Die nachstehenden Buchungsbedingungen sind, soweit wirksam vereinbart, Inhalt des
zwischen Ihnen und dem jeweiligen Hotelbetrieb im Falle Ihrer Buchung zustande kommenden Vertrags. Bitte lesen Sie diese Bedingungen daher aufmerksam durch.
The following booking conditions are, provided they have been effectively agreed, a part
of the contract that is concluded between you and the hotel of your choice in the event
of a booking being made. Please therefore read these conditions carefully.
1. Abschluss des Vertrags

1.1. Ihren Buchungswunsch übermitteln Sie bitte schriftlich mit dem im Katalog enthaltenen Buchungsformular an die Baden-Baden Kur & Tourismus GmbH. Die BadenBaden Kur & Tourismus GmbH hat ausschließlich die Stellung eines Vermittlers.
1.1. Please make your booking in writing to Baden-Baden Kur & Tourismus GmbH using
the booking form contained in the catalogue. Baden-Baden Kur & Tourismus GmbH
operates solely as an intermediary.
1.2. Mit dem Buchungsauftrag bieten Sie dem von Ihnen ausgewählten Hotelbetrieb
den Abschluss eines Reisevertrages auf der Grundlage der Prospektbeschreibung und
dieser Buchungsbedingungen verbindlich an.
1.2. By submitting the booking order, you are offering the hotel of your choice a
binding contract with you, based on the description in the catalogue and these booking
conditions.
1.3. Der Reisevertrag kommt ausschließlich durch die schriftliche Buchungsbestätigung
zustande, welche vom Hotelbetrieb selbst vorgenommen wird.
1.3. The travel contract comes about solely through the written booking confirmation,
which is provided by the relevant hotel.
1.4. Weicht die Buchungsbestätigung von Ihrer Buchung ab, liegt ein neues Angebot
des Hotelbetriebs vor, dass Sie innerhalb von 7 Tagen durch schriftliche Erklärung
gegenüber dem Hotelbetrieb annehmen können.
1.4. If the booking confirmation differs from your booking, this constitutes a new offer
from the hotel, which you are free to accept within 7 days by sending a written
declaration to the hotel.
2. Obliegenheiten und Kündigung des Reisegastes
2. Duties and termination on the part of the guest
2.1. Sie sind verpflichtet, auftretende Mängel unverzüglich dem Hotelbetrieb anzuzeigen und Abhilfe zu verlangen. Ansprüche Ihrerseits entfallen nur dann nicht, wenn die
Ihnen obliegende Rüge unverschuldet unterbleibt.
2.1. You are obliged to notify the hotel of any defects immediately and to insist on
rectification. Any claims on your part will be honoured if through no fault of your
own you have failed to report the problem.
2.2. Wird der Aufenthalt infolge eines Mangels erheblich beeinträchtigt, so können Sie
den Vertrag kündigen. Dasselbe gilt, wenn Ihnen der Aufenthalt infolge eines solchen
Mangels aus wichtigem, dem Hotelbetrieb erkennbarem Grund nicht zuzumuten ist. Die
Kündigung ist erst zulässig, wenn der Hotelbetrieb eine von Ihnen bestimmte angemessene Frist hat verstreichen lassen, ohne Abhilfe zu leisten. Der Bestimmung einer
Frist bedarf es nicht, wenn die Abhilfe unmöglich ist oder vom Hotelbetrieb verweigert
wird oder wenn die sofortige Kündigung des Vertrages durch ein besonderes Interesse
Ihrerseits gerechtfertigt wird.
2.2. If there is considerable detriment to the quality of the stay as the result of a defect,
you may terminate the contract. The same applies if you cannot be expected to
undertake your stay for an important reason recognisable by the hotel and resulting
from such a defect. Termination will only be permitted when the hotel has allowed an
appropriate period set by yourself to pass without providing rectification. No such
period may be set if rectification is impossible or refused by the hotel, or if instant
termination of the contract is justifiable for a special interest on your part.
2.3. Sämtliche Ansprüche, die im Zusammenhang mit dem Vertrag, bzw. den vom Hotelbetrieb erbrachten Leistungen stehen, gleich aus welchem Rechtsgrund, haben Sie
innerhalb eines Monats nach dem vertraglich vorgesehenen Rückreisedatum gegenüber
dem Hotelbetrieb geltend zu machen.
2.4. Die Geltendmachung kann fristwahrend nur gegenüber dem Hotelbetrieb, nicht
gegenüber der Baden-Baden Kur & Tourismus GmbH erfolgen. Eine schriftliche Geltendmachung wird dringend empfohlen. Durch die vorstehenden Bestimmungen bleiben die
gesetzlichen Regelungen über eine unverschuldete Fristversäumnis durch den Kunden
sowie die Vorschriften über die Hemmung der Verjährungsfrist unberührt.
