The year 2015 has surely come
to a close, but not without a bang
from the best and the brightest
Filipino-Australians who have
made it to the headlines. They are
the many exceptional individuals
who served as our source of pride
as Filipinos.
We are all familiar with the roster of talents which have graced
our pages in the past few years:
Marlisa Punzalan, Anne Curtis,
Jasmine Curtis-Smith, Jason
Day and James Reid to name a
few. But this year, we welcome
2016 by highlighting some of the
people who made the previous
year just as memorable by making
their success as one of our own.
Darling of the chess world
In a sweeping move to find
a mate, FIDE titleholder for
Woman International Master
Arianne Caoili got engaged
to Armenian grandmaster
Levon Aronian on the 18 th of
February. Caoili, Manila-born
and one of Australia’s leading
chess players, met Aronian
in 2006. Aside from her upcoming wedding with the
Armenian player, she is also
completing her PhD in Germany on Russian-Armenian
relations. She has a jazz album
tucked under her belt and
currently works for a global
consultancy firm.

Fiesta’s Laverton property remortgaged at $300k
The Philippine Fiesta of
Victoria’s (PFVI) Laverton
property was remortgaged
last year at $300,000 as per
mortgage document presented by the Concerned
Members of Philippine Fiesta
of Victoria Inc (CMPFVI) during the 9 December 2015
Supreme Court hearing. The
Judge did not include the
mortgage issue in the deliberation as it was a new
affidavit and not part of the
summons.
Gabriel Kuek of AccessLaw, the lawyer representing
the CMPFVI led by Maina
Walkley, emailed the lawyer
of Committee of Management (COM) of the PFVI
led by Ross Manuel on 19
November 2015 notifying
his clients that they have
contravened a 21 May 2014
undertaking.
The court undertaking provides “that until further order
of the trial of this proceeding
they would not take any steps
in the management of the Association without first notifying the plaintiff’s lawyers, via
email, of the steps they wish
to take at least 10 working
days prior to the taking of the
proposed steps.”
The undertaking does not
include the daily business
operation of the Fiesta such
as paying rates, taxes, bank
fees, utilities, insurance and
the like.
Walkley’s group believes
that the new loan seems to
be in breach of what was
agreed upon by the two parties. “It appears that your
clients have, in raising a loan
of $300,000 and securing the
borrowing with a mortgage
over the Laverton property,
contravened their undertaking of 21 May 2014,” writes
Kuek.
The mortgage document
was signed on 21 March 2015
by PFVI Chairperson Ross
Manuel and Mario Magbiray,
and Mark and Lorena Pernell
for MLP Corporation Pty Ltd.

Manuel has yet to respond
why his Committee of Management (COM) secured the
loan. The biggest PFVI project so far is the building in
2017 of the Philippine Community Centre, a multi-purpose site for cultural, sports
and entertainment activities.
Reinstatement as Fiesta
members
Meanwhile, Kuek told The
Philippine Times that his
clients have already paid
around $3,000 membership fees for the banned
members. This is part of
the condition set by the
Supreme Court before they
will be reinstated as Fiesta
members. As of this writing,
the banned members have
not yet been reinstated. What if Manuel’s COM
will not reinstate Maina’s
group as members? Kuek
said this is not possible.
“Failure to reinstate the
plaintiffs as full members of
the PFVI might amount to
disobedience of the Court’s
Order. That might justify
a further application to the
Court for the defendants
to be dealt with for contempt
of Court,” he said.
The Supreme Court has
ordered Manuel’s management to “use their best endeavours and do all things
reasonably necessary to accept the Plaintiffs into ordinary membership of the First
Defendant (Fiesta) with the
Plaintiffs’ respective standings as ordinary members
undisturbed by the purported ban from membership
imposed upon the Plaintiffs
on 30 June 2013, upon payment by the Plaintiffs of the
prescribed membership fees

Filipinos to join Australia Day Parade 2016
The Filipino Community
Council of Victoria (FCCVI) led by its Chairperson
Perla Luetic will lead the
Filipino delegation at the
annual Australia Day Parade 2016 on 26 January
2016.
Luetic told The Philippine Times that since there
are several ethnic communities who will be joining this year’s parade, the
Filipino community is allocated only 40 slots to join
the parade.
Assembly time will be
at 10am at Burke Street,
Melbourne. The Parade will
start at 11am following the
Australia Day Official Flag
Raising Ceremony at the
Melbourne Town Hall.
Thousands of Australians and individuals wearing different costumes will
march down Swanston
Street. They represent
more than 100 community
and cultural groups. The
spectacular parade sees
people waving their flags
as they display their costumes, colours and movements.
Australia Day is celebrated every year in Melbourne
and Victoria with the Victorian Government bringing a
festive atmosphere of fun
activities and free events.
Those interested to join
the Filipino community
delegation will be accepted
on a first come, first served
basis due to limited slots.

