REPORT Mission to Georgia December 21-24, 2014 REGULATORY GUILLOTINE PROJECT IN ARMENIA Legislative process /Regulatory Framework/ Regulatory Reforms in Georgia The Regulatory Guillotine project in Armenia - funded by the Austrian Development Agency, Organization for Security and Co-operation in Europe and the World Bank - organized a study tour in Tbilisi, Georgia for the purpose of getting familiarized with the legislative reforms of the country in different sectors of economy, studying Georgian Legislative Procedures’ and Regulatory Framework related policies, structures and practices, familiarizing themselves with the Georgian model of Regulatory Decision making principles and the dialogue between the public and private sector, also changing experience based on the economic reforms in Georgia moving to a relatively wellfunctioning market economy in 2014. The delegation headed Armen Yeghiazaryan, Director of the National Centre for Legislative Regulation and included experts reviewing different spheres of the Armenian legislation. The 3-day mission included up to 10 meetings with heads/representatives of ministries and other state agencies, international organizations, projects and parliamentarians. DAY 1: December 22, 2014 Meeting #1, Public Service Hall - National Agency of Public Registry (NAPR) under the Ministry of Justice of Georgia Hosted by: Ekaterina Meskhiadze, Head of International Relation Division Regulatory Guillotine Project team: Armen Yeghiazaryan (Director), Heghine Manukyan (Deputy Director), Vahe Chibukhchyan (Deputy Director), Sonya Hovsepyan, Lilit Gulkanyan, Nelli Harutyunyan, Lilit Meshchyan, Karen Ghaltakhchyan, Lusine Tovmasyan, Garri Kasparov and Tamar Minasyan The customer-oriented operating in Georgia. registration It involves: “ONE-STOP-SHOP” principle; system is o Centralized registration and cadastre system & decentralized customer service (delivering services by the authorized users), o Simplified property registration procedure, and; o Voluntary notarization, electronic application and receipt of the abstract, cadastral plan and other documents, availability of distance registration service and cadastral map of Georgia. The meeting was divided into two parts. 1. NCLR team was introduced the way the Public Service Hall was running in reality (tour and case study). 2. NCLR team was provided by thorough presentation on procedure of property registration and business registration methodology. Property registration: During the meeting Ekaterina Meskhidze represented the property registration procedure (Picture 1), registration terms and fees (Picture 2). Talking about cadastre in Georgia, Mrs. Meskhidze stated that: The cadastral survey work is done by the private sector, NAPR is responsible for the maintenance of cadastral data, there is a centralized processing of cadastral data via internet, data storing/processing is done by using ESRI ARCGIS software, GIS operator inserts data in SDE server, makes situational map, exports it in PDF format and uploads it on PDF servers. She also mentioned that there is a public access to cadastral data Picture 1: 2 Picture 2: Business and Non-Commercial Entities registration: During the meeting Mrs. Meskhidze represented also 1. the business registration procedure (Picture 3), 2. registration terms and fees (Picture 4), 3. the documents needed for registration of a business in Georgia (application; a copy of ID of a person filing the application; registration application (Charter/Partners’ Agreement/Certificate of Incorporation) duly certified and signed by all partners/founders; a document confirming payment of registration service fee). She also told that in some cases additional documents can be needed. Picture 3: Starting Business • Access to charter of all legal forms via NAPR website • On-line access of Tax Department to NAPR database • Reports about transactions sent to TD in every five minutes • Voluntary notarization of agreements • Public access to any registration document • Centralized system Picture 4: 3 For NCLR, it was much informative and helpful to hear about Georgian practice and especially their approach of solving such arduous problems. Meeting #2, Ministry of Economy and Sustainable Development of Georgia Hosted by: Lali Gogoberidze, Head of Economic Analysis and Policy Department and Mariam Gabunia, Deputy Head of Department for Foreign Trade and international Economic Relations Regulatory Guillotine Project team: Vahe Chibukhchyan (Deputy Director), Lilit Meshchyan and Lusine Tovmasyan The following topics were discussed during the meeting: Licenses and Permits: obtaining processes, necessary documentation, implemented and ongoing reforms; Certificate of Origin; Implemented reforms to enhance economic activity; Regulatory impact assessment; The process of obtaining of the permit for goods of dual-use on import, export, reexport, transit and it’s similarities between the Armenian system. Previously the permits were issued by the Ministry of Economy and Sustainable Development of Georgia. Currently the permits are issued by the Revenue Service of Georgia. The decision was made to make the permit issuing process more effective. Permits are issued within 20 days. When the imported or exported item belongs