Los Angeles County public
health officials backtracked
Tuesday on their statements
last week that at least 16
unpublicized cases of HIV in
adult film performers had been
reported to them since 2004,
The Los Angeles Times reported
Wednesday.
Despite their release of data
to The Times describing the
cases as “adult film performers,”
the county’s top health official
acknowledged that the agency
does not know whether any
of those people were actively
working as porn performers at
the time of their positive test.
Health officials also corrected
upward, from 16 to 18, the total
number of new cases reported
by the Adult Industry Medical
Foundation, a San Fernando
Valley-based clinic that serves
the porn industry, since a 2004
HIV outbreak and the revelation
last week that a female porn
performer had tested HIV
positive, the newspaper reported.
County public health officials
said they had mislabeled all
reports from the AIM clinic
as adult performers when, in
fact, information about their
occupation is unclear. Although
the clinic was created primarily
to serve the porn industry, it
serves other clients, according to
The Times.
“We have no information on
these individuals,” Dr. Jonathan
Fielding, the county’s health
officer, told the newspaper. “All
we have is the number from
AIM.”
Sharon Mitchell, the clinic’s
co-founder, told The Times this
week that none of the HIV cases
cited by the county involved
active performers.
“Here’s the bottom line: We’re
an HIV testing center,” Mitchell
told the newspaper. “We don’t
just test the adult entertainment

The battle over same-sex
marriage was on the minds of
many who attended Sunday’s
39th annual Pride Parade in West
Hollywood, which celebrated
the lesbian, gay, bisexual and
transgender communities.
Los Angeles Mayor Antonio
Villaraigosa and San Francisco
Mayor Gavin Newsom — who
could soon be competing with
each other for the Democratic
nomination for governor
— were both at the parade
and both criticized the Obama
administration’s defense of a
federal law restricting same-sex
marriage, the Los Angeles Times
reported.
“I think it’s a big mistake,”
Newsom said of a Justice
Department brief filed Thursday
in support of the Defense of
Marriage Act.
“I’m concerned about some
of the arguments being made
by the Justice Department,”
Villaraigosa said.
Villaraigosa and Newsom also
said they will seek the repeal of
Proposition 8, the November
ballot measure that barred samesex marriage in California.
“We’re going to do everything
we can, to put this issue back on
the ballot,” Villaraigosa said.
The fight over samesex marriage loomed over
the celebration of the 40th
anniversary of the Stonewall
riots in Greenwich Village that
launched the modern gay rights
movement.
Rodney Scott, president of
Christopher Street West, the
parade’s chief sponsor, told The
Times he was “deeply saddened”
by the Obama administration’s
defense of the marriage law.
“That’s not the president I
voted for,” he said.
Bill Rosendahl, a gay member
of the Los Angeles City Council
who supported Obama for
president, told the newspaper he
was “very upset with (Obama) on
everything he’s done regarding
us so far.”
White House spokesman Shin
Inouye told The Times that in
filing the brief, the Justice
Department was following its
usual policy of defending a law
on the books in court.
But he added, “The president
has said he wants to see a
legislative repeal of the Defense
of Marriage Act because it
prevents [lesbian, gay, bisexual
and transgender] couples from
being granted equal rights and
benefits. However, until Congress
passes legislation repealing the
law, the administration will
continue to defend the statute
when it is challenged in the
justice system.”
He said Obama “remains fully
committed” to his proposals on
gay rights.

