President’s Message

I just celebrated my
birthday. Invariably, someone
asks, “What do you want for
a present?”. As I get older I
have a harder time coming up
with an honest answer to that
question. When I was 10, the
list was endless, I’m still
waiting for my pet lion. At 16,
my Magnum P.I. 308 Ferrari never materialized
in my driveway. During the lean college years,
cash was the perfect size and color, and was
readily converted into weekend libations. But
now that I have a family, house, car, and my own
income, I find that it is very difficult to find
something “I want for my birthday”.
I get the ties for Father’s day, socks at
Christmas, and chocolate on Halloween. Those
of you who know me are aware of the fact that I
have most of the new “gadgets” so my iPhone
can sync with my iPad and then make a free call
to China while tracking my children’s
whereabouts via encrypted GPS. So, this year, I
decided to do something different, something
that makes me feel good without adding to the
clutter of my closet or garage. I signed up for a
5K race with the American Cancer Society and
asked my family and friends to sponsor me in
the race in lieu of presents.
need, I am giving a person in need a chance at
life, the chance to beat cancer and spend many
more birthdays with their families and loved ones.
I hope that through my and thousands of others’
efforts, donations and involvement, people who
are diagnosed with cancer will have to
contemplate the question, “What do you want for
your birthday this year?” for many years to come.
I can guarantee that 100% of you will (over
the next year) have the opportunity to celebrate
your birthday. And most of you will be asked,
“What do you want for your birthday”.
I
challenge you to find a cause, program or charity
that makes you feel good and have your friends
and family support them in honor of you getting a
little older. Being a lawyer is stressful, tedious
and often times contentious; let’s not forget what
is really important. Together, we'll save lives,
change the world and make each subsequent
birthday that much more special.
As lawyers, I believe that we all have a duty,
obligation, responsibility, commitment, (you pick
the word) to do more for our community by
getting involved and helping those people who
would benefit from our expertise, training, and
chosen profession. In trying to reach out and do
more for my profession’s image, I have
registered for a race for the cure to cancer. So
on October 20, 2012, along with hundreds of
other folks, I will participate in the Put On Your
Pink Bra – American Cancer Run to find a cure
for breast cancer. That way, as I celebrate my
birthday by running further than I would like to, I
am proud of the fact that there are 2.5 million
breast cancer survivors who celebrated another
birthday this year, because my friends and family
are supporting the American Cancer Society.

first meeting on August 8th and
planned out events and
activities for the year.
Our
August Happy Hour at
Chaparall Mexican Grill was a
huge success. We collected an abundance of
donations of school supplies for the Children’s Home
Society Back to School Drive. Board member Gracie
Heim and I made a visit to the Children’s Home
Society to deliver the donations, and they were very
appreciative.
The Young Lawyers Division will host two major
events in September. The first is our quarterly
Beach Cleanup, which will take place on Saturday,
September 8, 2012 at 10:00 AM at Bicentennial
Beach Park located at 1877 SR A1A in Indian
Harbour Beach.
We are hoping to involve a
significant portion of our membership this year, and
we will provide free YLD t-shirts and a barbeque to
all participants.
Our second event of September is our Happy
Hour which will take place at Off the Traxx, located
at 918 East New Haven Avenue in Melbourne. We
will be taking donations to improve the inmate library
at the Brevard County Jail Complex. We are looking
for donations of copy paper (to help with the printing
of legal research) and educational books (such as
Spanish-English dictionaries, Alcoholics Anonymous/
Narcotic Anonymous books, and high school level

