CHARLES LLOYD & MARIA FARANTOURI TECHNICAL/HOSPITALITY RIDER ATTACHMENT B 08/19/2014 This technical rider is a binding part of the attached contract for this engagement. PLEASE READ THIS RIDER CAREFULLY. By signing this rider you agree to provide for and arrange for at your sole cost and expense, specific production and staging requirements that are essential for this performance. A TU RI 00 G R D 07 EN AL ER C U Y SE 1) NO SMOKING The PURCHASER will make every effort to present the concert in a nonsmoking environment. It will be announced prior to the concert that the ARTIST requests NO SMOKING due to health reasons. If needed, signs will be posted around the venue to this effect. It is very important that the PURCHASER will make sure that the stage crew is made aware of this NON SMOKING policy. Due to a medical condition and two throat surgeries, Charles Lloyd cannot be near smoke. 2) ) BILLING, ADVERTISING AND PROMOTION ARTIST will be given 100% headline / top billing in any and all paid advertisements including but not limited to posters, fliers, programs, signs, marquees and banners. ARTIST shall have approval of any other artist to appear on the program, and shall have top billing. PURCHASER will notify Artist of any other artist(s) that may appear at the same engagement. ARTIST reserves the right to perform before or after any other artist’s performance and has the right to determine the length of any other artist’s performance. All photographs or likeness of ARIST used in advertising, programs or posters to promote the appearance of ARTIST, must be approved by ARITST, if not previously provided by ARTIST”S representative. A1. BILLING: CHARLES LLOYD & MARIA FARANTOURI, (100%) featuring Takis Farazis, Reuben Rogers, Eric Harland, and Socratis Sinopoulos ( 75%) W A2. ARTIST is to receive 100% star billing on ALL publicity releases and paid advertisements, including without limitation: programs, flyers, signs, newspaper ads, marquees, tickets, radio spots, TV spots, etc. unless otherwise authorized in writing by ARTIST OR HIS REPRESENTATIVE. N O A3. PURCHASER agrees to use only artwork, ad mats, photos and / or promotional materials provided or approved by artist in all advertisements (which can be found at www.charleslloyd.com). No product, service, or publication utilizing the name or likeness of Artist may be produced, sold, or distributed without the prior written consent of artist. PURCHASER agrees not to commit artist to any personal appearances, interviews or other promotion or appearance without prior written consent from ARTIST OR HIS REPRESENTATIVE. A5. PURCHASER agrees that there shall be no signs, placards or other advertising materials on or near the stage during the entire performance; nor shall any such advertising appear on tickets, flyers, handbills, or posters without the prior consent of ARTIST; nor shall the ARTIST’s appearance be sponsored by, or in any other way tie-in with, any political candidate, commercial product or business. A6. ARTIST retains rights and control over corporate concert sponsorship and / or tour sponsorship. In the event a tour sponsorship is added at any time before or after contracting is completed, it is understood that the . PURCHASER will make the best efforts to incorporate the tour sponsor's name, logo, and other requirements to any and all advertising henceforth. A7. ARTIST shall have sole and exclusive merchandising rights. 1 A8. PURCHASER will make available twenty (20) ( or a reasonable number based on size of venue) complimentary tickets per show to artist for their sole use. Seats must be in preferred locations. Artist will contact the box office no later than one hour prior to the concert in the case of unused tickets. A9. PURCHASER shall have the right to distribute 20 tickets or 1% of the sellable house (whichever is greater) for use for media, sponsor, and other promotional needs. These tickets do not include those set aside for artist requirements. No other complimentary tickets are to be distributed without express written permission of artist. A TU RI 00 G R D 07 EN AL ER C U Y SE A representative of the Artist shall have the