Why is it that on the way to becoming adults we
lost our ability to be enthusiastic? As children, every day
we were full of the joys of life, curiosity and a desire to
discover everything that the wonderful things of life offer
us. According to brain researcher Prof Dr Gerald Hüther,
it would also do us adults no harm
to open up to feelings of happiness again, which flow through
the body when we are excited by
something. On the contrary, this
is even urgently necessary as so
much wasted creative potential is
waiting to be fulfilled in our society. Because when we experience
enthusiasm, the brain releases a
"cocktail of neuroplastic messengers" and prompts the increased "production of proteins
to create a new sequence of connections" − in other
words, our brains can develop further. "Every little storm
of enthusiasm to some extent leads to the brain doping
itself. All those substances are produced that are needed
by neural networks for growth and modification processes." If you can no longer really remember when you
were last brimming with enthusiasm, then you should try
to perceive the world in a different way. Whatever it is
that makes you euphoric, do it, right away and without
hesitating! So get out of that routine, let's give things
their significance back and fall in love with life again. For,
as Prof Hüther says: "Everything that helps people, that
they find inviting, encouraging and inspiring and leads
them to experience something new and different from
before, is good for the brain and therefore good for society." And somewhere deep within all of us is slumbering
our ability for enthusiasm, just waiting to be awakened...
Wann ist uns eigentlich auf dem Weg zum Erwachsenendasein unsere Begeisterungsfähigkeit abhanden
gekommen? Als Kinder standen bei uns die pure Lebensfreude, die Neugierde und die Entdeckerlust an all den
wundersamen Dingen des Lebens Tag für Tag auf dem
Programm. Laut Hirnforscher Prof. Dr. Gerald
Hüther würde es auch uns Erwachsenen nicht
schaden, uns wieder für die Glücksgefühle zu
öffnen, die den Körper durchströmen, wenn wir
für eine Sache brennen. Im Gegenteil, es wäre
sogar dringend notwendig, um die so vielen
brach liegenden kreativen Potenziale unserer
Gesellschaft zur Entfaltung zu bringen. Denn
erlebt man den Zustand der Begeisterung,
kommt es im Gehirn zur Ausschüttung eines
»Cocktails von neuroplastischen Botenstoffen«
und einer verstärkten »Eiweißproduktion zur Bildung neuer
Verknüpfungsfortsätze«, sprich unser Gehirn kann sich weiterentwickeln. »Jeder kleine Sturm der Begeisterung führt
gewissermaßen dazu, dass im Hirn ein selbst erzeugtes
Doping abläuft. So werden all jene Stoffe produziert, die
für alle Wachstums- und Umbauprozesse von neuronalen
Netzwerken gebraucht werden.« Wenn Sie sich nicht mehr
erinnern können, wann Sie das letzte Mal so richtig aus dem
Häuschen waren, dann versuchen Sie doch, die Welt aus
einer anderen Perspektive wahrzunehmen. Was auch immer
es ist, das Sie in Euphorie versetzt, tun Sie es augenblicklich und ohne zu zögern! Also raus aus der Routine, geben
wir den Dingen ihre Bedeutsamkeit zurück und verlieben
wir uns wieder in das Leben! Denn, so Hüther: »Alles, was
Menschen hilft, was sie einlädt, ermutigt und inspiriert, eine
neue, andere Erfahrung zu machen als bisher, ist gut für das
Hirn und damit gut für die Gemeinschaft.« Und irgendwo tief
in uns allen schlummert unsere Begeisterungsfähigkeit und
wartet nur darauf geweckt zu werden…

¿Por qué vamos perdiendo nuestra capacidad de entusiasmo según nos vamos haciendo
mayores? Cuando éramos niños todo era pura alegría de vivir, curiosidad y ganas de descubrir cada
día todas las cosas maravillosas de la vida.
Según el profesor y doctor en investigación del cerebro Gerald Hüther, a los adultos no nos vendría mal
volver a despertar nuestro sentido de la felicidad,
ese que nos recorre todo el cuerpo cuando nos
apasionamos por una cosa, porque cuando vivimos
un estado de entusiasmo el cerebro recibe un cóctel
de neurotransmisores plásticos y aumenta la
producción de proteínas para la formación de nuevas
prolongaciones de conexión, es decir, nuestro
cerebro puede seguir desarrollándose. Por decirlo
así: cualquier carga de entusiasmo hace que el cerebro produzca droga por sí mismo y así se crean todos
los ingredientes que las conexiones neuronales
necesitan para los procesos de crecimiento y
transformación.
Si ya no se acuerda cuándo fue la última vez que
se entusiasmó de verdad, intente contemplar el

completely withdraw from the running
of Concordia, but only reduce the
amount she does in future. FINEST