At noon, the parade stopped
for a “Silent Celebration,’’ to
remember individuals who fought
for the rights of the lesbian,
gay, bisexual and transgender
communities, those who died
from AIDS and breast, prostate,
testicular or colon cancer, and
“all of our loved ones who have
passed on.’’
The West Hollywood City
Council on Monday voted to
extend the waiting period for
a property to become eligible
for re-nomination as a historic
property.
The motion, which was
the final legislative effort
spearheaded by late Councilman
Sal Guarriello, who died on April
19. It amended the city’s cultural
heritage preservation ordinance
by lengthening the waiting period
from five years to 10.
The item passed by a 3-2 vote,
with Councilmen John Duran
and Jeffrey Prang dissenting.
Guarriello called for the
revision as a way of protecting
homeowners who do not want
their homes to be designated has
historic after being nominated by
others in the community.
Challenging a nomination
is a process that involves
attorneys and consultants, which
Guarriello’s staff report labeled
as “financially burdensome.”
Guarriello said he wanted to
extend the re-nomination period
if a property is denied historic
designation to ten year intervals
to to eliminate “capricious
nominations.”
In addition, 43 properties that
have passed the five-year mark
since their initial nominations
will now have to wait until the
now-mandated 10 years have
lapsed, according to city staff
reports.
Mayor Pro Tempore John
Heilman supported the
amendment, although he added
that it still may not be the
best approach to protecting
homeowners.
“The five years of added
protection for the homeowner
is beneficial,” he said. “It may
not completely give them total

Local resident Brad Kiestler,
who’s been planting in one of
the 26 of the garden’s plots
for 15 years, said he was upset
when city officials confirmed the
news.
“This is a valuable asset to the
city and it would be a shame to
let it go after the city lost the two
other gardens,” he said.

THEATER REVIEW: DAME EDNA: 'MY FIRST LAST TOUR'
In rare form, a self-styled cultural
icon is a collaborative crowd pleaser

There is no recession of
laughter in grand Dame Edna’s
new show, “Dame Edna: My First
Last Tour.”
Dr. Barry Humphries’ alter ego
is in fine form with her in-yourface insults and spontaneous,
irreverent humor. Her raucous
brand of “stage rage” shines as
she badgers a select few audience
members and improvises her
zingers. I am sure those patrons
in the first few rows are thinking,
“Don’t choose me” as they ask,
“How many did she trample to
get to the top?”
But the jokes at their expense
provide so much laughter, that
audience members revel in
their as enabling co-stars. The
show celebrates 50 years of
Humphries’ Dame Edna’s life in
showbiz. Modestly, Dame Edna
says, “They drink at my fountain
and worship at my shrine.” And
who else but Dame Edna could
get laughter out of our present
economy?
I last saw Dame Edna Everage
at the Ahmanson in 2005 when
she did her Tony Award-winning
Broadway show, “Back With
A Vengeance.” Could she get
better? Yes. Edna has honed
her act, sharpening both her wit
and her tongue. Don’t let the
rhinestone spectacles; the purple
wig and glitzy gown fool you.
This “lady is a tramp” and her
humor is lethal and hilarious.
Her act opens with a clever
and outrageously funny montage
of clips and stills which show
how Dame Edna evolved into
her familiar incarnation. There
are images of Baby Edna with
baby “Edna glasses,” sepia-toned
photos of her growing up, marrying
Norm Everage (the Electrolux
salesman who succumbed to a
“prostate murmur”) and footage
showing how Dame Edna was
brought to fame through “failed
actor Barry Humphries.” The
video serves as an hors d’oeuvre
to a wonderful smorgasbord of
comedy and song.
On opening night, Dame Edna
marveled that the house was full
at this “little theater” despite
that it was a Wednesday night
in downtown “Los Angeleez,”
and in the middle of a recession.
She tosses her “gladdies” (her
signature flower is the gladiola)
to the audience and looks up to
the balcony and welcomes the
“downpour of disadvantaged,”
which she notes is flooded with
hedge fund managers, bankers
and friends of Bernie. “Hello
Paupers.”
Nothing is sacred as she tells of
the disciples who “flashed their
fishnets” at Jesus. After all, “the
Gospels were the Harry Potter
books of their day.” Edna — selfproclaimed psychic, self-helper
to the stars and talk show hostess
— selects five audience members
to pick on, or as she calls it, “to
empower” them with her brand
of tough love. This part of the
show is improvised and we can
see what Dame Edna does best.
Linda looks lonely and must
be single. Psychic Edna is not
thrown when Linda says she has a
husband. “Well, dear, a husband
is a form of loneliness isn’t he?”
She singles out another woman
and remarks that she looks like
she has dressed for a “special
occasion” — not this one. Her
outfit may be more suitable for
cleaning out the garage. Dame
Edna spies an 11-year-old girl
whose name is “Milan.” They
are naming children after Italian
cities. “Is there anyone named
Bologna” here?”
No one is spared. Dame Edna
has given great advice to former
President G.W. Bush who could
not find “Overseas” in the Atlas
she had given him; Queen
Elizabeth, “whose marvelous
sense of humor unfortunately
does not show on the coins,”
and Michelle Obama. She shares
her views on motherhood with
other showbiz mothers as Joan
Crawford, Debbie Reynolds and
Joan Rivers. In this segment Edna
is aided and abetted by ErinKate Whitcomb who plays her
daughter Valmai. In contrast to
the over the top bejeweled Dame
Edna, Valmai makes her dramatic
entrance in a special outfit. This
has to be a surprise so I am not
describing it. Edna gets a lot of
mileage out of her dysfunctional
daughter who gave her morning
sickness, “just this morning.”
Edna sings a delightful song
dedicated to her favorite son
Kenny, who designs her frocks,
(costumes are by John Van
Gastel and Stephen Adnitt) is
“a stewardess,” and dabbles in
antiques. If you don’t catch her
drift, you will after she invites the
audience to join in on the number
“Friends of Kenny,” which
celebrates his life as a “man’s
man.”
The five audience members are
invited up for an impromptu “talk
show” televised pilot as a white
couch and chair are wheeled onstage. Dame Edna duels with the
intelligentsia of Beverly Hills.
How could one not know if she
has an “attached” or “detached”
house? Everyone is a good sport.
And, no one knows what will
come out of Edna’s dark red lips,
even Edna herself.
The show ends on a high note.
Dame Edna closes with her
“trembling gladdies” and tosses

