"I think my little girl is dead"

The dispatcher on the 911 telephone at the
Brazoria County Sheriff's Office received the call
at 11:15 a.m. February 17, 1999.
The man's voice was shaking as he begged, "Oh
please! Oh God!"
The caller was Donald Chapman, explaining he
had left work and returned home that morning,
after receiving a phone call from his wife Rita saying their two-and-a-half year old adopted daughter,
Crystal Chapman, was dead.
He had difficulty relating the situation to the dispatcher, Lori Rickert. Not only was he dealing with
the horror of finding his daughter still and cold, he
was also dealing with his wife, Rita Chapman, who

was brandishing a 12-gauge shotgun threatening to
kill herself.
Rickert dispatched deputies to the Chapman’s mobile home on Wellborn Road
in the Pearland area of Brazoria County, while she continued to talk with Donald
Chapman keeping track with developments in the trailer house and radioing the
deputies.
At one point she told the responding officers she could hear the couple scuffling
over the gun, and at another she heard him cry out that his wife had just kicked him
between the legs as he tried to wrestle control of the weapon from her.
"She keeps pushing me, trying to break my hold," he told the dispatcher.
Urging him to hold on and to try to get his wife to talk to him, Rickert heard him
ask about the little girl's condition.
"Why is she like this, Rita? Rita, talk to me! Why is she like this?"
As the first deputy, Investigator Henry Wright, arrived, the dispatcher's connection with Chapman went dead.
Wright hurried to the door of the residence, where he heard scuffling inside.
Finding the door unlocked, he burst inside, where the Chapmans were struggling
over the gun.
Wright realized the woman was trying to reach the trigger to fire the weapon, so
he helped Chapman take it away from her.

Cop Killer Set To Die June 15th
HUNSTVILLE - 58-year old David Lee Powell
twice convicted of using an assault rifle to kill an
Austin police officer during a traffic stop more than
30 years ago will face the executioner June 15th.
Powell is scheduled to die for the 1978 slaying of
Ralph Ablanedo, who was hit by 10 bullets from an
AK-47. According to testimony, Powell also tossed
a hand grenade at officers. He was arrested after the
shootout and has been sent to death row three times,
most recently in 1999.
Before the shooting, Ablanedo had pulled over a
car being driven by Powell’s girlfriend, Sheila Meinert, near downtown Austin because it did not have
a rear license tag. Powell, who was wanted at the
time on suspicion of theft and passing more than
100 bad checks in Austin , was a passenger.

According to testimony, drug use had led Powell
to become so paranoid that he began carrying loaded weapons, including a .45-caliber pistol, an AK-47 and a grenade.
Evidence showed that Ablanedo was shot with the AK-47 in semiautomatic mode
as he walked toward the vehicle. According to testimony, the fallen officer tried
to get up, and Powell opened fire again, switching the weapon to full automatic
mode.
Ablanedo, 26, was wearing a bulletproof vest, but it was not designed to handle
that kind of firepower.
After a shootout with other officers, Powell and Meinert were arrested in a nearby
apartment complex parking lot. Meinert later testified that Powell gave her the grenade and told her to remove tape from it. She said she became hysterical and shoved
it back to him.
Powell’s first conviction was vacated by the U.S. Supreme Court and returned to
the Texas Court of Criminal Appeals. The state court reaffirmed the conviction and
death sentence, and the U.S. Supreme Court vacated the sentence.
He was retried and again given the death penalty in 1991. Although the high court
had reversed only the sentence, Texas law at the time required a full retrial. The
second sentence, however, was reversed by the state Court of Criminal Appeals
because of improper jury instructions.
Texas law had changed by then, and the third retrial was only for sentencing,
which prompted the latest appeal.

Time is up for killer of 12-year old girl
HUNTSVILLE - Jonathan Marcus
Green, a 42-year-old man, is due to be
executed in Huntsville June 30th. He
was sentenced to death in 2002 for the
murder of Christina Neal in 2000. His
lawyers have claimed that he suffers
from mental illness and possible ‘mental retardation’.
Christina Neal, who lived with her two
sisters and their father in Montgomery
County , went missing on June 21, 2000
after she stormed out of a friend’s house
following a fight with her sister.
At first, investigators believed Christina was a runaway. Then, searchers
found the little girl’s glasses, underwear
and jewelry on the side of the road. A
tip led investigators to a squalid shack a
quarter mile away.
Somebody had called in a tip that Jonathan Green had been over there burning trash. He had a burn pile over there
burning trash everyday since the little
girl came up missing.
It turned out their neighbor, Jonathan
Green, had buried Christina’s body then
dug up her remains and stored them inside the shack.
On July, 19th Christina’s partially
decomposed body was found by investigators searching Jonathan Green’s
home. Her body was in a bag behind a

