#99-2-16 • EATON COUNTY, MICHIGAN 1999 ELECTRICAL CODE Ordinance No. Commissioner Brehler moved the approval of the following Resolution. Seconded by Commissioner Kempf. AN ORDINANCE TO AMEND THE EATON COUNTY ELECTRICAL CODE, AS AMENDED, TO ADOPT BY REFERENCE THE National Electrical Codef) (1999 Ed.) AND. TH E Residential Electrical Maintenance Code For One And Two· Family Dwellings (1994 Ed.), AND AS AMENDED HEREIN, TO PROVIDE FOR CERTAIN VIOLATIONS OF SAID ORDINANCE TO BE MUNICIPAL CIVIL INFRACTIONS; TO DESIGNATE AUTHORIZED LOCAL OFFICIALS TO ENFORCE MUNICIPAL CIVIL RESPONSIBLE INFRACTION VIOLATIONS OF THE ELECTRICAL CODE; TO PLACE THE VIOLATIONS BUREAU AT THE EATON COUNTY CONSTRUCTION CODE DEPARTMENT; TO ADOPT A SAVINGS CLAUSE; AND TO PROVIDE AN EFFECTIVE DATE. • WHEREAS, Eaton County is authorized to adopt and enforce a nationally-recognized model electrical code or other nationally-recognized code; and WHEREAS, the 1999 edition of NfiPA 70, commonly known as the National Electrical Codef) and the 1994 edition of NfiPA 73 commonly known as the Residential Electrical Maintenance Code For One And Two Family Dwellings, published by the National Fire Protection Association, are nationally-recognized model electrical codes; THE COUNTY OF EATON ORDAINS: SECTION 1. ADOPTION OF "NATIONAL ELECTRICAL CODE" (1999 ED.) AND "RESIDENTIAL ELECTRICAL MAINTENANCE CODE FOR ONE AND TWO FAMILY DWELLINGS" (1994 Eo.) The County of Eaton adopts by reference the 1999 edition of NfiPA 70, commonly known as the National Electrical Codef) and the 1994 edition of NfiPA 73 commonly known as the Residential Electrical Maintenance Code For One And Two Family Dwellings, published by the National Fire Protection Association as the 1999 Eaton County Electrical Code. • • SECTION 2. AMENDMENT OF ARTICLE 90 ("Introduction") OF THE NATIONAL ELECTRICAL CODE. Subsection 90-12 is added to read: Permits A person shall not or allow anyone to equip a "90-12 building with electrical conductors or electrical equipment or make an alteration to, change in or addition to any electrical conductors or electrical equipment without first, making application and obtaining an electrical permit from Eaton County. If the electrical wiring and/or equipment for which a permit has been issued has been inspected by the Eaton County Electrical Official and found to be in compliance with the Eaton County electrical code, then an approved inspection notice shall be placed on it or in a conspicuous location indicating that the inspection has passed. This section of the code does not apply to installations that are referred to in 1956 PA 217 §§ 7 (3) (a), (b), (c), (d), (e), (f), (h), (k) or (I), as amended, being Michigan Compiled Laws §§ 338.887 (3) (a), (b), (c), (d), (e), (f), (h), (k) or (1)." Section 90-13 is added to read: 1190-13 • • 1. Who May Obtain A Permit: To obtain electrical permits, an applicant shall be one of the following: A. A homeowner who occupies or will occupy a single family dwelling for which the permit is being obtained and who will install the electrical wiring and/or equipment as certified by the homeowner's affidavit as in~icated on the permit application. The homeowner shall also sign the application as the applicant. 8. A person who has obtained an electrical contractors license and a master electricians license, or has in his exclusive full time employment a master electrician under 1956 PA 217 as amended, being Michigan Compiled Laws § 338.881 and has properly registered his licenses with Eaton County. The contractor of record shall sign the application as the applicant. C. A person, firm, or corporation that employs a licensed master electrician to actively supervise the installation of electrical equipment on premises which are owned or occupied and Eaton County Electrical Code Adopted 17-Feb-99 2 • • • used by the applicant in the conduct of his business and at which the licensed electrician performs his duties ill those instances where business or industrial procedures require the regular employment of a licensed master electrician. However, an affidavit furnished by Eaton County shall be signed by both the employer and the licensed master electrician. The affidavit shall be kept in the possession of the Eaton County Electrical Inspector and shall contain the following information: 1. The name and address of the person, firm, or corporation who employs the licensed master electrician. 2. The name and address of the master electrician. 3. The license nUITlber of the master electrician and the name of the licensing authority (must provide the county with a copy of his current master license). 4. A statement that the employer and the licensed master electrician will comply with all provisions of the Eaton County Electrical Code that regulates the installation and maintenance of electrical equipment. 