two hour non-stop show.

In ‘Noir,’ an actor finds
a haven for classic styles
It would be the most
understandable of mistakes to
assume that “$9.99,” made
entirely with stop-motion clay
animation, was produced decades
ago.
With the mouse and keyboard
acting as a paintbrush for most
animators nowadays, it seems
that no one outside of elementary
school plays with clay anymore.
That is, except for director Tatia
Rosenthal — who has taken
what was an outdated medium
and molded it into one charming
piece of cinematic art that
embodies the heart and sincerity
from a golden era of animation.
And my, is it gorgeous to look
at.
However, “$9.99” probably
isn’t geared toward the age
bracket that used to tune in to
“Gumby.” The film tells its
story through several interwoven
tales that take place in Sydney,
Australia, with each character
tackling personal problems and
trying to discover whether there
is something more to life.
Dave Peck (Samuel Johnson),
an unemployed 28-year-old,
serves as the narrative voice,
as he finds a book that claims
it holds the meaning of life —
which, of course, he purchased
for $9.99. As he digs into the
book’s pages, he learns a little bit
more about people and why they
do the things they do.
We meet other charming
characters along the way as
well, including a young boy
who wishes to set his piggy
bank free; an old man and his
grumpy guardian angel; a broke
magician; and a woman who
prefers her men to be completely
hairless from head to toe.
It is a storytelling formula
that’s all too common nowadays,
but in “$9.99” it is delivered well
in terms of how much contrast
there is between each character’s
story. The only cliché that pops
up is that this can sometimes
come across as yet another
philosophy-for-dummies flick,
though it’s not done so blatantly
here.
On the plus side, the writing is
so sharp, clever and honest it could
over audiences as a traditional
live-action production. Kudos
to the producers, who wanted
to tell a legitimate story in an
unconventional medium instead
of just trying to go for something
overtly gross or raunchy for
shock value.
Instead, “$9.99” tries to teach
us the importance of values that
go beyond anything monetary.
But it’s the stop-motion
animation that is the real
draw here and it is executed
impeccably. So much attention
was paid to every wrinkle, every
dimple and every other possible
detail on all characters. Even with
all of the Pixar and DreamWorks
cash cows drawing in hundreds
of millions at the box office with
regularity, “$9.99” is the product
of true and genuine artistry.
While some may dismiss
the claymation approach as
a gimmick, especially with so
many mature undertones, $9.99
wouldn’t have the same heart if
it was done any other way.
It may not have the most
original story to tell, but its
presentation carries a much
deeper message: that in some
ways, we are all made of clay
and those around us can help
mold us each and every day.

appreciation for a timeless film genre.

