Many European countries are faced with several
economic threats. On one hand there is the immeasurable rise of, mostly overseas based, online companies
who are profiting at the expense of other countries. On
the other hand the effect of the internet has changed
the balance of our system with
its online distribution structures. If
left unchecked then this could lead
to companies such as Amazon,
Google and Ebay monopolising the
market. Do we want a few giant
companies controlling the distribution and production structure
and dictating the prices? The sole
traders, the hoteliers, the taxi sector and the property sector have
already suffered at the hands of internet based competition. This threatens jobs and destroys prices. If these
aggressive tactics of tax evasion by large internet based
companies carry on unabated then all is as good as lost.
What should national economies who are dependent
upon income from taxation “feed off”? The European
policy has failed because how can Europe and the Euro
grow together when there are such unequal conditions?
It cannot be the case that single countries are afforded
the opportunity to profit from their status as a tax haven
whilst others suffer very badly because of this. This antiEuropean strategy should be dropped as soon as possible. Some countries such as Spain are hit very hard
when they lose the income from tax exiles and business
be it small scale or large scale. A harmonisation of tax
laws is urgently needed! We are all waiting on tenterhooks to see what the new year of changes will bring.
However, we remain confident of our strengths and despite everything we remain hopeful.

Viele europäische Länder sind mehreren wirtschaftlichen Bedrohungen ausgesetzt. Zum einen gibt es
die schier ins Unermessliche wachsenden Onlinekonzerne, meist aus Übersee, die sich auf Kosten anderer Länder
bereichern. Zum anderen verändert der Sog des Internets
mit seinen Onlinevertriebsstrukturen die Ordnung unserer Systeme. Geht alles ungebremst
so weiter, könnten Firmen wie Amazon, Google und Ebay Monopolstellung erlangen. Wollen wir, dass einige wenige Megakonzerne in
ihrem Marktsegment sämtliche Vertriebs- und
Produktionsprozesse steuern und die Preise
diktieren? Der Einzelhandel, die Hotellerie, das
Taxigewerbe und die Immobilienbranche leiden bereits aufgrund der Konkurrenz aus dem
Netz, die Arbeitsplätze bedroht und die Preise kaputt macht. Wenn dann noch Taktiken aggressiver
Steuervermeidung seitens vieler internetbasierter Großkonzerne hinzukommen, na dann gute Nacht. Dann zahlen die, die es sich leisten können, bald gar keine Steuern
mehr. Wovon sollen sich die auf Steuereinnahmen angewiesenen Volkswirtschaften noch »ernähren«? Die europäische Politik hat versagt, denn wie sollen der Euro und
Europa zusammenwachsen, wenn es so derart ungleiche
Verhältnisse gibt? Es darf nicht sein, dass einzelne Länder
die Möglichkeit haben, sich als Steueroasen zu profilieren,
und anderen Nationen damit massiv geschadet wird. Dieser kontraproduktive Anti-Europa-Kurs muss schleunigst
verlassen werden! Einem Land wie Spanien tut es richtig
weh, wenn die Steuern abwandern und der Einzel- /Großhandel seine Umsätze verliert. Eine Harmonisierung des
Steuerrechts wäre daher dringend erforderlich! Bleiben
wir gespannt, was das neue Jahr an Umwälzungen mit
sich bringt. Aber vertrauen wir weiterhin auf unsere Stärken und bleiben wir trotz alledem voller Hoffnung.

Muchos de los países europeos se ven expuestos a muchas amenazas económicas. Por un lado, existen empresas en línea con un crecimiento prácticamente
inconmensurable, que en la mayoría de los casos tienen
su sede en ultramar y se enriquecen a costa de otros
países. Por otro lado, está el remolino de Internet que ha
cambiado el orden de nuestro sistema con sus estructuras de venta en línea. Si todo sigue adelante sin freno,
empresas como Amazon, Google o Ebay terminarán creando un monopolio. ¿Queremos que unos pocos consorcios
gigantescos dirijan y dicten todos los procesos de venta
y producción dentro de este segmento del mercado? Las
tiendas minoristas, la hostelería, las empresas de taxi y el
sector inmobiliario ya están sufriendo la competitividad de
la red, que pone en peligro puestos de trabajo y revienta
los precios. Si a esto añadimos las agresivas tácticas para
evitar impuestos que practican muchos de los consorcios
basados en Internet, apaga y vámonos. Dentro de poco los
que más se lo pueden permitir, acabarán por no pagar más
impuestos. ¿De qué se "alimentará" la economía nacional,

pero sigamos confiando en nuestro potencial y mantengamos, a pesar de todo ello, plena esperanza.

