Spanien wieder im Aufwind
Spain has done its homework. After years of
recession, the burst property bubble and record unemployment figures, the country is now finally regaining its selfconfidence. Even though sovereign debt remains high, in
the second quarter of this year the GDP rose by 1.2 percent
in comparison with last year, while
the unemployment rate fell by 1.4
percentage points. Furthermore,
domestic tourism is growing in the
double-digit range. This can also be
seen when one looks at Marbella.
The gastronomic and hotel sectors
have both done far better this year.
And in the summer evenings, the
Puerto Banús was so full of life that
one had the sensation of being at
the Munich Oktoberfest. We just had to accept that it was
very hard to find a free parking space. The main thing is
that the local people are again wanting to stroll, shop and
consume. Even economics minister Luis de Guindos is confident that the economy will grow by around 1.5 percent in
2014 and two percent in 2015. Consequently, investors are
showing more faith in Spanish companies and products.
Prime Minister Mariano Rajoy also recently expressed
optimism: "The fact is that our economy is recovering and
gaining in strength, (…) we are back on dry land." The
Spanish-German solicitor Fernando Frühbeck provides
advice as a specialist in real estate law: "It is time to take
a look at the coast before prices rise again." Because: "In
the province of Màlaga alone, during the first six months
of 2014 as many properties were sold as in the whole of
2013." Spain is awakening from its hibernation and becoming more popular than ever as a tourist destination
and country for property investment.
Spanien hat seine Hausaufgaben gemacht. Nach
Jahren der Rezession, der geplatzten Immobilienblase und
der Rekordarbeitslosenzahlen tritt das Land endlich mit
neuem Selbstbewusstsein auf. Auch wenn die Staatsverschuldung immer noch hoch ist, so legte das BIP im 2. Quartal
dieses Jahres um 1,2 Prozent im Vergleich zum
Vorjahr zu, die Arbeitslosenquote ging zugleich
um 1,4 Prozentpunkte zurück und der Inlandstourismus wächst im zweistelligen Bereich. Das
merkt man auch am Stadtbild von Marbella. Die
Gastronomie und Hotellerie haben stark zugelegt. Und in den sommerlichen Abendstunden
war der Puerto Banús so voller Leben, dass man
das Gefühl hatte, man sei auf dem Münchner
Oktoberfest… Dass dadurch auch die Parkplätze überfüllt waren, nehmen wir gerne in Kauf.
Hauptsache, die Menschen vor Ort haben wieder Lust am
Bummeln, Shoppen und Genießen. Selbst Wirtschaftsminister Luis de Guindos gibt sich zuversichtlich, dass die Wirtschaft in 2014 um 1,5 und in 2015 um zwei Prozent zulegen
wird. So haben Investoren nach den harten Reformmaßnahmen verstärkt Vertrauen in spanische Firmen und Produkte.
Von Fiesta-Stimmung an der Börse zu sprechen ist zwar
ein bisschen übertrieben, aber die Tendenz stimmt. Auch
Ministerpräsident Mariano Rajoy machte vor Kurzem Mut:
»Fakt ist, unsere Wirtschaft erholt sich und gewinnt an Kraft,
(…) wir betreten Festland.« Der spanisch-deutsche Anwalt
Fernando Frühbeck rät als Immobilienrechtsspezialist: »Man
sollte sich die Küste jetzt anschauen, bevor die Preise wieder steigen.« Denn: »Während der ersten sechs Monate von
2014 hat man allein in der Provinz Màlaga so viele Immobilien verkauft wie im ganzen Jahr 2013.« So ist Spanien aus
seinem Dornröschenschlaf erwacht und als Tourismusdes

гулять, заниматься шопингом и наслаждаться
жизнью. Сам министр экономики Луис де Гиндос
обнадеживает, что темпы развития экономики
возрастут в 2014 году на 1,5 %, а в 2015 году –