At a time when series about the dark side of policing have been all
but officially declared a television cliché, Kasey Wilson is turning to
the stage to remind audiences of an era when a depiction of clean, cutand-dry detective work was considered the height of drama.
Long enthralled with film noir and the fashions of the 1940s, Wilson
has written and directed “Nights of Noir,” a cover title for two one-act
noir style comedies: “Marked for Love” and “Of Dicks and Dames,”
currently playing at The Attic Theatre in Hollywood.
But it took more than her passion for classic film noir to successfully
put a fresh face on detective stories, and Wilson found that something
extra in her lead actor, Scott Gerard. As the tough-but-emotional
detective Bolt, Wilson infused the character with some qualities that
would be instantly familiar to fans of Humphrey Bogart and others
that, well, come from a more personal place.
“Bolt is more easily hurt, I think,” said Wilson. “Bolt — maybe it’s
just the romantic in me — is looking for love.”
Scott, who originally auditioned for a supporting role, knew from
the beginning that he loved the premise of “Nights of Noir.” He
says the one-acts recall an era of entertainment that showcased a real
passion for the material.
“Back then it was tongue-in-cheek humor, there was a very straight
and serious style of them, that just stays with you,” said Gerard,
who, at his director’s request, watched such classic films as “The
Maltese Falcon,” and “The Big Sleep” to prepare for the part. “There’s
something about that era that you can’t help but fall in love with,
maybe because it was so dramatic, very dry voices, the style. I think I
prefer it much more than some of the stuff nowadays.”
In studying for his role — and knowing what Wilson wanted out of
her lead character — Gerard decided to drop all potentially distracting
affectations and just play the role straight, like Bogart might have.
“These are styled noir scenes,” he said. “I have a new affinity for these
old noir films. It’s interesting how Kasey [Wilson] has combined such
dramatic pieces of writing, lighting and costumes, with very tongue-

in-cheek comedy.”
The role, it seems, has influenced the direction of Gerard’s acting
career. “I would like to find more work along these lines,” he said. “I
have found a new love for this style of roles. Rather than playing roles
in films for special effects or dramatic effects or silly gags, it’s great
when you are involved in something where you just let the writing do
the heavy lifting.”
He added: “Writers today know that to do something right, they
need to look to the past, to the classics. ‘The Maltese Falcon’ may
have not been a blockbuster, but it’s a classic and it’s what was good.
It’s the opposite for a lot of writers today. A lot of more interested in
making a blockbuster, rather than a classical film.”
As for Wilson’s production, no detail from the ‘40s is overlooked.
“Nights of Noir” will take audiences back in time to a show with a
burlesque hostess, and candy-cigarette girls walking around.
“This is a great show,” said Gerard. “I hope people will leave
the show with an appreciation of the style of the show we’re doing.
… Noir captivates the whole evening, and to that I credit Kasey’s
attention to detail … and I promise you, you’ll laugh a lot.”
“Nights of Noir” runs through June 27 at the ATTIC Theater and

