Proposed Rule: Animal Welfare; Retail Pet Stores and Licensing Exemptions
The English Shepherd Club strongly opposes the proposed changes to the longstanding interpretation of a “retail pet store” as described in the Animal Welfare
Act.
The English Shepherd Club is a 501(c)3 non-profit, and America’s oldest and
largest club for the English Shepherd breed.
The changes that APHIS has proposed should be withdrawn, for reasons that
include:
1.
The stated rationale for these proposed changes – that the Internet has
created a new class of “sight unseen” retail pet stores – is false. Remote
“sight unseen” retail pet stores have been common since before the
Animal Welfare Act passed more than 40 years ago. Congress would
have been aware that they existed, and yet decided not to regulate them.
2.
The proposed rule changes are contrary to Congressional intent and the
history of the Animal Welfare Act (AWA). Congress has amended the
AWA several times, most recently in 2008, yet has never changed the
more than 40-year old regulatory interpretation of a “retail pet store”. Per
the U.S. Supreme Court, this can be taken as “persuasive evidence that
the interpretation is the one intended by Congress.”
3.
APHIS has underestimated by more than a factor of 10, and perhaps a
factor of 100, the number of dog breeders who would be subject to these
proposed rule changes. APHIS does not have the resources to regulate
such a large number of breeders.
4.
The proposed rules would cause grave harm to the availability of wellbred and well-socialized dogs.
5.
The proposed rules would have a devastating impact on the availability of
the working dogs needed for national security, disaster response, law
enforcement, agriculture, the disabled, and many other critical working
roles.

The proposed rules would violate the Fourth Amendment right against
unreasonable searches.
7.
The proposed rules are at odds with the purpose of the Animal Welfare
Act, because animal welfare would be undermined if these proposed
rules went into effect.
APHIS’s Key Justification for these Proposed Changes is False
The Background section of the proposed rules includes the primary rationale for
the proposal:
The current definition of the term retail pet store was established
over 40 years ago to ensure that the appropriate retail facilities
were exempt from the licensing requirements. At that time, such
outlets were primarily hobby breeders, whose small facilities
usually pose less risk to the welfare of animals than do large
facilities, and traditional “brick and mortar” stores that were
subject to a degree of oversight by persons who physically entered
their place of business to personally observe the animals offered
for sale prior to purchase and/or to take custody of the animals
after purchase. In this way, animals sold by such traditional retail
pet stores can be monitored by the public for their health and
humane treatment. However, with the increased use of the Internet in
the 1990s, many retailers began to offer their animals for sale
remotely over the Internet and to sell and transport their animals
nationwide. As a result, today's customers are often unable to enter
the retailer's place of business to observe the animals before
taking them home. Because the current definition of retail pet store
includes all retail outlets, with the limited exceptions discussed
above, retailers selling animals by any means, including remote
sales conducted over the Internet or by mail, telephone, or any
other means where the customers do not physically enter a physical
premises, qualify as retail pet stores and are exempt from the
licensing requirements, even if they lack the public oversight
provided by customers entering their place of business.
These claims are misleading and ill informed:
1) The Internet did not create remote “sight unseen” retail sales of dogs or other
pet animals.
2) The Internet did not create nationwide shipments of dogs or other pet animals
for retail sales.
Remote retail sales involving the nationwide shipment of pets were very common
in 1966 when the Animal Welfare Act was enacted, and were very common each
time the AWA was amended. They were common 50 years ago, 70 years ago,
and 90 years ago. They were common long before the Internet was invented.
The English Shepherd Club Page 2 of 11 Throughout the 20th century, many responsible breeders sold some of their dogs
to buyers who took delivery directly from the breeder, often at the breeder’s
residence. But these same breeders also advertised, shipped, and sold many
other dogs at retail throughout the nation. The local market for their well-bred
dogs was (and still is) too small. Dogs bred by quality breeders with good
reputations were (and still are) in demand all across the nation.
