A U.S. District Court judge has ruled that changes in
Michigan’s parole laws since Oct. 1, 1992, “as they have been
applied in practice retroactively to non-drug parolable lifers
who committed their crimes before that date, violates” the U.S.
Constitution.
Here’s a look at some of Saginaw County’s most notorious
criminals seeking parole hearing.
Marcos G.
Martinez, 55
Martinez, who had no known address,
received a life sentence for the Oct. 26,
1974, slaying of Kim S. Crawford of
Saginaw. A jury convicted Martinez of
shooting Crawford at an “after hours
establishment” on Glenwood between
Webber and Hiland. Martinez, sentenced
Nov. 1, 1979, is in the Lakeland
Correctional Facility in Coldwater.
Other mid-Michigan inmates
who could receive a hearing:
! John S. Bergevin, 68, of Bay County was convicted
by a jury of kidnapping involving a child stemming from
a May 19, 1974, incident. Bergevin, sentenced Nov. 24,
1980, is an inmate at the Saginaw Correctional Facility in
Tittabawassee Township.
! Phillip L. Lippert, 55, of Ithaca in Gratiot County
pleaded guilty to second-degree murder stemming from
a Nov. 19, 1970, incident. Lippert, who received his
sentence Jan. 26, 1971, is a prisoner at the Lakeland
Correctional Facility.
! Michael D. McLaughlin, 59, of Bay County pleaded
guilty to second-degree murder stemming from a July 3,
1972, homicide. McLaughlin, sentenced May 14, 1973, is
in the Ryan Correctional Facility in Detroit.
! Curtis Tate, 54, who listed a Saginaw address, was
convicted by a jury of kidnapping stemming from a
Dec. 10, 1974, incident. Tate, who received his sentence
June 2, 1976, is a prisoner at the Lakeland Correctional
Facility.

Behind bars since 1972 for three counts each of
kidnapping, armed robbery and rape. In
July 2004, a third three-judge panel ruled
that the 1972 life sentence that former
Circuit Judge Joseph R. McDonald
handed down to Guerrero will stand.
Guerrero pleaded guilty to the rapes;
he is in the Thumb Correctional Facility.
Prosecutors have argued his crimes
were so heinous that corrections officials
should never release him from prison.
The state Parole Board has denied
Guerrero release eight times since 1983, despite a
prison record that one Saginaw judge once called one of
the best he’s ever seen.

BAY CITY — The city and
its bridge tenders struck a
tentative deal to keep five
full-time bridge tenders on
the job through 2012.
The tradeoff for the bridge
tenders’ union is that it will
allow the city to use nonunion
seasonal workers to fill four
other bridge tender positions.
And as full-time positions
open, seasonal workers would
fill those jobs.
The Utility Workers Union
of America Local 542 offered
the compromise to head off
interest in studying privatization of bridge operations.

A Bridgeport Township
family of two is homeless
after a Saturday afternoon
fire destroyed their house.
Fire Chief Patrick B. Nelson said a state fire investigator will look into the cause of
the blaze at 2282 Madsen that
firefighters fought for nearly
five hours beginning at noon.
“We should know more
Monday,” Nelson said, add-
ing he should have a damage
estimate by then.
An elderly female and her
adult son escaped injury. A
firefighter received a shock
when he came in contact with
an active electrical outlet,
Nelson said.
“Consumers (Energy officials) said they pulled the
meter,” he said. “We thought
it was off, but it wasn’t. We’ll
be looking into that, too.”