жестких реформ стали больше доверять
испанским фирмам и продуктам. Премьерминистр Мариано Рахой недавно вселил

años de recesión, del estallido de la burbuja inmobiliaria y de la cifra récord de parados, el país pisa con una
nueva conciencia de su valía. A pesar de que el Estado
aún sigue muy endeudado, el PIB subió un 1,2 por ciento durante el segundo trimestre, en comparación con
el año anterior, la cifra de parados bajó. Todo esto se
nota también en la imagen de la ciudad de Marbella, en
donde la gastronomía y la hostelería se han incrementado notablemente. Así, durante las tardes veraniegas
Puerto Banús estaba tan lleno de vida que parecía ser
la fiesta de la cerveza muniquense, por lo que no dudamos de que los aparcamientos estuvieran igualmente
repletos. Lo principal es que la gente del lugar vuelve a
tener ganas de salir a la calle, ir de compras y disfrutar.
Incluso el ministro de economía, Luis de Guindos, está
convencido de que la economía aumentará un 1,5 en
2014 y un 2,00 por ciento para 2015. Los inversores
vuelven a confiar en las empresas y los productos españoles tras las duras medidas de reformas acometidas.
Aunque hablar de espíritu de fiesta en bolsa sería algo
exagerado, sin embargo la tendencia va por ahí. Incluso
el presidente del gobierno, Mariano Rajoy, se mostraba animado recientemente diciendo: "El hecho es que
la economía se va recuperando y ganando fuerza (…)
pisamos tierra firme". El abogado hispano-alemano
Fernando Frühbeck, como experto en derecho inmobiliario, aconseja "mirar ahora en la costa, antes que
vuelvan a subir los precios", ya que "solo en la provincia
de Málaga se han vendido tantos inmuebles durante
los seis primeros meses de 2014 como en todo 2013".
España se ha despertado de su sueño de Bella Durmiente y ahora más que nunca es el lugar favorito como
destino turístico y país para invertir en inmuebles.

For 20 years, the AIDS aid organisation, Concordia, has
done all it can to provide important explanations and
information and to offer assistance to all those in the
region who have already caught the
virus. A particularly good opportunity to
collect donations for this is the annual
summer ball, the already legendary Concordia Gala, which every year attracts
prominent friends and sponsors from
throughout the world. As was the case
this year, too. On the first evening of
August, 350 top-class guests came to
the private finca La Concepción close to
Marbella, where they conversed in the
beautiful garden and in the most elegant
of settings, while supporting this good cause. Princess
Marie Louise of Prussia, Countess Schönburg was more
than happy that the lottery she herself organised, which
moreover only offered prizes worth 1,000 euros or more,
raised a total of 20,000 euros for the association. Funds
that are urgently needed, because, as Countess Schönburg explained: "Only in this way can we fund our work
and, unfortunately, the number of AIDS infections is
rising …."
Of course, the performances by the "Bollywood"
dance group were especially impressive as were the
fantastic songs performed by the exceptional Yanela
Brooks, which went straight to the heart. As sponsors of
the gala, Bentley, Fesacamp S.L. and deditus design did
their best to make this event truly unforgettable.

Informationsarbeit zu leisten sowie ein Hilfsangebot für
all diejenigen in der Region zur Verfügung
zu stellen, die bereits am Virus erkrankt
sind. Eine besonders gute Gelegenheit,
um Spenden hierfür zu sammeln, ist der
alljährliche Sommerball, – die bereits
legendäre Concordia-Gala –, die Jahr für
Jahr prominente Freunde und Sponsoren
aus der ganzen Welt anlockt. So auch
in diesem Jahr, kamen doch am ersten
Augustabend 350 hochkarätige Gäste in
die Privatfinca La Concepción unweit von
Marbella, um sich im wunderschönen
Garten in äußerst elegantem Ambiente auszutauschen
und zugleich die gute Sache zu unterstützen. Prinzessin
Marie Louise von Preußen, Gräfin Schönburg, freute sich
sehr, dass mit der eigens veranstalteten Lotterie, die übrigens nur Preise ab 1.000 Euro ausschüttete, insgesamt
20.000 Euro für den Verein eingenommen werden konnten. Geld, das dringend gebraucht wird, denn, so die Gräfin Schönburg: »Nur so können wir unsere Arbeit finanzieren und leider steigt die Zahl der AIDS-Infizierungen…«
Besonders beeindruckend waren natürlich die Vorführungen der indischen Tanzgruppe »Bollywood« ebenso
wie die fantastischen Gesangseinlagen der Ausnahmesängerin Yanela Brooks, die direkt ins Herz gingen. Als
Sponsoren sorgten vor allem Bentley, Fesacamp S.L. und
deditus design für eine rundum perfekte Gala.

