ANTI-DISCRIMINATION CLAUSE
(Section 755, Pennsylvania Public School Code)
1. In
accordance with the provisions of the Pennsylvania Public School Code, the Contractor agrees:
a.
That in the hiring of employees for the performance of work under this contract, or any
subcontractor hereunder, no contractor, subcontractor, nor any person acting on behalf of such
contractor or subcontractor, shall by reason of race, creed or color, discriminate against any citizen
of the Commonwealth of Pennsylvania who is qualifred and available to perform work to which
the employment relates;
That no contractor, subcontractor, or any person acting on behalf, shall in any manner
discriminate against or intimidate any employee hired for performance of work under this contract
on account ofrace, creed, or color;

That there may be deducted from the amount payable to the contractor under this contract, a

INSTRUCTIONS FOR NON.COLLUSION AFFIDAVIT

the Pennsylvania Antibid Rigging Act, 62 Pa. C.S.A. $+SOt, et seq., governmental agencies may

SECTION 111 PTJBLIC SCHOOL CODE AGREEMENT

This agreement is part of the agreement between the undersigned business person or entity and the Bucks County
Schools Cooperative Purchasing Group, for the sale of goods or the provision of services as an independent vendor
or contractor.
The undersigned understands that vendors and independent contractors and their employees and their
subcontractors' employees hired after that date shall comply with Section I l1 of the Public School Code, Act34,
Act 114, Act 151 or similar legislation in the future, which provides, among other things,that a RESPONSE FOR
CRß4INAL IilSTORY RECORD CHECK. PENNSYLVANIA CHILD ABUSE HISTORY CLEARANCE ANd
FBI FINGERPRINTING REPORT must be obtained for each employee who could come into contact with school
children, showing that such employees have not been convicted of certain crimes. A copy of the law is available
upon request.

INSTRUCTIONS TO BIDDERS, GENERAL CONDITIONS, AND SPECIFICATIONS TO SUPPLY THE ITEMS AND/OR
SERVICES HEREIN LISTED TO BE PURCHASED JOINTLY BY ONE OR MORE OF THE NINETEEN (I9)
PARTICIPATING LOCAL EDUCATION AGENCIES OF BUCKS COUNTY, PENNSYLVANIA, THAT ARE HEREINAFTER
NAMED
1.
The Bucks County Schools Cooperative Purchasing Group, acting through the Bucks County lntermediate Unit No. 22
Board of Directors (Board), is comprised of the following eighteen (19) Local Education Agencies (LEAs): School
District of Bensalem Township, Bristol Borough School District, School District of BristolTownship, Centennial School
Ðistrict, Central Bucks School District, Council Rock School District, Morrisville School District, Neshaminy School
District, New Hope-Solebury School District, Palisades School District, Pennridge School District, Pennsbury School
District, Quakertown Community School District, Bucks County Technical High School, Middle Bucks lnstitute of
Technology, Upper Bucks County Area VocationalTechnical School, Bucks County lntermediate Unit No. 22, and
Bucks County Community College.

Bids will not be considered unless submitted on the Bucks County Schools Cooperative Purchasing Group's forms.
Faxed bids will not be accepted. Bids altered in any way will not be accepted. Late bids will not be accepted.
Properly executed and comolete bid packet must be returned.
3. All bids for equipment, materials,
be siqned by
supplies, and/or services listed shall be typewritten, or leqiblv printed in ink, and shall
ihe bidder on the Bid Submission form alonq with the Non-Collusion Affidavit and Section 111 Public
School Code Aqreement forms supplied herewith.
4.
To allow sufficient time for the awarding process, b¡ds mav not be withdrawn for a period of sixty (60) days from date of
bid openinq.
5.
Bids must show both unit and total prices, where applicable, but where the figures are inconsistent, awards will be
made on the basis of unit price. Bids shall include deliverv costs but no state or federal sales tax. All participants in
this bid are tax exempt and will issue exemption certificates for their individual LEA.
6.
The successful bidder agrees to furnish quantities of items as needed by the LEA's at a cost equal to the bid
price specified in the bid award.
7.
All bid prices must be F.O.B. point of delivery basis, all charges paid, to the individual school and/or schools as
specified, and in the proper quantities as designated by the purchase orders issued by each participating LEA.
8.
Where the invitation for bids describes or specifies a particular article, alternate bids offering articles equal, or greater,
in all respects are permitted, untess otherwise stated. The naming of any manufacturer is for the purpose of
establishing a standard of quality, clarification and identification, and does not signify a preclusion of other
manufacturers. However, alternates shall be at least equal to those specified, and shall, regardless of any "Trade
Name" or use of manufacturels name, meet the specifications listed. The Bucks County Schools Cooperative
Purchasing Group bid committee willdecide the equality of items.