I cannot simply withdraw completely as too much depends on
me. But I am trying gradually to
delegate more responsibilities.
Nonetheless, I am right in the
middle of organising the International AIDS Day on 1 December.
We would like to illuminate some
important buildings, such as the
tower and the entry to Marbella and the Mayor's office, in red.
And also place information tables on the Costa del Sol. After
all, education about AIDS is one
of our most important activities.
As every year, our Saint Nicholas Gala will be held in the Hotel
Puente Romana on 5 December.
And there's a lot of preparation
needed for that. As you can see, I
have my hands very full again.

noch nicht gänzlich aus der ConcordiaLeitung zurückziehen möchte, jedoch in

AIDS-Tag am 1. Dezember zu organisieren. Wir möchten einige wichtige Gebäude, wie z.B. den Turm
am Eingang von Marbella und das
Bürgermeisteramt, rot beleuchten und Informationstische an der
Costa del Sol platzieren. Schließlich
ist die Aufklärung über AIDS eine
unserer wichtigsten Aufgaben. Am
5. Dezember findet wie in jedem
Jahr unsere Sankt-Nikolaus-Gala
im Hotel Puente Romana statt. Und
da gibt es auch noch einiges zu tun.
Wie Sie sehen, bin ich schon wieder
sehr im Stress.

There are many good
reasons for holding a big party.
And on 26 September Ewald Fichthaler had no fewer
than four good reasons to celebrate! For 30 years, he
has been a successful chef, for three years he has
been conjuring up delicious dishes for his guests at the
Nueva Kaskada, and for 16 years he has lived happily on the Costa del Sol. The likeable chef decided this
would be a great opportunity to get together with his
friends, family and, of course, his guests. A further
highlight for Ewald Fichthaler and his team this year
was being awarded the Certificate of Excellence 2014.

Gute Gründe für eine große Party gibt es
viele. Und Ewald Fichthaler hatte am 26. September
gleich vier davon, um ausgelassen zu feiern. Seit
30 Jahren steht er als erfolgreicher Koch hinter den
Töpfen, seit drei Jahren verköstigt er seine Gäste im
Nueva Kaskada und seit 16 Jahren ist er an der Costa
del Sol zu Hause. All dies nahm der sympathische
Koch zum Anlass, gemeinsam mit seinen Freunden,
seiner Familie und natürlich seinen Gästen anzustoßen. Als weiteres Highlight konnten Ewald Fichthaler
und sein Team in diesem Jahr das »Certificate for
Excellence 2014« entgegennehmen. Besonderer Dank
gilt hierbei Ángeles Muñoz und Jose Luis Hernandez
für ihre Betreuung und Freundlichkeit.

gran fiesta y Ewald Fichthaler tuvo muchos para
celebrarla alegremente el 26 de septiembre, pues
desde hace 30 años trabaja como cocinero de éxito
detrás de los fogones, desde hace tres alimenta a
sus clientes en el Nueva Kaskada y hace 16 años
que tiene su hogar en la Costa del Sol. Todo esto

Recently he celebrated the restaurant's 25th anniversary and held an exciting and utterly enjoyable
party to mark the occasion. Over 100 friends and
regular guests came to congratulate the master in
person, enjoy a wonderful evening and a marvellous
dinner. The musical offerings were also very well
received, so it was a totally fun and unforgettable
celebration for all participants. But it was Francisco Gómez himself who had the most reason to celebrate. The fact that the Paraguayan consul presented
him with a commemorative plaque also filled him
with pride and joy.

genussvolle Jubiläumsparty veranstalten. Über 100
Freunde und Stammgäste kamen, um dem Meister
persönlich zu gratulieren, sich köstlich zu amüsieren und ein wunderbares Abendessen zu genießen.
Auch die musikalischen Darbietungen kamen sehr
gut an und so war es eine überaus stimmungsvolle und unvergessliche Feier für alle Beteiligten. Vor
allem Francisco Gómez war sehr glücklich. Dass ihm
der Konsul von Paraguay eine Ehrentafel überreichte, erfüllte Francisco ebenfalls mit Freude und Stolz.