to the list of sensitive items, a recommendation of the Inter-departmental Committee of Military and Technical Cooperation of the Ministry of Defense is needed. The permit can be obtained at any border checkpoint, as well as the Customs Department based on written or electronic application. Since September 1, 2014, Certificate of Origin EUR.1 is issued by the Revenue Service of Georgia. The changes were made in accordance with the Association Agreement between Georgia and the EU, including the Deep and Comprehensive Free Trade Agreement. The Certificate of origin is issued within 3 working days and can be obtained in the Customs Department, based on written or electronic application. During past 8 years Georgian Government implemented a reform policy to enhance economic activity. To achieve this purpose the reforms were held in several directions. The main directions were elimination of licenses and permits, except the ones that were necessary for healthcare, security and environment protection purposes, simplification of tax system and fight against corruption. As a result now there are 100 licenses instead of previously existing 900. Natural and legal entities can apply for the licenses and permits electronically and one-stop shop principle is implemented. 4 The tax types were reduced to 6 flat taxes instead of previously existing 21. Tax rates were reduced and now it is possible to pay all taxes electronically. Implemented reforms combined with the anticorruption policies in state agencies guaranteed increased economic activity and greater budget revenues. Georgian officials represented the current state of Regulatory Impact Assessment (RIA) process in Georgia. RIA was implemented in Georgia in 2007. A unit within the Ministry of Economy and Sustainable Development of Georgia was trained to undertake Regulatory Impact Assessment. Presently International Organizations’ experts group is working on the design of the improved RIA which will be implemented in Georgia. Meeting #3, Ministry of Labour, Health and Social Affairs of Georgia Hosted by: Valeri Kvaratskhelia, Deputy Minister of Labour, Health and Social Affairs of Georgia and representatives of Lepl State Regulation Agency for Medical Activities Regulatory Guillotine Project team: Armen Yeghiazaryan (Director), Heghine Manukyan (Deputy Director), Karen Ghaltakhchyan, Nelli Harutyunyan, Lilit Gulkanyan and Tamar Minasyan Issues discussed during the meeting were the following: The mission and functions of the Ministry in the drug regulation; Regulation of vaccines; Registration and import/export of medical equipment; Procedures for sale of drugs in drug stores, tools applied for supervision and control of quality; Georgian legislation on free medical assistance and service; Budgetary allocations and their distribution; Drug related licensing procedures; and, Other preconditions for activities in this sphere. The Deputy Minister asked to tell more about the NCLR, particularly motives for its establishment, activity and the progress of the reforms in Armenia. Mr. Yeghiazaryan, Director of the NCLR told about NCLR main directions of its activities, relations with other Government agencies, local authorities, businessmen and citizens. 5 The NCLR representative presented NCLR’s recommendations in drug related policies as well as the Armenian legislation on healthcare and particularly, the new draft law “On drugs” and procedures required for its implementation. Numerous inquiries were made by the NCLR representatives during the meeting, including: Implementation of GMP, GLP, GDP, GSP, GCP standards, Supervision of the production, Import/export And sanitary rules for the preservation of drugs, The procedure for implementing parallel import and its results, Reduction of prices and stimulation of competition. Availability of competitive markets, Expert laboratories for drugs and their certification, Reference laboratories for dealing with disputes. Meeting #4, Ministry of Labour, Health and Social Affairs of Georgia Hosted by: Irakli Margvelashvili, Executive Director Regulatory Guillotine Project team: Karen Ghaltakhchyan and Garry Kasparov Irakli Margvelashvili described the current conditions of drug market during the meeting. Since he was familiar with NCLR's activities and its proposed reforms (Mr. Margvelashvili has visited RA MOH as well as the "Drug and Medical Technology Expertise Centre’ and was in connection with the NCLR representatives and MPI Union), he explained the nature of the 2005-2015 reforms and their impact on the inflation rate in the industry. Issues discussed during the meeting were as follows: • Import-export customs procedures of medication; • licensing mechanisms of pharmaceutical industry The NCLR representative briefly presented the new draft law on drugs and other related legal amendments. The following issues were raised during the discussions: o Implementation of GMP, GLP, GDP, GSP, GCP standards process, o The process of drugs manufacture, o Import, export, o Sanitary standards of storage; and, o Control mechanisms. Mr. Margvelashvili mentioned that the legislation should be amended in order to allow foreign companies to take advantage of Armenian organizations providing laboratory testing, he stressed 6 that , "Liquor" Local company was equipped with the latest technologies and had the ability to provide services not only for resident, but also nonresident companies. The following questions were in the Agenda of the day as well, such as: o The availability of drugs laboratories, o Their certification, o Competitiveness of the market; and, o Reference laboratories for dispute resolution. It was stated that the Georgian market was liberalized; however there were not many laboratories still existing. They did not have a reference laboratory; therefore they outsourced the service in Europe, pointing the possibility to use the Armenian companies, if they passed the appropriate certification process and receive certification. Meeting #5, Agricultural Cooperatives Development Agency Hovsepyan, Nelli Harutyunyan and Lilit Gulkanyan Hosted by: Ana Sabakhtarishvili, Deputy Chairman and Kakha Nadiradze, Head of Targeted Projects Department Regulatory Guillotine Project team: Vahe Chibukhchyan (Deputy Director), Tamar Minasyan, Public Relations Associate, Sonya During the meeting Ana Sabakhtarishvili represented the legislation reforms of agricultural cooperatives, mainly the adoption of law on Agricultural Cooperative as well as the main functioning principles of the cooperatives which were as follows: Voluntary participation and fairness; One member, one voice; Joint management of Share capital; Cooperation through Cooperative(second level cooperatives); Cooperative is independent form of a business and totally controlled by members; Mrs. Sabakhtarishvili also represented agricultural cooperative registration procedure and main requirements. Agricultural cooperative members SHOULD be: At least 3 in mountainous regions and 5 in rest of Georgia. An individual, Minimum age of 18; Cooperatives. Agricultural cooperative REGISTRATION procedure: Register as cooperative 7 Apply to ACDA for granting the status of agricultural cooperative. During the meeting Mrs. Sabakhtarishvili talked about the state support the agricultural cooperatives, which was mainly expressed by the possibility in applying to the state grant programmes and special tax approach as well. The tax system for agricultural cooperatives was as follows: PROFIT TAXES Turnover of GEL 200,000 which was one of the obstacles for establishing farmer organizations still remains in tax code on primary production level. However, according to the recent changes introduced for agriculture cooperative, this threshold was abolished from tax code until January 2017 and therefore, is not subject of taxation. Also, supply of agriculture products produced by cooperative members or/and provision of relevant services within cooperative members will not be counted as gross income until January 2017 and therefore is not subject of taxation. However, the tax code does not clearly define if this article is applicable to processing cooperatives. Dividends are not subject to taxation for primary production cooperatives as well as for processing cooperatives. Grants received by agriculture cooperatives are tax exempt. Moreover, the share contribution by member farmers is not counted as an income for cooperatives and exempted from taxation. VALUE ADDED TAX The initial supply prior to manufacturing and processing of agricultural products (prior changing of a commodity code) by an individual in agricultural production (excluding eggs) are exempted from tax (with entitlement to reclaim input VAT deduction). PROPERTY TAX The assets (excluding land plots) owned and used by agriculture cooperatives are not subject of taxation until January 2017. Moreover, the movable assets that are leased by agriculture cooperatives are exempted. Agriculture land plots with up to five hectare area owned by an individual as of March 1, 2004 are exempted from tax, but in case of agriculture cooperatives, if agriculture land plot owned by individuals will be used as a contribution (share) to the agriculture cooperatives and registration date will be changed, the land plots will be counted as a cooperative asset and are taxed according to regime mentioned ahead. Mrs. Sabakhtarishvili also represented ongoing programmes that were directed to the agricultural cooperative development. For the NCLR, it was much informative and helpful to hear about Georgian practice and especially their approach of solving such arduous problems. 8 DAY 2: December 23, 2014 Meeting #6, Customs Clearance Zone “Tbilisi”, Gardabani municipality Hosted by: Mr. Samson Uridia – Head of the Department for International Relations; Mr. Shota Tsuladze – Head of the Main Division of the Customs Clearance of the Customs Department; Mr. Dimitri lomadze - Head of the Service Division of the Customs Clearance Zone “Tbilisi” of the Main Division of the Customs Clearance Zone of the Customs Department; Mr. Mikheil Kavtaradze – Deputy Head of the Main Division of the Customs Clearance of the Customs Department and Mr. Givi Murvanidze – Deputy Head of Information Technology Center Regulatory Guillotine Project team: Armen Yeghiazaryan (Director), Heghine Manukyan (Deputy Director), Lusine Tovmasyan, Lilit Meshchyan, Garri Kasparov and Tamar Minasyan The following topics were discussed at the meeting: Legal certainty Infrastructure and equipment