Påstått støtte til Husnes Industripark AS, - svar på forespørsel om
tilleggsinformasjon.
Vi viser til deres brev av 14.02.2013 hvor de ber om svar på noen spørsmål knyttet til et oppslag i
avisa Kvinnheringen 21.11.2012 om påstått støtte på kr 17,6 mill kr til Husnes Industriselskap AS. Det
blir framstilt som om Hordaland fylkeskommune skal løyve disse midlene til Husnes
Industritomteselskap AS (HIT). Midlene kommer fra de årlige bevilgningene til fylkeskommunene
over Statsbudsjettet—Kap 551.61 Næringsretta midler til regional utvikling, kompensasjonfor auka
arbeidsgiveravgift (kompensasjonsmidlene).
Som det går fram av det som er skrevet under, er det ikke gitt noe tilsagn om fylkeskommunale midler
til HIT. Vi finner det derfor vanskelig å besvare de spørsmål som er stilt i deres brev. I stedet vil vi gi
en redegjørelse for hvordan kompensasjonsmidlene blir forvaltet av fylkeskommunen og hvordan
denne saken så langt er blitt behandlet av oss.
La oss innledningsvis forklare hvordan kompensasjonsmidlene blir forvalta i Hordaland.
Fylkeskommunen har opprettet en egen styringsgruppe bestående av ordfører pluss en
næringslivsrepresentantutpekt av NHO fra hver av de 7 kommunene i fylket som er omfattet av
ordninga, pluss en næringslivsrepresentant for de bedriftene som ikke er organisert i NHO, totalt 15
medlemmer. En av de viktigste oppgavene for denne styringsgruppa er å utarbeide en årlig
handlingsplan hvor bruken av kompensasjonsmidlene er fordelt på ulike tiltak og prosjekt i de
respektive kommunene. Planen går så videre til behandling i Regionalt næringsforum for Hordaland
som kommer med en tilråding til fylkesutvalget. Fylkesutvalget har endelig avgjøringsmyndighet og
godkjenner planen helt eller delvis, eller sender den tilbake til ny behandling i styringsgruppa.
Fylkesutvalget kan også gjøre endringer i forslaget til handlingsplan direkte. Dette forvaltingsregimet
ble opprettet i 2007 er ment å vare ut 2013.
Når planen er godkjent blir det enkelte prosjekt saksbehandlet med utforming av tilsagn og utbetaling
av midler i tråd med gitte vilkår. Hordaland fylkeskommune er ansvarlig for saksbehandlinga. I denne
prosessen er det ofte nødvendig å be om en nærmere beskrivelse av de ulike tiltakene da beskrivelsene
i planen er på et svært overordnet nivå og derfor utilstrekkelige for saksbehandlingen. I
saksbehandlingeninngår en vurdering av det enkelte prosjekt i forhold til E0S-avtalens regler om
offentlig støtte.
Ett av tiltakene i de årlige planene har vært Næringsutvikling i Kvinnherad. I beskrivelsen har det
fremgått at Kvinnherad har stort behov for nytt næringsareal og at bedriftene ønsker å gå inn i et
samarbeid med kommunen for å kunne gjennomføre kartlegging av tilgjengelig areal og kunne løyse
inn nytt næringsareal.

I planen for 2012 har det i tillegg til denne generelle omtalen av Næringsutvikling i Kvinnherad
kommet inn et nytt underpunkt med beskrivelse av et tiltak kalt Infrastruktur Husnes. I beskrivelsen
går fram at Husnes Industritomteselskap AS har overtatt administrasjon av et ca 100 dekar stort
tomteområde som Kvinnherad kommune har festet av bedriften Søral AS. Området er regulert til
næringsformål. I tillegg har HIT utarbeidet en privat reguleringsplan for et areal på 200 dekar, dels til
næringsformål og dels til grøntareal hvor Søral er grunneier. Skal området bli tilgjengelig for
industriformål er det avgjørende at det blir etablert god infrastruktur. Målsettinga med prosjektet er
derfor å legge til rette for ny infrastruktur for industriområdet på Husnes. Innholdet i prosjektet er kort
beskrevet med å planlegge og gjennomføre utbygging av infrastruktur med hovedvei (ca 1100meter),
sykkel- og gangvei, grøfter, vann, avløp, strøm- og telekabler med mer. Det går også fram at før
prosjektet er klart til å gjennomføres må det på plass en feste-/kjøpsavtale med grunneier for arealet på
200 dekar og nødvendige avtaler mellom grunneier, kommune og Husnes Industritomteselskap AS.