2. To obtain fire alarm system permits, as defined in 1956 PA 217 § 1a (1) as amended, being Michigan Compiled Laws § 338.881 a (1), an applicant shall be one of the following: A. A -person who has obtained an electrical contractors license and a master electricians license, or has in his exclusive full time employment a master electrician under 1956 PA 217, being Michigan Compiled Laws § 338.881 and has properly registered his licenses with Eaton County. The contractor of record shall sign the application as the applicant. B. A person who has obtained a fire alarm specialty contractors license under 1956 PA 217 as amended, being Michigan Compiled Laws § 338.881 and has properly reg~stered his Iicense/s with Eaton County. The contractor of record shall sign the application as the Eaton County Electrical Code Adopted 17-Feb-99 3 • applicant. C. A person, firm, or corporation that employs a licensed master electrician to actively supervise the installation of electrical equipment on premises which are owned or occupied and used by the applicant in the conduct of his business and at which the licensed electrician performs his duties in those instances where business or industrial procedures require the regular employment of a licensed master electrician. However, an affidavit furnished by Eaton County shall be signed by both the employer and the licensed master electrician. The affidavit shall be kept in the possession of the Eaton County Electrical Inspector and shall contain the following information: • 1. To obtain- electrical sign or outline lighting permits, as defined in 1956 PA 217 §§ 1b (1) and (2) as amended, being Michigan Compiled Laws §§ 338.881 b (1) and (2), an applicant shall be one of the following: • A. A person who has obtained an electrical contractors license and a master electricians license, or has in his exclusive full time enlployment a nlaster electrician under 1956 PA 217 as amended, Michigan Compiled Laws § 338.881 and has properly registered his licenses with Eaton County. The contractor of record shall sign the application as the applicant. B. A person who has obtained a sign specialty contractors Eaton County Electrical Code Adopted 17-Feb-99 4 • license under 1956 PA 217 as amended, being Michigan Compiled Laws § 338.881 and has properly registered his Iicense(s) with Eaton County. The contractor of record shall sign the application as the applicant. C. A person, firm, or corporation that employs a licensed master electrician to actively supervise the installation of electrical eq'uipment on premises which are owned or occupied and used by the applicant in the conduct of his business and at which the licensed electrician performs his duties in those instances where business or industrial procedures require the regular employment of a licensed master electrician. However, an affidavit 'furnished by Eaton County shall be signed by both the employer and the licensed master electrician. The affidavit shall be kept in the possession of the Eaton County Electrical Inspector and shall contain the following information: • 1. A statement that the employer and the licensed master electrician will comply with all provisions of the Eaton County Electrical Code that regulates the installation and maintenance of electrical equipment. 4. To obtain electrical permits for water well pumps for single family dwellings only, as defined in 1978 PA 368, Part 127 as amended, being Michigan Compiled Laws §§ 333.12701 to 333.12771, an applicant shall be one of the following: A. • A person who has obtained an electrical contractors license and a master electricians license, or has in his exclusive full time employment a master electrician under 1956 PA 217 as amended, being Michigan Eaton County Electrical Code Adopted 17-Feb-99 5 Compiled Laws § 338.881 et seq, and has properly registered his licenses with Eaton County. The. contractor of record shall sign the application as the applicant. • B. C. • A person who has obtained a pump installers license under 1978 PA 368, Part 127 as amended, being Michigan Compiled Laws §§ 333.12701 to 333.12771, and has properly registered his license(s) with Eaton County. The contractor of record shall sign the. application as the applicant. A person, firn1, or corporation that employs a licensed master electrician to actively supervise the installation of electrical equipment on premises which are owned or occupied and used by the applicant in the conduct of his business and at which the licensed electrician performs his duties in those instances where business or industrial procedures require the regular employment of a licensed master electrician. However, an affidavit furnished by Eaton County shall be signed by both the employer and the licensed master electrician. The affidavit shall be kept in the possession of the Eaton County Electrical Inspector and shall contain the following information: 1. The name and address of the person, firm, or corporation who employs the licensed master electrician. 2. The name and address of the master electrician. 3. . The license number of the master electrician and the name of the licensing authority (must provide the county with a copy of his current master license). 4. A statement that the employer and the licensed master electrician will comply with all provisions of the Eaton County Electrical Code that regulates the installation and maintenance of electrical equipment. 