Bisher mussten Patienten oftmals Gewebeschwellungen und
starke postoperative Schmerzen ertragen. Das Nobel-GuideSystem funktioniert ganz ohne Einsatz von Skalpell und ohne
Wundnähte, daher reduziert sich der Behandlungszeitraum auf
ein Minimum. Der Zahnarzt kann die Behandlung individuell
planen sowie die bestehende Knochendichte des Patienten

Every once in a while the historical Vehicle Club of the
Costa del Sol organizes special old-timer excursions and
meetings. Recently, participants from Madrid, Granada,
Jaén, Córdoba, Sevilla, Cádiz, Ronda, Estepona, Marbella
and San Pedro de Alcántara came together to drive a 320
km route in their 39 brightly polished classic cars. Among
the cars were some Rolls-Royce models from the 1920s
as well as a Mercedes 340 (year of construction 1938).

institute held its team dinner at the Jaipur Restaurant Marbella, and surely everyone enjoyed the fine Indian

On 4 December, the Lions in Spain celebrated their 50th anniversary with a ceremonial act in the historical »El hospitalillo« following a
gala charity dinner. More than 120 guests gathered to congratulate the four Lions Clubs of Marbella, Puerto Banús, being Cosmopolite,
Lengua Alemana, Francófono and Decano. The perfect location for the fabulous dinner party was the »La Meridiana del Alabardero«
and, of course, donations were collected – this time in favour of the guide dogs. All in all
1,600 euros was raised and everyone enjoyed a night with lots of special moments.

On 29 November the Oscar Awards ceremony took
place in Olivia Valere's Restaurant "Babylonia". All
nominees joined with their friends to celebrate
this first Marbella "OSCAR AWARDS" event organised by Oscar Horacio. Among them were important business people who received an "OSCAR",

Ein orientalischer Traum mitten

The Alhambra, built on the Sabikah Hill in Granada,
is one of Europe's most visited monuments and was
declared a world heritage site in 1984. The fortress’s
name derives from the red colour of its walls. Its
spectacular Arabic buildings, reminiscent of the fairy
tales of 1001 Nights, have for many centuries fascinated locals and travellers alike.
Die auf dem Sabikah-Hügel in Granada gelegene
Alhambra zählt zu den meist besuchten Monumenten Europas und gehört seit 1984 zum Weltkulturerbe. Benannt wurde die Stadtburg nach der rötlichen
Farbe ihrer Mauer. Seit jeher beeindruckt sie Einheimische und Weitgereiste mit ihren spektakulären arabischen Bauwerken, die ein bisschen an die
Märchen von 1.001 Nacht erinnern.
Der älteste Teil der Alhambra besteht aus der
Alcazaba (Zitadelle) und den Roten Türmen (Torres
Bermejas). Die Gestaltung der heutigen Alcazaba ist
Mohammed I., dem damaligen Sultan von Granada,
zu verdanken. Er ummauerte die Burg und erweiterte
diese um drei neue Türme: den zerbrochenen Turm,
den Ehrenturm und den Wachturm. Dabei wurde
das ursprünglich als Festung genutzte Bauwerk erst
Jahre später von Mohammed als königlicher Sitz
bewohnt. Viele der Monarchen residierten im Comares-Palast mit Ausblick über das Darro-Tal. Dieser
Komplex besteht aus mehreren Gebäuden um den
Myrtenhof, der von verschiedenen Säulengängen

The oldest part of the Alhambra comprises the
Alcazaba (citadel) and the Vermillion Towers (Torres
Bermejas). The architect of today’s Alcazaba was
Mohammed I, then Sultan of Granada. He constructed
the ramparts around the castle and added three new
towers: the Broken Tower, the Keep and the Watch
Tower. The original building was used as a fortress
and only became Mohammed's royal residence many
years later. Many of the monarchs resided in the
Comares Palace overlooking the Darro Valley. This
complex comprises several buildings around the
Court of the Myrtles surrounded by various porticos.
The impressive design featuring intricate decorations
and innumerable inscriptions are truly amazing.
Below the walls of the fortress at the entrance to
the Alcazaba we find the magnificent gardens. This
is where probably the most spectacular view across
the mystical city in Southern Spain is offered. The
Western side of the gardens is bordered by a wall
stretching all the way to the Vermillion Towers. Many
kings used the Generalife as a place of recreation,
offering seclusion from palace life. The erstwhile
monarchs found relaxation in the simple atmosphere
with its calming view over the valleys of the rivers
Genil and Darro.
The Nasrid Castles, decorated with Arabic writings and ornaments, are part of the heart of the
Alhambra. The inside of the domes have so-called