The singular as used herein shall include the plural: the masculine shall include the feminine and neuter: "articles" as
used herein shall include equipment, materials, supplies and all service (work and labor) if the same is contemplated in
these specifications. Wherethe term "the Board" is used, it shall be taken to mean the members of the Bucks County
lntermediate Unit No. 22 Board of Directors or its authorized representatives. The term "furnished" shall mean to deliver
at the destinations within Bucks County to be designated.
10. The bidder shall be responsible for notifying the Bucks County Schools Cooperative Purchasing Group of the price
advantage to the LEAs if the order of any item were to be increased to the next higher break point for that item. Should
such break point exist, such notice must be given at the time the bid is submitted.
11. The Board shall award to the lowest responsible responsive bidder(s) meeting specifications. The Board will then notify
the participating LEAs.

12. The Board reserves the right to make award(s) on the basis of bids received for individual items or by section, or to
award bid(s) as a whole to a single vendor if it will benefit the Board to do so. Further, the Board reserves the right to
reject any or all bids, in whole or in part, and to waive informalities permitted by law.
13. The bidder agrees that if award is made to it, the bidder will not assign in whole or part any rights or privileges which
may accrue to it under the terms of the contract.
14. The bidder agrees that if award is made to it, the bidder will not assign or transfer the award, unless specific permission
to do so is granted in writing by the Board.
15. The bidder agrees that if award is made to it, the bidder will not subcontract any of the duties or responsibilities
thereunder.
16. Following award to the successful bidder(s), each participating LEA will order equipment, materials, supplies andlor
service by issuing its own purchase order(s). The delivery location(s) will be specified on each LEA's purchase order.
Any payments due as a result of the equipment, materials, supplies and/or service delivered against those purchase
orders shall be the responsibility of the individual LEA. Vendors are to process individual purchase orders as they are
received. Under no circumstances shall vendors delay shipment of any item pending receipt of purchase orders from
other participating LEAs. LEAs may require partial shipments of larqe volume items within five (þ) davs with the balance
delivered within thirty (30) davs. Some items may require delivery within twenty-four (24) hours. (Please note: Poor
performance and delayed deliveries may remove a vendor from future bids.)
17. Payment for all goods, and services will be made in accordance with each individual LEA's payment schedule and/or
practice and current Pennsylvania law. ln those instances where payment schedules and/or practices differ from
Pennsylvania law, the individual LEA's payment schedule and/or practice will prevail.
18. The bidder agrees to repair any damage to the LEA's buildings and/or premises, caused by person, vehicle or spillage
in the delivery of supplies, materials, equipment and/or services and further agrees to remove any or all dirt or debris
resulting from delivery.
19. The bidder agrees to hold harmless and to indemnity the Board of Directors, officers, members and employees from
each of the LEAs for any and all expenses incurred for all claims arising from the liability for bodily injury and property
damage, including costs of counsel and all expenses incident thereto, due to the vendors negligence.
20. ln the event the successful bidder shall neglect or refuse to furnish and deliver said articles or any part thereof, as
provided in these specifications or to replace any which are rejected, then, the Board and/or LEAs are authorized and
empowered to purchase articles in conformi$ with this contract from such parties, in such quantities and in such
manner as it shall deem necessary at the expense of the successful bidder, or to cancel this contract reserving to itself,
nevertheless, all rights for damages which may be incurred by the Board. FAILURE TO DELIVER AS HEREIN
SPECIFIED SHALL RESULT IN THE APPLICATION OF THIS PROVISION.
21. Bidders shall state, in the appropriate place on the Bidder Submission form, what discount, if any, is offered for prompt
payment of bills; and if such cash discount is offered it shall also be stated within what period of time the discount will
be allowed. (Discount will not be considered during the awarding process.)
22. Each vendor shall supply to the Board of the Bucks County lntermediate Unit No. 22 a list of items purchased by each
LEA no later than July 15,2O14.