5. To obtain telecommunication wiring permits, an applicant shall be one of the following: • Eaton County Electrical Code Adopted 17-Feb-99 6 • C. • A. A person who has obtained an electrical contractors license and a master electricians license, or has in his exclusive full time employment a master electrician under 1956 PA 217 as amended, being Michigan Compiled Laws § 338.881 and has properly registered his licenses with Eaton County. The contractor of record shall sign the application as the applicant. B. A person, firm or corporation who is primarily engaged in the telecommunications and related information. systems industry. A person, firm, or corporation that employs a licensed master electrician to actively supervise the installation of electrical equipment on premises which are owned or occupied and used by the applicant in the conduct of his business and at which the licensed electrician performs his duties in those instances where business or industrial procedures require the regular employment of a licensed master electrician. However, an affidavit furnished by Eaton County shall be signed by both the employer and the licensed master electrician. The affidavit shall be kept in the possession of the Eaton County Electrical Inspector and shall contain the following information: 1. The name and address of the person, firm, or corporation who employs the licensed master electrician. 2. The name and address of the master electrician. 3. The license number of the master electrician and the name of the licensing authority (must provide the county with a copy of his current master license). 4. A statement that the employer and the licensed master electrician will comply with all provisions of the Eaton County Electrical Code that regulates the installation and maintenance of electrical equipment. Section 90-14 is added to read: 1190-14 • Application For Permit: Eaton County Electrical Code Each application for a permit, with Adopted 17-Feb-99 7 • the required fee, shall be filed with the electrical official on a form furnished by Eaton County. The application shall indicate the proposed u~e and occupancy of all parts of the building and of that portion of the site or lot, if any, not covered by the building or structure and shall contain such other information required by the electrical official. JJ Section 90-15 is added to read: "90-15 Action on Application: The electrical official shall examine or cause to be examined all applications for permits and amendments thereto within a reasonable time after filing. If the application or the construction documents do not conform to the requirements of all pertinent laws, the electrical official shall reject such application in writing, stating the reasons therefor. If the electrical official is satisfied that the proposed work conforms to the requirements of the code and all laws and ordinances applicable thereto, the electrical official shall issue a permit therefor as soon as practicable." Section 90-16 is added to read: • "90-16 Revocation Of Permit: The electrical ofFicial shall revoke a permit or approval issued under the provisions of this code in case of any false statement or misrepresentation of fact in the application or on the construction documents upon which the permit or approval was based." Section 90-17 is added to read: "90-17 Expiration Of Permit: Every permit issued by the electrical official under the provisions of this code shall expire by limitation and become null and void if the work authorized by such permit is not commenced within 180 days from the date of such permit, or if the work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of 180 days. Before such work recommences, a new permit shall be first obtained and the fee, therefor, shall be one-half the amount required for a new permit for such work, provided no changes have been made or will be made in the original construction documents for such work, and provided further that such suspension or abandonment has not exceeded one year." Section 90-18 is added to read: "90-18 • Pernlit Abandonment: Eaton County Electrical Code If a permit holder quits the Adopted 17-Feb-99 8 • installation of electrical wiring or electrical equipment, for any reason, that person shall immediately notify the Eaton County Electrical Official.:' Section 90-19 is added to read: "90-19 Required Final Inspection: Every permit issued by the electrical official under the provisions of this code shall have a final inspection. If a permit holder quits an installation before it is completed that person shall immediately notify the electrical official and request a final inspection. The electrical official shall inspect the work installed and record the acceptance of, or violations against the work. No refunds shall be made for the permit. " Section 90-20 is added to read: "90-20 Building Owner Inspection: If the permit holder quits the installation after the electrical wiring and/or electrical equipment has been installed and fails to