PLN2012-10 Public Hearing to consider the application of Ms. Carol Whitsett, on behalf of Sedusa Studios, for a Modification (PLN2012-10) of a Whitsett, C. previously-approved Conditional Use Permit to allow a five-year extension of approval for a large fitness studio on property located at 1300 Dell Avenue in a C-M (Controlled Manufacturing) Zoning District. Staff is recommending that this project be deemed Categorically Exempt under CEQA. Planning Commission action final unless appealed in writing to the City Clerk within 10 calendar days. Public Hearing to consider the application of Ms. Teresa Lai for a Conditional Use Permit (PLN2011-253) and a Parking Modification Permit (PLN2012-44) to allow the establishment of a Commercial Child Care Center with a maximum enrollment of 192 children on property located at 430 Darryl Drive in a C-2 (General Commercial) Zoning District. Staff is recommending that this project be deemed Categorically Exempt under CEQA. Planning Commission action final unless appealed in writing to the City Clerk within 10 calendar days. Staff Report ~ Planning Commission Meeting of February 28, 2012 PLN2012-10 ~ 1300 Dell Ave. – Sedusa Studios Page 2 of 3 DISCUSSION Background: At its meeting of February 23, 2010, the Planning Commission approved a Conditional Use Permit application to allow operation of a fitness studio (reference Attachment 3 & 4 – Staff Report & Meeting Minutes). The Planning Commission’s approval was time limited for a period of two years, expiring March 5, 2012. This application is a request to extend the approval period for an additional five years. Location: The subject property is located on the west side of Dell Avenue, at the intersection of Hacienda Avenue (reference Attachment 5 – Location Map). The site abuts the Los Gatos County Park to the east and commercial buildings in the other three directions. The fitness center is located within a 7,200 square-foot commercial building on a site that shares common ingress/egress with an adjacent parcel. Operational Description: The applicant has submitted an operational description (reference Attachment 6) and other documentation that describes the operation of the fitness center. Locations: The Campbell location of Sedusa Studios was first established in 2006. It is the first of three locations for this business, which has now expanded to South San Francisco and in process of locating in Walnut Creek. Business Operation: The fitness center specializes in aerobic dance for women. The fitness center offers a variety of sessions such as pole dancing and “go-go” dancing. The center averages approximately 15 fitness sessions per week. Participants: The sessions have typically averaged eight to twelve women each, although with the economic downturn, sessions average six to eight women. Hours of Operation: The majority of the sessions are held in the evenings, Monday through Friday, between 5 PM and 9 PM, with occasional classes being held Monday and Friday mornings from 9 AM to 12 PM. The fitness studio is open Saturday for private “parties,” which are essentially private group sessions. Employees: In addition to the applicant, the studio employs three instructors. Each session is typically led by one to two instructors. Building Usage: The floor plan shows the layout of the fitness center. The use includes the primary fitness floor (as shown on the photograph to the right), an elevated stage, storage area, reception, changing room, and a boutique for incidental retail sales of fitness accessories. Application of Alka Montessori, Inc., for a Conditional Use Permit (PLN2011-316) to allow a commercial daycare center with 31 children within the former Taco Bell restaurant building on property located at 70 S. San Tomas Aquino Road. 2. Application of CCBA Hearts and Hands Preschool for a Conditional Use Permit (PLN2011-163) and Parking Modification Permit (PLN2011-220) to allow a commercial daycare center with 68 children in an existing church building (First Baptist Church of Campbell) on property located at 400 Llewellyn Avenue.