right to be present in the box office prior to and during the performance and intermission periods and such representative shall be given full access to all box office sales and gate receipts (and the expenditures if required) at each performance hereunder. A10. The ARTIST shall have exclusive control over all creative elements of the engagement including, but not limited to, the following: audio, lighting, curtains, staging, set pieces, quantity and type of musicians, repertoire, length of performance, supporting/opening acts, presenters and speakers (including master of ceremonies and welcoming speakers) and their length of performance, and any ancillary music, film or videotape played to patrons at any time. All pre- and post-show activities/music must be approved, in advance by the ARTIST. 3) PAYMENT All payments shall be made as agreed by contract. In the event the Purchaser fails to make any payment at the time stipulated herein or breaches any other provision of this agreement, Artist shall have the right to withhold performance without prejudice to his right hereunder. In the event of cancellation, the ARTIST shall be discharged of any further liability hereunder and shall be entitled to retain any deposits or other monies theretofore paid to ARTIST by PURCHASER, in addition to ARTIST’s other legal and equitable remedies. W 4) PHOTOGRAPHY No photography during soundcheck, unless permission is given by Manager. Before start of concert PURCHASER shall make the announcement to the audience: “There shall be NO photography, NO audio and NO video recording. It is requested that ALL phones, beepers or other electronic devices be turned OFF. Thank you.” Journalists shall be permitted to take photos from off stage locations during the first 15 minutes of the concert, unless otherwise determined by Manager. N O 5) ) HOTEL All hotel accommodations must be approved, in advance, by the ARTIST. PURCHASER shall provide a NON smoking, king bed bona fide suite with bathtub (one bedroom + living room with door ) on the highest “Executive, Club, or Concierge” floor of the hotel for Mr. Lloyd, a two bedroom suite for Mrs. Farantouri and her assistant, Maria Hadzara, and 5, (five) “executive, club” deluxe king bed, NON smoking rooms, dinner ( or 50 euros per person) and breakfast included, in a 5 star hotel. Hotel should have a restaurant and provide 24-hour room service or alternative food and beverage service comparable to 24-hour service, high-speed internet access in the rooms at no additional charge. If ARTIST is driving, parking to be included. If you have already designated a hotel for approval, please contact Tour manager: Dorothy Darr/ [email protected] 4) TRANSPORTATION PURCHASER shall provide PURCHASER to meet ARTIST with a clearly marked sign with the ARTIST’S name at the airport arrival gate or train arrival platform to assist with carrying the luggage for the ARTIST. PURCHASER shall provide shall provide, at its sole cost, all ground transportation for ARTIST and entourage (9- 10 persons) between airport, hotel 2 and venue - and to return to airport in same manner for departure. Three (3 ) sedans: Lincoln Town car, MBZ S class / BMW 7 series / Audi – one for Mr. Lloyd and Ms Darr, one for Mrs. Farantouri, her assistant, Maria Hatzara and one for Farazis, Rogers, Harland, , and Sinopoulos, OR, two sedans and one mini van. AND, a 12’ ( 3.5 meter) cargo van with back seats removed, to take all luggage, instruments ( including double bass ) and Mr. Camardella. In addition, PURCHASER shall provide all overweight, excess baggage, airport transfer, and equipment/ instrument cartage costs in connection with the performance. A TU RI 00 G R D 07 EN AL ER C U Y SE 5) STAGING DETAILS a. Stage performing area needs to be at least 20 X 34 feet (7 X 10 meters) b. Three carpets or rugs will be needed on stage: 2X2 meter under the piano bench and a 3X4 meter Persian / Oriental carpet (preferably old) under Charles Lloyd. And, a carpet of adequate size to go under the drums. c. PURCHASER shall provide one twenty six – twenty eight inch stool for Mrs. Farantouri, and same for Mr. Lloyd, a normal orchestra