I de årlige planene for bruk av kompensasjonsmidlene for 2007 til 2011, som alle er godkjent av
fylkesutvalget, er det satt av til sammen 12,8 mill kr til Næringsutvikling Kvinnherad. I tillegg er det
overført 1,0 mill kr fra planen for 2006 til dette formålet. I planen for 2012 er det foreslått avsatt 3,84
mill til Næringsutvikling Kvinnherad, noe som gir en total ramme på 17,64 mill kr. Samtidig er det
skissert at total kostnadsrarnme for Infrastruktur Husnes er grovt kalkulert til 20 mill kr og at det er
lagt til grunn at dette finansieres med 15 mill kr fra kompensasjonsmidlene og 5 mill kr fra
Kvinnherad kommune. Det betyr at det så langt ikke kommet forslag til disponering av de siste 2,64
mill kr avsatt til formålet.
Plan for bruk av kompensasjonsmidler 2012 er godkjent i to omganger av fylkesutvalget, sist
20.02.13. I det siste møtet ble behandling av tiltaket Næringsutvikling i Kvinnherad utsatt. Samtidig
ble fylkesrådmannen bedt om å kvalitetssikre at tildelingene til alle prosjekt i planen er i tråd med
relevant lovverk. Det ble spesielt pekt på at tildeling til Næringsutvikling i Kvinnherad gjelder dette
forvaltningslova og E0S-lovgivinga.
Som det går fram av det som er sagt over, har fylkeskommunen til nå ikke fått nødvendig informasjon
og prosjektbeskrivelse til å saksbehandle et tilskudd til Næringsutvikling Kvinnherad. Det samme
gjelder også Infrastruktur Husnes. Hordaland fylkeskommune har derfor ikke gitt tilsagn om eller
utbetalt noe støtte til dette.
Underveis i prosessen har vi hatt noe dialog med styringsgruppa, og gitt veiledning om hvordan
tiltaket kan utformes for at det skal være mest mulig i tråd med gjeldende nasjonale og regionale
retningslinjer for bruk av kompensasjonsmidlene inldudert EØS-avtalens regler om offentlig støtte.
Her har vi blant annet pekt på at vi ser det som vanskelig å kunne gi disse midlene til Husnes
Industritomteselskap AS for opparbeiding av industriområdet uten å komme i konflikt med dette
regelverket. Vi har videre signalisert at på generelt grunnlag er det lettest å få godkjent en løsning hvor
kompensasjonsmidlenegår til Kvinnherad kommune og blir brukt til bygging av kommunal hovedvei
og gang- og sykkelvei gjennom området. Det er imidlertid umulig å gi en endelig vurdering før vi har
en konkret sak å forholde oss til.
I disse rådene har vi støttet oss på Fornyings-, Administrasjons- og Kirkedepartementet sin veileder
EØS-avtalens regler om offentlig støtte, særlig Kap 3.3 Offentlig finansiert infrastruktur. Av
veilederen forstår vi at dette er et vanskelig område og at det foreligger sparsomt med rettspraksis på
området. Fylkeskommunen vil bare gi støtte til dette prosjektet dersom vi finner at dette ikke
innebærer støtte som omfattes med EØS avtalen sine bestemmelser om statsstøtte og da særlig vurdert
i forhold til selektivitetsprinsippet.Dersom vi finner at støtten innebærer direkte eller indirekte
bedriftsstøtte vil vi enten overlate til Innovasjon Norge å vurdere om støtten kan gies i tråd med noen
av deres notifiserte støtteordninger, eller vi vil avslå støtte og be styringsgruppen komme med forslag
til omdisponering av midlene. Dette har vi tidligere gjort i ett tilfelle når det gjelder
kompensasjonsmidlenehvor vi vurderte at et bedriftsutviklingsprogram innebar direkte støtte til de
bedriftene som deltok. I dette tilfellet ble rammen som var avsatt i planen overført til Innovasjon
Norge for videre saksbehandling og forvalting.

De nasjonale retningslinjene for bruk næringsretta utviklingsmidler blir fastsatt i de årlige
tildelingsbrevene fra Kommunal- og regionaldepartementet til fylkeskommunene. Her heter det bl.a. at
midlene skal nyttes til å styrke verdiskaping i næringsmiljø og utvilde attraktive arbeidsplasser ved å
fremme innovasjon, omstilling og nyetableringer. Midlene skal også medvirke til å utvilde lokal
infrastruktur, kompetanse og attraktive steder. I retningslinjene heter det videre at i Sone II, III og IV i
det distriktspolitiske området kan det blir gitt støtte til investeringer i kommunale prosjekt som
tilrettelegging for næringsvirksomhet, stedsutvikling, vassverksutbygging og liknende. Kvinnherad
kommune ligger i Sone III og er også en av kommunene som fikk gjeninnført differensiert
arbeidsgiveravgift i 2007.