Zum Herzstück der Alhambra gehören die mit
arabischen Schriften und Ornamenten verzierten
Nasridenpaläste. Die Innenseite der Kuppeln ist mit
den sogenannten spitzbogenartigen »Muqarnas«
gestaltet, die ein wenig an Tropfsteinhöhlen erinnern und die die Nischen und Wände miteinander

Special touristic highlight: the Court of the Lions
with its twelve stone lions carrying a fountain. The
Granada born poet Ibn Zamrak decorated the edge of
the fountain with the words: “Blessed are the eyes
beholding this garden of beauty.”
And if you want to see even more, you can venture a little further. Here rises the imposing Palacio
de Carlos V, constructed over 30 years and built
directly adjoining the Alhambra on request of the
Emperor. The courtyard with its Spanish Renaissance
design is particularly impressive.
This way or that, Granada is absolutely worth
a visit. And even though the Alhambra is not one of
the Seven Wonders of the World, it remains one of
Europe's most beautiful places of interest.

So oder so ist Granada immer einen Ausflug
wert. Und selbst wenn die Alhambra nicht zu den
sieben Weltwundern zählt, so ist sie doch eine der
schönsten Sehenswürdigkeiten Europas.

anlehnt, bereitet er alles stets frisch zu und kombiniert es mit original indischen, natürlich selbstgemahlenen Gewürzen und Kräutern. »Unsere Küche
hat von ganz mild bis sehr scharf für alle Geschmäcker etwas zu bieten«, gerät der feine Gastgeber ins
Schwärmen. Dass sein Essen sehr gut ankommt,
beweist seine jüngste Tripadvisor-Auszeichnung, die
ihm vom Bürgermeister der Stadt Marbella bereits
zum 2. Mal verliehen wurde. Welche Eigenschaften
ihm geholfen haben, so erfolgreich zu sein? »Seit
über 25 Jahre tue ich nichts anderes als indisch zu
kochen. Eine Zeit lang habe ich viele Kochkurse in
Deutschland gegeben und ich habe eine sehr gute
Ausbildung in Indien genossen. Das hat mich sehr
geprägt. Darüber hinaus kaufe ich nur qualitativ
hochwertige Nahrungsmittel ein, aber in Marbella
ist dies problemlos möglich.«
Wie er dazu kam, in Marbella ein indisches
Restaurant aufzumachen? »Mir hat vor allem für
meine Kinder das Klima und die Gastfreundlichkeit
gefallen. Die Bewohner sind bunt gemischt und sehr
weltoffen, ein guter Ort, um kleine Kinder aufwachsen zu lassen.« Dass Virender Thakur es schafft, den

mild to very spicy”, says the fine host enthusiastically.
The fact that his food is well received was illustrated
by his latest Tripadvisor award, bestowed upon him for
the second time by the Mayor of the city of Marbella.
So what characteristics have helped him to be so successful? “For more than 25 years I have done nothing
but cook Indian food. For a time I ran a large number of
cookery courses in Germany, and I enjoyed a very good
training in India. That greatly influenced me.” How did
he come to open an Indian restaurant in Marbella? “I
liked the climate and the hospitality, especially for my
children. There is a real mix of inhabitants and they are
very cosmopolitan, so it is a good place for bringing up
children.” The fact that Virender Thakur manages to run
his restaurant business perfectly while at the same time
raising his children to be multilingual and in an exemplary way is an amazing achievement.

ist doch sein Restaurant Jaipur zu einer begehrten
Adresse für Feinschmecker avanciert, die gesunde
und frische Zutaten zu schätzen wissen – und sein
Wissen auf liebevolle Weise natürlich auch an seine
Kinder weitergeben.