chair for Mr. Sinopoulos, and one (1) 30 inch (30 = 77 cm) stools without arms for Mr. Rogers. Five (5) professional black music stands.. A small table for Mr. Lloyd, and a small table for Mrs. Farantouri d. The attached stage plot shall indicate the set up. e. For outdoor concerts, the stage and performance area will be covered to protect the ARTIST from inclement weather, and the piano will be sheltered from the sun. The piano must be in tune. 6) LIGHTING Lighting should be set to create a warm atmosphere. The lights should not be too bright or hot on the performers. And, not quick lighting changes in the middle of songs, a la rock and roll. N O W 7) SOUND a. PURCHASER shall provide a state of the art house and stage reinforcement system with high quality three-way speaker stacks on each side of the stage to provide good acoustic quality in the house. b. Sound System will include 16 track or 24 track mixing stage monitor mix capable of giving five(5) separate discrete monitor mixes. c. The sound system will include: • Six (6) wedge monitor speakers with 2 or 3 way speaker array in each. • The following microphones of the highest quality: • Piano: Three (3 ) AKG 414/ 460 / KM84 or AKG 460/451 KM84 • Drums: Six (6) • Saxophone/flute : Two (2) mics for saxophone Neumann M 147, & one clip on mic either an ATM 35 or a DPA 4036 (or 4022 ) (Shure SM 98 might be acceptable), One (1) flute/ announce mic Neumann M 147 or a Sennheiser e865, • Bass: One (1) RE20 for bass • Lyra: One ( 1) RE20 • Vocal, Three (3) Shure SM58 vocal microphones or Neumann TLM 105 or equivalent • One (1) wireless announce mic • Stands: Fifteen (15) boom-style mic stands. • The sound system will be ready for ARTIST to sound check at least four (4) hours prior to performance. ARTIST will be allowed to sound check for at least one hour. • Once a sound balance is set at sound check, the sound engineer mixing the house sound will not greatly change the mix in the house, and will not increase the volume of soloists as in rock and roll. 3 8) PIANO a. PURCHASER shall provide a 9 foot concert grand in perfect condition. Steinway, Boesendorfer, or Yamaha 9 foot concert grand in excellent condition will be acceptable. NOTE: A baby grand will not be acceptable b. b. Piano should be tuned to A440 prior to sound check and tuned again, prior to concert by a quality professional piano technician. A TU RI 00 G R D 07 EN AL ER C U Y SE Bassist will need a high quality bass amp: Gallien Krueger MB 150S 1x12 combo OR substitute Hartke Kickback 1x12 combo OR SWR California Blonde 1x12 Two (2) 15ft patch cables One (1) short boom mic stand One (1) RE20 microphone One bar stool/bass stool ***When presenter is requested to supply a bass:: Prefer 3/4 German bass and German, bow equipped with David Gage realist pickup....NOTE: when possible prefer another bassist's instrument instead of backline company N O W 10) DRUMS For Eric Harland: (Eric Harland is a Yamaha artist) Yamaha Absolute Drum Series: Other drum manufacturers might be acceptable but would need advance approval. The drum kit shall include: 2x 18in Bass Drum 12in Rack Tom 14in Floor Tom 14in x 5in Snare Drum (bring 2 to choose from Wooden and Metal) 4 Cymbal Stands (prefer light weighted) 2 Snare Stands Hi Hat Stand Highly Adjustable Drum Seat + drum key 3 Foot Pedals (one for the cow bell, one for backup incase of breakdown) Foot Pedaled Cow Bell (It sits on the floor with a foot pedal attached to it) Mounted Tambourine (with mount) Coated Ambassador Drum Heads on the Snare Drum and Rack Tom ONLY!!! Clear Ambassador Drum Heads on the Floor Tom and Bass Drum ONLY!!! ARTIST will supply drum sticks and cymbals. DRUM SIZES CAN NOT BE SUBSTITUTED A LARGER BASS DRUM WILL NOT BE ACCEPTABLE 12) BACKSTAGE DETAILS AND CATERING a. ARTIST will need four or five (4 / 5) clean comfortable dressing rooms with table, chairs / sofa, and access to clean private toilets with hot and cold running water, and which LOCK and are not accessible to the audience. A master dressing room for Mr. Lloyd, a master dressing room for Mrs. Farantouri and two for the other musicians. b. AN IRON AND IRONING BOARD IN THE DRESSING ROOM AREA, a hair dryer, and hair dresser for Mrs Farantouri in her dressing room one hour before start of concert. c. ARTIST will need eight (8) clean black or dark colored towels to be placed in the dressing room prior to performance, and an ironing board with place to hang clothes. d. A TU RI 00 G R D 07 EN AL ER C U Y SE e. items in the ARTIST'S dressing room: 1. 