Let’s choose our battles
We often hear the saying, “choose or pick
your battles”, especially in times of conflict
in personal, professional, community or international relationships. It futher goes, “you
don’t have to show up to every argument
you are invited to.” By actually choosing,
we learn to prioritise which issues really
bear weight for which we should fuzz or
make a stand.
So your partner not pressing the toothpaste tube from the base should not make
you lose sleep. There are far more relevant
things to discuss like sorting parental styles
and how to instill discipline and values
among children. On a professional level,
standing up against office bullying or discrimination holds greater significance than
updating office layout to make it look more
modern.
In our own community, we should go up in
arms for those eroding our community solidarity and confidence with hidden agenda
and gossip. All other things, like other organisations stealing our thunder or outdoing us
in a similar activity, shouldn’t bug us.
Should we speak up that China has built
structures around the disputed Spratly Islands fortifying its ownership or that it has
destroyed the coral reefs in the portion of the
Island we claim as ours? That our national
patrimony is being grossly snatched away
should send the red flag up and have us up
in arms. This is still more paramount than
criticising our Miss Universe Pia Wurtzbach
for finding no fault in having American bases
on Philippine soil.
The goal of choosing our battles is to seek a
win-win situation and to foster a harmonious
and smooth relationship despite differences
of opinions. By making a stand on something
we feel strongly about, or picking our battles,
does not give us the license to be combative
and aggressive and to have a perspective of
winning over someone.
When we stand firm in taking the cudgels
for something of importance, this gives us
an opportunity to be the better person, by
listening, being open to dialogue and negotiation, and accepting that the other party is
of equal importance with values, viewpoints
and opinions which need to be respected,
even if far different from our own.
Life is not always about competition or
factions, or gaining an upper hand over the
other. If we look at life with this perspective, we lose the beauty of a healthy banter,
positive interaction, cooperation and shared
victories.
The term co-opetition is a business term
where business competitors or rivals compete and cooperate for mutual benefit, for
example, to expand the market. The same
principle can be applied to organisations
and countries in a bid to act in consideration
of long-term benefits and consequences. It
downplays the “I” syndrome in a selfless act
of improving oneself while at the same time
giving the good to the more.

I am writing this on 30 December and I am reminded that it
was through the writings and
works of Dr. Jose Rizal that our
forefathers found the will to
move towards a united country,
free from abuse and inequality.
What is so inspiring is that Dr.
Rizal’s courage and intelligence,
his sense of duty, hunger for
knowledge, passion for reform
and undying love of country are
an invitation to all of us to be
the best that we can be in our
own way.
The beginning of another year
provides us with an opportunity
to review our lives, to look back
on how much we have achieved
and to plan ahead for our own
personal growth and professional development in the year
ahead. It is also a time to find
our bearings and renew our approach to life.
The idea is that, despite the
hardship and stress that can
sometimes come our way, we
can choose to overcome these
by meeting all challenges before
us with a positive attitude and
an unwavering hope that everything will turn out all right.

Melbourne from 19th to 22nd
January 2016 to attend to the
biometrics capture of Philippine
ePassport applicants and to administer the oath of allegiance to
petitioners for dual citizenship.
Only pre-registered applicants
may attend and will have already
been given a particular time
by the Embassy to attend their
appointment at the MacKillop
Room at St. Francis Pastoral
Centre located at 326 Lonsdale
Street in Melbourne.
The Consulate office will remain open on Tuesday 19th and
Wednesday 20th January, while
the Mission is in operation.
Please be patient as the volunteer consular officers attend to
each of your requests in order.

