ISSUE:
Whether to schedule the renewal application for Pho Real LLC, d/b/a Pho Real, 2399 West Main Street,
Littleton, Colorado for a public hearing.
BACKGROUND:
Routine liquor license renewals are generally handled administratively under Section 3-2-16 of the city code.
That section states that the chairperson of the authority is authorized to grant renewals so long as “no
information regarding alleged violations of the Colorado liquor and beer codes or amendment 20 of the
Colorado constitution or violations of this code have been referred to him or her by the police department or
otherwise.” Pursuant to Section III.B of the Licensing Authority Guidelines: “If the Littleton Police Department
(LPD) renewal report or any other information obtained from other City departments (e.g., Finance) indicates to
the City Attorney probable cause to believe there is “good cause” to refuse to renew, the City Attorney has
discretion to place the renewal application on the agenda. The issue before the Licensing Authority shall be
whether to schedule the renewal application for a public hearing. The Licensing Authority shall be provided
with the renewal application, renewal report and any other information upon which the City Attorney based its
decision to place the renewal application on the agenda. No testimony shall be taken and the Licensing
Authority shall base its decision solely upon such information provided. If the Licensing Authority decides to
schedule the renewal application for a public hearing, the renewal application shall be scheduled for the next
available public hearing date, following notice as required by C.R.S. § 12-47-302. The chairperson shall be
authorized to proceed with approving any renewal application not scheduled for a public hearing by the
Licensing Authority as part of this procedure.”
The City Attorney’s Office has placed this application on the agenda for the following reason(s):

On the renewal application (question 3), the applicant indicates that the applicant, agent, owner,
manager, partner or lender had been convicted of a crime since the date of filing of the last annual
application. The applicant attached the required detailed explanation to the application.
RECOMMENDATION:
Staff recommends that the Authority schedule the renewal application for a hearing at its next regularly

Yes, I was convicted of possession/manufacturing a medical marijuana concentrate, with intent
to distribute, and was given 4 years of minimum supervision probation in the city and county of
Denver. Here is the explanation below:
With so many people trying to extract concentrates for Medical/Recreational marijuana
purposes, the number of home explosions have increased significantly in the past year. (See attached)
With no facilities that assisted the community for legal and safe extraction, and idea was born. Through
seeking legal council and reviewing Colorado Laws, The Grey Area LLC was created.
I, Victor Nguyen, registered the business with The State of Colorado, rented a commercial
space, and also bought a close loop extraction machine, sold in Colorado, and used by the Medical
Marijuana Processing Centers. All this was done, not out of criminal activity, but out in the open,
trying to comply with all the frequently changing laws in the Medical/Recreational marijuana industry.
The Grey Area LLC was intended to be a place where medical patients can take their own trim,
and have it processed safely, with only a service charge. It was The patient's trim, and the patient's
finished product. I was NOT selling anything but a service.
If there was a processing License that allowed for a business to service the community by
safely extracting their Medial/Recreational trim, I would have definitely went and applied for that,
therefor with no license to acquire, and the laws not stating that it was illegal at that time, I opened The
Grey Area LLC.
Through helping patients with their processing needs, I acquired a lot of the patients trim. It was
in trash bags to be disposed of properly. That's why it was not in the dumpster, and in The Grey Area.
So basically I am being charged, and prosecuted for trash and trim that was not mine. My soul intention
was to service the community, safely, in a commercial space, abiding by all the ever-changing laws in
the Medical Marijuana field. The Medical Marijuana attorneys that work closely in the field, and
myself, thought it was a good idea for this servicing center, and never once in my mind did I think it
was illegal, or intentionally tried to break any laws.
So to summarize, I have owned two Dispensaries in the past, (with licenses). I have also gone
before the Liquor Board in Littleton, and have acquired my liquor license and although I have a past
record, as the Liquor Board knows, I was given the opportunity to obtain a Liquor License in Littleton,
and the board was able to see past my previous convictions. For that, I am grateful and greatly respect
and cherish the opportunity to service the Down Town Littleton patrons with my Pho restaurant and a
Liquor License. In this past year we have not had any violations or nuisances regarding our Liquor
license, and there for I hope once again you can see what I was doing was not of illegal intentions, but
to try to safely service the community and change my life and the lives around me, to be a better part of

Hash oil, a form of concentrated THC from cannabis plants that is created using liquid butane, has been linked with dozens of explosions in
Colorado, where marijuana use has been legal since 2012. Similar explosions have been reported in California and Washington state.
In the predawn hours of May 16, 2014 in Manitou Springs, Colorado, an explosion ripped through the apartment of 23-year old Audrey
Horowitz and 18-year old Michael Austin. According to an eyewitness speaking to local TV news station KRDO, the blast was strong enough
to rip the door from a refrigerator. The couple was taken into custody on suspicion of rust-degree arson, reckless endangerment and child abuse
(Horowitz's 3-year-old daughter was in the home at the time) and later released on bond. No one was hurt in the explosion and friends deny the
couple were doing anything illegal, KRDO reports.
According to
evidence collected at the home seemed to indicate Horowitz and Austin were manufacturing hash oil in the apartment.
Colloquially called honey oil, dabs or earwax, hash oil is a concentrated form of THC, the active constituent of cannabis. Smoking the oil
creates a more potent high than marijuana does, but producing the oil requires the use of certain explosive chemicals, an increasing number of
home chemists, many of them in Colorado, may have discovered.