Throughout the 20th century, each year many thousands of dogs were shipped
directly from breeders to final buyers. These were “sight unseen”, “remote” retail
sales of dogs.
In the first decades of the 20th century, these retail breeders shipped many dogs
by rail. In later years, air shipments became common.
Prior to the Internet, retail breeders advertised dogs for sale in national
magazines, brochures, and catalogs [1,2,3]. They advertised in national
publications because they shipped nationwide.
Even the decades-long symbol of the traditional American retailer – Sears –
advertised puppies for mail order retail sale in their catalog, as did Spiegel and
other big mail order retailers.
It’s never been the case that ALL buyers visited the premises of retail pet stores,
or for that matter, retail stores in general. Mail order retail was a way of life in
America through much of the 20th century.
More than 40 years ago one could purchase from mail order retailers pet
puppies, pet kittens, pet monkeys, pet parrots, pet toucans, pet skunks, pet
burros, pet rabbits, pet seahorses, pet ponies other pet species.
Contrary to what APHIS cites as the justification for the proposed rule changes,
there is no evidence that remote retail sales of dogs or other pets are more
common today than when the AWA became law, or any of the times it was
amended. Congress and the USDA knew 40 years ago that “sight-unseen” retail
pet sales were common, yet they chose to exempt them.
The USDA has apparently lost this knowledge and falsely believes that remote
retail pet sales are something new, a creation of the Internet.
A proposed requirement that ALL buyers must visit the premises of a retail pet
store to maintain the exemption is contrary to the well-known reality that existed

when USDA created the current retail pet store exemption rule.
The Internet did fundamentally change the retail sales market for dogs, but not in
the way APHIS falsely believes.
The main change that the Internet brought is an increase in transparency.
Through the Internet, potential dog buyers can easily search discussion forums,
blogs, websites, social networking sites, and news articles to obtain far more
information about a remote retail pet seller than could be acquired in the past
through newspapers and magazines. They can view photographs, webcams,
and videos of a breeder’s operation and dogs, read feedback from other buyers,
and easily network with other buyers. Internet-facilitated retail purchases are not
“sight unseen” just because a buyer doesn’t set foot on the premises. Quite the
contrary.
Because of this new and extraordinary ability to gather information about remote
retail pet sellers and the increase in transparency, the Internet has reduced
rather than increased any justification for inspections of remote retail pet stores.
The fundamental justification that APHIS has given for the proposed revisions to
the definition of a “retail pet store” is false. The Internet has not created a case
for more inspections. Lacking that, no valid case exists for the proposed rule
changes.
Proposed Rules Violate Congressional Intent
Congress passed the Animal Welfare Act (AWA) in 1966, and Congress
amended the AWA several times over the years. In the more than 4 decade
history of the AWA, individuals who bred and sold pet dogs and other companion
animals direct to the end buyer (i.e. retail sales) were exempt from the licensing,
inspections, and standards requirements of the AWA -- because the
USDA/APHIS appropriately classified them as “retail pet stores” under the
language of the AWA. The remote retail pet sellers (residential breeder-retailers)
that have been very common throughout the history of the AWA have always
been exempt.
If Congress had wanted these residential breeder-retailers to be subject to the
licensing, inspections, and standards requirements of the AWA, Congress could
have easily amended the AWA to make such a change, to override the USDA’s
long-standing interpretation.
Less than 10 years ago, USDA/APHIS successfully argued in federal court that
residential breeder-retailers should be exempt from the licensing, inspections,

under the AWA. A federal appeals court found in Doris Day Animal League v.
Veneman:
“[I]t is true that in the years since passage of the Act and the Secretary's adoption
of the regulation, Congress has not altered the regulatory definition of “retail pet
store” although it has amended the act three times. One line of Supreme Court
cases holds that “when Congress revisits a statute giving rise to a
longstanding administrative interpretation without pertinent change,
the ‘congressional failure to revise or repeal the agency's
interpretation is persuasive evidence that the interpretation is the one
intended by Congress.’  ” … The quotation fits this case perfectly.”
