Contest Official Rules
NO PURCHASE IS NECESSARY TO ENTER OR WIN.
Bahamas Takes Flight Contest (the "Contest") starts on April 21, 2015 at 3:00 p.m. Eastern Time
(“ET”) and ends on June 30, 2015 at 11:59 p.m. ET (“Contest Period”).
ELIGIBILITY: Contest is open to citizens or permanent legal residents of the forty eight (48)
contiguous United States and the District of Columbia (excluding residents of Alaska and
Hawaii), who are 21 years of age or older as of date of entry and a licensed pilot. Employees of
The Bahamas Ministry of Tourism (“Sponsor”), and their immediate family (spouse, mother,
father, sister, brother, ward, daughter or son and their respective spouses, regardless of where
they reside) and persons living in the same household of such employees, whether or not related,
are not eligible to enter or win. Void in Alaska, Hawaii, and where prohibited by law.
Sweepstakes is subject to all applicable federal, state and local laws.
HOW TO ENTER:
(a) You must have a Facebook, Twitter, or Instagram account to enter.
(b) During the Contest Period, go to www.bahamas.com/TakesFlight (the “Web Site”), and
follow the instructions provided at the Web Site to enter the Contest during the Contest
Period in order to receive one (1) entry. Unlimited entries will be allowed.
(c) Upload your Photo or Video to Instagram via your public profile and tag it with
#BahamasTakesFlight
(d) Upload your Photo or Video to Twitter via your public profile and tag it with
#BahamasTakesFlight
All entries must be received by 11:59 p.m. ET on May 29, 2015. There are no limits to
entries per person and respective Facebook, Twitter, or Instagram accounts throughout the
Contest Period. Entrants assume all risk of lost, late, misdirected, incomplete, or illegible
Entries. You may not use multiple Facebook or Instagram accounts to enter the Contest, and
an entrant who enters through multiple accounts will be disqualified. Entries generated by
script, macro, or other automated means and entries by any means which subvert the entry
1 | P a g e process are void. Any attempt at entry except as above stated is void. All entries become the
sole property of the Sponsor and will not be acknowledged or returned.
The Video must (a) be the original creation of entrant; (b) be in the English language (if
Video contains spoken or written language); (c) contain the physical likeness of the entrant;
(d) be a minimum of 15 seconds and a maximum of 60 seconds in length; (e) be in a format
supported for use on YouTube.com, and the maximum video size is 500 MB; (f) cannot
prominently display third-party brands or logos; (g) be suitable for family viewing on a
national news network; (h) and make reference to a pilot experience with a Bahamian spin.
The Photo must (a) be the original creation of entrant; (b) be in at least a 300DPI high
resolution format (c) cannot prominently display third-party brands or logos; (d) be suitable
for family viewing on a national news network; (e) and make reference to a pilot experience
with a Bahamian spin.
Sponsor’s (or its contractor’s) servers and clock will be the official clock for all phases of the
Contest, and entrant’s proof of a submission does not constitute proof of receipt by Sponsor.
Sponsor is not responsible for (i) lost, misdirected, late, incomplete, illegible, or
unintelligible Entries or for inaccurate entry information, whether caused by participant or by
any of the equipment or programming associated with or utilized in the Contest, or by any
technical or human error that may occur in the processing of Entries; or (ii) any printing,
production, human, or typographical errors in any materials associated with the Contest.
Sponsor reserves the right in its sole and unfettered discretion to disqualify at any time any
Entry containing obscene, offensive, pornographic or sexually explicit material, or libelous,
disparaging, infringing or other inappropriate content or subject matter (as determined by
Sponsor in its sole discretion).
DRAWING: Five (5) potential winners will be judged and rated by a panel of qualified judges
selected by Sponsor using the following criteria: (a) how well the entrant’s Photo or Video
showcases the entrant’s flight experience with a Bahamas twist; (b) the amount of creativity
demonstrated in the Photo or Video; and (c) quality and composition of the Photo or Video
production (collectively, the “Judging Criteria”). One (1) Grand Prize winner will be selected by
the judges based on the Judging Criteria.
