This sounds good but what does this really mean? This does not reflect the millions of people working part time jobs who cannot find full time opportunities, or the millions of people who have just given up looking for jobs. Part of the story is that over 91,000 jobs have been lost in the oil industry. Why? Because of the lower cost in oil prices. As I reported in the last addition, I was concerned over the OPEC countries holding oil prices down. This is done, in my opinion, to put the U.S. oil producing efforts out of business, and then come back later and raise prices. I hope I’m wrong but time will tell. Once again all of organized labor is fighting the current administration in Washington, D.C. over their fast track initiative. After promising in 2008 that N.A.F.T.A. was wrong, those same Politicians on both sides of the aisle are saying that moving our American jobs overseas is good for America. Another interesting note is that fast food giant, McDonalds, is bragging that they have raised their employees pay to $10.00 per hour. According to USA Today, this only applies to company owned stores and not the franchise owned stores. This will only apply to 5% of their employees, since the overwhelming majority of their stores are franchised. I guess 95% of their employees don’t “deserve a break today”. I recently attended a couple of organizing meetings with a company that our local is working on in Archbold, Ohio. After listening to some of the tall tales that the company was spreading about unions, I challenged the boss at this company to a debate. I offered for him to meet with me and allow his employees to ask all the questions they wanted us to address in front of the group. The boss responded by sending a letter saying it was illegal for him to debate me. One of the curious employees took it upon himself to call the National Labor Relations Board to see if the boss’s statement was true. Guess what? It was NOT true. This employee took it upon himself to handbill his co-workers to tell them “the boss” had told them another lie. Why couldn’t he just tell the truth? Because he doesn’t want to bargain with his employees or listen to their complaints. It’s easier to lie to his employees and tell them that he knows what is good for them, than to have a formal debate in front of the group and let them make their own informed decision. Such is the life of a corporate dictator! Vice President Roy Weldon had a long and fulfilling career. It all started back when he joined the army and showed such leadership promise, that he was recruited to NCO training (Non Commissioned Officers) where he completed some of the most rigorous training imaginable. After proudly serving our Country in the Vietnam War, earning several service medals, including the Purple Heart, he came back to Northwest Ohio and began school at BGSU. In 1970, while attending college, he found a job at a small shipping company, UPS, where less than 100 people were working. Within months of starting his job he was elected Chief Steward of the shop, where he remained for the next 30 years. In 2001, President Bill Lichenwald asked him to come work for Local 20 as the Business Representative for UPS. To date, UPS has grown with Roy to a membership of 2000 plus strong! After working for Local 20 for 14 years, he has moved through the ranks and with his great leadership, honesty, and hard work he retired as our Vice President. You have touched and taught everyone you have ever met and your knowledge and leadership will be missed, we wish you the best of luck in retirement. Riker Products was founded in 1946 and has been represented by Teamsters Local 20 since 1969. After a brief shut down in 1990, Riker was bought by the Brenlin Group and then restructured through a partner of that group into the Cypress Companies, of Akron, in 1995. Volvo/Mack, Navistar, Caterpillar, and CNH are some of the larger companies that Riker supplies. To date Riker operates out of a 250,000 square foot building located on Stickney Ave. in North Toledo and has about $27million in sales annually, which is a direct contribution of about 90 hardworking Teamster Local 20 members. Every so often I receive a call from a former client that I represented in a Bankruptcy case complaining about a creditor attempting to collect a debt discharged in the client’s case. I understand that mistakes happen. Information does not get to the proper party. Computers malfunction. However, it is frustrating when the actions of a creditor could be remedied by better training and/or instruction. The facts for my most recent former client to contact me are familiar. The client files a Chapter 7 petition and receives his discharge. The debtor owned real property in the City of Toledo that he does not intend to retain. An outstanding water bill to the Department of Public Utilities is listed on the petition. A foreclosure complaint is filed and the real property sells at a foreclosure sale. There are insufficient proceeds to pay all of the liens against the property, so the bill to the City for water is unpaid. Water and sewer bills are different from most creditors. The unpaid balance due to the Department of Public Utilities will become a lien against the real property and can be enforced against the real property. If a sale occurs, the unpaid balance may be paid from the sale proceeds. In an all too common fact pattern, the City DPU contacts the debtor after the Bankruptcy Discharge has been entered and after the foreclosure is final. A new owner is in place, but the proceeds of the foreclosure sale did not satisfy the water/sewer bill. The City DPU seeks to collect the unpaid balance from the debtor, the prior owner, claiming that the Bankruptcy Discharge does not affect the lien. Their argument is that a lien cannot be discharged. They are correct that a bankruptcy discharge does not eliminate the lien. However, the bankruptcy discharge eliminates the personal liability of the debtor to pay the City for the unpaid water bill. The creditor cannot seek payment from the debtor for the unpaid prepetition debt. The City DPU’s only remedy is to enforce the lien against the real property. Since there were insufficient proceeds of sale, the bill remains unpaid and the lien is now extinguished via the foreclosure action. The City DPU is in violation of the Discharge injunction when it contacts a debtor to demand payment in a scenario as outlined above. The injunction prevents any action to collect, recover or offset any discharged debt as a personal liability of a debtor. A debtor may bring a civil contempt proceeding if a creditor persists in collecting a prepetition debt that has been discharged. You can obtain a copy of the Notice of Privacy Practices by calling the Fund Office at 1-800-523-8467 My name is Ron Hipp and I’m the Chief Steward at Heidelberg Distributing Co. I have been employed at Heidelberg for 12 years. Heidelberg Distributing Co. sells and distributes beer, wine and low proof liquors to every county in the state of Ohio. My position with Heidelberg is a driver. I have been on my current delivery route now for 9 years. My route is a 4 day route, Tuesday through Friday. My day starts shortly after 5 a.m. when I arrive to the warehouse. I’ll start the day by collecting my invoices, check in sheet and my pre trip report form. As drivers we are responsible to check our cases and kegs of beer on our truck in the morning before we leave to verify that we have what we need for the day. We have a 3rd shift crew that starts at 7pm and they are responsible for loading our trucks. After I finish my pre trip and my supervisor tells me I’m clear to go, I head to my first account. While we are delivering we are responsible for the product, the money we collect and rotating the product. In certain situations we are also responsible for double stacking and rotating kegs. We are also responsible to make sure we are making the proper deductions on our invoices for any returns, this includes the deposits for the empty kegs. This profession is extremely physical and we have to work in all types of climate conditions. On top of having to be in good physical condition to perform the job, we also have to be skilled drivers. We have to be fully aware while driving. We also have to be accountants with all the money and paperwork we handle. It helps to be a people person, because we deal with all kinds of different personalities. As Chief Steward I have been very fortunate to work alongside the best 45 co-workers anyone could ask for. My job is extremely difficult sometimes, but we are Teamsters and we get it done.