The Starlite Festival is one of the highlights of Marbella’s cultural agenda and is, therefore, considered
to be one of the biggest social and entertainment events in Spain, with 100 personalities from business,

Guiseppe Villano practically grew up in his parents'
restaurant and fell in love with cookery at an early
age. When preparing meals together with his
mother, Álvaro Hermosín already knew that he wanted to become a chef, while in the case of Larry Ingles, it was his grandmother who triggered his passion for cookery. Today, all three are exceptionally
talented chefs who have selected the Kempinski
Hotel Bahía to practise their art.

It has been three years now since the establishment
opened, and day after day he has produced cuisine
with his own very personal signature and been the
perfect host. He has been perfecting his craft on the
Costa del Sol for 16 years and can even look back
on three decades of experience as a chef. Today
he is indisputably one of the best on the coast and,
with the Nueva Kaskada, he has created a true
oasis of pleasures. Fichthaler himself is full of gratitude: "I am grateful for everything: for my health,
my culinary gift and for all the loyal guests and, of
course, my wonderful team who I thank from the
bottom of my heart for working with me to meet

geschaffen. Fichthaler selbst ist voller Dankbarkeit:

Nach einem tollen Sommer kehren nun langsam die
herbstlichen Aromen in die Küche des Nueva Kaskada ein. So findet man in dieser Zeit auch hin und
wieder ein Gericht aus Ewalds Heimat Deutschland
auf der Tageskarte. Derzeit stehen Wildgerichte und
Pilze hoch im Kurs. Ein wenig komisch ist es dem
Meister der Kochlöffel schon, wenn er an die Weihnachts- und Silvestermenüs denkt, die er demnächst
bei gerade noch 35 Grad kreieren wird… Aber jetzt
ist erst mal noch die Zeit, sich voll und ganz dem

MATERIA DE SUCESIONES
Abänderungen nach der neuen Erbrechtsverordnung
Hasta ahora la determinación del
sucesor en caso de fallecimiento de un
extranjero, que tuviese su residencia
habitual en España, se determinaba por
el derecho de su nacionalidad, aunque
esto no se encontrase dispuesto en
ningún testamento…
Bisher wurde die Erbfolge ausländischer Staatsbürger, die ihren
gewöhnlichen Aufenthaltsort in
Spanien hatten, nach Staatsa ngehörigkeitsrecht geregelt, auch wenn
dies in keinem Testament vorgesehen
war…
A partir del 17/8/2015 esto va a cambiar, porque
entra en vigor el nuevo Reglamento de la Unión Europea
número 650/2012 sobre la competencia, la ley aplicable,
el reconocimiento y la ejecución de las resoluciones, la
aceptación y la ejecución de los documentos públicos en
materia de sucesiones mortis causa y la creación de un
certificado sucesorio europeo.
A partir de la fecha mencionada se aplicará el
Derecho español y en su caso el Derecho foral para determinar quién es sucesor, si el causante mantenía su residencia habitual en España.
Por este motivo es necesario asesorar con el tiempo
suficiente sobre cuáles son las normas de aplicación en
materia de sucesiones en caso de que no se haya otorgado testamento. En la preparación de los testamentos
de residentes extranjeros, debería tenerse en cuenta las
especialidades del derecho español.
En el reglamento se determina un único derecho aplicable a toda la herencia, independiente del patrimonio y
del lugar en el que se encuentra. Por tanto, El reglamento
lo que intenta es fijar un principio de unidad.
No obstante, habrá que estar atento en algunos casos en los que el testamento que no haya sido

