Advocates called on the U.S. Supreme Court to take up immigration relief.

T
he nine needed to move.
Such was the message from immigrants
and advocates who assembled on Thurs., Jan.
14th, imploring the country’s highest court
to take up the case on immigration relief,
as the justices of the U.S. Supreme Court
prepared to decide which cases would be
heard in 2016.
They gathered at Manhattan’s Judson
Memorial Church to call for an extension of
Deferred Action for Childhood Arrivals (DACA)
and Deferred Action for Parents of Americans
and Lawful Permanent Residents (DAPA), two
key components of President Barack Obama’s
executive action issued in November 2014.
The measures would shield 5 million
undocumented immigrants from deportation,
including approximately half a million in New
York City.
While immigrants were hopeful when Obama
first announced the executive action, DACA
and DAPA have since been stalled after being
blocked by the Fifth Circuit Court of Appeals
last November.
The Judson Church demonstration, organized
by the New York Immigration Coalition (NYIC),
convened immigrants, advocacy groups and
clergy members, who urged the Supreme Court
to proceed with the DACA/DAPA case and help
eliminate the fear of deportation for millions
of people.
Aber Kawas, a youth leader with the Arab
American Association of New York, spoke
about her father, who was undocumented
and was deported after being incarcerated
for more than three years.
“Programs like DACA and DAPA not
only give opportunities for people to work
and go to school, but they also keep families
together rather than tear them apart,” insisted
Kawas.
Mónica Robles, a Mexican immigrant,
said the stalling of immigration reform has
affected her family and delayed their dreams
of finding steadier work and giving their
kids a better education.
“The plans I had with my husband and
children were torn apart,” said Robles.
“My children live in constant fear,” she
stated. “My son does not want to go to school
because he worries that when he returns home,
we will no longer be there.”
Herlinda Hernández, a member of Jacob
Riis Settlement House who cleans houses for
a living, told gatherers that she obtained an
Associate’s Degree to help care for mentally
impaired children, but has been unable to find
better work due to her undocumented status.
“The system allowed me to study and I
made sacrifices to pay up, but right now the
same system does not allow me to work,” said
Hernández.
Dale St. Marthe, born in St. Lucia with a
severe immune deficiency disorder, came to
the United States with his family because his
home country could not provide adequate
medical care.
A DACA recipient, he credited the program
with allowing him to stay in this country,
attend college and get a job.
“Many other young immigrants want to go
to college and contribute to society too,” St.
Marthe said. “Taking away their ability to do
so will only waste all the potential they have.”
Immigrant rights are a moral imperative,
said Rev. Donna Schaper of Judson Memorial
Church, which she called “a sanctuary” for all
lifestyles and beliefs.
Schaper chastised the anti-immigrant rhetoric
of some Republican presidential candidates,
saying that it demeaned a hardworking class of
people.
“They are called names, are asked to
leave, and are treated less than human,” she
said. “Something has been poisoned in this
country’s soul when there are people who
support Donald Trump’s stupid ideas and who
do not stop to consider the suffering and effort

what others miss.
While others may be locked into tiny
glowing screens, she watches the world with a
camera with a zoom lens.
The results are currently on display at
Dichter Pharmacy until the end of the month.
Mostly shot in Inwood Hill Park,
O’Shaughnessy composes tight images,
often focusing on patterns, both natural and
manmade.

as if holding on for one last gasp of life.

“It’s actually post-season blues,” she said.
“It reminded me of being 11 years old and
having it be the end of something.”
O’Shaughnessy, an Inwood resident, started
photographing women’s music groups in the
early 1980’s. But not long after a career in tech
took priority and she stopped photographing.
But after flipping through some old contact
sheets, she decided to give it another try.
When Bob Bahr, who curates the space at
Dichter, asked her if she wanted a show, it
was “a seismic shift in seeing myself as an
artist.”
One of her most powerful images is of a
black lamppost. It bears a sign, mostly torn
away, with a headline that says “Missing.”
People who didn’t know the story behind
the sign thought it was meant to be ironic.
But after she explained that it was a poster
for Anthony Ureña, a young man who was
missing and found months later, drowned in
the Hudson River, the attitudes changed.
“I thought about whether or not I wanted
to put it up because it is a very sad thing
that happened here,” she said. “But people’s
reaction to it was so powerful that I thought
I should.”
Even the Church of the Good Shepherd has
a close-up, with the light playing on the stone
surfaces.
When O’Shaughnessy was growing up in
Manhattan, the world and its citizens were
defined by which parish people attended.
“It’s a marker of class, it’s a marker
of culture, it’s a marker of all kinds of
social relationships if you grew up in that
environment.”
Other meticulously composed shots are
close-ups of Inwood Hill Park’s Nature Center
and silver benches lining a park path. Few
people recognize the locations. “But they’re
out there,” she said.

