang domestik; g. Mendesak parlemen untuk beraksi memberikan dukungan berkelanjutan untuk pemulihan perdamaian dalam situasi post-conflict yang mengakibatkan kekejaman masal; serta mendesak parlemen untuk mengalokasikan anggaran yang dibutuhkan untuk membantu rekonstruksi negara yang baru bangkit dari krisis atau konflik dan berkontribusi terhadap dana UN peacebuilding sebagaimana diperlukan; h. Meminta parlemen untuk mempromosikan good governance berdasarkan korelasi positif antara good governance dan peningkatan perdamaian dan keamanan; i. Mendorong parlemen untuk bekerjasama dengan masyarakat sipil pada isu perdamaian dan keamanan untuk memberi jaminan yang lebih baik dan meningkatkan perlindungan HAM warga negara; j. Menghimbau pemerintah dan parlemen untuk melaksanakan kewajiban untuk melindungi hak-hak pengungsi dan hak mereka atas perlindungan internasional. 2. Resolusi Fair Trade and Innovative Financing Mechanisms for Sustainable Development, dengan pokok-pokok isi sebagai berikut: a. Menghimbau parlemen untuk meningkatkan dan mendukung fair trade dan inisiatif-inisiatif perdagangan yang dimonitor secara mandiri lainnya dan berkontribusi terhadap peningkatan standar sosial dan lingkungan sebagai 48 alat untuk mencapai MDGs dan penerapan Agenda Pembangunan pasca2015; b. Meminta negara-negara maju untuk menyediakan sumber-sumber finansial untuk negara-negara berkembang melalui mekanisme kerjasama pembangunan untuk mengembangkan produk-produk fair trade baru dan memastikan konsumen memiliki akses terhadap seluruh informasi yang dibutuhkan untuk membuat pilihan-pilhan yang tepat; c. Menghimbau adanya kemitraan yang saling mendukung antara pemerintah, otoritas lokal, bisnis, dan masyarakat yang memastikan akses pasar untuk produsen yang tidak diuntungkan dan menjamin keberlanjutan kehidupan serta mendorong praktek-praktek produksi pertanian yang mendukung lingkungan secara berkelanjutan; d. Mendesak parlemen dan pemerintah untuk mengeksplorasi potensi sumbersumber pendanaan nasional, regional dan/ atau internasional dalam bentuk sumber pendanaan inovatif, yaitu pajak transaksi finansial, perpajakan emisi karbon, perpajakan dari aktivitas global, kemitraan masyarakat dan swasta, serta penggunaan jaminan dan asuransi untuk menstimulasi pendanaan swasta untuk pembangunan; e. Mendesak parlemen dan pemerintah dari negara-negara berkembang dan maju untuk meningkatkan kerjasama internasional untuk memerangi penghindaran pajak dan meningkatkan upaya-upaya di bidang pajak; f. Menghimbau anggota parlemen dan IPU untuk menjalankan peran penting dalam melakukan advokasi melalui fair trade sebagai suatu cara untuk memastikan pembangunan yang berkelanjutan. 3. Resolusi mengenai The Use of Media, Including Social Media, to Enhance Citizen Engagement and Democracy, dengan pokok-pokok sebagai berikut: a. Merekomendasikan kepada parlemen untuk mengembangkan strategi dan panduan untuk meningkatkan keterlibatan warga negara dalam proses demokratis melalui penggunaan media, termasuk media sosial dengan 49 mengedepankan prinsip saling menghormati (mutual respect) di antara anggota parlemen dan antara anggota parlemen dengan publik saat berinteraksi melalui media, termasuk melalui media sosial; b. Menghimbau parlemen untuk menyebarkan informasi mengenai keparlemenan, sidang, dan tata cara sidang melalui media, termasuk media sosial, dengan tujuan untuk membiasakan warga negara dengan informasiinformasi tersebut; c. Mendorong parlemen untuk menggunakan media, termasuk media sosial sebagai dasar interaksi dengan warga negara, sambil tetap memastikan bahwa hubungan melalui media sosial tidak akan menggantikan hubungan offline, seperti melalui media tradisional; d. Menekankan bahwa pengaturan media harus sejalan dengan kewajibankewajiban HAM internasional dalam kaitannya dengan kebebasan berekspresi; e. Menghimbau pengguna media sosial untuk menghormati hukum negara masing-masing dalam hal penistaan dan fitnah, serta menghindarkan diri dari menyatakan kebencian dan hasutan untuk melakukan kekerasan, sesuai dengan hukum HAM internasional f. Menghimbau parlemen dan anggota parlemen untuk secara aktif mendukung dan melindungi jurnalis dan pengguna media sosial, termasuk bloggers, dan pembela kebebasan berpendapat di seluruh dunia; g. Mendesak anggota parlemen untuk menggunakan media sosial untuk meningkatkan hubungan baik dengan kaum muda, sehingga dapat meningkatkan kesadaran akan masalah-masalah, kebutuhan, dan aspirasi kaum muda. 4. Resolusi Emergency Item mengenai The Role of Parliaments in Addressing the Security and Humanitarian Impact of The Crisis in Syria and in Bringing Pressure to Bear on Their Governments to Assume Their International and Humanitarian 50 Responsibility Towards Syrian Refugees and to Support The Neighbouring Countries that Receive Them dengan pokok-pokok sebagai berikut: a. Menghimbau anggota parlemen dan parlemen anggota IPU untuk menekan Pemerintahnya agar menyediakan dukungan materi dan finansial yang dapat diberikan kepada pengungsi; b. Menghimbau seluruh negara untuk menyediakan perlindungan dan akomodasi bagi pengungsi di negara-negara penerima untuk melindungi mereka terhadap cuaca; sementara menyerukan kepada lembaga-lembaga bantuan untuk menyediakan fasilitas, seluruh bantuan medis yang dibutuhkan, dan makanan dengan jumlah yang mencukupi untuk seluruh pengungsi Syiria; c. Mendesak seluruh pihak-pihak di Syiria untuk mengakhiri seluruh bentuk kekerasan segera, secara penuh, dan tanpa syarat; dan menghimbau kepada seluruh pihak-pihak regional dan internasional yang relevan untuk menemukan cara untuk membantu Syiria mencapai solusi damai untuk konflik internalnya, dengan tetap mempertahankan integritas dan kedaulatan termasuk keselamatan, keamanan, dan HAM warga negaranya. 5. Quito Communique yang merupakan rangkuman diskusi dalam debat pleno dengan tema From unrelenting growth to purposeful development "Buen vivir": New approaches, new solutions. Tema ini dipilih sebagai bentuk kontribusi terhadap refleksi global terhadap agenda pembangunan pasca-2015 dan Sustainable Development Goals yang akan diterapkan baik di negara berkembang maupun negara maju. Pokok-pokok isi Quito Communique adalah sebagai berikut: a. Model ekonomi saat ini yang merupakan siklus kekal dari peningkatan konsumsi dan produksi tidak lagi dapat dilihat sebagai sesuatu yang berkelanjutan. Pertumbuhan saja tidak dapat menjawab tantangan-tantangan sosial, ekonomi, dan lingkungan dewasa ini, bahkan pertumbuhan sekarang menjadi bagian dari masalah yang harus dipecahkan; 51 b. Meskipun demikian, pertumbuhan adalah kondisi yang dituntut untuk pembangunan, yang harus diperhatikan adalah sifat-sifat pertumbuhan dan distribusi dari keuntungan pertumbuhan tersebut; c. Pada kenyataannya, kesejahteraan tidak harus terbgantung pada konsumsi dan produksi materi yang tidak terbatas. Pendidikan, kesehatan, kebudayaan, rekreasi, praktek keagamaan, pemenuhan HAM, pemenuhan emosional, dan perasaan menjadi bagian dari masyarakat merupakan dimensi dari kebahagiaan manusia yang dapat ditingkatkan dengan sedikit dampak terhadap lingkungan namun memberikan keuntungan sosial yang besar; d. Untuk menjalankan dengan sukses kebijakan-kebijakan yang berorientasi pada kesejahteraan (well-being policies) sangat penting untuk menghilangkan ketidaksetaraan gender sehingga perempuan dapat memenuhi potensinya secara penuh sebagai warga negara dan aktor ekonomi; e. Green economy (ekonomi berorientasi lingkungan) dengan efisiensi teknologi dan produk ramah lingkungannya, menunjukkan arah yang benar hanya jika ia menjadi bagian dari kerangka kebijakan yang lebih lebar; f. Kebijakan yang berorientasi pada kesejahteraan harus berupaya untuk mencapai keseimbangan yang lebih baik antara kepentingan-kepentingan swasta dan kepentingan bersama, antara kompetisi dan kerjasama, dan antara swasta dan publik untuk memproduksi barang-barang yang dapat dinikmati semua dan dapat ditanggung oleh lingkungan bumi; g. Partisipasi, transparansi, dan akuntabilitas menjadi inti dari democratic governance yang merupakan tujuan dan sekaligus kunci penentu pembangunan yang berkelanjutan; h. Oleh karena itu, saat ini peran parlemen menjadi jauh lebih besar untuk menjalankan peran mereka dalam proses pembuatan keputusan di tingkat nasional dan internasional; 52 i. Institusi parlemen memiliki peran penting pada keseluruhan arsitektur democratic governance dan oleh karenanya perlu untuk diperkuat dengan kemampuan pengawasan dan kewenangan legislasi yang lebih besar. 