The culture of the Maya, which began roughly 5,000 years
ago and ended around the time of the Spanish conquest,
is still a mystery. On our trip you will discover three Maya
strongholds: Tulum in Mexico is the only Maya city situated
on the coast; Altun Ha and Lamanai are in Belize. Lamanai
remained populated for roughly 3,000 years. Excavations
have revealed that over 20,000 people lived there around
700 A D.
The world’s second largest coral reef
The Belize Barrier Reef contains countless small coral
islands. The Lighthouse Reef Atoll features a particularly
special natural wonder: the Great Blue Hole, a circular
submarine sinkhole and UNESCO World Heritage Site.

The largest of the Mediterranean islands is a fabulously
diverse microcosm in its own right with its rich cultural

Bathed in gold: the Cappella Palatina
and its mosaics
At the highest point of the medieval town centre in
Palermo lies a castle whose roots can be traced back
to the Normans. From the outside this building seems
imposing and spellbinding, but its interior charm is truly
breathtaking – especially the “Cappella Palatina” and
its design with Arab, Byzantine and Norman influences.
Stained glass and gold mosaics on the walls, a wooden
ceiling richly adorned with Arab ornaments, and an

Grenada – the island of spice
Although Grenada has been blessed with around 45
picture-perfect beaches, the country’s real treasure
remains its lush, green island interior. Deep volcanic lakes,
dense rainforests, waterfalls and small river courses form
the primordial backdrop of the island’s sugar cane fields
and spice plantations. It is the reason why the scent of
cloves, cinnamon and nutmeg hangs in the air wherever
you go on Grenada.
For many, life under water is a fascinating world – one
that becomes even more magical the closer you get.
The Tobago Cays’ Horseshoe Reef is such a place. This
horseshoe-shaped coral reef encloses four small islands
that glow in rich shades of green. The sea, in contrast,
embraces turquoise, emerald and every shade of blue.
The natural beauty spots of St Lucia
and Dominica
The pitons of St Lucia are world famous and magnificently
beautiful. But perhaps even more beautiful is the unique
view you have of this stunning natural masterpiece from
the Sea Cloud’s anchorage. Dominica is one of the
wildest and most primal of the Lesser Antilles. The heart
of the island is covered in thick virgin forest, where you will
find plunging rivers and small creeks winding their way
through the jungle.
Although many like to call it “St Barts” for short, the
island’s official name is St Barthélemy. Having passed
through several different owners, the land was finally
bought by France in 1877 and is now firmly in the hands
of the jet set. Elegant Gustavia entices with classy goods
and glamour hidden away behind restored facades, and
the harbour hosts luxury yachts with famous owners.

It is sometimes easy to think that this is one of nature’s
fairy tales: Once upon a time, there was a giant who
played with large stone marbles. His favourite playground was in Virgin Gorda, a place now called “The

bed in antique white, gold decoration, lavish ceiling décor, a floorto-ceiling dressing mirror and a large, walk-in closet – this approx.
38 m2/410 sq ft suite, formerly occupied by Marjorie Merriweather
Post, was designed to meet her demands for absolute elegance.
The double bed has two mattresses (each 90 cm x 200 cm), the
approx. 9 m2/97 sq ft bathroom features an antique dresser, a
washbasin and a bathtub.
Luxury owner’s cabin No 2 (Cat. A)
A living space with maple panelling, a marble fireplace,
a magnificently decorated bathroom and a large walk-in
closet – the suite of the former owner Edward Hutton is
approx. 34 m2/366 sq ft. He even made use of the suite’s
bureau bookcase, which features mirrored glass. The generous
bed has two separate mattresses (each 90 cm x 200 cm).
The red carrara marble bathroom is approx. 9 m2/97 sq ft
and includes a bathtub, a washbasin and a dresser.
De luxe original cabin No 3 (Cat. B)
A sage-coloured marble bathroom, a walk-in closet, antique
single beds (each 90 cm x 200 cm), armchairs, a mirrored
dresser and serving cabinets. In addition, the room’s overall
colour scheme gives it a certain colonial touch. Approx.
24 m2/258 sq ft, perfect for a good night’s sleep. The
bathroom, approx. 4 m2/43 sq ft in size, features a bathtub.
Approx. 22 m2/237 sq ft. Designed in the style of an English
country house and ideal for a relaxing night’s sleep. The
centrepiece of the main room is a comfortable double bed (two
mattresses, each 90 cm x 200 cm) which perfectly complements
the cabin’s lavish Louis XVI-style antiques. At approx. 5 m2/
54 sq ft, the bathroom with bathtub is very spacious, and the
walk-in closet offers sufficient storage space.
Spacious, antique mahogany dressers, a marble bathroom
and fireplace, mahogany décor and antique furniture, along
with a well-sized walk-in closet, ensure a cosy and subtle
elegance, all within a space of approx. 20 m2/215 sq ft. The
two single beds (each 90 cm x 200 cm) are placed next
to each other, forming a double bed; the approx. 5,4 m2/
58 sq ft bathroom is fitted with a bathtub.
This approx. 18 m2/194 sq ft original cabin also recreates the
feel of elegant 1930s travel. The cabin’s fireplace and beautiful
bathroom (approx. 4 m2/43 sq ft with a fitted shower) are
made of marble; the cabin also features a generous walk-in
closet. The room’s small, specially selected, antique mahogany
furniture makes a graceful addition. Carefully chosen fabric
colours give the entire room a very warm, sunny and light
atmosphere. The two single beds (each 90 cm x 200 cm) are
placed next to one another, forming a double bed.