Vårt foreløpige utgangspunkt for vurdering av et tiltak for offentlig tilrettelegging av infrastruktur
knyttet til utvikling av næringsareal er at en må skille mellom selve veien og annen gratis infrastruktur
og betalt infrastruktur. Dersom veien inkludert gang- og sykkelvei, bygges som kommunal vei åpen
for fri ferdsel, bør dette kunne skje uten å være i strid med EØS regelverket om bedriftsstøtte. Særlig
bør dette være tilfellet hvis veien også skal løse andre transportbehov til/fra eller gjennom området. Vi
legger da til grunn av bruk av kommunal vei, og for den saks skyld også annen offentlig vei (statlig og
fylkeskommunal) er gratis i Kvinnherad, i Norge og i resten av EØS området. Derimot kan midlene
ikke gå til helt eller delvis å finansiere infrastruktur bygget av offentlige eller private aktører hvor slik
utbygging, drift og vedlikehold normalt blir finansiert med tilknytningsavgifter og avgifter på bruk.
En slik støtte vil innebære subsidiering av leverandør og/eller sluttbruker av denne tjenesten.
Eksempler på dette er vann, avløp, elektrisitet, tele, breiband med mer. Vi legger til grunn at både
stikkveier og stikkledninger etc inn i industriområdet er bedriftenes ansvar og ikke kan subsidieres
med offentlige midler. Dersom dere mener disse generelle vurderingene som her er skissert er i strid
med EØS avtalens bestemmelser og intensjon om offentlig støtte, ber vi om en tilbakemelding på
dette.

Alleged aid to Husnes Industripark AS, - answer on request for additional
information.
This is in reference to your letter dated 14.02.13 requesting additional information related to an article
in the local newspaper Kvinnheringen (21.11.12) concerning an alleged support of 17,6 million NOK
to Husnes Industriselskap AS.
It is presented as though Hordaland County Council will grant these means to Husnes Industriselskap
AS (HIT). These funds belong to the annual grant that the county council receive over the National
budget —Chapter 551.61 Fundsfor commerciallyfocused regional development, compensationfor
increased employer's contribution (the compensationfunds).
As can be read from the information below, no commitment on regional funds to HIT has been given
by the county authorities. We therefore find it difficult to answer the questions raised in your letter.
Instead we would like to provide an explanation as to how these compensation funds are actually
administered by the county council and how this particular case has been managed by us so far.
As an introduction, we would like to explain how these compensation funds are administered in
Hordaland. The county council has established a dedicated steering group which consists of the mayor
and a business representative, designated by The Confederation of Norwegian Enterprise (NHO) from
each of the seven municipalities in our county covered by this arrangement. In addition there is one
representative from the businesses that are not members of NHO. This gives a total of 15 members.
One of the key assignments of this steering group is to work out an annual action plan where the use
of the compensation funds are distributed to different actions and projects in the municipalities in
question. This plan goes on to be discussed in the Regional Economic Development Group for
Hordaland which will give a recommendation to the county's executive council. The Executive
Council has the final decisive authority and approves the action plan, partially or in full, or send it
back for additional proceedings in the steering group. The county's Executive Committee can also
make direct changes in the proposed action plan. This management regime was established in 2007
and will continue until the end of 2013.
Once the action plan is approved, each of the projects goes through a process where grants are
formulated and means are paid out according to the set guidelines. Hordaland County Council is the
responsible authority in this process. A request for further information on the different actions is often

required as the descriptions in the action plan tend to be at a very general level and therefore
inadequate in the bureaucratic process. During this procedure, an assessment of the individual projects
in regards to the EEA agreements rules on state aid is included.
One of the actions in the annual plans has been Business development in Kvinnherad. In the
description it has been argued that Kvinnherad has a great need for new commercial space and that the
industry wants to cooperate with the local authorities in order to both map the accessible areas and
acquire new commercial space.
In the action plan for 2012, the general description of Business development in Kvinnherad has been
supplemented by a new sub point outlining an action called Infrastructure Husnes. From this
description it is clear that Husnes Industritomteselskap AS has taken over the administration of a 10
hectare area of land that Kvinnherad municipality has leased from the company Søral AS. The area is
regulated for industrial purposes. In addition to this, HIT has developed a private land use plan for an
area of 20 hectares, partly for industrial use and partly as a recreational area where Søral AS is land
owner. If the area is to be accessible for industrial purposes, it is vital that good infrastructure is
established. The ambition of the project is therefore to accommodate for new infrastructure for an
industrial zone at Husnes. In short, the content of the project is to plan and build the infrastructure
with a main road (approx. 1100 meter), bike- and walking paths, ditches, water, sanitation, electricand telecom cables etc. It is also made clear that before the project can be started an agreement to
lease/buy the area of 20 hectares must be agreed with the land owners, in addition to the necessary
agreements between the land owners, the municipality and Husnes Industritomteselskap AS.