6. Presidential Statement on Sexual Violence against Women dengan pokok-pokok isi sebagai berikut: a. Menyatakan keprihatinan yang sangat dalam akan meluasnya aksi-aksi kekerasan seksual terhadap perempuan, khususnya pemerkosaan dalam segala manifestasi dan konteksnya; b. Mengutuk dengan keras kekerasan seksual, sebagai salah satu bentuk kekerasan yang paling sering menimpa wanita baik di ranah pribadi maupun publik; c. Menghimbau aksi-aksi mendesak dan efektif untuk menjamin hak-hak perempuan akan integritas fisik dan psikologis serta akan kehidupan yang bebas dari ketakutan dan kekerasan; d. Mendesak seluruh parlemen untuk menelusuri undang-undang yang sudah ada untuk memastikan kejahatan ini didefinisikan sebagaimana – suatu kejahatan terhadap integritas fisik dan otonomi seksual seorang individu, yang dilakukan oleh siapapun tanpa menghiraukan hubungan antara pelaku dan korban, dalam kondisi apapun; e. Melalui fungsi pengawasan dan kontrol politik parlemen, kita harus memastikan penegakan hukum dan alokasi sumber daya yang dibutuhkan; f. Parlemen akan menuntut pemerintah untuk memastikan semua pihak yang terlibat dalam penegakan hukum dipersiapkan, dilatih, dan dituntut akuntabilitasnya; g. Parlemen mendeklarasikan secara tegas bahwa aksi-aksi semacam ini tidak dapat ditoleransi dan parlemen akan berkomitmen untuk medorong penyelesaian kekerasan terhadap perempuan. 53 VI. CATATAN DAN REKOMENDASI 1. Delegasi DPR-RI telah berpartisipasi aktif dalam rangkaian pertemuan IPU ke128, yang terbukti dari terpilihnya Delegasi DPR RI sebagai Presiden Committeee to Promote Respect on International Humanitarian Law dan anggota Committee on Middle East Question. 2. Delegasi DPR RI juga berkontribusi aktif dalam pembahasan hasil pertemuan tersebut termasuk pada rancangan resolusi yang disahkan oleh IPU Assembly ke-128 ini. Sebagian besar masukan Indonesia dalam ketiga draf resolusi Standing Committee telah diakomodasi dan diterima. 3. Diangkatnya isu orientasi seksual oleh Selandia Baru sebagai emergency item pada IPU Assembly ke-128 kiranya patut menjadi perhatian dan antisipasi Delegasi RI untuk Pertemuan IPU mendatang mengingat Selandia Baru dan negara barat lain yang berkeinginan untuk tetap membawa isu kontroversial tersebut untuk dibahas oleh Third Standing Committee on Democracy and Human Rights. Indonesia kiranya perlu mencermati perkembangan isu ini mengingat adanya kecenderungan isu ini terus dibawa ke berbagai pertemuan internasional. 4. Perubahan pengambilan keputusan dalam Komite dari yang semula diserahkan kepada Biro menjadi pembahasan dalam Komite lengkap dinilai mempersempit peluang negara anggota untuk mengusulkan suatu masukan mengingat dalam proses “drafting” usulan dapat dipatahkan hanya oleh ketidak setujuan satu negara. Hal ini memaksa banyaknya pengambilan suara dalam setiap paragraf yang berpotensi membuat pertemuan menjadi berlarut-larut. 5. Pertemuan IPU mendatang yang akan dilaksanakan di Jenewa 7-9 Oktober tahun 2013 akan difokuskan pada pengesahan format dan prosedur Pertemuan IPU di masa mendatang. Sehubungan dengan hal tersebut, Delegasi RI perlu mempersiapkan posisi secara baik guna menghindari 54 kemungkinan adanya hal-hal yang dapat merugikan kepentingan Indonesia dan negara-negara berkembang lainnya di IPU. Calls on all parliamentarians and IPU Member Parliaments to bring pressure to bear on their governments to provide whatever financial and material support they can to these refugees; 2. Urges the donor countries which met at the most recent conference in Kuwait to fulfil their obligation to provide financial support of US$ 1.5 billion; 3. Calls on all countries to provide refugees in recipient countries with shelter and accommodation to protect them against the cold in winter and the heat in summer; 4. Appeals to relief agencies to provide sanitation facilities, all necessary medical care (consultation, hospital care, obstetric care and medical equipment) and sufficient quantities of foodstuffs for Syrian refugees, most of whom are women, children, elderly persons or persons with disabilities, and to try to provide schooling for the children in the camps; 5. Urges countries to provide financial support to recipient countries to ease the pressure on their financial resources, which are already scarce in many of them, including Jordan; 6. Calls on Syria’s neighbours to ensure, with the support of relief agencies, that refugees on their territories are accommodated in accordance with the 1951 UN Convention Relating to the Status of Refugees and its 1967 Protocol; 7. Also calls on the United Nations to assist recipient countries in preventing the cross-border circulation of weapons so as to guarantee the safety of refugees; 8. Expresses its concern that, given current circumstances surrounding the influx of refugees, some recipient countries may be forced to close their borders, which will further complicate the humanitarian situation in the region; 9. Urges all parties in Syria to put an end to all forms of violence immediately, fully and unconditionally; and calls on all relevant regional and international parties to find ways of helping Syria to reach a peaceful solution to its internal conflict, while safeguarding its territorial integrity and sovereignty, as well as the safety, security and human rights of its citizens. * Reservations with regard to the use of the word "security" in the title of the resolution were expressed by the delegations of Algeria, Cuba, Ecuador, El Salvador, Iran (Islamic Republic of), Mexico, Peru, Russian Federation, Sudan, Syrian Arab Republic and Uruguay. In addition, the delegation of the Syrian Arab Republic expressed reservations on several parts of the resolution which it felt violated the sovereignty of Syria, and the delegation of Cuba expressed a reservation on the first preambular paragraph. LAMPIRAN 2 SPEECH BY THE HEAD OF DELEGATION OF THE INDONESIAN HOUSE OF REPRESENTATIVES TO THE 128TH IPU ASSEMBLY AND RELATED MEETINGS QUITO – ECUADOR, 22 – 27 MARCH 2012 GENERAL DEBATE From unrelenting growth to purposeful development “Buen Vivir”: New approaches, new solutions Mr. President, Distinguished delegates, Ladies and Gentlemen, Allow me on the outset to congratulate the National Assembly of Ecuador for the excellent organization of the 128th Assembly of IPU, and I would also like to extend my sincerest gratitude for the kind hospitality provided to our delegation during our stay in Quito, the capital city of Ecuador. The Indonesian Delegation appreciates the selection of the theme for our debate on this IPU Assembly, ‘From Unrelenting Growth to Purposeful Development “Buen Vivir” New Approaches, New Solutions.’ The rapid economic growth stemming from the uncontrolled industrialization, excessive consumerism and irresponsible exploitation of natural resources, has caused wicked impacts to the life of human beings. One can argue that current economic development is a failure when considering all the side effects it has created such as environmental degradation and inequitable growth. For that reason, we should come up with a new concept as an alternative way to development. The concept of “buen vivir” or well-being, or living well, is an innovative proposal that could be considered as a better solution to achieve a more purposeful development in the future. In this particular concept, the emphasis is no longer centered solely on economic growth, but also on seeking balance between the rights of human being to pursue growth with the rights of nature. In this respect, we would like to share our experience in Indonesia. In our culturally diverse country, we always endeavor to find the delicate balance between rights of the people to live well and the rights of nature. Every person shall have the right to live and to prosper, to enjoy a good and healthy environment. We organize our national economy as a common task based on the principle of “kekeluargaan” or togetherness. The land, the waters and the natural resources within shall be under the power of the State and shall be used to the greatest benefit of the people. The organisation of the national economy is also conducted on the basis of economic democracy, where production is done by all and for all, under public supervision. The environmental perspective always being considered in our entire economic development program, one of the concrete examples is the issuance of laws and regulations relating to the preservation and protection of environment in the context of development. In the near future, the Indonesian parliament, will pass another law on the Prevention of Forest Degradation. Those are some of Indonesia’s committment in establishing a harmonious coexistence between human and the nature and in ensuring the well-being of all citizen as enshrined in our Constitution. The Preamble of our Constitution has made it clear that the goal of the founding of Indonesia is to advance public prosperity with democracy in which the highest power is held by the people. As part of the international community, we believe that it is very timely for the IPU to contribute in the discourse on the new approaches and solutions for current global issues. In this context, we would like to appreciate