Brevard Bar Foundation

Greetings. I have the privilege,
once again, to be President of the
Brevard Bar Foundation. We have
come a long way in the last several
years as a Foundation. We have
initiated, and have a substantial
amount of money in an endowment
founded by contributions, among
others, from, O. John Alpizar, Esq.,
the endowment’s name sake, the Brevard Bar
Foundation, Stephen Charpentier, and, most recently,
a generous contribution from Dr. Stanton Cooper, a
distinguished area chiropractic physician.
The main purpose of the Bar Foundation is to
enhance public opinion of attorneys. The Foundation
does this in many different ways. We contribute to the
Brevard County Bar Association.
Annually, we
contribute to the Florida High School Mock Trial
Competition, Brevard County Legal Aid and the Law
Day Program.
We contribute to local charities. In the past, we
have contributed to the Brevard Alzheimer’s
Foundation, Brevard Association for the Blind, Brevard
Rescue Mission, Brevard Schools Foundation, Sally’s
House, Yellow Umbrella, Red Cross, Sharing Center of
Central Brevard, Rolling Readers Space Coast Inc.,
Candlelighters of Brevard, Promise in Brevard, as well
as others.
Another way we enhance public opinion of
attorneys is through different programs that we
sponsored this past year. We had our Third Annual
Golf Tournament, headed up by Steve Koons, former
Brevard Bar Foundation President. We also had our
First Annual Bowling Tournament, which was
remarkably well attended and a lot of fun. Our newlyappointed Board Member, Mario Musil, did a fantastic
job in putting the tournament together. We also
continued our sponsorship of
the Space Coast
Community Law School, led by Britta Hawkins. The
Law School gives the public the opportunity to take
courses that are topical in the law and features lectures
from prominent attorneys and judges. We also hosted
our first CLE, put together under the leadership of
Brooke Deratany Goldfarb and Ed Kinberg, which was
very well received. So last year was an active year
and these programs will be continued this year.
This year, also, we will be hosting our fourth
annual dinner, at which we will be honoring as the
recipient of our second Community Leader of the Year
award Dr. Jim Richey, President of Brevard Community
College. The dinner will be on October 4, 2012. Please

Also, the Brevard Bar Foundation will be a
sponsor in Florida Institute of Technology’s first
Lecture in Law which will occur on September 27th
and will have as its inaugural speaker United States
District Court Judge John Antoon, II. The lecture will
take place in the Hartley Room on the Florida
Institute of Technology campus located on the 2nd
Floor of the Denius Student Center. Late registration
and check in will begin at 6:00 p.m. The reception
will begin at 6:15 p.m. with the lecture commencing
at 7 p.m.
So, it is with great anticipation and excitement
that I once again become President of the Brevard
Bar Foundation. My goals are simple: to continue the
programs that we have started; to raise further
monies for the O. John Alpizar Endowment in order
to continue to fund local charities; and to increase
membership. Please come join the Brevard County
Bar Foundation in its effort to enhance public
awareness of the contribution, both monetary and
otherwise, of Brevard’s attorneys to the community.

meet this very friendly, down-to-earth, and intelligent
fellow attorney.
Member Spotlight
Meet J. Patarick Anderson

J. Patrick Anderson, of Frese
Hansen, is a board- certified tax
and business attorney. He was
born and raised in the chilly regions
of Minnesota and Syracuse, New
York. When he was 15, he moved
to Palm Beach County.
His
undergraduate degree from Florida
Atlantic University was in psychology and, for about 6
years, he served in the mental health field, as a
counselor and then as a probation officer. During this
experience, he became interested in the law and
decided to pursue law as a career.
He earned his J.D. from the Nova Southeastern
University Shepard Broad Law Center and his L.L.M.
at the University of Florida, where he met his future
wife, Laura Anderson, another of our BCBA
members. Patrick worked his way through law
school, clerking at several South Florida law firms.
He and Laura studied tax law next to each other in
the carels of the library and, after Laura moved to
Atlanta for a job, Patrick decided that he couldn’t let
her go, so he too went to Atlanta to work. After they
got married, they moved back to Florida. They have
practiced law together at the same firm for 22 years.
Patrick and Laura have two daughters, Katie and
Abby. Patrick is unable to avoid returning to the
frosty climate of Syracuse, because Katie attends the
University of Syracuse, where she is studying musical
theater and aspires to be a Broadway star. She is
quite talented, having played Evita in “Evita” and
Peter Pan at the Cocoa Village Theater. Apparently,
Katie received her musical talent from both of her
parents – Patrick having played the guitar for 40
years and Laura having been a voice major at Florida
State. Abby is a Senior at Viera High School. As a
consequence of her passion for animal rights, Abby is
a devout vegan and has converted her sister and her
parents.
Patrick and Laura spend much of their free time
traveling. In fact, their vacations often center around
bicycle tours. They have biked in Oregon and
throughout
Europe,
including
Belgium,
the
Netherlands, Luxembourg, and France.
Patrick
particularly enjoys riding in Belgium and the
Netherlands and stopping at pubs along the way,
where the beer is quite good. He cautions, however,
that bicycling in Amsterdam can be perilous.