End of gratis Passport
Extension facility
Please note that the gratis passport extension facility was only
available until the end of 2015.
This is in line with the normalisation of passport production.
This means that extension of
Philippine Passports gratis is no
longer available.
The Philippine Consulate in
Melbourne is now able to provide a Passport Extension at the
scheduled fee to an applicant
who (1) has already completed
the Passport Renewal process
(via the Embassy or the Sydney
Consulate General) and (2) has
an official receipt which will
need to be presented to the
Consulate in Melbourne when
applying for an extension.
Applicants in Victoria may
apply for an ePassport at any of
the following:
• the Department of Foreign
Affairs (DFA) in Manila,
• the DFA’s regional offices
throughout the Philippines,
• the Philippine Embassy in
Canberra,
• the Philippine Consulate
General in Sydney
Mobile passport services

While the application for a
Philippine ePassport is lodged
with the Embassy, the passport
is produced in Manila. It may
take an estimated 8-10 weeks for
the new passport to be released.

Magic and keeping
a sense of wonder
by my word, allowed me to
end 2015 on a positive note.
As I reflect on the coming
of another year yet again, I
welcomed the word ‘magic’
and loved it for the many
possibilities it seems to
refer to.
Magic, to me, means seeing the extraordinariness
amidst the ordinary, finding
delicious pleasures amidst
the everyday, and discovering big milestones in the
little moments - the smallness of life; the special
pockets amidst the routine,
everyday details.
Magic - and a sense of
wonder!
By the time this column
comes out and you get a
copy of this edition of The
Philippine Times, January
may soon be at a close and
all the excitement of the
new year may have already
gone. Yes, the arrival of
2016 is now ‘old news’ and
we may already be referring to “How fast time flies,
sooner or later it will be
Christmas yet again.”
But, let us not look way
too much in advance just
yet. We are still at the first
quarter of the year and
while new year’s resolutions may have already
been forgotten by some, I
can argue that we are still
on the “fresh start” mode.
And if you find that you
are not, and that you are
already tired, give yourself
the opportunity to start
again, reboot and begin
anew. Stop and catch yourself before you get into the
cycle of mindless running
around the hamster wheel.
A few years ago, I got into
the practice of beginning
the year by adopting a word
– inspired by Benedictine
monk Christine Valters
Paintner. The word should
‘come to me’ after a period
of reflection, and should
guide me throughout the
year. On my first year of
getting into this practice,
I let the word ‘slow’ guide
me as I try to consciously
adopt a less busier lifestyle.
The following year was a
time of ‘breakthrough’ that
took me to the opposite
direction and a more frenzied pace, prompting me
to change course mid-year
and adopt the word ‘happy.’
I was glad that this change
of mindset, guided along
And now, that the holidays
have come and gone,
and all the merry-making, now subdued. As
the last of the carols
fade away and wee
children tire of hastily
opened gifts.
As the gay wrappers, have
been torn and tossed,
and the last bottle of
wine consumed.
Now, we usher the time of
giving way, Now, we
welcome the period of
new beginnings.
Friends, The years of melancholy are past. The
time for the big magic
is here!

Words and pictures
When I was a child, I would
lock myself in my room
for hours on end that mum
would eventually come
knocking at the door demanding I tell her what I was
doing. I never gave her the
same excuse I did later on
as a teenager when telling a
white lie was less sinful than
her finding out the truth.
No, when I was a child
I’d reply to her persistent
questions with one simple
answer: I’m drawing.
Around the age of eight, I
discovered that I could create
reality with my fingers and
eyes as instruments and a
piece of paper as my canvas. I
drew pictures and caricatures
of things that would pop in
my head, usually strongly
influenced by the wildly
nonsensical Japanese anime
characters of which I consumed with much gusto at
the time. Cartoons and comic
books were borne from my
overactive imagination and
I soon had piles of booklets
filled with black and white
sketching. To this day they
remain in my desk drawer
back at my childhood home,
collecting dust as well as
nostalgic significance.
Grade school introduced
me to the wonders of stringing words into sentences.
When my teacher praised
a short story I had written
about a turtle at a crossroads
and a pagan Sun God who
showed him the way, I realised that I was probably
doing something that I could
be quite good at. Years later, I
became a published freelance
writer.
Lately, I’ve begun revisiting my childhood love for
art. Moving on from the
monochromatic sketching
of graphic novels, I’ve discovered a new-found love
in something a little more
unconventional yet very colourful. I was gifted an adult
colouring book and a box
of brightly-tinted coloured
pencils – and whilst nothing
serious will come of it, what
it has provided is a muchneeded outlet.
You see, I’ve been too busy
– too frenzied – and therefore,
too uninspired. Commitment
and responsibility sap creativity as much as it does time.
You may or may not have
noticed, but last year, this
column was absent for many
months. 2015 ended up being
one hell of a teacher, and how
it kicked my sorry behind!
So, when it’s been utterly
frustrating to find both the
space and energy to write,
colouring has become a fantastic distraction. There’s
something about the freeflowing stream of consciousness transferred physically
onto a blank page without
much thought or deliberation
that I have found to be a great
form of meditation. It clears
the mind of things dark and
hazy and borne from this
is something colourful and
beautiful.
Equally, I’ve realised this
to be a fitting analogy for
life and the New Year. 2016
is a fresh page waiting to
be coloured in. Your pencils are your family, your
friends, your hobbies and
your interests. There is no
right or wrong hue and you
can colour within or outside
the lines. Whichever way
you wish to do it, it is a new
canvas that will inevitably
be completed. So complete
yours with freedom and
confidence, and may it prove
bright like a rainbow all the
year through.