sofa, after having apparently been removed from a shallow grave in Green’s
backyard earlier that day. An autopsy
revealed Christina had been raped and
strangled to death.
On July 15, 2002, a jury convicted
Jonathan Green of the capital murder
of Christina Neal during the course of
committing or attempting to commit
kidnapping or sexual assault.
At the sentencing phase, at which the
prosecution presented evidence of previous acts of violence by Green, the jury
concluded that there was a reasonable
probability that Jonathan Green would
commit future acts of criminal violence
constituting a threat to society, and that
there was insufficient mitigating evidence to warrant a life sentence. He was
sentenced to death.
In an appeal filed in federal District
Court in 2007, Green’s lawyers argued
that he was suffering from a serious
mental disorder and was “actively psychotic”, experiencing a variety of hallucinations as well as paranoia.
The appeal stated that Jonathan Green
was convinced that he would be set free
if only his current lawyers would present a judge with certain papers in the
possession of his former lawyers. The
appeal continued that “Mr. Green be-

said he was relieved by the court’s decision.
“The wheels of justice turn slow, but
they are turning,” he said. “To me, it’s
not final until the sentence is carried
out.”

In her decision in February
2008
Steven Scott Gaines
upholding the
death sentence, the US District Court
Judge ruled that there was no categorical prohibition on the execution of
people with mental illness under US
law, and that the claim that Green was
incompetent for execution (that he did
not comprehend the reason for his punishment) could not be ruled upon until
his execution was imminent. The US
Court of Appeals for the Fifth Circuit
later echoed this in its decision.
In 2002, the US Supreme Court prohibited the execution of offenders with
mental retardation. Jonathan Green’s
2007 appeal to the District Court asserted that he “exhibits clear signs of
subnormal intelligence”, but that he had
refused to submit to a psychological or
neurological assessment. The appeal
drew attention to evidence of possible
mental retardation – his functional il-
literacy and innumeracy, his inability to
hold menial jobs, and the fact that “after
his mother died he was unable to maintain a household. He lived in rank squalor and could not manage basic tasks
including minimal tasks of maintaining
personal hygiene”. The District Judge
ruled against the claim.
MONTGOMERY COUNTY - 26-year
old Robert Ellis Hinton, II is lead to a
holding cell in the Precinct Four Constable’s Office after being arrested in connection with the discovery of a woman’s
incinerated body in a barrel.
The body was discovered in a wooded
area of East Montgomery County according to Constable Rowdy Hayden.