enrolling in health club memberships.
Prompted by New Year resolutions and
health club promotions, consumers flock to
health clubs and sign contracts prepared by
health club operators.
New York State’s Health Club
Law provides consumers with certain
protections. For example, no health club
contract can exceed $3,600 a year or be for
a term longer than 36 months. In addition,
all health club contracts are cancelable
within three days of the signing of the
contract, and at any time for any of the
following reasons: if the health club ceases
to offer the services stated in the contract;
if the consumer moves 25 miles from any
health club operated by the seller; and if
upon a doctor’s order, the consumer cannot
receive the services as stated in the contract
because of significant physical disability
for a period in excess of six months. Such
notices must appear on all health club
contracts.
The health club must provide refunds
within 15 days of such cancellation.

Schneiderman offers the following
consumer tips when considering a health
or fitness club:
•Become an educated consumer
and visit or call more than
one health club to earn
about dues and when
they must be paid,
hours of operation,
variety and frequency of
classes and ability to use
multiple locations
•Do not give in to high
pressure sales tactics or
feel obligated to sign a
contract immediately. A reputable gym
will give you enough time to read the
contract thoroughly, tour the facilities,
and check out other options before
making an informed decision. Tell the
health club representative you need time
to think about joining the club and ask for
free passes to determine if the club is right
for you. Talk to other members.
•If a health club requires you to pay a downpayment or pre-pay your dues, ask if it is
bonded or has filed the proper financial
security to protect you against losses of
pre-paid membership dues. A health club
is exempted from this requirement if they
do not offer pre-paid memberships or if
they offer a monthly payment option and
the monthly dues do not exceed $150,
memberships do not exceed one year
and the contract does not contain an

For the first time, city legislators are
considering the implementation of a
system that would allow residents to report
emergencies by punching it into their phone’s
keypads as a text message.

Vanessa Gibson, Mark Levine and
Laurie Cumbo, the bill calls on the city’s
Department of Information Technology and
Telecommunications (DoITT) to devise a
plan for allowing the public
to send texts, photos and
video to the city’s 911 call
system.
Known as Intro 868, it
marks the first time a textto-911 system has been
considered in New York
City. Other
municipalities
across the country, as well
as Rockland and Monroe
counties in New York State,
already have texting capabilities for 911.
Technology Committee Chair James Vacca
and Gibson, the Public Safety Chair, led a
City Council hearing on January 14 to gauge
the feasibility of implementing the system in
the city.
“There’s no doubt that those who are deaf,
hard of hearing or have a speech impediment
would especially benefit,” said Vacca.
Cumbo explained that the ability to text
911 instead of calling would be useful for
dangerous situations where a phone call could
prove unsafe, such as domestic violence or
home invasion incidents.
“This bill will enable any New Yorker who
is in immediate danger and unable to make
a voice call to communicate directly with
911 operators and police dispatchers without
delay,” said Cumbo.
Levine read a text exchange between a deaf
woman in Alpharetta, Georgia, and that city’s
911 system — the woman texted to report that
two young children

working on a long-term strategy for a textto-911 system, and is prepared to solicit
information from vendors to assess options for
implementation.
However, Kirks could not provide a timeline
for completion, or cost estimate, for the 911
texting platform.
Kirks cautioned that while smaller U.S.
municipalities have successfully implemented
such a system, New York City “is really on a
different scale.”

oncology patients at Columbia University’s
Cancer Center.
A poignant video captured the moment
when a good Samaritan literally gave a sickly
homeless man the shirt off his back. The viral
clip that was shared to FB recently by Lazaro
“El Feo” Nolasco has been viewed nearly
15 million times already. Lazaro was heading
home on the A Train from visiting his girlfriend
in Washington Heights when he happened to
record the heart and soul warming gesture.
Not only did the young man give the elderly
and clearly distressed man his shirt, but he
lovingly put it on him and gave him a hat as
well.