esto no se encontrase dispuesto en
ningún testamento…

A partir del 17/8/2015 esto va a cambiar, porque
entra en vigor el nuevo Reglamento de la Unión Europea
número 650/2012 sobre la competencia, la ley aplicable,
el reconocimiento y la ejecución de las resoluciones, la
aceptación y la ejecución de los documentos públicos en
materia de sucesiones mortis causa y la creación de un
certificado sucesorio europeo.
A partir de la fecha mencionada se aplicará el
Derecho español y en su caso el Derecho foral para determinar quién es sucesor, si el causante mantenía su residencia habitual en España.
Por este motivo es necesario asesorar con el tiempo
suficiente sobre cuáles son las normas de aplicación en
materia de sucesiones en caso de que no se haya otorgado testamento. En la preparación de los testamentos
de residentes extranjeros, debería tenerse en cuenta las
especialidades del derecho español.
En el reglamento se determina un único derecho aplicable a toda la herencia, independiente del patrimonio y
del lugar en el que se encuentra. Por tanto, El reglamento
lo que intenta es fijar un principio de unidad.
No obstante, habrá que estar atento en algunos casos en los que el testamento que no haya sido

Aufenthaltsort des Erblassers ist. Aus diesem Grund
sollte dieser Personenkreis rechtzeitig darüber beraten
werden, welche gesetzlichen Regelungen der Erbfolge
im Einzelfall zur Anwendung kommen, sofern kein Testament vorhanden ist. Bei einer Testamentserstellung unter
ausländischen Staatsangehörigen sollten die Besonderheiten spanischen Rechts beachtet werden.
In der ErbRVO wird ein einziges, auf die Gesamtheit
des Nachlasses anwendbares Recht festgelegt (Einheitsprinzip), unabhängig von der Art und Beschaffenheit des
Vermögens und des Ortes, wo sich dieses befindet. Dennoch wird man in den Fällen achtgeben müssen, in denen
das nicht in Spanien erstellte Testament dem spanischen
Recht unbekannte Möglichkeiten der Ausgestaltung der

otorgado en España contemple posibilidades que en
España nuestro derecho no conozca. Por ejemplo en países como Alemania, se dá mucho la figura de la sucesión
fideicomisaria, que nuestro derecho no contempla y crea
dificultades de interpretación en numerosos casos en la
inscripción. Tampoco existe en el Derecho español el testamento conjunto del matrimonio con efectos vinculantes.
Es cierto que el conocido en Alemania como "Berliner
Testament" es de aplicación total en España, pero en la
práctica surgen al menos hasta ahora, algunos problemas
para aplicar estas figuras jurídicas, salvo que los notarios
y registradores intervinientes, tengan alguna experiencia
con ellas. Otro problema importante del sistema jurídico
español es su complejidad, dado que en un solo estado
nos encontramos con distintas legislaciones autonómicas. Para evitar este problema el reglamento establece
que los estados en los que haya distintas normativas,
se establezca cuál es la aplicable de conformidad con su
legislación interna. No obstante, nos encontramos que
en España existe una laguna legal, dado que no encontramos una norma que solucione el caso del conflicto
normativo.
El conflicto entre normas se regula en el artículo
16 del Código civil. De acuerdo con este no es la nacionalidad, sino el lugar en el que se reside, la condición
determinante. En caso de extranjeros resulta un problema
claro. La legislación no contempla en la antigua regulación, aún vigente, la residencia habitual. De acuerdo con el
artículo 12 del Código civil la calificación para determinar
la norma de conflicto aplicable será siempre con arreglo
a la Ley española y continua diciendo que cuando una
norma de conflicto remita a la legislación de un estado en
el que coexistan diferentes sistemas legislativos, la determinación del que sea aplicable entre ellos, se hará conforme a la legislación de dicho estado. Por este motivo se
ha indicado desde la Unión Europea al legislador español
la necesidad de promulgar una ley que ofrezca una solución a esta situación.
El artículo 36 del reglamento remite a las