Hace poco celebró los 25 años de su restaurante con una
fiesta de aniversario por todo lo alto llena de diversión.
Más de 100 amigos y clientes habituales se acercaron
a felicitar personalmente al maestro, divertirse a lo
grande y disfrutar de una maravillosa tarde. También la
oferta musical fue muy bien recibida y la fiesta resultó
inolvidable y muy animada para todos los presentes.
Pero sobre todo, Francisco Gómez fue tremendamente
feliz. El hecho de que el cónsul de Paraguay acudiera
y pudiera prepararle una mesa de honor, le llenó de
alegría y orgullo.

Andrea Nische, it organises trips and
wine tastings, walks and museum
visits
Only recently there was a short trip to
the idyllic mountain village of Jimena de
la Frontera, which is only half an hour's
journey from Marbella. There the 19
participants enjoyed a lovely time with
interesting talks. The monastery with its
beautiful dome and magnificent inner
courtyard and cloisters was admired, and of course there
was a walk up to the highest point of the castle, where a
breathtaking panoramic view of the surrounding nature
reserve with its cork trees, the sea and mountains could
be appreciated. Moreover, the visitors enjoyed strolling
through magical alleys and sampled various specialities
in a local tapas bar. All in all the ladies agreed that it
was a very special day. The official meetings take place
every first Tuesday of the month from 8 pm at a different restaurant each time. New members are more than
welcome.

Erst kürzlich stand ein kleiner Ausflug ins idyllische
Bergdorf Jimena de la Frontera an, das nur eine halbe
Stunde Fahrt von Marbella aus entfernt ist. Hier erwartete die insgesamt 19 Teilnehmerinnen eine schöne
Zeit mit interessanten Vorträgen. Unter anderem
wurde das hiesige Kloster mit seiner wunderschönen
Kuppel und seinem herrlichen Innenhof mit Säulengang bestaunt und natürlich wurde
auch der höchste Punkt des Castillos
erklommen, um einen atemberaubenden
Rundblick auf das umliegende Naturschutzgebiet mit Korkeichen, auf das
Meer und die Berge zu genießen. Darüber hinaus schlenderte man durch zauberhafte Gässchen und naschte in einer
kleinen Tapasbar diverse Spezialitäten.
Besonders typisch, lecker und kalorienreich war der hausgemachte Kuchen, bestehend aus
allerlei Nüssen, Gewürzen, Honig und vielem mehr
(100 Gramm = 570 Kalorien!) Alles in allem waren sich
alle Damen einig, dass dies ein ganz besonderer Tag
war. Wer mag, kann ebenfalls Clubmitglied werden.
Die offiziellen Meetings finden jeden ersten Dienstag
im Monat ab 20 Uhr in wechselnden Restaurants statt.

…and so the oceanic sea breeze also influences the
marvellously moderate climate in what may be Europe's
oldest city. The students meet for a cortado coffee in one
of the cafeterias, beach promenaders can walk themselves sore along the many kilometres of sandy beaches
and everywhere the city is adorned by palms, jasmine,
oleander and fig trees. The Phoenicians, Carthaginians,
Romans, Western Goths and Moors already knew why
they settled in the important trading centre. The Castilian
King Alfonso X finally conquered Cádiz on 14 September
1262 once and for all and even managed to resist the
efforts of the British to conquer the city, who were interested in Cádiz because of the connection to America. Today
a half-excavated and restored Roman theatre still recalls

einen Cortado in einer der Cafeterías, Strandflanierer
können sich die Füße auf den kilometerlangen feinen Sandstränden wund laufen und überall wird das
Stadtbild von Palmen, Jasmin, Oleander und Feigenbäumen geprägt. Die Phönizier, Karthager, Römer,
Westgoten und Mauren wussten schon, warum sie
sich in der bedeutenden Handelsstadt niederließen.
Der kastilische König Alfons X. eroberte Cádiz schließlich am 14.09.1262 ein für alle Mal und hielt selbst
den Eroberungsbemühungen seitens der Engländer
stand, die sich aufgrund der Amerika-Verbindung stark
für Cádiz interressierten. Heute erinnert ein zur Hälfte
ausgegrabenes und restauriertes römisches Theater
noch an die Kaiserzeit, in der Cádiz zu den reichsten

Sie Seehecht in Salzkruste oder eine gegrillte Iberische Presa mit Mango und Apfel-Chutney. Besondere
Nascherei des Hauses: Flan de Naranja con Piña al
Coco y Ron.
Zur Ruhe kommt man mit einem Blick auf einen

