NOTICE TO INFORM ON THE LODGEMENT OF STATUTORY
DOCUMENTS FOR INDIVIDUALS BLACKLISTED AS A CONSEQUENCE
OF FAILING TO SETTLE COMPOUNDS ISSUED FOR OFFENCES
COMMITTED UNDER THE COMPANIES ACT 1965

Please note that with effect from 1st December 2015, the Companies Commission of
Malaysia (SSM) will be implementing the second phase of blacklisting individuals
who have two or more outstanding compounds issued up to year 2014 for offences
committed under the Companies Act 1965 (Act 125).
Any lodgement of statutory documents such as Form 49, 48B, 48C and 48E to be
queried as long as the status of the individual concerned is still in the “black list”.
This blacklisting will also affect the formation of companies and the filing of First
Forms after the incorporation of the companies via MyCoID system. As a result, the
statutory documents could not be registered, appointment of directors could not be
effected and you may not be able to incorporate any companies.

Therefore, your immediate attention towards this matter is required and kindly check
on the individual's status before any documents are being lodged to SSM. The
checking may be conducted via "e-Compound" which can be accessed under the
"e-Services" in SSM's official website at www.ssm.com.my.

NOTIS MAKLUMAN BERHUBUNG SERAHSIMPAN DOKUMEN
BERKANUN BAGI INDIVIDU YANG DISENARAIHITAM ATAS
KEGAGALAN MENJELASKAN KOMPAUN BAGI KESALAHAN DI
BAWAH AKTA SYARIKAT 1965

Sila ambil perhatian bahawa bermula pada 1 Disember 2015 Suruhanjaya Syarikat
Malaysia (‘SSM’) akan melaksanakan FASA KEDUA penyenaraian hitam
melibatkan individu yang mempunyai 2 notis kompaun tertunggak untuk tempoh
2014 ke bawah bagi kesalahan di bawah Akta Syarikat 1965 (Akta 125).
Tindakan penyenaraian hitam ini akan menyebabkan sebarang serahsimpan
dokumen berkanun seperti Borang 49, 48B, 48C dan 48E akan dikueri selagi status
individu berkenaan masih dalam senarai hitam. Tindakan ini juga akan menjejaskan
penubuhan syarikat dan pemfailan Borang Pertama atau First Forms pasca
penubuhan syarikat melalui sistem MyCoid. Akibatnya, dokumen berkanun tidak
dapat didaftarkan, pelantikan pengarah tidak dapat diteruskan dan pihak tuan/puan
tidak dapat menubuhkan syarikat.

Justeru, pihak tuan / puan dinasihatkan untuk memberi perhatian yang serius
terhadap perkara ini dan menyemak terlebih dahulu status individu sebelum
menyerahsimpan dokumen ke SSM. Semakan status kompaun tertunggak boleh
dibuat di modul semakan e-Kompaun yang boleh diakses di bawah menu
e-Perkhidmatan di laman sesawang rasmi SSM iaitu di www.ssm.com.my.
Kerjasama pihak tuan / puan amat diharapkan agar dapat dipanjangkan Notis
Makluman ini kepada pengarah-pengarah syarikat di bawah kendalian tuan / puan.