8 litres of mineral water ( 3 sparkling and 5 flat ) 18 small bottles, flat mineral for stage 2. Four (4) litres of organic (bio) fruit juice (apple, grape, or pineapple) cold beer and three (3) bottles of premium red wine, two (2) chilled white wine at start of sound check 3. Two bottles (2) bottle of fine chilled premium champagne at the end of the concert. 4. Fresh coffee, whole milk, hot water for tea, (black&herbal) sugar, honey and fresh lemon. 5. An assortment of cheese, crusty bread, crackers, mustard, mayonnaise, and fresh organic (bio) fruit and vegetables. 6. An assortment of pastries, dark chocolate, organic(bio) raisins and dried fruits, almonds, and walnuts ABSOLUTELY: NO PISTACHIOS, PINE NUTS, OR CASHEWS 7. Glasses, cups, utensils, plates and napkins PURCHASER shall provide ARTIST with a hot meal at first class restaurant before the concert (if time permits) or following the concert. The “a la carte” selection shall include a choice of 1. fresh fish, or seafood, 2. chicken and, 3. a vegetarian main dish, along with a variety of fresh vegetables, fresh salad and desert for nine (9/10) people, wine, water, coffee and tea. PLEASE NOTE, ERIC HARLAND IS ALLERGIC TO NUTS W 13) RECORDING: RADIO & TELEVISION a. No audio or video recording, filming, radio or television rights are part of this agreement without written approval of the ARTIST. ARTIST has the right to make archival audio or video recording. b. If ARTIST gives written approval for any audio or video or radio or television broadcast, he will be given a DAT or BETA SP copy of the Master immediately following the performance. N O 14) VISAS, WORK PERMITS, AND TAXES a. Any necessary work permits, visas, licenses, tax or other legal authorizations or documents from any government agency, bureau, and or department federal, national, state, provincial or local necessary for ARTIST’S group, staff or entourage to complete this contract will be the sole responsibility of the PURCHASER to arrange, provide and pay. Such permits or documents will be provided to the ARTIST in advance or at the time of his arrival at Customs and entrance into the country where the PURCHASER shall meet the ARTIST with proper documents and a copy of the signed contract at customs if necessary in order to facilitate the process. b. PURCHASER agrees that the ARTIST contracted fee is a net fee, and that any taxes due on this fee are to be arranged and settled and paid for solely by the PURCHASER to the proper national, federal, or provincial taxing authorities. In the event that the ARTIST cannot and does not perform because of threat physical violence, or in the event of war, public calamity, riot, epidemic, fire, serious injury or illness, cancellation not under the control of the ARTIST or other acts of nature, no claim will be made of the ARTIST for non-fulfillment of this agreement with regard to the performance so affected. In the event of injury or illness, a Doctor’s Certificate will be supplied upon request. b. Rain and inclement weather will not be considered as one of the above such clauses, and in the event of cancellation due to inclement weather, the PURCHASER shall still be responsible to pay the ARTIST his full fee even if the concert is canceled. c. In the event of a breach by Purchaser of any of the terms, covenants or conditions of this contract, Artist shall not be required to perform hereunder and Purchaser shall pay to Artist the full amount of fixed payments required hereunder. A breach of any clause contained in this rider by Purchaser shall be deemed a material breach. If Artist elects to perform notwithstanding a breach of this agreement by Purchaser, the performance by Artist shall not constitute a waiver of any claim Artist may have for damages or otherwise. d.