I bought a 1000 piece
puzzle of the map of Australia in September 2015. I
was hoping that my daughter would be inspired to
complete it just like the
previous two she did a few
years ago. When I look at
the massive puzzles she
created that now hung at
home, I am amazed by the
beauty of the scenes and
the dedicated patience that
went to finalising them.
But having done some
studies on dementia, I realised that for brain health,
I should be doing it myself.
So there I was, starting the
journey with trepidation.
Do I really have time for
this, I asked, worried about
my hectic schedule.
I convinced myself that
the exercise would do me
good. I forced my weary
eyes and foggy brain to
give it a try. My knowledge
of Australian geography is
minimal, so that in itself is
a reward.

piece I learned about
Australian geography
–that Lake Disappointment is in Western Australia, that
Anxiety Bay is close to
the Great Australian
Bight, Indonesia is a
neighbour and that
the Indian Ocean, East
Timor Sea and Arafura Sea can engulf us.
But most of all, I
learned that life is
very much like a puzzle. We start with a
humble piece and we
start growing, as we
collect more and more
experiences. There are
the strong, vibrant colours that mirror our
joy and milestones;
the dark, sombre colours
that reflect our sad, lonely,
anxious times; the neutral
colours when decisions
are ambiguous, confusing
us as there are no distinct
clues; then the need for
borders so we don’t dodge
the structures of life.

that during adversity,
trials, tribulations, great
sorrow, addiction or sin,
we can forget the missing
piece. As we try logic,
science, knowledge and
the arts to resolve our
life’s conflicts, we painfully realise God is the
missing piece we have
been searching for.
When I clicked the
very last piece after three
months of intensive labour, on 8 December at
10.30am, I felt a tremendous sense of triumph.
But there was sadness as
well. It is very much like
finishing a good book. I was
grateful for the daily company and the healing, the
puzzle had become somehow a comforting friend.
This reminded me that
one day, the final piece
of my life would also be
sealed by the finality of
life, called death. As I look
at the completed puzzle, I
marvelled at the completeness of the panorama. My
grand-daughter Eva, aged
6 congratulated me: “Good
job, Grandma!” Would God
say the same of me?
This New Year 2016 can
be a wonderful opportunity
to build a work of art. Many
times everything looks like
random pieces thrown at
us, but if wisely placed
together, we can see we
are heading for a chance to
build a masterpiece.
Our life experiences are
not random pieces with
no sense. The adventure
becomes magical, if we
are able to catch the significance of every moment,
trusting that God often gives
us clues as we move on to
the next connection.
“For we are God’s masterpiece. He has created us
anew in Christ Jesus, so we
can do the good things He
planned for us long ago.”

