sound and proceeded "down tire Sound to Xiong
Tsland; but immediately before reaching the spot an
incident occurred ■whicnica.used a long- detention.
It was about Ifalf-past two o'clock when, at a
•considerable distance, a vessel was descried close in
shore with Tror lore and top-gallant. yardß down, and
her mainyard boused. At the time, it was blowing
a full half gale of wind. Tho Eangatira immediately
bore down, when it was ascertained that the vessel in
listress was the brigantine Rebecca, which had left
Ais port two days before. She was on a dead lee
shore, having through the night, dragged both
anchors. Mr. Baillie, Harbour Master, readily
receiving the consent of the Commissioners to act as
he thought best in the emergency, went on board the
brigantine with Mr. Liardet's boat, and crew. The
vessel was in great danger, and it was not certain at
what moment she might drift on to tho rocks. A
warp was conveyed on board, and by a skilful
manoeuvre executed by Capt. Mundle., the sttamer
was brought to tho bow of the brigantine, wheli slio
■was towed off into open water.
It is right to mention that Mr. Love's boat's crew, from the whaling
station at the Sound, rendered most valuable assistance. The ' Bebecca' being carried out of danger,
tho ' Bangatira' returned back to Picton, arriving at
■the wharf soon after dark.
On Thursday the Commissioners started for Blenheim but, before arriving at tho "Wairau, they were
informed by a gentleman, whom they met on tho
way, that it would be impossible to cross the ferry.
Acting upon ipse dixit tho party returned to Picton,
when it was shortly after ascertained that there was
nothing to have prevented them going through. Mr.
Eyes and Mr. Sinclair, who had left Blenheim to meet
the Commissionershalf-way, came on to Picton, and a
gentleman connected with our establishment rodo
through Blenheim in a little over three hours.
In the afternoon tho Commissioners, accompanied
by the Superintendent and Capt. Baillie, embarked
in Mr. Liardet's boat, and paid a visit to Sliakcspear
Bay and the localities surrounding it, returning
early in the evening.
Yesterday the Commissioners went through to
Blenheim, and during tho earlier part of their drive,
they must have experienced some very rough

SUPREME COURT. —Saturday.
(Hefore Hit Honor the Chief Justice.!
lIT BE JOHN HATTItAY.
His Honor took liis scat on tho Bench at ten
o'clock.
The Sheriff made a return of a writ of attachment
against tho person of tho bankrupt, endorsed non
iiireritaa.
His Honorsaid the writ Would have effect; at any
time. The authority given by the Court of Chancery
were plenary in cases of this kind, tho object being
the realization of an estate I'or t-lie benefit of creditors.
The only question now was what steps should bo
taken to wind up the estate. He thought tho best
was to adjourn the Court to give time to the creditors
to consider nnd suggest to the Court by what action
this object might be most conveniently attained.
Mr. Beveridge cited the 12th section of the
Debtors' and Creditors' Act, as giving tho Court
power to order assignment, if it should seem fit, to
ono or more of the creditor?'.
His Honor: That proceeds upon the assumption
that ordinary course of practice lias been adhered to,
where the bankrupt has been examined, wliero his
release follows, and where one or more of the creditors
have been petitioners.
This case, however, is
different. The bankrupt's examination had not been
concluded. Tho bankrupt had been petitioned, and
was not present, or within the authority of tho Court.
The whole of this Act of Parliament is built upon
the usual practice being observed, and it contemplates that release shall lmve been given before
assignment shall be ordered. In this dilemma, 1
think there is no other alternative than for the Court
to adjourn with tho object I have stated.
As the
criminalbusiness will be proceeded with on Monday
next, and will last some days, I propose that the
further hearing of this case bo adjourned to Friday
Edgecombe's on the Great North _ Boad. I saw a
crowd assembled to witness a prize tight between
tho prisoners Cooper and Hill. Tho priseners Bichardson and Thomson woro seconding Cooper, and tho
prisoners Dui't.y nnd Milner, wero seconding Hill.
I accompanied tho Commissioner of Polite into the
ring and ordered them to desist. A Iter a low scrambles they obeyed us. I cannot say of my own knowledge whether they
went
out
for tho purpose of
fighting or not.
Thomas Stephenson, deposed: That tho fight in
question was for the sum of £25 n-sido.
This closed the case for tlio prosecution.
The prisoners reserved their defenco.
His Worshipremarked that this was the first, and
ho sincerely trusted would bo tho last, circumstance
of tho kind that would occur in Auckland. Prize
fights were most disgraceful exhibitions in a civilized
community, and ho trusted tho means which the
policc hud adopted would have tho efl'cct of putting a
stop to such proceedings for tho future.
Jivorv
person who had been present at tho fight in question
was liable fo tako their placo where the prisoners
now stood, as aiding and abetting a breach of the
peace.
His Worship here cited a case in point:—" Persons
who aro present at a prize fight, and who have gone
thither with fho purpose of seeing tliopersons strike
each other, aro all principals in tho breach of tho
peace, and indictable for an asfault as well as the
actual combatants, and it is not at all material which
martial law so simplifies the Civil Government of