notify the electrical official for a final inspection, then the building owner or his agent may notify the electrical official and request that inspection. The electrical official shall inspect the work installed and record the acceptance of, or violations against the work. The permit holder shall be sent a notice of any violations." • Section 90-20(a) is added to read: "90-20(a) Reinspection And Testing: Where any work or installation does not pass an inspection, the necessary corrections shall be made within 10 (ten) working days so as to achieve compliance with this code. The work or installation shall then be resubmitted to the code official for inspection." Section 90-21 is aGded to read: "90-21 Transfer of A Permit: An electrical permit may not be transferred from one entity to another." Section 90-22 is added to read: "90-22 Construction Documents: Construction documents, engineering calculations, diagrams and other data shall be submitted in two sets with each application for a permit. Construction documents for buildings of 2 (two) stories or more shall indicate where penetrations will be made for • Eaton County Electrical Code Adopted 17-Feb-99 9 ------ ----- - - • ---------------- electrical wiring and/or electrical equipment and shall indicate the materials and methods for maintaining required structural safety, fire resistance ratings and fire blocking. The construction documents shall also include all of the following details: A. B. C. D. E. F. G. H. I. ~ Lighting layout Circuitry Swifching Conductor and raceway sizing Wattage schedule Service location and riser diagram Load calculations Selection of suitable disconnecting and overcurrent devices All conductors are assumed to be copper unless otherwise indicated in the construction documents." Section 90-22(a) is added to read: • 1190-22(a) Responsibility for Design: Eaton County, when approving construction documents, does not assume any responsibility for the design or for any deviations therefrom. Construction documents that are approved by Eaton County, or a certified copy thereof shall be available on the job site for the use of the electrical official or other Eaton County Construction Department employees." Section 90-22(b) is added to read: 1190-22(b) Plans and Specifications Preparation: Plans and specifications f9r new construction work, alterations, repair, expansion, addition, or modification work shall be prepared by or under the direct supervision of an architect or engineer licensed pursuant to 1980 PA, as amended, being Michigan Compiled Laws § 339.101 et seq, and shall bear that architect's or engineer's signature and seal. Exceptions: A. Alterations and repair work determined by the building ofFicial and electrical official to be of a minor nature. B. Work performed by a governmental subdivision (Township, City, Village, etc.) With a total cost of construction (building, . electrical, mechanical and plumbing) with a total cost of not • Adopted 17-Feb-99 Eaton County Electrical Code 10 • more than $15,000.00. C. A building of use group R-3 or R-4 containing not more than 3,500 square feet of building area." Section 90-23 is added to read: "90-23 Permit Holder On Job Site: Eaton County, through the electrical official, reserves the right to require a representative of the permit holder to be at the job site when an inspection is performed." Section 90-23(a) is added to read: "90-23(a) Trade Representative On Job Site: An electrical contractor who is responsible for the installation of, alteration to, change in or addition to any electrical wiring and/or electrical equipment shall have a licensed tradesman on the construction site at all times when electrical work is in progress." Section 90-25 is added to read: • "90-25 Inspection Notice: The electrical official shall be given no less n that 24 hours notice when calling for an electrical inspection. Section 90-26 is added to read: "90-26 Posting And Removal Of Inspection Notices: A notice of inspection shall be posted in a conspicuous location on the construction site by the electrical official. The inspection notice may not be removed from the construction site by anyone other than the electrical official until the n project has been completed and a final approval has been given. Section 90-27 is added to read: "90-27 Concealing Wiring: A person shall not conceal, or cause to be concealed, any electrical wiring and/or electrical equipment before it has been inspected and approved by the electrical official." Section 90-28 is added to read: "90-28 Requests For Information: The Eaton County Construction Code Department is not responsible for code interpretations or • Adopted 17-Feb-99 Eaton County Electrical Code 11 • other information relative to electrical installations given over the telephone. Requests for information shall be made in person or in writing." Section 90-29 is added to read: Violation Penalties: Any Person who violates this code "90-29 or causes this c~de to be violated or fails to comply with any of the requirements of this code or who shall erect, install, alter or repair