Purpose. The purpose of this ordinance is to create Section 2.32.050 of the Allison Municipal Code. Section 2. Pond Ordinance: 2.32.050 Pond Regulations: Vessels operated on any pond located within the city limits of Allison may not be equipped with any power unit mounted or carried aboard the vessel unless it be an outboard battery operated electric trolling motor. All occupants of any type of vessel on any pond located in the City of Allison shall wear floatation devices as defined in Iowa Code Chapter 462. A violation of this section shall be a municipal infraction and punishable by a fine of up to $150. Section 3. Severability Clause. If any section, provision or part of this ordinance is adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part of this ordinance not adjudged invalid or unconstitutional. Section 4. When Effective. This ordinance shall be in effect after its final passage, approval and publication as provided by law. Blockhus entered the meeting at 5:16 p.m. Others present: Allan Brockway, City Engineer–Lee Gallentine, Brian Schoon-INRCOG, City Financial Advisor–Michael Hart, City Attorney–Marty Peterson, Pat Racette–Tribune Journal, Daniel Shafer, Michael Shafer. Motion by Platter and Second by Cramer to approve the agenda. Ayes: All. Nays: None. Motion Carried. Open Forum: Michael Shafer was present at the meeting. He wants to use crossties donated by Iowa Northern Railway Company for his Eagle Scout project with the crossties being used as borders for workout stations at Wilder Park. He needs a letter from the City stating that they approve the project with the use of these donated crossties and that it is Okay for Iowa Northern Railway to deliver the crossties to Wilder Park. The Council directed the City Clerk to write such a letter in support of the project. Consent Agenda: It was moved by Henrichs and Seconded by Platter to approve the consent agenda. New Business: Brian Schoon was present at the meeting to discuss applying for a CDBG grant for the sanitary sewer treatment facility updates mandated by the DNR. The grant will be applied for in November but we need to have our facility plan in place with the DNR and our finance options figured out before we can apply for the grant. The city will need to spend approximately $1,800,000 for necessary maintenance to the present system which includes dredging of the current lagoons and installing bio domes. With the current flow that is going into the lagoons, it may require a new lagoon to be added with that cost being approximately $2,800,000. The cost to reline the rest of the sanitary sewer system would be $2,400,000. The City Council has asked the cities financial advisor, Michael Hart of Northland Securities, to do rate studies and come up with possible financing options. He will report back to the Council at their meeting on August 25, 2014. A motion was made by Cramer and seconded by Henrichs to adopt a Municipal Service Agreement with Northland Securities to secure the services of Michael Hart for financial advice for the City. A request for the City to put up “NO Truck Parking” signs by the EMS building for the Lion’s Club fish fry on September 5, 2014 was approved by the Council. Allan Brockway will take care of this matter. A request was made by Daniel Shafer to stable a horse for the winter months for his daughter’s animal therapy. Daniel’s daughter broke her arm recently and part of her recovery therapy has been taking care of a horse. They would stable the horse for the winter months in a shelter to be built at their home at 21098 Hwy 14 and then in the spring it would be taken to the Boy Scout Camp. The City okayed for him to stable the horse for the winter months and Daniel stated he would come back to the City for the building permit for the shelter. The Council discussed the settlement that the City will receive for the class action takings case in Butler & Franklin Counties of Burgess, et al. v United States and asked that our attorney, Marty Peterson take a look at the papers before we sign anything. The matter of moving the Allison sign at the corner of 7th Street & Hwy 14 was discussed and tabled until further information is obtained.