Hash oil explosions arc becoming more common in Colorado after the state approved a referendum to legalize recreational marijuana in
2012. As The New York Tinier reported Sunday, at least five people were hospitalized in the state's 32 hash oil explosions in 2014, and 17
received treatment for severe burns. But now that cannabis is legal in Colorado, so is hash oil, in theory at least.
Hash oil is created by drawing liquid butane through a tube stuffed with cannabis. Resin from the cannabis that contains THC is caught in the
butane as it passes through the tube. The butane-resin mixture then enters a glass vial where the butane turns to gas, leaving behind only
concentrated THC resin, which is then lit and smoked. The resultant butane gas, however, is highly flammable.
Officials quoted in the Times say that regulated, controlled hash oil manufacturing operations are legal but homemade hash oil is still against
the law. Pot advocates disagree, with some telling the Times that legal weed means legal weed, in all its sundry forms. Hash oil explosions
should be treated as accidents, not crimes, they say. They welcome regulation, not prosecution.
Legal authorities in Colorado are largely unmoved by these arguments. A judge in Mesa County, Colorado, recently ruled that laws
prohibiting the production of concentrated hash oil are not unconstitutional under the state's new marijuana laws.

Mouser said using a closed canister ensures the dangerous gasses
never escape.

"It's a constant recycling system," he said. "There's no end butane or

The state has licensed that method of hash making and firefighters
have inspected the system.

too high and the results could be deadly.

Mouser agrees with that assessment.
"The bottom line is we have a situation on our hands here in
Colorado and nationally," he said.
Mouser said many Colorado hash makers learned their trade with
those more dangerous methods.
"We all came from somewhat of an open blasting background," he
said.
While he concedes some use those old methods, he said responsible
hash makers are making safety a priority.
"We've gone from the garage to laboratory methods," Mouser said.
"Now there's not really an excuse to do open blasting."
Mouser said lawmakers could take steps to target those hash oil athome operations, specifically by cracking down on bulk butane sales.
That would be taking the same approach used to curtail meth
production by limiting the over-the-counter sale of some cold
medicines.
"If you limit the sales of cans of butane, I think you will limit the
explosions," Mouser said.
Mouser also said regulators are moving to make sure all hash
makers move to that safer closed-loop system by July 1.
It is against fire code to make Hash in a home in Denver and many
other municipalities. Violators could face up to 30 days in jail or
heavy fines.

C.R.S. 12-47-312 Results of investigation-decision of authorities. (2)(a) Before entering any
decision approving or denying the application, the local licensing authority shall consider, except where
this article specifically provides otherwise, the facts and evidence adduced as a result of its
investigation, as well as any other facts, the reasonable requirements of the neighborhood for the type of
license for which application has been made, the desires of the adult inhabitants, the number, type, and
availability of alcohol beverage outlets located in or near the neighborhood under consideration, and any
other pertinent matters affecting the qualifications of the applicant for the conduct of the type of
business proposed; except that the reasonable requirements of the neighborhood shall not be considered
in the issuance of a club liquor license. The reasonable requirements of the neighborhood may, but
are not required to, be considered in the conversion or transfer of a liquor-licensed drugstore license
to a retail liquor store license.
5. Character, Record and Reputation (C.R.S. § 12-47-307)
When considering this requirement, the Authority should refer to C.R.S. § 12-47-307, which states:
C.R.S. 12-47-307 Persons prohibited as licensees. (1)(a)
Article 46 or 48 of this title shall be issued to or held by:

holding ten percent or more interest therein, are not of good moral character;
Any person employing, assisted by, or financed in whole or in part by any other person who
is not of good character and reputation satisfactory to the respective licensing authorities;
Any person unless such person’s character, record, and reputation are satisfactory to the
respective licensing Authority;
Any natural person under twenty-one years of age. For a hotel and restaurant license, the
applicant also must show that the registered manager for the establishment is a person of
good character, record and reputation. C.R.S. § 12-47-411(11).
*As of the date of this memorandum, a report from the Littleton Police Department has not been received
pending availability of results based on fingerprints of the principle officers.
CONCLUSIONS AND RECOMMENDATIONS
The application is complete and all required documents are in order. Therefore, should the applicant’s
presentation and the facts and evidence adduced as a result of the Licensing Authority’s investigation indicate
that the needs of the adult inhabitants of the neighborhood are not now being met, that the desires of the adult
inhabitants of the neighborhood are to have the license issued, that existing similar liquor licenses in the
designated neighborhood are not adequate, and that the applicant and registered manager are of satisfactory
record and reputation, staff would recommend that the Authority approve the application for a hotel and
restaurant liquor license, as requested by the applicant.

