April 2002 Volume XIV, Issue 1 The New Jersey Land Title Association NJLTA Organizing a Grass Roots Campaign By:Michael Grant, President The New Jersey state elections in November resulted in a shift of power away from the Republicans to the Democrats. As I write this article in early February, the new Administration and Legislature are in the process of reorganization in Trenton. While we will have to wait for them to complete their reorganization it has become clear that our Association may be in the best position ever to push for bills that can benefit the title insurance industry while fighting those that can adversely affect us. We are especially fortunate this year to have in the Legislature two members from the title industry, Ronald Rice who is a Senator and Assemblyman Albio Sires who is the Assembly Speaker. IN THIS ISSUE: NJTA Organizing a Grass Root Campaign . . . . . .1 NJLTA & The Political Process . . . . . . . . . . . .3 Title Insurance and Access . . . . . . . . . . . . .4 The New Jersey Land Title Association Gets a New Look . . . . . . . . . .5 What our Association needs to do while the state government is reorganizing is organize a grass roots lobbying effort. “Grass roots” means the basic or fundamental source of the elected representative’s support. That source, of course, is you and I. Grass roots lobbying involves having association members personally meeting with or calling their legislators about issues that affect our industry asking them to support and vote for bills favorable to the title industry while voting against bills that are detrimental. We especially ask (need, plead, beg) to get association members involved who have personal friends or relatives that are legislators. A visit or call from a constituent who the elected official knows personally is far more effective than a form letter from a group about whom they know little. When any legislative bill is introduced into the Senate or the Assembly, that bill most likely will sit without action for the length of the Legislative Session unless the bill’s sponsor or other legislators ask that it be moved forward. It is estimated that only about 10% of the bills introduced in the Legislature actually become law. We must request that our representatives call the chairman of the committee handling the bill and ask that it be released. Once the bill reaches the Floor of the Senate or Assembly, we need to ask all of our legislators to vote affirmatively for the bill. When the bill passes the Senate and the Assembly, it goes on to the Governor. Phone calls to the Governor from friends in the title industry can answer questions that he may have and increase the bill’s chances of being signed into law. The New Jersey Land Title Association is currently supporting three bills that we would like to have passed into law. The first bill concerns Notary Fees. If this bill becomes law, it will set the settlement notary fees at $15.00 for the sellers and $25.00 for the mortgagors respectively. The second bill amends the “Good Funds Act” to allow a trust check received at closing from another title agency or an attorney to be considered “Good Funds”. They currently are not! The third bill would require the Department of Treasury to complete Franchise Tax Reports within 15 business days. So where do we begin? NJLTA & The Political Process By Lydia Fowler, Old Republic Title Insurance Company The political process is interesting starting with an eventful campaign, ending with the ultimate winner on Election Day. Also interesting is how the New Jersey Land Title Association, The Marcus Group, and the New Jersey Title Insurance Political Action Committee (NJ/TIPAC) works within the title insurance industry. We start with the New Jersey Land Title Association (NJLTA), which is separate and apart from NJ/TIPAC. The NJLTA maintains a long-standing relationship with the wellrespected lobbying firm, The Marcus Group. The Marcus Group, through dedicated time and hands-on experience with our industry, understands the complexities of the title insurance industry and our needs. As part of the services rendered by The Marcus Group, legislation is monitored and the NJLTA is informed. The pending legislation is sent to the Association’s Legislative Committee for review and report to the New Jersey Land Title Association. The members of the New Jersey Land Title Association vote on the position of the industry and advise the Marcus Group of same. We may oppose, support, or merely monitor the progress of each bill. Through the dedicated service of our industry members and our lobbying firm, New Jersey State legislators are effectively informed of the positions of the New Jersey Land Title Association. NJ/TIPAC is focused on our legislators, but from a different perspective. The purpose of the New Jersey Title Insurance Political Action Committee, NJ/TIPAC, as stated in the bylaws is “.... to encourage and support candidates for public office in New Jersey who have an interest in the fields of evidencing title to real estate, conveying and insuring therein, maintaining, protecting and improving the recording system and our system for the free ownership and alienation of real estate, and encouraging enlightened regulation