Now that we are officially in Spring, many of you will be
dusting off those golf shoes and it will be just in time for the opening of the Westland Golf Course. The old adage may seem like a
cliché but it still holds true today – business is done on the golf
course.
The famous Bobby Jones once said, “competitive golf is played
mainly on a 5 ½ inch course…the space between your ears.” So
put on those thinking caps along with those golf shoes, because
your course of action should be about doing business in Westland.
Every week we feature Monday Madness at the Westland Golf
Course. It is a lunch and a 9-hole game special. You can always

Whether on the green or at City Hall, Westland is all a buzz
when it comes to business. This past month we went from our successful 1st Annual Westland “Business Connect” to our popular
“Eggs and Opportunities” Event. This year's Eggs and Opportunities event provided commercial and residential real estate developers, brokers and agents with an update on recent public as well
as private investment in Wayne County's All-American City.
At this insider's breakfast, our Economic Development Team
outlined the city’s portfolio of incentives that have attracted more
than $200 million in new development and reinvestment making
Westland Wayne County's hottest market. The program also includes an overview of the City's prime development opportunities
for residential construction and commercial investment.
Success does not happen by mistake. It happens through vision,
hard work and collaboration. As a small business owner, I understand that great cities depend on a vibrant business community and
strong economic climate.
We are extremely proud with the turnout of local businesses
across all sectors for our business and development events. Westland prides itself on being a progressive business friendly community and it's important for the City to maintain a strong working

The Importance if a Well-Drafted Non-Compete Agreement - Part 2
In my February legal column, I discussed the importance of a welldrafted non-compete agreement for use in your business. A recent
Michigan Court of Appeals decision illustrates this point perfectly.
Generally, these agreements not to compete are enforceable when they
protect the employer’s reasonable competitive business interests and
are reasonable in duration, geographical scope, and line of business.
However, in September 2014, the Court of Appeals struck down a
non-compete clause that prohibited the former employee from working
for any company that “makes or sells any products competitive with a
product offered by the company.” While this may sound like typical
language in a non-compete clause, the Michigan Court of Appeals determined it to be overly broad and unenforceable.
In that case , Defendant was a former employee of Plaintiff who resigned to go work for another company. Both companies manufactured
and sold “material handling equipment” (i.e. conveyor equipment).
Plaintiff argued that Defendant violated his two year non-compete
clause by working for a competitor within that time frame.

The court held that the non-compete was unenforceable because it
prohibited Defendant from working for any company that offers even
a single product that is “competitive” with a product offered by Plaintiff. This prohibited Defendant from working for any company that is
even in remote competition with Plaintiff, and was therefore unreasonably restrictive.
This case demonstrates how imperative it is to carefully draft contract language in non-compete agreements. The language in this case
is similar to what is commonly used by businesses who do not seek
the advice of experienced legal counsel. Seeking the advice of experienced counsel will help ensure that the courts