The Bucks County Schools Cooperative Purchasing Group will receive sealed bids for AudioVisual and IMS Supplies until 3:00 P.M., July 3l ,2013. Bids will be publicly opened and read
aloud thereafter. All bids shall be submitted in a sealed envelope, addressed to the "Bucks
Gountv Intermediate Unit No. 22. Bid Dept.. 705 N. Shadv Retreat Road. Dovlestoyvn' PA
199,9L". The envelope must have your company name placed thereon, and must be plainly

with the receptionist prior to bid opening. Late bids will not be accepted.

A bid bond. certified check or cashier's check in the amount of three thousand dollars($3.0001.

Checks must be valid for the duration of the bid. Upon award of the bid, successful bidders may
exchange their certified check or cashier's check with another certified or cashier's check in an
amount equal to ten percent (10o/o) of the bidder's awarded amount Security for successful
bidders shall be held by the Bucks County Intermediate Unit No. 22 for the duration of the
bid. Upon expiration of bid, bid bonds will be destroyed unless written request was made at time of
bid for bid bond to be returned.
3.
Quantities are not determined at this time. The vendor shall furnish both columns pricing for
quantities of one (1) and two to six (2-6) shipping to one location. A vendor must furnish prices for
both columns. The price larger quantities shipping to one location shall be negotiable. The list is
comprised of items that the LEA's foresee a need for in the next school year however cannot
determine quantities at this time.
4.
Bid prices for Bid #13-012, Audio-visual & IMS Supplies shall be irrevocable from JULY l. 2013
THROUGH JANUARY 31.2014, with the option to extend the pricing thru JUNE 30,2014.
5.
Successful bidders must supply (per shipment), where applicable, "Material Safety Data" sheets in
compliance with the Employee Right to Know laws. Failure to provide the MSDS sheets may
result in withholding of payment until received.
6.
IT IS THE RESPONSIBILIW OF THE BIDDER TO GHECK THE BCIU NO. 22 INTERNET WEBSITE,
PRIOR TO SUBMITTING BID, FOR ANY ADDENDA PERTAINING TO THIS B¡D. EACH ADDENDUM
MUST BE LOGGED ON THE COVER SHEET AND ATTACHED TO THE B¡D PACKET. THE INTERNET
WEBSITE ADDRESS IS WWW3.BUCKSIUOBGIEIDSI.

ALTERNATE BID ITEMS: The bidder must clearly indicate on his or her bid, the manufacturer
name, model number, and/or other identifying information for every item bid. Samples, catalogs,
brochures and/or catalog cuts with brief descriptions shall also be submitted for alternates bid.
The item number must be clearly marked thereon. Do not provide alternates for items marked "NO
SUBSTITUTIONS".

8.
Product samples must be submitted under separate cover from the sealed b¡d and must be
received prior to bid opening. The sample must clearly indicate item number and for which
bidde(s) the sample represents. After the awards are made, the unsuccessful bidders may pick
up their samples at their own expense. Successful bid samples will be retained until final delivery
of these items is made.
9.
Bids should be as specified or current model. Bídder(s) must indicate the brand name and model
number of each item on which a price is submitted. Failure to do so shall result in the
disqualification of the bid.
10. Deliveries will be accepted daily between 8:00 AM and 3:00 PM, and not on Saturday, Sunday or
holidays except by special arrangement. (Note special delivery instructions on PO's.)
11. A ONE-YEAR WARRANTY to include all parts and labor shall apply to any and all equipment or
items awarded. The year will commence the date of receipt of the items by a participating LEA.
12. All supplies and materials subject to deterioration furnished under this bid shall be warranted to be
current stock, useful for fifteen (15) months. ANY STOCK FOUND TO BE UNUSABLE BECAUSE
OF DETERIORATION WILL BE REPLACED PROMPTLY BY THE SUCCESSFUL BIDDER FOR
SAID ITEM.
13. Brand name and model # column must be filled in for bid to be accepted. Any deviation
from the model indicated must be noted in the "Brand Name/Model Number" Column.
Complete MANUFACTURER specifications shall be included with your bid for "Alternate"
Items or alternate model numbers. Failure to inctude this information will result in the
disqualification of this item from your bid.
14. A new section for projector lamps has been added. Preference will be given to vendors bidding all
lamps or all lamps by projector brand name. We may award this section in its entirety, per
projector brand or by line item.
15. No substitution of awarded items without prior approval by the LEA generating the purchase order.