M
ichael Mendel gets up early,
grabs an old Nikon and
heads outside. He walks the streets,
haunts the waterfront and idles in
the park. He hunts for intriguing
compositions and captures it on
camera.
In the Shadow of the Towers.

paintings on display at the Armin and Estelle
Gold Wing of the Hebrew Tabernacle.
The show is like coming home for the artist.
Mendel, was born in Berlin, Germany
in 1933, and as anti-Semitism grew, he and
his family escaped – first to Cuba and then
arriving in 1940 to the United States.
His bar mitzvah was held at the old location
of the Hebrew Tabernacle on West 164st
Street.
The
82-year-old
is now exhibiting a
small collection of his
watercolors at the gallery.
He has a B.A. in art
from City College and had
a 40-year career designing
album covers for the
likes of Tony Bennett and
Gladys Knight. But when
it comes to painting, he
says he’s self-taught.
He started painting in
2009, after going through
a divorce.
Three hundred paintings
later, he’s mastered a
photo-realistic
style.
Images, meticulously and
lovingly rendered, reveal complex patterns
and intimate detail.
Many paintings are places New Yorkers
know well—Fort Tryon Park, Inwood Hill
Park and Van Cortland Park. After his family
moved to New York, Mendel grew up on
Cabrini Boulevard and now lives in the Bronx.

“I sat there all afternoon taking
photographs. I was shooting as
different people were playing,” he
said. The result is children of all
races playing together.
Mendel views the process of
painting as a series of solving
problems. He works with thin
brushes and magnifying glasses.
When he can’t get the perspective
or the color right, he walks away
from the painting. Then he comes
back—often in the middle of the
night—and finds something he
hadn’t noticed before.
“Out of 308 paintings, every
problem has been solved,” he said.
“I feel very driven to doing a perfect
job. Or as perfect as I could.”

t was the face-off at Fort
Washington.
The Democratic candidates vying
for New York’s 13th Congressional
District seat (NY-13) gathered at the Fort
Washington Collegiate Church on Thurs.,
Jan 14th for the first debate of the season,
held by the Uptown Democratic Club
(UDC).
The forum was moderated by Juan
Manuel Benítez, Host and Executive
Producer of Pura Política on NY1 Noticias.
“I’m very
glad to be
here,” said
Charles
Rangel.
“[Our club] is a diverse group of people,”
said Club Co-President Johanna García,
“and our candidates for Congress are equally
diverse.”
The seat, long considered a stronghold
of Harlem political power, was redrawn
following the 2010 Census, and now extends
past its original boundaries in Northern
Manhattan and includes a swath of the Bronx.
Of the eight formally declared candidates
on the Democratic line, five were present.
They included Suzan Johnson Cook, Mike
Gallagher, Guillermo Linares, Adam Clayton
Powell IV and Clyde Williams. State
Senators Adriano Espaillat and Bill Perkins
and Assemblymember Keith Wright did not
participate.
In addition to concerned
residents, in the audience
also was incumbent Charles
Rangel, who said this would
be his last term in office.
“I’m very glad to be
here,” beamed Rangel, who
has held the position for 23
consecutive terms.
“My wife is afraid I
might jump in there,”
he joked, noting that it

“The true American spirit is a melting
pot of different religions and backgrounds,”
commented St. Marthe. “It’s in our
Constitution. Refusing immigrants the right to
be blended into America is basically refusing
the American spirit.”
Kawas said that presently, the Arab and
Muslims communities are being specifically
targeted for deportation due to recent world
events and a prevailing anti-Islam sentiment
in the United States.
“But it’s not just one ethnic community
that’s affected by the DACA and DAPA
delays, we’re all feeling the same thing,” she
said. “Hopefully when they see a gathering
like this, the Supreme Court will see the level
of importance this has.”
Francis Madi, a Regional Associate for the
NYIC, said that she senses the disappointment
within immigrant communities that Obama’s
relief efforts have been stuck in neutral.
“Many immigrants don’t trust the
government, but they want a reason to
believe,” said Madi. “There’s a reason why
they came to this country.”
“The fact that it hasn’t passed yet is a big
deal,” Madi stated.
Days later, advocates and elected officials
cheered the news that the court would hear
the case, titled United States v. Texas, after
conferring in private on January 15.
The case is likely to be heard in April, with a
decision expected by the end of June.
“We are thrilled that our families will now
get our day in court,” said Javier H. Valdés, CoExecutive Director of Make the Road New York,
said on Tues., Jan. 19th. “We are confident that
the Supreme Court will rule in our communities’
favor and allow President Obama’s immigration
relief initiatives, which are backed by extensive
legal precedent, to proceed.”

of limbo by shielding them from deportation
and giving them status. The fates of millions
rest on the Supreme Court and they must do
the right thing and come down on the side of
hardworking immigrants.”