lying motionless, unresponsive to what
was going on around her.
Wright was still struggling with Rita
Chapman when Deputy Stuart Rice
arrived at the scene.
Rice helped Wright restrain the
woman so he could handcuff her, but
her combative behavior continued as
they dragged her outside and put her
in the back seat of a patrol car where
she would be safe while they continued
their investigation.
Rice headed back into the mobile
home, finding that the little girl had
been dead long enough that her body
was cold.
Outside the woman continued to yell
and struggle and slam her head against
the car window.
When a deputy opened the car door,
she asked for a cigarette, becoming less
aggressive once he gave it to her.
More sheriff's deputies arrived and
began their investigation into the events
that led to the death of little Crystal
Leann Chapman.
Following the investigation Rita
Chapman was charged with capital murder. The 41-year-old woman entered a
not-guilty plea, and in January of 2000 a
jury of nine men and three women was
selected to hear her case in the courtroom of District Judge J. Ray Gayle
III.
Prosecutors decided not to seek the
death penalty in the case, noting that if
she were convicted of the lesser charge
or murder, she would be required to
serve at least 40 years in prison, without
the possibility of parole.
Crystal, who was described as a "normal, healthy and beautiful little girl,"
had been raised by the Chapmans since
infancy.
During opening statements in the
trial, Rita Chapman sobbed and covered
her ears as the prosecution told the jury
she had beaten the little girl to death.
Brazoria County District Attorney
Jerri Yenne told the jurors that Crystal's
body told the story of her brutal murder.
As Yenne prepared to show photos of
the child’s injuries, Chapman stood
abruptly and ducked into a back room
with her attorney to avoid seeing the
pictures.
In the defense's pre-trial statement,
Katherine Scardino testified Chapman
had been heavily medicated at the time
of Crystal's death, and had "behaved
strangely" both before and immediately
afterward.
Two days before Crystal's death,
Rita suffered severe back pain and
obtained three prescriptions to alleviate
it, Scardino said. It would be up to the
jury to determine whether Crystal was
deliberately killed, Scardino said.
Yenne noted, however, that a blood
sample taken from Chapman indicated
the levels of her prescriptions were
within normal limits.
Several Sheriff's deputies testified
about Chapmans uncooperative and
combative behavior at the scene.
Mental health deputy Patrick Matocha
said she told him that no one cared about
her, they just cared about her worthless
husband and the baby.
Witnesses said that later in the day,
when Rita was taken to a hospital to
give a blood sample, it was necessary
to hold her down in order to draw the
blood.
Lt. Steve Ricks described her actions
at that time as uncooperative, belligerent, hostile, and angry. He said she was
yelling and cursing.
Both Hal Hawkins, a pathologist at
the University of Texas Medical Branch
in Galveston, and Sparks Veasey, medical examiner at the UTMB testified
about Crystal's head injuries and multiple bruises.
The location and force of these injuries indicated her death was a homicide,
they testified.
Chapman sobbed at intervals during
the trial. When the prosecution played
the 911 tape of her husband's call to the
sheriff's dispatcher, she screamed for
prosecutors to turn off the tape in which
he detailed finding the toddler's badly
beaten body.
Donald Chapman, married to the
defendant for 25 years, said his wife had
been hostile to him on the day before
Crystal's death. He had stayed home
from work that day and taken the child
to the park to play.
They returned home to find his wife
still in bed, Chapman said, adding that
she was sarcastic with the child and put
her to bed as punishment for sucking
her thumb.
Later that evening he went to the
store and when he returned home she
was upset about the brand of cigarettes
he had bought. He said his wife locked
him out of the house and ignored his
knocking, so he left and drove to work.
At 10:30 the next morning, he received
the call from her saying that Crystal was
dead.
Breaking into tears as he described
seeing the child lying on her back in her
crib and realized she was cold, he said
he picked her up and ran into the living
room, trying to give her CPR while dialing 911.
During this time his wife covered her
ears with her hands, but did not cry.
He told the jury that after she ducked
into a bedroom, she returned with a
loaded shotgun, the end of the barrel in
her mouth. He described his struggle to
retrieve the gun and keep her from pulling the trigger.
The Chapman’s two daughters, Emily
Beard, 23, of Texas City, and Beth
Hairston, 22, of Santa Fe both testified
their mother had assaulted and thrown
things at them when they were children.
Although both said they still loved
her, they said they would not trust her
to watch their children.
Describing instances in which Mrs.
Chapman displayed anger toward
Crystal, Hairston said that on one occasion Mrs. Chapman almost choked the
girl by shoving scrambled eggs down
her throat.
The final witness for the prosecution
was a former county jail inmate, who
said Chapman had told her she hoped
that if she was found guilty of Crystal's
murder, she would serve only four or
five years in jail.
The defense called one character witness and two Houston doctors to the witness stand on Mrs. Chapman's behalf.
Bill Webster, a former neighbor, said
the defendant was a good mother to
Crystal, and that they sometimes played
outside. He said he had never seen
bruises on the girl.
Tom Gorsuch, a Houston psychologist, told the jury the defendant suffered
from a mixed personality disorder and
depression, had no close friends except
family, and had an element of paranoia.
Milton Williams, a Lake Jackson psychiatrist, said that from his review of
Mrs. Chapman's medical records, it was
possible the combination of medications
she was taking could cause a person to
become violent.
While the jury was not in the courtroom, Mrs. Chapman criticized her
court-appointed attorneys, Scardino and
Jimmy Phillips Jr., for not having called
more witnesses.
"I don't work for you; you work for
me," she told them.
Phillips calmed her at that time, but at
the end of the day, some six hours after
the jury had gone home for the day, she
sought to be allowed to speak in court,
claiming that three witnesses had lied
on the stand.
Denying that request, Judge Gayle
said that Mrs. Chapman "had an opportunity to testify and did not."
Closing arguments were scheduled
for Tuesday, Jan. 18, 2000, one week
after testimony began.
Phillips told the jury that even though
a child was dead that did not mean the
defendant intentionally killed the little
girl.
"It doesn't fit." He said, because
Crystal had "never been bruised like
that before."
Prosecutor Keith Allen contended
that the bruises borne by the child indicated intent, however. As pictures of the
child's bruised body were shown on a
screen, he said that "every mark, every
bruise … equals intent."
The jury found Rita Chapman guilty
of Crystal's capital murder after just
two hours of deliberation. Yenne noted
that although it was difficult to believe
that someone would beat a 2 ½ year old
child to death, she felt justice had been
done with Chapman's conviction.
Crystal's biological father read a
statement saying that Mrs. Chapman
"took away someone who can never be
replaced." The last words Crystal said
to him had been, "I love you, Daddy,"
he said.
Judge Gayle called the killing "stupid
and senseless" and added that he agreed
with the jury's verdict.
Both of Mrs. Chapman's biological
daughters said they were satisfied with
the verdict, even though they said they
still love their mother.
Today Rita Chapman is serving her
life sentence in the Mountain View prison unit at Gatesville, Texas where she
is identified as inmate number 902885. She will be eligible for her first parole
hearing on February 17, 2039 when she
is 81 years old.