This room was once home to Dina, the daughter of the previous owners.
The furniture, made of sophisticated maple, features mahogany inlays.
The unusual layout of this cabin, with its angled fireplace, makes
this approx. 24 m2/258 sq ft room (featuring two single beds, each
90 cm x 200 cm) appear larger than it actually is. The gold-plated
marble bathroom, which includes a bathtub, is approx. 7 m2/75 sq ft.
The cabin also features a walk-in closet.

De luxe outside cabin No 9 (Cat. C)
Warm and bright tones dominate this approx. 20 m2/215 sq ft
deluxe outside cabin fitted with a double bed (two mattresses, each
90 cm x 200 cm) and situated on the Main Deck. The cabin features
a modern elegance, generous storage space and a walk-in closet.
The approx. 3,6 m2/35 sq ft marble bathroom is fitted with a bathtub.
De luxe outside cabin No 10 (Cat. C)
Cabins 9 and 10 are located at the end of the corridor. They have their
own staircase to the Promenade Deck. This approx. 18,5 m2/198 sq ft
cabin follows the same design pattern as Cabin No 9. It includes a
walk-in closet as well as additional storage space and cabinets built
into the cabin’s overall furnishings. The approx. 3,3 m2/39 sq ft marble

Double-bed cabins No 30 and 31 (Cat. 1)
These two double-bed cabins are located on the Captain’s and Lido
Deck and feature unique corner panorama windows. Approx. 13 m2/
140 sq ft in size, they offer a substantial wardrobe, a double bed with two
mattresses (each 80 cm x 200 cm) and a spacious, elegant bathroom
with a fitted shower.
Twin-bed cabins No 32-37 (Cat. 2)
Each of these cabins features a marble bathroom with a fitted shower,
two single beds (each 80 cm x 200 cm), a substantially sized wardrobe
and additional built-in storage space. Their location on the Captain’s
and Lido Deck and their design, featuring two panorama windows,
mean these approx. 13,5 m2/145 sq ft cabins feel extremely bright.
Twin-bed cabins No 18-25 (Cat. 3)
Located on the Promenade Deck, each of these outside cabins also
features panorama windows, a marble bathroom with a fitted shower
and furnishings similar to Cat. 2 cabins. They are approx. 12,5 m2/
135 sq ft in size.
Twin-bed cabins No 28 and 29 (Cat. 4)
These cabins are each approx. 10,5 m2/113 sq ft and located on the

Despite all their modern conveniences, these outside cabins, with their
upper and lower single beds, are reminiscent of the days of merchant

“Trade winds” is the name given to the powerful currents
of air that great seafaring nations used to rely upon to
carry their fleets across the Atlantic. Today they are one
of the reasons why the Lesser Antilles have become a
paradise for sailing enthusiasts. It is easy to see why one
of the world’s most famous sailing regattas, the Antigua
Race Week, takes place here: The warm trade winds that
blow around the Leeward Islands mean sailors constantly
have the wind in their sails.

Grenada – the island of spice
Although Grenada has been blessed with around 45
picture-perfect beaches, the country’s real treasure
remains its lush, green island interior. Deep volcanic lakes,
dense rainforests, waterfalls and small river courses form
the primordial backdrop of the island’s sugar cane fields
and spice plantations. It is the reason why the scent of
cloves, cinnamon and nutmeg hangs in the air wherever
you go on Grenada.
For many, life under water is a fascinating world – one
that becomes even more magical the closer you get.
The Tobago Cays’ Horseshoe Reef is such a place. This
horseshoe-shaped coral reef encloses four small islands

island’s official name is St Barthélemy. Having passed
through several different owners, the island was finally
bought by France in 1877 and is now firmly in the hands

Attended by around three million guests from all over
the world and featuring various sailing regattas and a
bustling fair, Kieler Woche is a world-class sailing event.
At the end of June, numerous tall and traditional sailing
ships, marine and sailing school boats, private yachts
and historical steamers will set course for Kiel. The
Sea Cloud ii will join the traditional tall ship parade.
Stockholm and its archipelago
On mild summer evenings, Sweden’s capital city exudes
a Mediterranean joie de vivre. Stockholm is creative and
in tune with nature, welcoming and historical, a shopping
paradise and home of the Royal Palace. Upon departure in
the morning, you will be greeted by an idyllic view of the
old town island before entering the enchanting world of the

St Petersburg – the old city of the tsars
In 1703, Tsar Peter the Great tasked the best architects
of his day with the planning of a perfect and harmonious
city. The result was one of the most brilliant cities of old

