courses like listed in our Net price List.

Equipment provided by the Agent:
Please advise either your Customer or your Dive staff to ensure that your Rental Equipment will not be
forgotten with the transfer back to Phuket. KSA can not be held responsible for any loss or damage of
your Rental Equipment. Further please advise your Staff or Guests that your rental Equipment needs to
be rinsed and packed by them and taken care that the Equipment comes on the Transfer bus.

Please place your reservation after you checked the availability. We can guarantee a fast and efficient
service by phone daily from 10 am to 8.30 pm in the High season. Of course you can place your
reservation also by e-mail, but during our busy working hours we can’t guarantee that fast and efficient
service. We will hold the reservation for 24 hours; any delays on your confirmations need to be confirmed
(from case to case) by phone.

We accept bookings only by correspondence. After we have checked the sent booking form(s), we will
confirm or reject your booking(s) by Fax. We highly recommend sending your bookings by FAX to
provide and guarantee a good, safe & efficient service. You are most welcome to use the provided
Booking forms. If you wish to use your own Booking form please ensure that all topics, below are
provided

It is the policy of Khao Lak Scuba Adventures to only allow staff on board who fulfill ALL of the following criteria:
1. You and your Staff agrees on to follow the Advice from the Trip leader and the Staff Rules of KSA
2. You and your Staff agrees on to help & work in non diving Time in the same way like our own Staff while
check in/out and on Board
3. Be renewed and in active status with PADI (and other training agencies if applicable)
4. Have a full set of scuba diving equipment (including, knife, SMB audible signal device, dive light)
5. Have diving insurance with DAN or equivalent.
6. You and your Staff are willing to take over Divers from KSA if needed. The maximum Ratio is 4:1 on our Boats
RULES:

If an agent has 1 or more divers the agent may send their own staff free of charge (provided the above criteria can
be met).
Manta Queen III & Flying Manta 1 (Overnight Trips)
If an agent has 2 or more divers the agent may send their own staff free of charge (provided the above criteria can
be met).
Manta Queen I & II (4 Day-4 Nights
If an agent has 2 or more divers or KSA cannot cover the language, the agent may send their own staff free of
charge (provided the above criteria can be met).