recommended that we should have night lights, in
order to communicate with vessels lying in the roadstead when danger threatens, or to give warning to
go to sea or hold on, or whatever the necessity may
be ; yet, although not one earthly exception can be
taken to such recommendation, action expires in imbecile communication with the Provincial Council.
One day last week four men, military settlers, were
committed for trial fcr stealing a cask of ale from the
canteen at Potoko. The magisterial inquiry was
conducted with closed doors, the Press being also excluded. Tiie law, it is true, gives power to magistrates to conduct such preliminary inquiries in this
manner, where they think the ends of justice will be
furtherinsured by so doing. I am not aware, however, of any facts in connection with this case which
would support the Bench in tho exercise of this unusual power. The Herald of last Saturday has taken
exception to the course pursued by the Court in tliis
case, and calls attention to the fact that the accused
men aro liable to some six or nine months' incarceration in the infamous den called u jail in this
town, before their trial comes on, wlim it has to
bo finally ascertained whether they are innocent
friendships and her enmities, and made to share in a
policy which does not iepresent our ideas, or legislate
for our wants, and which we do not diiect, and can-
not contiol. It is therefore idle to quarrel with our
present utuation, and infatuation to blink the consequents that may arise out of it. If We do not help

the Admiralty have nothing to spare us. It is only
by tho last mail that orders arrived in Kew Zealand
for the recall of the troofs, and we may be certain
that, should tho war extend from the continent to the
sea, the defencc of Melbourne will not he included in
the official programme."
THE LATE NAVAL FIGHT.
[From the Weekly
Thk Captain of tho Kcarsage has addressed the fol-
lowing letter to a contemporary :
Sir,—There lias been so many nonsenical publications on the engagement which took place between
theAlabama and the Kenrsage, that it is my wish
that a correction should be made. In the first place
no challenge was sent by Captain "Winsloyv ; to have
done so would have been to have violated the order
of tho Navy Department. On the contrary, Captain
Winslow received a request from Captain Semmcs
not to have, as ho would fight the Kearsuge, and
would only occupy a day or two in his preparations.

Galujtwni publishes Captain "YVinslow's official report ol' (he engagement, to which there is the following postscript:—" Capt. Scrnmes complains that he
was iired into after striking, and that the boats of
the Kearsage "were not sent soon enough. Captain
Semmes knows well that 3Kid it been known the
Alabama had surrendered, another gu* would never
have been discharged, and the two undisabled boats
were sent immediatelywhen his condition was known.
It. would seem strange that such complaints come
from one who did not hesitate, and availed himself
of the means sent in the cause of humanity to save
life, to make oil'; and could the captain of the Kearsage have believed it was possible for the commander
of the Deerhouud to have actcd so dishonourably, ho
would have instantly sunk the Dc'erliound."
A correspondent of the Indcpcndancc Beige says
that two days after the defeat of the Alabama an
iron-plated vessel, built by 51. Arinan, at Bordeaux,
left that port, with the view, it is supposed, of
succeeding- the notorious privateer, and of revenging
the naval disaster which lias befallen the South.