of title insurance underwriters and agents. To fulfill these purposes, NJ/TIPAC will solicit and accept voluntary contributions from individuals and corporations which will be used to support such candidates, all in conformity with applicable laws and regulations.” NJ/TIPAC does not lobby or take a position on the legislative process. The Marcus Group and industry members lobby. The New Jersey Land Title Association determines the industry position for pending legislation. Through the guidance of the Marcus Group, the Trustees of NJ/TIPAC identify those legislators in a position to further the interests of our industry. The responsibility of the Trustees is to solicit funds from industry members and affiliates and to distribute those funds to the identified individuals who seek public office in New Jersey. NJ/TIPAC has expanded its Board of Trustees from five to nine members this year. The nine members actively solicit contributions from individuals and corporations in accordance with State and Federal laws. Election year 2001 was an extremely important election year for supporting the Gubernatorial, Senate, and General Assembly elections. This phenomenon happens every four years. The three years in between is dedicated to obtaining sufficient funding for each election year and building sufficient funding resources for election years like 2001. Support of NJ/TIPAC is in the form of monetary contributions. Equally important, however, is the delivery of contributions by members of our industry who personally know the candidates. NJ/TIPAC Trustees rely on our industry members for the delivery system. Our legislators are very interested in our concerns and interests, and through our industry member, our message is heard through familiar voices. We have achieved a well-respected open dialogue. Nothing happens in Trenton without dialogue that is well-informed framing respected industry positions. The forum for our informed, respected dialogue has been earned through the efforts of the New Jersey Land Title Association members and the Marcus Group. The delivery of monetary support through the efforts of the Trustees assists in continued development of the legislative process. The New Jersey Land Title Association thanks all those who care enough to serve the people of New Jersey by seeking political office, and we congratulate all the successful candidates in our November, 2001 election. The 2001 Election is over, but the process starts all over again. Winkler, Senior Vice President and Special Counsel Fidelity National Title Insurance Company of New York Access Insurance in the Policy Both the American Land Title Association’s Owners and Loan Policy forms insure “… against loss or damage … sustained or incurred by the insured by reason of: … 4. Lack of a right of access to and from the land….” The access incurred is legal access only. If the property abuts a public street somewhere (even for a foot) or there is some legal way of getting to the property, then the title insurer has no liability under this provision. It does not insure any particular access or developable access or access for a particular purpose. The title insurance policy excludes matters of zoning, subdivision, and other exercise of the governmental policy power. Hence, the policy does not deal with issues such as whether the access is adequate to satisfy subdivision or zoning regulations. For example, a 100 Acre tract that has frontage of 46 feet on an accepted town road has access under the terms of the policy even though, in order to subdivide the property, the owner must have the ability to build a road 50 feet wide that connects with the existing town road. A parcel fronting on a state highway has access even though the State will not authorize a curb cut to allow a restaurant to be constructed on the site. In some jurisdictions, there are Access Endorsements that insure that the parcel abuts a particular street that refines the access to a particular street. There is also a modified Access Endorsement that insures that an appurtenant easement provides access to a particular street. Neither of these endorsements have been filed and approved for use in New Jersey. It is also important to be aware that a title insurance policy insures title to “land.” Under paragraph 1.(d) of the conditions and stipulations, “The term “land” does not include any property beyond the lines of the area described of referred to in Schedule [A], … but nothing herein shall modify or limit the extent to which a right of access to and from the land is insured by this policy.” A driveway that crosses the neighbor’s property, is not insured(in the absence of other endorsements) so long as there is other frontage. The access insurance will not create liability in this situation. 