The court’s rationale continues to hold true today. Indeed, the AWA was
amended two more times since DDAL v Veneman, as recently as 2008, yet
Congress again allowed the long-standing interpretation of the “retail pet store”
exemption to stand unchanged. As the U.S. Supreme Court indicated, that is
strong evidence that Congress agrees with the existing interpretation.
The proposed new rules would massively upend the long-standing interpretation
of a “retail pet store” under the AWA, making them contrary to Congressional
intent, as the court determined in DDAL v Veneman.
APHIS Underestimated By More Than A Factor Of 10 the Number
of Dog Breeders Who Would Be Subject To These Proposed
Rule Changes
APHIS estimates that 1500 retail pet stores would lose their exemption as a
result of these proposed changes, and become subject to the licensing,
inspections, and standards requirement of the AWA.
Perhaps 1500 is an estimate for the number of unlicensed high volume
commercial breeders who sell at retail. But as written, the actual number of pet
retailers who would lose their exemption due to the proposed rule changes is
more than 10 times higher than APHIS estimates, and perhaps 100 times higher.
In DDAL v Veneman, the court ruling states: “Hundreds of thousands of dog
breeders throughout the United States raise and sell puppies from their homes.”
The court upheld USDA’s long-standing interpretation of statute that these
residential retail dog breeders are not subject to the AWA, because they are
retail pet stores.
The only way that only 1500 of these “hundreds of thousands of dog breeders”
would be impacted by the proposed change in the definition of a retail pet store is
The English Shepherd Club Page 5 of 11 if over 99% of them maintain 4 or fewer breeding females – including all of the
regulated species – or if over 99% of them sell ALL of their dogs to buyers who
visit their premises. Both of these assumptions are profoundly untrue.
One time and casual dog breeders maintain 4 or fewer breeding females.
But serious residential hobby breeders often maintain more than 4 breeding
females, especially since multiple species are included in the total. These
individuals breed as a thoughtful dedicated hobby, but they are not covered by
the useless $500 annual gross sales hobby breeder exemption in the APHIS
rules – because just one well-bred puppy typically sells for more than that.
These serious hobby breeders do health checks, performance and temperament
test their breeding stock, research bloodlines, etc. They socialize, worm, and
vaccinate their puppies.
These serious residential hobby breeders produce most of the best-bred dogs in
America, for pet homes and working homes.
A recent survey with 1446 respondents found that 28% of dog breeders have
more than 4 breeding females, and that most of them, 84%, have sold one or
more dogs to a buyer who did not visit their premises [4].
If there are “hundreds of thousands” of residential dog breeders in America as
stated in DDAL v Veneman, then this number is in the range of 200,000 to
900,000.
If 28% of these dog breeders have more than 4 breeding females, and 84% of
those have sold one or more dogs to a buyer who did not visit their premises,
then 200,000 to 900,000 * 28% * 84% = 47,040 to 211,680 residential dog
breeders would be impacted by these proposed regulations.
The number of impacted retail pet sellers is a lot higher than 1500, and it is many
times higher than the number of commercial wholesale dog breeders that APHIS
currently regulates.
USDA/APHIS does not have the resources to license and inspect 47,040211,680 currently exempt dog breeders who would be subject to the proposed
change in the definition of a “retail pet store”. Indeed, USDA made this very
argument in DDAL v Veneman, when it successfully defended in court its longstanding interpretation that these dog breeders are exempt as “retail pet stores”.
For every high volume commercial retail pet store that is targeted by these
proposed rule changes, 10 to 100 hobby breeders would become collateral
damage. Government regulations should not be implemented with such a

The Proposed Rules would Cause Grave Harm to the Availability
of Well-bred and Well-socialized Dogs
The AWA standards that regulate dog breeding were intended to address animal
welfare concerns at large-scale commercial operations. These standards
improve animal welfare compared to the subset of commercial wholesale
operations that maintained dogs in deplorable, filthy, inhumane conditions. But
these standards were never intended to apply to small-scale hobby breeders who
breed pets out of their family homes. To impose these standards on residential
retail dog breeders would be like imposing all of the standards that regulate
large-scale group residential facilities on every private home in America that has
children.