In the event a potential winner’s Entry is disqualified, the entrant who submitted the next highest
rated Entry will be a potential Grand Prize winner, and must comply with the requirements in
these Official Rules. All decisions of the judges are final and binding.
2 | P a g e WINNER NOTIFICATION: Potential winners will be notified by phone or e-mail on or about
June 22, 2015, except that if the potential winner entered via Twitter or Instagram, Sponsor will
directly message the potential winner on Instagram or Twitter and Sponsor will provide an email address or other contact information where the potential winner can claim the prize.
Potential winner will be sent an Affidavit of Eligibility, Liability and Publicity Release (unless
prohibited by law), which must be completed and returned within three (3) days of date of
receipt. Return of prize notification as undeliverable, failure to sign and return requested
documentation within date specified, Sponsor’s inability to contact a potential winner within a
reasonable time period or noncompliance with these Official Rules by potential winner will
result in disqualification and another potential winner will be selected.
GRAND PRIZE: The Grand Prize is one (1) Vacation Package, which consists of: (A) A
destination vacation package for Grand Prize winner in Andros, The Bahamas with up to one (1)
guest. Vacation package consists of (i) roundtrip, coach class air transportation for Grand Prize
winner and up to one (1) guest from a major U.S. gateway airport nearest Grand Prize winner’s
residence to South Andros International Airport, Andros in The Bahamas; (ii) four (4) days, three
(3) nights standard hotel accommodations (one (1) room, double occupancy) in Andros; (iii) stay
is subject to availability; (iv) room type is subject to availability; (v) Meals and regular soft
drinks are included; (vi) certain high demand dates are blacked out (Thanksgiving, Christmas,
New Years); (vii) offer expires May 31, 2016; (viii) guests must comply with hotel standard
terms and conditions. Total Approximate Retail Value (“ARV”) for Vacation Package: $5,000.
All prize details are at the sole discretion of Sponsor. This Grand Prize does not include on island
transportation.
-------Prize cannot be substituted, assigned or transferred or redeemed for cash, but Sponsor reserves
the right, at its sole discretion, to substitute prize with one of comparable or greater value. All
expenses and incidental travel costs associated with prize acceptance and use not expressly stated
as being included in the package description above, including but not limited to, ground
transportation, luggage fees, meals, activities, tours, phone calls, incidentals, souvenirs,
passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal
charges at lodging, security fees, and all federal, state and local taxes are the responsibility solely
of winner. Actual value of trips may vary based on point of departure and package selected. Any
difference between stated value and actual value will not be awarded. Grand Prize winner and
guest must comply with all venue rules and regulations. Failure to do so may result in forfeiture
of such portion of prize. All dates and all components of prize package must be fulfilled and
occur within ten (12) months from the date the Grand Prize winner is confirmed or prize will be
forfeited and Sponsor will have no further obligation to such winner. Travel must be made
through Sponsor’s agent, on a carrier and with itinerary of Sponsor’s choice at least thirty (30)
3 | P a g e days prior to travel. Travel arrangements cannot be changed in any way once booked and
confirmed. No refund or compensation will be made in the event of the cancellation or delay of
any flight. Travel and accommodations are subject to availability and certain travel restrictions
and blackout dates apply. Blackout dates include but are not limited to seven (7) days before and
after all major U.S. holidays. Sponsor reserves right to change dates. Grand Prize winner and
guest must travel together on the same itinerary and are responsible for obtaining all required
international travel documents (i.e. passport). Guests must be of legal age of majority in his/her
jurisdiction of residence (and at least 18), unless the child or legal ward of Grand Prize winner or
a guest and must sign a liability/publicity release prior to issuance of travel documents. If guest
is child or legal ward of Grand Prize winner or a guest, he/she must sign and return release on
behalf of such child or legal ward.