4 affecting the title to the land, not excluded or excepted from coverage, which would entitle a purchaser of the estate or interest described in Schedule A … to be released from the obligation to purchase by virtue of a contractual condition requiring the delivery of marketable title.” Marketability is an extremely slippery concept, and the definition in the policy is basically circular. It is designed to allow a claim to be made before there is an actual failed sale, but it is otherwise obscure. Clearly, a total lack of access would render title unmarketable, but access limitations that reduce or eliminate the opportunity for a particular use may make the property unsaleable at a particular price to a particular purchaser. Title to a rear lot that has adequate access over an easement for one house is marketable even though it cannot be subdivided. It is unlikely that a title would be deemed unmarketable where there was some access. Even in the no apparent access situation, there may be easements by necessity or implication that might save the day. Conclusion While a title insurance policy does provide “Access Insurance,” it should not be relied upon without other due diligence such as a survey to accept a property as having the necessary access for a particular activity. In the title business, it is often easy to forget that the goal of acquiring property is not to have “title” to the property or have “access” to the property but to be able to use the property for some specific purpose. ■ Better Safe Than Sorry In this day and age when your identity can be stolen, it is good to plan ahead. Starting with your wallet, you should place the contents on a photocopy machine, do both sides of each license, credit card, etc. This will provide you with all the account numbers and the emergency telephone numbers to report a missing card. Remember to keep the photocopy in a safe place. If your wallet is stolen immediately call the vendors and notify the police. Similarly, if there is an appurtenant easement that is not included in the description in the policy, it is not insured, provided that the property otherwise has access. If physical access is over an easement that is not mentioned in the insured description, then the title company does not have liability so long as there is legal access, even if the legal access is over a cliff or through a swamp. Also call the three national credit reporting organizations without delay to place a fraud alert on your name and Social Security Number. This alert means that if anyone attempts to open a new account using your name, the agency will have to call you before it can proceed. It can prevent a lot of damage and clean up work. This rate increase has two features as follows. 1. Increase in Refinance Rate (Section 4.6.1 of N.J.L.T.I.R.B.Rate Manual): The refinance rate is increased by $0.25 in all brackets. 2. Increase in Minimum Underwriting Charge (Section 4.1 of N.J.L.T.I.R.B.Rate Manual): The minimum underwriting charge for all transactions is increased to $200.00. Under section 4.6.1 of the N.J.L.T.I.R.B. Rate Manual, the Refinance Rate is applicable anytime a “refinance, recast or substitution loan is made to the same borrower on the same property” and applies up to “the face amount of the mortgage or mortgages other than construction loans being refinanced.” This section of the Rate Manual does not require production of a prior policy to qualify for the Refinance Rate. ■ changes to laws and regulations impacting the title industry. Some of the topics were: Unfair Business Practices The determination by the Department of Banking and Insurance as to what is an inducement for a specific act is still unresolved. The first letter was sent to the Department in October asking for a clarification. At the December meeting of the Liaison Committee with the Department, the Department stated that they had not received the letter. A copy was presented and the Director stated that he would respond by the next Liaison meeting in February. That meeting was cancelled due to the installation of the new Governor and his Department Heads. A new letter was sent out March 4, 2002 to again request a response from the Department. We await the response. Web Site The Agency Section web site has been merged with the Association site, www.njlta.org. This was accomplished through the efforts of Current Status, Inc., and Charles Jones, LLC. A presentation by Patrick Roe of Charles Jones, Inc. was given. There is another article in this newsletter that provides more information. By-Laws Revision A Committee was formed to study, revise and integrate our By-laws with the Constitution of the Land Title Association. As pointed out on numerous occasions, there are conflicting portions between both. An update will be given at the next meeting in April. Other items that were noted: Survey A survey will be going out shortly asking agents to 1) verify their information as shown on the web site, 2) determination of best area(s) to have meetings and 3) gather opinion as to presenting seminars/classes that provide profession improvement but not Continuing Education Credits. The increase in refinance rates, the change in recording fees & how they would be implemented and the mortgage impairment products were also discussed. Very little time was spent dealing with mortgage impairment products (MIP) which needs major attention. Most agents experienced a great upsurge in refinance orders during the past year. Every 4 or 5 years we see this cycle in refinances. If the MIPs take hold this will no longer occur. While ALTA has a new form of policy for refinances, it has not yet been approved nor accepted by the lenders.
