I find the plaintiff failed to prove his claims.” Summey, who was hired away from Maryville High School in early 2007 to “turn the football program around” at Sequoyah High School, alleged the dismissal was “wrongful.” His $2 million lawsuit claimed he was denied his right of due process when Principal Maurice Moser, Schools Director Mike Lowry, and the Board of Education refused to allow him the opportunity to appeal his case to them. Summey’s attorney, Kevin Shepherd, called the case “complicated but basic,” describing the suit as one of an individual’s “fundamental rights.” School board counsel Doris Matthews said Summey had no claim, because he admitted in testimony before Bryant that he had not been fired but only stripped of his coaching position, that he admitted he refused to accept the teaching post at the middle school, and that he admitted that his second of two contracts with the school system did not specifically carry an addendum – as did the first – that prioritized his coaching duties above a teaching position. “Mr. Summey did not look for another job to mitigate his damages,” Matthews said, “but he was offered a job by Mr. Lowry to finish the 81 days remaining on his contract.” “It was very clear from the beginning that Mr. Summey was brought into Sequoyah High School as a football coach and not a teacher,” Shepherd said. Dr. Jim DeVoe CHIRoPRACTIC WELLNESS CENTER Across From Dollar General Store 1351 Hwy 411 884-6611 Vonore “As a matter of fact, the Board of Education had to create a special position in the school system just to hire my client.” Shepherd argued that under the terms of his contract, Summey could be transferred within Sequoyah High but not to other schools in the school system. “The addendum was very restrictive,” Shepherd said. “Mr. Summey was hired as a football coach and not as a teacher.” Shepherd argued the middle school position vacancy that was offered by Lowry did not exist nor had it been posted, as required. He said Summey did not receive in writing, also a policy requirement, a notice of his dismissal and the stated reasons for the dismissal. “My client never had the opportunity for a full and complete hearing,” Shepherd said, “and he had no opportunity to be represented by counsel, because he had no hearing. Mr. Summey did not get his due process.” Shepherd called Summey’s firing as coach “capricious and arbitrary.” In May 2008, Summey met with Moser, Assistant Schools Director Tim Blankenship, and a cadre of volunteer coaches. According to court testimony, Moser told him he could either resign as coach or be fired. The meeting came after Summey had been in Ohio at a funeral. Summey said he had no advance notice that Moser would be moving him out of the coach’s position. Afterward, he was not permitted to appeal his firing with Moser, Lowry, or the school board. And there is no appeal granted when one is fired as a football coach.” Matthews said Summey was offered a job after he was fired as coach. “But he refused to take it,” she said. “We offer to the court that he breached his contract.” In the end, Bryant apparently agreed with Matthews. “The plaintiff has failed to prove his claims,” Bryant stated. “This case is dismissed.” Shepherd, whose record as a private attorney includes two appeals upheld by the Tennessee Supreme Court, said he and Summey would be appealing Bryant’s ruling. The election centers on three expiring city commission seats and three city school board posts that are up for grabs. Voters will also get to say yes or no to retail packaged liquor sales and a half-cent sales tax increase. Election Day is less than a week now. Sweetwater's Marcella Center for the Arts and Education Community Center was selected to receive a $5,000 grant from the Appalachian Community Fund located in Knoxville. The Appalachian Community Fund began in 1987 in order to help East Tennessee communities, along with communities in Eastern Kentucky, Southwest Virginia, and all of West Virginia to organize and to promote social changes. These grants are used for specific projects and are intended to give operational support. So far, the mutant has killed 17 persons in Germany and one in Sweden and has sickened 1,500 others. As many as 270 Libyan refugees were missing in the Mediterranean Sea on Thursday, following the break down of a boat that was illegally carrying them to Europe. Tunisia offi- cials rescued 570, saying the missing were believed to have drowned in a rush to exit the rickety vessel. The measure requires a third grade student to show basic understanding for curriculum through standardized test scores or daily grades before passing to the fourth grade. Senate Bill 1776 was sponsored by Senator Charlotte Burks (D-Monterey) and co-sponsored by Senate Education Chairman Dolores Gresham (R-Somerville). Strickland died shortly after the gunshot, which struck his chest. Mason has charged Hunt with premeditated first-degree murder, aggravated kidnapping, and theft over $1,000.