Mr. Sepúlveda, how did it all begin?
My family has always worked in the hotel sector.
My father was a well-known baker, my grandfather
worked in the hotel business and so it was inevitable that I would be interested in that from an early
age. I attended a variety of schools in order to know
the hotel trade inside out.
Why do you so much enjoy being a chef?
As far as food is concerned, I love to learn and try out
new things. I simply feel at my best in the kitchen.
The restaurant is decorated with hundreds of photos of celebrities. Have all of them visited Los Bandidos and dined here? And who did you most enjoy
cooking for?
Most of these famous personalities have been visiting us regularly for a long time to eat and drink with
us. One of the most famous men I have cooked for
so far is Hugh Grant. Every time he comes here, he
is very pleasant and finds kind words for us.
One final question: What is the recipe for the
success of your dishes and of the Los Bandidos
restaurant?
We have been successful for over 29 years. I believe that this success is mainly attributable to our
enormous passion for our cuisine. We have always

Meine Familie war schon immer in der Hotellerie tätig.
Mein Vater war ein bekannter Bäcker, mein Großvater
hat im Hotelbusiness gearbeitet und so war auch ich
schon früh daran interessiert. Ich habe verschiedene
Schulen besucht, um das Hotelfach genau zu lernen.
Warum genießen Sie es so, ein Koch zu sein?
Ich liebe es zu lernen und neue Dinge auszuprobieren, was Lebensmittel angeht. In der Küche fühle
ich mich einfach am besten.
Hunderte Fotos von Prominenten schmücken das
Restaurant. Hat denn jeder von ihnen das Los Bandidos besucht und hier gegessen? Und für wen haben
Sie am liebsten gekocht?
Die meisten berühmten Persönlichkeiten haben uns
über eine lange Zeit regelmäßig besucht, um bei
uns zu essen und zu trinken. Einer der berühmtesten
Männer, für die ich bisher gekocht habe, war Hugh
Grant. Jedes Mal, wenn er uns besucht, ist er sehr
nett und findet immer anerkennende Worte.

Wir halten seit Jahren einen sehr hohen Standard,
was Qualität und Frische unserer Zutaten angeht.
Wir sind viel unterwegs, um uns Anregungen zu
holen, und sind stets bemüht, uns in jedem noch
so kleinen Detail zu verbessern. Wir servieren auch
das ganze Jahr über die gleichen Gerichte, so kann
jeder Kunde sich sicher sein, bei jedem Besuch
seine Lieblingsspeise auf der Karte zu finden.

Mi familia siempre se dedicó al negocio de la hostelería. Mi padre era un conocido panadero, mi
abuelo trabajó en el sector hotelero y por eso es
normal que me interesara pronto por ello. Además
me he formado en diferentes escuelas para conocer
con precisión el negocio hotelero.
¿Por qué disfruta tanto siendo cocinero?
Me encanta aprender y probar cosas nuevas, en
lo que a los alimentos se refiere. En la cocina es
donde mejor me siento.
Su restaurante está adornado con cientos de fotos
de famosos. ¿Han venido todos ellos a Los Bandidos y se han quedado a comer? ¿Y para quién ha
cocinado con más agrado?
La mayoría de estos famosos nos han venido a visitar para comer y beber de forma regular durante
mucho tiempo. Uno de los hombres más conocidos
para los que he cocinado hasta la fecha ha sido
Hugh Grant. Cada vez que viene es muy amable y
siempre tiene palabras de reconocimiento.
Una pregunta antes de finalizar: ¿cuál es la receta del éxito de sus platos y del restaurante Los
Bandidos?
Llevamos más de 29 años teniendo éxito, yo creo
que tiene que ver fundamentalmente con la enorme
pasión que ponemos en nuestra cocina. Además,
mantenemos desde hace años un elevado estándar
de calidad y frescura en nuestros ingredientes, viajamos mucho para recoger sugerencias y estímulos y
siempre procuramos mejorar, aún en el más mínimo
detalle y servimos los mismos menús todo el año, así
el cliente puede estar seguro de que siempre encontrará en la carta su plato favorito cuando venga.