The year that was in embracing the faith

Philippines in January 2015
or somewhere in summery
Australia glued on your television beholding the arrival
of His Holiness Pope Francis on Philippine soil. The
Smiling Pope shared with
us his compassion, humility
genuine love for the Philippines and even his humour.
Pope Francis, or Lolo Kiko
as he wished to be called by
Filipinos, brought hope and
joy to the Catholic faithful
to Filipinos worldwide who
followed his five-day pastoral visit.
Just about a month after
this auspicious visit, good
news once more dawned on
Filipino Catholics in Australia when His Holiness appointed Archbishop Adolfo
Tito Yllana as Papal Nuncio,
the official diplomatic envoy
of the Holy See. Archbishop,
who hails from Naga City,
has held the same post in
Solomon Islands, Pakistan
and Congo.
The Filipino Chaplaincy
in Melbourne also led feast
day celebrations honouring
San Lorenzo Ruiz, Our Lady
of Peñafrancia, the Sto Niño
and the Black Nazarene.
Filos joined the novena, and
Mass celebrations in line
with feasts and held the traditional procession parading
the Saints around the block,
in some instance while praying the Rosary.
Other traditions observed
were the Flores de Mayo and
the staging of Panunuluyan,
a reprise of Joseph’s and
Mary’s search for an inn.
Christian denominations
in Melbourne also had major activities. Connect City
Church held its annual
women’s conference with
the theme “Called… For
Such a Time Like This”,
which honoured the strength
of women in times of trials
and tribulation, while the
Sydenham and Pakenham
Baptist Churches held a
Women’s Prayer Day. The
Ambassadors of Christ Fellowship celebrated its 7th anniversary with a fundraising
activity.
A family camp by St Albans Uniting Church brought
families together to focus on
each other instead of on their
gadgets. It was a day of team
games and family reflection.
In a testimony of faith, two
individuals declared their
life transformation through
Jesus and had a water baptism with members of the
Faith Community Christian
Church witnessing.

its guest Kate Ceberano.
Kate, who has appeared in
various films and television
shows, has been making
waves as far back as the '80s
as a soul and jazz singer in
Australia. Born to a FilipinoAmerican father and an Australian mother, she has made
her way up the ladder as a
back-up singer, eventually
winning Best Female Vocalist at the 1986 Countdown
Awards. Since then she has
been a staple voice in Australian mainstream and was
dubbed Queen of Moomba
in 2013. Aside from her brief
stint in The Living Room,
she also sang the Australian
anthem at the AFL Grand
Final last 3 October.
APO Hiking Society’s Jim
Paredes had his share of
screen time as well. Appearing on StarFlix’s mobile
series Must Date the Playboy under Star Cinema, he
starred alongside Xian Lim,
Kim Chiu and Jesse Mendiola. Playing Xian Lim’s father,
Paredes and the other cast
members serve as the romcom fix for the telenovela
cravings of the FilipinoAustralian community. A
full-length movie based on
the series was released on
23 October.

has welcomed a new host:
Sydney-raised Iya Villania.
Iya, born to both Filipino
parents but who grew up in
Australia, is the new face of
the news program’s showbiz
segment. She even went as
far as taking in the role of
Iyadora in her recaps of the
phenomenal AlDub Kalyeserye.
Ylona Garcia is surely
‘winging’ it on her new teleserye On the Wings of Love
(OTWOL), which started
airing last November. After
placing first runner-up in
Pinoy Big Brother (PBB):
737, she has been out and
about as Star Music’s newest
recording artist and #SpotifySpotlight 2016 representative. Born to medical practitioner parents, she started
singing as front act to touring
artists in Australia such as
Martin Nievera and Sarah
Geronimo. She has released
two songs on Spotify after
her PBB win, one of which
is her original composition
titled ‘Win the Fight’.
Of course, it has to be said
that OTWOL’s lead, James
Reid has become one of the
Philippines’ hottest stars,
with a regular TV show,
movies, recording deals,
concert and commercial endorsements tucked under his
belt. Like Ylona, James first
rose to fame after his PBB
Teen edition win in 2010.
Since then, there’s no stopping this Filipino-Australian
from dominating Philippine
showbiz and the hearts of
throngs of fans.

world map
And who would forget the
Filipino chef who put our
dishes on the gastronomic
map? John Carasig not only
dreams of serving Filipino
traditional cuisine to the
global community but also
of marrying his dancer beau
Dave Evangelio. Making it
to Masterchef’s Top 12 has
brought Filipino dishes and
desserts such as adobo and
halo-halo to the Australian
audience and to the judges
who were all praises for
the food’s novelty. He has
started an online-based food
venture, Adobo Kitchen,
which recreates many Filipino favourites to be served
to Australians and hopefully
to a bigger and more global
community in the future.
And the biggest feat of all
for the year 2015 is Cyrus
Villanueva who brought
the house down with his
X Factor win. In a two-peat
win following last year’s
Marlisa Punzalan, the community has once again
proven the vocal prowess