the efforts made by the IPU in promoting global consultation on Post-2015 Development Agenda. Tomorrow, the Indonesian House of Representatives under the support of the IPU will organize a Regional Consultation on MDGs and Post-2015 Development Agenda in Bali. This event will be held on the side of the Fourth Consultative Meeting of the High Level Panel of Eminent Persons for Post-2015 Development Agenda. The President of the Republic of Indonesia, H.E. Susilo Bambang Yudhoyono, in his capacity as the Co-Chair of High Level Panel, proposed a global partnership and means of implementation of sustainable growth with equity, because sustainability can only be reached if there is equity, not only to intensify more economic growth, but also to balance the development in all aspects and help to sustain the life of development itself. Indonesia is of the view that a global master plan on what we will have for the Post-2015 Development should be defined comprehensively, and it should be reached through a bottom-up process. Therefore, global consultation needs to involve more diverse stakeholders. With regard to the agenda to be discussed in three standing committees, let me take this opportunity to convey our appreciation for excellent works of co-rapporteurs and the secretariat in preparing the final draft reports and resolutions. We are in the agreement that civilian peaceful means should be at our utmost priority, and that military intervention should be the last resort in the peace-building scheme. In relation to fair trade, Indonesia underlined the need to have a fair share of benefit of trade and calls for stronger national action and international support to help build competitive supply and export capacities, as well as trades logistics for LDCs and developing countries. On the use of media we acknowledged the importance of social media in enhancing citizen engagement and democracy, but so as to gain fair and balance news coverage, we are in the view that right to freedom of expression is not absolute. Mr. President, Fellow Parliamentarians, Ladies and Gentlemen, In a more complicated world that faces multiple crisis: economic, financial, environment, climate and others, I once again would like to point out that buen vivir is an alternative concept to development, which we should take into consideration in the evaluation of the achievement of the Millenium Development Goals, as well as the future proposals of Post-2015 Development Agenda. The theme was chosen as a contribution to the global reflection on the post-2015 development agenda and the future Sustainable Development Goals that will apply to both developed and developing countries. The following is a summary of the discussion held during the plenary debate of the Assembly, which the IPU is requested to share with the United Nations. IPU Members may also wish to submit this communiqué to their respective parliaments. Sustainable development is now at a crossroads. In a finite world, the perennial cycle of increasing consumption and production that is at the heart of the current economic model is no longer sustainable. Growth alone is not the answer to the social, economic and environmental challenges of our time; in fact it is becoming part of the problem. A different approach that focuses on well-being in all its dimensions is required if we are to evolve as a global community able to fulfil core human values of peace, solidarity and harmony with nature. While growth is a necessary condition for development, and indeed has helped countless generations climb out of poverty, more attention now needs to be paid to the nature of growth and to the distribution of its benefits. Strong growth does not necessarily lead to increased human development and happiness. Inversely, with the right social policy balance it is possible to improve overall well-being even at low levels of economic growth. Job creation and the possibility for people to earn a decent living must be central to policies that support growth and well-being. In developing countries, material growth is essential if we are to eradicate extreme poverty and provide everyone with the necessities of life. Here too, environmental and social sustainability must be part of economic policy from the very start. This will be particularly important in view of population growth and the resultant urban explosion. Ultimately, well-being consists of human factors that do not necessarily depend on unrestrained material consumption and production. Education, health, culture, leisure time, the practice of religion, the enjoyment of all human rights, emotional fulfilment, as well as a sense of belonging to a community, are all dimensions of human happiness that can be advanced at little cost to the environment and with huge social dividends. Supporting more of these goods should be another focus of a new model of growth and development. While the private sector must continue to lead in job creation, more jobs will be needed in the social sector and in infrastructure development, which benefits communities and minimizes the impact on the environment. Youth unemployment in particular must be given priority. For well-being policies to succeed, it is imperative that gender inequalities are eradicated so as to realize women’s full potential as citizens and economic actors. Women, half of the global population, remain by far the most disadvantaged group in all spheres of life. In many countries, discriminatory laws and cultural norms deprive women of economic opportunities, with less access to credit and lower wages. In most countries, barriers still exist, preventing women from entering political office or corporate boardrooms. Violence against women remains pervasive and further underscores women’s vulnerability in most of our societies. The transition to well-being policies will not be easy and the course has yet to be fully charted. Bold experimentation will be required. Decision-makers must work to reduce the vast inequalities of conditions and opportunities that exist today both within and between countries. Incentives and regulation must be put in place for market forces to work towards well-being. As a number of countries at various levels of development have shown, it is possible today for all governments to adopt indicators to help better target economic, social and environmental policies for human welfare. Measuring national well-being beyond mere GDP will be critical in redefining growth, not only in terms of material production and consumption, but also in terms of social and environmental progress. The green economy, with its reliance inter alia on technological efficiency and environmentally friendly products, points us in the right direction but only if it is part of a broader policy framework. This will require fiscal incentives and policies to shift the composition of growth towards less resource-intensive production and consumption. A revised growth model will also need to rely more on distributive policies to spread wealth and opportunity more evenly in order to make economies more viable and strengthen well-being. Indeed, nothing undermines well-being more than a feeling of exclusion and deprivation in contrast to the excessive wealth of others. Well-being policies will need to strive for a better balance between private interests and the common good, between competition and cooperation, and between private and public investments to produce goods that all can enjoy and that the planet can afford to support. In short, the pursuit of well-being as the ultimate purpose of development, and of human progress, will require a new social contract premised on a vision of the planet and of people as assets to be nurtured. The guiding principle of “Buen vivir” should be paired with “Ubuntu”, the African dictum that the success of one depends on the success of the whole community. To achieve this vision of development, greater global cooperation will be required. Developed countries bear a greater responsibility for global sustainable development and the eradication of extreme poverty. More pro-active efforts to place developed countries’ economies on a sustainable path will be needed. More efforts will also be required to facilitate green technology transfers to developing countries, including technologies to mitigate the effects of climate change and other environmental emergencies. Development cooperation must be increased and made more accountable to both donor and recipient countries. It should also aim more directly to support wellbeing. Re-thinking the growth-centric economic model will also require a different kind of globalization: based more on solidarity and cooperation than on unfettered competition. The international economic, financial and trade architecture tends to reinforce the wrong growth model and remains tilted in