“Sail Bremerhaven” – the great windjammer festival: Oslo – Hamburg
The impressive Norwegian fjords
Over several ice ages, the incredible force of Mother
Nature carved narrow valleys in the rocks of southern
Norway, leading to the formation of spectacular landscapes: the majestic fjords. Each and every one of them
is definitely worth seeing: In the Oslofjord you will sail
past small landing stages and colourful wooden houses,
the Lysefjord boasts the impressive Preikestolen plateau, towering at an altitude of over 600 metres, and
the Hardangerfjord is adorned by a wide range of fruit
trees thanks to its mild climate.
Moster and its historic church
Having spent several years involved in Viking raids, Olaf
Tryggvason returned to Norway in the year 995 in order
to claim the throne. In the small harbour town of Moster
he held a mass, established Christianity as the country’s
new religion and had a church built on that spot. With its
square chancel and rectangular nave, the white church in
Moster is one of Norway’s oldest churches.

Kippers, cutters and launches, Viking longships and old
steamers – as we arrive for “Sail Bremerhaven”, the
Weser estuary is abound with vessels of all kinds. The city
of Bremerhaven and the art of seafaring are closely linked
by tradition. More than 250 large ocean-going sailing
vessels were built in the city’s shipyards until 1926. It
therefore comes as no surprise that this seaport hosts one
of Europe’s major windjammer events every five years.

The narrow streets of Palermo’s historic centre with their
rattling Vespa scooters and vivacious market women
lead to the impressive Norman palace. Inside it you will
find the famous Cappella Palatina. Its richness is simply
overwhelming: The erstwhile royal chapel is decorated
with elements of both Christian and Islamic style, artistic
carvings and marble floors. It contains an inner room
which is entirely covered with precious golden mosaics.

La Seu – Palma’s Gothic cathedral
In 1230, at a site once occupied by a mosque, construction work began on the famous cathedral of St Maria in
Palma de Mallorca, otherwise known as “La Seu”. Initially
built in a pure Gothic style, with spires stretching up to
the sky, this cathedral was given a few “modern” touches
over the course of the centuries. And at the beginning of
the 20th century some of the building’s interior rooms
were redesigned by none other than Gaudí.

as he set sail in 1492? It is virtually impossible to sail
across the Atlantic in the discoverer’s footsteps without
constantly considering his thoughts and ideas. Columbus
had not yet discovered the trade winds which provide
ideal sailing conditions in the westerly direction during
the winter months, but nowadays we know that they will
provide the Sea Cloud ii with idyllic sailing on its way

Through the Panama Canal to the unique natural treasures of
Costa Rica and Panama.
It took 30 eventful years for the Panama Canal to be
finally completed. In 2014, this huge construction is
celebrating its 100th anniversary and the new three-tier
lock system is also set to be brought into service. Travelling through the canal during the day is a very special
experience. Panama City is the latest top destination in
Central America and also an absolute must-see, with its
historical quarters and the ultra-modern centre creating
an appealing contrast.
Costa Rica’s and Panama’s Pacific coast:
perfect sailing waters
The Pacific coast is blessed with an abundance of natural beauty, reliable winds, outstanding anchorages, lush
green coasts and radiant sunshine. Columbus named
Costa Rica “La Huerta”, or “the garden”, and the name is
just as fitting today as it was back then.
The Coiba National Park
The Coiba National Park is one of the largest marine national
parks in the world and was declared a UNESCO World Heritage
Site in 2005. Made up of 38 smaller islands and the larger
Coiba Island, the park is home to many indigenous plant and
animal species. And as this is also the ideal habitat for marine
wildlife, you are more than likely to encounter one of the park’s
23 whale and dolphin species.

Costa Rica and Panama
On the tranquil coasts of Costa Rica and Panama, unforgettable natural scenery and beautiful relaxing beaches can be
found just a few steps away from one another. Paradisiacal
conservation areas blend into charming bays, and shady

more, if you really just want to relax, you will find the perfect
place to do so in the soft sand of Coiba, Tortuga and the Islas
de las Perlas.
The Corcovado National Park: one of the
most picturesque areas of Costa Rica
Stretching out into the Pacific Ocean, the Osa Peninsula
is home to one of Costa Rica’s unspoiled rainforests.
Gigantic trees reach up to 80 metres (262 feet) into the
air, while around 400 different species of bird fill the skies.
The forest is also home to a host of other wildlife including
tapirs, pumas, jaguars, ocelots and anteaters.
Granada –
a UNESCO World Heritage Site
Situated picturesquely at the foot of a volcano and on
the shore of a lake, the Nicaraguan town of Granada
never ceases to conjure up stunning views of the natural
and the man-made. Founded by the Spanish in 1524, it
was one of the most influential towns in Central America
for around 200 years. It is still considered an insider tip
among the region’s colonial pearls. The significance of
its historical legacy has earned it a very special seal of
approval: a place on the UNESCO World Heritage Site List.
The fascinating flora and fauna in Costa Rica’s national
parks are bound to throw up questions. Therefore, a scientist with a detailed knowledge of the region’s various

Both approx. 27 m2/290 sq ft owner
suites are located on the Lido Deck.
Their panorama windows let in a great
deal of light and offer stunning views of
the sea. The centrepiece of each room
is a romantic, four-poster king size
bed featuring two separate mattresses
(each 99 cm x 209 cm). In addition to
specially selected furniture, guests may
also make use of four wardrobes, a TV with
a DVD player (concealed behind a painting above the fireplace), a
mini-bar and a safe. In the room’s approx. 4,2 m2/45 sq ft marble
bathroom, gold-plated taps and inlays offer a nostalgic touch. Both
bathrooms feature a bathtub, a separate shower, a marble washbasin
and a WC. Owner suite No 402 is decorated in shades of orange.