3. Haftung
3.1. Die vertragliche Haftung des Hotelbetriebes für Schäden, die nicht Körperschäden
sind (auch die Haftung für die Verletzung vor-, neben- oder nachvertraglicher Pflichten),
ist auf den dreifachen Reisepreis beschränkt, soweit
a) ein Ihnen entstandener Schaden weder vorsätzlich noch grob fahrlässig herbeigeführt oder
b) der Hotelbetrieb für einen Ihnen entstehenden Schaden allein wegen eines
Verschuldens eines Leistungsträgers verantwortlich ist.
Eine etwaige Haftung des Hotelbetriebs gemäß §§ 701 ff. BGB bleibt hiervon unberührt.
3.2. Der Hotelbetrieb haftet nicht für Leistungsstörungen im Zusammenhang mit
Leistungen, die als Fremdleistungen lediglich vermittelt werden (z.B. Sportveranstaltungen, Theaterbesuche, Ausstellungen, Ausflüge usw.) und die in der konkreten
Leistungsbeschreibung ausdrücklich als Fremdleistungen gekennzeichnet oder während
des Aufenthalts als Fremdleistungen vermittelt werden.
4. Verjährung
Ihre Ansprüche gegenüber dem Hotelbetrieb, gleich aus welchem Rechtsgrund – jedoch
mit Ausnahme Ihrer Ansprüche aus unerlaubter Handlung – verjähren nach 1 Jahr
ab dem vertraglich vorgesehenen Rückreisedatum. Dies gilt insbesondere auch für
Ansprüche aus der Verletzung von vor- und nachvertraglichen Pflichten und den Nebenpflichten aus dem Reisevertrag. Die gesetzliche Regelung des § 651 g Abs. 2 BGB über
die Hemmung der Verjährungsfrist bleibt von den vorstehenden Regelungen unberührt.
5. Gerichtsstand
5.1. Auf das gesamte Rechts- und Vertragsverhältnis zwischen dem Hotelbetrieb und
Ihnen findet, soweit Sie keinen allgemeinen Wohn- oder Geschäftssitz in Deutschland
haben, ausschließlich deutsches Recht Anwendung.
5.2. Sie können den Hotelbetrieb nur an dessen Sitz verklagen. Für Klagen des Hotelbetriebs gegen Sie ist Ihr Wohnsitz maßgebend, es sei denn, Sie sind Kaufmann, juristische Person des öffentlichen oder privaten Rechts, Sie haben Ihren Wohnsitz oder
gewöhnlichen Aufenthaltsort im Ausland oder Ihr Wohnsitz oder gewöhnlicher Aufenthalt ist im Zeitpunkt der Klageerhebung nicht bekannt. In diesen Fällen ist der Sitz
des Hotelbetriebs maßgebend.
5.3. Erfüllungsort aller wechselseitigen Rechte und Pflichten aus diesem Vertrag ist
Baden-Baden.
2.3. Any claims arising in connection with the contract and/or the services rendered by
the hotel for whatever legal reason must be raised against the hotel within a period of
one month after the contractually agreed date of return travel.
Any claims made within the specific period may only be raised against the hotel and
not against Baden-Baden Kur & Tourismus GmbH. We strongly recommend that the
assertion be made in writing. The above terms will not affect the legal conditions
for excusable failure to comply within a specified period on the part of the client or the
rules for stay of the period of limitation.
3. Liability
3.1. Contractual liability on the part of the hotel for damages that are not physical
injuries (including liability for damages to preceding, auxiliary or subsequent duties) is
limited to three times the price of the holiday, provided
a) any damage to yourself was not brought about deliberately or with gross negligence or
b) the hotel is solely responsible for damage caused to yourself by the fault of a service
provider.
This will not affect liability by the hotel in accordance with paragraphs 701 pp of the
BGB [German Civil Code].
3.2. The hotel will not be responsible for interruptions to services in connection with
other services negotiated by third parties (e.g. sporting events, theatre visits, exhibitions, excursions etc.) and which are described as outside services in the specific
description of services or are negotiated as outside services during the stay.
4. Statutory limitation
Your claims against the hotel for whatever legal reason – but with the exception of your
claims arising from non-permitted actions – will expire 1 year after the contractually
agreed date of return travel. This applies in particular for claims arising from the infringement of preceding and subsequent duties and auxiliary duties in the travel
contract. This does not affect the legal definition contained in para- graph 651 g section
2 of the BGB [German Civil Code] on the stay of the period of limitation.
5. Place of jurisdiction
5.1. German law alone applies to the entire legal and contractual relationship between
the hotel and yourself if you have no general residential or business base in Germany.
5.2. You can only sue the hotel in the place of its registered office. Your place of residence will apply for claims against you by the hotel unless you are a merchant, legal person in public or private law, or your domicile or place of usual residence is abroad or not
known at the time the action is brought against you. In these cases the address of the
hotel’s registered office will apply.
5.3. Place of fulfillment of all reciprocal rights and obligations within this contract is