PROPOSED MOTION:
I move that the public hearing be closed and that a resolution of the Littleton Licensing Authority be approved
which grants Columbine Country Club Inc., d/b/a Columbine on Main, 2299 West Main Street, Littleton,
Colorado, a hotel and restaurant liquor license for a members-only establishment contingent upon approval by
the Colorado Liquor Enforcement Division and based upon the following findings of fact: (1) that notice of the
hearing was properly posted and published; (2) that the applicant has possession of the premises and the
premises are suitable for the requested license; (3) that the needs of the neighborhood are not now being met;
(4) that it is the desire of the adult inhabitants of the neighborhood that the license be issued; (5) that existing

1. Under the direction and control of Oedipus, Inc. management, the Oedipus, Inc. employees
were briefed on the application.

A. Two maps of the area denoting the proposed location of the license and the boundaries
of the defined neighborhood together with a list provided by the City Clerk's office of
establishments holding liquor licenses that sell similar alcoholic beverages in the
suggested area, all of which are attached hereto;
B. Petitions allowing individuals contacted to indicate their opinion with instructions and
qualifications for signing;
C. A stat sheet to record the opinion of those not signing and not-at-homes.

This petition/opinion poll was performed on Tuesday, 29 December 2015 (businesses), and
Monday, Tuesday, Wednesday, and Thursday, 28, 29, 30 and 31 December 2015 (residences)
within the neighborhood defined by the City Clerk's Office of Littleton (see maps).

The circulation packets have cover maps, and the areas in which each petition
circulation/polling took place are outlined in highlighter. Included in this Report is a master
circulation map outlining all areas where circulation/polling was conducted.
5.
Individuals were contacted on a random sampling basis, were screened to identify them as
parties in interest, and were asked their opinion after they had been informed of the applicant,
site location, and type of license being applied for. Their opinion was either recorded on the
petition format or on the stat sheet.
6. Three (3) petition packets (one packet representing businesses, two packets representing
residences), together with a Summary Letter and this Report were prefiled with the office of

A RESOLUTION OF THE LIQUOR LICENSING AUTHORITY OF THE CITY OF LITTLETON,
COLORADO, APPROVING THE APPLICATION OF COLUMBINE COUNTRY CLUB INC., DOING
BUSINESS AS COLUMBINE ON MAIN, LITTLETON, COUNTY OF ARAPAHOE, FOR A HOTEL &
RESTAURANT LIQUOR LICENSE.
WHEREAS Columbine Country Club Inc.., doing business as Columbine on Main, 2299 West
Main Street, Littleton, Colorado, has filed an application for a Hotel & Restaurant liquor license; and
WHEREAS, the Liquor Licensing Authority of the City of Littleton desires to enter its written
findings and decision regarding approval of said license by resolution pursuant to that authority granted by
Title 12, Article 47 of the Colorado Revised Statutes.
NOW, THEREFORE, BE IT RESOLVED BY THE LIQUOR LICENSING AUTHORITY OF
THE CITY OF LITTLETON, COLORADO, THAT:
Section 1: Based upon testimony heard and evidence presented at a public hearing on
January 13, 2016, the Authority finds that notice of the hearing was properly posted and published,
that the needs of the neighborhood are not now being met, that it is the desire of the adult
inhabitants of the neighborhood that the license be issued, that existing similar liquor licenses in
the designated neighborhood are not adequate, that the applicant and registered manager are of
good moral character, record and reputation, and that the applicant has possession of the premises
and the premises are suitable for the requested license
Section 2: The application of Columbine on Main, 2299 West Main Street, Littleton,
Colorado for a Hotel & Restaurant liquor license is hereby approved and the license is ordered to
be issued to the applicant subject to the approval by the State of Colorado Liquor Enforcement
Division.
Section 3. The City Clerk is hereby directed to send to the applicant a copy of the within
resolution by certified mail, return receipt requested, approving the issuance of said license at the
address shown on said application.
INTRODUCED, READ, AND ADOPTED at a regular meeting of the Littleton Liquor Authority of
the City of Littleton, Colorado, on the 13th day of January, 2016, in the Littleton Center, 2255 West Berry
Avenue, Littleton, Colorado.