of the Filipinos. On the 24th
of November, all eyes were
glued to the TV as the 19year old from Wollonggong
broke down after being announced as the new X Factor
winner.
Being the humble Filipino
that he is, he thanked all his
supporters including his
mentor Chris Isaak. Nothing
shows best the Filipino’s
love for music than the
back-to-back win of the two
contestants. Cyrus’ selftitled album was released
on the 9th of December under
Sony Music Australia, and
we couldn’t wait for what
this year has in store.
There’s talk that these
Filipinos who bring us a
sense of pride are important
in keeping our Filipino iden-
tity. There’s no denying that
Pia Wurtzbach’s win in the
Miss Universe 2015 pageant
did unify us Filipinos, from
the parloristas back home to
the OFWs the world over—
all glued to the mishap that
happens to be her winning
announcement. And for the
hardworking Filipinos in
Australia, the Australians
with a Filipino heart, the
Ylona Garcia
disunited communities of
Filipinos, and the Filipinos
who are missing home, we
all know how these people
on our list gave us the much
needed push to keep us going through the year that
was. So by this year, we’re
keeping our fingers crossed
for a longer list and wishing

Animated short film by FilipinoAustralian makes Oscars cut

animation director and producer Robertino Zambrano’s
film Love in the Time of
March Madness has been
shortlisted in the short animation category for the 2016
Academy Awards. Robertino, who is based in Sydney,
is an animation director and
designer.
Narrated, co-produced
and co-directed by US College basketballer Melissa
Johnson, the nine-minute
animated short film is based
on Melissa’s own life story. A
lifetime in the making, Love
in the Time of March Madness was written by Melissa
and draws from her unique
and unusual life vantage
point as a tall woman on the
dating scene.
After hitting 6’4" in the 8th
grade and becoming a college basketball star, the film
follows her hilarious and
awkward misadventures in
romance as she dates shorter
men and gets cheered or
jeered wherever she goes.
It is one of ten short films
to be shortlisted for the Best
Animated Short Film Oscar.

Last year was a landmark as
we now have our own league,
the Melbourne Filipino Basketball League established by
the Filipino United Basketball Association. So important was this milestone that
the finals game became the
curtain raiser to the opening
game of the National Basketball League.
On a more local scale, the
South Eastern Australian Pilipino Basketball League had
its 9th season with 16 teams
participating. Whether large
or small scale tournaments,
nothing makes our heart
thump faster and bring Filos
together than basketball.

The Australian Filipino
Community Service (AFCS)
was in the forefront in initiating elderly care projects,
which culminated with the
holding of a forum on “Ageing
in a Foreign Land”. The forum
focused on age care services
available to families as well
as strategies for planning.
Other programs spearheaded by AFCS included
setting the Amigos para
Siempre, a volunteer program calling on help for the
needy especially the aged;
organising Memory Lane in
cooperation with elderly organisations of other cultures
for a monthly exchange of
culture through food and
entertainment, and hosting a
demonstration for preparing
finger food and pureed meals
and drinks for people with
Alzheimer’s.
The demo was conducted
by executive chef Peter Morgan-Jones, who specialises in
this type of meal preparation.
Socials were also held
such as the Christmas in July
program of Damayan of the
Filipino Community Council
of Victoria and Health and
Diversity by the Philippine
Cultural Society for Family
and Friends.

