r j \. l l Meeting September 13, 1965 Meeting Opened Page 225 The Board of County Commissioners met in their room in the Court House Annex on Monday, September 13, 1965. Commissioners John H. Talton, F. B. Surguine, Jr., James T. Cooper and Cliff R. Freeman; James Meade and Ed Nagel; Banner were present~ County Attorneys Clerk Arthur W. Newell and Deputy Clerk D. S. There being a quorum, the meeting was called to order by Chairman T _a lton at 9:30 o'clock A. M. The invocation was given by Rev. B. Harrison Taylor. Minutes Proposed University Area Planning The minutes of the September 7, 1965 meeting were read, approved and signed. Mr. W. E. Fulford, Chairman of a Committee appointed by the Planning and Zoning Com'mission to' study the area near the University Site, and Planning Director Don Greer appeared before the Board and presented their recommendations for Board information. They displayed a large map and pointed out various areas. as same were discussed. are summarieed below: ~n brief, the recommendations , I 11 I> 1. Provision of access roads to the University and surrounding territory; (a) Hall Road should be the first priority and should be extended from Alafaya Trail to Lake Barton Road. (b) Alafaya Trail should be. improved as warranted by traffic demand. (c) Further study should be given to development of McCullpch Road as a State designated facility. In the interim, consideration should be given to extending McCulloch Road east to North Tanner Road. 2. Recommended remedial action be taken in order to protect the area around the University site. Considerable area within one to two miles of the University site is presently zoned A-2, R-1 and R-2, and is bounded by Rouse Road on the west, State Road 420 and North Tanner Road on the east, Seminole County on the north, and State Road 50 on the south. This area should be reand "estate" zoning classification be developed in parts of area. zoned R-1-A/ The University site itself should be considered for rezoning to R-3. 3. Recommended that a Land Use Plan be adopted in the form of a policy statement, for this area. Mr. Fulford stated that the Board of Regents want protection in this area. Meeting September 13, 1965 Page 226 The Planning and Zoning Commission will have to take the whole area, probably in three sections, for rezoning. The Board. expressed interest in making the University site an outstanding example for other universities. Tax Assessor No action was taken on the recommendations. Bill Ford, Assistant Tax Assessor, appeared before the Board and reported instead that pf 121,000 parcels to be re-assessed, they had 141,000, and that they will need an increase in their budget of $8,500 to pay Howze around $6,000 extra and the balance for overtime for employees working on the re-assessments. He was advised to make his request to the Budget Commission. Agreement Tavares and Gulf Railroad Co. Upon motion 'by Commissioner Freeman, seconded by Commissioner Surguine, and unanimously carried, the Chairman was authorized to execute the Agreement between Tav~res and GuH Railroad Company and Orange County to lay, maintain and operate under the tracks and property of the Railroad a 72 inch reinforced concrete, gravity flow storm water drainage pipe in or near Winter Garden accord_ing to drawing attached to the agreement. Apprai~al - Robinson Property Upon motion by Commissioner Freeman, seconded by Commissioner Surguine, and unanimously carried, the County Right of Way Agent was authorized to obtain an appraisal on the Robinson property at the intersection of 441 By-pass and Silver Star Road. Lake Level Hearings The Board scheduled the following lake level hearings for the afternoon of Sept~ml;>er 30th: 2:00 P. M. - Lakes Druid, Cay-Dee and Shannon 3:00 P. Buchanc In parcel of right of way for the Hall Road extension, and further, statement from James J. Bettes in the amount of $40. 00, covering said appraisal, was approved for payment. Half-Pint Football Pr-ogr_am. Upon motion by Commissioner Co~per, seconded by Commissioner Freeman, and· unanbnous·cy carried, payment in the amount" of $400. 00 was authorized to be made to the Orlando Amateur Athletic Association covering the ·county's portion for the Half Pint Footfuall Program , same to be paid from the 1965-66 Budget. Howard C. Kaufold Upon motion by Commissioner Surguine, seconded by Commissioner Freeman, and unanimously carried, payment in the amount of $50. 00 was authorized to be made to Howard C. Kaufold covering services rendered in connection with the processing of claims before the Board of Equalization. Petition to Abate a Nuisance The Board received a petition signed by seventeen persons to abate a nuisance at the intersection of South Orange Blossom Trail and 18th Street created by Clarence C. Lance and Sarah Lance d/b/a Lance Metal Arts, as they are conducting a public and private :nauiSam.ne in that they are operating an unenclosed junk yard which is odious, offensive and unsightly. The petition was referred to the County Attorney and the Zoning Commission. , Appraisal Jaffa Parcel Upon motion by Commissioner Freeman, seconded by Commissioner Cooper, and unanimously carried, statement from Lawrence Condict in the amount of $100. 