All junior suites are located on the
Promenade Deck, where you will also find
the restaurant, boutique and reception.

These two de luxe outside cabins are
located on the Promenade Deck. They

204 sq ft in size, these cabins always

These Cat. E outside cabins are approx.
16 m2/172 sq ft and are also located on the
Cabin Deck. The two single beds create a
large queen size bed (180 cm x 200 cm). Of
course these cabins also feature a TV with
a DVD player, a mini-bar, a wardrobe and a
safe. A small seating area is situated next to
the two portholes, emphasising the room’s
modern maritime feel. The approx. 3 m2/
32 sq ft bathroom includes a shower, a marble
washbasin with gold-plated taps and a WC.
No 204-206 (Cat. F)
The cabins in this category are still furnished
in the traditional windjammer style: with bunk
beds (each 90 cm x 200 cm). They are mainly
suited to single travellers and are located on
the Cabin Deck. These cabins are approximately
12 m2/129 sq ft. The approx. 3 m2/32 sq ft
bathroom features a fitted shower, a WC and
a marble washbasin with gold-plated taps. The

The boutique on each yacht provides accessories, clothes
and gifts. These can be purchased on board or via the
website www.seacloudseason.de/en.
We are happy to take into account your requests in terms
of dietary requirements. Please inform us of these well
before your voyage.
Cabin fittings:
Dress code:
On all of our ships, each cabin is equipped with a direct-dial
telephone, a safe in the wardrobe and an assortment of soft
drinks, which are available free of charge. In the bathroom
you will find a selection of luxury toiletries, as well as
bathrobes, slippers and a hair dryer. Cabins on board the
Sea Cloud ii are also equipped with a television, a DVD
player and a radio.
Changes of schedule:
Even with the most meticulous route planning, changes to
the itinerary may be necessary due to weather conditions
or other unforeseeable circumstances. You will be kept
informed on board about any necessary changes.

Gratuities are not included in the cruise-only rate and
are at each passenger’s discretion. At the end of the
voyage, designated tip envelopes will be available. As a

During the day, and depending on the weather, a
sophisticated summer look is suitable. For the evening, we
recommend smart-casual wear. We also kindly request that
guests refrain from wearing shorts at evening meals. The
Captain’s Dinner (an event which normally takes place twice
on each trip – once on short cruises) is a time when our
guests tend to opt for a more elegant look. We recommend
a suit for men and appropriate smart dress for women.
The voltage on board is 220 V. Each bathroom is equipped
with a razor socket.

The languages used on board are German and English.
Daily programmes, menus and announcements will be
made in English. Depending on the group, we always
endeavour to organise German or English-speaking tour
guides for our shore excursions.
Laundry:
Our washing and ironing service is provided at an
additional charge and carried out overnight. For guests
staying in cat. A-C cabins (Sea Cloud) or cat. A+B cabins
(Sea Cloud ii), this service is provided free of charge.
Restaurant:
Massage/beauty treatments:
Smoking is only permitted on the outer decks outside of
meal times. However, we kindly request that smokers take
the comfort of other passengers into consideration.
For your own personal comfort, we provide a range of
spa services on board the Sea Cloud ii (massages and
beauty treatments at an extra charge), using the finest
products from Maria Galland.
Medical advice:
The Sea Cloud and the Sea Cloud ii both have
on-board hospitals managed by the ship’s doctor, who is
available at any time in the event of an emergency. No lifts
are available on our yachts, and guests will have to use
the stairs, therefore you should make sure you are in good
physical health before embarking on one of our voyages.
If you are unsure whether you will be able to manage the
conditions on board, please contact us. Specific care must
be agreed upon in advance.
On-board programme:
The main attraction is, of course, sailing and seafaring skills
on board our windjammers. Lecturers and artists are also
on board on selected voyages, offering stimulating talks
or additional entertainment. An on-board pianist will be
playing on both ships during our afternoon coffee service
and in the evenings. In addition, guests can borrow books
(in both English and German), popular board games, as well
as DVDs (Sea Cloud ii only).
On our yachts, you will eat in one sitting with a free choice
of table seating. Meal times are printed on the daily on-board
programme.
Smoking:
Watersports equipment:
On board the Sea Cloud and the Sea Cloud ii you
will have access to waterski facilities and snorkelling
equipment – enough for all guests and available in
various sizes. The gangway (Sea Cloud) or the swim
platform (Sea Cloud ii) offer guests direct access to the
largest swimming pool in the world: the sea. The ship’s
management team will decide where and when swimming
stops will take place; subject to weather conditions and
approval from the appropriate authorities.