A lawyer for a former
boyfriend of Madonna on Friday
chastised a West Hollywood
businesswoman who he alleges
may have used his client’s
money from a $600,000 loan
for reasons outside their original
agreement.
The attorney, Keith A. Fink,
filed court papers Monday
seeking a review of financial
documents from three of four
businesses Sandy Sachs co-owns
with Robin Gans to see whether
Chris Paciello’s funds were
used only for improvements
at the Murano restaurant as he
intended.
Paciello dated Madonna in the
early 1990s. He also has been
romantically linked to actresses
Jennifer Lopez and Sofia
Vergara, former MTV host
Daisy Fuentes and models Niki
Taylor and Naomi Campbell.
Sachs and Gans are long-time
stalwarts of the West Hollywood
gay business community.
Valerie F. Horn, Sachs’
attorney, maintains in her court
papers that the request for the
documents is too extensive and
is an invasion of her client’s
privacy. So, Fink is asking a
judge to rule in Paciello’s favor
and a hearing is scheduled July
13.
“The explanation is simple:
Ms. Sachs is trying to hide the
financial records of her other
establishments because she
knows she [allegedly] diverted
the money Mr. Paciello loaned
Murano to these other places,’’
Fink said.
Sachs’ other restaurants are
The Factory nightclub, Girl Bar
and the Fitness Factory gym.
“It is alleged and believed
by Mr. Paciello that Ms. Sachs
… has used the proceeds of the
loan made to her by Mr. Paciello
towards the operations of those
entities without his consent,’’
Fink’s court papers state.
Horn was not immediately
available for comment.
Sachs and Gans started the
litigation between themselves
and Paciello with a lawsuit
filed Dec. 26. According to the
women’s court papers, Paciello
— whose real name is Christian
Ludwigsen — told them last
June that he was interested
in investing $600,000 in the
restaurant, Murano, in exchange
for receiving 50 percent of the
company’s common stock.
A snag occurred when Sachs
and Gans learned that as a
convicted felon, Paciello could
not own stock in their enterprise
because of California Department
of Alcoholic Beverage Control
licensing rules, their suit states.
Paciello spent seven years
in prison after pleading guilty
to murder and armed robbery
in October 2000 for being the
getaway driver in a homeinvasion robbery in which Staten
Island, N.Y. housewife Judith
Shemtov was shot to death by a
Paciello cohort in 1993.
Finally, Paciello verbally
agreed to lend Gans and Sachs
the $600,000 if they agreed to
remodel Murano and re-open by
Labor Day with a chef picked by
him, according to the plaintiffs.
“[Paciello] promised to bring
such entertainment clientele into
the restaurant such as Madonna,
Jennifer Lopez and and Leonardo
DiCaprio’’ and that [Murano]
“would become the hot spot in
Los Angeles,’’ the suit states.
Although Gans and Sachs
completed the improvements,
Paciello only loaned them
$350,240, claiming he could
not provide the rest because he
was “broke,’’ according to their
court papers.
Paciello, 37, filed his own
lawsuit Jan. 15 in Los Angeles
Superior Court against Sachs,
Gans and their business venture,
Murano Ristorante Partners
Inc. The complaint has been
consolidated with the SachsGans suit.
Paciello alleges 11 causes
of action, including fraud and
deceit, breach of a written
contract and both intentional and
negligent misrepresentation.
Paciello’s suit states that he
provided the women with twothirds of the $600,000 loan
— $400,000 — and that they
promised to make him the
“front man’’ at Murano with a
management fee distribution of
half of Murano’s profits.

think any of us want to do that.”
A number of local governing
bodies made recommendations
against the amendment in the
staff report including the Historic
Preservation Commission.
In the staff report, the
commission stated there is no
need for a change to the cultural
heritage preservation ordinance
because there has only been one
occurrence that a property that
was denied historic designation
was nominated again after the
five year period.
Since the ordinance was
adopted in 1989, 157 nominations
have been brought before the
council of which 76 were denied
and 81 were approved.
The only one that was brought
back for a nomination was the
commercial property at the
former site of the Herman Miller
Showroom at 8806 Beverly
Blvd., and that was brought back
ten years after the council cast its
decision on that property.
In addition, the Historic
Preservation Commission
stated that no other neighboring
community has a waiting period
of more than a maximum of five
years.
Prang vehemently opposed
the amendment and called the
extension a “witch hunt” that is
out to vilify those who sincerely
want historic designation for a
landmark.
“I don’t think our application
process has been problematic,
we have not had abuse,” he
said, later adding: “Sometimes
we have nominations and
recommendations that people
don’t like and they call it abuse,
that’s just how the process works.
… I’d hate to see the vilification
of anyone who has an interest in
historic preservation.”
The only alteration the
council made to Guarriello’s
proposed amendment was too
include the Historic Preservation
Commission in hearing renominations because it originally
only indicated it would be the
council that would have that
responsibility.
After the vote, Mayor Abbe
Land said she wanted to pursue
revising the criteria to be
considered a historic landmark,
which she felt was the best
method to prevent “capricious
nominations.”
“I think we need a separate
conversation to look at our
standards for the application,”
she said. “I think there’s
something we can do to so that
those properties that need to get
nominated get nominated.”