In the annual plans for the use of the compensation funds, from 2007 to 2011, which are all approved
by the county's Executive Comrnittee, a total of 12,8million NOK have been allocated to Business
Development in Kvinnherad. In addition to this, 1 million NOK from the 2006 plan has been
transferred to this same objective. In the plan for 2012, 3,84 mill. NOK have been proposed allocated
to Business Development in Kvinnherad, giving it a total frame of 17,64 million NOK. At the same
time, the total cost for Infrastructure Husnes has been roughly estimated to 20 million NOK where it
is assumed a financing of 15 million from the compensation funds and 5 million from Kvinnherad
municipality. This means that so far, no proposal for use of the last 2.64 million allocated to this
objective has been received.
Plan for the use of the compensation funds for 2012 has been approved in two instances by the
county's Executive Committee, last on 20.02.13 In the last meeting the discussion of the action
Business Development in Kvinnherad was postponed. At the same time the county's Chief Executive
was asked to assure that all allocations were in line with relevant laws and regulations. Special
mention was given to the allocation to Business Development in Kvinnherad where both the
administrative law and acts of law related to the EEA agreement are of special relevance.
As can be read from the information above, the county council has until now not received the
necessary information and project outline in order to process the request for grants to Business
Development in Kvinnherad. The same is true for Infrastructure Husnes. For this reason, Hordaland
County Council has neither allocated nor paid out any financial support to this.
During this process we have had some dialogue with the steering group, and given some guidance as
to how this action can be defined in order to be in cornpliance with current national and regional
guidelines for the use of the compensation funds, including the EEA agreement's acts on state aid.
Among other things, we have in this case pointed to the fact that we see it as problematic to allocate
these means to Husnes Industritomteselskap AS to develop the industrial area without coming into
conflict with these rules. We have further on signaled that on general terms it is easier to have the
project approved if the compensation funds could go to Kvinnherad municipality and be used for the
construction of a public main road with paths for biking and walking through the concerned area. It is
nevertheless impossible to give a final consideration until we have a concrete case to relate to.

In giving these advices, we have found support in the Ministry of Government Administration,
Reform and Church Affair's guidance "The EEA agreement's rules on state aid", in particular chapter
3.3: Publicly financed infrastructure. From this guidance we understand that this is a difficult field and
that there is little jurisprudence on the subject. The county council will only provide financial support
for this project if we fmd that it does not include support that falls under the EEA agreement's
provisions on state aid, and in particular considering the selectivity principle. If we fmd that the
support entails direct or indirect aid to companies, we will either leave it up to Innovation Norway to
consider whether the support can be given in line with any of their notarised funding programmes, or
we will reject the funding application and ask the steering group to come up with proposals for a
reallocation of the means. We have done this in one earlier case concerning the compensation funds,
when we estimated that an industrial development programme entailed direct aid to the participating
businesses. In that case the sum that was allocated in the action plan was transferred to Innovation
Norway for further processing and administration.
The national guidelines for the use of commercially focused development funds are defined in the
annual allotment letters from the Ministry of Local Government and Regional Development to the
county councils. Here it is clearly stated that these funds should be used to strengthen the growth in
the business sector and develop attractivejobs through the promotion of innovation, restructuring and
new ventures. The funds should also contribute to the development of local infrastructure, competence
and attractive local communities. The guidelines further on states that within Zone II, III and IV of the
working area for rural policies, support can be given to investments in local projects such as
facilitating commercial activities, development of strong local communities, construction of
hydroelectric installations etc. Kvinnherad is situated within zone III and is also one of the
municipalities where differentiated employer's contribution was reinstated in 2007.
Our starting point when assessing a project for public facilitation of infrastructure related to the
development of a commercial zone is that one has to separate between the road and other "free"
infrastructure and the paid infrastructure. If the road, including bike- and pedestrian paths, are
constructed as a municipal road, with public access, this is something that should be possible without
being in violation of the EEA agreements regulations on company aid. This would, in particular, be
the case if the road also serves other transport needs to/from or through the area. A prerequisite is that
the use of public roads (be it municipal, regional or national roads) are free in Kvinnherad, in Norway
and in the rest of the EEA area. Infrastructure, constructed by public or private actors, where the
construction, operation and maintenance are normally financed with charges for connection or use, on
the other hand, would not be eligible for such funds. Such a support would constitute a subsidy of
providers and/or end users of the service in question. Examples of this can be water, sanitation,
electricity, telephone lines, broad band etc. We assume that both connecting roads, connecting cables
etc. into the commercial zone, are the responsibilities of the companies and something that cannot be
subsidised with public means.
If the assessments that have been outlined here, in your opinion, are in violation of the EEA
agreement's regulations and intentions in terms of state aid, we would like you to report back to us.
