TERMS AND CONDITIONS
1. Instructions on how to claim and the offer forms part of these Terms and
Conditions. Participation in this promotion is deemed acceptance of these Terms
and Conditions. Offer not valid in conjunction with any other offer.
2. Claims are only open to Australian residents. Employees (and their immediate
families) of the Promoter, participating retailers and agencies associated with
this promotion are ineligible to claim.
3. Promotion ends for purchases at close of business on 31/12/2013
(‘Promotional Period’).
4. To be eligible to claim, individuals must purchase any Rowenta Handstick or
Canister (‘Eligible Product’) from any participating retailer during the Promotional
Period and return the Eligible Product within 30 days of purchase in accordance
with clause 5 below.
5. To claim, individuals must complete this form, attach a photocopy of their original
purchase receipt, enclose the Eligible Product they wish to return and send
together to, ‘Rowenta Money Back Promotion’, C/- Groupe SEB Australia, PO
Box 7535, Silverwater, NSW 2128, so that it is received within 30 days of the date
of purchase as stipulated on the
purchase receipt.
6. The Promoter reserves the right, at any time, to verify the validity of claims and
claimants (including a claimant’s identity, age and place of residence) and to
disqualify any claimant who submits a claim that is not in accordance with
these Terms and Conditions or who tampers with the claim process. Errors
and omissions may be accepted at the Promoter’s discretion. Failure by the
Promoter to enforce any of its rights at any stage does not constitute a waiver
of those rights.
7. Incomplete, indecipherable or illegible claims will be deemed invalid.
8. Multiple claims permitted, subject to the following: (a) only one (1) claim
permitted per Eligible Product; and (b) each claim must be submitted separately
and in accordance with claim requirements.
9. Claimants must retain their original purchase receipt(s) to verify their claim(s).
Failure to produce the proof of purchase for all claims when requested may,
in the absolute discretion of the Promoter, result in invalidation of ALL of a
claimant’s claims and forfeiture of any right to an offer. Purchase receipt(s) must
clearly specify the store of purchase and that the purchase was made during the
Promotional Period but prior to claim.
10. The Promoter’s decision is final and no correspondence will be entered into.
11. Every valid claim received will be awarded money back in the form of a cheque
equal to the value of the returned Eligible Product shown on the purchase
receipt. Within 28 days of the Promoter receiving a valid claim that complies
with these Terms and Conditions, the cheque will be mailed to the claimant at
the address provided on their claim form. Once a cheque has left the Promoter’s/
supplier’s premises, the Promoter and its agencies and companies associated
with the promotion will not be responsible for any delay in delivery, loss or
damage to the cheque.
12. If a claim is deemed not to comply with these Terms and Conditions, the claim
will be discarded and the claimant will not receive a communication in this
regard. The Promoter’s decision in relation to all aspects of this promotion is final
and no correspondence will be entered into.
13. Claimants who return a Rowenta Vacuum Cleaner after they have received a
bonus must also return the bonus to the Promoter. This clause is not intended to
affect any claimants’ statutory rights in relation to returned goods.
14. Each claimant is responsible for paying for the costs associated with
participating in the promotion, including but not limited to postage. All claims
become the property of the Promoter.
15. If this promotion is interfered with in any way or is not capable of being
conducted as reasonably anticipated due to any reason beyond the reasonable
control of the Promoter, including but not limited to technical difficulties,
unauthorised intervention or fraud, the Promoter reserves the right, in its sole
discretion, to the fullest extent permitted by law: (a) to disqualify any claimant; or
(b) to modify, suspend, terminate or cancel the promotion, as appropriate.
16. Nothing in these Terms and Conditions limits, excludes or modifies or purports
to limit, exclude or modify the statutory consumer guarantees as provided under
the Competition and Consumer Act, as well as any other implied warranties
under the ASIC Act or similar consumer protection laws in the State and
Territories of Australia (“Non-Excludable Guarantees”). Except for any liability
that cannot by law be excluded, including the Non-Excludable Guarantees, the
Promoter (including its respective officers, employees and agents) excludes
all liability (including negligence), for any personal injury; or any loss or damage
(including loss of opportunity); whether direct, indirect, special or consequential,
arising in any way out of the promotion.
17. Except for any liability that cannot by law be excluded, including the
Non-Excludable Guarantees, the Promoter (including its respective officers,
employees and agents) is not responsible for and excludes all liability (including
negligence), for any personal injury; or any loss or damage (including loss of
opportunity); whether direct, indirect, special or consequential, arising in any
way out of: (a) any technical difficulties or equipment malfunction (whether or
not under the Promoter’s control); (b) any theft, unauthorised access or third
party interference; (c) any claim form or money back that is late, lost, altered,
damaged or misdirected (whether or not after their receipt by the Promoter)
due to any reason beyond the reasonable control of the Promoter; or (d) any tax
liability incurred by a claimant.
18. The Promoter collects personal information in order to conduct the promotion
and may, for this purpose, disclose such information to third parties, including
but not limited to agents, contractors, service providers, offer suppliers and as
required, to Australian regulatory authorities. Claim is conditional on providing
this information. The Promoter may, for an indefinite period, unless otherwise
advised, use the information for promotional, marketing, publicity, research
and profiling purposes, including sending electronic messages or telephoning
the claimant. Claimants should direct any request to access, update or correct
information to the Promoter. All claims become the property of the Promoter.