Terms and Conditions of Travel of the Company
Sea Cloud Cruises GmbH in its capacity as Tour Organizer for
SY Sea Cloud and SY Sea Cloud ii
Dear Guest,
We hope that you have found the appropriate vacation trip in our programme, and
we welcome you to the exclusive circle of S ea Cloud Cruises GmbH (SCC) guests.
Please read the following
Information and Conditions
carefully so that you will know exactly what you can expect from us. The information
and conditions regulate the contractual relationship between you and us, and you shall
recognize them with your reservation. We are striving to relieve you of troubles and
worries in as far as humanly possible. The delineation of our responsibility is designed
to provide clarity regarding what you may expect and our liability.
1. Application and Travel Confirmation
1.1. Via your tour application, you are offering SCC, in a binding manner, the opportunity
to close a travel agreement. Your tour registration may transpire in writing. The travel
agreement will only become binding from the time that we confirm the reservation and
the price to you or your travel agent in writing.
1.2. The applicant is liable for all contractual obligations of other tour participants that
he registers provided that he has expressly confirmed to do so.
1.3. You shall receive a travel confirmation upon conclusion of the contract or without
delay thereafter. The confirmation shall contain all essential information regarding travel
performances you have reserved, provided that said information does not already follow
from the travel brochure.
1.4. All personal data, which you submit to us for handling your trip, is subject to the
provisions of the Federal Data Protection Act. Data will be protected against improper use.
1.5. If the subject-matter of the confirmation of the holiday deviates from the subjectmatter of the booking, then a new offer by SCC is in existence to which it is bound for
the duration of 10 days. The contract comes into existence on the basis of this new
offer if the traveller declares his acceptance to SCC in writing or by payment within the
commitment period.
2. Payment
2.1. You are required to make a down-payment of 10% per person within one week
following receipt of the travel confirmation and the invoice. The remaining balance shall
be due for payment four weeks prior to commencement of travel and before receipt of
travel documents (tickets, etc.). The entire tour price is due for immediate payment in
the event of applications made at short notice.
2.2. If the traveller is in default with a payment to SCC, SCC can cancel the contract. In
this case SCC can claim cancellation fees in accordance with paragraph 5.2.
2.3. The travel contract will be cancelled automatically if payment is not received by
the beginning of travel. In this instance, SCC will be entitled to demand corresponding
cancellation charges as compensation for damages according to paragraph 5.2.
2.4. The customer is required to bear the cost of ancillary performances, such as
acquiring a visa, etc., as well as the costs for reservations or inquiries made by telegraph or telephone.
2.5. All payments must be made directly to SCC. The travel agency is not authorized
to receive payments. Payments to the intermediary travel agency will be made at the
traveller’s own risk and will have no dept-discharging effect should the travel agency fail
to forward the payments to SCC.
3. Performances and Prices
3.1. The scope of contractual performances arises from the travel itinerary and from
the travel confirmation.
3.2. Service package
Included are:
• cruise in the reserved cabin including full board and soft drinks. Table wines are
included at meal times;
• all transfers and luggage transport mentioned in the programme;
• all overnight stays mentioned in the programme;
• all meals mentioned in the programme;
• all sightseeing tours mentioned in the programme (German or English), if not stated otherwise;
• harbour and docking fees.
The following items are not included:
tips, excess baggage, additional meals, beverages (so far as not expressly included),
optional excursions, other personal expenses.
3.3. Flights
SCC only arranges flights as intermediary if this is expressly stated in the confirmation
of travel. Carriage is booked in the Tourist Class; also in the Business or First Class at
extra tariff cost in as far as these are available. Flights on days other than the travel days
booked e.g. as a result of pre- or post-programmes can lead to extra costs. The airlines
always only accept seat reservations as non-binding wishes.
The conditions of carriage of the airlines for whose flights we act as intermediary are
binding. We shall be pleased to provide these to you on request.
Depending on the selection of flights it can happen that the outward flight is in the
late afternoon or evening, but the return flight is in the morning. There is no claim for
compensation for catering services not used at the location.
3.4. Baggage conveyance
Up to 20 kg baggage per flight passenger will be conveyed (First Class 30 kg). For travel
to some countries (incl. USA, Canada, Mexico and within Germany) measurements are
based not on the weight, but instead on the number of baggage items and their dimensions. Excess baggage can in principle be carried at extra cost. Children under the age
of two have no claim to baggage conveyance.
Please report damage or delays in delivery promptly on the spot to the relevant airline
via a Property Irregularity Report (P.I.R.). The report is a prerequisite for any liability.
3.5. Services not used by traveller
SCC shall endeavour to obtain reimbursement of saved costs from the service provider
if the traveller fails to utilize travel services due to premature return journey and in other
significant cases. This shall not apply if services are fully irrelevant or if a refund is
opposed by legal or official regulations. SCC is entitled to retain 20% of the refundable
amount as compensation for additional effort and expenses.