Transparency and anti-corruption measures Bilateral relations with neighbouring countries The process of customs valuation and its differences with the Armenian system. Previously Georgian businesses also had the problem of discretionary interpretation of customs procedural requirements due to vagueness of the legislation, which in its turn affected greatly the process of customs valuation and consequently estimation of customs duties. Currently Georgian customs estimates the value with special software. This gives to importers and exporters chance to estimate the exact amount of money to be paid, providing businesses with highest grade of certainty and predictability. Mr Samson Uridia explained the process on the example of importing of vehicles. For customs clearance the importer only needs to enter VIN code, Maker, Production Year and the engine capacity in the system and made the payment either with cash or electronically. Moreover, based on the application of the importer, it is allowed to transport a vehicle from Poti and Batumi ports and go through the customs clearance in Tbilisi. Without the need of the importer to be present in Poti or Batumi, vehicle and its goods can be subject to customs clearance in any customs clearance zone as it is requested by the importer. 9 Mr. Uridia made a presentation on experience of Georgian Government in fighting corruption. The anti-corruption measures administered in the country started in 2006, along with reforming lawenforcement and judicial systems were targeted on fiscal system including tax and customs administration. Significant payroll raises for public servants employed in the sector were carried out within a short timeframe in order to help fight economic crime and corruption. Bigger part of the staff had been fired, following by hiring a younger generation of tax and customs officials. At the end Georgian representatives described recent measures that have been undertaken in order to improve the institutionalization and the efficiency of cooperation between the Georgian customs and customs services of neighbouring countries. Mr Uridia specially mentioned mutual recognition of authorized economic operators and development of new mechanisms for the exchange of information between Georgian and Turkish Customs. Then he expressed his anticipation of mutually beneficial cooperation with Armenian customs service regarding mentioned issues. As per the speaker, Armenian and Georgians already started cooperation within the framework of UNDP and EU funded Provision of Equipment and Infrastructure for the Bagratashen-Sadakhlo Border Crossing Point between Armenia and Georgia and enhancement of their capacities (SBIBM) project. However Georgian side is looking forward for more active cooperation. Meeting #7, Parliament of Georgia Hosted by: Dr. Gia Jorjoliani, MP, Leader of SocialDemocrats Party Regulatory Guillotine Project team: Vahe Chibukhchyan (Deputy Director), Sonya Hovsepyan, Nelly Harutyunyan and Lilit Gulkanyan Dr. Jorjoliani is a famous politician in Georgia, he is the head of the new founded political movement “Social Democrats for Development” and the founder of the organization “Centre for Social Studies”. As a member of parliament, he is responsible person of regional/community development issues in the country. During the meeting he represented briefly the state-of-affairs of regional management and development in Georgia by stressing the key importance the Georgian authorities give to this vital area. He was well-informed about foreign best practices and brought some interesting cases for comparison. In order to promote regionalism and regional policy development in Georgia it is key to attract and engage people, as well as all stakeholders (local government, community and central government) in such processes as it is done in many developed countries (Norway, Netherlands). Presently, they need to support communities in their endeavour through implementing RDA projects 10 and also launching other types of activities which should entail strengthening and promotion of local democracy in Georgia. Strong local communities mean strong regions. To this regard, the Lisbon Treaty and the EU's new high-level strategy (Europe 2020) introduced a third dimension: territorial cohesion. Georgia will benefit much from this project to further support local regional development initiatives. Another issue in question was establishing adequate legal framework for regional development and, in general, regulatory processes in Georgia and Armenia. Conclusion: Opinions exchanged on this issue led to a conclusion that since each of these countries have passed their own individual way towards achieving regional improvements (land privatization, local self-governments institutionalization) they would most likely design and implement their own model of regional reforms in this area. For NCLR, it was much informative and helpful to hear about Georgian practice and especially their approach of solving such arduous problems. Meeting #8, Governing for Growth in Georgia, USAID Hosted by: Natalia Beruashvili - Deputy Chief of Party, Nino Chokheli - GoG Capacity Strengthening Component lead, Economic Governance and Policy Expert and Grigori Chikovani - Water and Energy Expert