The first thing that comes to mind is perhaps accidents, which in the worst case can be fatal, but
there are also many smaller risks you have to look
out for. For example, it is common for a workman
to be doing little repairs around the house. He
might well be using a drill and not immediately
think about taking all safety precautions. He will
generally be in a hurry and when doing little jobs
of that kind, he does not always think too much
about what can go wrong. But then something
happens! For instance, recently a workman drilled
a small hole in a wooden chair, but the drill was
not adequately secured and before he could do
anything, the drill bored through his left hand. He
immediately had to be rushed to hospital to see
whether his bones were broken or nerves severed.
Happily, in this case the workman only suffered
minor injuries. The hospital nevertheless checked
the cause of the accident and commissioned a
detailed investigation.
When a workman is employed with a construction firm, it has to arrange his social security
and insure him appropriately. The situation is different when customers ask the workman to carry
out little repairs on his own time for cash. Then
the house owner is liable when the workman is
moonlighting. If the workman wanted to, in the

geringfügigen Schaden davon. Das Krankenhaus
überprüfte dennoch die Unfallursache und gab eine
genauere Untersuchung in Auftrag.
Wenn ein Arbeiter bei einer Baufirma angestellt
ist, muss diese sich um die soziale Sicherheit kümmern und den Arbeitnehmer entsprechend versichern.
Anders sieht es aus, wenn Kunden die Arbeiter fragen, ob sie Kleinigkeiten »unter der Hand« gegen
Barzahlung reparieren können. Dann haftet immer der

habitual en España, se determinaba por
el derecho de su nacionalidad, aunque
esto no se encontrase dispuesto en
ningún testamento…

Spanien hatten, nach Staatsa ngehörigkeitsrecht geregelt, auch wenn
dies in keinem Testament vorgesehen
war…
A partir del 17/8/2015 esto va a cambiar, porque
entra en vigor el nuevo Reglamento de la Unión Europea
número 650/2012 sobre la competencia, la ley aplicable,
el reconocimiento y la ejecución de las resoluciones, la
aceptación y la ejecución de los documentos públicos en
materia de sucesiones mortis causa y la creación de un
certificado sucesorio europeo.
A partir de la fecha mencionada se aplicará el
Derecho español y en su caso el Derecho foral para determinar quién es sucesor, si el causante mantenía su residencia habitual en España.
Por este motivo es necesario asesorar con el tiempo
suficiente sobre cuáles son las normas de aplicación en
materia de sucesiones en caso de que no se haya otorgado testamento. En la preparación de los testamentos
de residentes extranjeros, debería tenerse en cuenta las
especialidades del derecho español.
En el reglamento se determina un único derecho aplicable a toda la herencia, independiente del patrimonio y
del lugar en el que se encuentra. Por tanto, El reglamento
lo que intenta es fijar un principio de unidad.
No obstante, habrá que estar atento en algunos casos en los que el testamento que no haya sido

(ErbRVO) in Kraft. Ab dem genannten Datum wird spanisches Recht und ggf. das regionale Foralrecht auf die
Erbfolge angewendet, wenn Spanien der gewöhnliche
Aufenthaltsort des Erblassers ist. Aus diesem Grund
sollte dieser Personenkreis rechtzeitig darüber beraten
werden, welche gesetzlichen Regelungen der Erbfolge
im Einzelfall zur Anwendung kommen, sofern kein Testament vorhanden ist. Bei einer Testamentserstellung unter
ausländischen Staatsangehörigen sollten die Besonderheiten spanischen Rechts beachtet werden.
In der ErbRVO wird ein einziges, auf die Gesamtheit
des Nachlasses anwendbares Recht festgelegt (Einheitsprinzip), unabhängig von der Art und Beschaffenheit des
Vermögens und des Ortes, wo sich dieses befindet. Dennoch wird man in den Fällen achtgeben müssen, in denen
das nicht in Spanien erstellte Testament dem spanischen
Recht unbekannte Möglichkeiten der Ausgestaltung der