1. Terms and Definitions
1.1 Khao Lak Scuba Adventures Co., Part., who shall comprise (“the Client”), as well as all their affiliates, officers, employees, workers and directors and [COMPANY
AS STATED BELOW], (“the Agent”), shall agree to enter into this agreement of agency (“the Agreement”) from this date, the [DATE OF SIGNATURE BELOW].
1.2 The Agent shall represent the Client in the scuba diving industry (“the Industry”) for a period of 9 months, beginning on the date this contract is signed.
1.3 Within the Industry, in particular, the Agent shall be able to represent and facilitate the Client’s business, in the retail procurement and booking of recreational
liveaboard trips, day trip diving excursions, and PADI diving courses (“the Business”) subject to the following provisions.
2 Contractual Provisions
2.1 Representation of the Business
2.1.1 In representing the Client, the Agent must furnish to the Client, copies of their official Company paperwork, clearly delineating the Agent’s legal capability
to represent and sell the Client’s Business, and to operate in Thailand.
2.1.2 The Agent shall use their best endeavours to engage in the promotion and sale of the Business, and the Client, in the following manner:
2.1.2.1 the Agent shall always represent the Client in a professional and sincere manner befitting the reputation of the Client and the Client’s Business;
2.1.2.2 the Agent shall ensure that the marketing and promotional material, as supplied by the Client, is always organised, up to date, visible and conspicuous to
the average consumer;
2.1.2.3 in representing the Client, the Agent shall always market to the consumer, the most current and applicable information about the Business, and the Client;
2.1.2.4 the Agent must notify the consumer of the full and complete price of their booking, as well as all associated inclusions and exclusions.
2.1.3 The Agent may represent another client in the Industry, so long as the Agent continues to represent the Client in accordance with the provisions of this
Agreement.
2.1.4 The Agent is not permitted to advertise or sell any aspect of the Client’s Business for anything other than the published net retail cost, as outlined
in the pricelist the Client gives to the Agent, (“the Price”). The Agent may not forfeit their commission, to offer any aspect of the Business at a discount or diminished
price.
2.1.5 Any online or promotional offers or packages offered by the Client themselves, are reserved solely to the Client, and shall not be represented or sold by the
Agent at any time.
2.1.6 To enable the fulfilment of the Agent’s provisions as stipulated above, the Client shall provide to the Agent, the most sufficient and up to date promotional
material and information, so that the Agent may promote the Business in the most effective way.
2.1.7 The Client will also ensure that the Agent is imminently informed of any change in the Business’ schedule, proposed destinations and/or
availability.
2.2 Remuneration
2.2.1 The Client shall pay to the Agent, a commission of 30% based on the net Price of each trip and/or course booked by the Agent. There shall be
no commission on any airport transfers, course materials, equipment rental or National Marine Park Fees.
2.2.2 The Client shall pay to the Agent, a commission of 30% based on the net Price of any PADI course sold, and booked, by the Agent. This commission
shall not extend to the sale or purchase of any PADI materials.
2.2.3 As means of remuneration, the Agent shall procure from the consumer 30% of the net Price. This 30% shall comprise a deposit (“the Deposit”)
on the consumer’s booking. The Agent shall keep this Deposit as their commission, and consequent remuneration.
2.3 Confirmation and Payment
2.3.1 Before booking any Business, the Agent must confirm with the Client, the availability of each proposed trip or course.
2.3.2 Once the Client has confirmed availability, the Agent must fill out a booking form, (“the Form”). The Form must be sent to the Client to confirm the booking,
and the Client will return the Form to the Agent with a consequent stamp of confirmation; if the Form is not fully completed or able to be confirmed, the Agent
must amend and re-send the Form to the Client via facsimile or email to acquire the requisite confirmation.
2.3.3 Subsequent to the Agent procuring the Deposit from the consumer, the Agent must present the consumer with a booking voucher to be redeemed with the
Client. The Agent must inform the consumer of the outstanding balance, and that this must be settled directly at the Client’s place of business, before departure.
2.3.4 Where 2.3.3 shall be impracticable and contrary to the Agent’s longstanding business practices, the Agent must obtain the Client’s written permission to
adhere alternatively to the following procedures, [and] such permission shall only be conferred at the Client’s discretion:

2.3.4.1 procure from the consumer, the full amount of the Price, including the Deposit; and
2.3.4.2 the Agent shall pay to the Client’s bank account, the whole amount of the Price less the Deposit, within 5 business days of the Client
dispatching an invoice.
2.3.5 Where the Agent procures a full charter of one of the Client’s boats, the Agent may set the price per day to be charged to the consumer, so long
as this price incorporates the charge per day required by the Client, for the duration of the trip.
2.3.6 Upon the booking of the charter, the Agent must take a 30% deposit on the total price the Client will charge for the entire charter, and this must
be paid directly to the Client’s bank account. The Agent must then procure the outstanding 70% to be paid to the Client, at the latest, 2 weeks before
the time the trip is due to depart (“the Departure Time”).
2.4 Cancellation and Refund
2.4.1 Where a cancellation is made by the Client, for a reason other than those listed below, the Client may refund all monies paid by the consumer.
Where a Deposit has been taken by the Agent, the Agent must revert this back in full, to the consumer:
2.4.1.1 the Client reserves the right to modify, delay and/or cancel diving arrangements where the remoteness or inaccessability of the diving
destination, local custom, Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, political unrest and other
hostilities (regardless of whether war is declared), or other technical difficulties cause the arrangements to become unsafe, perillous and/ or
impracticable;
2.4.1.2 the Client may prohibit an individual’s participation on a dive(s), where they are physically, mentally or emotionally unfit to dive, demonstrate
a distinct lack of respect for National Marine Park rules and regulations, handle or harm marine life, consume alcohol between dives, or fail to abide
by general international safe diving standards and practices; and
2.4.1.3 where an individual fails to complete scheduled dives, segment(s) of the dive trip, and/or course training dives for whatever reason, no refund
shall be administered in these circumstances.
2.4.2 The cancellation of any booking by the Agent, for whatever reason, shall result in the following:
2.4.2.1 where the Agent makes a cancellation less than 24 hours before the Departure Time, and the consumer has paid the Agent the Deposit only, the Agent
shall forfeit the Deposit, as his commission procured from the consumer, and transfer this amount instead, to the Client’s bank account within 5 business days of
the cancellation being made;
2.4.2.2 where the Agent makes a cancellation less than 24 hours before the Departure Time, and the consumer has additionally paid to the Agent the outstanding
70% on the booking (“the Outstanding Amount”), no part of this will be refunded. The Outstanding Amount must be paid to the Client as above, and the Agent
may retain the Deposit.
2.4.3 Where the Agent makes a cancellation more than 24 hours before the Departure Time;
2.4.3.1 the Agent shall forfeit the Deposit as above, to the Client;
2.4.3.2 where the consumer has additionally paid the Outstanding Amount to the Agent, the Agent must refund this to the consumer.
2.4.4 Where there is a cancellation of a full charter after the booking has been made, the deposit paid to the Client is non-refundable to the consumer. The
outstanding 70%, if paid, will only be returned to the consumer, if the cancellation is not later than two weeks before the Departure Time.
3. Breach and Termination
3.1 Either party may terminate this agreement at any given time, provided that the terminating party gives 1 week’s written notice prior to termination, stating
clearly, the reasons for termination.
3.2 Any deviation from, or failure by the Agent to adhere to any of the contractual provisions in the Agreement, shall result in the immediate termination of the
contract by the Client, without warning, and an entitlement to seek damages for any ensuing losses.
3.3 Where the Agent behaves in a manner which is unrepresentative of the Client and unprofessional per se, the Client reserves the right to seek repudiation, and
damages for any damage to the Client’s reputation or Business.
3.4 Where the Agent is late in paying the Client monies owed, for whatever reason, the Client shall charge the Agent a 5% late payment penalty fee from the
payment deadline, for each day the Agent is late in paying the Client.