Regulatory Guillotine Project team: Vahe Chibukhchyan (Deputy Director) and Karen Ghaltakhchyan Natalia Beruashvili represented the basic principles and directions of their activities and, particularly, mentioned that the main purpose of the program is to assure the direct participation of businesses and citizens' in the reform process. In terms of participation, the program does not guarantee the participation of businesses and citizens' in the law drafting process, but their participation in adoption of approaches of main directions, particularly policy making, fiscal, documentation and other directions, which will subsequently be implemented within the legal acts related to the adoption of the reforms and the legal provision of the reforms. USAID is the coordinator of the project. 11 In terms of works, meetings with citizens and businesses are held by sectors, such as energy and water projects, education and science, transport and communication, etc. At the same time, a major role and significance is given to the proposals on the implementation of reforms submitted by the business and citizens, as well as collection of information on the regulatory impact effectiveness of the legal acts which ensure the reform implementation, and the recommendations submitted to the Government on the main directions of further steps of the reform process. The NCLR representative introduced the working mechanism and collaboration format of the NCLRbased Business Council, and, particularly was interested in the degree of involvement and activity of the businesses in the reform implementation process and subsequent actions to improve collaboration. At the request of the Georgian side, the NCLR representatives talked about the format of the meetings with the businesses and the assessment of the effectiveness of that format. Both sides expressed their willingness to continue their cooperation and to make more effective the involvement of businesses and citizens in the reform processes by mutual visits and exchange of experience. Meeting #9, LEPL Technical and Construction Supervision Agency at the Ministry of Economy and Sustainable Development of Georgia Hosted by: Grigoul Kakauridze, Head of the Agency, Astamur Chaba, Deputy Head, and David Gigineishvili, Head of Spatial Planning and Construction Policy Department Regulatory Guillotine Project team: Vahe Chibukhchyan (Deputy Director) and Karen Ghaltakhchyan The meeting was dedication to the introduction of the Agency’s activities and functions as well as its role in urbanization. The NCLR representative introduced the NCLR main activities and cooperation with Government agencies, local authorities, businesses and citizens. Grigoul Kakauridze presented the implemented urbanization reforms starting from 1992 onwards. At the request of Georgian colleagues the NCLR representative briefly presented the Armenian legislation on urbanization. A number of issues were discussed were as follows: The implementation of GIS system, The availability of a requirement for architectural assignment in Georgia, 12 The implementation of general plan, Spatial planning, zoning systems and their effect on the sector, The Georgian experience on licensing in urbanization, and, Minimum requirements for professional qualification of architects, builders and technical controllers, Sanitary norms and rules, Construction rules, their application and post-soviet reforms. The parties exchanged thoughts and analyzed the existing practices. DAY 3: December 24, 2014 Meeting #10, Food and Agricultural Organization of the United Nations (FAO) in Georgia Hosted by: Lasha Dolidze, Deputy Team Leader Regulatory Guillotine Project team: Sonya Hovsepyan, Nelli Harutyunyan, Lilit Gulkanyan and Karen Ghaltakhchyan Cooperative Issues The meeting was dedicated to the main functioning principles of the cooperatives, the agricultural cooperative registration procedure and main requirements. Mr. Dolidze also talked about the tax system for agricultural cooperatives. Lasha Dolidze mentioned two steps that must be taken to promote the development of agricultural cooperatives; 1. The support of the state. By saying state support he meant not only the tax approach, but also so called the “cheap credits”. 2. Internal management of the cooperatives. Seeds Certification Issues Mr. Dolidze mentioned that in Georgia there was no regulation on certification of seeds and pedigree seeds. He told that it w as necessary to implement regulation on certification, but it must be not obligatory, but voluntary. For NCLR, it was much informative and helpful to hear about Georgian practice and especially their approach of solving such arduous problems. 13 PUBLIC VISIBILITY OF THE MISSION During all meetings and discussions Armen Yeghiazaryan, Director of NCLR presented the activities of the Regulatory Guillotine project in Armenia with stressing the critical role that the Donor organizations – OSCE Yerevan Office, Austrian Development Agency, the operational unit of the Austrian Development Cooperation and the World Bank have in realization of the project. During the mission the NCLR team worked closely with PR units of state agencies – to raise awareness of the Regulatory Guillotine project in Armenia and the Georgian visit.