retailers throughout the five boroughs.
Parents are typically unaware of what
chemicals might exist in the products they
purchase for their children, said Bobbi Chase
Wilding, Deputy Director for Clean and
Healthy New York.
“A parent is completely flying blind,” she
remarked. “It’s like playing Russian roulette.”
“[We] have no idea that these dangerous
products are out there,” added Miller.
On January 14, advocates gathered on the
steps of City Hall to show support for Intro
803-A, legislation that could potentially ban
the use of certain chemicals in children’s
products. Currently, no law exists in New
York that requires manufacturers to disclose
the use of or eliminate many toxic chemicals
used in the manufacture of kid’s merchandise.
Councilmember Mark Levine, who is
supporting the bill, said that consumers
are vulnerable due to the current lack of
regulations.
“What’s terrifying to me about these toys is
that they look normal,” he remarked. “I could
see myself buying one of these.”
Chase Wilding explained that Clean and
Healthy New York tested kid’s products
purchased at a range of discount stores, bigbox retailers and 99-cent shops, including
Target, Toys “R” Us, Macy’s, Jack’s and
Shopper’s World.
Tests results showed traces of arsenic, lead,
cadmium and other chemicals in many of the
toys.
“With no law on the books, thousands of
families across the city have unknowingly
purchased an item on this list,” said Cecil
Corbin-Mark, Deputy Director of WE ACT.
“Many of our members are parents who
reside in Northern Manhattan and the Bronx,
where the job of taking care of a child is
already hard enough — they shouldn’t have
to be mom, dad and toxicologist,” he stated.

oversight in the manufacturing industry for
ensuring that companies exclude chemicals
from kid’s products.
“If we’re leaving it up to the manufacturers
to do the right thing, then we’ve failed,” he
remarked.

Scholarship Program. This scholarship was
announced last year in honor of Carey Gabay,
an attorney and public servant from the Bronx,
who was tragically killed as an innocent
victim of gun violence in
October at the age of 43.

students who exemplify
Carey’s commitment to
social justice, leadership,

mentoring,

succeeding
academically
despite

The federal government’s notoriously
complicated financial aid process
may become simpler for students
beginning this fall with a new
rule allowing families to use tax
information they have in hand from
the “prior, prior” year’s returns. The
hope is that the government’s FAFSA
form will be easier to fill out on-line
using existing tax data from the IRS.
And students can apply for aid as
early as October, allowing colleges
to speed up financial aid offers.

“Text-to-911 would not allow for that

Advocates for the deaf testified that the
inability to use texting to report emergencies
in progress was discriminatory and put deaf
New Yorkers at risk.
“The deaf and hard of hearing community
are among the most vulnerable to
victimization, yet have access to the least
amount of services,” said Christopher
Bromson, Assistant Director of the Crime
Treatment Center at Mount Sinai Hospital.
“911 should be a right.”
“Access to police, fire or emergency
medical services should not be denied to
someone because the language they use is not
a spoken one,” Bromson stated.
Ronald DiBiase, a program integration
manager for DoITT, said it was essential
for the city to get it right from a technical
and operational perspective if a 911 texting
system was launched.
He noted, “Once a texting implementation
is rolled out to the public, there’s no way to
pull it back.”
DoITT representatives noted that the
department expects to issue a Request for
Information (RFI) soon in order to collect
information from prospective tech sector
vendors to gauge options for implementation.

throughout the country.”

thinking in the 21st Century that diversity,
social justice and civil rights can be
accomplished through cooperation where
like-minded institutions come together.
Among other multicultural organizations
that have agreed to sign the MOU include:
Hispanic Federation, National Council of La
Raza (NCLR), National Hispanic Federation
for the Arts, SER-National, Asian Pacific
American Advocates, East West Players,
Media Action Network for Asian Americans
and the Asian Pacific American Institute for
Congressional Studies.
“We are committed to working with
Charter,” said President of the Hispanic
Federation, José Calderón. “[We will] ensure
that the MOU serves and benefits our students
and families through a significant expansion
of their low-cost broadband programs, the
job training and recruitment of Latinos across
their urban markets, and meaningful, systemic
and long-term philanthropic investments in
our communities.”

Zoo is accepting applications for its teen
Discovery Guide program. Program
participants are volunteers who help teach
zoo visitors about wildlife. They assist
with special programs and events, provide
narration at animal exhibits, and lead artsand-crafts activities for families.

Adolescentes
en Queens
La Sociedad de Conservación de la Fauna
(WCS, por sus siglas en inglés) del Zoológico
en Queens está aceptando solicitudes para su
programa de adolescentes ‘Discovery Guide’.
Los participantes del programa son
voluntarios que ayudan a enseñar a los
visitantes del zoológico acerca de la fauna.
Estos asisten con programas especiales y
eventos, proveen narración en exhibiciones de
animales, y dirigen actividades de manualidades
para las familias.
‘Discovery Guides’ deben de tener por lo
menos 14 años de edad y estar en escuela
superior. Cada uno debe de comprometerse a