favour of entrenched interests. There must be policies to reduce the excessive power, both economic and political, of transnational corporations and financial conglomerates. The increasing concentration of land ownership in a few hands undermines the livelihood of the rural poor. Since a more equitable land distribution leads to higher growth and improved human development, this problem needs to be addressed. By definition, well-being policies require all citizens, and particularly vulnerable groups such as women, youth, indigenous peoples and the poor, to participate in decision-making. Being able to participate in the decisions that affect our lives and the social and environmental context around us is in itself a key dimension of well-being. Inversely, well-being is also necessary for citizens to participate effectively in the management of public affairs. Participation and its attendants of transparency and accountability are in turn key pillars of democracy and of the way democracy applies to the functioning of government at all levels - global, national and local - and in response to citizens’ needs. Participation, transparency and accountability constitute the core of democratic governance, which isan end in itself and an enabler of sustainable development. There can be no true prosperity without respect for the universal values of democracy, the rule of law and human rights. Democratic governance should therefore be a stand-alone goal among the new Sustainable Development Goals, as well as a dimension of other goals that will be part of the future development framework. This is further supported by the results of a survey of hundreds of members carried out during the Assembly. To help steer sustainable development on a new course, a rebalancing of the role of the market and that of government is called for. Effective ways to help reconcile market needs with social imperatives include the development of private-public partnerships, community-based enterprises and other forms of cooperative models. Government intervention to guarantee the rights of the very poor and to safeguard the natural resource base will also be needed. The interdependent challenges of sustainable development require a concerted approach that only governments can initiate and help implement. To this end, it will be more important than ever for parliaments to assert their legitimate place in the decision-making process at the national and international levels. The institution of parliament is pivotal to the entire architecture of democratic governance and needs to be strengthened virtually everywhere in the world, with greater oversight capacities and legislative authority. More specifically, stronger parliaments will have to play a central role in the implementation of the future Sustainable Development Goals. This will include ensuring that development policies and plans are drawn up through participatory and inclusive processes, and with regular progress reports submitted to parliament for review. This debate should continue in national parliaments as a way of engaging them in the global consultations foreseen in the Rio outcome document, aptly called The Future We Want. LAMPIRAN 4 Chemin du Pommier 5, C.P. 330, CH-1218 Le GrandSaconnex/Geneva, Switzerland ENFORCING THE RESPONSIBILITY TO PROTECT: THE ROLE OF PARLIAMENT IN SAFEGUARDING CIVILIANS’ LIVES Resolution adopted by consensus* by the 128th IPU Assembly (Quito, 27 March 2013) The 128th Assembly of the Inter-Parliamentary Union, Acknowledging that, following several global initiatives, the responsibility to protect was recognized at the 2005 World Summit as a necessary and important principle to prevent, and protect populations from, genocide, ethnic cleansing, war crimes and crimes against humanity, Recalling that this principle was established with a view to preventing genocides such as those that occurred in Srebrenica and Rwanda, Also recalling that the UN Security Council considers that the international crimes of genocide, war crimes, ethnic cleansing and crimes against humanity constitute threats to international peace and security and that the principle of the responsibility to protect was reaffirmed in its resolution 1674 (2006), which addressed the protection of civilians in situations of armed conflict, Stressing that any decision related to the application of the responsibility to protect must be taken in a timely and decisive manner, through the UN Security Council, in accordance with the Charter of the United Nations, in particular its Chapter VII, on a case-by-case basis and in cooperation with relevant regional organizations as appropriate, should peaceful means be inadequate and national authorities manifestly fail to protect their populations from genocide, war crimes, ethnic cleansing and crimes against humanity, and that any such action must be accompanied by the provision of adequate means to protect civilians, by giving priority to peaceful means, Underscoring the special plight of women and children in situations of armed conflict, Recalling that rape and other forms of sexual violence can constitute crimes against humanity under the provisions of UN Security Council resolutions on women and peace and security (1325, 1888 and 1960) and, in particular, resolution 1820, which recognizes that rape and other forms of sexual violence can constitute war crimes, crimes against humanity or a constitutive act with respect to genocide, Mindful of the fact that the responsibility to protect is based on three pillars: the permanent responsibility of each individual State to protect its population, whether nationals or not, from genocide, war crimes, ethnic cleansing and crimes against humanity, which entails the prevention of such crimes, including their incitement, through appropriate and necessary means; the international community’s commitment to assist and help to build the capacity of States to fulfil this obligation; and its commitment to take collective action in a timely and decisive manner when national authorities manifestly fail to protect their populations from genocide, war crimes, ethnic cleansing and crimes against humanity, Underscoring the importance of combating impunity in the case of perpetrators and instigators of the most serious crimes of concern to the international community and recognizing the contribution in this field of the International Criminal Court (ICC); Invites parliaments and parliamentarians to use all the public education and awareness-raising tools at their disposal to help prevent and put an end to genocide, war crimes, ethnic cleansing and crimes against humanity, paying particular attention to the plight of women and children, and to address issues related to the root causes of armed conflict; 2. Calls on parliamentarians to use all the tools at their disposal, including social media, to denounce acts of violence against women and children and fight impunity; 3. Urges parliaments to ensure that their governments protect populations, whether or not the nationals of their countries, from genocide, war crimes, ethnic cleansing and crimes against humanity, and also urges parliaments and governments to assist and build the capacity of States to prevent the commission of genocide, ethnic cleansing, war crimes and crimes against humanity and protect their populations, whether or not their own, from them and, where necessary, to engage in timely and decisive action, in accordance with the UN Charter, to prevent or put an end to such crimes; 4. Calls on parliaments to step up their oversight of government action to combat terrorism and implement UN Security Council resolutions adopted under Chapter VII of the UN Charter, which call on States to refrain from financing terrorists, facilitating their movement and aiding terrorism; 5. Also calls on parliaments to adopt laws and policies to protect women and children, to prevent and criminalize sexual violence and to provide redress for victims in times of peace and conflict; 6. Encourages parliaments to become acquainted with their States’ obligations under international treaties and resolutions, to monitor the executive’s submission of country reports as required by the relevant treaty bodies, particularly those relating to human rights, to become more involved with regional and international human rights mechanisms and to ensure that all United Nations doctrines and resolutions regarding the responsibility to protect are fully applied and respected by every country; 7. Calls on parliaments where necessary to ensure that all international treaties to which their country is party are incorporated in domestic law, giving priority to treaties dealing with human rights and the protection of civilians, especially those applicable to the rights and protection of women and children during and after armed conflicts and