electrical wiring or electrical equipment in violation of the approved construction documents, work outlined on a permit application or a directive of the code official, or of a permit or certificate issued under the provisions of this code, shall be guilty of a misdemeanor, punishable by a fine of not more than Five Hundred ($500.00) Dollars or by imprisonment not exceeding 90 days, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense. A violation includes any act which is prohibited or made or declared to be unlawful or an offense and any omission or failure to act where the act is required by the Eaton County Electrical Code." Section 90-30 is added to read: • Municipal Civil Infraction: "90-30 A. Any violation of any provision of the following subsections of this code or any exception granted thereunder, shall be a municipal civil infraction: 1. Article 90-12 [performing work without an electrical permit] 2. Article 90-13 [failure to register contractors license with Eaton County before performing work within Eaton County] 3. Article 90-19 [not obtaining required inspections after a electrical permit has been issued, or not obtaining a final inspection] 4. Article 90-20 [not obtaining required inspections after a electrical permit has been issued, or not obtaining a final inspection] 5. Article 90-20(a) [not correcting a code violation within 10 days of notice of violation] 6. • Article 90-21 [transferring a permit from one entity to another. Adopted 17-Feb-99 Eaton County Electrical Code 12 • 7. Article 90-23 [not being available, when requested, during an inspection] 8. Article 90-23(a) [not having a tradesman on the construction site during construction] 9. Article 90-31 [unlawful continuance (not honoring a stop work ordefj]. B. The sanction for any violation of the subsections of the Electrical Code listed in the immediately preceding subsection which are municipal civil infracti6ns shall be a civil fine, plus any costs, damages, expenses and other sanctions, as authorized under Chapter 87 of 1961 PA 236, as amended, and other applicable laws. C. The Director of the Eaton County Construction Code Department, Eaton County Electrical Inspectors and deputies of the Eaton County Sheriff are the County Officials authorized to issue municipal civil infraction citations and municipal civil infraction violation notices for violations of the subsections of the Electrical Code listed above. • D. In addition to enforcement of violations as municipal civil infractions, enforcement of violations of the subsections of the Electrical Code listed above may be accomplished by civil action, along with any other remedies provided by law. Violations of this code are hereby declared a nuisance, per se, and adjudication of responsibility for a municipal civil infraction violation of the subsections of the Electrical Code listed above sha.ll not preclude other civil proceedings to abate such nuisance. E. The Violations Bureau shall be located at the Eaton County Construction Code Department offices in the Eaton County Courthouse, 1045 Independence Blvd., Charlotte, MI 48813." Section 90-31 is added to read: "90-31 Stop Work Orders: Upon notice from the code official that electrical work is being done contrary to the provisions of this code or in a dangerous or unsafe manner, such work shall immediately cease. Such notice shall be in writing and shall be given to the owner of the property, or to the owner's agent, or to the person doing the work, or on the job site in a conspicuous location. The notice shatl state the conditions under which work is authorized to resume. Where an emergency exists, the code official • Adopted 17-Feb-99 Eaton County Electrical Code 13 • shall not be required to give a written notice prior to stopping the work. Any person who shall continue any work on the system after having been served with a stop work order, except for work that directed to be completed to remove a violation or unsafe condition, shall be guilty of a misdemeanor, punishable by a fine of not more than Five Hundred ($500.00) Dollars or by imprisonment not exceeding 90 days, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense." SECTION 3. REPEALER All ordinances in conflict are repealed only to the extent necessary to give this ordinance full force and effect. SECTION 4. SEVERABILITY The various parts, sections and clauses of this ordinance are hereby declared to be severable. Should any part, clause, sentence, paragraph or section of this ordinance be found invalid or unconstitutional for any reason by any court of competent jurisdiction, any such decision shall not affect the validity of the remainder of this ordinance. • SECTION 5. SAVINGS CLAUSE All proceedings pending and all rights and liabilities existing, acquired or incurred at the time this ordinance takes effect are saved and may be consummated according to the law in force when they were commenced. SECTION 6. EFFECTIVE DATE The provisions of this ordinance are ordered to take effect after publication and approval by the State of Michigan, Construction Code Division.