otorgado en España contemple posibilidades que en
España nuestro derecho no conozca. Por ejemplo en países como Alemania, se dá mucho la figura de la sucesión
fideicomisaria, que nuestro derecho no contempla y crea
dificultades de interpretación en numerosos casos en la
inscripción. Tampoco existe en el Derecho español el testamento conjunto del matrimonio con efectos vinculantes.
Es cierto que el conocido en Alemania como "Berliner
Testament" es de aplicación total en España, pero en la
práctica surgen al menos hasta ahora, algunos problemas
para aplicar estas figuras jurídicas, salvo que los notarios
y registradores intervinientes, tengan alguna experiencia
con ellas. Otro problema importante del sistema jurídico
español es su complejidad, dado que en un solo estado
nos encontramos con distintas legislaciones autonómicas. Para evitar este problema el reglamento establece
que los estados en los que haya distintas normativas,
se establezca cuál es la aplicable de conformidad con su
legislación interna. No obstante, nos encontramos que
en España existe una laguna legal, dado que no encontramos una norma que solucione el caso del conflicto
normativo.
El conflicto entre normas se regula en el artículo
16 del Código civil. De acuerdo con este no es la nacionalidad, sino el lugar en el que se reside, la condición
determinante. En caso de extranjeros resulta un problema
claro. La legislación no contempla en la antigua regulación, aún vigente, la residencia habitual. De acuerdo con el
artículo 12 del Código civil la calificación para determinar
la norma de conflicto aplicable será siempre con arreglo
a la Ley española y continua diciendo que cuando una
norma de conflicto remita a la legislación de un estado en
el que coexistan diferentes sistemas legislativos, la determinación del que sea aplicable entre ellos, se hará conforme a la legislación de dicho estado. Por este motivo se
ha indicado desde la Unión Europea al legislador español
la necesidad de promulgar una ley que ofrezca una solución a esta situación.
El artículo 36 del reglamento remite a las

mit mehreren Rechtsordnungen handelt. Zur Bewältigung dieser Problematik legt die Verordnung fest, dass in
Staaten mit verschiedenen Rechtsordnungen das Gesetz
in Konformität mit seinen internen Normen angewendet
wird. Allerdings gibt es in Spanien eine Gesetzeslücke,
denn es ist kein selbstständiges gesetzliches System der
internen Konfliktlösung vorgesehen. Dieser beschriebene

legislaciones internas de cada estado, aunque menciona
como se debe actuar en los casos de lagunas o conflictos.
Puede ocurrir, por ejemplo que la residencia habitual en el
momento de la muerte o la norma de unidad de territorio,
al que el causante se encontraba más sujeto, determinen
la norma a aplicar.
Para los numerosos extranjeros que viven actualmente en España, este reglamento es de gran importancia y
habría que determinar qué entendemos por residencia
habitual. Desde el punto de vista español la residencia
habitual se aplicaría a las personas que conocemos como
residentes en España a efectos fiscales. Esto es a aquellas personas que viven más de 183 días al año en España, de acuerdo con el artículo 8 de la Ley del Impuesto
sobre la Renta de las Personas físicas. Las diferencias de
la nueva situación para un ciudadano extranjero pueden
ofrecer nuevas posibilidades, pero también problemas.
Los problemas vendrán probablemente en el caso de la
aplicación de derechos forales que de acuerdo con al artículo 38 del reglamento sigue siendo aplicable. De esta
manera las viudas que residan en Navarra heredarán el
usufructo legal de fidelidad. Esto significa que a la viuda
sólo le quedará el usufructo, y ello en el caso de que no
vuelva a contraer matrimonio. En caso de que algún extranjero quiere evitar esta situación, si vive en Navarra,
debe otorgar un testamento ante notario de acuerdo con
las leyes de su país de origen.

Konflikt wird gemäß Art. 16 Código Civil gelöst; danach
ist nicht die Staatsangehörigkeit, sondern die zivilrechtliche Gebietszugehörigkeit maßgebend. Für Ausländer
stellt dies ein Problem dar, da sie in der Regel keine zivilrechtliche Gebietszugehörigkeit aufweisen. Gemäß Art.
12 CC wird die Anwendung der Bestimmungen hinsichtlich der Zuordnung, der Weiterleitung und der Ausnahmeregelung der öffentlichen Ordnung ausgeschlossen.
Aus diesem Grund wurde der spanische Gesetzgeber auf
die Notwendigkeit hingewiesen, ein Gesetz zu erlassen,
das für diese Situation eine Lösung bietet.
Der Art. 36 ErbRVO verweist auf die internen Richtlinien des Staates, zeigt jedoch an, wie in Ermangelung
solcher Richtlinien zur Bestimmung des anwendbaren
Rechts vorzugehen ist. Es kann z.B. der reguläre Wohnsitz zum Zeitpunkt des Ablebens oder die Gebietseinheit,
zu der der Verstorbene die engste Beziehung pflegte, den
Ausschlag geben. Für alle zurzeit in Spanien lebenden
Ausländer ist diese Verordnung von großer Bedeutung,
denn fraglich ist, was für sie unter dem »gewöhnlichen
Aufenthalt« zu verstehen ist. Aus spanischer Sicht würde
man darunter einen regulären Wohnsitz verstehen, wenn
die Person einen längeren Zeitraum als »residente« in
Spanien steuerpflichtig ist. Dies ist bei einem durchgehenden Aufenthalt in Spanien von mindestens 183 Tagen
im Jahr der Fall (Art. 8 und 9 Abs. 1 span EStG – Ley del
impuesto sobre la Renta de las Personas Físicas – LIRPF).
Die Unterschiede des Erbstatuts in anderen Ländern
und in Spanien können für einen deutschen Staatsbürger sowohl Chancen bieten als auch Probleme mit sich
bringen. Probleme entstehen vor allem dann, wenn
Foralrechte zur Anwendung kommen, was gem. Art. 38
ErbRVO auch weiterhin möglich ist. So gilt für Witwen
in Navarra das »mittelalterliche« Nießbrauchsrecht der
Treue. Dies bedeutet, dass der Witwe nur ein Nießbrauch zusteht, wenn sie sich nicht wieder verheiratet.
Will eine deutsche Staatsbürgerin dem vorbeugen, sollte
sie ein notarielles Testament unter Anwendung deutschen Rechts abfassen.