our own festivities.
The last installment of the
Philippine Fiesta and Trade
Expo featured Filipino entertainment, food and products
in various stalls. Held in the
heart of the CBD, the Fiesta
took a major step by holding
an expo to encourage trade
among Filipino entrepreneurs and those of other
nationalities. It was an ideal
meeting of business mindedindividuals.
The Philippine Festival
of Music, Arts, and Culture,
on the other hand, featured
cultural parades, a santacruzan, food, games and
entertainment, typical of
what we expect in a fiesta.
The program highlight was
the peeling of drums with
the ati-atihan performance.
We also joined other festivals, namely the Mosaic
Festival, Fringe Festival, and
festivals in Gippsland, Ballarat and Bendigo.
Community issues
and concerns
The Philippine Consulate
intensified its campaign for
acquiring dual citizenship.
The Mobile Mission generated
more than a thousand partici-
pants to procure a Philippine
passport and to reacquire
Philippine citizenship. The
move was also timely as the
Philippine Government also
amped up its drive to register
overseas Filipino voters in
time for the national elections
in May 2016.
Last year, the Philippine
community was rocked by a
controversy in the Filipino
Community Council of Victoria Inc when a breakaway
group led by Jing Sosa challenged the leadership of Perla
Luetic and called on the 32
financial members and Committee of Management for
adjournment of the Annual
General Meeting and election
of officers. Without heeding
this memo of Sosa, the AGM
and election proceeded as
planned.
Ms Luetic was re-elected
as Chairperson, while Marisa
Vedar was elected Executive
Director of the Philippine
Australia Foundation Inc.
Meanwhile, the Supreme
Court (SC) of Victoria has ordered to reinstate Maina Walkley and company as ordinary
members of the Philippine
Fiesta of Victoria Inc (PFVI) in
a decision handed down at the
close of the year. Ms Walkley
and plaintiffs earlier filed a
case against the Management
Committee of PFVI for oppressive conduct, member issues
and defamation. The SC also
asked the Management Committee to refrain from drawing
funds from the organisation
for its defense in the said legal
proceeding.
Issues concerning the Philippine community would
have constant debates and
responses. Some sides remain
unheard and some questions
remain unanswered until the
end of 2015, but not without
our persistent trying.

The Secretary of Foreign
Affairs Albert del Rosario
presented the award to
Ambassador Tweddell on
5 January 2016 as a tribute
to Australia’s long legacy of
cooperation and friendship
with the Philippines. The
Philippines and Australia
are marking 70 years of
bilateral relations in 2016.
The award was also in
recognition of four years
of dedicated service to developing the bilateral relationship, and contributing
to the overall development
of the Philippines. Ambassador Tweddell
led the humanitarian response to Typhoon Haiyan
where Australia contrib-
uted a total of $100 million
in aid and defence assets. Ambassador Tweddell has
also promoted the peace
process, stronger defence
relationships capped by
the signing of the Status of
Visiting Forces Agreement,
supported trade expansion and liberalisation,
cooperation in law enforcement, border protection
and counter-terrorism, and
maintenance of a close,
balanced and responsive
development partnership.

De facto partner visa
For our kababayans who
are lucky enough to have
found another life partner
after a failed marriage and
who are not yet divorced or
whose marriage has not been
annulled yet for some reason
can apply for a De Facto Partner Visa, if they have been in
a relationship for one year.
Migration law provides
equal recognition to spouse
relationships and to de facto
partner relationships. De facto
partner applies equally to
opposite and the same sex
couples. It requires mutual
commitment to the exclusion
of all others as in spousal relationship. De facto partners are
considered to be members of a
person’s family and relatives.
It also allows a legallymarried person but permanently living apart from the
estranged partner to be considered in a de facto relationship with another for as long
as it can be shown that the
previous relationship has
ended.
It is also necessary that the
partners are not related by
blood or even by adoption.
Even their children are given
the same recognition, benefits
and obligations with that of
opposite sex relationships.
Among other considerations,
both partners must be adults,
at least 18 years old at the time
the visa application is made.
The couple must have a
mutually exclusive relationship which is genuine and
continuing. The length of
time the partners have lived
together is also an important
consideration. However, living together does not necessarily require cohabitation,
which means residing together under the same roof.
There are instances where,
although the parties are not
residing in the same address,
they are considered living together and having an ongoing
de facto relationship.
It is accepted that partners
may be living together, even
though living separately (but
not apart on a permanent
basis) for valid reasons that
do not diminish the completeness and purity of the
relationship.
Partners in an ongoing de
facto relationship may be temporarily separated for a number of reasons. Acceptable
reasons are frequent travel
for business purposes, employment abroad or employment outside commutable
distance or an unexpected
family emergency.