00 covering appraisal on the Ethel E. Jaffa, et al pl:operty was approved for payment. County Convict Camp Upon motion by Commissioner Cooper, seconded by Commissioner Freerri.an, and unanimously carried, Colorcrete Company was authorized to repair cracks and apply two coats of Colorcrete to the County Convict Camp bJi~g at a cost of $600.00. M., Thursday, October 7, 1965 Long Road Mr. Bob McCauley, resident at the corner of Clarcona and Long Road, appeared before the Board stating that Long Road was now being used as a drag strip, and he asked that speed limits be established on said road. Chairman Talton asked the Superintendent of the Road and Bridge Department to make a survey of this road, and make recommendations on same. Bailey, 703 Nicoma Trail, Maitland, appeared before the Board requesting that the word 11 Hills" be stricken from t4e : B<?a.r.d 1 S Resolution on their petition for a . Fire Co.ntrol District as they felt the word was misleading and should not have been included in their petition. Upon m<?tioz:t by Commissioner Evans, seconded by Commissioner Surguine, and unanimously carried, the Board overru~ed the Planning and Zoning Commission and granted the request for change of zoning from A-2 to C-1, and the Board made the following findings of facts: 1. Meeting Opened Notice having b~en published on August 26, 1965 and September 2, 1965 in the ' Orlando Even~ng Star that the Board of County Commissioners would hold a public hearing at 2:00P.M. in the County Commissioners' Room to hear from all interested parties on the designation of all primary water conservation and control facilities in the Wekiwa Basin, Little Weki\va Basin, Little Econlockhatchee Basin, Howell Branch Basin, Shingle Creek Basin, Boggy Creek Basin, St. John's River Basin, Big Econlockhatchee Basin, Reedy Creek Basin, Cypress Creek Basin, Lake Apopka Basin, Lake Hart and Lake Mary Jane having arrived, the C~erk Bas~ns, the hour read the notice, and proof?.£ publication of which was ordered filed. Public Hearing Chairman Talton outlined the purposes of the meeting, stating that first we would discuss the water sheds and how they affect people in Orange County, and then go on to discuss th~ proposed $25,000,000 Bond Issue. He called on Mr. Andrew Bergstro:rp., Chairman of the Water Advisory Committee to give the recommendations of the Committee . covering the primary water conservation and control facilities to be designated by the Board of County Commissioners, Chairman Bergstrom stated they were here today first, to officially and legally I ! designate the Primary Water Control System for the entire County, and second, to designate the projects to be completed under the $25,000,000 bond issue. He .. then called on Consulting Engineer A. E. O'Neall to give a schematic run down on the entire primary system in Orange County. Mr. O'Neall discussed the twelve .. Drainage Basins, and the recommended facilities for each Basin. He pointed out I the drainage basins on a large map, stating that no work is proposed in four of the Basins at this time. In eight of the Basins they have proposed work of some type. County Engineer Fred De Witt outlined the facilities, pointing the same out on a large map and several supplementary maps and exhibits, and explained the proposed changes since the last public hearings on such designations. Marks, 42 Lake Drive, asked what provision had been made in the Howell Branch Basin to take care of the Lake Killarney problem, and the County Engineer explained in detail how same would be }:landled. Mr. Otto Witt, 2136 N. Dean Road, stated that they are within 1/4 mile of the Econ area and asked what effect projects in this area would have on the.i r wells. He was informed that the wells would neAt ll>e contaminated, and that the water table in the area might rise 1/2 inch. Mr. DonRyb.olt, Rt. 4, Box 404, read a long prepared statement expressing the position of the Supervisors of the Orange Soil and Water Conservation District on this program. I• 1.: ~esire the statement outlined their opinions on each l I watershed. - Chairman Bergstrom stated that the Water Advisory Committee fully appreciates the comments made by the Soil Supervisors, stating that he thought with great honesty he could say that at one time or another most of the things \ ~ commented UJ>On had been discussed by them. M. i!l the County Commissioners' office wit~ ', the Supervisors. Commissioner Freeman stated that he would like a lake near Lake Ponder included, stating it was a four or five acre lake. Mr. John Land stated he would like a pond near Lake McCoy and Buchan Pond included. ' ' J Chairman Bergstrom que.stioned the wisdom of making alterations, stating J . . . that if something was added, it would have to be taken out somewhere else. Mr. Bob Wagner discusse_d the b<;md _issue, stating that the -County _may or may _n ot have surpluses. But under the bond resolution only projects designated could be constructed. I I After further . discussion, it was agreed that the final designation of funds ' for each Basin not be made until Monday, September 20, 1965. I l Mr. Jake Braswell, 714 Palmer Street, asked if the ballot would include the amount of money to b~ spent in each basin so that funds cannot be switched. County Attorney Dave Hedrick stated he would recommend that they put the $25,000,000 bond issue on the ballot according to the resolution passed by the Board. He stated, that it would be done according to the resolution, and it is not contemplated that there will be any change within each Basin unless there is a surplus. Michaels, Engineers, and A. E. O'Neall Associates, Inc., Engineers, on the Eight Dr~inage Ba?ins, and Supplement No. 1 to the Howell Branch Basin, and all revisions thereto, copies of which had previously been filed with the Clerk of the Board of County Commissioners as a~ended and supplemented by the doc~ments and exhibits since filed with the Clerk and the oral explanations of the facilities in the Lake Mary Jane and Lake ~art. Basin and the Big Econlockhatchee River Basin given by 1:fr. DeWitt, be designated as primary water conservationand control facilities. Maitland School Property Upon motion by Commissioner Evans, seconded by Commissioner Surguine, and unanimously carried, the Board adopted the following resolution: "BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS: 1. That the Board of Public Instruction be requested to grant a 60 foot right of way through the Maitland School property from the south entrance to the school grounds in a northeasterly direction to join to Thistle Lane; 2. That the actual alignment is to be surveyed by the County Engineer to avoid muck or swamp area; 3. That Orange County grade and stabilize the road as soon as practicable; and 4. That inasmuch as the 1965-1966 budget has been compiled and no funds are available for paying at this time, that the Board of County Commissioners make every effort to budget funds for hard surfacing the road in the .1966-67 Budget. 11 There being no further business, the meeting adjourned.