In der Regel haben die Patienten sich an diese
Symptome gewöhnt und empfinden sie nicht mehr
als Erkrankung, sondern nur noch als lästig. Der nötige Gang zum Hals-Nasen-Ohren-Arzt wird manchmal
über Jahre hinausgezögert – mit fatalen Folgen. In
dieser Zeit bilden sich in den Nasennebenhöhlen
häufig sogenannte Zysten, gutartige Gewebewucherungen. Diese erschweren und verlängern die Therapie und müssen oft sogar operativ entfernt werden.
Die Diagnostik einer akuten oder chronischen
Sinusitis beinhaltet die Sonografie (Ultraschall) der
Nasennebenhöhlen sowie die Beurteilung der nasalen Schleimhautverhältnisse und die Endoskopie der
Nase (schmerzfrei). Gibt es hier Anzeichen von Zystenbildung wäre der nächste Schritt der Diagnostik
ein Computertomogramm (CT) oder Kernspintomogramm (NMR). Diese zeigen – falls eine Operation notwendig wäre – die komplette Anatomie der
Nasennebenhöhlen und der angrenzenden Gebiete.
Im Anfangsstadium bilden sich die Zysten nur in den
Kieferhöhlen. Sie können aber auch in die Siebbeine
hineinwuchern, wobei es meistens zusätzlich auch
zur Polypenbildung in der Nase kommt. Über den
Weg der Siebbeine wachsen sie dann weiter nach
oben in die Stirnhöhlen und nach hinten Richtung
Schädelbasis, in die Keilbeinhöhlen hinein.
Zysten, die nur die Kieferhöhlen betreffen, operiert man heutzutage ambulant in einer Kurznarkose.
Alle Operationen der Nasennebenhöhlen werden
endoskopisch durchgeführt, somit minimalinvasiv
und blutarm, sodass post-operativ auf Tamponaden
verzichtet werden kann. Je weiter fortgeschritten
die Zystenbildung jedoch ist, desto tiefer geht auch
der operative Eingriff.
Auch schon Kinder unter 6 Jahren können an
Nasennebenhöhlenentzündungen leiden. Da die
eustachische Röhre bei Kindern eine andere Anatomie aufweist als bei Erwachsenen, sind in diesen
Fällen Mittelohrentzündungen ebenso vorprogrammiert wie die Polypenbildung im Nasen-RachenRaum (adenoide Vegetationen). Eine Nichtbehandlung dieser Erkrankung bei Kindern hat zur Folge,
dass diese unter einem Dauerschnupfen leiden, es
zu Hörminderung und permanentem Schnarchen
kommen kann. Im Kleinkindalter führt eine chronische Sinusitis zuweilen gar zu Sprachentwicklungsverzögerungen. Eine rechtzeitige Therapie
verhindert zudem, dass sogenannte Paukenröhrchen eingesetzt oder Polypen (Adenoide) operativ
entfernt werden müssen. Deshalb, liebe Patienten,
beachten Sie die Symptome bei jeder Erkältung
und jedem grippalen Infekt genau; schieben Sie im
Zweifelsfall den Gang zu Ihrem Hals-Nasen-OhrenArzt nicht hinaus. Oder noch besser: Bleiben Sie