other crises; 8. Urges all parliaments to adopt measures to respect the rights of civilians caught up in armed conflicts, ensure adequate and effective judicial remedies, including efficient investigation and prosecution, treat women and child victims with dignity, and guarantee reparation to victims; 9. Encourages parliaments to adopt programmes to help child soldiers resume a normal life; 10. Calls on parliaments to take all the necessary measures to bring their countries’ criminal and military law into line with international norms on the protection of civilians in armed conflict and to ensure that the perpetrators of the most serious crimes are held to account for their acts before a national court or, where a State is unwilling or genuinely unable to take action, before the International Criminal Court, in the case of a State Party to the Rome Statute; 11. Urges parliamentarians to use their international network to promote the universal ratification of the Rome Statute, which recognizes the competence of the International Criminal Court with regard to crimes of genocide, crimes against humanity and war crimes; requests parliaments to ensure that their governments sign the Rome Statute; and calls on all parliaments that have not already done so to ratify it; 12. Also urges parliaments to promote debate on an arms trade treaty in order to put an end to the transfer of weapons in cases where there is a high risk that such weapons will be used to commit or facilitate violations of human rights or international humanitarian law or to hinder the fight against poverty; 13. Calls on all parliaments that have not yet done so to establish committees to oversee international relations and provide such committees with sufficient financial and human resources and adequate time on the parliamentary agenda to conduct their work; 14. Encourages parliaments to ensure that the protection of human rights, including those of women and children, members of minorities and indigenous peoples, is guaranteed in domestic law and implemented in practice; 15. Urges parliaments and governments to guarantee the human rights of women and further enhance their role in peace and security initiatives, honour existing international commitments to protect women’s rights and incorporate women’s leadership in decision-making for preventing and putting an end to mass atrocity crimes; 16. Stresses that, with regard to the responsibility to protect, parliaments should pay special attention to the human rights of women and children in crisis areas, as they often suffer the most and their misery is overlooked, with far-reaching human, social and economic consequences; 17. Calls on parliaments to encourage their governments to support the creation and effective functioning of early warning systems and decision-making and response mechanisms at the national, regional and international levels, in order to respond faster and more effectively to situations of armed conflict and internal disturbances and tensions; 18. Invites parliaments to actively bring to the attention of their governments situations of risk for civilian populations by ensuring that their governments discharge their responsibility of follow-up and prevention; 19. Calls for efforts to promote the media’s role in documenting, preventing, and raising awareness about the commission of genocide, war crimes, ethnic cleansing and crimes against humanity by guaranteeing freedom of expression; ensuring that freedom of the media is protected by the national constitution and law; demanding that all parties abide by their international obligations related to the protection and safety of journalists, media professionals and associated personnel; encouraging accurate journalism that respects the human rights of all populations; speaking out against expressions of hatred that constitute incitement to discrimination, hostility or violence; and, where appropriate, legislating against such expressions; 20. Calls on parliaments to act resolutely upon the requests of their governments to provide sustainable assistance for the restoration of peace in post-conflict situations that give rise to mass atrocities and require such assistance, and to allocate the necessary funds to assist with the reconstruction of countries emerging from crises or conflicts and contribute to the UN peacebuilding fund as appropriate; 21. Requests parliaments to include funds in State budgets for the organization of operations to protect populations from violence and ensure their safety; 22. Calls on parliaments to ensure implementation of UN Security Council resolution 1325, including by facilitating the participation of women in peace processes and negotiations, ensuring that women make up at least one third of negotiating teams, are well represented in defence and security forces and are properly trained as peacemakers and peacebuilders; 23. Urges the IPU to facilitate an exchange of good practices in the areas of parliamentary oversight of the enforcement of the responsibility to protect and parliamentary involvement in the protection of civilians in situations of armed conflict and in the protection of populations from genocide, ethnic cleansing, war crimes and crimes against humanity; 24. Also urges parliaments to be attentive to and scrutinize the reports of human rights organizations and the way in which governments ensure the protection of human rights; 25. Calls on parliaments to promote good governance based on the positive correlation between good governance and the advancement of peace and security; 26. Also calls on parliaments to monitor closely UN Security Council proceedings, request their governments to make the case at the Security Council for the need to act responsibly when resorting to coercive measures and ensure that once adopted resolutions are enforced in their entirety and in a transparent manner; 27. Requests that fair trade certification processes be put in place under the authority of the State and in the framework of regional organizations competent in the area of trade and the WTO; 8. Urges parliaments and governments to explore the potential of innovative sources of financing required to meet development needs and to identify possible instruments and allocation mechanisms; 9. Encourages parliaments and governments to explore the national, regional and/or international potential of the following innovative financing sources: o a financial transaction tax, in a variety of forms; o taxation of carbon emissions, in a variety of forms; o taxation of globalized activities, such as aviation and maritime activities; o public-private partnerships to fight major diseases, such as the GAVI Alliance and Rotary International's successful campaign to eradicate malaria; and o the use of guarantees and insurance to stimulate private financing for development, such as Advanced Market Commitments; 10. Urges parliaments to play an active role both through legislation and regulatory action to reduce taxes and fees on fair trade products; 11. Appeals to parliaments and governments to better take into account remittances when defining their development strategies and financing thereof and stresses that labour-recipient countries should not impose any undue restrictions on the money transfers of these workers to their home countries but should, on the contrary, reduce the costs given that these are a basic source of hard currency in such countries; 12. Underscores that these innovative financial flows should not place additional burdens on developing countries, that they should supplement existing official development assistance flows without reducing them, and should be compatible with a post-2015-development-agenda-centred development strategy, while being as far as possible predictable and sustainable; 13. Also underscores that transparency and public scrutiny of innovative financing mechanisms are a sine qua non for their introduction and suggests conducting case studies of existing programmes with a view to providing guidance; appeals for the harmonization of fragmented monitoring and evaluation mechanisms to reduce transaction costs and facilitate independent monitoring and evaluation mechanisms so as to assess the delivery of innovative financing and its impact on development outcomes; 14. Cautions against setting up complicated structures for innovative financing that could impede transparent allocations of their proceeds to development projects, facilitate public scrutiny thereof and guarantee an effective evaluation of their contribution to development goals; 15. Appeals for consideration to be given to allocating the proceeds of innovative financing mechanisms through globally or regionally inclusive institutions; 16. Advocates for the coordination of relevant NGO activities and better use of existing programmes and experience; 17. Urges