4. Modification of Services and Prices
4.1. A change of airline company, of aircraft or of the departure and arrival airport may
become necessary should an airline cancel a flight and e.g. in the event of failure of the
airline to comply with the flight schedule. Right is retained to effect such kind of change
or modification in such or similar instances.
Only costs, equivalent to a second class railroad journey, will be refunded in the event
of substitute transportation.
4.2. Changes in the trip’s itinerary are possible for ship voyages, e.g. in case of floodings or low water level, inclement weather conditions, governmental regulations, if the
vessel could not adhere to its schedule at the time that travel commences because of
an unforeseen technical defect that causes postponement of the trip itinerary, if the
vessel’s management alters the vessel’s course in the interest of passengers’ safety or
any other special reason related to the ship travel. In any such cases SCC has the right
to make use of other means of transportation such as but not limited to coaches and
buses for some routes.
4.3. Any such and comparable divergences from and modifications to individual travel
performances contained in the travel agreement, which become necessary after the
agreement is closed, and which are not induced by SCC contrary to the principles of
good faith and trust, are solely permissible, if they are not substantial and if they do not
impede the overall tailored style of the reserved trip.
The modified performance shall supersede the performance due under contract. Contingent claims under warranty shall remain unaffected, in as far as substitute performance
is flawed.
In the event that the overall tailored style of the reserved trip is unreasonably modified
due to said substitute performances, then we shall grant you the option to change your
reservations, free of charge, or to cancel the travel agreement without paying any fees.
SCC shall undertake to immediately inform you of any such divergences or modifications, in as far as possible.
4.4. SCC reserves the right to alter the indicated prices, which have been confirmed
on booking, in the case of an increase of transportation costs or of fees for particular
services, such as port or airport charges, bunker surcharges, insurance fees or in the
case of an alteration of the exchange rates applicable to the holiday in question, to the
extent to which this increase has an effect on the price of the holiday per person or per
seat, provided more than four months lie between the conclusion of the contract and the
stipulated date of the holiday.
In the case of a subsequent amendment to the price of the holiday or of an amendment
to an essential travel service, SCC must inform the traveller accordingly without delay,
at the latest, however, 21 days before commencement of the holiday. Price increases
after this period are not permissible. In the case of price increases of more than 5% or
in the case of a considerable amendment to an essential travel service, the traveller is
entitled to withdraw from the tourist travel contract free of charge or to demand to take
a holiday which is at least of the same value, if the tour operator is in a position to offer
such a holiday from its range of holidays at no extra cost for the traveller. The customer
must assert these rights without delay against SCC after the latter’s declaration of the
price increase or of the amendment of the travel service.
5. Cancellation, Changing Reservations, Substitute Persons
5.1. You may cancel your trip in writing at any time prior to commencement of travel.
Your cancellation notice shall become effective on the date we receive it.
5.2. If one of the parties cancels the contract or if you do not start the journey, SCC
may demand reasonable compensation for arrangements it has made in conjunction
with the trip and for its expenses, even if SCC has not yet confirmed the trip or if you
fail to begin the journey. Our flat rate claim to reimbursement consists of a processing
fee of EUR 25.00 per person for cancellation of a reserved trip up to 150 days prior to
commencement of travel. The following annulment fees shall arise in the event of later
cancellation:
• 25% of the tour price for cancellation 149 – 50 days prior to commencement of travel;
• 80% of the tour price for cancellation 14 days or less prior to commencement of travel;
• 90% of the tour price for cancellation on the same day as the commencement of travel
or failure to appear.
Costs that the service provider charges to SCC, e.g., empty bed fee charged by a hotel
for cancellation at short notice or special fees for cruises, shall be additionally invoiced
in the event that individual or group trips are annulled.
The traveller is free to prove to SCC that SCC has no loss or that the loss is less than
the aforementioned flat rate. In this case the lower proven loss will be applied in place
of the flat. SCC reserves the right to charge reimbursement fees beyond the flat rates
mentioned above.
In this case SCC has to verify and prove the loss, taking any expenses that have been
saved and/or any other potential uses for the travel services into consideration.
5.3. We will endeavour to modify the travel registration (change reservations) subject to
availability, at your request, up to 75 days prior to commencement of travel.
Any change of reservations made as of the 74th day prior to commencement of travel
will require you to serve notice that you are cancelling the reserved trip, and it will require
subsequent re-registration. This shall not apply for requested changes of reservations
that solely cause substantiated, minor expenses.
Modification of the travel date, the travel destination, accommodations or the means of
transportation shall apply as a change of reservations.
5.4. You may appoint a substitute person for yourself up to commencement of travel.
In such case you are required to inform the tour organizer thereof. The tour organizer
may object to any such substitute person on the basis of good cause, (e.g., special
requirements linked to the trip, statutory bans, refusal by airlines or by hotel operators,
etc.). If a third party enters into the contract, then he or she and the registrant are jointly
and severally liable in respect of SCC for the price of the holiday and for additional costs
incurred through the entry of the third party.
5.5. Cancellation fees and fees for changing reservations are due for immediate payment.
6. Cancellation and Rescission of Agreement by the Tour Organizer