Release of Liability & Express Assumption of
Risk for Travel & Diving on a Liveaboard Trip
Please read the following document carefully, by signing it, you are assuming responsibilities and waiving legal rights.
Bookings will not be fully confirmed until this Release of Liability has been filled out by each participant.
Khao Lak Scuba Adventures Pa., Ltd shall be construed to comprise “the Company” as well as all their affiliates, officers, agents, lawyers, employees, workers, directors and representatives.
I,_________________________________________ (“the Participant”) hereby affirm that I am fully aware, and have been thoroughly advised and informed, that skin
diving, scuba diving, technical diving, snorkeling, swimming in the open ocean, and other aquatic activities carry with them inherent risks and hazards.
I subsequently understand, acknowledge and accept that:
1.even where I adhere to all appropriate safe standards and practices associated with scuba diving and technical diving, there continues to remain a risk and hazard of decompression
sickness, embolism, hyperbaric, or other injuries. As such, I expressly assume the risk of any or all said injuries, including death, and shall release the Company of any responsibility or
liability whatsoever, in accordance with such risks;
2.I expressly assume the risk of any or all of aforesaid injuries, including death, which may ensue where I engage in any dangerous practices whilst underwater, such as breath-holding,
interacting with any marine life, diving outside of my own personal, planned or accepted limits and/or depths, disregarding any local customs, rules or regulations, and putting myself
or others in any unnecessary danger whatsoever, and that I will not hold the Company responsible or liable for any or all such injuries;
3.I will be on a diving trip and/or land tour in areas made remote by either time, distance or both, from a recompression chamber and/or medical facility. As such, I choose nevertheless, to
proceed with such a trip, and dives, notwithstanding the feasible absence of a recompression chamber and/or medical facility in proximity to the remote location(s). I expressly assume
the risk of frequenting such locations, and subsequently release the Company of any responsibility or liability therein;
4.where I am involved in any accident or medical predicament, either in the water, on land or on board the vessel, I expressly assume all financial responsibility for the full and complete
cost of any medical and/or recompression treatment, emergency evacuation and/or repatriation; and subsequently declare that I have procured sufficient insurance to deal with such
instances;
5.I will thoroughly examine my snorkeling, scuba diving and/or technical diving equipment prior to engaging in the activities listed above, and will imminently notify the Company if any
of the equipment is not in full working order. Prior to each dive, I undertake to examine my own equipment, and assist my buddy with the examination of his, to ensure the functionality, effectiveness, completeness and familiarity of both sets of equipment. I do not expect my equipment to be checked by anyone else, and will not hold the Company responsible for
any injury, including death, that might result from any negligence on my part;
6.where I obtain any equipment from the Company, I shall check it thoroughly myself, and upon locating any defects or unsuitability, will similarly report this to the Company. The
Company will not be held responsible or liable for any injury, including death, which may result from a failure to perform such checks and report this;
7.the Company shall not be held liable for any acts, omissions or failures of any third parties connected with the diving trip, i.e. any travel services or public carriers, tour agencies, or
airport staff. It is my responsibility to arrive promptly at the nominated place for the trip’s departure;
8.in consideration of being allowed to participate in this trip, I hereby personally assume any and all such risks inherent with the trip that may befall me, whether foreseen or unforeseen,
and do hereby release the Company of any responsibility or liability, for the loss or damage to any property, personal injury or death, that may result from Acts of God (including fire,
flood, earthquake, storm, hurricane or other natural disaster), acts of war, political unrest and other hostilities (regardless of whether war is declared), acts of terrorism or piracy,
governmental requirements or local customs, the acts, omissions or failure of the Participant or any other third parties such as rescue operators;
9.I shall waive and relinquish any and all claims or causes of action against the Company whether foreseen or unforeseen, directly or indirectly related to my participation in the trip,
concerning accident, personal injury or illness, theft, damage to or loss of property and/or wrongful death; and that the Company shall be exempt, and not be held liable or responsible
for any such injury or death, or any other damages to me, my family, estate, heirs or assigns, that may occur as a result of my participation in this trip, or as the result of the negligence
of any party, including the Company, whether passive or active;
10.I agree to leave all land and underwater sites undisturbed. I shall not willfully damage, collect or remove any live animal, crustacean, fish, coral and/or any other items relating to the
natural environment, including shipwrecks, or any other fixtures, from their innate marine environment or ecosystem. I undertake to accept full and complete financial responsibility
and liability for any personal violation of this provision;
11.Statement of Understanding - In consequence of the previous provisions I have already accepted, I declare that I am of legal age in the jurisdiction of my residence and am competent to sign this document or, if not, that my parent or legal guardian shall sign on my behalf, and that my guardian or parent completely understands and agrees with this document.
I understand that the terms herein are contractual and not mere recital, and that I have signed this document of my own free act;
12.Severability - The failure by either party to enforce one or more of the provisions in this Agreement, because of the illegality, invalidity or unenforceability of that provision(s), shall
not affect the validity or enforceability of any other provision in the Agreement;
13.Assignment - The Agent shall not assign any of its responsibilities or obligations, or delegate any of its duties under this Agreement without express written permission by the Client;
14.Waiver - The failure by either party to perform one or more of its obligations contained in this Agreement, shall not be taken as a waiver of its contractual performance of any other
obligation(s) in the Agreement;
15.Entire Agreement - This Agreement contains all the rights and obligations of both parties relating to the subject matter, and no other arrangements, agreements or undertakings
shall be granted or implied from this Agreement;
16. No Third Parties - Nothing in this Agreement shall expressly or impliedly confer rights on any third party;
17.Governing Law - This contract shall be governed by, construed, and enforced in accordance with the laws of the Kingdom of Thailand. Where any question or issue should arise under
the Agreement or any of its provisions, it shall be decided only in the courts or tribunals of the Kingdom of Thailand, to the exclusion of any other courts or tribunals;