lawsuit brought by Darren James,
the porn star at the center of the
2004 outbreak, said she could
not release names or information
because of privacy laws.

Supporters hope to relocate
city’s community garden

can go and have space to garden
or learn to garden,” he said, later
adding. “This is really a valuable
program that the city should be
happy to have and protect.”
Originally, the garden’s
owners, the Farris family, who
own other properties throughout
West Hollywood, wanted to close
off the garden by June 20.
But after receiving a torrent
of criticism from the gardeners
for the short notice, city officials
negotiated a later date.
Baxter said a “verbal
agreement” has been made
with the Farris family to close
the garden on Aug. 23 in order
for gardeners to have time to
take advantage of the summer
growing season and to clear their
plots.
After the closing, the city has
until Sept. 1 to wipe the lot clean,
he added.
Baxter said the owners would
prefer keeping the property clear
to make it more attractive to
potential buyers.
“They felt it would be more
marketable if a community
garden wasn’t there,” he said.
However, Kiestler said his
concerned that the Norwich
garden would remain vacant for
years, much like the community
garden at Detroit Avenue, which
was cleared out six years ago and
has remained baron ever since.
Michael Garrison, a real estate
agent and representative for the
Farris family, confirmed that the
owners do not want an active
community garden in place while
trying to sell the lot.
“We have no alternative but
to scrape the garden so there is
no threat from whoever is using
it to try to thwart the efforts of a
potential developer,” he said.
It has been the Farris, led by
its patriarch, that has owned the
land for the community garden
since it opened.
Since the mid-1980s, the lot
was leased to the city and the
city handled maintenance issues
and paid property taxes in return
for using the property as a
community garden.
The patriarch died last year,
leaving his heirs to pay a hefty
inheritance tax, which is why
Garrison said his clients want to
sell the property.
“The heirs of the family have
been instructed by their attorneys
that they have to liquidate,” he
said.
However, Garrison said the
owners are willing to sell the
parcel to the city.
In 2006, the land was appraised
for $1,020,000, which was raised
to $1,050,000 last year after the
patriarch’s death.
The city rejected the offer to
take the offer because it was too
expensive.
Councilman Jeffrey Prang
said with $60 million invested
in the 25th Anniversary Capital
Improvement projects and other
pressures on the city’s treasury,
the funds for purchasing the
community garden are not there
to be tapped.
“The bottom line is the price is
tag is too high given all the other
demands on city resources at this
time,” he said.
But the city is trying browsing
through vacant lots, including
the former community garden on
Detroit Street, in order to find a
new spot for local gardeners to
restart their plots.
“We are out actively trying
to locate other vacant parcels in
the city so we can have our own
community garden continue,”
Baxter said.
Baxter and Mayor Abbe Land
shared this information during a
meeting with the gardeners last
Wednesday.
Until the closure date, Garrison
said the offer for the city to
purchase the Norwich garden
will remain open to the city.
He added that the Farris
family would be very flexible
with the city and the residents
with the financing process or
escrow period if there was “some
movement” toward purchasing
the property.
In the meantime, Kiestler said
starting a fundraiser with his
fellow gardeners and neighbors
is most likely the only resort they
have left to turn to, although he
is not very confident that they
would be able to raise funds for
the asking price by August.
“I’m kind of disheartened
about having the garden continue
after Aug. 23, we have a limited
amount of time to get our
organizing together,” he said.