Unfair dismissal claim
This complaint is most likely
resorted if the workers felt
that the dismissal is unfair,
harsh, unjust and unreasonable in the circumstances. It
is for this reason that I feel
obliged to deal on this issue
time and again for the sake
of everyone who is at the
lower and upper end of the
scale or position. This means
that unfair dismissal claim is
qualified and not everyone
has entitlement.
This is described under
section 394 of the Fair Work
Act 2009 (‘the Act’).
FAIR WORK ACT 2009 SECT 385
This particular complaint is
experienced and continued
to be experienced by many
whilst being employed. It is
not simple, but rather very
complicated more particularly when the employers,
although small businesses
are covered or defined as
associated entity within the
meaning of Section 50 AAAA
of the Corporation Act 2001
(Cth) (“the Corporation Act”).
Facts
Maria was employed by
Finke Enterprises Pty Ltd
ATF M7L Carlson Family
Trust t/a Fused Café Pender
Place for about 7.5 months as
Barista. For some reason or
the other, she was dismissed
without notice. This is being
said to be a small business
employer. Due to what Maria
thought to be unfair, harsh
and unreasonable she went
to the FWC to complain her
unfair dismissal and sought
appropriate relief under sec-
What is an unfair
dismissal?
“A person has been unfairly
dismissed if the Fair Work
Commission (FWC) is satisfied that:
(a) the person has been
dismissed; and
(b) the dismissal was
harsh, unjust or unrea-
tion 394 of the Fair Work Act
(2009) (Cth) (‘the Act’).
At the time of her dismissal the employer has 12
employees 7 of which were
casual employees who are
employed on regular and
systematic basis.
The employer objected to
the complaint and sought
its dismissal claiming that
as employer and small busi-
ness it is protected unfair
dismissal claim. So, in
short this is jurisdictional
issue that the FWC has to
deal prior to formal hearing
to determine the merit of
the case.
Maria claims that Carlson Group Australia Pty
Ltd. (Carlson Group) is an
associated entity of Finke
Enterprises and operates
the Fused Café where
Maria was working. It
was not in dispute that
Mr & Mrs Carlson both
have effective control of
the Finke Enterprises and
Carlson Group.
Further to this, Maria added that Carlson Group has
another six employees apart
from 12 employees earlier
mentioned to make up a
total of 21 employees.
Issue: The question
now is whether or
not the employer (Finke
Enterprises) is an entity of
Carlson Group and whether
or not entity includes a natural person defined under
section 64A of the Corporation Act and part of course
of the issues if jurisdictional
issue is resolved positively
is whether the dismissal is
unfair under section 394 of
the Act?
Conclusion
The FWC in this instance
supports Maria. It is satisfied that both enterprises
(Carlson Group and Finke
Enterprise) are associated
entities within the meaning of section 50AAA of
the Corporation Act with
the combined number of
employees of more than
15 which is the threshold
number for small business.
This means that the employer is no longer small
business within the protective mantle of unfair
dismissal claims.
Therefore, the jurisdictional complaint of the
employer is dismissed and
the case continues to be
heard to deal a significant
issue whether or not the
applicant or Maria’s dismissal was unfair, unjust
and unreasonable under
section 394 of the FW Act

Papal Nuncio stresses compassion in homily
Papal Nuncio Archbishop
Adolfo Yllana emphasised
Christ’s compassion for humanity with his birth as a human being and his death on
the cross in his homily on the
occasion of the Traslacion of
the Black Nazarene on 8 January 2016. The Mass was held
7pm at the St Mary Star of the
Sea Holy Family Shrine.
In his first Mass to the
Filipino community in Melbourne, the Papal Nuncio
shared that it was through
Jesus that God’s love spread
for all humanity, that hope
and promise of eternal life
and salvation from all sufferings was attained. “We
have once been condemned
to a fate of eternal death
and suffering because of our
sins and disobedience, but
the Lord who loves us all,
wanted another fate for us,”
the Filipino Archbishop said
in his homily.
Another message conveyed
by the Papal Nuncio dwelt on
humility. He drew from the
day’s reading God’s proclamation of Jesus as the saviour of the world during His
baptism. When He healed
the sick, like the leper in the
Gospel who suffered physical pain and stigma from
society, asked the leper not
to declare Jesus as his healer.
Jesus did His work “for their
sake entirely, and not for His
own glory”.
At the end of the homily,
Archbishop Yllana extended
an invitation to the faithful
to renew one’s commitment
to the Lord and strengthen
one’s faith in Him. In so doing, he says in conclusion,
“We may always bring glory
to Him and also that we may
remain always in His grace
and love, that we will never
be separated again from His
love.”
In honour of the Black
Nazarene, a Novena and
procession were also held
as per tradition on the same
day. Between 5 and 7 January,
Triduum Masses were also
celebrated.