DICKINSON - 29-year old Carlos Anthony Durant landed in
jail in Dickinson charged with the armed robbery of a Verizon
store. Durant hid out in Houston for awhile following the heist
but was tracked down and arrested by a contingent of police
from Dickinson, Precinct 8 Constable Jerry Fisher’s Office and
a State Trooper.

been re-elected to his third term as International Representative for the Rio Grande Conference of the Blue Knights
Law Enforcement Motorcycle Organization.
In his position Alvarez represents 1480 members, and 47
chapters in Texas, Arkansas, and Mexico .
Lt. Alvarez was the founder and organizer of the Galveston County Chapter of the Blue Knights in 2004 designated
Texas Chapter 31.
He has served as Chapter President since then and is a 22
year veteran of the Galveston Police Department.

ANGLETON - Nicholas-Michael Edwin Jean was kicked out
of the Army and was living with his mother in Pearland with no
money, no car and no job.
In need of money he called a friend and asked if he was willing
to steal cars again. The friend declined.
Two weeks later, Susana Puente De Jesus, 37, was shot to
death after being abducted during a carjacking in Pearland.

the 1993 slaying of his cell mate while
already serving two life
sentences for a previous
double murder.

fatally beating 55-yearold Leovigildo Bonal
with a belt and padlock Rogelio Cannady
in October 1993, but he
insisted the attack at the Texas Department of Criminal Justice McConnell
Unit in Beeville was self defense from
Bonal’s sexual advances.

22-year-old George Alarick Jones
Forrest Hall.
On April 13, 1993, Jones and three
accomplices went to the Red Bird Shopping Mall in Dallas to rob someone. They
forced their way into Forrest Hall’s car
as he was leaving the mall, then drove to
a secluded road in South Dallas . Once
parked on the side of the road, Jones ordered Hall out of the car, forced him to
lie face-down in a grassy ditch and shot
him twice in the back of the head. Jones
left Hall in the ditch and rejoined the
others at a nearby restaurant.
The day after the slaying, Dallas authorities recovered Hall’s car, stripped
of its tires, wheels, and stereo equipment near Fair Park in Dallas .
Within a week of the killing and during the course of another stolen vehicle
investigation, authorities recovered the
weapon used to murder Hall.
Five months later, as part of a separate
investigation, one of Jones’ accomplices
confessed to being involved in the Hall
murder and implicated Jones. Jones was
arrested and subsequently confessed.
Jones blamed his accomplice, but he
claimed he “accidentally” shot Hall once
with the gun in self-defense. Jones also
admitted that a car stereo and speakers
found in his house belonged to Hall.
At trial, a forensic document examiner
testified that Jones had signed a pawn
slip for the tires and rims from Hall’s car
at a Dallas pawn shop.
In addition to the capital murder, Jones
actively participated in at least five
other similar aggravated robberies. In
each, armed with either a handgun, rifle,
shotgun or some other weapon, Jones,
along with one or more other individuals, confronted a victim in a public place
and forcibly took the victim’s car. A surviving victim of at least one of these
robberies was shot at several times, and
another was sprayed with mace as he
used a public pay phone. The cars that
were eventually recovered had been destroyed or stripped of all their specialty
equipment including the tires, rims, and
stereos.
During one of his car-jacking sprees,
Jones and an accomplice kidnapped
and killed 20-year-old Kindra Buckner. Jones and his accomplice drove the
woman to a secluded spot, forced her
to strip naked, searched the contents of
her purse, and then shot her twice in the
head. Fearing that she might have survived, Jones and his accomplice later
returned to the scene and shot her in the
face with a shotgun. They then burned
the car to cover their tracks. The Buckner murder occurred five months after
Jones car-jacked and killed Forest Hall.

main drag and there they stay until donations totaling $300 each are collected from
supporters and passerby’s. In May donations totaled $4002 in four hours. The
money benefits Special Olympics.

WEBSTER - Webster police are looking
for Johnnie Lee Frazier
who they say has pawned
equipment,

an air compressor and
a paint sprayer that was
stolen from a job site.
Johnnie Lee Frazier has been charged

also has a warrant for his arrest on a
motion to revoke his parole. Officers
attempted to arrest Frazier in January
but he fled his home before he could be
arrested.
He has continued to pawn equipment
in and around the Houston area. He is
known to carry a gun and should be considered armed and dangerous.