If a boating-under-the-influence charge is
amended to a reckless-boating charge, I guess there
is no way around it being a wet reckless.
DENIED WITHOUT MERIT
It is one thing to deny the motion to suppress,
but to say there is no merit to the motion seems
unnecessary. Just “DENIED” is fine. “DENIED
WITHOUT MERIT,” not so nice. And if the Appellate
Court should overturn the DENIED WITHOUT MERIT
on appeal, should the appellate court say:

UNANSWERED PRAYERS TO THE COURT
It’s always interesting to read a motion where
one side says, “We pray that the court grants our
motion.” It seems only appropriate in those situation
that the opposing party respond by saying, “They
don’t have a prayer,” and we respectfully request that
the court, “not answer their prayer.” ORDERED AND
ADJUDGED that the Plaintiff’s Prayer goes
UNANSWERED.
ORDERED AND ADJUDGED
Isn’t it redundant to say ORDERED AND
ADJUDGED? Wouldn’t one suffice? Aren’t both
words a case of overkill?
SHE’S GONE POSTAL
Every time I hear the song, “She’s gone
Country,” I think there should be a song sung to the
same tune that goes, “She’s gone Postal…”
GOING SOMETHING OTHER THAN POSTAL?
Can a Fed Ex employee go postal? Or does it
have to be called something else? Like, “He went
Federal?” What about a UPS employee? “She’s gone
Parcel?” "I'm sorry, sir, but you can't go postal, you
work for Federal Express."

A SENTENCING HEARING ACCEPTANCE
SPEECH FOR LIFETIME ACHIEVEMENT IN CRIME
Judge: I sentence you as a Violent Career Criminal to
life imprisonment.
Defendant: It is an honor and a privilege to be here
today and accept your sentence. It has been a long
tough road, but through hard work and perseverance
I have been able to enjoy a wonderful career in crime.
To be recognized as a Violent Career Criminal is
more than I could have ever hoped for. I’d like to
thank my mother and father for the bad genes they
passed down to me, and the poor environment they
provided me with. I’d like to thank my many attorneys
who didn’t do a damn thing to help me. The
prosecutors for prosecuting me, your Honor for
sentencing me, and the clerks for memorializing this
day forever. Finally, I’d like to thank the police officers
who arrested me without whom I would not be
accepting this award and to God for not listening to
my prayers. I accept this award on behalf of all my
brother and sisters imprisoned by this Fascist country
we live in. God Bless!
ENDORSEMENT IN BLANK OR FINDERS
KEEPERS LOSERS WEEPERS
OR HOW TO BEAT YOUR FORECLOSURE TIP #1
When a bank forecloses on a person’s house
and it is a different bank than the one the person
signed the promissory note with, the new bank claims
that their physical possession of the note that says,
“Endorsement (in blank, meaning to no one),” but
signed by the bank who originated the note proves
that the new bank now owns the note. An
endorsement in blank means whomever has the note
in their hand owns it. But it has to be the original note.
It’s like finding a signed check that is made out to no
one. Whoever possesses it can cash it. So the trick is
to get your hands on as many of these notes as
possible. Especially if the note is for your own house.
So search for those notes. Walk through the bank and
or the lawyer’s offices of the people foreclosing on
you and grab the note off their desk or in their filing
cabinet or anywhere else you can find it. In fact, when
the Bank files the original note with the clerk’s office
anyone who takes it out of the file is now the owner of
the note. It won’t be considered a theft ,since the
endorsement is blank. You can legally say, “Finders
keepers, losers weepers.”
Another neat trick to try when the Bank's
attorney is getting ready to introduce the blank
endorsed note into evidence is for you ask to take a
look at it (which you are always allowed to do to make
sure it is what the other side is claiming it is), and
then, once you have it in your hand, don't give it back.
Then say, “Gotcha!” Because now you own the note
and they can no longer foreclose on your home.