parliaments and governments of both developed and developing countries to promote international cooperation in the fight against tax evasion and step up efforts in the area of taxation, mainly in terms of tax collection and measures to combat tax evasion and unlawful capital flows to tax heavens, efforts which are crucial to achieving a sound fiscal policy and increasing domestic revenue, in particular through the recognition and protection of property rights, especially for women, land registry systems and improving the business and investment climate in developing countries; 18. Calls for the strengthening and wider implementation of the Extractive Industries Transparency Initiative (EITI) as a means to improve revenue transparency and accountability in the extractive sectors, and invites parliaments to support and monitor EITI processes in their respective countries; 19. Invites the governments of developed countries to scale up their assistance in the area of strengthening tax authorities, the judiciary and anti-corruption agencies in developing countries; 20. Also invites the governments of developed countries to combat active corruption committed in developing countries by companies domiciled in their jurisdictions; 21. Urges developing and developed countries to scale up their efforts to combat corruption by putting in place effective and impartial judicial systems so as to increase the efficiency of public spending and investments; 22. Calls on governments and NGOs to work towards meeting the commitments under the Copenhagen Accord and other international accords dealing with climate change; 23. Encourages parliaments and governments to explore in depth the possibility of establishing innovative financing mechanisms to assist developing countries in combating climate change; 24. Calls on all governments, particularly in developing countries, to work towards the achievement of sustainable development by improving the level of education of their citizens and empowering women, children and other disadvantaged groups, and encourages parliaments and governments to explore in depth the possibility of establishing innovative financing mechanisms for education; 25. Also calls for the holding of an international parliamentary conference on fair trade to discuss ways of achieving fair trade and the role of parliaments therein; 26. Invites those States which have not yet done so to join the Leading Group on Innovative Financing for Development set up in 2006 and to participate in all existing financing mechanisms for sustainable development; 27. Calls on parliamentarians and the IPU to play a pivotal role in advocating for fair trade as a means of ensuring sustainable development. for much of the world’s population, Mindful of the fact that traditional media are facing challenges in responding to rapid technological and financial changes, which may affect their ability to provide information, including information about parliament, and noting that independent, pluralistic and quality media are fundamental for democratic processes, Aware that increasing numbers of citizens and parliamentarians are using social media globally, Cognizant of the possibilities offered by social media services for promoting the enjoyment of human rights and fundamental freedoms while underscoring that these same rights and freedoms, in particular the right to privacy and human dignity, may also be threatened on social networks, Considering the potential of social media to disseminating a certain political opinion, Underscoring the fact that fostering media and Internet literacy with regard to both traditional and new social media is an essential prerequisite for enhancing youth participation and inclusion in the political process, Concerned that social media may also be used to send hate messages, sometimes anonymously, and allow people with malicious intentions to organize and mobilize others, which may undermine democracy and peace, Underlining the importance of respecting laws regarding defamation and libel, with particular legislative efforts aimed at avoiding incitement to hatred, Aware of the need to use social media responsibly, not only fully respecting prevailing legislation, but also the confidentiality, privacy and integrity aspects of the information dealt with, Convinced of the very important role that media and press regulatory bodies can play in protecting human rights, particularly freedom of expression and the right to privacy, Also convinced of the role that media and parliamentary press bodies can play in scaling up communication between parliament and the public, Aware of the significant challenges that would be encountered in developing a universally enforceable code of conduct for social media users, Encouraged that the IPU and the ASGP are working on social media guidelines for parliaments, Convinced that parliamentarians need to share information about the potential of social media to enhance citizen engagement and representative democracy, its risks, and the technical requirements needed to realize its potential, Mindful of the watchdog role of journalists in the political system and the need for journalists to be accountable to the public while following the codes of ethics of journalism, Aware that journalists no longer have the monopoly on information dissemination, as users of social media generate content and information themselves, Convinced that corruption represents a serious threat to the rule of law, democracy, human rights, equity and social justice, Affirming that the right to freedom of expression should also be protected online, and bearing in mind that the enjoyment of this right carries with it special duties and responsibilities, in accordance with Article 19 of the Universal Declaration of Human Rights and Article 19 of the International Covenant on Civil and Political Rights, Underscoring Article 20, paragraph 2, of the International Covenant on Civil and Political Rights, according to which "Any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence shall be prohibited by law", Recalling United Nations Human Rights Council resolution 20/8 of 29 June 2012 on "The promotion, protection and enjoyment of human rights on the Internet", 1. Recommends that parliaments develop strategies and guidelines for enhancing citizen engagement in the democratic process through the use of media, including social media; 2. Calls on the IPU to collect and make publicly available the guidelines developed by its Member Parliaments, and to develop best practices in the use of social media to enhance citizen engagement; 3. Encourages parliaments to include in those guidelines additional provisions that address the need for mutual respect among parliamentarians and between parliamentarians and the public when interacting through the media, including social media; 4. Calls onparliaments to disseminate through the media, including social media, information on parliamentary business, debates and procedures with the aim of familiarizing citizens with them and making them more comprehensible, attractive and dynamic; 5. Encourages parliaments to use media, including social media, as part of a platform to interact with citizens, while ensuring that any social media engagement would not replace offline engagement, including through traditional media; 6. Urges parliaments and parliamentarians to ensure that their citizen engagement efforts are accessible to all regardless of gender, age, socio-economic status, place of residence, disability, religious belief, ethnicity or political affiliation; 7. Encourages parliaments to provide parliamentarians with the necessary information technology resources, assistance, training, equipment, technical support, access and any other forms of assistance to effectively use the media, including social media, as a way of engaging with citizens; 8. Urges parliaments to take effective measures aimed at narrowing the digital divide, especially for developing countries where the majority of the population still does not have access to information technology resources; 9. Calls on all stakeholders to foster Internet and media literacy for all citizens, in particular children and young people, for example by developing and offering special educational and training programmes; 10. Urges parliaments and parliamentarians to respect the rights to freedom of expression, information and assembly, both online and offline; 11. Underscores that a free, open and accessible Internet is both a fundamental human right and a tool for citizens to enhance engagement and democracy, and also underscores that parliamentarians must assume responsibility for ensuring that citizens have access to free and secure communications online; 12. Emphasizes that any regulation of the media must be consistent with international human rights