NB. It is a pre-requisite to be first-aid trained within the last 2 years to become a PADI Rescue Diver. The Rescue Diver Course is focusing on safety in Scuba Diving and rescue skills. This course expands on what you already know about how to
prevent problems, and how to manage them if they occur, moreover it’s a lots of fun as well. Most divers find this course both demanding and
rewarding, and at the end, say “it’s the best course they’ve ever taken!”
You will learn about self rescue first, then recognize and manage stress in other divers.

and 7.5 meters wide with steel hull. We believe that Manta Queen III is one of the most comfortable and modern ships working the West Coast of
Thailand.
During your stay on Manta Queen III you can enjoy freshly cooked breakfast, lunch, dinner and snacks as well as tea, coffee and soft drinks

development sessions and five practical dives called Adventure Dives.

This is a wonderful way to take a beginner course. You will be able to take 2 additional dives to become a good and safe diver. The course will take 4 days giving you

BASIC SCUBA DIVER COURSE
The scuba diver course can be done in as little as two days. A combination of theory and swimming pool training in our own Training Academy before you enjoy your 2
Open Water Training Dives the next day in Similan Islands. This course certifies you to dive under direct supervision of a PADI Dive Master or Instructor to 12 meters
maximum.
After you have checked in at our Head Center in Khao Lak you will have to complete a medical Questionnaire and a Student Record File. Please read chapter 1 and 2 in
your Manual and complete the knowledge Reviews and the Quizzes of these chapters as your Homework. (2 hours)

GUIDELINE DIVING ON MANTA QUEEN I & II
Manta Queen I & II are our two main live-aboard boats for the 4 Days 4 Nights independent dive safaris from the Similan islands
to Koh Bon, Koh Tachai and Richelieu Rock. You can make up to 14 Dives include sunset and night dives. On the way back to
the harbor on day 4 we stop at either Koh Bon or Koh Tachai and finish with an awesome dive at the famous Boon Sung wreck.
Please check in (in person) on the day of departure between 10 am and 7 pm (latest). At the main dive center you can make
your deposit, balance payment either by cash or credit card (3% is added for credit card sales and only visa and master card
can be accepted). After the check in is done you are welcome to use our social networking area to do some internetwork or if
you wish you can spend your Time at our Pool in the Training Academy. Please ask our check in Staff. The Transfer Bus will
leave the Dive center at latest 8.30pm on its way to the Harbor.
When you have seen your cabins onboard and had dinner, there will be time to set up equipment and make a thorough check
before leaving. The boat departs with a nice firework and then you will get a short but important boat briefing.
You will wake up in the Similan islands with a nice cup of coffee and a light first breakfast while your trip leader gives a dive
safety briefing and dive site briefing. After the first dive in paradise you will smile the whole day and the schedule is simple:
eat-sleep-dive-repeat ;) We have a slightly flexible schedule for the dive sites so we can choose the best for you.
After the Trip:
We will pick you up at the pier at 2:30 pm to return to the main dive center. Arriving at 2.45 pm you have time to sort out your
luggage and comment on Tripadvisor or facebook about your trip if you like to. If you have rented a dive computer or camera
please bring them back personally to the check out counter. We would need to charge you the Selling price if you don't bring
them back personally. Do not forget ANYTHING on the boat, as we have no chance to get back on until the next trip starts
because the Boat is out in the Harbor for a allover cleanup. At 4pm we will transfer you to your hotel or resort - either in Khao
Lak area or Phuket. Please enjoy this Time to fill out the comment form or even to make a comment on one of the Social
network Platforms, i.e. Trip Advisor or Facebook. For the Time onboard you will not need to take all your Belongings with you.
You can leave them in the Storage at the Dive center. Please ensure that you take all your valuables, Passport, Tickets and so
on with you on Board. On the Ship you can leave your Valuables in the Captains Safety Box if you like.

Flying Manta I is our custom built longtail-boat with a proper roof, a fresh water shower, a tank rack and lots of space.
Before departure in the morning from our main dive center in Khao Lak we provide you with a light Breakfast.
The transfer to the local dive sites TAKES ABOUT 45 to 60 minutes.
Drinking water and fresh fruits are provided the whole day. Between the dives we provide freshly cooked food on the boat.