Most residential hobby breeders would give up dog breeding before they
submitted to unannounced inspections of their residences by federal employees,
or worse, to standards that require them to remove their dogs from their loving
homes and house them in sterile cages that lack any permeable surfaces. Of
those who would attempt to comply, many would be blocked by zoning
ordinances that forbid the construction of AWA-mandated facilities in their
residential neighborhood.
As written, these proposed rule changes would force tens of thousands to
hundreds of thousands of residential hobby breeders to cease breeding. The
supply of the most responsibly bred, best socialized, and best cared for dogs in
America would plummet.
The effect of these regulations would be to massively reduce the supply of the
best bred dogs for pet homes, and for working homes.
The Proposed Rules Would Have a Devastating Impact on the
Availability of the Working Dogs Needed for National Security,
Disaster Response, Law Enforcement, Agriculture, the Disabled,
and Other Critical Working Roles
America depends on small-scale hobby breeders to maintain the populations that
produce highly trained dogs for national security, for homeland security at
airports and the border, for overseas deployments to protect our armed services
members from explosive devices, and by local law enforcement to apprehend
criminals.
The English Shepherd Club Page 7 of 11 Most of the dogs used to locate victims buried in rubble after disasters, or to find
lost children or overdue hikers, are similarly purpose-bred by residential hobby
breeders.
Countless human lives are saved by these working dogs.
Likewise, the working dogs used to protect and manage livestock or to locate
pests that harm crops for the most part derive from residential hobby breeders.
Very few dogs have “the right stuff” to do these jobs. Hobby breeders who
selectively breed dogs to excel in protection sports, hunting sports, and herding
maintain the canine genetics required for these roles. Many if not most of the
breeding dogs utilized in working dog programs are pets under the law. A
fraction of the dogs from most working-bred litters are not suitable for work, so
they go to pet homes.
Most service dogs that assist disabled Americans likewise would not exist if not
for the efforts of serious residential hobby dog breeders.
The proposed APHIS rules that would redefine a more than 40 year old
interpretation of a “retail pet store” would devastate these working dog
populations, which are priceless national treasures.
It’s meaningless to claim that the proposed APHIS rules would not target working
dog breeding programs. It’s not possible to draw a bright line in this regulation
that would cleanly separate working dog breeding programs from pet dog
breeding programs. Anyone who believes otherwise is profoundly and
dangerously ignorant about working dog breeding.
It’s meaningless to bring up the hobby breeder exemption in the APHIS rules,
since the useless $500 gross sales annual limit is less than the selling price of
one well-bred puppy.
The provision in the proposed rules that would require ALL buyers to visit the
premises of exempt retail pet sellers is totally unrealistic. It would lead to an
excess of well-bred puppies in rural areas where working dog breeding
flourishes. And it would lead to an insufficient supply in suburban/urban areas
where most of the dogs produced by working dog breeding programs are
needed.

Amendment Right Against Unreasonable Searches
The Fourth Amendment of the U.S. Constitution states that we are "to be secure
against unreasonable searches and seizures."
The existing APHIS rules that regulate dog breeding operations target
commercial wholesale businesses. Commercial businesses do not enjoy the
same degree of Fourth Amendment protection against administrative inspections
as residential properties, where a greater expectation of privacy exists.
The proposed new APHIS rules would extend mandatory unannounced
inspections to the residential properties of tens or hundreds of thousands of
hobby breeders.