obligations in relation to the right to freedom of expression; 13. Calls on all social media users to respect their country’s laws regarding defamation and libel in accordance with international human rights law; 14. Also calls on all social media users to refrain from hate speech or incitement to violence in accordance with international human rights law; 15. Further calls on parliaments to actively support and protect journalists and social media users, including bloggers, and defenders of the freedom of speech around the world; 16. Urges parliaments and parliamentarians to protect the right to freedom of expression and speech so as to facilitate journalists’ watchdog role through traditional media and social media while respecting ethical codes, thereby enhancing democracy; 17. Calls on parliaments to provide parliamentarians with information and assistance regarding legal and other issues pertaining to defamation, libel, the protection of privacy and confidentiality; 18. Invites parliaments to put in place, where necessary, regulations and procedures guaranteeing the rights of all persons using new information and communication technologies in a representative and participatory democracy; 19. Calls on parliamentarians not only to use new technologies safely, but also to promote such use by third parties and instil a culture of security in the use of social media; 20. Urges parliamentarians to work towards achieving a safer digital society, particularly with regard to the use of social networks; 21. Encourages the incorporation of social media and technologies into laws and regulations governing access to public information; 22. Also encourages parliaments and governments to adopt measures aimed at protecting press freedom, enhancing its transparency, strengthening its capacities and making it more democratic; 23. Urges parliamentarians, especially women parliamentarians, to use social media to support each other and interact with communities to enhance women’s participation and inclusion in democratic processes; 24. Also urges parliamentarians to use social media to increase their engagement with youth and raise awareness of youth problems, needs and aspirations; 25. Invites parliaments to conduct a study of media coverage of parliament in their countries so as to gauge the importance of each type of media and each medium; 26. Urges the governments of countries that do not already have one to put in place an independent watchdog body to monitor the proper functioning of the freedom of expression and communication of the media and to prevent abuses and human rights violations that might result from the activity of communications professionals; 27. Encourages parliaments to diversify their means of communication by creating their own media bodies and by facilitating public access thereto; 28. Also encourages parliaments and parliamentarians to establish and respect codes of ethics for communications and to recognize the need for discussions and mutual agreements on how political or other debates should be conducted. LAMPIRAN 7 Inter-Parliamentary Union Chemin du Pommier 5, C.P. 330, CH-1218 Le GrandSaconnex/Geneva, Switzerland PRESIDENTIAL STATEMENT ON SEXUAL VIOLENCE AGAINST WOMEN Endorsed by the 128th IPU Assembly (Quito, 27 March 2013) On behalf of the members of parliament attending the 128th Assembly of the InterParliamentary Union, I express our deep concern at widespread acts of sexual violence against women and, in particular, rape in all its manifestations and contexts. We strongly condemn sexual violence. It is one of the most frequent forms of violence inflicted upon women, be it in the public or private sphere. We call for urgent and effective action to guarantee women their right to physical and psychological integrity and a life free of fear and violence. We express our outrage at these heinous acts of violence and join public calls for an end to impunity. We urge all parliaments to scrutinize existing laws to ensure that these crimes are defined for what they are - a violation of an individual’s physical integrity and sexual autonomy, committed by any person regardless of their relationship to the victims, in any setting. We must criminalize such acts of sexual violence, enhance prevention by tackling their root causes, toughen punishment of perpetrators and provide women with adequate protection. Through our oversight function and political control, we must ensure the enforcement of laws and the allocation of appropriate resources. We will request our governments to report to us regularly on measures taken to raise public awareness. We will ask for statistical data so as to evaluate the incidence of acts of sexual violence and the effectiveness of measures in place. We will also demand that our governments ensure that all those involved in law enforcement are adequately prepared, trained and held accountable. We must ensure that the response to rape and sexual violence is sensitive to women’s needs and that the victims are not subject to punishment, abandonment or stigmatization. We firmly declare that such acts are intolerable and commit ourselves to championing the cause of ending sexual violence against women. LAMPIRAN 8 THE DELEGATION OF THE INDONESIAN HOUSE OF REPRESENTATIVES TO THE 128TH IPU ASSEMBLY AND RELATED MEETINGS QUITO – ECUADOR, 22 – 27 MARCH 2012 POINTS OF INTERVENTIONS 1 STANDING COMMITTEE ON PEACE AND INTERNATIONAL SECURITY st Enforcing the Responsibility to protect: The role of parliament in safeguarding civilian’s lives Mr/Mme Chairperson, Distinguished delegates, Ladies and Gentlemen, Let me first express my delegation’s appreciation to you for convening this session and to the work of our Rapporteur and their team for this excellent document. Indonesia has twelve short amendment to the final draft, however we will listen and see other delegation’s opinion in this matter to ensure a successful deliberation of the draft. Mr. Chairman, Since the end of second World War, the international effort has been undertaken in armed conflict to protect populations from mass atrocities, which so called genocide, ethnic cleansing, war crimes, and crimes against humanity and this principle of protection the civilian, particularly women and children, should be the key element of our report. Following the long road discourses on the primary responsibility of states to protect populations, we have reached consensus in World Summit 2005. The term responsibility to protect was first presented to the public and agreed by the World leaders to protect the populations from the grave threats of armed conflict. It has globally recognized that freedom and other fundamental human rights are the highest aspiration of common people. The Universal Declarations of Human Right has entailed the obligation of all states to provide any means in order to protect their populations. Mr. Chairman, The task ahead is neither to renegotiate the conclusion of World Summit 2005, nor to reinterpret the notion of Responsibility to Protect. The challenge is how best to implement the principle of responsibility to protect in practical, turn the words into policy and ensure the horrors witnessed during the genocide never occur again. We fully agree with the three pillars of Responsibility to Protect, namely, the primary responsibility of every state to protect its population from genocide, war crimes, ethnic cleansing and crimes against humanity; the responsibility of the international community to assist States to fulfill their national obligations, including capacity-building; and the commitment to take timely and decisive action, consistent with the UN Charter, in those situations where a state is manifestly failing in its responsibility to protect. Indonesia believes that the framework of the Responsibility to Protect and its three pillars will be enough to withstand and uphold the international humanitarian law. It is also important that this global consensus be preserved, sustained and operationalized in order to prevent the mass atrocities, including the consensus on the role of parliament on this issue. We should coordinate to assist the member states to build their capacity in exercising their primary responsibility to protect populations, to meet the standard of good governance and build democratic society. This will in turn lead to better law enforcement and the protection of civil society. It is worth to emphasize, that where the states manifestly falling in its protection responsibilities, the international community should prioritize the non-violent and noncoercive means to respond such condition. In case where the pertaining atrocities already happened, it is important to build mechanism that provide early, flexible, and balanced response that making use the maximum resources available. We should note that the military intervention should