Erbfolge angewendet, wenn Spanien der gewöhnliche
Aufenthaltsort des Erblassers ist. Aus diesem Grund
sollte dieser Personenkreis rechtzeitig darüber beraten
werden, welche gesetzlichen Regelungen der Erbfolge
im Einzelfall zur Anwendung kommen, sofern kein Testament vorhanden ist. Bei einer Testamentserstellung unter
ausländischen Staatsangehörigen sollten die Besonderheiten spanischen Rechts beachtet werden.
In der ErbRVO wird ein einziges, auf die Gesamtheit
des Nachlasses anwendbares Recht festgelegt (Einheitsprinzip), unabhängig von der Art und Beschaffenheit des
Vermögens und des Ortes, wo sich dieses befindet. Dennoch wird man in den Fällen achtgeben müssen, in denen
das nicht in Spanien erstellte Testament dem spanischen
Recht unbekannte Möglichkeiten der Ausgestaltung der

España nuestro derecho no conozca. Por ejemplo en países como Alemania, se dá mucho la figura de la sucesión
fideicomisaria, que nuestro derecho no contempla y crea
dificultades de interpretación en numerosos casos en la
inscripción. Tampoco existe en el Derecho español el testamento conjunto del matrimonio con efectos vinculantes.
Es cierto que el conocido en Alemania como "Berliner
Testament" es de aplicación total en España, pero en la
práctica surgen al menos hasta ahora, algunos problemas
para aplicar estas figuras jurídicas, salvo que los notarios
y registradores intervinientes, tengan alguna experiencia
con ellas. Otro problema importante del sistema jurídico
español es su complejidad, dado que en un solo estado
nos encontramos con distintas legislaciones autonómicas. Para evitar este problema el reglamento establece
que los estados en los que haya distintas normativas,
se establezca cuál es la aplicable de conformidad con su
legislación interna. No obstante, nos encontramos que
en España existe una laguna legal, dado que no encontramos una norma que solucione el caso del conflicto
normativo.
El conflicto entre normas se regula en el artículo
16 del Código civil. De acuerdo con este no es la nacionalidad, sino el lugar en el que se reside, la condición
determinante. En caso de extranjeros resulta un problema
claro. La legislación no contempla en la antigua regulación, aún vigente, la residencia habitual. De acuerdo con el
artículo 12 del Código civil la calificación para determinar
la norma de conflicto aplicable será siempre con arreglo
a la Ley española y continua diciendo que cuando una
norma de conflicto remita a la legislación de un estado en
el que coexistan diferentes sistemas legislativos, la determinación del que sea aplicable entre ellos, se hará conforme a la legislación de dicho estado. Por este motivo se
ha indicado desde la Unión Europea al legislador español
la necesidad de promulgar una ley que ofrezca una solución a esta situación.
El artículo 36 del reglamento remite a las

Staaten mit verschiedenen Rechtsordnungen das Gesetz
in Konformität mit seinen internen Normen angewendet
wird. Allerdings gibt es in Spanien eine Gesetzeslücke,
denn es ist kein selbstständiges gesetzliches System der