6.1. SCC may rescind the travel agreement after commencement of travel, without
complying with a term of notice, if travellers persistently disturb execution of the trip
despite an appropriate warning issued by the tour organizer. The same shall apply if
anyone should behave in a manner which is gravely in breach of contract and justifies
the immediate cancellation. In addition SCC has the right to cancel the travel
contract without notice if in the captain’s opinion the traveller is unfit for travel due
to illness, physical disability or for any other reason or if the traveller requires special
assistance but is travelling without this assistance or if the trip has been booked based
on incorrect information. SCC shall, however, after cancellation retain its claim to the
tour price. The person causing the disturbance is liable for any possible extra cost for
return transportation.
However, SCC is required to allow credit for the value of saved costs as well as for
advantages which may be obtained from another application of services not used, including possible reimbursements from service providers.
6.2. SCC may rescind the trip up to two weeks prior to commencement of travel due to
failure to obtain the minimum number of participants if (a) the minimum number of participants in the brochure is stated as well as the point in time by which the traveller must
be informed of the withdrawal prior to the contractually agreed-upon commencement of
the travel and (b) the number of minimum participants as well as the latest date of possible cancellation are clearly stated in the travel confirmation or reference is made to the
respective travel description where such information is stated. The cancellation notice
will be immediately forwarded to you. Your paid tour price will be immediately refunded.
7. Rescission of the Contract due to exceptional Circumstances
7.1. SCC or the traveller may both rescind the travel agreement if the trip is rendered
considerably difficult, endangered or impeded due to an Act of Providence, (e.g., war,
internal unrest, natural catastrophes). SCC shall immediately refund the paid tour price
in such instance.
However, SCC may demand compensation for rendered or outstanding travel performances.
7.2. If a trip is cancelled subsequent to commencement of travel, then the tour organizer
is obligated to undertake appropriate measures, and he is especially obligated to provide
return transportation for travellers, if possible. The contracting parties shall each bear
one half of the costs for return transportation. The traveller will be required to bear all
additional expenses.
8. Liability
8.1. We shall bear liability within the scope of the due diligence of a prudent businessman:
8.1.1. for conscientious preparation of the trip;
8.1.2. for careful selection and monitoring of service providers, (e.g., transportation
corporations, hotel operators, etc.);
8.1.3. for due and proper rendering of contractually covenanted tour performances,
under consideration of applicable legal provisions of the respective country and place
of destination.
8.2. However, we are not liable for information contained in hotel and local site brochures. We have no influence on their origin. We also bear no liability if national political
conditions and contingent entry regulations change at the point of destination, after this
brochure is printed, that encumber entry into the affected country or point of destination
or which render the same infeasible. We shall inform you at short notice of any such
essential, subsequent changes, in as far as possible.
8.3. We are liable for the fault of a person entrusted with rendering a service, unless
otherwise stipulated under these Terms and Conditions of Travel or stipulated by prevailing conditions, and provided that the person entrusted to render service had caused an
instance of damage not only upon the occasion of performing contract. The measure
of indebted diligence shall be determined by conditions at the site of service rendered.
Your tour will primarily take you to foreign countries, where foreign living conditions and
where laws, that are partially foreign to us, prevail.
8.4. Scope of liability
SCC is not liable for faulty performances among mediated third party services, provided
that expressed reference is made to mediated services in the travel documents and on
the travel confirmation. Having stated this requirement, the following provisions shall
solely apply for flights for which the traveller receives a corresponding ticket:
SCC, in its capacity as a mediator, is not liable for performance of transportation services, rather the corporate carrier is responsible. SCC is not an air freight carrier. The
liability of airline companies is based on their own terms and conditions of transportation, which can be provided by SCC upon request. For all remaining purposes, airlines’
liability is restricted by international conventions and regulations, e.g., by the Warsaw
Convention and EU Directive No. 295/91 dated February 4, 1991. We will send these to
you upon request. Liability for damages caused by delay is excluded.
8.5. Warranty
8.5.1. The traveller may demand relief if the tour is not performed in compliance with
contract. SCC may refuse relief if it necessitates disproportionate expense.
8.5.2. After returning from the tour, the traveller may demand reduction of the tour price,
commensurate with reduced performance, in the event that the demand for relief was
unsuccessful and the trip was not performed in compliance with contract. This shall
not affect contingent, more extensive claims for subsequent reduction of the tour price.
8.5.3. The traveller may rescind the travel agreement if the tour organizer failed to
perform relief, within a reasonable term, or if the tour organizer formally states that relief
cannot be performed, and if the trip will be considerably impaired due to performance
of services under noncompliance with contract. If the agreement is rescinded in this
manner, then SCC is obligated to take appropriate measures, and especially to provide
return transportation for travellers, if required.
8.6. The traveller may demand compensation for damages, and more precisely for vacation time spent to no avail, provided that the tour organizer is liable for a circumstance
that caused a flaw in the tour.
8.7. Restriction of liability
8.7.1. The tour operator’s contractual liability is limited to three times the tour price,
provided that damages sustained by the traveller are not caused by intent or gross
negligence. The same applies in as far as the tour organizer is responsible for damages