THE LOST AND FOUND PROMISSORY NOTE OR
HOW TO BEAT YOUR FORECLOSURE TIP #2
The banks can’t find the original promissory
note, and without it, they cannot foreclose on your
house. They can’t find it because they’re the third or
fourth bank that supposedly received it. So the last
bank to receive it files a motion to re-establish the
note it lost. Even though it’s not clear that it ever was
theirs to lose. Then they mysteriously find the original
note and withdraw their motion to re-establish the
note. I think one of the ways to find a lost note is to
look in the lost and found of all the banks who
supposedly had possession of the note. And, maybe,
you’ll find it before the bank. Just go to all the banks
and ask to look in their lost and found (don’t tell them
what you’re really looking for, say a watch or a piece
of clothing) and, who knows, you may get lucky and
find your note. And, since it will be endorsed in blank
once you find it, it’s yours, and you can keep your
house.

damage attributed to not wearing a seatbelt. Or
perhaps more appropriately compared to the “Helmet
Defense,” which suggests a person on a motorcycle
who is in an accident while not wearing a helmet could
have his or her damages reduced in a civil suit against
the person who hit them, by the amount of damage
attributed to not wearing the helmet.
Proof of Kosher Kill: Opposite of Proof of Life. When
a Jewish person orders kosher food online, a DVD of
the animal being killed in a kosher way (knife to the
jugular vein) along with the DNA of the animal is sent
with the food to verify that the animal killed kosherly is
in fact the same animal ordered.
One-Hitter: 1. A paraphernalia pipe for smoking
cannabis that is only good for one-hit after being lit. 2.
Disposable paraphernalia. (Similar to a disposable
razor.)
BUT NO MORE THAN 100% OR MORE EXAMPLES

WRITE STATUTES
903.28 Remission of forfeiture; conditions. 1) On
application within 2 years from forfeiture, the court
shall order remission of the forfeiture if it determines
that there was no breach of the bond. (2) If the
defendant surrenders or is apprehended within 90
days after forfeiture, the court, on motion at a hearing
upon notice having been given to the clerk of the
circuit court and the state attorney as required in
subsection (8), shall direct remission of up to, but not
more than, 100 percent of a forfeiture….
Maybe it’s me, but how would the surety ever be
entitled to more than 100 percent of the forfeiture.
“Hey, since you paid the bond for the Defendant’s
failure to appear and he was apprehended within
ninety (90) days we’re going to give you more money
back than you paid. It’s a tip.” Perhaps the statute
should remove these words: but not more than...
Really, who writes these statutes?
NEW ADDITIONS TO THE LEGALLY BALD
DICTIONARY OF WORDS, PHRASES, AND NONLEGAL HOLIDAYS
Condom Defense: An affirmative defense used by
men who are sued by women for giving them a
venereal disease or women who are sued by men for
giving them a venereal disease. Or if either party is
charged with violating Florida Statute, 384.24. The
argument is that, since the male was not wearing a
condom, he or she assumed the risk of catching a
disease and no action should lie either civilly or
criminally. Similar to the “Seatbelt-Defense.” In civil
cases when a person sues for damages in an

Fifth DCA E-Filing
On the Move!
Beginning September 1, 2012 the Fifth District
Court of Appeal will offer email service of all
acknowledgment letters, orders, opinions and
mandates through its eDCA Case Mail (email)
service. To receive documents electronically from the
court, an attorney or non-attorney party must have

Please note the following changes:
From September 1, 2012 and until October 1,
2012, the court will send both paper and email
documents. Beginning on October 1, 2012, service of
all letters, orders, opinions and mandates will be by
email only except to pro se parties who are not
registered and attorneys who have requested and
obtained a hardship waiver from the court.
Also beginning on September 1, 2012, those
documents currently required to be emailed by
Administrative Order 5DAO08-0 may be filed
electronically through eDCA and not emailed to the
court. If electronically filed, a document should not
also be filed on paper; however, if the document is
filed on paper, compliance with the email requirement
of 5DAO8-01 is still required.
A copy of the
administrative order can be found on the court’s
website.
Beginning on October 1, 2012, electronic
filing of these documents will be mandatory and
paper filings will no longer be accepted.
Registration is required before electronic filing of any
documents. The court will not accept any documents
other than those listed in 5DAO08-01 electronically
until further notice.
Complete information and instructions about how
to register and how to use eDCA may be found on the
court’s website. Electronic filing in the court will be
through eDCA until the statewide e-portal and
electronic filing system become operational in the
court.