GENERAL CONDITIONS: By participating, each entrant agrees: (a) to abide by these Official
Rules and decisions of Sponsor, which shall be final and binding in all respects relating to this
Contest; (b) to release, discharge and hold harmless Sponsor, and their respective parents,
affiliates, subsidiaries, retailers, and advertising and promotion agencies, and the respective
officers, directors, shareholders, employees, agents and representatives of the forgoing
(collectively, “Released Parties”) and their respective affiliates from any and all injuries,
liability, losses and damages of any kind to persons, including death, or property damage
resulting, in whole or in part, directly or indirectly, from participation in the Contest or any
Contest-related activity or the acceptance, possession, use or misuse of any awarded prize
(including any travel/activity related thereto). In addition, all entrants agree to the use of his/her
name, photograph, entry, Content, or likeness for programming, advertising, publicity and
promotional purposes in any and all media, now or hereafter known, worldwide and on the
Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited
by law) or additional consents from entrant or any third party and without prior notice, approval
or inspection, and to execute specific consent to such use if asked to do so. Prices quoted are
valid at the time of 'publication' and can be subject to change.
CONTENT: Grand Prize winner may be photographed, videotaped and otherwise recorded by
Sponsor in connection with the prize package (collectively, with written chronicle, "Content").
Content will be owned by Sponsor who has the right to use, edit, adapt, post, stream, copy and
exploit such Content and all elements embodied therein, including any names and likenesses
embodied therein, in any and all media now known or hereafter devised, including internet,
throughout the world, in perpetuity, for broadcast, advertising, promotional, trade and other
purposes. By accepting the prize, Grand Prize winner agrees that their name and likeness and
those of any other individuals present may be included in the Content, in Sponsor’s sole
discretion. Grand Prize winner agrees to share their experiences while in The Bahamas via their
social media channels with the hashtag #ItsBetterInTheBahamas. Grand Prize winner agrees to
help Sponsor retain necessary releases (as applicable) if requested by Sponsor to do so.
4 | P a g e MISCELLANEOUS: Released Parties are not responsible for late, lost, damaged, inaccurate,
delayed, garbled, misdirected, incomplete, undeliverable, destroyed or stolen entries; or for lost,
interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other
connections, availability or accessibility or miscommunications or failed computer, satellite,
telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or
misdirected transmissions or computer hardware or software malfunctions, failures or
difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic,
computer, network, typographical, printing or otherwise relating to or in connection with the
Contest, including, without limitation, errors or difficulties which may occur in connection with
the administration of the Contest, the processing of entries, the announcement of the prizes, or in
any Contest-related materials. Released Parties are also not responsible for any incorrect or
inaccurate information, whether caused by site users, tampering, hacking, or by any equipment
or programming associated with or utilized in the Contest. Released Parties are not responsible
for injury or damage to any person's computer related to or resulting from participating in this
Contest or downloading materials from or use of the website. Persons who tamper with or abuse
any aspect of the Contest or website, who act in an unsportsmanlike or disruptive manner or who
are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and
all associated Entries will be void. CAUTION: ANY ATTEMPT TO DELIBERATELY
UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN
VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE
MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER
REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE
FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. Should any
portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, nonauthorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt
or impair the administration, security, fairness or proper play, or submission of entries, or if
Contest is unable to run as planned for any other reason, Sponsor reserves the right at its sole
discretion to suspend, modify or terminate the Contest and, if terminated, at its discretion, select
the potential winners from all eligible, non-suspect entries received prior to termination.
ARBITRATION: Except where prohibited by law, as a condition of participating in this Contest,
entrant agrees that (1) any and all disputes and causes of action arising out of or connected with
this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of
class action, and exclusively by final and binding arbitration under the rules of the American
Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal
Arbitration Act shall govern the interpretation, enforcement and all proceedings at such
arbitration; and (3) judgment upon such arbitration award may be entered in any court having
jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant
hereby waives all rights to claim, punitive, incidental or consequential damages, or any other
damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs
5 | P a g e associated with participating in this Contest), and entrant further waives all rights to have
damages multiplied or increased.
CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation
and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in
connection with the Contest, shall be governed by, and construed in accordance with, the
substantive laws of the State of Florida, USA and The Bahamas.