como se debe actuar en los casos de lagunas o conflictos.
Puede ocurrir, por ejemplo que la residencia habitual en el
momento de la muerte o la norma de unidad de territorio,
al que el causante se encontraba más sujeto, determinen
la norma a aplicar.
Para los numerosos extranjeros que viven actualmente en España, este reglamento es de gran importancia y
habría que determinar qué entendemos por residencia
habitual. Desde el punto de vista español la residencia
habitual se aplicaría a las personas que conocemos como
residentes en España a efectos fiscales. Esto es a aquellas personas que viven más de 183 días al año en España, de acuerdo con el artículo 8 de la Ley del Impuesto
sobre la Renta de las Personas físicas. Las diferencias de
la nueva situación para un ciudadano extranjero pueden
ofrecer nuevas posibilidades, pero también problemas.
Los problemas vendrán probablemente en el caso de la
aplicación de derechos forales que de acuerdo con al artículo 38 del reglamento sigue siendo aplicable. De esta
manera las viudas que residan en Navarra heredarán el
usufructo legal de fidelidad. Esto significa que a la viuda
sólo le quedará el usufructo, y ello en el caso de que no
vuelva a contraer matrimonio. En caso de que algún extranjero quiere evitar esta situación, si vive en Navarra,
debe otorgar un testamento ante notario de acuerdo con
las leyes de su país de origen.

Konflikt wird gemäß Art. 16 Código Civil gelöst; danach
ist nicht die Staatsangehörigkeit, sondern die zivilrechtliche Gebietszugehörigkeit maßgebend. Für Ausländer
stellt dies ein Problem dar, da sie in der Regel keine zivilrechtliche Gebietszugehörigkeit aufweisen. Gemäß Art.
12 CC wird die Anwendung der Bestimmungen hinsichtlich der Zuordnung, der Weiterleitung und der Ausnahmeregelung der öffentlichen Ordnung ausgeschlossen.
Aus diesem Grund wurde der spanische Gesetzgeber auf
die Notwendigkeit hingewiesen, ein Gesetz zu erlassen,
das für diese Situation eine Lösung bietet.
Der Art. 36 ErbRVO verweist auf die internen Richtlinien des Staates, zeigt jedoch an, wie in Ermangelung
solcher Richtlinien zur Bestimmung des anwendbaren
Rechts vorzugehen ist. Es kann z.B. der reguläre Wohnsitz zum Zeitpunkt des Ablebens oder die Gebietseinheit,
zu der der Verstorbene die engste Beziehung pflegte, den
Ausschlag geben. Für alle zurzeit in Spanien lebenden
Ausländer ist diese Verordnung von großer Bedeutung,
denn fraglich ist, was für sie unter dem »gewöhnlichen
Aufenthalt« zu verstehen ist. Aus spanischer Sicht würde
man darunter einen regulären Wohnsitz verstehen, wenn
die Person einen längeren Zeitraum als »residente« in
Spanien steuerpflichtig ist. Dies ist bei einem durchgehenden Aufenthalt in Spanien von mindestens 183 Tagen
im Jahr der Fall (Art. 8 und 9 Abs. 1 span EStG – Ley del
impuesto sobre la Renta de las Personas Físicas – LIRPF).
Die Unterschiede des Erbstatuts in anderen Ländern
und in Spanien können für einen deutschen Staatsbürger sowohl Chancen bieten als auch Probleme mit sich
bringen. Probleme entstehen vor allem dann, wenn
Foralrechte zur Anwendung kommen, was gem. Art. 38
ErbRVO auch weiterhin möglich ist. So gilt für Witwen
in Navarra das »mittelalterliche« Nießbrauchsrecht der

INNOVATIVE CAPSULE ENDOSCOPY
Conventional gastroscopy and colonoscopy are often experienced by
patients as being burdensome and unpleasant, but they are a thing of the past at
the practice of Dr med Michael Peters in the centre of Marbella. The specialist in
internal medicine, gastroenterology, uses the latest cutting-edge technology:
capsules equipped with a little camera that the patient swallows, allowing him to
view under the microscope the stomach/intestines from the inside out

and diabetology – at the Jewish Hospital Berlin to

The latest generation of capsule software even enables us to obtain an image of the large intestine
with a previously unheard-of resolution. "Thus for the
first time there is now also an alternative to conventional colonoscopy by means
of endoscopy (coloscopy)."
Moreover, capsules are available for the examination of the
oesophagus. All the capsules
are used just the once. After
having been swallowed, they
send images to a recording
device for 8 to 12 hours while
they are being transported
through the gastro-intestinal
tract by natural motility. "The
capsules used by us, which
belong to the latest generation, have cameras that can
photograph in both directions
and, depending on the speed
of transport, take up to 35 images per second," says
Dr Peters. "I am very pleased to have the first private

