Basic Stall - Each basic stall will contain the following, a 2 x 2 stand reserved by you and clearly marked out, Special Reserved Parking for the Exhibitor and 2 Exhibitor Entrance tickets. Please take special note that some Basic stalls are under cover and others are not. 2. Standard Stall - Each standard stall will contain the following, a 3 x 3 stand reserved by you and clearly marked out, no cover included – you may bring your own Gazabo. Special Reserved Parking for the Exhibitor and 2 Exhibitor Entrance tickets, an additional Entrance ticket can be pre arranged up to a week before the event. 3. Special Stall - Each special stall will contain the following, a 3 x 3 stand reserved by you and clearly marked out, Covered by a Gazebo we would have put up for you, Special Reserved Parking for the Exhibitor and 2 Exhibitor Entrance tickets, an additional 2 Entrance tickets can be pre arranged up to a week before the event. 4. Larger Stands are available upon request. 5. All designers/dress importers who want to be part of the Matric Experience need to take part in one of the fashion shows taking place on each day and also have a stand. 6. The cost and arrangements are as follows: - Every designer will be part of at least 2 fashion shows (1 per day) - The cost is an additional R300 above the stall requested. - Everyone needs to have between 4 to 6 outfits on the fashion show - Fashion shows: Saturday & Sunday 10:30, 13:00 & 15:30 3. PAYMENT • • Please note no stand will be reserved until we have received your PROOF OF FULL PAYMENT and signed documentation. Your Companies Name must be used as reference on the deposit slip. 4. CANCELLATION OF THE STALL Should an Exhibitor decide to cancel the Stall the Exhibitor is responsible to find a replacement, as no refunds are available. We hereby apply for exhibition space at the MATRIC EXPERIENCE held at the Lombardy Hotel and Spa in Pretoria. We hereby abide to the STANDARD TERMS AND CONDITIONS as in Annexure “A”. STALL INFORMATION (referred to as “the Stall”) Stalls- Each stall will contain the following: 1.1. Basic Stall - Each basic stall will contain the following, a 2 x 2 stand reserved by you and clearly marked out, Special Reserved Parking for the Exhibitor and 2 Exhibitor Entrance tickets. Larger Stands are available upon request. 1.5 The Organizers Will Not Be Liable For Any Damages, Direct Or Indirect, Of Whatsoever Nature And Whatsoever Caused Including But Not Limited To Theft, Weather, Fire Or Any Damage. Please Make Sure That You Do Not Leave Valuables Unattended. 2. ADDITIONAL PROVISIONS 2.1 If the precise area or location of the Stall is not agreed upon between the parties, then the precise area or location will be at the Organizers’ reasonable discretion. 2.2 If the precise area and location of the Stall is agreed upon between the parties, the Exhibitor acknowledges that the Stall is subject to a variation in size of no more than 15% (fifteen percent), subject to the appropriate adjustments of the contract price, and furthermore, that the Organizers will have the right to relocate the Stall in its sole discretion. 2.3 All fixtures and fittings will be prepared and installed entirely at the Exhibitor's cost, but subject to the Organizers being entitled to issue written directives with regard to materials layout and design thereof. 2.4 The Exhibitor may not remove or dismantle any portion of the Stall before expiry of the duration of the exhibition. 2.5 The Exhibitor must dismantle and remove the installation and return the Stand to the condition in which it was when access thereto for the purpose of preparing the stall was given to the Exhibitor, by no later than ten on the last day of the exhibition. 2.6 Ownership in and to the Stall and all additional fixtures and fittings will remain with the Organizers, and it will be the Exhibitor's obligation to maintain it for the course of the exhibition, and to return it to the Organizers on completion of the exhibition in good order and condition, fair wear and tear only accepted. 3. PAYMENT If the Exhibitor should not meet these commitments, an additional fee will be sent to the exhibitor. All payments made to the Organizers must be made to: Matric Experience, Standard Bank, Lynnwood Ridge, Account number: 013383914, Branch code: 012445 4. ACCESS TO THE EXHIBITION The Exhibitor, upon compliance with all its obligations in terms of this contract, will be afforded access the day before and on the day in accordance with the exhibitor’s manual. 6. USE OF THE STALL The Exhibitor may use the stall solely for the purpose described in the contract. The Exhibitor will only be entitled to use “double sided tape” for the purpose of attaching items to their Gazebo and will not be entitled to use any other adhesive or method. No form of paint or colouring of the floor of the Stall is allowed. The Exhibitor may not cede, assign, transfer, make over, sub-let, alienate or in any way burden or encumber any of his/her rights in terms of this agreement. 7. CONDUCT OF THE EXHIBITOR The Organizers will stipulate the hours of the exhibition, and the Exhibitor will be obliged to keep the Stall open and adequately staffed during said hours for the duration of the exhibition. 8. CANCELLATION OF EXHIBITION . . All aspects of the promotion and marketing of the exhibition will be in the sole and absolute discretion of the Organizers. The parties agree and acknowledge that the Organizers make no warranties or representations regarding the success of the exhibition, nor the number of persons expected to attend the exhibition. . The parties agree and acknowledge that the Organizers may, in their own discretion cancel or postpone the exhibition, in which event the Exhibitor will be entitled to be refunded with all amounts paid to the Organizers by the Exhibitor in respect of the exhibition. . The parties agree and acknowledge that the Organizers will not refund the Exhibitors if the Exhibition is not cancelled, with regards to weather conditions it is up to the sole discretion of the Organizers whether to cancel / postpone or continue with the Event. 9. INDEMNITY . The Exhibitor irrevocably and unconditionally waive all rights and claims that he/she may have against the Event, the members of it personally and/or any employees, representatives or contractors of the Organizers, resulting from, directly or indirectly, in the widest sense, the actions or inactions of any of the abovementioned persons including the negligence of all or any of them in respect of their obligation in terms of this agreement and in addition hereby indemnify and hold any of the abovementioned persons harmless against any claims that may be instituted against all or any of them (including legal cost on a scale as between attorney and own client), by any third parties resulting from any actions or inactions stipulated above. . The Organisers will not be liable for any damages, direct or indirect, of whatsoever nature and howsoever caused including but not limited to theft, fire, cancellation of the exhibition, bad weather conditions, attendance of the exhibition and power failure, suffered by the Exhibitor and furthermore the Organizers will not be responsible for any damage of whatsoever nature caused to the stall or other property brought into the exhibition by the Exhibitor or his/her servants, or for any injury to the person of the Exhibitor or any of its servants, howsoever such damage or injury may have been caused. 10. GENERAL . No warranty or representation, expressed or implied other than contained in this contract, which constitutes the whole agreement between the parties, and no variation hereof will be valid or binding unless reduced to writing and signed by the parties. In the absence of a material breach hereof by the Organizers, the Exhibitor is not entitled to cancel the contract. . The Exhibitor hereby consents to the jurisdiction of the Magistrate's Court having territorial jurisdiction in terms of Section 28 of the Magistrate's Court Act, as amended, notwithstanding that amount in dispute exceeds the jurisdiction of such Court. . The Organizers in their discretion will be entitled to cede its right, title and interest in and to this contract. In whole or in part, to which the Exhibitor hereby irrevocably consents. . The Exhibitor waives and abandons any rights that it may have under Section 62(1) (c) of the Magistrate's Court Act, which provisions it, undertakes not to invoke.