incurred by a traveller solely through the fault of a service provider.
8.7.2. The tour organizer is not liable for defective performances that arise in conjunction with services mediated as third party performances, (e.g., sporting events,
attendance at theatres, exhibitions, etc.), and which are expressly identified as third
party performances in the brochure.
8.7.3. A claim to damage against the tour organizer is restricted or excluded, if – under
legal provisions applicable to required, rendered performances of a service provider – a
claim for damage against a service provider may solely be asserted under certain conditions or limitations or if such claim is excluded under certain conditions.
8.7.4. If the tour organizer assumes a position equivalent to a freight carrier, then his
liability shall be regulated by the provisions of the Air Transportation Act in conjunction
with Conventions covenanted in Warsaw, The Hague, Guadalajara and the Montreal
Agreement (solely for flights to Canada and the USA). As a rule, the Warsaw Convention
limits the freight carrier’s liability for death or physical injury and for loss and damage
of baggage. If the tour organizer constitutes a service provider, in other instances, then
he shall bear liability in accordance with provisions that apply for a service provider.
8.7.5. If the tour organizer assumes a position equivalent to a carrier, within the scope
of sea voyages, then his liability shall be regulated in compliance with provisions of the
Commercial Code and the Inland Waterways Transportation Act.
8.8. Duty to cooperate, complaints
8.8.1. In the event of defective performance, each traveller is required to undertake
whatever may be reasonably expected of him to contribute to alleviate the defect and to
keep any potential damages to a minimum.
8.8.2. If you should have reason for complaints, contrary to our expectations, then
immediately inform our tour management on site. If a respective local tour manager or
tour agent is not available or cannot be reached, or if they cannot alleviate a defective
performance, then please turn to the service provider (transfer company, hotel operator)
and/or the tour organizer or to his contact address in the area of destination. A traveller
is not entitled to claims if he culpably fails to perform the above obligations.
8.8.3. Tour guides are not authorized to formally recognize any claims whatsoever.
9. Exclusion of Claims and Statute of Limitation
9.1. Your claims are to be asserted within one month following the contractually
covenanted date of return. Claims are to be stated in writing and forwarded to
Sea Cloud Cruises GmbH, An der Alster 9, 20099 Hamburg, Germany. You may only
asset claims after expiration of the above term, if you were hindered from complying
with the deadline through no fault of your own.
9.2. All claims arising from the travel agreement shall lapse one year following the
contractually covenanted date of return.
9.3. Claims for damages due to prohibited actions shall lapse in two years.
9.4. The statue of limitations is suspended if the tour organizer initially states to you
that complaints and claims are being examined. The suspension is lifted when the tour
organizer informs the customer of the results of his examination with regard to the
customer’s claims.
10. Insurance Coverage
10.1. You are insured against transportation risk during flights, within the scope of
lawful provisions.
10.2. For your own safety, we recommend that you take out a travel insurance policy
that includes cancellation, interruption, health, baggage, accident and liability coverage.
11. Passport, Visa, Customs, Foreign Exchange and Health Regulations
11.1. You will receive essential information on the formalities required for your trip.
This information will be conveyed along with travel documents and through the travel
description contained in the catalogue. Please heed this information, as each traveller is
himself responsible for compliance with these regulations. You shall bear all costs and
the negative impact of failure to comply with said information.
11.2. Please ensure that your passport, which you will require for your trip, is still valid,
if possible for a period of six months beyond the planned travel date. Children require a
children’s passport which is appropriate to the respective destination. This information
applies for German citizens. Foreign nationals and holders of foreign passports are
requested to turn to their relevant consulate or embassy for appropriate information.
11.3. You are liable to SCC for all consequences and damages, especially penalties,
fees and expenses, that must be paid or deposited as a result of your failure to follow
applicable regulations for entry into, exit out of or transit through a country, or if in case
you have not provided the necessary documents or not provided them in the prescribed
manner. You are obliged to immediately reimburse any funds that SCC must pay or
deposit.
12. General Remarks
12.1. Printing errors and computational errors in the brochure or on the travel confirmation shall entitle SCC to avoid the validity of the travel agreement. In such instance,
SCC is required to compensate the traveller for the proven loss incurred by relying on
a declaration.
12.2. All information in our tour description corresponds to the current status of information at the time of printing.
12.3. Invalidity of individual provisions of the travel agreement shall not result in invalidity of the entire travel agreement. The same shall apply for these same Terms and
Conditions of Travel.
12.4. Oral agreements are only valid if we have confirmed them in writing.
12.5. The conditions of the respective shipowner or transportation corporation shall apply
in the event of travel by ship, combined air and ship travel, combined train and ship
travel and for bus trips. We will provide you with a copy of their conditions upon request.
12.6. German law is solely applicable to the contractual relationship between the
traveller and SCC.
12.7. The Free and Hanseatic City of Hamburg is deemed venue for courts of law for
all registered businessmen, and for persons who do not have a domestic place of
jurisdiction, as well as for persons who moved their place of residence or usual abode
to a foreign country, after closing the travel agreement, or whose place of residence or
usual abode is not known at the time that a suit is filed, and for litigation as a defendant.
These conditions of travel and cancellation terms apply in conjunction with the conditions