be the last resort in peace building scheme to restore international peace and stability. In addition to the principles that we mentioned earlier and looking at the final report, we would like to ask the Rapporteur to work on the possibility of merging some suggested paragraph that we think could be merged into a one good and complete paragraph. My delegation stands ready to engage constructively in discussing the various important issues raised therein. Thank You. LAMPIRAN 9 THE DELEGATION OF THE INDONESIAN HOUSE OF REPRESENTATIVES TO THE 128TH IPU ASSEMBLY AND RELATED MEETINGS QUITO – ECUADOR, 22 – 27 MARCH 2012 ND 2 POINTS OF INTERVENTIONS STANDING COMMITTEE ON SUSTAINABLE DEVELOPMENT, FINANCE AND TRADE Fair Trade and Innovative Financing Mechanisms for Sustainable Development Mr/Mme Chairperson, Distinguished delegates, Ladies and Gentlemen, Thank you for giving me the floor. We all know that past decade shown us that the traditional financial mechanism urgently need an overhaul. In this regards, Indonesia reiterate the crucial importance of seeking innovative financial support from all sources to enable and ensure the continuation of sustainable development in all countries, particularly developing countries. My delegation would likt to further encourage the need of additional and innovative financing resources mechanism such as: Private Public Partnership (PPP), taxation policies, and others. These resources will complement the Official Development Assistance (ODA) as the a main source of financing for sustainable development in developing countries. Furthermore, we reiterate the importance of ensuring that developing countries have steady and predictable access to adequate financing from all sources to promote their own development target. In this relation, we had an example on initiative on PPP. It gains its momentum as we introduced the Master Plan for Acceleration and Expansion of Indonesia Economic Development in May 2011. The Master Plan is designed to speed up the economic development of Indonesia in the period of 2011-2025. It is projected that the Master Plan will require at least US$ five hundred (500) billions of domestic and foreign investment. Through this Master Plan, we provide projects that will benefit for all, not only to the government, but also to the investors; it attracks not only to the locals, but also to foreigners with environment concerned. We have committed to promote projects which environmentally friendly. The development of Steam Power Plant in Central Java which will produce two thousand (2.000) megawatt of electricity has become the example of this environmentally sound project under the Master Plan. The power plant will produce lower carbon emission than the common coal-fired power plant. The Indonesian House support the Master Plan initiatives through several policies to provide incentives in other areas that will reduce the investors’ economic cost in Indonesia, including the adoption of Law on Land Acquisition for Public Development in 2011. Several legislation products also promote the spirit of sustainable development and of course can facilitate the way for the exploration of PPP scheme such as: Bill on Geothermal and Bill on Industry among others will be on the House table for the year of 2013. Fellow delegates, In its relation to fair trade, my delegation is of the view that the producers, particularly small producers, shall have the same benefit as the consumers. We should also support producers in facing economic, environmental and social challenges to strengthen their livelihoods and contribute to a more sustainable world. Farmers and workers at the beginning of the chain shall have their fair share of the trade. In Indonesia, we provided US$ 890 million in loans in 2011 to farmers and co-operatives (Koperasi) of farmers as part of our efforts to integrate farmers and rural population into our financial inclusion strategy. A bill on Protection and Empowerment of Farmers is scheduled to be discussed and deliberated by the House this year with a purpose to provide more benefit for farmers in supporting their livelihood. Indonesia therefore calls upon IPU Members in this session to take account the role of the farmers and workers and other producers in the chain of trade. At this opportunity, Indonesia calls for stronger national action and with international support to help build domestic competitive productive export supply capacities, as well as trade-supportive logistics for developing countries, including Africa, LDCs, landlocked developing countries, Small Island developing States and other countries which structurally weak and have vulnerable small economies. Indonesia also reiterates the importance of the Aid for Trade initiative, as part of international aid discourse in the WTO. We believe that such initiative will play important role in enhancing capacity, infrastructure and trade-related adjustment support for developing countries. My delegation has six very short amendment for the draft resolution and one paragraph to be considered by this committee. Let me commend the work of the rapporteurs in preparing such a comprehensive report and drafting a draft resolution on the use of media, including social media, to enhance citizen engagement and democracy. Fellow delegates, In a democratic environment, the will of the people shall be the core of the policy and decision making process. To support this concept, we need a channel that serves as a hub between people and those who govern them; the one which could enhance their awareness on what has been done and will be done by their government in fulfilling its duties to the people. I could not agree you more on the fact that by using media, and by considering the potential use of the social media, we could facilitate greater citizen engagement through two-ways or multi-ways interaction. As parliamentarians, we were mandated by the people to represent them and channel their aspiration. We have the responsibility to foster communication, to engage our constituents and translate their will into policy and law making process. Indonesia understands deeply these values. That is why the Indonesian House adopted a new Law on Press in 1999, a year after people’s movement incite a new regime of democracy in our country. The law provides a new path for the press by removing government intervention on the publication of media. In short, it protects the fundamental rights to freedom of expression. Ladies and Gentlemen, The need to engage citizen in the life of democracy is indispensable. Without their active participation, parliament will be no more than an office of elites. Thus, my delegation support the draft resolution proposed by rapporteurs which underscores the need to enhance the awareness and engagement of people on parliament and its work in the democratic process. Parliamentarians can utilize different type of media, including social media, to promote transparency, accountability of their work and that by providing interaction through social media, parliamentarians can have enough concept from the perspectives of peoples on issues that rise on a debate or discussion within community. Honourable friends We all know that fully guaranteeing the right to freedom of expression is always have its own challenges. It was like two sides of the same coin. The first side provides adequate channels to engage citizens in the work of democracy and its institutions, and the other provides enough tools to cause the increasing number of hate speech, malicious message, defamation, libel and so on. To deal with those kind of challenges, we need to make sure that an act refer to the right to freedom of expression shall be done within the spirit mutual respect and responsibility. May I refer to what has been envisioned by international community through the Universal Declaration of Human Rights. “All human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood,” It underlines the need to exercise all of those fundamental rights, including the right to freedom of expression under the spirit of brotherhood. The exercise of the right therefore, in our perspective, is not absolute. In the context of the draft resolution, Indonesia proposes six proposed amendment, including a new paragraph in the operative section which emphasizes the need to establish a professional environment of media which is accountable to their work in exercising journalism ethics and standard. Media which is accountable and responsible will support the way how people engage themselves in democracy and how they interact under the implementation of the right to freedom of expression. The proposal is in para twelve of the final draft which stated as follow: Calls upon press associations globally to develop ways and measures in ensuring the enforcement of journalism ethics and standards.