In Doris Day Animal League v Veneman, the federal Appeals Court warned
against:
“potential invasions of privacy that would result if federal inspectors began enforcing “cleaning, sanitation, handling, and other regulatory requirements in private homes.” In New York v Burger, the U.S. Supreme Court laid out the criteria required to
justify administrative inspections:
This warrantless inspection, however, even in the context of a pervasively
regulated business, will be deemed to be reasonable only so long as three criteria are
met. First, there must be a "substantial" government interest that informs the
regulatory scheme pursuant to which the inspection is made. Second, the warrantless
inspections must be necessary to further the regulatory scheme. Finally, the statute's
inspection program, in terms of the certainty and regularity of its application, must
provide a constitutionally adequate substitute for a warrant.
APHIS has presented a very flimsy case to justify intrusive inspections of
residential properties -- anecdotal, unspecified, un-quantified claims about
complaints from consumers or that “some consumers who purchased dogs over
the Internet had encountered health problems with their dogs.”
This is animal breeding, not a zero defect manufacturing process. Health
problems in a small fraction of the dogs sold and consumer complaints are
inevitable to some degree no matter how many precautions a responsible
breeder makes, or how many inspections APHIS conducts.
The English Shepherd Club Page 9 of 11 APHIS admits that it has no evidence that the alleged problems occur at a
greater rate among remote retail pet sellers than traditional brick-and-mortar pet
stores.
Scientific research has found that the class of retail pet stores these rule changes
would affect – retail breeders – sell dogs with significantly fewer behavior
problems than the brick-and-mortar pet stores that APHIS says do not require
regulation through the AWA [5]. So APHIS proposes to impose new regulatory
requirements upon the class of retail pet stores that sell dogs with fewer
problems, but to not impose these new requirements upon the class of retail pet
stores that sell dogs that have more problems. Facts and science cannot
support these proposed rule changes. Because Congress chose to exempt retail
pet stores in the AWA, the class of retail pet stores that sell dogs with fewer
problems should logically retain the exemption.
APHIS proposes to remove an exemption that has existed for over 40 years for
tens of thousands to hundreds of thousands of retail pet sellers, but it has
presented no compelling evidence or science-based case showing why they
should not retain the retail pet store exemption.
With the flawed and flimsy case that has been put forward, APHIS has failed to
satisfy the first and second mandatory criteria in New York v Burger. APHIS has
failed to show that warrantless inspections of hobby breeders’ home properties
further the regulatory scheme of the AWA.
In Kyllo v United States, the U.S. Supreme Court found that when it comes to
warrantless searches of the home, "all details are intimate details, because the
entire area is held safe from prying government eyes."
Likewise, the “prying government eyes” of APHIS should leave residential retail
hobby breeders alone, unless they have a court-ordered search warrant.
Animal Welfare Would Be Undermined By These Proposed Rules
Small-scale hobby breeders whelp and raise dogs in the enriched conditions that
dogs live in – within the home and its surroundings. Family and friends who visit
the home contribute to critical early socialization of puppies. Puppies and their
parents receive the love, attention, and environmental enrichment that maximizes
their welfare.

and its allies are lobbying to get egg-laying chickens out of cages, that they are
lobbying to get breeding dogs and puppies removed from their loving homes, to
be housed in cages with sterile impermeable surfaces. This would inevitably
result in fewer interactions for these dogs with their human families, poorer
socialization and less environmental enrichment.
The Animal Welfare Act cannot be used to justify this huge step backwards in
animal welfare.
Summary
The proposed rule changes have been justified on a false premise, and stray too
far from Congressional intent. They would undermine national security, disaster
response, and law enforcement. The rules would drastically reduce the number
of dogs for other working roles and as well-bred pets. They would violate the
Fourth Amendment and would undermine animal welfare. APHIS
underestimated by at least a factor of 10 the number of retail pet stores that
would be impacted. The proposed rule changes are a misguided overreach that
are unsupported by statute, and would cause far more collateral damage than
good.
The English Shepherd Club respectfully requests that Agriculture Secretary Tom
Vilsack withdraw this proposed rule change completely.