Firma ‘Given Imaging’, die es mit dieser Innovation

Operation möglich gewesen.« Die neueste Generation der Kapselsoftware ermöglicht nun sogar, den
Dickdarm in nicht gekannter Auflösung darzustellen.
»Damit ist jetzt erstmals auch eine Alternative zur
konventionellen Darmspiegelung mittels Endoskopie
(Koloskopie) gegeben.« Des Weiteren sind Kapseln
zur Untersuchung der Speiseröhre (Ösophagus) verfügbar. Alle diese Kapseln sind Einwegkapseln, die
nach dem Schlucken für acht bis 12 Stunden Bilder
an eine Aufnahmeeinheit funken, während sie von
der natürlichen Darmbewegung (Motilität) durch den
Magen-Darm-Trakt transportiert werden. »Die von
uns eingesetzten Kapseln der neuesten Generation
haben Kameras, die in beide Richtungen fotografieren und abhängig von der Transportgeschwindigkeit
bis zu 35 Fotos pro Sekunde machen können«, so Dr.
Peters. »Ich freue mich sehr, diese Untersuchung als
erste Privatpraxis in Marbella anbieten zu können.«

viel Wasser und ziemlich flaches Land. Während Los
Lagos sich über 52 Hektar erstreckt, ist Los Olivos
mit seinen schätzungsweise 40 Hektar die kleinere Alternative. Der erste eignet sich gut als Wettkampfkurs für Spieler mit niedrigen Handicaps, der
zweite bietet gute Übungsmöglichkeiten für Spieler
mit mittleren/hohen Handicaps. Ganz aktuell wurde
Los Lagos sogar noch das »i-Tüpfelchen« aufgesetzt. Nach einer intensiven Umbauphase wurden
die Greens nach USGA-Vorgaben erweitert und die
Tee-Bereiche vergrößert. Zudem garantiert ein völlig neues Be- und Entwässerungssystem das schöne
Spiel im Grünen zu jeder Zeit des Jahres – selbst
während oder nach starkem Regen!

Los Lagos has an area of 52 hectares defined by its wide
fairways lined with numerous lakes, hence the course
name. In addition, the 9 lakes showed on the course turn
the water into natural obstacles in 10 of the 18 holes.
At the same time, the course presents a lot of bunkers
and a great variety of autochthonous large size trees,
strategically located to defend the wide flat greens.
Recently, Los Lagos was completely refined. Now the
NEW LAGOS COURSE offers even larger greens, built to
USGA specifications, and at the same time, all the teeing areas have been also distended. A completely new
irrigation and drainage system has been installed all
around the course, to permit the play at any season of
the year (Even with/after a hard rain).
The second course of Mijas, Los Olivos, is
smaller, approx. 40 hectares, and it over passed an
important rebuilding between 2000-2001. Los Olivos
stands out because of its smaller greens with more
slope, well defended by bunkers. At the same time,
the big number of Olive trees strategically located
around the fairways, will require a more accurate and
straight drive from the player. On the one hand, Los
Lagos is considered a competition course, ideal for
low handicaps; while, on the other hand, Los Olivos is
the best choice for mid / high handicaps.

Once a week, I visit the Sierra de Grazalema with its
typical Andalusian white villages like El Gastor. The
locals are really very nice. Here you can experience
truly rural life and be "infected" by the calm lifestyle
of the villagers. That's an enormous help when you
really want to relax.
Wo ich nach der Arbeit zum Relaxen hingehen?
Einmal in der Woche besuche ich die Sierra de Grazalema mit ihren typischen andalusischen weißen
Dörfern wie El Gastor. Die Einwohner sind wirklich
sehr nett. Hier kann man das richtig rustikale Leben
