Planners Comments: The subject property is a regularly shaped lot located on the west side of
North 9th Street and measures approximately 9,966 square feet in area. Currently existing on
the site is a rental storage structure. The site is completely paved with impervious material and
slopes east towards North 9th Street. In addition, the structure presently exists a few feet from
the western property line and is surrounded entirely by county owned structures and land.
Located to the northwest behind the county jail; is an impound lot and the district courthouse;
paved parking surrounds these uses.
The applicant is proposing to construct a 5,867 square foot raised office building with parking
located on the ground floor underneath the elevated structure. In addition, green space has
been added as per Neighborhood Conservation Overlay requirements.
Setbacks in (GB) General Business zoned districts are; from the public ROW as follows:
Front: fifteen (15’) feet
Sides: ten (10’) feet
Rears: fifteen (15’) feet

The applicant is requesting a 9-foot rear yard setback variance to construct an elevated office
building. While the proposed project is an improvement to the existing non-conforming
structure, a hardship has not been clearly demonstrated.
A variance request may be granted under the terms of the Ordinance after the applicant can
demonstrate the following:
a. That special conditions and circumstances exist which are peculiar to the land,
structure, or building involved and which are not applicable in to other lands,
structures, or buildings in the same district;
b. That literal interpretation of the provisions of this ordinance would deprive the
applicant of rights commonly enjoyed by other properties in the same district under
the terms of this ordinance;
c. That the special conditions and circumstances do not result from the actions of the
applicant; and
d. That granting the variance requested will not confer on the applicant any special
privilege that is denied by this ordinance to other lands, structures, or buildings in
the same district.
Recommendation: If the applicant can demonstrate a hardship not self-created staff
recommends the following conditions accompany the request for the nine-foot (9’) rear yard
setback variance request:
1.
Variance request is for the attached site plan
2.
All stormwater requirements are met and approved by the Public Works
department prior to the issuance of a building permit.
3.
Impervious coverage of the lot shall not exceed 60% of total lot area, as per
section 148.07 (3) of the Land Development Code