The "dry eye syndrome" diagnosis is often a
confusing one. It is better to use the term "keratitis sicca". But this requires an explanation. FINEST

What is the function of the tear film and what is it
made of?
The tear film is there to moisten the eye and protect
it, to nourish the cornea and improve vision. It consists of three layers: mucous, which produces contact between the surface of the eye and the water
layer, then the water layer and on top of that an oil
layer. With a good tear film, there is always a stable
moistening of the eye.

sind übliche Reaktionen vieler Patienten, wenn ihr Augenarzt die Diagnose »trockenes Auge« stellt. Ist die Diagnose falsch? Gibt es überhaupt ein trockenes Auge? Die
Diagnose »trockenes Auge« ist zumeist missverständlich.
Besser ist es, den Begriff Benetzungsstörung zu benutzen.
Dieser bedarf jedoch einer Erklärung. FINEST addresses

What happens when the tear film is disturbed?
Reduced water production is relatively uncommon
and may e.g. be associated with rheumatic diseases. In most cases the fatty layer is not sufficiently formed. The absence of the mucous layer means
that when you blink, there is more friction between
the eyelid and eyeball, while the water layer evaporates more rapidly. Both together create irritation
to the eye. The resultant complaints vary widely: a
burning or scratching sensation, itchiness, blurred
vision … to name but a few.
Welche Aufgabe hat der Tränenfilm und woraus
besteht er?
Die Funktion des Tränenfilms ist, das Auge zu schmieren und zu schützen, die Hornhaut zu ernähren und die
Optik zu verbessern. Er besteht aus drei Schichten: einer
Schleimschicht, welche den Kontakt zwischen Augoberfläche und der Wasserschicht herstellt, eben dieser
wässrigen Schicht und obendrauf einer öligen bzw. Fettschicht. Bei gutem Tränenfilm ist das Auge kontinuierlich
stabil benetzt.

Sindrome del ojo seco
En la mayoría de los casos, el diag
nóstico del “ojo seco” suele malinterpretarse. Es
preferible utilizar el término síndrome del ojo seco.
El oftalmólogo Ulrich Geck, de Marbella Visión
nos lo explica: “La función de la película lagrimal es proteger y lubricar el ojo, alimentar la
córnea y mejorar la óptica. Si la película lagrimal es buena, el ojo está humedecido de forma
continua y estable. Si, por el contrario, la película lagrimal está dañada, puede producirse una
mayor fricción entre el párpado y el globo ocular
a la hora de pestañear, por ejemplo. Esto produce un estado de excitación e irritación en el ojo.
¿Qué hacer? El oculista puede determinar si se
trata de una disminución de la cantidad lacrimal
o de la calidad de las lágrimas. En caso de disminución de la cantidad lacrimal, se puede tratar
con diversas medidas, si se trata de una pérdida
de la calidad, el tratamiento suele ser el uso de
lágrimas artificiales.

Und warum tränt das Auge dann?
Aufgrund des Reizes, der erhöhten Reibung zwischen
Lid und Augapfel, produziert der Körper mehr Wasser
– anstatt mehr Fett zu produzieren. Und so kann es aufgrund der Benetzungsstörung zu tränenden Augen kommen. Als Reaktion auf die herabgesetzte Qualität des
Tränenfilms.
Was tun?
Ihr Augenarzt kann feststellen, ob es sich um eine Minderung der Tränenmenge oder um eine Minderung der
Tränenqualität handelt. Bei einer Minderung der Tränenmenge können verschiedene Maßnahmen ergriffen werden, bei Minderung der Tränenqualität wird zumeist mit
dem Eintropfen von künstlichen Tränen begonnen. Das
entscheidende der künstlichen Tränen ist ihr Anteil an
Schmierstoffen, weniger entscheidend ist der Wasseranteil. Denn die Schmierstoffe mindern beträchtlich den
Reizzustand und fördern somit das Wohlbefinden der
Augen. Steriles Wasser hilft nicht, da hier die Fettschicht
nicht aufgebaut wird und die Schmierung des Auges
weiterhin schlecht bleibt. Für einige Patienten klingt die
Diagnose »trockenes Auge« nach zu wenig, in Anbetracht der ausgeprägten Beschwerden, die im Einzelfall
bestehen können. Die Diagnose bedeutet in den meisten
Fällen eine deutliche Einschränkung der Lebensqualität
und bedarf einer konsequenten Behandlung.