Staaten mit verschiedenen Rechtsordnungen das Gesetz
in Konformität mit seinen internen Normen angewendet
wird. Allerdings gibt es in Spanien eine Gesetzeslücke,
denn es ist kein selbstständiges gesetzliches System der
internen Konfliktlösung vorgesehen. Dieser beschriebene

legislaciones internas de cada estado, aunque menciona
como se debe actuar en los casos de lagunas o conflictos.
Puede ocurrir, por ejemplo que la residencia habitual en el
momento de la muerte o la norma de unidad de territorio,
al que el causante se encontraba más sujeto, determinen
la norma a aplicar.
Para los numerosos extranjeros que viven actualmente en España, este reglamento es de gran importancia y
habría que determinar qué entendemos por residencia
habitual. Desde el punto de vista español la residencia
habitual se aplicaría a las personas que conocemos como
residentes en España a efectos fiscales. Esto es a aquellas personas que viven más de 183 días al año en España, de acuerdo con el artículo 8 de la Ley del Impuesto
sobre la Renta de las Personas físicas. Las diferencias de
la nueva situación para un ciudadano extranjero pueden
ofrecer nuevas posibilidades, pero también problemas.
Los problemas vendrán probablemente en el caso de la
aplicación de derechos forales que de acuerdo con al artículo 38 del reglamento sigue siendo aplicable. De esta
manera las viudas que residan en Navarra heredarán el
usufructo legal de fidelidad. Esto significa que a la viuda
sólo le quedará el usufructo, y ello en el caso de que no
vuelva a contraer matrimonio. En caso de que algún extranjero quiere evitar esta situación, si vive en Navarra,
debe otorgar un testamento ante notario de acuerdo con
las leyes de su país de origen.

Konflikt wird gemäß Art. 16 Código Civil gelöst; danach
ist nicht die Staatsangehörigkeit, sondern die zivilrechtliche Gebietszugehörigkeit maßgebend. Für Ausländer
stellt dies ein Problem dar, da sie in der Regel keine zivilrechtliche Gebietszugehörigkeit aufweisen. Gemäß Art.
12 CC wird die Anwendung der Bestimmungen hinsichtlich der Zuordnung, der Weiterleitung und der Ausnahmeregelung der öffentlichen Ordnung ausgeschlossen.
Aus diesem Grund wurde der spanische Gesetzgeber auf
die Notwendigkeit hingewiesen, ein Gesetz zu erlassen,
das für diese Situation eine Lösung bietet.
Der Art. 36 ErbRVO verweist auf die internen Richtlinien des Staates, zeigt jedoch an, wie in Ermangelung
solcher Richtlinien zur Bestimmung des anwendbaren
Rechts vorzugehen ist. Es kann z.B. der reguläre Wohnsitz zum Zeitpunkt des Ablebens oder die Gebietseinheit,
zu der der Verstorbene die engste Beziehung pflegte, den
Ausschlag geben. Für alle zurzeit in Spanien lebenden
Ausländer ist diese Verordnung von großer Bedeutung,
denn fraglich ist, was für sie unter dem »gewöhnlichen
Aufenthalt« zu verstehen ist. Aus spanischer Sicht würde
man darunter einen regulären Wohnsitz verstehen, wenn
die Person einen längeren Zeitraum als »residente« in
Spanien steuerpflichtig ist. Dies ist bei einem durchgehenden Aufenthalt in Spanien von mindestens 183 Tagen
im Jahr der Fall (Art. 8 und 9 Abs. 1 span EStG – Ley del
impuesto sobre la Renta de las Personas Físicas – LIRPF).
Die Unterschiede des Erbstatuts in anderen Ländern
und in Spanien können für einen deutschen Staatsbürger sowohl Chancen bieten als auch Probleme mit sich
bringen. Probleme entstehen vor allem dann, wenn
Foralrechte zur Anwendung kommen, was gem. Art. 38
ErbRVO auch weiterhin möglich ist. So gilt für Witwen
in Navarra das »mittelalterliche« Nießbrauchsrecht der
Treue. Dies bedeutet, dass der Witwe nur ein Nießbrauch zusteht, wenn sie sich nicht wieder verheiratet.
Will eine deutsche Staatsbürgerin dem vorbeugen, sollte
sie ein notarielles Testament unter Anwendung deutschen Rechts abfassen.

aspects are heeded
in terms of the driver
(driver 1), you may be
better off leaving it at
home! Swing the driver
with no more than 80%
power (as with a normal iron 7) and take the
time to carefully prepare (see photo). This is what counts:
- stand with your feet shoulder-width apart - body weight
(more to the right) - ball position (opposite your left side
chest) - step up higher - full finish - back swing (low &
slow). Note the rule of thumb: The less power you use,
the further the ball will travel! Good luck in practising!
